49. Chapter
٤٩۔ كِتَابُ النَّفَقَاتِ
[Machine] Her husband divorced her three times, and the Prophet ﷺ did not permit her to live with him or provide for her. So, I mentioned this to Ibrahim, and Ibrahim said, "Umar ibn Al-Khattab said, 'We do not forsake the book of our Lord and the Sunnah of our Prophet ﷺ based on the words of a woman concerning housing and financial support, which was narrated by Ash-Sha'bi."
أَنَّ زَوْجَهَا طَلَّقَهَا ثَلَاثًا فَلَمْ يَرَ لَهَا النَّبِيُّ ﷺ السُّكْنَى وَلَا النَّفَقَةَ قَالَ فَذَكَرْتُ ذَلِكَ لِإِبْرَاهِيمَ فَقَالَ إِبْرَاهِيمُ قَالَ عُمَرُ بْنُ الْخَطَّابِ ؓ لَا نَدَعُ كِتَابَ رَبِّنَا وَسُنَّةَ نَبِيِّنَا لِقَوْلِ امْرَأَةٍ لَهَا السُّكْنَى وَالنَّفَقَةُ حَدِيثُ الشَّعْبِيِّ
[Machine] "Narrated by Umar, may Allah be pleased with him, as a connected and supported chain of narration."
عَنْ عُمَرَ ؓ مَوْصُولًا مُسْنَدًا
[Machine] Allah did not provide her with a dwelling or sustenance, so Aswad took a handful of pebbles and threw it at her, then he said: "Woe to you! Are you talking about something like this?" Umar said: "We will not leave the Book of Allah and the Sunnah of our Prophet ﷺ for the statement of a woman, whether she remembered or forgot about her dwelling and sustenance." Allah the Almighty said: "Do not evict them from their houses, nor should they leave, unless they commit open immorality." [Surah Al-Talaq, 1]
اللهِ ﷺ لَمْ يَجْعَلْ لَهَا سُكْنَى وَلَا نَفَقَةً فَأَخَذَ الْأَسْوَدُ كَفًّا مِنْ حَصًى فَحَصَبَهُ ثُمَّ قَالَ وَيْحَكَ تُحَدِّثُ بِمِثْلِ هَذَا؟ قَالَ عُمَرُ ؓ لَا نَتْرُكُ كِتَابَ اللهِ وَسُنَّةَ نَبِيِّنَا ﷺ لِقَوْلِ امْرَأَةٍ لَا نَدْرِي حَفِظَتْ أَوْ نَسِيَتْ لَهَا السُّكْنَى وَالنَّفَقَةُ قَالَ اللهُ تَعَالَى {لَا تُخْرِجُوهُنَّ مِنْ بُيُوتِهِنَّ وَلَا يَخْرُجْنَ إِلَّا أَنْ يَأْتِينَ بِفَاحِشَةٍ مُبَيِّنَةٍ} [الطلاق 1]
