66.1 [Machine] Ordering Testimony in English
٦٦۔١ بَابُ الْأَمْرِ بِالْإِشْهَادِ
[Machine] God, whose praise is exalted, said: "{And bring to witness when you make a commercial contract.}" [Al-Baqarah: 282]. Al-Shafi'i, may God have mercy on him, said: "It seems, and God knows best, and I ask Him for success, that His command to bring witnesses at the time of sale indicates what is in the interest of having witnesses, not as an obligation. He based this on God's saying in the verse about debt, and debt is a form of transaction: '{So write it down}' [Al-Baqarah: 282]. Then He said: '{And if you are on a journey and cannot find a scribe, then a security deposit should be taken. And if one of you entrusts another, let the trustee fulfill his trust.}' [Al-Baqarah: 283]. When God commanded that if you cannot find a scribe, take a security deposit, and then allowed abandoning the security, it indicates that the initial command was guidance for the benefit, not an obligatory act whose omission would be sinful, and God knows best."
قَالَ اللهُ جَلَّ ثَنَاؤُهُ {وَأَشْهِدُوا إِذَا تَبَايَعْتُمْ} [البقرة: 282] , قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: " الَّذِي يُشْبِهُ , وَاللهُ أَعْلَمُ , وَإِيَّاهُ أَسْأَلُ التَّوْفِيقَ , أَنْ يَكُونَ أَمْرُهُ بِالْإِشْهَادِ عِنْدَ الْبَيْعِ دَلَالَةً عَلَى مَا فِيهِ الْحَظُّ بِالشَّهَادَةِ , لَا حَتْمًا , وَاحْتَجَّ بِقَوْلِهِ تَعَالَى فِي آيَةِ الدَّيْنِ , وَالدَّيْنُ تَبَايُعٌ: {فَاكْتُبُوهُ} [البقرة: 282] , ثُمَّ قَالَ: {وَإِنْ كُنْتُمْ عَلَى سَفَرٍ وَلَمْ تَجِدُوا كَاتِبًا فَرِهَانٌ مَقْبُوضَةٌ فَإِنْ أَمِنَ بَعْضُكُمْ بَعْضًا فَلْيُؤَدِّ الَّذِي اؤْتُمِنَ أَمَانَتَهُ} [البقرة: 283] , فَلَمَّا أَمَرَ إِذَا لَمْ يَجِدُوا كَاتِبًا بِالرَّهْنِ ثُمَّ أَبَاحَ تَرْكَ الرَّهْنِ دَلَّ عَلَى أَنَّ الْأَمْرَ الْأَوَّلَ دَلَالَةٌ عَلَى الْحَظِّ , لَا فَرْضًا مِنْهُ , يَعْصِي مَنْ تَرَكَهُ , وَاللهُ أَعْلَمُ.
