49. Chapter (4/8)
٤٩۔ كِتَابُ النَّفَقَاتِ ص ٤
I was one of the Naqibs who gave the ('Aqaba) Pledge of Allegiance to Messenger of Allah ﷺ . We gave the pledge of allegiance to him that we would not worship anything other than Allah, would not steal, would not commit illegal sexual intercourse, would not kill a person whose killing Allah has made illegal except rightfully, would not rob each other, and we would not be promised Paradise jf we did the above sins, then if we committed one of the above sins, Allah will give His Judgment concerning it. أَنَّهُ قَالَ إِنِّي مِنَ النُّقَبَاءِ الَّذِينَ بَايَعُوا رَسُولَ اللهِ ﷺ وَقَالَ بَايَعْنَاهُ عَلَى أَنْ لَا نُشْرِكَ بِاللهِ شَيْئًا وَلَا نَزْنِيَ وَلَا نَسْرِقَ وَلَا نَقْتُلَ النَّفْسَ الَّتِي حَرَّمَ اللهُ إِلَّا بِالْحَقِّ وَلَا نَنْتَهِبَ وَلَا نَعْصِيَ؛ فَالْجَنَّةُ إِنْ فَعَلْنَا ذَلِكَ فَإِنْ غَشِينَا مِنْ ذَلِكَ شَئْئًا فَإِنَّ قَضَاءَ ذَلِكَ إِلَى اللهِ ﷻ
[Machine] On the authority of the Prophet ﷺ , he said: "The greatest of the major sins are associating partners with Allah, killing a soul, disobedience to parents, and bearing false witness or testimony."
عَنِ النَّبِيِّ ﷺ قَالَ أَكْبَرُ الْكَبَائِرِ الْإِشْرَاكُ بِاللهِ وَقَتْلُ النَّفْسِ وَعُقُوقُ الْوَالِدَيْنِ وَقَوْلُ الزُّورِ أَوْ قَالَ شَهَادَةُ الزُّورِ
The Messenger of Allah ﷺ as saying: Refrain from seven (characteristics) which cause destruction. He was asked: What are they, Messenger of Allah ? He replied: To assign partner to Allah, magic, to kill a soul (man) which is prohibited by Allah except for which is due, to take usury, to consume the property of an orphan, to retreat on the day of the battle, and to slander chaste women, indiscreet but believing. Abu Dawud said: The name Abu al-Ghaith is Salim client of Ibn Muti'. (Using translation from Abū Dāʾūd 2874)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ اجْتَنِبُوا السَّبْعَ الْمُوبِقَاتِ قِيلَ يَا رَسُولَ اللهِ وَمَا هُنَّ؟ قَالَ الشِّرْكُ بِاللهِ وَالسِّحْرُ وَقَتْلُ النَّفْسِ الَّتِي حَرَّمَ اللهُ إِلَّا بِالْحَقِّ وَأَكْلُ الرِّبَا وَأَكْلُ مَالِ الْيَتِيمِ وَالتَّوَلِّي يَوْمَ الزَّحْفِ وَقَذْفُ الْمُحْصَنَاتِ الْغَافِلَاتِ
[Machine] Mansur, Zubayd, and Sulaiman informed me that they heard Abu Wael narrating from Abdullah, who said that the Messenger of Allah ﷺ said, "Insulting a Muslim is wickedness, and fighting him is disbelief." Zubayd said, "So I said to Abu Wael, 'Did you hear this from Abdullah from the Prophet ﷺ ?' He replied, 'Yes.'" And Ahmad ibn Ubaid narrated to us, from Abu Muslim, from Sulaiman ibn Harb, from Shu'bah, from Mansur, who said, "I heard Abu Wael narrating from Abdullah, from the Prophet ﷺ , something similar to this."
مَنْصُورٌ وَزُبَيْدٌ وَسُلَيْمَانُ أَخْبَرُونِي أَنَّهُمْ سَمِعُوا أَبَا وَائِلٍ يُحَدِّثُ عَنْ عَبْدِ اللهِ قَالَ قَالَ رَسُولُ اللهِ ﷺ سِبَابُ الْمُسْلِمِ فُسُوقٌ وَقِتَالُهُ كُفْرٌ قَالَ زُبَيْدٌ فَقُلْتُ لِأَبِي وَائِلٍ سَمِعْتَهُ مِنْ عَبْدِ اللهِ عَنِ النَّبِيِّ ﷺ؟ قَالَ نَعَمْ 15853 قَالَ وَأَخْبَرَنَا أَحْمَدُ بْنُ عُبَيْدٍ ثنا أَبُو مُسْلِمٍ ثنا سُلَيْمَانُ بْنُ حَرْبٍ ثنا شُعْبَةُ عَنْ مَنْصُورٍ قَالَ سَمِعْتُ أَبَا وَائِلٍ يُحَدِّثُ عَنْ عَبْدِ اللهِ عَنِ النَّبِيِّ ﷺ مِثْلَهُ
[Machine] "Those who do not judge by what Allah has revealed, they are the disbelievers." [Al-Ma'idah 44] It is a disbelief aside from disbelief.
عَنْ مِلَّةٍ {وَمَنْ لَمْ يَحْكُمْ بِمَا أَنْزَلَ اللهُ فَأُولَئِكَ هُمُ الْكَافِرُونَ} [المائدة 44] كُفْرٌ دُونَ كُفْرٍ
[Machine] Regarding the following passage:
"From the Prophet ﷺ who said, 'Whoever carries a weapon against us is not one of us.' And Ahmad narrated to us, Abu Usama narrated to us, from Ubaidullah, from Nafi', from Ibn Umar, from the Prophet ﷺ said something similar. They both agreed on the narration of Abu Musa from Abu Kurayb from Abu Usama. And Muslim narrated the hadith of Ibn Umar from Abu Bakr bin Abi Shaybah from Abu Usama."
عَنِ النَّبِيِّ ﷺ قَالَ مَنْ حَمَلَ السِّلَاحَ عَلَيْنَا فَلَيْسَ مِنَّا قَالَ وَثَنَا أَحْمَدُ ثنا أَبُو أُسَامَةَ عَنْ عُبَيْدِ اللهِ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ عَنِ النَّبِيِّ ﷺ مِثْلَ هَذَا الْقَوْلِ اتَّفَقَا عَلَى إِخْرَاجِ حَدِيثِ أَبِي مُوسَى عَنْ أَبِي كُرَيْبٍ عَنْ أَبِي أُسَامَةَ وَأَخْرَجَ مُسْلِمٌ حَدِيثَ ابْنِ عُمَرَ عَنْ أَبِي بَكْرِ بْنِ أَبِي شَيْبَةَ عَنْ أَبِي أُسَامَةَ
[Machine] From Mujahid in the statement of the Messenger of Allah ﷺ: "You are not one of us" does not mean that you are not from the people of Islam, but it means that you are not like us.
عَنْ مُجَاهِدٍ فِي قَوْلِ رَسُولِ اللهِ ﷺ لَسْتَ مِنَّا لَيْسَ يَعْنِي أَنَّكَ لَسْتَ مِنْ أَهْلِ الْإِسْلَامِ وَلَكِنْ يَعْنِي أَنَّكَ لَسْتَ مِثْلَنَا
Messenger of Allah ﷺ said, "A faithful believer remains at liberty regarding his religion unless he kills somebody unlawfully." (Using translation from Bukhārī 6862)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا يَزَالُ الْمَرْءُ فِي فُسْحَةٍ مِنْ دِينِهِ مَا دَامَ لَمْ يُصِبْ دَمًا حَرَامًا
[Machine] The Prophet ﷺ said, "A person will remain in a state of righteousness as long as they do not shed forbidden blood."
قَالَ النَّبِيُّ ﷺ لَا يَزَالُ الْمَرْءُ فِي فُسْحَةٍ مِنْ دِينِهِ مَا لَمْ يُصِبْ دَمًا حَرَامًا
One of the evil deeds with bad consequence from which there is no escape for the one who is involved in it is to kill someone unlawfully. (Using translation from Bukhārī 6863)
إِنَّ مِنْ وَرَطَاتِ الْأُمُورِ الَّتِي لَا مَخْرَجَ لِمَنْ أَوْقَعَ نَفْسَهُ فِيهَا سَفْكُ الدَّمِ الْحَرَامِ بِغَيْرِ حِلِّهِ
[Machine] The Prophet of Allah ﷺ said, "The first thing to be settled among people on the Day of Resurrection is the matter of blood."
قَالَ رَسُولُ اللهِ ﷺ أَوَّلُ مَا يُقْضَى بَيْنَ النَّاسِ فِي الدِّمَاءِ يَعْنِي يَوْمَ الْقِيَامَةِ
[Machine] I heard the Messenger of Allah ﷺ saying, "Every sin may be forgiven by Allah except for the one who dies as a polytheist or intentionally kills a believer." He said, "Charity." Khalid said, "Haneef ibn Kulthum ibn Kinnan al-Kinanee said, I heard Mahmoud ibn Rabee saying that he heard Ubada ibn As-Samit narrating from the Messenger of Allah ﷺ that he said, 'Whoever kills a believer and then rejoices in his killing, will never be accepted from him any compensation or justice.'"
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ كُلُّ ذَنْبٍ عَسَى اللهُ أَنْ يَغْفِرَهُ إِلَّا مَنْ مَاتَ مُشْرِكًا أَوْ قَتَلَ مُؤْمِنًا مُتَعَمِّدًا قَالَ صَدَقَةُ قَالَ خَالِدٌ فَقَالَ هَانِئُ بْنُ كُلْثُومِ بْنِ كِنَانِ الْكِنَانِيُّ سَمِعْتُ مَحْمُودَ بْنَ رَبِيعٍ يُحَدِّثُ أَنَّهُ سَمِعَ عُبَادَةَ بْنَ الصَّامِتِ يُحَدِّثُ عَنْ رَسُولِ اللهِ ﷺ قَالَ مَنْ قَتَلَ مُؤْمِنًا ثُمَّ اغْتَبَطَ بِقَتْلِهِ لَمْ يُقْبَلْ مِنْهُ صَرْفٌ وَلَا عَدْلٌ
[Machine] Narrated by Prophet Muhammad ﷺ , Haneeth bin Kulthoom, Mahmoud bin Rabee, and Ubada, the Prophet ﷺ said, "A believer remains righteous as long as he does not shed unlawful blood." Khalid asked Yahya Al-Ghassani about his feelings regarding killing, to which Yahya replied, "They are the ones who kill during times of turmoil, and they kill one of their own, believing that they are upon the right path without seeking forgiveness from Allah ever." And Abu Ali Al-Roudhbari informed us that Abu Bakr bin Dasa narrated to us, who was informed by Abu Dawood, who was informed by Mu'ammal bin Al-Fadl Al-Harani, who was informed by Muhammad bin Shuaib, who was informed by Khalid bin Dahqan. Khalid mentioned the three hadiths, except that he said in the third hadith, "A believer remains virtuous as long as he does not shed unlawful blood. But if he sheds unlawful blood, he becomes a rebellious disbeliever." And he did not mention the interpretation of Al-Ghassani.
عَنِ النَّبِيِّ ﷺ وَحَدَّثَ هَانِئُ بْنُ كُلْثُومٍ عَنْ مَحْمُودِ بْنِ الرَّبِيعِ عَنْ عُبَادَةَ عَنِ النَّبِيِّ ﷺ قَالَ لَا يَزَالُ الْمُؤْمِنُ صَالِحًا مَا لَمْ يُصِبْ دَمًا قَالَ قَالَ خَالِدٌ سَأَلْتُ يَحْيَى الْغَسَّانِيَّ عَنِ اغْتِبَاطِهِ بِقَتْلِهِ قَالَ هُمُ الَّذِي يَقْتُلُونَ فِي الْفِتْنَةِ فَيَقْتُلُ أَحَدُهُمْ فَيَرَى أَنَّهُ عَلَى هُدًى لَا يَسْتَغْفِرُ اللهَ مِنْهُ أَبَدًا 15862 وَأَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنبأ أَبُو بَكْرِ بْنُ دَاسَةَ ثنا أَبُو دَاوُدَ ثنا مُؤَمَّلُ بْنُ الْفَضْلِ الْحَرَّانِيُّ ثنا مُحَمَّدُ بْنُ شُعَيْبٍ عَنْ خَالِدِ بْنِ دِهْقَانَ فَذَكَرَ الْأَحَادِيثَ الثَّلَاثَةَ إِلَّا أَنَّهُ قَالَ فِي الْحَدِيثِ الثَّالِثِ لَا يَزَالُ الْمُؤْمِنُ مُعْنِقًا صَالِحًا مَا لَمْ يُصِبْ دَمًا حَرَامًا فَإِذَا أَصَابَ دَمًا حَرَامًا بَلَّحَ وَلَمْ يَذْكُرْ تَفْسِيرَ الْغَسَّانِيِّ
[Machine] The Messenger of Allah ﷺ said: "Verily, Allah has forbidden me from pardoning the one who kills a believer." He repeated this statement three times.
قَالَ رَسُولُ اللهِ ﷺ إِنَّ اللهَ ﷻ أَبَى عَلَيَّ لِمَنْ قَتَلَ مُؤْمِنًا قَالَهَا ثَلَاثًا
[Machine] It is narrated that a person was killed during the time of the Messenger of Allah ﷺ, and no one knows who killed him. The Prophet ﷺ said, "A person is killed, and I am among you, and no one knows who killed him. If the people of the heavens and the people of the earth were to join together in killing a believer, Allah would punish them, except if He did not will it." This is the wording of Al-Malini's hadith, and the hadith of Abu Abdullah is summarized: "If the people of the heavens and the people of the earth were to gather together to kill a believer, Allah would punish them."
أَنَّ قَتِيلًا قُتِلَ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ لَا يُدْرَى مَنْ قَتَلَهُ فَقَالَ النَّبِيُّ ﷺ يُقْتَلُ قَتِيلٌ وَأَنَا فِيكُمْ لَا يُدْرَى مَنْ قَتَلَهُ لَوْ أَنَّ أَهْلَ السَّمَاءِ وَأَهْلَ الْأَرْضِ اشْتَرَكُوا فِي قَتْلِ مُؤْمِنٍ لَعَذَّبَهُمُ اللهُ إِلَّا أَنْ لَا يَشَاءَ ذَلِكَ لَفْظُ حَدِيثِ الْمَالِينِيِّ وَحَدِيثُ أَبِي عَبْدِ اللهِ مُخْتَصَرٌ لَوِ اجْتَمَعَ أَهْلُ السَّمَاءِ وَأَهْلُ الْأَرْضِ عَلَى قَتْلِ امْرِئٍ مُؤْمِنٍ لَعَذَّبَهُمُ اللهُ
[Machine] The Messenger of Allah ﷺ said, "Whoever helps in the killing of a Muslim with even half a word, he will meet Allah on the Day of Resurrection with 'Hopeless' written on his forehead." Ibn Ahmad Ibn Abdan reported to us, reporting from Ahmed Ibn Ubaid, reporting from Ya'qub Ibn Ishaq Al Muaddib, reporting from Yahya Ibn Ayoub, reporting from Marwan Ibn Muawiyah, reporting from Yazid Ibn Ziyad Al Shami, who mentioned it with its chain of narration similar to this, except that he said, "On the day he meets him..."
قَالَ رَسُولُ اللهِ ﷺ مَنْ أَعَانَ عَلَى قَتْلِ مُسْلِمٍ بِشَطْرِ كَلِمَةٍ لَقِيَ اللهَ يَوْمَ الْقِيَامَةِ مَكْتُوبٌ عَلَى جَبْهَتِهِ آيِسٌ مِنْ رَحْمَةِ اللهِ 15866 وَأَخْبَرَنَا عَلِيُّ بْنُ أَحْمَدَ بْنِ عَبْدَانَ أنبأ أَحْمَدُ بْنُ عُبَيْدٍ ثنا يَعْقُوبُ بْنُ إِسْحَاقَ الْمُؤَدِّبُ ثنا يَحْيَى بْنُ أَيُّوبَ ثنا مَرْوَانُ بْنُ مُعَاوِيَةَ ثنا يَزِيدُ بْنُ زِيَادٍ الشَّامِيُّ فَذَكَرَهُ بِإِسْنَادِهِ مِثْلَهُ إِلَّا أَنَّهُ قَالَ يَوْمَ يَلْقَاهُ
[Machine] Narrated by the Prophet ﷺ , "By Allah, the world and everything in it is more insignificant to Allah than the wrongful killing of a believer. This is attributed to Yazid ibn Ziyad (or Ibn Abi Ziyad) Al-Shami, who is known for fabricating hadith. However, the first part of the narration has been reported from another perspective, attributed to Al-Zuhri, through a reliable chain of narrators."
عَنِ النَّبِيِّ ﷺ قَالَ وَاللهِ لَلدُّنْيَا وَمَا فِيهَا أَهْوَنُ عَلَى اللهِ مِنْ قَتْلِ مُؤْمِنٍ بِغَيْرِ حَقٍّ يَزِيدُ بْنُ زِيَادٍ وَقِيلَ ابْنُ أَبِي زِيَادٍ الشَّامِيُّ مُنْكَرُ الْحَدِيثِ وَقَدْ رُوِيَ الْمَتْنُ الْأَوَّلُ مِنْ وَجْهٍ آخَرَ عَنِ الزُّهْرِيِّ مُرْسَلًا
“Whoever helps to kill a believer, even with half a world, he will meet Allah (SWT) with (the words) written between his eyes, 'He has no hope of the mercy of Allah (SWT).” (Using translation from Ibn Mājah 2620)
مَنْ أَعَانَ عَلَى قَتْلِ مُؤْمِنٍ بِشَطْرِ كَلِمَةٍ لَقِيَ اللهَ ﷻ يَوْمَ الْقِيَامَةِ مَكْتُوبٌ بَيْنَ عَيْنَيْهِ آيِسٌ مِنْ رَحْمَةِ اللهِ
"Killing a believer is more grievous before Allah than the extinction of the whole world." (Using translation from Nasāʾī 3988)
لَقَتْلُ الْمُؤْمِنِ أَعْظَمُ عِنْدَ اللهِ مِنْ زَوَالِ الدُّنْيَا هَذَا هُوَ الْمَحْفُوظُ مَوْقُوفٌ
[Machine] The Messenger of Allah ﷺ said: "The disappearance of the world is easier for Allah than the killing of a Muslim." This hadith is also narrated by Ibn Abi Adi from Shu'bah in a marfu' form, and it is also narrated by Ghandar and others from Shu'bah in a mawquf form, and the mawquf form is more accurate.
قَالَ رَسُولُ اللهِ ﷺ لَزَوَالُ الدُّنْيَا أَهْوَنُ عَلَى اللهِ مِنْ قَتْلِ مُسْلِمٍ وَرَوَاهُ أَيْضًا ابْنُ أَبِي عَدِيٍّ عَنْ شُعْبَةَ مَرْفُوعًا وَرَوَاهُ غُنْدَرٌ وَغَيْرُهُ عَنْ شُعْبَةَ مَوْقُوفًا وَالْمَوْقُوفُ أَصَحُّ
49.36 [Machine] Do not point a weapon at someone who does not deserve to be killed, and whoever passes in a mosque or market with noble demeanor should hold its hilt.
٤٩۔٣٦ بَابُ لَا يُشِيرُ بِالسِّلَاحِ إِلَى مَنْ لَا يَسْتَحِقُّ الْقَتْلَ، وَمَنْ مَرَّ فِي مَسْجِدٍ أَوْ سُوقٍ بِنَبْلٍ أَمْسَكَ بِنِصَالِهَا
[Machine] The Messenger of Allah ﷺ said: "Verily, the angels curse one of you if he points with a metal object, even if it is to his brother from his father and mother."
قَالَ رَسُولُ اللهِ ﷺ إِنَّ الْمَلَائِكَةَ تَلْعَنُ أَحَدَكُمْ إِذَا أَشَارَ بِحَدِيدَةٍ وَإِنْ كَانَ أَخَاهُ لِأَبِيهِ وَأُمِّهِ
[Machine] "And the Messenger of Allah ﷺ said: 'One of you should not point his brother with a weapon because one of you does not know, perhaps the devil may cause it to slip from his hand and fall into a pit of fire.'"
وَقَالَ رَسُولُ اللهِ ﷺ لَا يُشِيرُ أَحَدُكُمْ إِلَى أَخِيهِ بِالسِّلَاحِ فَإِنَّهُ لَا يَدْرِي أَحَدُكُمْ لَعَلَّ الشَّيْطَانَ أَنْ يَنْزِعَ فِي يَدِهِ فَيَقَعَ فِي حُفْرَةٍ مِنَ النَّارِ
[Machine] "On the authority of the Prophet, ﷺ , he said: 'When one of you passes through our mosque or market with a whip, let him hold on to its end so as not to harm any of the Muslims.'"
عَنِ النَّبِيِّ ﷺ قَالَ إِذَا مَرَّ أَحَدُكُمْ فِي مَسْجِدِنَا أَوْ سُوقِنَا بِنَبْلٍ فَلْيُمْسِكْ عَلَى نِصَالِهَا لَا يُصِيبُ أَحَدًا مِنَ الْمُسْلِمِينَ بِأَذًى
[Machine] That a man passed by in the mosque with his arrows showing their tips, and he was ordered to take hold of his arrows so as not to harm a Muslim.
أَنَّ رَجُلًا مَرَّ فِي الْمَسْجِدِ بِأَسْهُمٍ قَدْ بَدَا نُصُولُهَا فَأُمِرَ أَنْ يَأْخُذَ بِنُصُولِهَا لَا تَخْدِشُ مُسْلِمًا
[Machine] Did the Messenger of Allah ﷺ hold onto its hilt? He said, "Yes."
لَهُ رَسُولُ اللهِ ﷺ أَمْسِكْ بِنِصَالِهَا ؟ قَالَ نَعَمْ
49.37 [Machine] Condemnation of Suicide
٤٩۔٣٧ بَابُ التَّغْلِيظِ عَلَى مَنْ قَتَلَ نَفْسَهُ
[Machine] About the Prophet ﷺ said, "Whoever takes an oath on anything other than Islam while lying, then he is as he said. And whoever kills himself with something, he will be punished with it on the Day of Resurrection. And whoever throws a believer with disbelief, then he is as if he killed him, and the curse of the believer is like killing him."
عَنِ النَّبِيِّ ﷺ قَالَ مَنْ حَلَفَ بِمِلَّةٍ سِوَى الْإِسْلَامِ كَاذِبًا فَهُوَ كَمَا قَالَ وَمَنْ قَتَلَ نَفْسَهُ بِشَيْءٍ عُذِّبَ بِهِ يَوْمَ الْقِيَامَةِ وَمَنْ رَمَى مُؤْمِنًا بِكُفْرٍ فَهُوَ كَقَتْلِهِ وَلَعْنُ الْمُؤْمِنِ كَقَتْلِهِ
[Machine] The Messenger of Allah ﷺ said, "Whoever kills himself with a piece of iron, that iron will be in his hand and he will continuously stab himself in the stomach with it in the Hellfire, forever. And whoever kills himself with poison, that poison will be in his hand and he will continuously consume it in the Hellfire, forever. And whoever throws himself from a mountain, he will continuously fall in the Hellfire, forever. Abu Salih ibn Abi Tahir al-Anbari narrated to us, who informed us that Yahya ibn Mansur al-Qadi narrated to us, who in turn informed us that Ahmed ibn Salamah narrated to us, who narrated from Is'haq ibn Ibrahim, who reported from Jareer al-A'mash, who mentioned it in his chain of narration. The meaning of it is that whoever throws himself from a mountain and kills himself..." (and the rest of the passage is missing).
قَالَ رَسُولُ اللهِ ﷺ مَنْ قَتَلَ نَفْسَهُ بِحَدِيدَةٍ فَحَدِيدَتُهُ فِي يَدِهِ يَتَوَجَّأُ بِهَا فِي بَطْنِهِ فِي نَارِ جَهَنَّمَ خَالِدًا مُخَلَّدًا فِيهَا أَبَدًا وَمَنْ قَتَلَ نَفْسَهُ بِسُمٍّ فَسُمُّهُ فِي يَدِهِ فِي جَهَنَّمَ يَتَحَسَّاهُ فِي نَارِ جَهَنَّمَ خَالِدًا مُخَلَّدًا وَمَنْ تَرَدَّى مِنْ جَبَلٍ فَهُوَ يَتَرَدَّى فِي جَهَنَّمَ خَالِدًا مُخَلَّدًا فِيهَا أَبَدًا 15878 وَأَخْبَرَنَا أَبُو صَالِحِ بْنُ أَبِي طَاهِرٍ الْعَنْبَرِيُّ أنبأ يَحْيَى بْنُ مَنْصُورٍ الْقَاضِي ثنا أَحْمَدُ بْنُ سَلَمَةَ ثنا إِسْحَاقُ بْنُ إِبْرَاهِيمَ أنبأ جَرِيرٌ عَنِ الْأَعْمَشِ فَذَكَرَهُ بِإِسْنَادِهِ وَمَعْنَاهُ زَادَ وَمَنْ تَرَدَّى مِنْ جَبَلٍ فَقَتَلَ نَفْسَهُ
[Machine] To lie about the Messenger of Allah ﷺ, he said, "The Messenger of Allah ﷺ said, "Among those who came before you, there was a man who had a wound that caused him distress. He took a blade and cut his hand with it, and he bled to death. Allah ﷻ said, 'My servant hastened his own death, so I have forbidden Paradise for him.'"
أَنْ يَكُونَ كَذَبَ عَلَى رَسُولِ اللهِ ﷺ قَالَ قَالَ رَسُولُ اللهِ ﷺ كَانَ مِمَّنْ كَانَ قَبْلَكُمْ رَجُلٌ خَرَجَ بِهِ خُرَاجٌ فَجَزِعَ مِنْهُ فَأَخَذَ سِكِّينًا فَجَرَحَ بِهَا يَدَهُ فَمَا رَقَأَ الدَّمُ حَتَّى مَاتَ فَقَالَ ﷻ عَبْدِي بَادَرَنِي بِنَفْسِهِ حُرِّمَتْ عَلَيْهِ الْجَنَّةُ
49.38 [Machine] The deterrence of retribution in intentional killing God, the Most Blessed and Exalted, said: "And We ordained for them therein a life for a life" [Al-Ma'idah: 45] and He also said: "In the Law of Equality there is (saving of) Life" [Al-Baqarah: 178].
٤٩۔٣٨ بَابُ إِيجَابِ الْقِصَاصِ فِي الْعَمْدِ قَالَ اللهُ تَبَارَكَ وَتَعَالَى: {النَّفْسُ بِالنَّفْسِ} [المائدة: 45] وَقَالَ: {كُتِبَ عَلَيْكُمُ الْقِصَاصُ فِي الْقَتْلَى} [البقرة: 178]
Qurayzah and Nadir (were two Jewish tribes). An-Nadir were nobler than Qurayzah. When a man of Qurayzah killed a man of an-Nadir, he would be killed. But if a man of an-Nadir killed a man of Qurayzah, a hundred wasq of dates would be paid as blood-money. When Prophethood was bestowed upon the Prophet ﷺ, a man of an-Nadir killed a man of Qurayzah. They said: Give him to us, we shall kill him. They replied: We have the Prophet ﷺ between you and us. So they came to him. Thereupon the following verse was revealed: "If thou judge, judge in equity between them." "In equity" means life for a life. The following verse was then revealed: "Do they seek of a judgment of (the days) ignorance?" Abu Dawud said: Quraizah and al-Nadir were the descendants of Harun the Prophet (peace be upon him) (Using translation from Abū Dāʾūd 4494)
كَانَ قُرَيْظَةُ وَالنَّضِيرُ وَكَانَ النَّضِيرُ أَشْرَفَ مِنْ قُرَيْظَةَ فَكَانَ إِذَا قَتَلَ رَجُلٌ مِنْ قُرَيْظَةَ رَجُلًا مِنَ النَّضِيرِ قُتِلَ بِهِ وَإِذَا قَتَلَ رَجُلٌ مِنَ النَّضِيرِ رَجُلًا مِنْ قُرَيْظَةَ أَدَّى مِائَةَ وَسْقٍ مِنْ تَمْرٍ فَلَمَّا بُعِثَ النَّبِيُّ ﷺ قَتَلَ رَجُلٌ مِنَ النَّضِيرِ رَجُلًا مِنْ قُرَيْظَةَ فَقَالُوا ادْفَعُوهُ إِلَيْنَا نَقْتُلْهُ فَقَالُوا بَيْنَنَا وَبَيْنَكُمُ النَّبِيُّ ﷺ فَأَتَوْهُ فَنَزَلَتْ {وَإِنْ حَكَمْتَ فَاحْكُمْ بَيْنَهُمْ بِالْقِسْطِ} [المائدة 42] وَالْقِسْطُ النَّفْسُ بِالنَّفْسِ ثُمَّ نَزَلَتْ {أَفَحُكْمَ الْجَاهِلِيَّةِ يَبْغُونَ} [المائدة 50] لَفْظُ حَدِيثِ ابْنِ أَبِي غَرَزَةَ
[Machine] "From Abu Al-Ala'iah: "Whoever commits aggression [Surah Al-Baqarah 178] and then is killed after being taken as a ransom [Surah Al-Baqarah 178], then he will have a painful punishment [Surah Al-Baqarah 178]. This is an alleviation from your Lord and a mercy [Surah Al-Baqarah 178]. He says, when you were given the ransom and it was not lawful for the people of the Torah, it is only a retribution or an act of forgiveness. And for the people of the Gospel, it is only an act of forgiveness, there is no other. So it was made permissible for this nation: retribution, ransom, and forgiveness [Surah Al-Baqarah 178]. And there is life for you in retribution [Surah Al-Baqarah 179]." He says, Allah ﷻ has made retribution a life for you, from a man who intends to kill, but is prevented out of fear of being killed."
عَنْ أَبِي الْعَالِيَةِ {فَمَنِ اعْتَدَى} [البقرة 178] فَقَتَلَ بَعْدَ أَخْذِهِ الدِّيَةَ {فَلَهُ عَذَابٌ أَلِيمٌ} [البقرة 178] {ذَلِكَ تَخْفِيفٌ مِنْ رَبِّكُمْ وَرَحْمَةٌ} [البقرة 178] يَقُولُ حِينَ أُطْعِمْتُمُ الدِّيَةَ وَلَمْ تَحِلَّ لِأَهْلِ التَّوْرَاةِ إِنَّمَا هُوَ قِصَاصٌ أَوْ عَفْوٌ وَكَانَ لِأَهْلِ الْإِنْجِيلِ إِنَّمَا هُوَ عَفْوٌ لَيْسَ غَيْرُهُ فَجُعِلَ لِهَذِهِ الْأُمَّةِ الْقَوَدُ وَالدِّيَةُ وَالْعَفْوُ {وَلَكُمْ فِي الْقِصَاصِ حَيَاةٌ} [البقرة 179] يَقُولُ جَعَلَ اللهُ ﷻ الْقِصَاصَ حَيَاةً لَكُمْ مِنْ رَجُلٍ يُرِيدُ أَنْ يَقْتُلَ فَيَمْنَعَهُ مِنْهُ مَخَافَةَ أَنْ يُقْتَلَ
[Machine] And Abu Abdullah al-Hafiz informed us that Abu al-Hasan al-Taraifi and Abu Muhammad al-Ka'bi said: Isma'il bin Qutaybah narrated to us, who narrated to us Yazid bin Salih, who narrated to us Bukair bin Ma'ruf from Muqatil bin Hayyan regarding his saying: "And for you in [the law of] qisas is life, O you of understanding" [Surah Al-Baqarah: 179]. He says to you about qisas being a means of preserving life, as it prevents the shedding of one another's blood out of fear of being killed. He says: "Perhaps you will be cautious" [Surah Al-Baqarah: 179] meaning the blood, if one of you fears being killed by it.
وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنبأ أَبُو الْحَسَنِ الطَّرَائِفِيُّ وَأَبُو مُحَمَّدٍ الْكَعْبِيُّ قَالَا ثنا إِسْمَاعِيلُ بْنُ قُتَيْبَةَ ثنا يَزِيدُ بْنُ صَالِحٍ ثنا بُكَيْرُ بْنُ مَعْرُوفٍ عَنْ مُقَاتِلِ بْنِ حَيَّانَ فِي قَوْلِهِ {وَلَكُمْ فِي الْقِصَاصِ حَيَاةٌ} [البقرة 179] يَقُولُ لَكُمْ فِي الْقِصَاصِ حَيَاةٌ بِمَا يَنْتَهِي بَعْضُكُمْ عَنْ دِمَاءِ بَعْضٍ أَنْ يُصِيبَ الدَّمَ مَخَافَةَ أَنْ يُقْتَلَ يَقُولُ {لَعَلَّكُمْ تَتَّقُونَ} [البقرة 179] الدِّمَاءَ إِذَا خَافَ أَحَدُكُمْ أَنْ يُقْتَلَ بِهِ
[Machine] That Rabi'a, the daughter of Nadr, broke the necklace of a servant girl, so they presented compensation to her, but she refused. They then offered forgiveness, but she still refused. So, they went to the Prophet ﷺ , who ordered retribution. Anas ibn Nadr, her brother, came and said, "O Messenger of Allah, would you really break the necklace of Rabi'a?" He replied, "No, I swear by the One who sent you with the truth, her necklace will not be broken." Then the Prophet ﷺ said, "O Anas, the law of God is retribution." He responded, "The people have agreed and forgiven." So the Messenger of Allah ﷺ said, "Verily, among the servants of Allah are those who, if they were to swear by Allah, would fulfill it."
أَنَّ الرُّبَيِّعَ بِنْتَ النَّضْرِ كَسَرَتْ ثَنِيَّةَ جَارِيَةٍ فَعَرَضُوا عَلَيْهِمُ الْأَرْشَ فَأَبَوْا وَعَرَضُوا عَلَيْهِمُ الْعَفْوَ فَأَبَوْا فَأَتَوَا النَّبِيَّ ﷺ فَأَمَرَ بِالْقِصَاصِ فَجَاءَ أَخُوهَا أَنَسُ بْنُ النَّضْرِ فَقَالَ يَا رَسُولَ اللهِ أَتَكْسِرُ ثَنِيَّةَ الرُّبَيِّعِ؟ لَا وَالَّذِي بَعَثَكَ بِالْحَقِّ لَا تُكْسَرُ ثَنِيَّتُهَا فَقَالَ النَّبِيُّ ﷺ يَا أَنَسُ كِتَابُ اللهِ الْقِصَاصُ قَالَ فَرَضِيَ الْقَوْمُ فَعَفَوْا فَقَالَ رَسُولُ اللهِ ﷺ إِنَّ مِنْ عِبَادِ اللهِ مَنْ لَوْ أَقْسَمَ عَلَى اللهِ لَأَبَرَّهُ
قَالَ رَسُولُ اللهِ ﷺ مَنْ قُتِلَ فِي عِمِّيَّا أَوْ رِمِّيَّا تَكُونُ بَيْنَهُمْ بِحَجَرٍ أَوْ سَوْطٍ فَعَلَيْهِ عَقْلُ خَطَأٍ وَمَنْ قَتَلَ عَمْدًا فَقَوَدُ يَدِهِ وَمَنْ حَالَ بَيْنَهُ وَبَيْنَهُ فَعَلَيْهِ لَعْنَةُ اللهِ وَالْمَلَائِكَةِ وَالنَّاسِ أَجْمَعِينَ لَا يُقْبَلُ مِنْهُ صَرْفٌ وَلَا عَدْلٌ وَصَلَهُ سُلَيْمَانُ بْنُ كَثِيرٍ وَالْحَسَنُ بْنُ عُمَارَةَ وَإِسْمَاعِيلُ بْنُ مُسْلِمٍ وَرَوَاهُ حَمَّادُ بْنُ زَيْدٍ فِي آخَرِينَ عَنْ عَمْرٍو عَنْ طَاوُسٍ مُرْسَلًا 15885 أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو زَكَرِيَّا يَحْيَى بْنُ مُحَمَّدٍ الْعَنْبَرِيُّ ثنا أَبُو عَبْدِ اللهِ مُحَمَّدُ بْنُ إِبْرَاهِيمَ الْعَبْدِيُّ ثنا الْحَكَمُ بْنُ مُوسَى ثنا يَحْيَى بْنُ حَمْزَةَ عَنْ سُلَيْمَانَ بْنِ دَاوُدَ عَنِ الزُّهْرِيِّ عَنْ أَبِي بَكْرِ بْنِ مُحَمَّدِ بْنِ عَمْرِو بْنِ حَزْمٍ عَنْ أَبِيهِ عَنْ جَدِّهِ عَنِ النَّبِيِّ ﷺ أَنَّهُ كَتَبَ إِلَى أَهْلِ الْيَمَنِ فَذَكَرَ الْحَدِيثَ قَالَ وَكَانَ فِي الْكِتَابِ إِنَّ مَنِ اعْتَبَطَ مُؤْمِنًا قَتْلًا عَنْ بَيِّنَةٍ فَإِنَّهُ قَوَدٌ إِلَّا أَنْ يَرْضَى أَوْلِيَاءُ الْمَقْتُولِ وَرَوَاهُ أَيْضًا عَبْدُ الرَّحْمَنِ بْنُ أَبِي لَيْلَى عَنِ النَّبِيِّ ﷺ مُرْسَلًا
49.39 [Machine] The retribution for the killer without others.
٤٩۔٣٩ بَابُ إِيجَابِ الْقِصَاصِ عَلَى الْقَاتِلِ دُونَ غَيْرِهِ قَالَ اللهُ تَبَارَكَ وَتَعَالَى: {وَمَنْ قُتِلَ مَظْلُومًا فَقَدْ جَعَلْنَا لِوَلِيِّهِ سُلْطَانًا فَلَا يُسْرِفُ فِي الْقَتْلِ} [الإسراء: 33]
يَقْتُلُ اثْنَيْنِ بِوَاحِدٍ
[Machine] In his saying "We have made for his ally authority" [Al-Isra 33], he said a way against it "So, let him not exceed in killing." [Al-Isra 33]. He said, "One should not kill two with one." Al-Shafi'i said, and it is said in his saying "So, let him not exceed in killing." [Al-Isra 33], he said, "Do not kill other than the killer." And this is similar to what was said, and Allah knows best.
فِي قَوْلِهِ {فَقَدْ جَعَلْنَا لِوَلِيِّهِ سُلْطَانًا} [الإسراء 33] قَالَ سَبِيلًا عَلَيْهِ {فَلَا يُسْرِفْ فِي الْقَتْلِ} [الإسراء 33] قَالَ لَا يَقْتُلِ اثْنَيْنِ بِوَاحِدٍ قَالَ الشَّافِعِيُّ وَقِيلَ فِي قَوْلِهِ {فَلَا يُسْرِفْ فِي الْقَتْلِ} [الإسراء 33] قَالَ لَا يَقْتُلْ غَيْرَ قَاتِلِهِ وَهَذَا يُشْبِهُ مَا قِيلَ وَاللهُ أَعْلَمُ
[Machine] "Do not kill except in self-defense, and do not harm with the same."
لَا يَقْتُلْ غَيْرَ قَاتِلِهِ وَلَا يُمَثِّلْ بِهِ
[Machine] In the times of ignorance, when a man from a tribe killed another man, they were not satisfied until they killed a nobleman in retaliation. But if the killer was not noble, they would not kill him and kill someone else instead. They were admonished by the saying of Allah, exalted be He: "And do not kill the soul which Allah has forbidden [to be killed] except by [legal] right. And whoever is killed unjustly - We have given his heir authority, but let him not exceed limits in [the matter of] taking life. Indeed, he has been supported [by the law]." (Quran 17:33) Zaid ibn Aslam said that excess is to kill someone other than the killer. Ash-Shafi'i said that Allah, exalted be He, said: "Prescribed for you is legal retribution for those murdered." (Quran 2:178)
أَنَّ النَّاسَ فِي الْجَاهِلِيَّةِ إِذَا قَتَلَ الرَّجُلُ مِنَ الْقَوْمِ رَجُلًا لَمْ يَرْضَوْا حَتَّى يَقْتُلُوا بِهِ رَجُلًا شَرِيفًا إِذَا كَانَ قَاتِلُهُمْ غَيْرَ شَرِيفٍ لَمْ يَقْتُلُوا قَاتِلَهُمْ وَقَتَلُوا غَيْرَهُ فَوُعِظُوا فِي ذَلِكَ بِقَوْلِ اللهِ تَبَارَكَ وَتَعَالَى {وَلَا تَقْتُلُوا النَّفْسَ الَّتِي حَرَّمَ اللهُ إِلَّا بِالْحَقِّ وَمَنْ قُتِلَ مَظْلُومًا فَقَدْ جَعَلْنَا لِوَلِيِّهِ سُلْطَانًا فَلَا يُسْرِفْ فِي الْقَتْلِ إِنَّهُ كَانَ مَنْصُورًا} [الإسراء 33] وَقَالَ زَيْدُ بْنُ أَسْلَمَ السَّرَفُ أَنْ يَقْتُلَ غَيْرَ قَاتِلِهِ قَالَ الشَّافِعِيُّ قَالَ اللهُ تَبَارَكَ وَتَعَالَى {كُتِبَ عَلَيْكُمُ الْقِصَاصُ فِي الْقَتْلَى} [البقرة 178] الْآيَةَ
[Machine] About the saying of Qatadah on the verse {O you who have believed, prescribed for you is legal retribution for those murdered— the free for the free, the slave for the slave, and the female for the female} [Al-Baqarah 178], he said, "The people of ignorance among them used to have aggression and obedience to Satan. So, when there was among them a number and quality, a slave of theirs would be killed by the slave of another people, they would say, 'We will only kill a free person in retaliation, to assert our superiority and preferential treatment over others in themselves.' And when a female of theirs was killed by another woman, they would say, 'We will only kill a man in retaliation.' So Allah revealed this verse to inform them that retaliation is for the slave, the free, and the female. And He prohibited them from aggression. Then He revealed Surat Al-Ma'idah and said, {And We ordained therein for them: a life for a life, an eye for an eye, a nose for a nose, an ear for an ear, a tooth for a tooth, and for wounds is legal retribution} [Al-Ma'idah 45]."
عَنْ قَتَادَةَ فِي قَوْلِهِ {يَا أَيُّهَا الَّذِينَ آمَنُوا كُتِبَ عَلَيْكُمُ الْقِصَاصُ فِي الْقَتْلَى الْحُرُّ بِالْحُرِّ وَالْعَبْدُ بِالْعَبْدِ وَالْأُنْثَى بِالْأُنْثَى} [البقرة 178] قَالَ كَانَ أَهْلُ الْجَاهِلِيَّةِ فِيهِمْ بَغْيٌ وَطَاعَةٌ لِلشَّيْطَانِ فَكَانَ الْحِيُّ فِيهِمْ إِذَا كَانَ فِيهِمْ عَدَدٌ وَعُدَّةٌ فَقُتِلَ لَهُمْ عَبْدٌ قَتَلَهُ عَبْدُ قَوْمٍ آخَرِينَ قَالُوا لَا نَقْتُلُ بِهِ إِلَّا حُرًّا تَعَزُّزًا وَتَفَضُّلًا عَلَى غَيْرِهِمْ فِي أَنْفُسِهِمْ وَإِذَا قُتِلَتْ لَهُمْ أُنْثَى قَتَلَتْهَا امْرَأَةٌ قَالُوا لَنْ نَقْتُلَ بِهَا إِلَّا رَجُلًا فَأَنْزَلَ اللهُ ﷻ هَذِهِ الْآيَةَ يُخْبِرُهُمْ أَنَّ الْعَبْدَ بِالْعَبْدِ وَالْحُرَّ بِالْحُرِّ وَالْأُنْثَى بِالْأُنْثَى وَنَهَاهُمْ عَنِ الْبَغْيِ ثُمَّ أَنْزَلَ سُورَةَ الْمَائِدَةِ فَقَالَ {وَكَتَبْنَا عَلَيْهِمْ فِيهَا أَنَّ النَّفْسَ بِالنَّفْسِ وَالْعَيْنَ بِالْعَيْنِ وَالْأَنْفَ بِالْأَنْفِ وَالْأُذُنَ بِالْأُذُنِ وَالسِّنَّ بِالسِّنِّ وَالْجُرُوحَ قِصَاصٌ} [المائدة 45]
[Machine] In his statement "Retribution is written upon you for the slain" [Al-Baqarah: 178], it is stated that this was applied in two tribes of the Arab before Islam, where they fought each other and killed each other before they embraced Islam. Some of them had disputes and killings, so they sought this in Islam. One of the two tribes had a favor over the other, so they swore by Allah that they would kill the men and free the women and slaves. When this verse was revealed, they were satisfied and submitted. Abu Abdullah Al-Hafiz informed us, Abu Al-Abbas Muhammad Ibn Ya'qub informed us, Al-Rabi' Ibn Sulaiman informed us, Al-Shafi'i informed us, Mu'adh Ibn Musa narrated from Bukayr Ibn Ma'ruf from Muqatil Ibn Hayyan who said: "I received this interpretation from a group including Mu'adh, Mujahid, Dahaak, and Al-Hasan. They mentioned its meaning except that they did not mention the statement 'and some of them upon others are scratches and killing.' Al-Shafi'i said: 'Their statement is not similar to what they have said because Allah, may He be exalted, only made each sinner responsible for his sin and did not make one guilty for another. Then he said that it has been reported from the Prophet ﷺ that the one who kills without being a combatant is the most hostile person to Allah.'"
فِي قَوْلِهِ {كُتِبَ عَلَيْكُمُ الْقِصَاصُ فِي الْقَتْلَى} [البقرة 178] الْآيَةَ قَالَ كَانَ بُدُوُّ ذَلِكَ فِي حَيَّيْنِ مِنْ أَحْيَاءِ الْعَرَبِ اقْتَتَلُوا قَبْلَ الْإِسْلَامِ بِقَلِيلٍ ثُمَّ أَسْلَمُوا وَلِبَعْضِهِمْ عَلَى بَعْضٍ خُمَاشَاتٌ وَقَتْلٌ فَطَلَبُوهَا فِي الْإِسْلَامِ وَكَانَ لِأَحَدِ الْحَيَّيْنِ فَضْلٌ عَلَى الْآخَرِ فَأَقْسَمُوا بِاللهِ لَيُقْتَلَنَّ بِالْأُنْثَى الذَّكَرُ مِنْهُمْ وَبِالْعَبْدِ الْحُرُّ مِنْهُمْ فَلَمَّا نَزَلَتْ هَذِهِ الْآيَةُ رَضُوا وَسَلَّمُوا 15892 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا الرَّبِيعُ بْنُ سُلَيْمَانَ ثنا الشَّافِعِيُّ أنبأ مُعَاذُ بْنُ مُوسَى عَنْ بُكَيْرِ بْنِ مَعْرُوفٍ عَنْ مُقَاتِلِ بْنِ حَيَّانَ قَالَ مُقَاتِلٌ أَخَذْتُ هَذَا التَّفْسِيرَ عَنْ نَفَرٍ حَفِظَ مُعَاذٌ مِنْهُمْ مُجَاهِدًا وَالضَّحَّاكَ وَالْحَسَنَ فَذَكَرَ مَعْنَاهُ إِلَّا أَنَّهُ لَمْ يَذْكُرْ قَوْلَهُ وَلِبَعْضِهِمْ عَلَى بَعْضٍ خُمَاشَاتٌ وَقَتْلٌ قَالَ الشَّافِعِيُّ وَمَا أَشْبَهَ مَا قَالُوا مِنْ هَذَا بِمَا قَالُوا لِأَنَّ اللهَ تَعَالَى إِنَّمَا أَلْزَمَ كُلَّ مُذْنِبٍ ذَنْبَهُ وَلَمْ يَجْعَلْ جُرْمَ أَحَدٍ عَلَى غَيْرِهِ ثُمَّ سَاقَ الْكَلَامَ إِلَى أَنْ قَالَ وَقَدْ جَاءَ عَنِ النَّبِيِّ ﷺ أَعْدَى النَّاسِ عَلَى اللهِ مَنْ قَتَلَ غَيْرَ قَاتِلِهِ
[Machine] "That the Messenger of Allah ﷺ said, 'The strongest of people in the sight of Allah is the one who kills someone other than his killer, or seeks blood revenge during the times of ignorance while being a Muslim, or blinds his two eyes as long as they are not blind.'"
أَنَّ رَسُولَ اللهِ ﷺ قَالَ أَعْتَى النَّاسِ عَلَى اللهِ مَنْ قَتَلَ غَيْرَ قَاتِلِهِ أَوْ طَلَبَ بِدَمٍ فِي الْجَاهِلِيَّةِ مِنْ أَهْلِ الْإِسْلَامِ أَوْ بَصَّرَ عَيْنَيْهِ مَا لَمْ تُبْصِرَا
[Machine] In the list of the Prophet's sword, a book was found that stated that the worst enemies of Allah are those who kill without being killed, who harm without being harmed, and those who betray without being loyal. Whoever supports them has disbelieved in what Allah has revealed to Muhammad.
وُجِدَ فِي قَائِمِ سَيْفِ رَسُولِ اللهِ ﷺ كِتَابٌ إِنَّ أَعْدَى النَّاسِ عَلَى اللهِ وَفِي حَدِيثِ سُلَيْمَانِ إِنَّ أَعْتَى النَّاسِ عَلَى اللهِ الْقَاتِلُ غَيْرَ قَاتِلِهِ وَالضَّارِبُ غَيْرَ ضَارِبِهِ وَمَنْ تَوَلَّى غَيْرَ مَوَالِيهِ فَقَدْ كَفَرَ بِمَا أَنْزَلَ اللهُ عَلَى مُحَمَّدٍ ﷺ
[Machine] I asked Abu Ja'far Muhammad ibn Ali about what was in the scroll that was with the Messenger of Allah. He said, "In it, Allah cursed the killer who is not the one intended to be killed, and the striker who is not the one intended to be struck, and whoever supports someone other than his benefactor has disbelieved in what Allah has revealed to Muhammad."
قُلْتُ لِأَبِي جَعْفَرٍ مُحَمَّدِ بْنِ عَلِيٍّ مَا كَانَ فِي الصَّحِيفَةِ الَّتِي كَانَتْ فِي قِرَابِ رَسُولِ اللهِ ﷺ؟ فَقَالَ كَانَ فِيهَا لَعَنَ اللهُ الْقَاتِلَ غَيْرَ قَاتِلِهِ وَالضَّارِبَ غَيْرَ ضَارِبِهِ وَمَنْ تَوَلَّى غَيْرَ وَلِيِّ نِعْمَتِهِ فَقَدْ كَفَرَ بِمَا أَنْزَلَ اللهُ عَلَى مُحَمَّدٍ ﷺ
[Machine] Two books were found in the inventory of the Prophet's ﷺ sword, which stated that the most unjust of people is the one who strikes someone who did not strike him, and the one who kills someone who did not kill him, and the one who withholds his blessings from someone who deserves them. Whoever does that has disbelieved in Allah and His Messenger. Allah does not accept any payment or justice from him. The narration is from Malik ibn Muhammad ibn Abdur Rahman ibn Abi Rijal, who narrated from his father.
وُجِدَ فِي قَائِمِ سَيْفِ رَسُولِ اللهِ ﷺ كِتَابَانِ إِنَّ أَشَدَّ النَّاسِ عُتُوًّا الرَّجُلُ ضَرَبَ غَيْرَ ضَارِبِهِ وَرَجُلٌ قَتَلَ غَيْرَ قَاتِلِهِ وَرَجُلٌ تَوَلَّى غَيْرَ أَهْلِ نِعْمَتِهِ فَمَنْ فَعَلَ ذَلِكَ فَقَدْ كَفَرَ بِاللهِ وَرَسُولِهِ لَا يَقْبَلُ اللهُ مِنْهُ صَرْفًا وَلَا عَدْلًا وَذَكَرَ الْحَدِيثَ هُوَ مَالِكُ بْنُ مُحَمَّدِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ أَبِي الرِّجَالِ يَرْوِي عَنْ أَبِيهِ
[Machine] I entered with my father to the Messenger of Allah ﷺ, and my father saw someone on the back of the Messenger of Allah ﷺ. So he said, "Let me treat the person on your back, for I am a physician." The Messenger of Allah ﷺ said, "Are you a companion of his?" He said, "My son testifies with him." The Messenger of Allah ﷺ said, "Indeed, he does not benefit you, and you do not benefit him."
دَخَلْتُ مَعَ أَبِي عَلَى رَسُولِ اللهِ ﷺ فَرَأَى أَبِي الَّذِي بِظَهْرِ رَسُولِ اللهِ ﷺ فَقَالَ دَعْنِي أُعَالِجُ الَّذِي بِظَهْرِكَ فَإِنِّي طَبِيبٌ فَقَالَ أَنْتَ رَفِيقٌ قَالَ رَسُولُ اللهِ ﷺ مَنْ هَذَا مَعَكَ؟ قَالَ ابْنِي أَشْهَدُ بِهِ فَقَالَ أَمَا إِنَّهُ لَا يَجْنِي عَلَيْكَ وَلَا تَجْنِي عَلَيْهِ
[Machine] I came to the Messenger of Allah ﷺ with my father, and the Messenger of Allah ﷺ met us on the way. My father said to me, "O my son, do you know who this approaching person is?" I said, "No." He said, "This is the Messenger of Allah ﷺ ." I was amazed when he said that because I thought he did not resemble other people. But there he was, a man with abundant hair, wearing a cloak made of fine linen and wearing two green garments. My father greeted him with peace and he returned the greeting. Then my father asked him, "Is he your son?" He replied, "Yes, by the Lord of the Kaaba." The Messenger of Allah ﷺ smiled from the resemblance of me to my father and from my father's oath regarding me. Then he said, "Indeed, there is no accountability upon you for him, nor is there accountability upon him for you." Then the Messenger of Allah ﷺ recited the verse, "And no bearer of burdens will bear the burden of another." [Surah Al-An'am: 164]
أَتَيْتُ رَسُولَ اللهِ ﷺ مَعَ أَبِي فَتَلَقَّانَا رَسُولُ اللهِ ﷺ فِي طَرِيقِهِ فَقَالَ لِي أَبِي يَا بُنِيَّ هَلْ تَدْرِي مَنْ هَذَا الْمُقْبِلُ؟ قُلْتُ لَا قَالَ هَذَا رَسُولُ اللهِ ﷺ قَالَ فَاقْشَعْرَرْتُ حِينَ قَالَ ذَاكَ وَذَلِكَ أَنِّي ظَنَنْتُ أَنَّهُ لَا يُشْبِهُ النَّاسَ فَإِذَا هُوَ بَشَرٌ ذُو وَفْرَةٍ عَلَيْهِ رَدْعٌ مِنْ حِنَّاءٍ وَعَلَيْهِ ثَوْبَانِ أَخْضَرَانِ فَسَلَّمَ عَلَيْهِ أَبِي فَرَدَّ عَلَيْهِ السَّلَامَ ثُمَّ قَالَ ابْنُكَ هَذَا؟ قَالَ إِي وَرَبِّ الْكَعْبَةِ فَتَبَسَّمَ رَسُولُ اللهِ ﷺ مِنْ ثَبْتِ شَبَهِي بِأَبِي وَمِنْ حَلِفِ أَبِي عَلَيَّ ثُمَّ قَالَ أَمَا إِنَّهُ لَا يَجْنِي عَلَيْكَ وَلَا تَجْنِي عَلَيْهِ ثُمَّ تَلَا رَسُولُ اللهِ ﷺ {وَلَا تَزِرُ وَازِرَةٌ وِزْرَ أُخْرَى} [الأنعام 164]
[Machine] I heard the Messenger of Allah ﷺ saying during the Farewell Hajj, "Which day has the greatest sanctity?" They replied, "This day of ours or the Day of Arafah." He said, "Indeed, your blood, your wealth, and your honor are sacred to you, just as the sanctity of this day of yours is sacred, in this land of yours. Behold! Let it not be that a revert to paganism after me should take someone's life, or take his property. An offspring may seek compensation for an injury, but no parent can seek compensation for a harm inflicted upon his child or offspring."
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ فِي حَجَّةِ الْوَدَاعِ أِيُّ يَوْمٍ أَعْظَمُ حُرْمَةً؟ قَالُوا يَوْمُنَا هَذَا أَوْ يَوْمُ الْحَجِّ الْأَكْبَرِ قَالَ فَإِنَّ دِمَاءَكُمْ وَأَمْوَالَكُمْ وَأَعْرَاضَكُمْ حَرَامٌ كَحُرْمَةِ يَوْمِكُمْ وَبَلَدِكُمْ أَلَا لَا يَجْنِي جَانٍ إِلَّا عَلَى نَفْسِهِ لَا يَجْنِي وَالِدٌ عَلَى وَلَدِهِ وَلَا مَوْلُودٌ عَلَى وَالِدِهِ
[Machine] Some people from the Banu Tha'laba bin Yarbua came to the Messenger of Allah ﷺ and they had caused harm to a companion of the Messenger of Allah ﷺ . A man said to the Messenger of Allah ﷺ , "O Messenger of Allah, the Banu Tha'laba bin Yarbua killed so-and-so." The Messenger of Allah ﷺ said, "One soul should not be harmed because of another." Shu'ba narrated this from a man from the Banu Tha'laba, and Ath-Thawri narrated it from Tha'laba bin Zahdam.
أَنَّ نَاسًا مِنْهُمْ أَتَوْا رَسُولَ اللهِ ﷺ وَكَانَتْ بَنُو ثَعْلَبَةَ بْنُ يَرْبُوعٍ أَصَابُوا رَجُلًا مِنْ أَصْحَابِ رَسُولِ اللهِ ﷺ فَقَالَ رَجُلٌ يَا رَسُولَ اللهِ هَؤُلَاءِ بَنُو ثَعْلَبَةَ بْنِ يَرْبُوعٍ قَتَلَتْ فُلَانًا فَقَالَ رَسُولُ اللهِ ﷺ لَا تَجْنِي نَفْسٌ عَلَى أُخْرَى هَكَذَا قَالَ شُعْبَةُ عَنْ رَجُلٍ مِنْ بَنِي ثَعْلَبَةَ وَقَالَ الثَّوْرِيُّ عَنْ ثَعْلَبَةَ بْنِ زَهْدَمٍ
[Machine] That his father, Malik, his uncles Qais and Ubaid, from the Banu Khushkhash tribe, came to the Prophet ﷺ and complained to him about a raid by a group of their cousins on the people. So the Messenger of Allah ﷺ wrote them a letter saying, "This is a letter from Muhammad, the Messenger of Allah, to Malik, Qais, and Ubaid, from the Banu Khushkhash tribe. Indeed, you are safe and protected. Your lives and wealth are not to be taken except by your own consent, and no harm shall come upon you except from your own hands."
أَنَّ أَبَاهُ مَالِكًا وَعَمَّيْهِ قَيْسًا وَعُبَيْدًا بَنِي الْخَشْخَاشِ أَتَوَا النَّبِيَّ ﷺ فَشَكَوْا إِلَيْهِ غَارَةَ خَيْلٍ مِنْ بَنِي عَمِّهِمْ عَلَى النَّاسِ فَكَتَبَ لَهُمْ رَسُولُ اللهِ ﷺ هَذَا كِتَابٌ مِنْ مُحَمَّدٍ رَسُولِ اللهِ ﷺ لِمَالِكٍ وَقَيْسٍ وَعُبَيْدٍ بَنِي الْخَشْخَاشِ إِنَّكُمْ آمِنُونَ مَسَلَّمُونَ عَلَى دِمَائِكُمْ وَأَمْوَالِكُمْ لَا تُؤْخَذُونَ بِجَرِيرَةِ غَيْرِكُمْ وَلَا تَجْنِي عَلَيْكُمْ إِلَّا أَيْدِيكُمْ
The Prophet ﷺ said, "The most hated persons to Allah are three: (1) A person who deviates from the right conduct, i.e., an evil doer, in the Haram (sanctuaries of Mecca and Medina); (2) a person who seeks that the traditions of the Pre-lslamic Period of Ignorance, should remain in Islam (3) and a person who seeks to shed somebody's blood without any right." عَنِ النَّبِيِّ ﷺ قَالَ أَبْغَضُ النَّاسِ إِلَى اللهِ مُلْحِدٌ فِي الْحَرَمِ وَمُبْتَغٍ فِي الْإِسْلَامِ سُنَّةَ الْجَاهِلِيَّةِ وَمُطَّلِبُ دَمِ امْرِئٍ بِغَيْرِ حَقٍّ لِيُهَرِيقَ دَمَهُ
49.40 [Machine] The Killing of a Man by a Woman
٤٩۔٤٠ بَابُ قَتْلِ الرَّجُلِ بِالْمَرْأَةِ قَالَ اللهُ تَبَارَكَ وَتَعَالَى: {وَكَتَبْنَا عَلَيْهِمْ فِيهَا أَنَّ النَّفْسَ بِالنَّفْسِ} [المائدة: 45]. وَقَالَ النَّبِيُّ ﷺ: " الْمُسْلِمُونَ تَتَكَافَأُ دِمَاؤُهُمْ "
[Machine] Allah said, "O you who have believed, prescribed for you is legal retribution for those murdered" [Al-Baqarah 178] the verse in its entirety. Then He said, "And We ordained for them in it that life is for life" [Al-Ma'idah 45] the verse in its entirety. Ibn Shihab said, when this verse was revealed, a woman was restrained from a man, and in cases of intentional injuries. Abdullah ibn Wahb narrated to us that Malik informed him that Sa'id ibn Al-Musayyib said, "A man is to be killed for killing a woman" Allah said, "And We ordained for them in it that life is for life" [Al-Ma'idah 45].
قَالَ اللهُ ﷻ {يَا أَيُّهَا الَّذِينَ آمَنُوا كُتِبَ عَلَيْكُمُ الْقِصَاصُ فِي الْقَتْلَى} [البقرة 178] الْآيَةَ كُلَّهَا ثُمَّ قَالَ {وَكَتَبْنَا عَلَيْهِمْ فِيهَا أَنَّ النَّفْسَ بِالنَّفْسِ} [المائدة 45] الْآيَةَ كُلَّهَا قَالَ ابْنُ شِهَابٍ فَلَمَّا نَزَلَتْ هَذِهِ الْآيَةُ أُقِيدَتِ الْمَرْأَةُ مِنَ الرَّجُلِ وَفِيمَا يُعْمَدُ مِنَ الْجِرَاحِ قَالَ وَحَدَّثَنَا عَبْدُ اللهِ بْنُ وَهْبٍ أَخْبَرَنِي مَالِكٌ أَنَّ سَعِيدَ بْنَ الْمُسَيِّبِ قَالَ الرَّجُلُ يُقْتَلُ بِالْمَرْأَةِ إِذَا قَتَلَهَا قَالَ اللهُ ﷻ {وَكَتَبْنَا عَلَيْهِمْ فِيهَا أَنَّ النَّفْسَ بِالنَّفْسِ} [المائدة 45]
