٥٧۔ كِتَابُ الْأَشْرِبَةِ وَالْحَدُّ فِيهَا ص ٤
[Machine] "Aisha was among some women from the people of cities, so they began asking her about certain situations. She said, 'You are asking about situations that were not forbidden during the time of the Messenger of Allah ﷺ , such as being prohibited from every intoxicant, and even if one of you were to become intoxicated by the water of its beloved.'"
عَلَى عَائِشَةَ ؓ فِي نِسْوَةٍ مِنْ أَهْلِ الْأَمْصَارِ فَجَعَلْنَ يَسْأَلْنَهَا عَنِ الظُّرُوفِ فَقَالَتْ تَسْأَلْنَ عَنْ ظُرُوفٍ مَا كَانَتْ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ أَنْهَاكُنَّ عَنْ كُلِّ مُسْكِرٍ وَإِنْ أَسْكَرَ إِحْدَاكُنَّ مَاءُ حِبِّهَا
57.13 [Machine] Prohibition of polluting water sources
٥٧۔١٣ بَابُ النَّهْيِ عَنِ اخْتِنَاثِ الْأَسْقِيَةِ
[Machine] The Messenger of Allah ﷺ forbade the practice of cross-dressing.
أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنِ اخْتِنَاثِ الْأَسْقِيَةِ
[Machine] From the Prophet ﷺ, he prohibited the act of drinking from the spouts of the water vessels.
عَنِ النَّبِيِّ ﷺ أَنَّهُ نَهَى عَنِ اخْتِنَاثِ الْأَسْقِيَةِ أَنْ يُشْرَبَ مِنْ أَفْوَاهِهَا
[Machine] The Prophet ﷺ prohibited a man from drinking from the water container. Ayub reported that he was informed that a man drank from the water container and a snake came out.
عَنِ النَّبِيِّ ﷺ أَنَّهُ نَهَى أَنْ يَشْرَبَ الرَّجُلُ مِنْ فِي السِّقَاءِ قَالَ أَيُّوبُ نُبِّئْتُ أَنَّ رَجُلًا شَرِبَ مِنْ فِي السِّقَاءِ فَخَرَجَتْ حَيَّةٌ
57.14 [Machine] What is the obligation on someone who drinks wine or intoxicating liquor?
٥٧۔١٤ بَابُ مَا جَاءَ فِي وُجُوبِ الْحَدِّ عَلَى مَنْ شَرِبَ خَمْرًا أَوْ نَبِيذًا مُسْكِرًا
[Machine] It is reported that the Prophet ﷺ was brought Al-Nu'ayman or his son while he was drunk. He then caused a great inconvenience to the Messenger of Allah ﷺ Then he ordered those who were in the house to beat him, so they beat him with their sandals and slippers. I was one of those who beat him.
أَنَّ النَّبِيَّ ﷺ أُتِيَ بِالنُّعَيْمَانِ أَوِ ابْنِ النُّعَيْمَانِ وَهُوَ سَكْرَانُ قَالَ فَشَقَّ عَلَى رَسُولِ اللهِ ﷺ مَشَقَّةً شَدِيدَةً ثُمَّ أَمَرَ مَنْ كَانَ فِي الْبَيْتِ أَنْ يَضْرِبُوهُ فَضَرَبُوهُ بِالنِّعَالِ وَالْجَرِيدِ قَالَ فَكُنْتُ فِي مَنْ ضَرَبَهُ
[Machine] The Prophet ﷺ was brought a man who had been drinking. The Messenger of Allah ﷺ said, "Strike him!" The man asked, "Shall I be struck by one of us with his hand, or by one of us with his slipper, or by one of us with his garment?" After the man left, some of the people said, "May Allah humiliate you!" The Messenger of Allah ﷺ said, "Do not say that and do not assist Satan against him. Instead, say, 'May Allah have mercy on you.'"
أُتِيَ النَّبِيُّ ﷺ بِرَجُلٍ قَدْ شَرِبَ فَقَالَ رَسُولُ اللهِ ﷺ اضْرِبُوهُ قَالَ فَمِنَّا الضَّارِبُ بِيَدِهِ وَمِنَّا الضَّارِبُ بِنَعْلِهِ وَمِنَّا الضَّارِبُ بِثَوْبِهِ فَلَمَّا انْصَرَفَ قَالَ بَعْضُ الْقَوْمِ أَخْزَاكَ اللهُ قَالَ رَسُولُ اللهِ ﷺ لَا تَقُولُوا هَكَذَا وَلَا تُعِينُوا الشَّيْطَانَ عَلَيْهِ وَلَكِنْ قُولُوا رَحِمَكَ اللهُ
[Machine] That the Prophet Muhammad ﷺ was brought a man with a disheveled hair and the Prophet ﷺ commanded his companions to hit him. Some of them hit him with their shoes, some with their hands, and some with their clothes. Then he said to them to stop and ordered them to cry for him. They started crying, and they said, "Are you not ashamed to do this in front of the Messenger of Allah ﷺ ?" Then he sent the man away. When the man turned away, people started cursing and scolding him. The one who was speaking said, "O Allah, humiliate him! O Allah, curse him!" The Messenger of Allah ﷺ said, "Do not say such things, but say, 'O Allah, forgive him! O Allah, have mercy on him!'"
أَنَّ النَّبِيَّ ﷺ أُتِيَ بِشَارِبٍ فَأَمَرَ النَّبِيُّ ﷺ أَصْحَابَهُ أَنْ يَضْرِبُوهُ فَمِنْهُمْ مَنْ ضَرَبَهُ بِنَعْلِهِ وَمِنْهُمْ بِيَدِهِ وَمِنْهُمْ بِثَوْبِهِ ثُمَّ قَالَ ارْجِعُوا ثُمَّ أَمَرَهُمْ فَبَكَتُوهُ فَقَالُوا أَلَا تَسْتَحِي؟ مَعَ رَسُولِ اللهِ ﷺ تَصْنَعُ هَذَا ثُمَّ أَرْسَلَهُ فَلَمَّا أَدْبَرَ وَقَعَ الْقَوْمُ يَدْعُونَ عَلَيْهِ وَيَسُبُّونَهُ يَقُولُ الْقَائِلُ اللهُمَّ أَخْزِهِ اللهُمَّ الْعَنْهُ فَقَالَ رَسُولُ اللهِ ﷺ لَا تَقُولُوا هَكَذَا ولَكِنْ قُولُوا اللهُمَّ اغْفِرْ لَهُ اللهُمَّ ارْحَمْهُ
During the lifetime of the Prophet ﷺ there was a man called ʿAbdullah whose nickname was Donkey, and he used to make Messenger of Allah ﷺ laugh. The Prophet ﷺ lashed him because of drinking (alcohol). And one-day he was brought to the Prophet ﷺ on the same charge and was lashed. On that, a man among the people said, "O Allah, curse him ! How frequently he has been brought (to the Prophet ﷺ on such a charge)!" The Prophet ﷺ said, "Do not curse him, for by Allah, I know for he loves Allah and His Apostle." أَنَّ رَجُلًا عَلَى عَهْدِ رَسُولِ اللهِ ﷺ كَانَ اسْمُهُ عَبْدُ اللهِ وَكَانَ يُلَقَّبُ حِمَارًا وَكَانَ يُضْحِكُ رَسُولَ اللهِ ﷺ وَكَانَ رَسُولُ اللهِ ﷺ قَدْ جَلَدَهُ فِي الشَّرَابِ فَأُتِيَ بِهِ يَوْمًا فَأَمَرَ بِهِ فَجُلِدَ فَقَالَ رَجُلٌ مِنَ الْقَوْمِ اللهُمَّ الْعَنْهُ مَا أَكْثَرَ مَا يُؤْتَى بِهِ فَقَالَ رَسُولُ اللهِ ﷺ لَا تَلْعَنْهُ فَوَاللهِ مَا عَلِمْتُ إِنَّهُ يُحِبُّ اللهَ وَرَسُولَهُ لَفْظُ حَدِيثِهِمَا سَوَاءٌ
عَنِ السَّائِبِ فَرَأَيْتُهُ يَحُدُّهُمْ
[Machine] Abdullah, I said by Allah, do not shave the heads of the people today, but enter and shave yours. At that time, they were shaving with Al-Hadd. So, he entered the house with me. Abdullah said, I shaved my brother with my own hand, then Amr bin al-As whipped the two of us. Then Umar bin al-Khattab heard about it, so he wrote to Amr bin al-As asking him to send Abdur Rahman bin Umar to him with a letter. Amr bin al-As did that, so when Abdur Rahman bin Umar arrived to Umar, he whipped and punished him for what he did. Then he sent him and he stayed for several months in good health. Then his fate came to him, and most people think that he died from the whipping of Umar, but he did not die from his whipping. The Sheikh, may Allah have mercy on him, said, by Allah, it is unlikely that he was whipped as a form of punishment, because there is no repetition of the punishment. And Allah knows best.
عَبْدُ اللهِ فَقُلْتُ وَاللهِ لَا تُحْلَقُ الْيَوْمَ عَلَى رُءُوسِ النَّاسِ ادْخُلْ أَحْلِقْكَ وَكَانُوا إِذْ ذَاكَ يَحْلِقُونَ مَعَ الْحَدِّ فَدَخَلَ مَعِيَ الدَّارَ قَالَ عَبْدُ اللهِ فَحَلَقْتُ أَخِي بِيَدِي ثُمَّ جَلَدَهُمَا عَمْرُو بْنُ الْعَاصِ فَسَمِعَ عُمَرُ بْنُ الْخَطَّابِ ؓ بِذَلِكَ فَكَتَبَ إِلَى عَمْرٍو أَنِ ابْعَثْ إِلِيَّ عَبْدَ الرَّحْمَنِ بْنَ عُمَرَ عَلَى قَتَبٍ فَفَعَلَ ذَلِكَ عَمْرٌو فَلَمَّا قَدِمَ عَبْدُ الرَّحْمَنِ عَلَى عُمَرَ ؓ جَلَدَهُ وَعَاقَبَهُ مِنْ أَجْلِ مَكَانِهِ مِنْهُ ثُمَّ أَرْسَلَهُ فَلَبِثَ أَشْهُرًا صَحِيحًا ثُمَّ أَصَابَهُ قَدَرُهُ فَيَحْسَبُ عَامَّةُ النَّاسِ أَنَّهُ مَاتَ مِنْ جَلْدِ عُمَرَ وَلَمْ يَمُتْ مِنْ جِلْدِهِ قَالَ الشَّيْخُ رَحِمَهُ اللهُ وَالَّذِي يُشْبِهُ أَنَّهُ جَلَدَهُ جَلْدَ تَعْزِيرٍ فَإِنَّ الْحَدَّ لَا يُعَادُ وَاللهُ أَعْلَمُ
[Machine] I do not give the punishment of whipping to a man who drinks alcohol or intoxicating wine, except if it is mandated by law.
لَا أُوتَى بِرَجُلٍ شَرِبَ خَمْرًا وَلَا نَبِيذًا مُسْكِرًا إِلَّا جَلَدْتُهُ الْحَدَّ
[Machine] The Messenger of Allah, ﷺ , said: "Flog (lash) in small and large amounts of alcohol, as both its beginning and end are prohibited."
رَسُولَ اللهِ ﷺ قَالَ اجْلِدُوا فِي قَلِيلِ الْخَمْرِ وَكَثِيرِهِ فَإِنَّ أَوَّلَهَا وَآخِرَهَا حَرَامٌ
57.15 [Machine] Who was subjected to the punishment four times and then had it returned to him?
٥٧۔١٥ بَابُ مَنْ أُقِيمَ عَلَيْهِ الْحَدُّ أَرْبَعَ مَرَّاتٍ ثُمَّ عَادَ لَهُ
[Machine] The Messenger of Allah ﷺ said: "If they drink alcohol, then flog them. If they drink again, then flog them. If they drink again, then flog them. If they drink again, then kill them." 17502 Abu Ali informed us, reporting from Abu Bakr, who reported from Abu Dawood, who reported from Musa ibn Ismail, who reported from Hammad, who reported from Humaid bin Yazid, who reported from Nafi, who reported from Ibn Umar, that the Messenger of Allah ﷺ said this statement, and I think he said it in the fifth occurrence: "If he drinks it, then kill him."
قَالَ رَسُولُ اللهِ ﷺ إِذَا شَرِبُوا الْخَمْرَ فَاجْلِدُوهُمْ ثُمَّ إِنْ شَرِبُوا فَاجْلِدُوهُمْ ثُمَّ إِنْ شَرِبُوا فَاجْلِدُوهُمْ ثُمَّ إِنْ شَرِبُوا فَاقْتُلُوهُمْ 17502 وَأَخْبَرَنَا أَبُو عَلِيٍّ أنبأ أَبُو بَكْرٍ ثنا أَبُو دَاوُدَ أنبأ مُوسَى بْنُ إِسْمَاعِيلَ ثنا حَمَّادٌ عَنْ حُمَيْدِ بْنِ يَزِيدَ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ أَنَّ رَسُولَ اللهِ ﷺ بِهَذَا الْمَعْنَى قَالَ وَأَحْسَبُهُ قَالَ فِي الْخَامِسَةِ إِنْ شَرِبَهَا فَاقْتُلُوهُ
[Machine] The Messenger of Allah ﷺ said, "If someone becomes intoxicated, flog him. If he becomes intoxicated again, flog him. If he becomes intoxicated again, flog him. If he repeats it a fourth time, then strike him on the neck." This is the statement of Yazid, and in the narration of At-Taghlibi, "Whosoever drinks alcohol, flog him. If he repeats it, flog him again. If he repeats it a fourth time, kill him." The report was narrated to us by Abu Ali Al-Rudhbary, who was informed by Abu Bakr Ibn Dasa. Abu Dawud Al-Sijistani and Umar Ibn Abi Salamah also narrated from their fathers, who narrated from Abu Huraira, who narrated from the Prophet ﷺ, "If someone drinks alcohol, flog him. If he repeats it a fourth time, kill him." Similarly, the report of Suhail from Abu Salih from Abu Huraira from the Prophet ﷺ, "If they drink alcohol for the fourth time, kill them." Also, the report of Ibn Abi Nu'm from Ibn 'Umar from the Prophet ﷺ, Ibn 'Amr from the Prophet ﷺ, Ash-Sharid from the Prophet ﷺ, and in the narration of Al-Jadali from Mu'awiyah from the Prophet ﷺ, "If someone repeats it the third or fourth time, kill him."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ إِذَا سَكِرَ فَاجْلِدُوهُ ثُمَّ إِنْ سَكِرَ فَاجْلِدُوهُ ثُمَّ إِنْ سَكِرَ فَاجْلِدُوهُ فَإِنْ عَادَ الرَّابِعَةَ فَاضْرِبُوا عُنُقَهُ لَفْظُ حَدِيثِ يَزِيدَ وَفِي رِوَايَةِ الطَّيَالِسِيِّ مَنْ شَرِبَ الْخَمْرَ فَاجْلِدُوهُ فَإِنْ عَادَ فَاجْلِدُوهُ فَإِنْ عَادَ الرَّابِعَةَ فَاقْتُلُوهُ 17504 أَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنبأ أَبُو بَكْرِ بْنُ دَاسَةَ قَالَ أَبُو دَاوُدَ السِّجِسْتَانِيُّ وَكَذَا حَدِيثُ عُمَرَ بْنِ أَبِي سَلَمَةَ عَنْ أَبِيهِ عَنْ أَبِي هُرَيْرَةَ عَنِ النَّبِيِّ ﷺ إِذَا شَرِبَ الْخَمْرَ فَاجْلِدُوهُ فَإِنْ عَادَ الرَّابِعَةَ فَاقْتُلُوهُ وَكَذَا حَدِيثُ سُهَيْلٍ عَنْ أَبِي صَالِحٍ عَنْ أَبِي هُرَيْرَةَ عَنِ النَّبِيِّ ﷺ إِنْ شَرِبُوا الرَّابِعَةَ فَاقْتُلُوهُمْ وَكَذَا حَدِيثُ ابْنُ أَبِي نُعْمٍ عَنِ ابْنِ عُمَرَ عَنِ النَّبِيِّ ﷺ وَكَذَا حَدِيثُ ابْنِ عَمْرٍو عَنِ النَّبِيِّ ﷺ وَالشَّرِيدِ عَنِ النَّبِيِّ ﷺ وَفِي حَدِيثِ الْجَدَلِيِّ عَنْ مُعَاوِيَةَ عَنِ النَّبِيِّ ﷺ فَإِنْ عَادَ فِي الثَّالِثَةِ أَوِ الرَّابِعَةِ فَاقْتُلُوهُ
[Machine] The Prophet Muhammad ﷺ said, "Whoever drinks alcohol, whip him. Then if he drinks again, whip him. Then if he drinks again, whip him. Then if he drinks for the fourth time, kill him. Bring me a man who has drunk alcohol." He was whipped, then he was whipped again, then he was whipped again, then he was whipped for the fourth time. The killing was lifted from the people, and it was permissible. It is confirmed by 17506. Abu Zakariya ibn Abu Ishaq informed us, Abu al-Abbas Muhammad ibn Ya'qub narrated to us, Rabee ibn Sulayman informed me, Al-Shafi'i narrated to me, Sufyan narrated from Al-Zuhri, from Qabisah ibn Dhu'ayb, who mentioned this narration, except that he said, "Then if he drinks, kill him." Al-Zuhri did not know whether it was after the third time or the fourth time. He said at the end, "The killing was suspended and it became permissible." Sufyan said, "Al-Zuhri said this to Mansur ibn al-Mu'tamir and Mikhwal, who were two visitors from Iraq with this narration."
قَالَ رَسُولُ اللهِ ﷺ مَنْ شَرِبَ الْخَمْرَ فَاجْلِدُوهُ ثُمَّ إِذَا شَرِبَ فَاجْلِدُوهُ ثُمَّ إِذَا شَرِبَ فَاجْلِدُوهُ ثُمَّ إِذَا شَرِبَ فِي الرَّابِعَةِ فَاقْتُلُوهُ فَأُتِيَ بِرَجُلٍ قَدْ شَرِبَ الْخَمْرَ فَجَلَدَهُ ثُمَّ أُتِيَ بِهِ فَجَلَدَهُ ثُمَّ أُتِيَ بِهِ فَجَلَدَهُ ثُمَّ أُتِيَ بِهِ فِي الرَّابِعَةِ فَجَلَدَهُ فَرَفَعَ الْقَتْلَ عَنِ النَّاسِ وَكَانَتْ رُخْصَةً فَثَبَتَتْ 17506 أَخْبَرَنَا أَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ أنبأ الرَّبِيعُ بْنُ سُلَيْمَانَ أنبأ الشَّافِعِيُّ أنبأ سُفْيَانُ عَنِ الزُّهْرِيِّ عَنْ قَبِيصَةَ بْنِ ذُؤَيْبٍ فَذَكَرَ هَذَا الْحَدِيثَ إِلَّا أَنَّهُ قَالَ ثُمَّ إِنْ شَرِبَ فَاقْتُلُوهُ لَا يَدْرِي الزُّهْرِيُّ بَعْدَ الثَّالِثَةِ أَوِ الرَّابِعَةِ قَالَ فِي آخِرِهِ وَوَضَعَ الْقَتْلَ وَصَارَتْ رُخْصَةً قَالَ سُفْيَانُ قَالَ الزُّهْرِيُّ لِمَنْصُورِ بْنِ الْمُعْتَمِرِ وَمِخْوَلٍ كُونَا وَافِدَيِ الْعِرَاقِ بِهَذَا الْحَدِيثِ
[Machine] The Messenger of Allah ﷺ said: "If someone drinks alcohol, then flog him. If he repeats it, flog him. If he repeats it again, flog him. If he repeats it once more, kill him." Then a man from the Ansar named Nu'ayman was brought to the Messenger of Allah ﷺ and he was beaten four times. The Muslims saw that killing had been postponed and that flogging had become obligatory. This had been narrated by Muhammad ibn Ishaq ibn Yasar from Ibn al-Munkadir from Jabir.
قَالَ رَسُولُ اللهِ ﷺ إِذَا شَرِبَ الْخَمْرَ فَاجْلِدُوهُ فَإِنْ عَادَ فَاجْلِدُوهُ فَإِنْ عَادَ فَاجْلِدُوهُ فَإِنْ عَادَ فَاقْتُلُوهُ فَأُتِيَ رَسُولُ اللهِ ﷺ بِرَجُلٍ مِنَ الْأَنْصَارِ يُقَالُ لَهُ نُعَيْمَانُ فَضَرَبَهُ أَرْبَعَ مَرَّاتٍ فَرَأَى الْمُسْلِمُونَ أَنَّ الْقَتْلَ قَدْ أُخِّرَ وَأَنَّ الضَّرْبَ قَدْ وَجَبَ وَقَدْ رُوِيَ هَذَا عَنْ مُحَمَّدِ بْنِ إِسْحَاقَ بْنِ يَسَارٍ عَنِ ابْنِ الْمُنْكَدِرِ عَنْ جَابِرٍ
[Machine] "That the Messenger of Allah ﷺ said, 'Whoever drinks wine, flog him. If he does it again, flog him. If he does it again, flog him. If he does it a fourth time, kill him.' The Messenger of Allah ﷺ struck Nai'man four times. The Muslims saw that the punishment was executed when the Messenger of Allah ﷺ struck him four times. Ma'mar narrated it from Muhammad ibn al-Munkadir and from Zaid ibn Aslam, both of them said the same."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنْ شَرِبَ الْخَمْرَ فَاجْلِدُوهُ فَإِنْ عَادَ فَاجْلِدُوهُ فَإِنْ عَادَ فَاجْلِدُوهُ فَإِنْ عَادَ الرَّابِعَةَ فَاقْتُلُوهُ قَالَ وَضَرَبَ رَسُولُ اللهِ ﷺ النُّعَيْمَانَ أَرْبَعَ مَرَّاتٍ قَالَ فَرَأَى الْمُسْلِمُونَ أَنَّ الْحَدَّ قَدْ وَقَعَ حِينَ ضَرَبَ رَسُولُ اللهِ ﷺ أَرْبَعَ مَرَّاتٍ وَرَوَاهُ مَعْمَرٌ عَنْ مُحَمَّدِ بْنِ الْمُنْكَدِرِ وَعَنْ زَيْدِ بْنِ أَسْلَمَ أَنَّهُمَا قَالَا ذَلِكَ
57.16 [Machine] Whoever is found with the scent of alcohol or is encountered drunk
٥٧۔١٦ بَابُ مَنْ وُجِدَ مِنْهُ رِيحُ شَرَابٍ أَوْ لُقِيَ سَكْرَانَ
[Machine] "That the Messenger of Allah ﷺ did not set a limit for drinking wine. Ibn 'Abbas said that a man drank wine and got drunk, so he was brought leaning towards the dawn and taken to the Prophet ﷺ . When he reached the house of al-'Abbas, he slipped away and entered the house of al-'Abbas. He held onto him, and that was mentioned to the Prophet ﷺ , so he laughed and said, 'He did it.' Then he did not command anything regarding him." 17510 Abu 'Ali al-Rudhbari informed us, Abu Bakr bin Dasa narrated to us, Abu Dawud narrated to us, al-Hasan bin 'Ali and Muhammad bin al-Muthanna mentioned it in the same way, except that he said, 'He did not seize him.' Abu Dawud said, 'This hadith is from the distinctive narrations of the people of Madinah.' 17511 Abu 'Abdullah al-Hafiz informed us, al-Hasan bin Muhammad al-Isfirayini narrated to us, Muhammad bin Ahmad bin al-Bara said, 'Ali bin al-Madinini was asked about Muhammad bin 'Ali bin Rukana who narrated this hadith from 'Ikrimah, so he said, 'He is unidentified.' The sheikh said, 'And Muhammad bin Ishaq bin Yasir narrated the meaning of this hadith from Muhammad bin Talhah bin Yazid bin Rukana.'"
أَنَّ رَسُولَ اللهِ ﷺ لَمْ يُوَقِّتْ فِي الْخَمْرِ حَدًّا قَالَ ابْنُ عَبَّاسٍ فَشَرِبَ رَجُلٌ فَسَكِرَ فَلُقِيَ يَمِيلُ فِي الْفَجِّ فَانْطُلِقَ بِهِ إِلَى النَّبِيِّ ﷺ فَلَمَّا حَاذَى بِدَارِ الْعَبَّاسِ انْفَلَتَ فَدَخَلَ عَلَى الْعَبَّاسِ فَالْتَزَمَهُ فَذُكِرَ ذَلِكَ لِلنَّبِيِّ ﷺ فَضَحِكَ وَقَالَ فَعَلَهَا ثُمَّ لَمْ يَأْمُرْ فِيهِ بِشَيْءٍ 17510 وَأَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنبأ أَبُو بَكْرِ بْنُ دَاسَةَ ثنا أَبُو دَاوُدَ ثنا الْحَسَنُ بْنُ عَلِيٍّ وَمُحَمَّدُ بْنُ الْمُثَنَّى فَذَكَرَهُ بِنَحْوِهِ إِلَّا أَنَّهُ قَالَ لَمْ يَقِتْ قَالَ أَبُو دَاوُدَ هَذَا الْحَدِيثُ مِمَّا تَفَرَّدَ بِهِ أَهْلُ الْمَدِينَةِ 17511 أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أَنْبَأَ الْحَسَنُ بْنُ مُحَمَّدٍ الْإِسْفِرَايِينِيُّ ثنا مُحَمَّدُ بْنُ أَحْمَدَ بْنِ الْبَرَاءِ قَالَ سُئِلَ عَلِيُّ بْنُ الْمَدِينِيِّ عَنْ مُحَمَّدِ بْنِ عَلِيِّ بْنِ رُكَانَةَ الَّذِي رَوَى هَذَا الْحَدِيثَ عَنْ عِكْرِمَةَ فَقَالَ مَجْهُولٌ قَالَ الشَّيْخُ وَقَدْ رَوَى مَعْنَى هَذَا الْحَدِيثِ مُحَمَّدُ بْنُ إِسْحَاقَ بْنِ يَسَارٍ عَنْ مُحَمَّدِ بْنِ طَلْحَةَ بْنِ يَزِيدَ بْنِ رُكَانَةَ
[Machine] The Messenger of Allah ﷺ did not strike anyone for drinking alcohol except in the end. He went on the expedition of Tabuk and his room was visited at night by Abu 'Alqamah ibn Al-A'war Al-Sulami, who was drunk. Abu 'Alqamah accidentally tore some of the curtains of the room. The Messenger of Allah ﷺ asked, "Who is this?" and he was told that it was Abu 'Alqamah who was drunk. The Messenger of Allah ﷺ said, "Let someone from among you go to him and hold his hand until he is taken back to his camp." It is correct according to the words of Ibn Abbas that the Prophet did not prescribe a specific punishment for drinking alcohol, meaning that he did not mention it explicitly, but he established it in practice. This incident is mentioned, and Allah knows best, because it was not brought up for him after entering the house of Al-Abbas, as it was not firmly established upon him through his admission or the testimony of witnesses. Rather, it happened on the way, and he leaned over, so he was thought to be drunk, but the Prophet did not expose him and left him. Allah knows best.
مَا ضَرَبَ رَسُولُ اللهِ ﷺ فِي الْخَمْرِ إِلَّا أَخِيرًا لَقَدْ غَزَا غَزْوَةَ تَبُوكَ فَغَشِيَ حُجْرَتَهُ مِنَ اللَّيْلِ أَبُو عَلْقَمَةَ بْنُ الْأَعْوَرِ السُّلَمِيُّ وَهُوَ سَكْرَانُ حَتَّى قَطَعَ بَعْضَ عُرَى الْحُجْرَةِ فَقَالَ مَنْ هَذَا؟ فَقِيلَ أَبُو عَلْقَمَةَ سَكْرَانُ فَقَالَ رَسُولُ اللهِ ﷺ لِيَقُمْ إِلَيْهِ رَجُلٌ مِنْكُمْ فَلْيَأْخُذْ بِيَدِهِ حَتَّى يَرُدَّهُ إِلَى رَحْلِهِ وَهَذَا إِنْ صَحَّ فَقَوْلُ ابْنِ عَبَّاسٍ لَمْ يَقِتْ فِي الْخَمْرِ حَدًّا يَعْنِي لَمْ يُوَقِّتْهُ لَفْظًا وَقَدْ وَقَّتَهُ فِعْلًا وَذَلِكَ يُرَدُّ وَإِنَّمَا لَمْ يَعْرِضْ لَهُ وَاللهُ أَعْلَمُ بَعْدَ دُخُولِهِ دَارَ الْعَبَّاسِ مِنْ أَجْلِ أَنَّهُ لَمْ يَكُنْ ثَبَتَ عَلَيْهِ الْحَدُّ بِإِقْرَارٍ مِنْهُ أَوْ بِشَهَادَةِ عُدُولٍ وَإِنَّمَا لُقِيَ فِي الطَّرِيقِ يَمِيلُ فَظُنَّ بِهِ السُّكْرُ فَلَمْ يَكْشِفْ عَنْهُ وَتَرَكَهُ وَاللهُ أَعْلَمُ
أَنَّهُ حَضَرَهُ يَحُدُّهُمْ
[Machine] Ata said, "Verily, the wind can be made from a beverage that is not harmful, so if they all gather together over one drink and one of them becomes intoxicated, then they should all be given the full punishment. Al-Shafi'i said, and the statement of Ata is like the statement of Umar ibn al-Khattab."
عَطَاءٌ إِنَّ الرِّيحَ لَتَكُونُ مِنَ الشَّرَابِ الَّذِي لَيْسَ بِهِ بَأْسٌ فَإِذَا اجْتَمَعُوا جَمِيعًا عَلَى شَرَابٍ وَاحِدٍ فَسَكِرَ أَحَدُهُمْ جُلِدُوا جَمِيعًا الْحَدَّ تَامًّا قَالَ الشَّافِعِيُّ وَقَوْلُ عَطَاءٍ مِثْلُ قَوْلِ عُمَرَ بْنِ الْخَطَّابِ ؓ
[Machine] Abdullah said, "I was sitting in Hims and they told me to read, so I recited Surah Yusuf. A man from the people said, 'By Allah, this is not how Allah revealed it.' So I said, 'Woe to you, I have recited it to the Messenger of Allah ﷺ .' He said, 'Well done, and you are saying to me what you are saying.' Then, while I was talking to him, I smelled the odor of alcohol from him. So I said, 'You deny the Book of Allah and drink alcohol? By Allah, you will not return to your family until you receive the punishment.' It was mentioned in the authentic narration of Al-A'mash. It is also possible that Abdullah bin Mas'ood did not whip him until it was proven to him that he had consumed enough to become intoxicated, either through clear evidence or confession. And Allah knows best."
قَالَ عَبْدُ اللهِ كُنْتُ جَالِسًا بِحِمْصَ فَقَالُوا لِي اقْرَأْ فَقَرَأْتُ سُورَةَ يُوسُفَ فَقَالَ رَجُلٌ مِنَ الْقَوْمِ وَاللهِ مَا هَكَذَا أَنْزَلَهَا اللهُ ﷻ فَقَالَ فَقُلْتُ وَيْحَكَ لَقَدْ قَرَأْتُهَا عَلَى رَسُولِ اللهِ ﷺ فَقَالَ أَحْسَنْتَ وَأَنْتَ تَقُولُ لِي مَا تَقُولُ قَالَ فَبَيْنَا أَنَا أُكَلِّمُهُ إِذْ وَجَدْتُ مِنْهُ رِيحَ الْخَمْرِ فَقُلْتُ تُكَذِّبُ بِكِتَابِ اللهِ ﷻ وَتَشْرَبُ الْخَمْرَ أَمَا وَاللهِ لَا تَرْجِعُ إِلَى أَهْلِكَ حَتَّى أَجْلِدَكَ الْحَدَّ أَخْرَجَاهُ فِي الصَّحِيحِ مِنْ حَدِيثِ الْأَعْمَشِ وَيُحْتَمَلُ أَنَّ عَبْدَ اللهِ بْنَ مَسْعُودٍ لَمْ يَجْلِدْهُ حَتَّى ثَبَتَ عِنْدَهُ شُرْبُهُ مَا يُسْكِرُ بِبَيِّنَةٍ أَوِ اعْتِرَافٍ وَاللهُ أَعْلَمُ
[Machine] O commander of the faithful, Qudamah drank and got intoxicated, and I witnessed him committing an act that is truly against the limits set by Allah, so it is my duty to report it to you. Umar asked, "Who witnessed this with you?" He replied, "Abu Hurairah." So Umar called Abu Hurairah and asked, "Why did you witness this?" Abu Hurairah answered, "I did not see him drink, but I saw him intoxicated and vomiting." Umar said, "You have taken a hasty decision in giving testimony." Then he wrote a letter to Qudamah, instructing him to come to him from Bahrain. Qudamah came and Garud came to him and said, "Abide by the Book of Allah." Umar said, "Are you his opponent or a witness?" Garud replied, "I am a witness." Umar said, "Then you have given your testimony." Garud remained quiet until he came to Umar. Umar said to him, "Abide by the limits set by Allah." Umar said, "I see no one except you as an opponent, and there was no one who witnessed with you except one man." Garud said, "I bear witness to Allah that if you do not hold your tongue, I will harm you." Abu Hurairah said, "If you doubt our testimony, send a message to the daughter of Al-Walid and ask her. She is the wife of Qudamah." So Umar sent a message to Hind bint Al-Walid to testify, and she confirmed the testimony against her husband. Umar said to Qudamah, "I am against you." Qudamah replied, "If I had drunk as people say, you would not have punished me." Umar asked, "Why?" Qudamah said, "Allah says: 'There is no sin upon those who believe and do righteous deeds for what they have eaten.'" Umar said, "You have interpreted it wrong. If you fear Allah, you would have abstained from what Allah has prohibited for you." Then Umar turned to the people and asked, "What do you think about punishing Qudamah?" They said, "We do not think he should be punished as he was sick." Umar remained silent on the matter for some time. Then one day he decided to punish him and asked his companions, "What do you think about punishing Qudamah?" The people said, "We do not think he should be punished as long as he is in pain." Umar said, "I would prefer to meet Allah under the whip than meet Him with it on my back. Bring me a full whip." So Umar ordered for Qudamah to be whipped. Umar was angry with Qudamah and did not speak to him for a while. Later, when they finished their Hajj, Umar went to As-Suqya and woke up from his sleep and said, "Hurry up and bring me Qudamah." So they came to him, but he refused to go. Umar ordered him to be brought to him. If he refused to be dragged, Umar addressed him and sought forgiveness for him. This was their first reconciliation in the beginning of this incident, which indicates that Umar did not completely accept their testimony as they did not agree on his drinking. When Umar punished Qudamah, it is likely that he was convinced of his drinking either by his confession or the testimony of others along with Garud.
يَا أَمِيرَ الْمُؤْمِنِينَ إِنَّ قُدَامَةَ شَرِبَ فَسَكِرَ وَإِنِّي رَأَيْتُ حَدًّا مِنْ حُدُودِ اللهِ حَقًّا عَلَيَّ أَنْ أَرْفَعَهُ إِلَيْكَ فَقَالَ عُمَرُ ؓ مَنْ شَهِدَ مَعَكَ؟ قَالَ أَبُو هُرَيْرَةَ فَدَعَا أَبَا هُرَيْرَةَ فَقَالَ بِمَ تَشْهَدُ؟ فَقَالَ لَمْ أَرَهُ شَرِبَ وَلَكِنِّي رَأَيْتُهُ سَكْرَانَ يَقِيءُ فَقَالَ عُمَرُ ؓ لَقَدْ تَنَطَّعْتَ فِي الشَّهَادَةِ قَالَ ثُمَّ كَتَبَ إِلَى قُدَامَةَ أَنْ يَقْدَمَ عَلَيْهِ مِنَ الْبَحْرَيْنِ فَقَدِمَ فَقَامَ إِلَيْهِ الْجَارُودُ فَقَالَ أَقِمْ عَلَى هَذَا كِتَابَ اللهِ فَقَالَ عُمَرُ ؓ أَخَصْمٌ أَنْتَ أَمْ شَهِيدٌ؟ قَالَ بَلْ شَهِيدٌ قَالَ فَقَدْ أَدَّيْتَ الشَّهَادَةَ فَصَمَتَ الْجَارُودُ حَتَّى غَدَا عَلَى عُمَرَ فَقَالَ أَقِمْ عَلَى هَذَا حَدَّ اللهِ فَقَالَ عُمَرُ ؓ مَا أَرَاكَ إِلَّا خَصْمًا وَمَا شَهِدَ مَعَكَ إِلَّا رَجُلٌ فَقَالَ الْجَارُودُ إِنِّي أَنْشُدُكَ اللهَ فَقَالَ عُمَرُ لَتُمْسِكَنَّ لِسَانَكَ أَوْ لَأَسُوءَنَّكَ فَقَالَ أَبُو هُرَيْرَةَ إِنْ كُنْتَ تَشُكُّ فِي شَهَادَتِنَا فَأَرْسِلْ إِلَى ابْنَةِ الْوَلِيدِ فَاسْأَلْهَا وَهِيَ امْرَأَةُ قُدَامَةَ فَأَرْسَلَ عُمَرُ إِلَى هِنْدَ بِنْتِ الْوَلِيدِ يَنْشُدُهَا فَأَقَامَتِ الشَّهَادَةَ عَلَى زَوْجِهَا فَقَالَ عُمَرُ لِقُدَامَةَ إِنِّي حَادُّكَ فَقَالَ لَوْ شَرِبْتُ كَمَا يَقُولُونَ مَا كَانَ لَكُمْ تَجْلِدُونِي فَقَالَ عُمَرُ ؓ لِمَ؟ قَالَ قُدَامَةُ قَالَ اللهُ ﷻ {لَيْسَ عَلَى الَّذِينَ آمَنُوا وَعَمِلُوا الصَّالِحَاتِ جُنَاحٌ فِيمَا طَعِمُوا} [المائدة 93] الْآيَةَ قَالَ عُمَرُ ؓ أَخْطَأْتَ التَّأْوِيلَ إِنِ اتَّقَيْتَ اللهَ اجْتَنَبْتَ مَا حَرَّمَ اللهُ عَلَيْكَ قَالَ ثُمَّ أَقْبَلَ عُمَرُ ؓ عَلَى النَّاسِ فَقَالَ مَاذَا تَرَوْنَ فِي جَلْدِ قُدَامَةَ قَالُوا لَا نَرَى أَنْ تَجْلِدَهُ مَا كَانَ مَرِيضًا فَسَكَتَ عَنْ ذَلِكَ أَيَّامًا ثُمَّ أَصْبَحَ يَوْمًا وَقَدْ عَزَمَ عَلَى جَلْدِهِ فَقَالَ لِأَصْحَابِهِ مَا تَرَوْنَ فِي جَلْدِ قُدَامَةَ فَقَالَ الْقَوْمُ مَا نَرَى أَنْ تَجْلِدَهُ مَا دَامَ وَجِعًا فَقَالَ عُمَرُ ؓ لَأَنْ يَلْقَى اللهَ ﷻ تَحْتَ السِّيَاطِ أَحَبُّ إِلِيَّ مِنْ أَنْ يَلْقَاهُ وَهُوَ فِي عُنُقِي ائْتُونِي بِسَوْطٍ تَامٍّ فَأَمَرَ عُمَرُ ؓ بِقُدَامَةَ فَجُلِدَ فَغَاضَبَ عُمَرُ ؓ قُدَامَةَ فَهَجَرَهُ فَحَجَّ وَحَجَّ قُدَامَةُ مَعَهُ مُغَاضِبًا لَهُ فَلَمَّا قَفَلَا مِنْ حَجِّهِمَا وَنَزَلَ عُمَرُ بِالسُّقْيَا وَاسْتَيْقَظَ عُمَرُ مِنْ نَوْمِهِ فَقَالَ عَجِّلُوا عَلَيَّ بِقُدَامَةَ فَأْتُونِي بِهِ فَوَاللهِ إِنِّي لَأَرَى أَنَّ آتِيًا أَتَانِي فَقَالَ سَالِمْ قُدَامَةَ فَإِنِّي أَخُوكَ فَعَجِّلُوا إِلِيَّ بِهِ فَلَمَّا أَتَوْهُ أَبَى أَنْ يَأْتِيَ فَأَمَرَ بِهِ عُمَرُ ؓ إِنْ أَبَى أَنْ يُجَرَّ إِلَيْهِ حَتَّى كَلَّمَهُ وَاسْتَغْفَرَ لَهُ وَكَانَ ذَلِكَ أَوَّلَ صُلْحِهِمَا فِي ابْتِدَاءِ هَذِهِ الْقِصَّةِ مَا دَلَّ عَلَى أَنَّ عُمَرَ ؓ تَوَقَّفَ فِي قَبُولِ شَهَادَتِهِمَا حَيْثُ لَمْ يَجْتَمِعَا عَلَى شُرْبِهِ وَحِينَ حَدَّهُ يُحْتَمَلُ أَنْ يَكُونَ ثَبَتَ عِنْدَهُ شُرْبُهُ بِإِقْرَارِهِ أَوْ شَهَادَةِ آخَرَ عَلَى شُرْبِهِ مَعَ الْجَارُودِ
[Machine] "When Jaruud came to Umar, he mentioned a hadith and Umar said, 'O Amirul Mu'minin, have you employed someone to drink alcohol?' Jaruud answered, 'Abu Hurairah is my witness.' Al-Ansari said, 'Your circumcision, your circumcision.' Umar asked, 'And who witnessed this?' Al-Aqrama replied, 'They both witnessed it.' Umar then said to Jaruud, 'By Allah, I will lash you with a whip.' Jaruud asked him, 'What is the justice in you drinking and me being whipped?' Umar asked, 'And who witnessed this?' Al-Aqrama said, 'Alqamah and his companions testified to it.' Umar ordered him to be whipped and said, 'I have not allowed anyone to disobey me since I was appointed, so I will not be blessed with it. Go, and lash him.'"
أَنَّ الْجَارُودَ لَمَّا قَدِمَ عَلَى عُمَرَ ؓ فَذَكَرَ الْحَدِيثَ قَالَ فَقَالَ يَا أَمِيرَ الْمُؤْمِنِينَ اسْتَعْمَلْتَ عَلَيْنَا مَنْ يَشْرَبُ الْخَمْرَ قَالَ وَمَنْ شُهُودُكَ؟ قَالَ أَبُو هُرَيْرَةَ قَالَ خَتَنُكَ خَتَنُكَ قَالَ الْأَنْصَارِيُّ وَكَانَتْ أُخْتُ الْجَارُودِ تَحْتَ أَبِي هُرَيْرَةَ قَالَ أَمَا وَاللهِ لَأُوجِعَنَّ مَتْنَهُ بِالسَّوْطِ قَالَ فَقَالَ لَهُ مَا ذَاكَ فِي الْحَقِّ أَنْ يَشْرَبَ خَتَنُكَ وَتَجْلِدَ خَتَنِي قَالَ وَمَنْ؟ قَالَ عَلْقَمَةُ فَشَهِدُوا عِنْدَهُ فَأَمَرَ بِجِلْدِهِ وَقَالَ مَا حَابَيْتُ فِي إِمَارَتِي أَحَدًا مُنْذُ وُلِّيتُ غَيْرَهُ فَمَا بُورِكَ لِي فِيهِ اذْهَبُوا فَاجْلِدُوهُ
[Machine] Allah, may He be exalted, did not vomit it until he drank it, so he said to Ali, "Give him the punishment." Ali said to Al-Hasan, "Give him the punishment." The one who leads her team grabbed her whip, and Ali took it and whipped him. Ali kept counting, and when it reached forty, he said, "The Prophet ﷺ whipped him forty times, I count them." And Abu Bakr whipped him forty times, and Umar eighty times, and each one is a sunnah, and this is dearer to me.
اللهُ عَنْهُ إِنَّهُ لَمْ يَتَقَيَّأْهَا حَتَّى شَرِبَهَا فَقَالَ لِعَلِيٍّ ؓ أَقِمْ عَلَيْهِ الْحَدَّ فَقَالَ عَلِيٌّ لِلْحَسَنِ ؓ أَقِمْ عَلَيْهِ الْحَدَّ فَقَالَ وَلِّ حَارَّهَا مَنْ تَوَلَّى قَارَّهَا فَقَالَ عَلِيٌّ ؓ لِعَبْدِ اللهِ بْنِ جَعْفَرٍ أَقِمْ عَلَيْهِ الْحَدَّ قَالَ فَأَخَذَ السَّوْطَ فَجَلَدَهُ وَعَلِيٌّ ؓ يَعُدُّ فَلَمَّا بَلَغَ أَرْبَعِينَ قَالَ حَسْبُكَ جَلَدَ النَّبِيُّ ﷺ أَرْبَعِينَ أَحْسَبُهُ قَالَ وَجَلَدَ أَبُو بَكْرٍ ؓ أَرْبَعِينَ وَعُمَرُ ؓ ثَمَانِينَ وَكُلٌّ سُنَّةٌ وَهَذَا أَحَبُّ إِلِيَّ
57.17 [Machine] What is stated in the imposition of the limit in the case of intoxication or until his intoxication subsides.
٥٧۔١٧ بَابُ مَا جَاءَ فِي إِقَامَةِ الْحَدِّ فِي حَالِ السُّكْرِ أَوْ حَتَّى يَذْهَبَ سُكْرُهُ
[Machine] The Messenger of Allah ﷺ was brought Nu'ayman or the son of Nu'ayman while he was drunk. He caused a great inconvenience to the Messenger of Allah ﷺ , and then he ordered those who were in the house to beat him. He said, so they beat him with sandals and twigs. He said, "I was among those who were beating him."
أَنَّ رَسُولَ اللهِ ﷺ أُتِيَ بِالنُّعَيْمَانِ أَوِ ابْنِ النُّعَيْمَانِ وَهُوَ سَكْرَانُ فَشَقَّ عَلَى رَسُولِ اللهِ ﷺ مَشَقَّةً شَدِيدَةً ثُمَّ أَمَرَ مَنْ كَانَ فِي الْبَيْتِ أَنْ يَضْرِبُوهُ قَالَ فَضَرَبُوهُ بِالنِّعَالِ وَالْجَرِيدِ قَالَ فَكُنْتُ فِيمَنْ يَضْرِبُهُ
[Machine] The Messenger of Allah, ﷺ , said: "Strike those who are in the house." Abu Amr al-Bistami informed us, Abu Bakr al-Ismaili narrated to us, Muhammad ibn Ishaq ibn Khuzaymah narrated to us, Bundar narrated to us, from Abdul Wahhab ibn Abdul Majid, from Ayyub, who mentioned it.
رَسُولُ اللهِ ﷺ لِمَنْ فِي الْبَيْتِ اضْرِبُوهُ أَخْبَرَنَاهُ أَبُو عَمْرٍو الْبِسْطَامِيُّ أنبأ أَبُو بَكْرٍ الْإِسْمَاعِيلِيُّ ثنا مُحَمَّدُ بْنُ إِسْحَاقَ بْنِ خُزَيْمَةَ ثنا بُنْدَارٌ نا عَبْدُ الْوَهَّابِ بْنُ عَبْدِ الْمَجِيدِ عَنْ أَيُّوبَ فَذَكَرَهُ
[Machine] A man was brought to the Prophet ﷺ while he was intoxicated. He then ordered a group of about twenty men to discipline him with palm branches and sandals. This incident was mentioned in a hadith, and it is possible that it occurred after the person's intoxication had worn off. Allah knows best.
أَنَّ رَجُلًا رُفِعَ إِلَى النَّبِيِّ ﷺ قَدْ سَكِرَ قَالَ فَأَمَرَ قَرِيبًا مِنْ عِشْرِينَ رَجُلًا فَجَلَدُوهُ بِالْجَرِيدِ وَالنِّعَالِ وَذَكَرَ الْحَدِيثَ وَهَذَا يُحْتَمَلُ أَنْ يَكُونَ رُفِعَ إِلَيْهِ بَعْدَمَا ذَهَبَ سُكْرُهُ وَاللهُ أَعْلَمُ
[Machine] He said, "I do not drink wine after the Messenger of Allah ﷺ forbade it. When I was brought a drink made with grapes and dates, I said, 'O Messenger of Allah, I did not drink alcohol, but I drank a drink made with raisins and dates in a container.' The Prophet ﷺ then commanded that it be poured out by shaking it with the hands and striking it with the sandals. He prohibited grapes, dates, and containers."
أَنَّهُ قَالَ لَا أَشْرَبُ نَبِيذَ الْجَرِّ بَعْدَ إِذْ أُتِيَ رَسُولُ اللهِ ﷺ بِنَشْوَانَ فَقَالَ يَا رَسُولَ اللهِ مَا شَرِبْتُ خَمْرًا إِنَّمَا شَرِبْتُ نَبِيذَ زَبِيبٍ وَتَمْرٍ فِي دُبَّاءَةٍ قَالَ فَأَمَرَ بِهِ النَّبِيُّ ﷺ فَنُهِزَ بِالْأَيْدِي وَخُفِقَ بِالنِّعَالِ قَالَ وَنَهَى عَنِ الزَّبِيبِ وَالتَّمْرِ وَعَنِ الدُّبَّاءِ
[Machine] "The Prophet ﷺ was brought a drunk man and he said, 'O Messenger of Allah, I did not drink wine, I only drank raisins and dates.' So the Prophet commanded for him to be lashed, and he forbade the mixing of these two, according to the narration of the group from Shu'bah, then from Abu Ishaq."
أَنَّ النَّبِيَّ ﷺ أُتِيَ بِرَجُلٍ سَكْرَانَ فَقَالَ يَا رَسُولَ اللهِ إِنِّي لَمْ أَشْرَبِ الْخَمْرَ إِنَّمَا شَرِبْتُ زَبِيبًا وَتَمْرًا فَأَمَرَ بِهِ فَضُرِبَ الْحَدَّ وَنَهَى عَنْهُمَا أَنْ يُخْلَطَا هَكَذَا رِوَايَةُ الْجَمَاعَةِ عَنْ شُعْبَةَ ثُمَّ عَنْ أَبِي إِسْحَاقَ
[Machine] That the Messenger of Allah ﷺ was brought a drunken man or it was said, intoxicated. When his drunkenness went away, he ordered for him to be flogged. He said, "O Messenger of Allah, I did not drink wine, I only drank a mixture of bukhoor and dates." So the Prophet ordered for him to be flogged, then forbade the mixing of the two.
أَنَّ رَسُولَ اللهِ ﷺ أُتِيَ بِرَجُلٍ سَكْرَانَ أَوْ قَالَ نَشْوَانَ فَلَمَّا ذَهَبَ سُكْرُهُ أَمَرَ بِجَلْدِهِ قَالَ يَا رَسُولَ اللهِ إِنِّي لَمْ أَشْرَبْ خَمْرًا إِنَّمَا شَرِبْتُ خَلِيطَ بُسْرٍ وَتَمْرٍ فَأَمَرَ بِهِ فَجُلِدَ ثُمَّ نَهَى عَنْهُمَا أَنْ يُخْلَطَا
[Machine] If you wake up tomorrow, strike him with the limit. Umar came and he struck him severely. He said, "You killed the man, how many times did you strike him?" He said, "Sixty." He said, "Reduce it by twenty." Abu Ubaid said, "Reduce it by twenty." He says, "Make the severity of this strike be reduced by twenty, which remains in this conversation of jurisprudence that striking a drunkard is a light strike, and that he did not strike him while he was drunk until he woke up. Didn't you hear his saying when you wake up tomorrow, strike him with the limit?" The Sheikh said, may Allah have mercy on him, "And in it is that exceeding forty is punishment and not a limit."
إِذَا أَصْبَحْتَ غَدًا فَاضْرِبْهُ الْحَدَّ فَجَاءَ عُمَرُ ؓ وَهُوَ يَضْرِبُهُ ضَرْبًا شَدِيدًا فَقَالَ قَتَلْتَ الرَّجُلَ كَمْ ضَرَبْتَهُ؟ قَالَ سِتِّينَ قَالَ أَقِصَّ عَنْهُ بِعِشْرِينَ قَالَ أَبُو عُبَيْدٍ أَقِصَّ عَنْهُ بِعِشْرِينَ يَقُولُ اجْعَلْ شِدَّةَ هَذَا الضَّرْبِ الَّذِي ضَرَبْتَهُ قِصَاصًا بِالْعِشْرِينَ الَّتِي بَقِيَتْ فِي هَذَا الْحَدِيثِ مِنَ الْفِقْهِ أَنَّ ضَرْبَ الشَّارِبِ ضَرْبٌ خَفِيفٌ وَفِيهِ أَنَّهُ لَمْ يَضْرِبْهُ فِي سُكْرِهِ حَتَّى أَفَاقَ أَلَمْ تَسْمَعْ قَوْلَهُ إِذَا أَصْبَحْتَ غَدًا فَاضْرِبْهُ الْحَدَّ؟ قَالَ الشَّيْخُ رَحِمَهُ اللهُ وَفِيهِ أَنَّ الزِّيَادَةَ عَلَى الْأَرْبَعِينَ تَعْزِيرٌ وَلَيْسَتْ بِحَدٍّ
[Machine] A man came from the Muslims with his drunken nephew and said, "O Abu Abdur Rahman, my nephew is drunk." He said, "Torture him and shake him and reprimand him." So they did so and took him to prison. Then he called for him the next day and mentioned the conversation about how he should be beaten. Abu Ubaid said, "It is that he should be moved and shaken and reprimanded until the smell comes out of him, so that they know what he has drunk." This refers to "at-taltalah," "attartarah," and "almazmazah," all having the same meaning. Abu Ubaid said, "Some scholars deny this hadith." Shaykh said, "May Allah have mercy on him, due to the weakness of Yahya Al-Jabri and the ignorance of Abu Majid."
جَاءَ رَجُلٌ مِنَ الْمُسْلِمِينَ بِابْنِ أَخٍ لَهُ وَهُوَ سَكْرَانُ فَقَالَ يَا أَبَا عَبْدِ الرَّحْمَنِ إِنَّ ابْنَ أَخِي سَكْرَانُ فَقَالَ تَرْتُرُوهُ وَمَزْمِزُوهُ وَاسْتَنْكِهُوهُ فَفَعَلُوا فَرَفَعَهُ إِلَى السِّجْنِ ثُمَّ دَعَا بِهِ مِنَ الْغَدِ وَذَكَرَ الْحَدِيثَ فِي كَيْفِيَّةِ جَلْدِهِ قَالَ أَبُو عُبَيْدٍ هُوَ أَنْ يُحَرَّكَ وَيُزَعْزَعَ وَيُسْتَنْكَهُ حَتَّى يُوجَدَ مِنْهُ الرِّيحُ؛ لِيَعْلَمَ مَا شَرِبَ وَهِيَ التَّلْتَلَةُ وَالتَّرْتَرَةُ وَالْمَزْمَزَةُ بِمَعْنَى وَاحِدٍ قَالَ أَبُو عُبَيْدٍ وَهَذَا الْحَدِيثُ بَعْضُ أَهْلِ الْعِلْمِ يُنْكِرُهُ قَالَ الشَّيْخُ رَحِمَهُ اللهُ لِضَعْفِ يَحْيَى الْجَابِرِ وَجَهَالَةِ أَبِي مَاجِدٍ
[Machine] The jurists from the people of Madinah used to say that the drunkard should not be lashed until he sobers up.
عَنِ الْفُقَهَاءِ مِنْ أَهْلِ الْمَدِينَةِ كَانُوا يَقُولُونَ لَا يُجْلَدُ السَّكْرَانُ حَتَّى يَصْحُوَ
57.18 [Machine] What is mentioned in the limit of alcohol?
٥٧۔١٨ بَابُ مَا جَاءَ فِي عَدَدِ حَدِّ الْخَمْرِ
[Machine] He whipped him, so he took the whip and 'Ali (may Allah be pleased with him) counted until he whipped him forty times, then he said to him: "Hold the whip of the Messenger of Allah ﷺ forty times, and Abu Bakr (may Allah be pleased with him) whipped him eighty times, and each was according to the Sunnah, and this is more beloved to me."
يَجْلِدَهُ فَأَخَذَ فِي جَلْدِهِ وَعَلِيٌّ ؓ يَعُدُّ حَتَّى جَلَدَ أَرْبَعِينَ ثُمَّ قَالَ لَهُ أَمْسِكْ جَلَدَ رَسُولُ اللهِ ﷺ أَرْبَعِينَ وَأَبُو بَكْرٍ ؓ وَجَلَدَ عُمَرُ ؓ ثَمَانِينَ وَكُلٌّ سُنَّةٌ وَهَذَا أَحَبُّ إِلِيَّ
[Machine] While you are like this, he said, "No, you have become weak and tired, O Abdullah ibn Jafar. Get up and whip him." So Ali started whipping him, counting until he reached forty. He then said, "Stop, the Messenger of Allah ﷺ whipped forty, Abu Bakr whipped forty, and Umar whipped eighty, and each is a Sunnah." And Abu Muhammad informed us, who informed us Abu Sa'eed, who narrated from Az-Za'farani, who narrated from Yazid ibn Harun, who narrated from Sa'eed, who narrated from Abdullah Ad-Danaji, who narrated from Hudhayn ibn Al-Mundhir ibn Al-Harith ibn Wa'lah, that Al-Walid ibn Uqbah prayed Fajr with the people four rak'ahs, then turned to them and said, "Should I increase upon you?" This was then conveyed to Uthman, who mentioned something similar to it, except in the hadith of Yazid, it mentions that the Messenger of Allah ﷺ whipped forty, and Abu Bakr and Umar did the same, during the beginning of their caliphates, and Umar continued with eighty, and each is a Sunnah.
ؓ فِيمَا أَنْتَ وَهَذَا وَلِّ هَذَا غَيْرَكَ فَقَالَ بَلْ عَجَزْتَ وَوَهَنْتَ وَضَعُفْتَ يَا عَبْدَ اللهِ بْنَ جَعْفَرٍ قُمْ فَاجْلِدْهُ فَجَعَلَ يَجْلِدُهُ وَعَلِيٌّ ؓ يَعُدُّ حَتَّى بَلَغَ أَرْبَعِينَ فَقَالَ أَمْسِكْ جَلَدَ رَسُولُ اللهِ ﷺ أَرْبَعِينَ وَجَلَدَ أَبُو بَكْرٍ أَرْبَعِينَ وَجَلَدَ عُمَرُ ثَمَانِينَ وَكُلٌّ سُنَّةٌ 17531 وَأَخْبَرَنَا أَبُو مُحَمَّدٍ أنبأ أَبُو سَعِيدٍ ثنا الزَّعْفَرَانِيُّ ثنا يَزِيدُ بْنُ هَارُونَ أنبأ سَعِيدٌ عَنْ عَبْدِ اللهِ الدَّانَاجِ عَنْ حُضَيْنِ بْنِ الْمُنْذِرِ بْنِ الْحَارِثِ بْنِ وَعْلَةَ أَنَّ الْوَلِيدَ بْنَ عُقْبَةَ صَلَّى بِالنَّاسِ الصُّبْحَ أَرْبَعًا ثُمَّ الْتَفَتَ إِلَيْهِمْ فَقَالَ أَزِيدُكُمْ؟ فَرُفِعَ ذَلِكَ إِلَى عُثْمَانَ ؓ فَذَكَرَ نَحْوَهُ غَيْرَ أَنَّ فِي حَدِيثِ يَزِيدَ ضَرَبَ رَسُولُ اللهِ ﷺ أَرْبَعِينَ وَأَبُو بَكْرٍ وَعُمَرُ ؓ صَدْرًا مِنْ خِلَافَتِهِ أَرْبَعِينَ ثُمَّ أَتَمَّهَا عُمَرُ ثَمَانِينَ وَكُلٌّ سُنَّةٌ
[Machine] The Prophet ﷺ administered the punishment of flogging with a stick in cases of theft. Abu Umara said that he was flogged with a stick in cases of drinking alcohol, and his sandals were also used in the flogging. Abu Bakr also administered forty lashes. However, when Umar became the caliph, he asked, "The people have moved closer to the rural areas, so what do you think about the punishment for drinking alcohol?" Abdur Rahman ibn Awf replied, "We suggest that you make it the lightest of punishments, so flog them eighty times."
أَنَّ النَّبِيَّ ﷺ جَلَدَ فِي الْحَدِّ بِالْجَرِيدِ وَقَالَ أَبُو عُمَرَ ضَرَبَ فِي الْخَمْرِ بِالْجَرِيدِ وَالنِّعَالِ وَضَرَبَ أَبُو بَكْرٍ ؓ أَرْبَعِينَ فَلَمَّا أَنْ وَلِيَ عُمَرُ ؓ قَالَ إِنَّ النَّاسَ قَدْ دَنَوْا مِنَ الرِّيفِ فَمَا تَرَوْنَ فِي حَدِّ الْخَمْرِ؟ فَقَالَ لَهُ عَبْدُ الرَّحْمَنِ بْنُ عَوْفٍ ؓ نَرَى أَنْ تَجْعَلَهُ كَأَخَفِّ الْحُدُودِ فَجَلَدَهُ ثَمَانِينَ
[Machine] ﷺ He used to strike in gambling with sandals and palm branches a total of forty. Abu Bakr struck forty. When Umar became caliph, he was asked about that, so Umar consulted with them and Ibn Awf said, "I think he should be struck eighty times." So he struck him eighty times.
ﷺ كَانَ يَضْرِبُ فِي الْخَمْرِ بِالنِّعَالِ وَالْجَرِيدِ أَرْبَعِينَ وَأَبُو بَكْرٍ ؓ ضَرَبَ أَرْبَعِينَ فَلَمَّا وَلِيَ عُمَرُ ؓ سُئِلَ عَنْ ذَلِكَ فَشَاوَرَهُمْ عُمَرُ فَقَالَ ابْنُ عَوْفٍ ؓ أَرَى أَنْ تَضْرِبَهُ ثَمَانِينَ فَضَرَبَهُ ثَمَانِينَ
[Machine] The Prophet ﷺ was brought a man who had drunk alcohol, and he struck him with two palm branches, about forty times. Abu Bakr did the same, and when Umar sought the people's advice about it, Abdur Rahman ibn Awf said to him, "Eighty is the lightest of the prescribed punishments", so he did the same.
أَنَّ النَّبِيَّ ﷺ أُتِيَ بِرَجُلٍ شَرِبَ الْخَمْرَ فَضَرَبَهُ بِجَرِيدَتَيْنِ نَحْوًا مِنْ أَرْبَعِينَ ثُمَّ صَنَعَ أَبُو بَكْرٍ ؓ مِثْلَ ذَلِكَ فَلَمَّا كَانَ عُمَرُ ؓ اسْتَشَارَ النَّاسَ فِيهِ فَقَالَ لَهُ عَبْدُ الرَّحْمَنِ بْنُ عَوْفٍ ؓ أَخَفُّ الْحُدُودِ ثَمَانُونَ فَفَعَلَ
[Machine] We used to be brought drinks during the time of the Prophet ﷺ, during the time of Abu Bakr, and a part of Umar's caliphate. We would hit them with our hands, sandals, and robes until it became a part of Umar's reign. He would lash them forty times, and if they persisted and were disobedient, he would lash them eighty times.
كُنَّا نُؤْتَى بِالشُّرَّابِ فِي عَهْدِ رَسُولِ اللهِ ﷺ وَفِي عَهْدِ أَبِي بَكْرٍ وَصَدْرًا مِنْ إِمْرَةِ عُمَرَ يَعْنِي فَنَضْرِبُهُمْ بِأَيْدِينَا وَنِعَالِنَا وَأَرْدِيَتِنَا حَتَّى كَانَ صَدْرًا مِنْ إِمْرَةِ عُمَرَ ؓ فَجَلَدَ أَرْبَعِينَ حَتَّى إِذَا عَتَوْا فِيهِ وَفَسَقُوا جَلَدَ ثَمَانِينَ
[Machine] I saw the Prophet ﷺ in the year of Hunayn asking about Khalid ibn al-Walid. So I came in front of him and asked about Khalid ibn al-Walid until he was brought in shackles. The Prophet ﷺ ordered them to strike him, and they struck him with their hands, sandals, and the edges of their garments. They also threw dirt on him. Then the Prophet ﷺ said, "Stop hitting him," and they stopped. Then the Prophet ﷺ sent him. Abu Bakr asked the people who were present at the time of his being struck, and they testified against him forty times. Abu Bakr hit him forty times with a whip. Then Umar (may Allah be pleased with him) continued to hit him in front of the people until people started following him in hitting Khalid. Umar consulted and struck him eighty times. This continued
رَأَيْتُ النَّبِيَّ ﷺ عَامَ حُنَيْنٍ يَسْأَلُ عَنْ رَجُلِ خَالِدِ بْنِ الْوَلِيدِ فَجِئْتُ بَيْنَ يَدَيْهِ أَسْأَلُ عَنْ رَجُلِ خَالِدٍ حَتَّى أَتَاهُ جَذَعًا وَأُتِيَ النَّبِيُّ ﷺ بِشَارِبٍ قَالَ اضْرِبُوهُ فَضَرَبُوهُ بِالْأَيْدِي وَالنِّعَالِ وَأَطْرَافِ الثِّيَابِ وَحَثَوْا عَلَيْهِ التُّرَابَ ثُمَّ قَالَ النَّبِيُّ ﷺ بَكِّتُوهُ فَبَكَتُوهُ ثُمَّ أَرْسَلَهُ قَالَ فَلَمَّا كَانَ أَبُو بَكْرٍ ؓ سَأَلَ مَنْ حَضَرَ ذَلِكَ الْمَضْرُوبَ فَقَوَّمَهُ أَرْبَعِينَ فَضَرَبَ أَبُو بَكْرٍ ؓ فِي الْخَمْرِ أَرْبَعِينَ حَيَاتَهُ ثُمَّ عُمَرُ ؓ حَتَّى تَتَابَعَ النَّاسُ فِي الْخَمْرِ فَاسْتَشَارَ فَضَرَبَهُ ثَمَانِينَ وَكَذَلِكَ
[Machine] I saw the Prophet ﷺ during the year of conquest and I was a young boy asking about the location of Khalid ibn Al-Walid's house. So, I was brought a bearded man and they ordered him to be beaten with what they had in their hands. Some of them used a whip to beat him, while others used a stick. The Prophet ﷺ then brushed off the dust from his clothes.
رَأَيْتُ النَّبِيَّ ﷺ عَامَ الْفَتْحِ وَأَنَا غُلَامٌ شَابٌّ يَسْأَلُ عَنْ مَنْزِلِ خَالِدِ بْنِ الْوَلِيدِ فَأُتِيَ بِشَارِبٍ فَأَمَرَهُمْ فَضَرَبُوهُ بِمَا فِي أَيْدِيهِمْ فَمِنْهُمْ مَنْ يَضْرِبُ بِالسَّوْطِ وَمِنْهُمْ مَنْ يَضْرِبُ بِالْعَصَا وَحَثَا عَلَيْهِ النَّبِيُّ ﷺ التُّرَابَ
[Machine] On the day of Hunayn, the Prophet ﷺ was asking people about the whereabouts of Khalid ibn al-Walid. They brought a drunk person to him, and the Messenger of Allah ﷺ said, "Whoever has control over him, strike him." So they struck him with whatever was in their hands. The Messenger of Allah ﷺ then vowed that he would sprinkle dust on him. Then Abu Bakr came with a drunk person, and the one who had been struck that day avenged himself by striking him forty times. Al-Zuhri said, "Then Humaid ibn Abdur Rahman told me, on the authority of Ibn Jabalah al-Kalbi, that Khalid ibn al-Walid sent me to Umar. So I went to him, and with him were Uthman ibn Affan, Abdul Rahman ibn Awf, Ali, Talha, and Zubayr, and they were reclining in the mosque. And I said, 'Khalid ibn al-Walid sends greetings to you, and he says that the people have become preoccupied with wine and have disregarded the punishment for it.' Umar said, 'Are they here with you?' So he asked them, and Ali said, 'We see him when he is intoxicated, he does this and does that, and he accuses others of it. And for the accuser, the punishment is eighty lashes.' Umar said, 'Convey to your companion what I have said.' He said, 'So Umar lashed Khalid eighty times, and he lashed Umar eighty times as well.' And when a weak person who had made a mistake was brought to Umar, he would strike him forty times. Uthman also struck him eighty-four times. And this is narrated by Al-Husayn, on the authority of Ya'qub, on the authority of Roha, on the authority of Osama ibn Zaid, on the authority of Ibn Shihab, on the authority of Abdur Rahman ibn Azhar, on the authority of the Prophet ﷺ , something similar to this was mentioned. Al-Husayn also narrated, on the authority of Ya'qub, on the authority of Uthman ibn Umar, on the authority of Osama ibn Zaid, on the authority of Al-Zuhri, on the authority of Abdur Rahman ibn Azhar, on the authority of the Prophet ﷺ , something similar to this was mentioned.
ﷺ يَوْمَ حُنَيْنٍ وَهُوَ يَتَخَلَّلُ النَّاسَ يَسْأَلُ عَنْ مَنْزِلِ خَالِدِ بْنِ الْوَلِيدِ فَأُتِيَ بِسَكْرَانَ قَالَ فَقَالَ رَسُولُ اللهِ ﷺ لِمَنْ عِنْدَهُ اضْرِبُوهُ فَضَرَبُوهُ بِمَا فِي أَيْدِيهِمْ قَالَ وَحَثَا رَسُولُ اللهِ ﷺ عَلَيْهِ التُّرَابَ قَالَ ثُمَّ أُتِيَ أَبُو بَكْرٍ ؓ بِسَكْرَانَ قَالَ فَتَوَخَّى الَّذِي كَانَ مِنْ ضَرْبِهِمْ يَوْمَئِذٍ فَضَرَبَ أَرْبَعِينَ قَالَ الزُّهْرِيُّ ثُمَّ أَخْبَرَنِي حُمَيْدُ بْنُ عَبْدِ الرَّحْمَنِ عَنِ ابْنِ وَبَرَةَ الْكَلْبِيِّ قَالَ أَرْسَلَنِي خَالِدُ بْنُ الْوَلِيدِ إِلَى عُمَرَ ؓ فَأَتَيْتُهُ وَمَعَهُ عُثْمَانُ بْنُ عَفَّانَ وَعَبْدُ الرَّحْمَنِ بْنُ عَوْفٍ ؓ وَعَلِيٌّ وَطَلْحَةُ وَالزُّبَيْرُ ؓ وَهُمْ مَعَهُ مُتَّكِئُونَ فِي الْمَسْجِدِ فَقُلْتُ إِنَّ خَالِدَ بْنَ الْوَلِيدِ أَرْسَلَنِي إِلَيْكَ وَهُوَ يَقْرَأُ عَلَيْكَ السَّلَامَ وَيَقُولُ إِنَّ النَّاسَ قَدِ انْهَمَكُوا فِي الْخَمْرِ وَتَحَاقَرُوا الْعُقُوبَةَ فِيهِ فَقَالَ عُمَرُ ؓ هُمْ هَؤُلَاءِ عِنْدَكَ فَسَأَلَهُمْ فَقَالَ عَلِيٌّ ؓ نَرَاهُ إِذَا سَكِرَ هَذَى وَإِذَا هَذَا افْتَرَى وَعَلَى الْمُفْتَرِي ثَمَانُونَ قَالَ فَقَالَ عُمَرُ ؓ أَبْلِغْ صَاحِبَكَ مَا قَالَ قَالَ فَجَلَدَ خَالِدٌ ؓ ثَمَانِينَ وَجَلَدَ عُمَرُ ؓ ثَمَانِينَ قَالَ وَكَانَ عُمَرُ ؓ إِذَا أُتِيَ بِالرَّجُلِ الضَّعِيفِ الَّتِي كَانَتْ مِنْهُ الزَّلَّةُ ضَرَبَهُ أَرْبَعِينَ قَالَ وَجَلَدَ عُثْمَانُ ؓ أَيْضًا ثَمَانِينَ وَأَرْبَعِينَ 17540 قَالَ وَحَدَّثَنَا الْحُسَيْنُ ثنا يَعْقُوبُ ثنا رَوْحٌ ثنا أُسَامَةُ بْنُ زَيْدٍ ثنا ابْنُ شِهَابٍ أَخْبَرَنِي عَبْدُ الرَّحْمَنِ بْنُ أَزْهَرَ عَنِ النَّبِيِّ ﷺ مِثْلَ ذَلِكَ 17541 قَالَ وَحَدَّثَنَا الْحُسَيْنُ ثنا يَعْقُوبُ ثنا عُثْمَانُ بْنُ عُمَرَ ثنا أُسَامَةُ بْنُ زَيْدٍ عَنِ الزُّهْرِيِّ عَنْ عَبْدِ الرَّحْمَنِ بْنِ أَزْهَرَ عَنِ النَّبِيِّ ﷺ فَذَكَرَ مِثْلَ ذَلِكَ
A man who had drunk wine was brought before the Prophet ﷺ when he was in Hunayn. He threw some dust on his face. He then ordered his Companions and they beat him with their sandals and whatever they had in their hands. He then said to them: Leave him, and they left him. The Messenger of Allah ﷺ then died, and AbuBakr gave forty lashes for drinking wine, and then Umar in the beginning of his Caliphate inflicted forty stripes and at the end of his Caliphate he inflicted eighty stripes. Uthman (after him) inflicted both punishments, eighty and forty stripes, and finally Mu'awiyah established eighty stripes. (Using translation from Abū Dāʾūd 4488)
أَخْبَرَهُ عَنْ أَبِيهِ أُتِيَ رَسُولُ اللهِ ﷺ بِشَارِبٍ وَهُوَ بِحُنَيْنٍ فَحَثَا فِي وَجْهِهِ التُّرَابَ ثُمَّ أَمَرَ أَصْحَابَهُ فَضَرَبُوهُ بِنِعَالِهِمْ وَمَا كَانَ فِي أَيْدِيهِمْ حَتَّى قَالَ لَهُمْ ارْفَعُوا فَرَفَعُوا فَتُوُفِّيَ رَسُولُ اللهِ ﷺ ثُمَّ جَلَدَ أَبُو بَكْرٍ ؓ فِي الْخَمْرِ أَرْبَعِينَ ثُمَّ جَلَدَ عُمَرُ ؓ أَرْبَعِينَ صَدْرًا مِنْ إِمَارَتِهِ ثُمَّ جَلَدَ ثَمَانِينَ فِي آخِرِ خِلَافَتِهِ ثُمَّ جَلَدَ عُثْمَانُ ؓ الْحَدَّيْنِ كِلَيْهِمَا ثَمَانِينَ وَأَرْبَعِينَ ثُمَّ أَثْبَتَ مُعَاوِيَةُ رَحِمَهُ اللهُ الْحَدَّ ثَمَانِينَ
[Machine] "That they used to beat the drinkers during the time of the Messenger of Allah ﷺ with their hands, sandals, and sticks. They were even more numerous during the caliphate of Abu Bakr. Abu Bakr said, 'If we imposed this punishment on them, it would exceed what they were beaten during the time of the Messenger of Allah ﷺ .' So Abu Bakr whipped them forty times until they died. Then it happened in the time of Umar after them, and he whipped them likewise forty times until a man from the early emigrants came and drank. Umar ordered that he be whipped, and he said, 'Why are you whipping me? Between me and you is the Book of Allah.' Umar asked him, 'In which verse of the Book of Allah do you find that I should not whip you?' He said, 'Indeed, Allah the Almighty says in His Book, "There is no sin upon those who believe and do righteous deeds for what they have eaten" (Surah Al-Ma'idah, 5:93). I am a witness with the Messenger of Allah ﷺ at Badr, Uhud, the Trench, and the Marites.'" Umair said: "Why don't you respond to what he is saying?" Ibn Abbas said: "These verses were revealed as an excuse for those before and a proof against those who come after. It was an excuse for those before because they met Allah before prohibition was imposed upon them, and it was a proof against those who come after because Allah the Almighty says, 'O you who have believed, indeed, intoxicants, gambling, [sacrificing on] stone alters [to other than Allah], and divining arrows are but defilement from the work of Satan' (Surah Al-Ma'idah, 5:90). If it is from those who believe and do righteous deeds and they fear Allah and excel in good, then indeed Allah has forbidden them from drinking intoxicants." Umair said: "So what do you see?" Ali ibn Abi Talib said: "We see that if he drinks and becomes intoxicated, he is lashed. And if he is intoxicated and behaves foolishly, he is beaten. And the one who behaves foolishly is penalized with eighty lashes. So Umar ordered that he be whipped eighty times." 17544 This was narrated to us by Ali ibn Abi Abdullah Al-Hafiz, narrated to us by Abdullah ibn Ja'far Al-Farisi, narrated to us by Ya'qub ibn Sufyan, narrated to us by Sa'id ibn Kathir ibn 'Ufair, who narrated to me Yahya ibn Fuleih, from Thawr ibn Zaid, from Ikrimah, from Ibn Abbas, that they used to beat the drinkers during the time of the Messenger of Allah ﷺ with their hands, sandals, and sticks until the Messenger of Allah ﷺ passed away. Then he mentioned the hadith in detail."
أَنَّ الشُّرَّابَ كَانُوا يُضْرَبُونَ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ يَعْنِي بِالْأَيْدِي وَالنِّعَالِ وَالْعِصِيِّ قَالَ وَكَانُوا فِي خِلَافَةِ أَبِي بَكْرٍ ؓ أَكْثَرَ مِنْهُمْ فِي عَهْدِ النَّبِيِّ ﷺ فَقَالَ أَبُو بَكْرٍ ؓ لَوْ فَرَضْنَا لَهُمْ هَذَا فَتَوَخَّى نَحْوًا مِمَّا كَانُوا يُضْرَبُونَ فِي عَهْدِ رَسُولِ اللهِ ﷺ فَكَانَ أَبُو بَكْرٍ ؓ يَجْلِدُهُمْ أَرْبَعِينَ حَتَّى تُوُفِّيَ ثُمَّ كَانَ عُمَرُ ؓ مِنْ بَعْدِهِمْ فَجَلَدَهُمْ كَذَلِكَ أَرْبَعِينَ حَتَّى أُتِيَ بِرَجُلٍ مِنَ الْمُهَاجِرِينَ الْأَوَّلِينَ وَقَدْ شَرِبَ فَأَمَرَ بِهِ أَنْ يُجْلَدَ فَقَالَ لِمَ تَجْلِدُنِي؟ بَيْنِي وَبَيْنَكَ كِتَابُ اللهِ قَالَ وَفِي أِيِّ كِتَابِ اللهِ تَجِدُ أَنْ لَا أَجْلِدَكَ؟ قَالَ إِنَّ اللهَ تَعَالَى يَقُولُ فِي كِتَابِهِ {لَيْسَ عَلَى الَّذِينَ آمَنُوا وَعَمِلُوا الصَّالِحَاتِ جُنَاحٌ فِيمَا طَعِمُوا} [المائدة 93] الْآيَةَ شَهِدْتُ مَعَ رَسُولِ اللهِ ﷺ بَدْرًا وَأُحُدًا وَالْخَنْدَقَ وَالْمَشَاهِدَ فَقَالَ عُمَرُ ؓ أَلَا تَرُدُّونَ عَلَيْهِ مَا يَقُولُ؟ فَقَالَ ابْنُ عَبَّاسٍ إِنَّ هَؤُلَاءِ الْآيَاتِ نَزَلَتْ عُذْرًا لِلْمَاضِينَ وَحُجَّةً عَلَى الْبَاقِينَ فَعُذْرُ الْمَاضِينَ؛ لِأَنَّهُمْ لَقُوا اللهَ ﷻ قَبْلَ أَنْ تُحَرَّمَ عَلَيْهِمُ الْخَمْرُ وَحُجَّةً عَلَى الْبَاقِينَ؛ لِأَنَّ اللهَ تَعَالَى يَقُولُ {يَا أَيُّهَا الَّذِينَ آمَنُوا إِنَّمَا الْخَمْرُ وَالْمَيْسِرُ وَالْأَنْصَابُ وَالْأَزْلَامُ} [المائدة 90] الْآيَةَ فَإِنْ كَانَ مِنَ الَّذِينَ آمَنُوا وَعَمِلُوا الصَّالِحَاتِ ثُمَّ اتَّقَوْا وَأَحْسَنُوا فَإِنَّ اللهَ قَدْ نَهَى أَنْ تُشْرَبَ الْخَمْرُ قَالَ عُمَرُ ؓ فَمَاذَا تَرَوْنَ؟ قَالَ عَلِيُّ بْنُ أَبِي طَالِبٍ ؓ نَرَى أَنَّهُ إِذَا شَرِبَ سَكِرَ وَإِذَا سَكِرَ هَذَى وَإِذَا هَذَى افْتَرَى وَعَلَى الْمُفْتَرِي ثَمَانُونَ جَلْدَةً فَأَمَرَ عُمَرُ فَجُلِدَ ثَمَانِينَ 17544 أَخْبَرَنَاهُ عَالِيًا أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا عَبْدُ اللهِ بْنُ جَعْفَرٍ الْفَارِسِيُّ ثنا يَعْقُوبُ بْنُ سُفْيَانَ ثنا سَعِيدُ بْنُ كَثِيرِ بْنِ عُفَيْرٍ حَدَّثَنِي يَحْيَى بْنُ فُلَيْحٍ عَنْ ثَوْرِ بْنِ زَيْدٍ عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ أَنَّ الشُّرَّابَ كَانُوا يُضْرَبُونَ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ بِالْأَيْدِي وَالنِّعَالِ وَالْعِصِيِّ حَتَّى تُوُفِّيَ رَسُولُ اللهِ ﷺ قَالَ ثُمَّ ذَكَرَ الْحَدِيثَ بِطُولِهِ
[Machine] Umar came across an elderly man who had consumed alcohol during the month of Ramadan. Umar lashed him eighty times and banished him to Syria. He also made him ask, "Should our children fast during the month of Ramadan, or should our young boys fast?"
أُتِيَ عُمَرُ ؓ بِشَيْخٍ قَدْ شَرِبَ الْخَمْرَ فِي شَهْرِ رَمَضَانَ فَجَلَدَهُ ثَمَانِينَ وَنَفَاهُ إِلَى الشَّامِ وَجَعَلَ يَقُولُ لِلْمَنْخَرَيْنِ أَفِي شَهْرِ رَمَضَانَ وَوُلْدَانِنَا صِيَامٌ أَوْ صِبْيَانُنَا صِيَامٌ؟
[Machine] Ali came with a bowl full of wine and drank it during Ramadan, then he broke his fast. So he was beaten eighty times.
أُتِيَ عَلِيٌّ ؓ بِالنَّجَاشِيِّ قَدْ شَرِبَ خَمْرًا فِي رَمَضَانَ فَأَفْطَرَ فَضَرَبَهُ ثَمَانِينَ ثُمَّ
[Machine] That Ali had whipped a man forty lashes with a whip that had two ends, as if he intended to double the lashes with each end. And it was mentioned in another place, as we have narrated in the Hadith of Sa'dan, that it was narrated to us in the continuous Hadith, that he ordered forty lashes and argued with someone before him. And this narration is disconnected, and Allah knows best.
أَنَّ عَلِيًّا ؓ جَلَدَ رَجُلًا فِي الْخَمْرِ أَرْبَعِينَ جَلْدَةً بِسَوْطٍ لَهُ طَرَفَانِ وَكَأَنَّهُ أَرَادَ صَارَ أَرْبَعِينَ بِالطَّرَفَيْنِ وَذَكَرَهُ فِي مَوْضِعٍ آخَرَ كَمَا رُوِّينَا فِي حَدِيثِ سَعْدَانَ فَقَدْ رُوِّينَا فِي الْحَدِيثِ الْمَوْصُولِ عَنْهُ أَنَّهُ أَمَرَ بِجَلْدِهِ أَرْبَعِينَ وَاحْتَجَّ فِيهِ بِمَنْ قَبْلَهُ وَهَذِهِ الرِّوَايَةُ مُنْقَطِعَةٌ وَاللهُ أَعْلَمُ
[Machine] Ben Al-Khattab, Uthman bin Affan, and Abdullah bin Umar had their slaves beaten with half the punishment of free individuals for drinking alcohol.
بْنَ الْخَطَّابِ وَعُثْمَانَ بْنَ عَفَّانَ وَعَبْدَ اللهِ بْنَ عُمَرَ ؓ قَدْ جَلَدُوا عَبِيدَهُمْ نِصْفَ حَدِّ الْحُرِّ فِي الْخَمْرِ
57.19 [Machine] The drinker dies from excess beyond forty, and one who dies without an obligatory limit is punished for it.
٥٧۔١٩ بَابُ الشَّارِبِ يُضْرَبُ زِيَادَةً عَلَى الْأَرْبَعِينَ فَيَمُوتُ فِي الزِّيَادَةِ , وَالَّذِي يَمُوتُ فِي غَيْرِ حَدٍّ وَاجِبٍ فِيمَا يُعَاقَبُ بِهِ
[Machine] There is no man upon whom I have imposed a punishment and he died, except that I find nothing in myself except for alcohol. For indeed, if he dies, I will mourn him, for the Messenger of Allah ﷺ did not recommend it.
مَا مِنْ رَجُلٍ أَقَمْتُ عَلَيْهِ حَدًّا فَمَاتَ فَأَجِدُ فِي نَفْسِي إِلَّا الْخَمْرَ فَإِنَّهُ إِنْ مَاتَ وَدَيْتُهُ ؛ أَنَّ رَسُولَ اللهِ ﷺ لَمْ يَسُنَّهُ
