٤٩۔ كِتَابُ النَّفَقَاتِ
Abu Salamah bin ‘Abd Al Rahman reported on the authority of Fatimah daughter of Qais Abu ‘Amr bin Hafs divorced her (Fatimah daughter of Qais) absolutely when he was away from home and his agent sent her home barley. She was displeased with it. He said “I swear by Allah, you have no claim on us. She then came to Apostle of Allah ﷺ and mentioned that to him. He said to her “No maintenance is due to you from him. He ordered her to spend the waiting period in the house of Umm Sharik but he said afterwards “that is a woman whom my Companions visit. Spend the waiting period in the house of Ibn Umm Maktum for he is blind and you can undress. Then when you are in a position of being remarried, tell me.” She said “When I was in a position to remarry, I mentioned to him that Mu’awiyah bin Abi Sufyan and Abu Jahm had asked me in marriage. The Apostle of Allah ﷺsaid “As for Abu Jahm, he does not put down his stick from his shoulder, and as for Mu’awiyah he is a poor man who has no property; marry Usamah bin Zaid. I disliked him but he said “Marry Usamah bin Zaid. So, I married him. And Allah prospered him very much and I was envied.” (Using translation from Abū Dāʾūd 2284)
وَاللهِ مَا لَكِ عَلَيْنَا مِنْ شَيْءٍ فَجَاءَتْ رَسُولَ اللهِ ﷺ فَذَكَرَتْ ذَلِكَ لَهُ فَقَالَ لَهَا لَيْسَ لَكِ عَلَيْهِ نَفَقَةٌ وَأَمَرَهَا أَنْ تَعْتَدَّ فِي بَيْتِ أُمِّ شَرِيكٍ ثُمَّ قَالَ إِنَّ تِلْكَ امْرَأَةٌ يَغْشَاهَا أَصْحَابِي اعْتَدِّي فِي بَيْتِ ابْنِ أُمِّ مَكْتُومٍ فَإِنَّهُ رَجُلٌ أَعْمَى تَضَعِينَ ثِيَابَكِ وَإِذَا حَلَلْتِ فَآذِنِينِي قَالَتْ فَلَمَّا حَلَلْتُ ذَكَرْتُ لَهُ أَنَّ مُعَاوِيَةَ بْنَ أَبِي سُفْيَانَ وَأَبَا جَهْمٍ خَطَبَانِي فَقَالَ رَسُولُ اللهِ ﷺ أَمَّا أَبُو جَهْمٍ فَلَا يَضَعُ عَصَاهُ عَنْ عَاتِقِهِ وَأَمَّا مُعَاوِيَةُ فَصُعْلُوكٌ لَا مَالَ لَهُ انْكِحِي أُسَامَةَ بْنَ زَيْدٍ قَالَتْ فَكَرِهْتُهُ فَقَالَ انْكِحِي أُسَامَةَ بْنَ زَيْدٍ فَنَكَحْتُهُ فَجَعَلَ اللهُ فِيهِ خَيْرًا وَاغْتَبَطْتُ
There is no maintenance allowance for you, and you better go to the house of Ibn Umm Maktum and live with him for he is a blind man and you can put off your clothes in his house (i. e. you shall not face much difficulty in observing purdah there). (Using translation from Muslim 1480c)
أَنْ يُنْفِقَ عَلَيْهَا فَجَاءَتْ إِلَى رَسُولِ اللهِ ﷺ فَأَخْبَرَتْهُ فَقَالَ رَسُولُ اللهِ ﷺ لَا نَفَقَةَ لَكِ فَانْتَقِلِي وَاذْهَبِي إِلَى ابْنِ أُمِّ مَكْتُومٍ فَكُونِي عِنْدَهُ فَإِنَّهُ رَجُلٌ أَعْمَى تَضَعِينَ ثِيَابَكِ عِنْدَهُ
By Allah, I will inform Messenger of Allah ﷺ, and if maintenance allowance is due to me then I will accept that which will suffice me, and if it is not due to me, I will not accept anything from him. She said: I made a mention of that to Messenger of Allah ﷺ and he said: There is neither maintenance allowance for you nor lodging. (Using translation from Muslim 1480b)
أَنَّهُ طَلَّقَهَا زَوْجُهَا فِي عَهْدِ رَسُولِ اللهِ ﷺ وَكَانَ نَفَقَ عَلَيْهَا نَفَقَةً دُونَ فَلَمَّا رَأَتْ ذَلِكَ قَالَتْ وَاللهِ لَأُكَلِّمَنَّ رَسُولَ اللهِ ﷺ فَإِنْ كَانَتْ لِي نَفَقَةٌ أَخَذْتُ الَّذِي يُصْلِحُنِي وَإِنْ لَمْ يَكُنْ لِي نَفَقَةٌ لَمْ آخُذْ شَيْئًا قَالَتْ فَذَكَرْتُ ذَلِكَ لِرَسُولِ اللهِ ﷺ فَقَالَ لَا نَفَقَةَ لَكِ وَلَا سُكْنَى
[Machine] A man from the tribe of Makhzum divorced his wife on the spot. She then sent word to her family seeking financial support, but they refused to provide for her. So she went to the Prophet ﷺ and informed him of her situation. He told her that her family was not obligated to support her, but she must observe the waiting period. He advised her to go to Umm Sharik, who was a woman frequented by her brothers from the early Muslim migrants. She then should go to the son of Umm Maktoom, who was a blind man. If she were to undress in front of him, he would not see anything. The Prophet ﷺ added, "Do not put us in a difficult position." She replied, "When I am free of my obligations, men will want to propose to me." The Prophet then asked, "And what about Osama?" She did not like that suggestion and said, "I will only marry the one you mentioned." So she got married. Muhammad bin Amr narrated from Muhammad bin Ibrahim that Aisha used to advise Fatimah, saying, "Fear Allah, for I know what led to this."
رَجُلٍ مِنْ بَنِي مَخْزُومٍ فَطَلَّقَهَا الْبَتَّةَ فَأَرْسَلَتْ إِلَى أَهْلِهِ تَبْتَغِي النَّفَقَةَ فَقَالُوا لَيْسَتْ لَكِ عَلَيْنَا نَفَقَةٌ فَأَتَتِ النَّبِيَّ ﷺ فَأَخْبَرَتْهُ فَقَالَ لَيْسَتْ لَكِ عَلَيْهِ نَفَقَةٌ وَعَلَيْكِ الْعِدَّةُ فَانْتَقِلِي إِلَى أُمِّ شَرِيكٍ ثُمَّ قَالَ إِنَّ أُمَّ شَرِيكٍ امْرَأَةٌ يَدْخُلُ عَلَيْهَا إِخْوَتُهَا مِنَ الْمُهَاجِرِينِ الْأَوَّلِينَ فَانْتَقِلِي إِلَى ابْنِ أُمِّ مَكْتُومٍ فَإِنَّهُ رَجُلٌ أَعْمَى إِنْ وَضَعْتِ ثَوْبَكِ لَمْ يَرَ شَيْئًا وَلَا تُفَوِّتِينَا بِنَفْسِكَ قَالَتْ فَلَمَّا أَحَلَّتْ ذَكَرَهَا رِجَالٌ فَقَالَ النَّبِيُّ ﷺ فَأَيْنَ أَنْتِ عَنْ أُسَامَةَ؟ قَالَ فَكَأَنَّ أَهْلَهَا كَرِهُوا ذَلِكَ قَالَتْ لَا وَاللهِ لَا أَنْكِحُ إِلَّا الَّذِي قَالَ فَنَكَحَتْهُ قَالَ مُحَمَّدُ بْنُ عَمْرٍو فَحَدَّثَنِي مُحَمَّدُ بْنُ إِبْرَاهِيمَ أَنَّ عَائِشَةَ ؓ كَانَتْ تَقُولُ يَا فَاطِمَةُ اتَّقِي اللهَ فَقَدْ عَرَفْتُ مِنْ أِيِّ شَيْءٍ كَانَ ذَلِكَ
[Machine] And its deputy, I do not have any obligation to you in terms of expenses. So the Messenger of Allah ﷺ came and asked him about that. He told her the truth and conveyed it to the son of Umm Makhtum. The people denied what she used to say about his departure before it was resolved.
لِي وَكِيلُهُ مَا لَكِ عَلَيْنَا مِنْ نَفَقَةٍ فَجَاءَتْ رَسُولَ اللهِ ﷺ فَسَأَلَتْهُ عَنْ ذَلِكَ فَقَالَ لَهَا صَدَقَ وَنَقَلَهَا إِلَى ابْنِ أُمِّ مَكْتُومٍ فَأَنْكَرَ النَّاسُ عَلَيْهَا مَا كَانَتْ تُحَدِّثُ مِنْ خُرُوجِهَا قَبْلَ أَنْ تَحِلَّ
By Allah, there is no maintenance allowance for you, except in case you are pregnant. She came to Allah's Apostle (may peace he upon him) and mentioned their opinion to him, whereupon he said: There is no maintenance allowance for you. Then she sought permission to move (to another place), and he (the Holy Prophet) permitted her. She said: Messenger of Allah, where (should I go)? He said: To the house of Ibn Umm Maktum and, as he is blind, she could put off her garmeqts in his presence and he would not see her. And when her 'Idda was over. Allah's Apostle ﷺ married her to Usama b. Zaid. Marwan (the governor of Medina) sent Qabisa b. Dhuwaib in order to ask her about this hadith, and she narrated it to him, whereupon Marwan said: We have not heard this hadith but from a woman. We would adopt a safe (path) where we found the people. Fatima said that when these words of, Marwan were conveyed to her. There is between me and you the word of Allah, the Exalted and Majestic: Do" not turn them out" of their houses. She asserted: This is in regard to the revocable divorce what new (turn can the event take) after three pronouncements (separation between irrevocable). Why do you say there is no maintenance allowance for her if she is not pregnant? Then on what ground do you restrain her? (Using translation from Muslim 1480h)
حَامِلًا فَأَتَتِ النَّبِيَّ ﷺ فَذَكَرَتْ لَهُ قَوْلَهُمَا فَقَالَ لَا نَفَقَةَ لَكِ وَاسْتَأْذَنَتْهُ فِي الِانْتِقَالِ فَأَذِنَ لَهَا فَقَالَتْ أَيْنَ يَا رَسُولَ اللهِ قَالَ إِلَى ابْنِ أُمِّ مَكْتُومٍ وَكَانَ أَعْمَى تَضَعُ ثِيَابَهَا عِنْدَهُ وَلَا يَرَاهَا فَلَمَّا مَضَتْ عِدَّتُهَا أَنْكَحَهَا النَّبِيُّ ﷺ أُسَامَةَ بْنَ زَيْدٍ فَأَرْسَلَ إِلَيْهَا مَرْوَانُ قَبِيصَةَ بْنَ ذُؤَيْبٍ يَسْأَلُهَا عَنْ هَذَا الْحَدِيثِ فَحَدَّثَتْهُ بِهِ فَقَالَ مَرْوَانُ لَمْ نَسْمَعْ بِهَذَا الْحَدِيثِ إِلَّا مِنِ امْرَأَةٍ سَنَأْخُذُ بِالْعِصْمَةِ الَّتِي وَجَدْنَا النَّاسَ عَلَيْهَا فَقَالَتْ فَاطِمَةُ ؓ حِينَ بَلَغَهَا قَوْلُ مَرْوَانَ بَيْنِي وَبَيْنَكُمُ الْقُرْآنُ قَالَ اللهُ ﷻ لَا تُخْرِجُوهُنَّ مِنْ بُيُوتِهِنَّ وَلَا يَخْرُجْنَ إِلَّا أَنْ يَأْتِينَ بِفَاحِشَةٍ مُبَيِّنَةٍ حَتَّى بَلَغَ {لَا تَدْرِي لَعَلَّ اللهَ يُحْدِثُ بَعْدَ ذَلِكَ أَمْرًا} [الطلاق 1] قَالَتْ هَذَا لِمَنْ كَانَتْ لَهُ مُرَاجَعَةٌ فَأِيُّ أَمْرٍ يَحْدُثُ بَعْدَ الثَّلَاثِ فَكَيْفَ تَقُولُونَ لَا نَفَقَةَ لَهَا إِذَا لَمْ تَكُنْ حَامِلًا فَعَلَامَ تَحْبِسُونَهَا؟
[Machine] "So I gathered my clothes and went to the Prophet ﷺ. He asked me, 'How many times did your husband divorce you?' I replied, 'Three times.' He said, 'It is true that you are no longer entitled to any provision. Prepare yourself to stay in the house of Ibn Umm Maktum, where you can put aside your clothes.'"
فَجَمَعْتُ عَلَيَّ ثِيَابِي فَأَتَيْتُ النَّبِيَّ ﷺ فَقَالَ كَمْ طَلَّقَكِ؟ فَقُلْتُ ثَلَاثًا فَقَالَ صَدَقَ لَا نَفَقَةَ لَكِ اعْتَدِّي فِي بَيْتِ ابْنِ أُمِّ مَكْتُومٍ تَضَعِينَ عَنْكِ ثِيَابَكِ
[Machine] About the divorce of the wife of the Prophet ﷺ , she said, "Her husband divorced her talaq." She said, "So I argued with him in front of the Messenger of Allah ﷺ about housing and financial support." She said, "He did not assign me a house or financial support and he ordered me to reside in the house of Ibn Umm Maktum."
عَنْ قَضَاءِ رَسُولِ اللهِ ﷺ عَلَيْهَا فَقَالَتْ طَلَّقَهَا زَوْجُهَا الْبَتَّةَ قَالَتْ فَخَاصَمْتُهُ إِلَى رَسُولِ اللهِ ﷺ فِي السُّكْنَى وَالنَّفَقَةِ قَالَتْ فَلَمْ يَجْعَلْ لِي سُكْنَى وَلَا نَفَقَةً وَأَمَرَنِي أَنْ اعْتَدَّ فِي بَيْتِ ابْنِ أُمِّ مَكْتُومٍ
[Machine] My husband divorced me three times, and the Messenger of Allah ﷺ did not grant me a dwelling or provision.
طَلَّقَنِي زَوْجِي ثَلَاثًا فَلَمْ يَجْعَلْ لِي رَسُولُ اللهِ ﷺ سُكْنَى وَلَا نَفَقَةً
[Machine] The Prophet ﷺ said to Fatimah bint Qays, "O Fatimah, indeed, the residence and provisions belong to the one upon whom returning to her husband is required." This is the statement presented by Al-Aswad ibn 'Amir, although the authentic narration is the first one. The sheikh narrated from a group, from Abu Salamah ibn 'Abdul Rahman, from Fatimah bint Qays regarding the negation of the provisions but not the residence. The same narration was also reported by 'Ubaidullah ibn 'Abdullah ibn 'Utbah from Fatimah, and in the narration of some of them from Abu Salamah, as well as in the narrations of Al-Sha'bi and Al-Bahiy. All of them agreed upon her negation. There was a difference of opinion concerning Abu Bakr ibn Abi Al-Jahm's narration from Fatimah. It is most likely that the context of the hadith states that the Prophet ﷺ denied her provisions and allowed her to move due to a reason, perhaps out of shyness from mentioning it, while others have mentioned it previously in the book of "Al-Adad" (numbers). And the negation of the residence was not mentioned initially, is it not clear to you? ﷺ did not say to her, "Go wherever you want," but rather he protected her where he thought best, when her husband was absent and she had no guardian to protect her. As for his statement, "Indeed, the residence and provisions belong to the one upon whom returning to her husband is required," it is not known from the perspective that confirms it. As for the denial of those who denied it to Fatimah, it is only due to their silence being the cause of its transmission.
النَّبِيَّ ﷺ قَالَ لِفَاطِمَةَ بِنْتِ قَيْسٍ يَا فَاطِمَةُ إِنَّمَا السُّكْنَى وَالنَّفَقَةُ لِمَنْ كَانَ لِزَوْجِهَا عَلَيْهَا الرَّجْعَةُ كَذَا أَتَى بِهِ الْأَسْوَدُ بْنُ عَامِرٍ شَاذَانُ وَالصَّحِيحُ هُوَ الْأَوَّلُ قَالَ الشَّيْخُ رِوَايَةُ الْجَمَاعَةِ عَنْ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ عَنْ فَاطِمَةَ بِنْتِ قَيْسٍ فِي نَفْيِ النَّفَقَةِ دُونَ السُّكْنَى وَكَذَلِكَ رِوَايَةُ عُبَيْدِ اللهِ بْنِ عَبْدِ اللهِ بْنِ عُتْبَةَ عَنْ فَاطِمَةَ وَفِي رِوَايَةِ بَعْضِهِمْ عَنْ أَبِي سَلَمَةَ وَفِي رِوَايَةِ الشَّعْبِيِّ وَالْبَهِيِّ نَفْيُهُمَا جَمِيعًا وَاخْتُلِفَ فِيهِ عَلَى أَبِي بَكْرِ بْنِ أَبِي الْجَهْمِ عَنْ فَاطِمَةَ وَالْأَشْبَهُ بِسِيَاقِ الْحَدِيثِ أَنَّ النَّبِيَّ ﷺ نَفَى النَّفَقَةَ وَأَذِنَ لَهَا فِي الِانْتِقَالِ لِعِلَّةٍ لَعَلَّهَا اسْتَحَيَتْ مِنْ ذِكْرِهَا وَقَدْ ذَكَرَهَا غَيْرُهَا عَلَى مَا قَدَّمْنَا ذِكْرَهَا فِي كِتَابِ الْعِدَدِ وَلَمْ يَرِدْ نَفْيُ السُّكْنَى أَصْلًا أَلَا تَرَاهُ ﷺ لَمْ يَقُلْ لَهَا اعْتَدِّي حَيْثُ شِئْتِ وَلَكِنَّهُ حَصَنَهَا حَيْثُ رَضِيَ إِذْ كَانَ زَوْجُهَا غَائِبًا وَلَمْ يَكُنْ لَهُ وَكِيلٌ يُحْصِنُهَا وَأَمَّا قَوْلُهُ إِنَّمَا السُّكْنَى وَالنَّفَقَةُ لِمَنْ كَانَتْ عَلَيْهِ رَجْعَةٌ فَلَيْسَ بِمَعْرُوفٍ فِي هَذَا الْحَدِيثِ وَلَمْ يَرِدْ مِنْ وَجْهٍ يُثْبِتُ مِثْلَهُ وَأَمَّا إِنْكَارُ مَنْ أَنْكَرَ عَلَى فَاطِمَةَ فَإِنَّمَا هُوَ لِكِتْمَانِهَا السَّبَبَ فِي نَقْلِهَا
[Machine] She was being defiant in her husband's house, so I said, "What happened to the incident of Fatimah bint Qays?" He said, "Here it is." And he described that she became angry and said, "Fatimah was causing trouble among the people with her tongue and she exceeded the limits with her remarks." So the Messenger of Allah ﷺ ordered her to stay in the house of the son of Umm Maktoom, and so it was.
تَعْتَدُّ فِي بَيْتِ زَوْجِهَا فَقُلْتُ فَأَيْنَ حَدِيثُ فَاطِمَةَ بِنْتِ قَيْسٍ؟ فَقَالَ هَاهْ وَوَصَفَ أَنَّهُ تَغَيَّظَ وَقَالَ فَتَنَتْ فَاطِمَةُ النَّاسَ كَانَتْ بِلِسَانِهَا ذَرَّابَةً فَاسْتَطَالَتْ عَلَى أَحْمَائِهَا فَأَمَرَهَا رَسُولُ اللهِ ﷺ أَنْ تَعْتَدَّ فِي بَيْتِ ابْنِ أُمِّ مَكْتُومٍ وَكَذَلِكَ
ابْنُ عَبَّاسٍ أَصَبْتَ يَا ابْنَ أَخِي أَنَا مَعَكَ
[Machine] "He heard him say that the expenditure of the divorced woman is not prohibited as long as she is not forbidden, but if she is forbidden, then there is provision according to custom."
أَنَّهُ سَمِعَهُ يَقُولُ نَفَقَةُ الْمُطَلَّقَةِ مَا لَمْ تُحَرَّمْ فَإِذَا حُرِّمَتْ فَمَتَاعٌ بِالْمَعْرُوفِ
[Machine] "He spends on her for the sake of the relationship, so if it is not a marital relationship, then there is no expenditure for her. And Allah knows best."
أَنَّهُ يُنْفِقُ عَلَيْهَا مِنْ أَجْلِ الْحَبَلِ فَإِذَا كَانَتْ غَيْرَ حُبْلَى فَلَا نَفَقَةَ لَهَا وَاللهُ أَعْلَمُ
