49. Chapter
٤٩۔ كِتَابُ النَّفَقَاتِ
يَقْتُلُ اثْنَيْنِ بِوَاحِدٍ
[Machine] In his saying "We have made for his ally authority" [Al-Isra 33], he said a way against it "So, let him not exceed in killing." [Al-Isra 33]. He said, "One should not kill two with one." Al-Shafi'i said, and it is said in his saying "So, let him not exceed in killing." [Al-Isra 33], he said, "Do not kill other than the killer." And this is similar to what was said, and Allah knows best.
فِي قَوْلِهِ {فَقَدْ جَعَلْنَا لِوَلِيِّهِ سُلْطَانًا} [الإسراء 33] قَالَ سَبِيلًا عَلَيْهِ {فَلَا يُسْرِفْ فِي الْقَتْلِ} [الإسراء 33] قَالَ لَا يَقْتُلِ اثْنَيْنِ بِوَاحِدٍ قَالَ الشَّافِعِيُّ وَقِيلَ فِي قَوْلِهِ {فَلَا يُسْرِفْ فِي الْقَتْلِ} [الإسراء 33] قَالَ لَا يَقْتُلْ غَيْرَ قَاتِلِهِ وَهَذَا يُشْبِهُ مَا قِيلَ وَاللهُ أَعْلَمُ
[Machine] "Do not kill except in self-defense, and do not harm with the same."
لَا يَقْتُلْ غَيْرَ قَاتِلِهِ وَلَا يُمَثِّلْ بِهِ
[Machine] In the times of ignorance, when a man from a tribe killed another man, they were not satisfied until they killed a nobleman in retaliation. But if the killer was not noble, they would not kill him and kill someone else instead. They were admonished by the saying of Allah, exalted be He: "And do not kill the soul which Allah has forbidden [to be killed] except by [legal] right. And whoever is killed unjustly - We have given his heir authority, but let him not exceed limits in [the matter of] taking life. Indeed, he has been supported [by the law]." (Quran 17:33) Zaid ibn Aslam said that excess is to kill someone other than the killer. Ash-Shafi'i said that Allah, exalted be He, said: "Prescribed for you is legal retribution for those murdered." (Quran 2:178)
أَنَّ النَّاسَ فِي الْجَاهِلِيَّةِ إِذَا قَتَلَ الرَّجُلُ مِنَ الْقَوْمِ رَجُلًا لَمْ يَرْضَوْا حَتَّى يَقْتُلُوا بِهِ رَجُلًا شَرِيفًا إِذَا كَانَ قَاتِلُهُمْ غَيْرَ شَرِيفٍ لَمْ يَقْتُلُوا قَاتِلَهُمْ وَقَتَلُوا غَيْرَهُ فَوُعِظُوا فِي ذَلِكَ بِقَوْلِ اللهِ تَبَارَكَ وَتَعَالَى {وَلَا تَقْتُلُوا النَّفْسَ الَّتِي حَرَّمَ اللهُ إِلَّا بِالْحَقِّ وَمَنْ قُتِلَ مَظْلُومًا فَقَدْ جَعَلْنَا لِوَلِيِّهِ سُلْطَانًا فَلَا يُسْرِفْ فِي الْقَتْلِ إِنَّهُ كَانَ مَنْصُورًا} [الإسراء 33] وَقَالَ زَيْدُ بْنُ أَسْلَمَ السَّرَفُ أَنْ يَقْتُلَ غَيْرَ قَاتِلِهِ قَالَ الشَّافِعِيُّ قَالَ اللهُ تَبَارَكَ وَتَعَالَى {كُتِبَ عَلَيْكُمُ الْقِصَاصُ فِي الْقَتْلَى} [البقرة 178] الْآيَةَ
[Machine] About the saying of Qatadah on the verse {O you who have believed, prescribed for you is legal retribution for those murdered— the free for the free, the slave for the slave, and the female for the female} [Al-Baqarah 178], he said, "The people of ignorance among them used to have aggression and obedience to Satan. So, when there was among them a number and quality, a slave of theirs would be killed by the slave of another people, they would say, 'We will only kill a free person in retaliation, to assert our superiority and preferential treatment over others in themselves.' And when a female of theirs was killed by another woman, they would say, 'We will only kill a man in retaliation.' So Allah revealed this verse to inform them that retaliation is for the slave, the free, and the female. And He prohibited them from aggression. Then He revealed Surat Al-Ma'idah and said, {And We ordained therein for them: a life for a life, an eye for an eye, a nose for a nose, an ear for an ear, a tooth for a tooth, and for wounds is legal retribution} [Al-Ma'idah 45]."
عَنْ قَتَادَةَ فِي قَوْلِهِ {يَا أَيُّهَا الَّذِينَ آمَنُوا كُتِبَ عَلَيْكُمُ الْقِصَاصُ فِي الْقَتْلَى الْحُرُّ بِالْحُرِّ وَالْعَبْدُ بِالْعَبْدِ وَالْأُنْثَى بِالْأُنْثَى} [البقرة 178] قَالَ كَانَ أَهْلُ الْجَاهِلِيَّةِ فِيهِمْ بَغْيٌ وَطَاعَةٌ لِلشَّيْطَانِ فَكَانَ الْحِيُّ فِيهِمْ إِذَا كَانَ فِيهِمْ عَدَدٌ وَعُدَّةٌ فَقُتِلَ لَهُمْ عَبْدٌ قَتَلَهُ عَبْدُ قَوْمٍ آخَرِينَ قَالُوا لَا نَقْتُلُ بِهِ إِلَّا حُرًّا تَعَزُّزًا وَتَفَضُّلًا عَلَى غَيْرِهِمْ فِي أَنْفُسِهِمْ وَإِذَا قُتِلَتْ لَهُمْ أُنْثَى قَتَلَتْهَا امْرَأَةٌ قَالُوا لَنْ نَقْتُلَ بِهَا إِلَّا رَجُلًا فَأَنْزَلَ اللهُ ﷻ هَذِهِ الْآيَةَ يُخْبِرُهُمْ أَنَّ الْعَبْدَ بِالْعَبْدِ وَالْحُرَّ بِالْحُرِّ وَالْأُنْثَى بِالْأُنْثَى وَنَهَاهُمْ عَنِ الْبَغْيِ ثُمَّ أَنْزَلَ سُورَةَ الْمَائِدَةِ فَقَالَ {وَكَتَبْنَا عَلَيْهِمْ فِيهَا أَنَّ النَّفْسَ بِالنَّفْسِ وَالْعَيْنَ بِالْعَيْنِ وَالْأَنْفَ بِالْأَنْفِ وَالْأُذُنَ بِالْأُذُنِ وَالسِّنَّ بِالسِّنِّ وَالْجُرُوحَ قِصَاصٌ} [المائدة 45]
[Machine] In his statement "Retribution is written upon you for the slain" [Al-Baqarah: 178], it is stated that this was applied in two tribes of the Arab before Islam, where they fought each other and killed each other before they embraced Islam. Some of them had disputes and killings, so they sought this in Islam. One of the two tribes had a favor over the other, so they swore by Allah that they would kill the men and free the women and slaves. When this verse was revealed, they were satisfied and submitted. Abu Abdullah Al-Hafiz informed us, Abu Al-Abbas Muhammad Ibn Ya'qub informed us, Al-Rabi' Ibn Sulaiman informed us, Al-Shafi'i informed us, Mu'adh Ibn Musa narrated from Bukayr Ibn Ma'ruf from Muqatil Ibn Hayyan who said: "I received this interpretation from a group including Mu'adh, Mujahid, Dahaak, and Al-Hasan. They mentioned its meaning except that they did not mention the statement 'and some of them upon others are scratches and killing.' Al-Shafi'i said: 'Their statement is not similar to what they have said because Allah, may He be exalted, only made each sinner responsible for his sin and did not make one guilty for another. Then he said that it has been reported from the Prophet ﷺ that the one who kills without being a combatant is the most hostile person to Allah.'"
فِي قَوْلِهِ {كُتِبَ عَلَيْكُمُ الْقِصَاصُ فِي الْقَتْلَى} [البقرة 178] الْآيَةَ قَالَ كَانَ بُدُوُّ ذَلِكَ فِي حَيَّيْنِ مِنْ أَحْيَاءِ الْعَرَبِ اقْتَتَلُوا قَبْلَ الْإِسْلَامِ بِقَلِيلٍ ثُمَّ أَسْلَمُوا وَلِبَعْضِهِمْ عَلَى بَعْضٍ خُمَاشَاتٌ وَقَتْلٌ فَطَلَبُوهَا فِي الْإِسْلَامِ وَكَانَ لِأَحَدِ الْحَيَّيْنِ فَضْلٌ عَلَى الْآخَرِ فَأَقْسَمُوا بِاللهِ لَيُقْتَلَنَّ بِالْأُنْثَى الذَّكَرُ مِنْهُمْ وَبِالْعَبْدِ الْحُرُّ مِنْهُمْ فَلَمَّا نَزَلَتْ هَذِهِ الْآيَةُ رَضُوا وَسَلَّمُوا 15892 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا الرَّبِيعُ بْنُ سُلَيْمَانَ ثنا الشَّافِعِيُّ أنبأ مُعَاذُ بْنُ مُوسَى عَنْ بُكَيْرِ بْنِ مَعْرُوفٍ عَنْ مُقَاتِلِ بْنِ حَيَّانَ قَالَ مُقَاتِلٌ أَخَذْتُ هَذَا التَّفْسِيرَ عَنْ نَفَرٍ حَفِظَ مُعَاذٌ مِنْهُمْ مُجَاهِدًا وَالضَّحَّاكَ وَالْحَسَنَ فَذَكَرَ مَعْنَاهُ إِلَّا أَنَّهُ لَمْ يَذْكُرْ قَوْلَهُ وَلِبَعْضِهِمْ عَلَى بَعْضٍ خُمَاشَاتٌ وَقَتْلٌ قَالَ الشَّافِعِيُّ وَمَا أَشْبَهَ مَا قَالُوا مِنْ هَذَا بِمَا قَالُوا لِأَنَّ اللهَ تَعَالَى إِنَّمَا أَلْزَمَ كُلَّ مُذْنِبٍ ذَنْبَهُ وَلَمْ يَجْعَلْ جُرْمَ أَحَدٍ عَلَى غَيْرِهِ ثُمَّ سَاقَ الْكَلَامَ إِلَى أَنْ قَالَ وَقَدْ جَاءَ عَنِ النَّبِيِّ ﷺ أَعْدَى النَّاسِ عَلَى اللهِ مَنْ قَتَلَ غَيْرَ قَاتِلِهِ
[Machine] "That the Messenger of Allah ﷺ said, 'The strongest of people in the sight of Allah is the one who kills someone other than his killer, or seeks blood revenge during the times of ignorance while being a Muslim, or blinds his two eyes as long as they are not blind.'"
أَنَّ رَسُولَ اللهِ ﷺ قَالَ أَعْتَى النَّاسِ عَلَى اللهِ مَنْ قَتَلَ غَيْرَ قَاتِلِهِ أَوْ طَلَبَ بِدَمٍ فِي الْجَاهِلِيَّةِ مِنْ أَهْلِ الْإِسْلَامِ أَوْ بَصَّرَ عَيْنَيْهِ مَا لَمْ تُبْصِرَا
[Machine] In the list of the Prophet's sword, a book was found that stated that the worst enemies of Allah are those who kill without being killed, who harm without being harmed, and those who betray without being loyal. Whoever supports them has disbelieved in what Allah has revealed to Muhammad.
وُجِدَ فِي قَائِمِ سَيْفِ رَسُولِ اللهِ ﷺ كِتَابٌ إِنَّ أَعْدَى النَّاسِ عَلَى اللهِ وَفِي حَدِيثِ سُلَيْمَانِ إِنَّ أَعْتَى النَّاسِ عَلَى اللهِ الْقَاتِلُ غَيْرَ قَاتِلِهِ وَالضَّارِبُ غَيْرَ ضَارِبِهِ وَمَنْ تَوَلَّى غَيْرَ مَوَالِيهِ فَقَدْ كَفَرَ بِمَا أَنْزَلَ اللهُ عَلَى مُحَمَّدٍ ﷺ
[Machine] I asked Abu Ja'far Muhammad ibn Ali about what was in the scroll that was with the Messenger of Allah. He said, "In it, Allah cursed the killer who is not the one intended to be killed, and the striker who is not the one intended to be struck, and whoever supports someone other than his benefactor has disbelieved in what Allah has revealed to Muhammad."
قُلْتُ لِأَبِي جَعْفَرٍ مُحَمَّدِ بْنِ عَلِيٍّ مَا كَانَ فِي الصَّحِيفَةِ الَّتِي كَانَتْ فِي قِرَابِ رَسُولِ اللهِ ﷺ؟ فَقَالَ كَانَ فِيهَا لَعَنَ اللهُ الْقَاتِلَ غَيْرَ قَاتِلِهِ وَالضَّارِبَ غَيْرَ ضَارِبِهِ وَمَنْ تَوَلَّى غَيْرَ وَلِيِّ نِعْمَتِهِ فَقَدْ كَفَرَ بِمَا أَنْزَلَ اللهُ عَلَى مُحَمَّدٍ ﷺ
[Machine] Two books were found in the inventory of the Prophet's ﷺ sword, which stated that the most unjust of people is the one who strikes someone who did not strike him, and the one who kills someone who did not kill him, and the one who withholds his blessings from someone who deserves them. Whoever does that has disbelieved in Allah and His Messenger. Allah does not accept any payment or justice from him. The narration is from Malik ibn Muhammad ibn Abdur Rahman ibn Abi Rijal, who narrated from his father.
وُجِدَ فِي قَائِمِ سَيْفِ رَسُولِ اللهِ ﷺ كِتَابَانِ إِنَّ أَشَدَّ النَّاسِ عُتُوًّا الرَّجُلُ ضَرَبَ غَيْرَ ضَارِبِهِ وَرَجُلٌ قَتَلَ غَيْرَ قَاتِلِهِ وَرَجُلٌ تَوَلَّى غَيْرَ أَهْلِ نِعْمَتِهِ فَمَنْ فَعَلَ ذَلِكَ فَقَدْ كَفَرَ بِاللهِ وَرَسُولِهِ لَا يَقْبَلُ اللهُ مِنْهُ صَرْفًا وَلَا عَدْلًا وَذَكَرَ الْحَدِيثَ هُوَ مَالِكُ بْنُ مُحَمَّدِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ أَبِي الرِّجَالِ يَرْوِي عَنْ أَبِيهِ
[Machine] I entered with my father to the Messenger of Allah ﷺ, and my father saw someone on the back of the Messenger of Allah ﷺ. So he said, "Let me treat the person on your back, for I am a physician." The Messenger of Allah ﷺ said, "Are you a companion of his?" He said, "My son testifies with him." The Messenger of Allah ﷺ said, "Indeed, he does not benefit you, and you do not benefit him."
دَخَلْتُ مَعَ أَبِي عَلَى رَسُولِ اللهِ ﷺ فَرَأَى أَبِي الَّذِي بِظَهْرِ رَسُولِ اللهِ ﷺ فَقَالَ دَعْنِي أُعَالِجُ الَّذِي بِظَهْرِكَ فَإِنِّي طَبِيبٌ فَقَالَ أَنْتَ رَفِيقٌ قَالَ رَسُولُ اللهِ ﷺ مَنْ هَذَا مَعَكَ؟ قَالَ ابْنِي أَشْهَدُ بِهِ فَقَالَ أَمَا إِنَّهُ لَا يَجْنِي عَلَيْكَ وَلَا تَجْنِي عَلَيْهِ
[Machine] I came to the Messenger of Allah ﷺ with my father, and the Messenger of Allah ﷺ met us on the way. My father said to me, "O my son, do you know who this approaching person is?" I said, "No." He said, "This is the Messenger of Allah ﷺ ." I was amazed when he said that because I thought he did not resemble other people. But there he was, a man with abundant hair, wearing a cloak made of fine linen and wearing two green garments. My father greeted him with peace and he returned the greeting. Then my father asked him, "Is he your son?" He replied, "Yes, by the Lord of the Kaaba." The Messenger of Allah ﷺ smiled from the resemblance of me to my father and from my father's oath regarding me. Then he said, "Indeed, there is no accountability upon you for him, nor is there accountability upon him for you." Then the Messenger of Allah ﷺ recited the verse, "And no bearer of burdens will bear the burden of another." [Surah Al-An'am: 164]
أَتَيْتُ رَسُولَ اللهِ ﷺ مَعَ أَبِي فَتَلَقَّانَا رَسُولُ اللهِ ﷺ فِي طَرِيقِهِ فَقَالَ لِي أَبِي يَا بُنِيَّ هَلْ تَدْرِي مَنْ هَذَا الْمُقْبِلُ؟ قُلْتُ لَا قَالَ هَذَا رَسُولُ اللهِ ﷺ قَالَ فَاقْشَعْرَرْتُ حِينَ قَالَ ذَاكَ وَذَلِكَ أَنِّي ظَنَنْتُ أَنَّهُ لَا يُشْبِهُ النَّاسَ فَإِذَا هُوَ بَشَرٌ ذُو وَفْرَةٍ عَلَيْهِ رَدْعٌ مِنْ حِنَّاءٍ وَعَلَيْهِ ثَوْبَانِ أَخْضَرَانِ فَسَلَّمَ عَلَيْهِ أَبِي فَرَدَّ عَلَيْهِ السَّلَامَ ثُمَّ قَالَ ابْنُكَ هَذَا؟ قَالَ إِي وَرَبِّ الْكَعْبَةِ فَتَبَسَّمَ رَسُولُ اللهِ ﷺ مِنْ ثَبْتِ شَبَهِي بِأَبِي وَمِنْ حَلِفِ أَبِي عَلَيَّ ثُمَّ قَالَ أَمَا إِنَّهُ لَا يَجْنِي عَلَيْكَ وَلَا تَجْنِي عَلَيْهِ ثُمَّ تَلَا رَسُولُ اللهِ ﷺ {وَلَا تَزِرُ وَازِرَةٌ وِزْرَ أُخْرَى} [الأنعام 164]
[Machine] I heard the Messenger of Allah ﷺ saying during the Farewell Hajj, "Which day has the greatest sanctity?" They replied, "This day of ours or the Day of Arafah." He said, "Indeed, your blood, your wealth, and your honor are sacred to you, just as the sanctity of this day of yours is sacred, in this land of yours. Behold! Let it not be that a revert to paganism after me should take someone's life, or take his property. An offspring may seek compensation for an injury, but no parent can seek compensation for a harm inflicted upon his child or offspring."
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ فِي حَجَّةِ الْوَدَاعِ أِيُّ يَوْمٍ أَعْظَمُ حُرْمَةً؟ قَالُوا يَوْمُنَا هَذَا أَوْ يَوْمُ الْحَجِّ الْأَكْبَرِ قَالَ فَإِنَّ دِمَاءَكُمْ وَأَمْوَالَكُمْ وَأَعْرَاضَكُمْ حَرَامٌ كَحُرْمَةِ يَوْمِكُمْ وَبَلَدِكُمْ أَلَا لَا يَجْنِي جَانٍ إِلَّا عَلَى نَفْسِهِ لَا يَجْنِي وَالِدٌ عَلَى وَلَدِهِ وَلَا مَوْلُودٌ عَلَى وَالِدِهِ
[Machine] Some people from the Banu Tha'laba bin Yarbua came to the Messenger of Allah ﷺ and they had caused harm to a companion of the Messenger of Allah ﷺ . A man said to the Messenger of Allah ﷺ , "O Messenger of Allah, the Banu Tha'laba bin Yarbua killed so-and-so." The Messenger of Allah ﷺ said, "One soul should not be harmed because of another." Shu'ba narrated this from a man from the Banu Tha'laba, and Ath-Thawri narrated it from Tha'laba bin Zahdam.
أَنَّ نَاسًا مِنْهُمْ أَتَوْا رَسُولَ اللهِ ﷺ وَكَانَتْ بَنُو ثَعْلَبَةَ بْنُ يَرْبُوعٍ أَصَابُوا رَجُلًا مِنْ أَصْحَابِ رَسُولِ اللهِ ﷺ فَقَالَ رَجُلٌ يَا رَسُولَ اللهِ هَؤُلَاءِ بَنُو ثَعْلَبَةَ بْنِ يَرْبُوعٍ قَتَلَتْ فُلَانًا فَقَالَ رَسُولُ اللهِ ﷺ لَا تَجْنِي نَفْسٌ عَلَى أُخْرَى هَكَذَا قَالَ شُعْبَةُ عَنْ رَجُلٍ مِنْ بَنِي ثَعْلَبَةَ وَقَالَ الثَّوْرِيُّ عَنْ ثَعْلَبَةَ بْنِ زَهْدَمٍ
[Machine] That his father, Malik, his uncles Qais and Ubaid, from the Banu Khushkhash tribe, came to the Prophet ﷺ and complained to him about a raid by a group of their cousins on the people. So the Messenger of Allah ﷺ wrote them a letter saying, "This is a letter from Muhammad, the Messenger of Allah, to Malik, Qais, and Ubaid, from the Banu Khushkhash tribe. Indeed, you are safe and protected. Your lives and wealth are not to be taken except by your own consent, and no harm shall come upon you except from your own hands."
أَنَّ أَبَاهُ مَالِكًا وَعَمَّيْهِ قَيْسًا وَعُبَيْدًا بَنِي الْخَشْخَاشِ أَتَوَا النَّبِيَّ ﷺ فَشَكَوْا إِلَيْهِ غَارَةَ خَيْلٍ مِنْ بَنِي عَمِّهِمْ عَلَى النَّاسِ فَكَتَبَ لَهُمْ رَسُولُ اللهِ ﷺ هَذَا كِتَابٌ مِنْ مُحَمَّدٍ رَسُولِ اللهِ ﷺ لِمَالِكٍ وَقَيْسٍ وَعُبَيْدٍ بَنِي الْخَشْخَاشِ إِنَّكُمْ آمِنُونَ مَسَلَّمُونَ عَلَى دِمَائِكُمْ وَأَمْوَالِكُمْ لَا تُؤْخَذُونَ بِجَرِيرَةِ غَيْرِكُمْ وَلَا تَجْنِي عَلَيْكُمْ إِلَّا أَيْدِيكُمْ
The Prophet ﷺ said, "The most hated persons to Allah are three: (1) A person who deviates from the right conduct, i.e., an evil doer, in the Haram (sanctuaries of Mecca and Medina); (2) a person who seeks that the traditions of the Pre-lslamic Period of Ignorance, should remain in Islam (3) and a person who seeks to shed somebody's blood without any right." عَنِ النَّبِيِّ ﷺ قَالَ أَبْغَضُ النَّاسِ إِلَى اللهِ مُلْحِدٌ فِي الْحَرَمِ وَمُبْتَغٍ فِي الْإِسْلَامِ سُنَّةَ الْجَاهِلِيَّةِ وَمُطَّلِبُ دَمِ امْرِئٍ بِغَيْرِ حَقٍّ لِيُهَرِيقَ دَمَهُ
