٥٧۔ كِتَابُ الْأَشْرِبَةِ وَالْحَدُّ فِيهَا ص ٣
[Machine] That the Messenger of Allah ﷺ used to fast, so I prepared his Iftar with wine that I made with grapes in a container. Then I brought it to him and he realized what it was, so he said, "Strike the wall with this, for this is the drink of those who do not believe in Allah and the Last Day." And Abu al-Hasan Ali ibn Ahmad ibn Abdan informed us that Ahmad ibn Ubaid al-Saffar narrated to us, who was narrated by al-Hulwani, meaning Ahmad ibn Yahya, who was narrated by al-Haytham ibn Kharjah, who was narrated by Uthman ibn Allaq, from Zaid ibn Waqid, who said: Khaled ibn Husain, the freed slave of Uthman ibn Affan, narrated to me. He said: I heard Abu Huraira saying, and he mentioned its meaning.
أَنَّ رَسُولَ اللهِ ﷺ كَانَ يَصُومُ فَتَحَيَّنْتُ فِطْرَهُ بِنَبِيذٍ صَنَعْتُهُ فِي دُبَّاءٍ ثُمَّ أَتَيْتُهُ بِهِ فَإِذَا هُوَ يَنِشُّ فَقَالَ اضْرِبْ بِهَذَا الْحَائِطَ فَإِنَّ هَذَا شَرَابُ مَنْ لَا يُؤْمِنُ بِاللهِ وَالْيَوْمِ الْآخِرِ 17434 وَأَخْبَرَنَا أَبُو الْحَسَنِ عَلِيُّ بْنُ أَحْمَدَ بْنِ عَبْدَانَ أنبأ أَحْمَدُ بْنُ عُبَيْدٍ الصَّفَّارُ ثنا الْحُلْوَانِيُّ يَعْنِي أَحْمَدَ بْنَ يَحْيَى ثنا الْهَيْثَمُ بْنُ خَارِجَةَ ثنا عُثْمَانُ بْنُ عَلَّاقٍ عَنْ زَيْدِ بْنِ وَاقِدٍ قَالَ حَدَّثَنِي خَالِدُ بْنُ حُسَيْنٍ مَوْلَى عُثْمَانَ بْنِ عَفَّانَ ؓ قَالَ سَمِعْتُ أَبَا هُرَيْرَةَ يَقُولُ فَذَكَرَ مَعْنَاهُ
[Machine] Mus'ab al-Ash'ari came to the Prophet Muhammad ﷺ with a jar of wine that was still fermenting. The Prophet commanded him to strike the wall with it, saying that whoever believes in Allah and the Day of Judgment should not drink it. The scholar, may Allah have mercy on him, said that even if it was permissible to pour water over it to make it permissible, the Prophet still would not have commanded to pour it out. Allah knows better, and I have seen in the narration of Yahya ibn Abi Kathir from Thumamah ibn Kalab from Abu Salamah from Aisha, raised up, "Do not reject the pulp of grapes, the skin of fruit, the skin of a watermelon, and do not reject all types of dates, raisins, except for that. If it becomes intense for you, then break it with water." Thumamah ibn Kalab is unknown and what is certain is what is narrated from Yahya ibn Abi Kathir from Abu Salamah from Abu Qatadah from the Prophet Muhammad ﷺ in prohibition of mixing without this wording. Allah knows best, and I have also seen it in the narration of Ikrimah ibn Ammar from Abu Kathir al-Suhaymi from Abu Hurairah, raised up, except that he said, "When you have doubt about your drink, then pour water on it to remove its prohibition and drink its permissibility." This is also weak, Ikrimah ibn Ammar mixed up in the later part of his life and his memory deteriorated, so he narrated what was not continuous on him, and it is attributed to him.
مُوسَى الْأَشْعَرِيَّ ؓ أَتَى النَّبِيَّ ﷺ بِنَبِيذِ جَرٍّ يَنِشُّ فَقَالَ اضْرِبْ بِهِ الْحَائِطَ فَإِنَّهُ لَا يَشْرَبُ هَذَا مَنْ كَانَ يُؤْمِنُ بِاللهِ وَالْيَوْمِ الْآخِرِ قَالَ الشَّيْخُ رَحِمَهُ اللهُ وَلَوْ كَانَ إِلَى إِحْلَالِهِ بِصَبِّ الْمَاءِ عَلَيْهِ سَبِيلٌ لَمَا أَمَرَ بِإِرَاقَتِهِ وَاللهُ أَعْلَمُ وَرَأَيْتُ فِي حَدِيثِ يَحْيَى بْنِ أَبِي كَثِيرٍ عَنْ ثُمَامَةَ بْنِ كِلَابٍ عَنْ أَبِي سَلَمَةَ عَنْ عَائِشَةَ ؓ مَرْفُوعًا لَا تَنْبِذُوا فِي الدُّبَّاءِ وَالْمُزَفَّتِ وَلَا النَّقِيرِ وَلَا الْحَنْتَمِ وَلَا تَنْبِذُوا الْبُسْرَ وَالرُّطَبَ جَمِيعًا وَلَا التَّمْرَ وَالزَّبِيبَ جَمِيعًا وَمَا كَانَ سِوَى ذَلِكَ فَاشْتَدَّ عَلَيْكُمْ فَاكْسِرُوهُ بِالْمَاءِ وَثُمَامَةُ بْنُ كِلَابٍ هَذَا مَجْهُولٌ وَالثَّابِتُ عَنْ يَحْيَى بْنِ أَبِي كَثِيرٍ عَنْ أَبِي سَلَمَةَ عَنْ أَبِي قَتَادَةَ عَنِ النَّبِيِّ ﷺ فِي النَّهْيِ عَنِ الْخَلِيطَيْنِ دُونَ هَذِهِ اللَّفْظَةِ وَاللهُ أَعْلَمُ وَرَأَيْتُهُ أَيْضًا فِي حَدِيثِ عِكْرِمَةَ بْنِ عَمَّارٍ عَنْ أَبِي كَثِيرٍ السُّحَيْمِيِّ عَنْ أَبِي هُرَيْرَةَ مَرْفُوعًا إِلَّا أَنَّهُ قَالَ إِذَا رَابَكَ مِنْ شَرَابِكَ رَيْبٌ فشِنَّ عَلَيْهِ الْمَاءَ أَمِطْ عَنْكَ حَرَامَهُ وَاشْرَبْ حَلَالَهُ وَهَذَا أَيْضًا ضَعِيفٌ عِكْرِمَةُ بْنُ عَمَّارٍ اخْتَلَطَ فِي آخِرِ عُمْرِهِ وَسَاءَ حِفْظُهُ فَرَوَى مَا لَمْ يُتَابَعْ عَلَيْهِ وَقَدْ
[Machine] The Messenger of Allah ﷺ circled the house on a scorching hot day and asked the people of Quraysh if anyone had any drink to send it to him. So a man from them went to his house and a maid came with a vessel containing raisin wine. When the Prophet ﷺ saw it, he said, "Can't you ferment it even with a stick on it? " When he brought it closer, he found a strong scent from it, so he poured it out and threw away the vessel. The man said, "O Messenger of Allah, if it is Haram (forbidden), we would not have drunk it." So the vessel was returned and a bucket of Zamzam water was poured on it, and he said, "If its drink intensifies on you, do the same."
طَافَ رَسُولُ اللهِ ﷺ بِالْبَيْتِ فِي يَوْمٍ قَائِظٍ شَدِيدِ الْحَرِّ فَاسْتَسْقَى رَهْطًا مِنْ قُرَيْشٍ فَقَالَ هَلْ عِنْدَ أَحَدٍ مِنْكُمْ شَرَابٌ فَيُرْسِلَ إِلَيْهِ؟ فَأَرْسَلَ رَجُلٌ مِنْهُمْ إِلَى مَنْزِلِهِ فَجَاءَتْ جَارِيَةٌ مَعَهَا إِنَاءٌ فِيهِ نَبِيذُ زَبِيبٍ فَلَمَّا رَآهَا النَّبِيُّ ﷺ قَالَ أَلَا خَمَّرْتَهُ وَلَوْ بِعُودٍ تُعْرَضُ عَلَيْهِ؟ فَلَمَّا أَدْنَاهُ مِنْهُ وَجَدَ لَهُ رَائِحَةً شَدِيدَةً فَقَطَبَ وَرَدَّ الْإِنَاءَ فَقَالَ الرَّجُلُ يَا رَسُولَ اللهِ إِنْ يَكُنْ حَرَامًا لَمْ نَشْرَبْهُ فَاسْتَعَادَ الْإِنَاءَ وَصَنَعَ مِثْلَ ذَلِكَ فَقَالَ الرَّجُلُ مِثْلَ ذَلِكَ فَدَعَا بِدَلْوٍ مِنْ مَاءِ زَمْزَمَ فَصَبَّهُ عَلَى الْإِنَاءِ وَقَالَ إِذَا اشْتَدَّ عَلَيْكُمْ شَرَابُهُ فَاصْنَعُوا بِهِ هَكَذَا
[Machine] The Messenger of Allah ﷺ went around on a hot day and asked for water. He was brought a container of wine, but when he was about to drink it, a branch fell into it, so he left it. The man said, "O Messenger of Allah, is this drink forbidden for the people of Makkah?" He remained silent. Then it was brought to him a second time, and a branch fell into it, but he wiped it off. The man said to him the same thing, so he called for sins or a bucket of water and poured it over it. Then he gave it to the one next to him and the one on his right to drink. Then he said, "Do the same when it overpowers you. This is what you should do when it overpowers you."
طَافَ رَسُولُ اللهِ ﷺ فِي يَوْمٍ حَارٍّ فَاسْتَسْقَى فَأُتِيَ بِإِنَاءٍ مِنْ نَبِيذٍ فَلَمَّا رَفَعَهُ إِلَى فِيهِ قَطَبَ فَتَرَكَهُ فَقَالَ الرَّجُلُ يَا رَسُولَ اللهِ هَذَا شَرَابُ أَهْلِ مَكَّةَ أَحَرَامٌ هُوَ؟ فَسَكَتَ ثُمَّ أَتَاهُ الثَّانِيَةَ فَقَطَبَ فَنَحَّاهُ فَقَالَ لَهُ الرَّجُلُ مِثْلَ ذَلِكَ فَدَعَا بِذَنُوبٍ أَوْ دَلْوٍ مِنْ مَاءٍ فَصَبَّهُ عَلَيْهِ ثُمَّ سَقَى الَّذِي يَلِيهِ وَالَّذِي عَنْ يَمِينِهِ ثُمَّ قَالَ هَكَذَا اصْنَعُوا بِهِ إِذَا غَلَبَكُمْ فَهَذَا إِنَّمَا
[Machine] The Messenger of Allah ﷺ became thirsty near the Kaaba, so he asked for water. He was given wine from the water container, which he smelled and turned away from. He said, "Bring me Zamzam water." Then he poured it over the wine and drank it. A man said, "Is it forbidden, O Messenger of Allah?" He said, "No, the wording is from the hadith of the Shahidiyy and the hadith of Abu Ma'mar, and the hadith goes like this: The Prophet ﷺ was asked while circumambulating the Kaaba whether it is halal or haram. He said, 'It is halal,' meaning the wine." Ali ibn Umar said, "This is a well-known hadith from Yahya ibn Yemen, and it is said that the chain of narration has been mixed with the hadith of Kalbi from Abu Salih, and Kalbi is abandoned and Abu Salih is weak. I was told by Abu Sa'd al-Malini, who was informed by Abu Ahmad ibn Adi al-Hafiz, who said, "I heard Abdan saying, 'I heard Muhammad ibn Abdullah ibn Numayr saying, 'Ibn Yemen is forgetful and his hadith is incorrect, and it is from Thawri from Mansur from Khalid ibn Sa'd from Abu Mas'ud, and it is actually from Kalbi from Abu Salih from Muttalib ibn Abi Wada'ah.' I was informed by Abu Abdul Rahman al-Sulami, who was informed by Abu al-Hasan al-Mahmoudi, who informed us that Abu Abdullah Muhammad ibn Ali al-Hafiz informed us that Abu Musa said, 'I mentioned to AbdurRahman ibn Mahdi the hadith of Sufyan from Mansur regarding wine, and he said, 'Do not narrate this. The Sheikh's narration has been stolen by Abdul Aziz ibn Aban and it was narrated by Sufyan, and it was also stolen by Yasir ibn Ismail and it was narrated by Zaid ibn Hibab from Sufyan. Abdul Aziz ibn Aban is abandoned and Yasir ibn Ismail is weak in hadith.'
عَطِشَ رَسُولُ اللهِ ﷺ حَوْلَ الْكَعْبَةِ فَاسْتَسْقَى فَأُتِيَ بِنَبِيذٍ مِنَ السِّقَايَةِ فَشَمَّهُ فَقَطَبَ فَقَالَ عَلَيَّ بِذَنُوبٍ مِنْ زَمْزَمَ فَصَبَّهُ عَلَيْهِ ثُمَّ شَرِبَ فَقَالَ رَجُلٌ حَرَامٌ هُوَ يَا رَسُولَ اللهِ؟ قَالَ لَا لَفْظُ حَدِيثِ الشَّهِيدِيِّ وَحَدِيثُ أَبِي مَعْمَرٍ مُخْتَصَرٌ سُئِلَ النَّبِيُّ ﷺ وَهُوَ فِي الطَّوَافِ أَحَلَالٌ هُوَ أَمْ حَرَامٌ؟ قَالَ حَلَالٌ يَعْنِي النَّبِيذَ قَالَ عَلِيُّ بْنُ عُمَرَ هَذَا حَدِيثٌ مَعْرُوفٌ بِيَحْيَى بْنِ يَمَانٍ وَيُقَالُ إِنَّهُ انْقَلَبَ عَلَيْهِ الْإِسْنَادُ وَاخْتَلَطَ بِحَدِيثِ الْكَلْبِيِّ عَنْ أَبِي صَالِحٍ وَالْكَلْبِيُّ مَتْرُوكٌ وَأَبُو صَالِحٍ ضَعِيفٌ 17439 أَخْبَرَنَا أَبُو سَعْدٍ الْمَالِينِيُّ أَنْبَأَ أَبُو أَحْمَدَ بْنُ عَدِيٍّ الْحَافِظُ قَالَ سَمِعْتُ عَبْدَانَ يَقُولُ سَمِعْتُ مُحَمَّدَ بْنَ عَبْدِ اللهِ بْنِ نُمَيْرٍ يَقُولُ ابْنُ يَمَانٍ سَرِيعُ النِّسْيَانَ وَحَدِيثُهُ خَطَأٌ عَنِ الثَّوْرِيِّ عَنْ مَنْصُورٍ عَنْ خَالِدِ بْنِ سَعْدٍ عَنْ أَبِي مَسْعُودٍ إِنَّمَا هُوَ عَنِ الْكَلْبِيِّ عَنْ أَبِي صَالِحٍ عَنِ الْمُطَّلِبِ بْنِ أَبِي وَدَاعَةَ 17440 وَأَخْبَرَنَا أَبُو سَعْدٍ أَنْبَأَ أَبُو أَحْمَدَ ثنا الْجُنَيْدِيُّ قَالَ قَالَ الْبُخَارِيُّ فِي حَدِيثِ يَحْيَى بْنِ الْيَمَانِ هَذَا لَمْ يَصِحَّ عَنِ النَّبِيِّ ﷺ هَذَا وَقَالَ الْأَشْجَعِيُّ وَغَيْرُهُ عَنْ سُفْيَانَ الْكَلْبِيِّ عَنْ أَبِي صَالِحٍ عَنِ الْمُطَّلِبِ 17441 أَخْبَرَنَا أَبُو عَبْدِ الرَّحْمَنِ السُّلَمِيُّ أَنْبَأَ أَبُو الْحَسَنِ الْمَحْمُودِيُّ ثنا أَبُو عَبْدِ اللهِ مُحَمَّدُ بْنُ عَلِيٍّ الْحَافِظُ ثنا أَبُو مُوسَى قَالَ ذَكَرْتُ لِعَبْدِ الرَّحْمَنِ بْنِ مَهْدِيٍّ حَدِيثَ سُفْيَانَ عَنْ مَنْصُورٍ فِي النَّبِيذِ قَالَ لَا تُحَدِّثْ بِهَذَا قَالَ الشَّيْخُ وَقَدْ سَرَقَهُ عَبْدُ الْعَزِيزِ بْنُ أَبَانٍ فَرَوَاهُ عَنْ سُفْيَانَ وَسَرَقَهُ الْيَسَعُ بْنُ إِسْمَاعِيلَ فَرَوَاهُ عَنْ زَيْدِ بْنِ الْحُبَابِ عَنْ سُفْيَانَ وَعَبْدُ الْعَزِيزِ بْنُ أَبَانٍ مَتْرُوكٌ وَالْيَسَعُ بْنُ إِسْمَاعِيلَ ضَعِيفُ الْحَدِيثِ
[Machine] Ibn Abbas narrated about the story of the Prophet's circumambulation (tawaf) and his supplication with a drink. He said, "A drink was brought to him and he drank from it, then he called for water and poured it in it and drank. Then, it became intense for him, so he called for water and poured it in it, and then he drank two or three times. Then he said, 'When it becomes intense for you, kill it with water.' Yazid ibn Abi Ziyad is weak and his narration is not relied upon due to his poor memory retention. Khaled al-Hadha narrated from Ikrimah from Ibn Abbas the story of the Prophet's circumambulation and his drinking, but he did not mention what Yazid ibn Abi Ziyad mentioned. This additional information is only known from the narration of Al-Kalbi, as mentioned before. Furthermore, it is stated that the Prophet ﷺ drank from it before mixing it with water, which is contrary to other narrations. How can it be believed that the Prophet ﷺ would drink an intoxicant, if it was indeed intoxicating according to their claim, before mixing it with water? This indicates that there is no basis for their claim. Allah knows best.
عَنِ ابْنِ عَبَّاسٍ فِي قِصَّةِ طَوَافِ النَّبِيِّ ﷺ وَدُعَائِهِ بِشَرَابٍ قَالَ فَأُتِيَ بِشَرَابٍ فَشَرِبَ مِنْهُ ثُمَّ دَعَا بِالْمَاءِ فَصَبَّهُ فِيهِ فَشَرِبَ ثُمَّ اشْتَدَّ عَلَيْهِ فَدَعَا بِمَاءٍ فَصَبَّهُ فِيهِ ثُمَّ شَرِبَ مَرَّتَيْنِ أَوْ ثَلَاثَةً ثُمَّ قَالَ إِذَا اشْتَدَّ عَلَيْكُمْ فَاقْتُلُوهُ بِالْمَاءِ وَيَزِيدُ بْنُ أَبِي زِيَادٍ ضَعِيفٌ لَا يُحْتَجُّ بِهِ لِسُوءِ حِفْظِهِ وَقَدْ رَوَى خَالِدٌ الْحَذَّاءُ عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ قِصَّةَ طَوَافِ النَّبِيِّ ﷺ وَشُرْبِهِ لَمْ يَذْكُرْ فِيهَا مَا ذَكَرَ يَزِيدُ بْنُ أَبِي زِيَادٍ وَإِنَّمَا تُعْرَفُ هَذِهِ الزِّيَادَةُ مِنْ رِوَايَةِ الْكَلْبِيِّ كَمَا مَضَى وَزَادَ يَزِيدُ شَرِبَهُ مِنْهُ قَبْلَ خَلْطِهِ بِالْمَاءِ وَهُوَ بِخِلَافِ سَائِرِ الرِّوَايَاتِ وَكَيْفَ يُظَنُّ بِالنَّبِيِّ ﷺ أَنْ يَشْرَبَ الْمُسْكِرَ إِنْ كَانَ مُسْكِرًا عَلَى زَعْمِهِمْ قَبْلَ أَنْ يَخْلِطَهُ بِالْمَاءِ؟ فَدَلَّ عَلَى أَنَّهُ لَا أَصْلَ لَهُ وَاللهُ أَعْلَمُ
[Machine] About wine, he said: The Messenger of Allah, ﷺ , said: Every intoxicant is forbidden. So I said, O Ibn Abi Rabah, these people are serving us wine in the mosque. He said: By Allah, I have certainly witnessed that. Indeed, a person would drink it and his lips would stick together because of its sweetness, but freedom has vanished and slavery has taken its place, so they take it lightly.
عَنِ النَّبِيذِ فَقَالَ قَالَ رَسُولُ اللهِ ﷺ كُلُّ مُسْكِرٍ حَرَامٌ فَقُلْتُ يَا ابْنَ أَبِي رَبَاحٍ إِنَّ هَؤُلَاءِ يَسْقُونَنَا فِي الْمَسْجِدِ فَقَالَ أَمَا وَاللهِ لَقَدْ أَدْرَكْتُهَا وَإِنَّ الرَّجُلَ لِيَشْرَبُ مِنْهَا فَتَلْتَزِقُ شَفَتَاهُ مِنْ حَلَاوَتِهَا وَلَكِنَّ الْحُرِّيَّةَ ذَهَبَتْ وَوَلِيَهَا الْعَبِيدُ فَتَهَاوَنُوا بِهَا
[Machine] The Messenger of Allah ﷺ found a man smelling of wine and said, "What is this smell?"
وَجَدَ رَسُولُ اللهِ ﷺ مِنْ رَجُلٍ رِيحَ نَبِيذٍ فَقَالَ مَا هَذِهِ الرِّيحُ؟
[Machine] A man came to the Prophet ﷺ and found a smell from him. He said, "What is this smell?" He replied, "It is wine." He said, "Send me some of it." So he sent it to him, and he found it strong. He called for water and poured it on it, then drank it. He said, "When it becomes sour, break it with water and drink it." Isma'il bin Abi Khalid narrated it from Qurrah al-Ajali from 'Abdul-Malik, and he said, "Cut its ropes with water."
جَاءَ رَجُلٌ إِلَى النَّبِيِّ ﷺ فَوَجَدَ مِنْهُ رِيحًا فَقَالَ مَا هَذِهِ الرِّيحُ؟ فَقَالَ نَبِيذٌ قَالَ فَأَرْسِلْ إِلِيَّ مِنْهُ فَأَرْسَلَ إِلَيْهِ فَوَجَدَهُ شَدِيدًا فَدَعَا بِمَاءٍ فَصَبَّهُ عَلَيْهِ ثُمَّ شَرِبَ ثُمَّ قَالَ إِذَا اغْتَلَمَتْ أَشْرِبَتُكُمْ فَاكْسِرُوهَا بِالْمَاءِ وَرَوَاهُ أَيْضًا إِسْمَاعِيلُ بْنُ أَبِي خَالِدٍ عَنْ قُرَّةَ الْعِجْلِيِّ عَنْ عَبْدِ الْمَلِكِ وَقَالَ فَاقْطَعُوا مُتُونَهَا بِالْمَاءِ
[Machine] We were with the Prophet ﷺ when mention was made of a drink, so a cup of it was brought to him. When it was brought near to him, he disliked it and returned it. Some of the people said, "Is it forbidden, O Messenger of Allah?" He said, "Return it." Then he took some of it, called for water, poured it on it, and said, "Look at this cup. If it becomes turbid, then cut its ropes with water." This is a Hadith narrated by 'Abdul Malik bin Nafe' who is an unknown person. There is disagreement regarding his name and the name of his father. It is said that it is like this and it is said that it is 'Abdul Malik bin Al Qa'qa' and it is said that it is the son of Abu Al Qa'qa' and it is said that it is Malik bin Al Qa'qa'. 17447 Abu Sa'ad Al Malini informed us, Abu Ahmad bin Adi Al Hafiz narrated to us, 'Ali bin Ahmad bin Suleiman narrated to us, Ibn Abi Maryam said, "I asked Yahya bin Ma'een, 'What do you think about the Hadith of 'Abdul Malik bin Nafe' that Ismail bin Abi Khalid narrates about the wine?' He said, 'They weaken it.' He said, 'And Abu Ahmad narrated that he heard Ibn Hammad saying, 'Al Bukhari said, "Abdul Malik bin Nafe' is the son of my brother Al Qa'qa' bin Shawr, from Ibn 'Umar regarding the wine. It is not continuously narrated on him." And Abu Abdur Rahman An Nasa'i said, "Abdul Malik bin Nafe' is not well-known and his Hadith is not relied upon. The well-known thing is the difference in narrating it from Ibn 'Umar."
كُنَّا مَعَ النَّبِيِّ ﷺ فَذُكِرَ لَهُ شَرَابٌ فَأُتِيَ بِقَدَحٍ مِنْهُ فَلَمَّا قَرَّبَهُ إِلَى فِيهِ كَرِهَهُ فَرَدَّهُ فَقَالَ بَعْضُ الْقَوْمِ أَحَرَامٌ هُوَ يَا رَسُولَ اللهِ؟ فَقَالَ رُدُّوهُ فَأَخَذَ مِنْهُ ثُمَّ دَعَا بِمَاءٍ فَصَبَّهُ عَلَيْهِ ثُمَّ قَالَ انْظُرُوا هَذِهِ الْأَسْقِيَةَ إِذَا اغْتَلَمَتْ فَاقْطَعُوا مُتُونَهَا بِالْمَاءِ حَدِيثٌ يُعْرَفُ بِعَبْدِ الْمَلِكِ بْنِ نَافِعٍ هَذَا وَهُوَ رَجُلٌ مَجْهُولٌ اخْتَلَفُوا فِي اسْمِهِ وَاسْمِ أَبِيهِ فَقِيلَ هَكَذَا وَقِيلَ عَبْدُ الْمَلِكِ بْنُ الْقَعْقَاعِ وَقِيلَ ابْنُ أَبِي الْقَعْقَاعِ وَقِيلَ مَالِكُ بْنُ الْقَعْقَاعِ 17447 أَخْبَرَنَا أَبُو سَعْدٍ الْمَالِينِيُّ أَنْبَأَ أَبُو أَحْمَدَ بْنُ عَدِيٍّ الْحَافِظُ ثنا عَلِيُّ بْنُ أَحْمَدَ بْنِ سُلَيْمَانَ ثنا ابْنُ أَبِي مَرْيَمَ قَالَ قُلْتُ لِيَحْيَى بْنِ مَعِينٍ أَرَأَيْتَ حَدِيثَ عَبْدِ الْمَلِكِ بْنِ نَافِعٍ الَّذِي يَرْوِيهِ إِسْمَاعِيلُ بْنُ أَبِي خَالِدٍ فِي النَّبِيذِ؟ قَالَ هُمْ يُضَعِّفُونَهُ قَالَ وَأَنْبَأَ أَبُو أَحْمَدَ قَالَ سَمِعْتُ ابْنَ حَمَّادٍ يَقُولُ قَالَ الْبُخَارِيُّ عَبْدُ الْمَلِكِ بْنُ نَافِعٍ ابْنُ أَخِي الْقَعْقَاعِ بْنِ شَوْرٍ عَنِ ابْنِ عُمَرَ فِي النَّبِيذِ لَمْ يُتَابَعْ عَلَيْهِ وَقَالَ أَبُو عَبْدِ الرَّحْمَنِ النَّسَائِيُّ عَبْدُ الْمَلِكِ بْنُ نَافِعٍ لَيْسَ بِمَشْهُورٍ وَلَا يُحْتَجُّ بِحَدِيثِهِ وَالْمَشْهُورُ عَنِ ابْنِ عُمَرَ خِلَافُ حِكَايَتِهِ
[Machine] Thaqif received Umar bin Nabi and found him severely ill, so he called for water and poured it on him two or three times.
تَلَقَّتْ ثَقِيفٌ عُمَرَ ؓ بِنَبِيذٍ فَوَجَدَهُ شَدِيدًا فَدَعَا بِمَاءٍ فَصَبَّ عَلَيْهِ مَرَّتَيْنِ أَوْ ثَلَاثًا
[Machine] Break it with water, as its intensity and Allah knows best whether it is acidity or sweetness. It has been narrated from Naafi', the freed slave of Ibn 'Umar, that 'Umar ibn al-Khattaab asked him to go to our brothers and seek a drink from them. So he went to them and they said, "We only have this iidaawah and it has changed." So 'Umar called for it and tasted it, and his face contracted, then he called for water and poured it on it, then he drank it. Naafi' said, "By Allah, his face did not contract except that it became mild."
اكْسِرُوهُ بِالْمَاءِ فَإِنَّمَا كَانَ اشْتِدَادُهُ وَاللهُ أَعْلَمُ بِالْحُمُوضَةِ أَوْ بِالْحَلَاوَةِ فَقَدْ رُوِيَ عَنْ نَافِعٍ مَوْلَى ابْنِ عُمَرَ أَنَّ عُمَرَ بْنَ الْخَطَّابِ ؓ قَالَ لِيَرْفَأَ اذْهَبْ إِلَى إِخْوَانِنَا فَالْتَمِسْ لَنَا عِنْدَهُمْ شَرَابًا فَأَتَاهُمْ فَقَالُوا مَا عِنْدَنَا إِلَّا هَذِهِ الْإِدَاوَةَ وَقَدْ تَغَيَّرَتْ فَدَعَا بِهَا عُمَرُ ؓ فَذَاقَهَا فَقَبَضَ وَجْهَهُ ثُمَّ دَعَا بِمَاءٍ فَصَبَّ عَلَيْهِ ثُمَّ شَرِبَ قَالَ نَافِعٌ وَاللهِ مَا قَبَضَ وَجْهَهُ إِلَّا أَنَّهَا تَخَلَّلَتْ
[Machine] Narrated by Nafi' from Qais bin Abi Hazim from 'Uthbah bin Farqad, who said, "The wine that 'Umar drank had been mixed with water." And it is mentioned from Zaid bin Aslam that when wine became sour for the companions of the Messenger of Allah, they would break it with water.
عَنْ عُمَرَ ؓ بِنَحْوٍ مِنْ رِوَايَةِ نَافِعٍ وَيُذْكَرُ عَنْ قَيْسِ بْنِ أَبِي حَازِمٍ عَنْ عُتْبَةَ بْنِ فَرْقَدٍ قَالَ كَانَ النَّبِيذُ الَّذِي شَرِبَهُ عُمَرُ ؓ قَدْ تَخَلَّلَ وَيُذْكَرُ عَنْ زَيْدِ بْنِ أَسْلَمَ أَنَّ أَصْحَابَ رَسُولِ اللهِ ﷺ كَانُوا إِذَا حَمُضَ عَلَيْهِمُ النَّبِيذُ كَسَرُوهُ بِالْمَاءِ
[Machine] Indeed, 'Umar broke the wine due to its intense sweetness.
إِنَّمَا كَسَرَ عُمَرُ النَّبِيذَ مِنْ شِدَّةِ حَلَاوَتِهِ
[Machine] "Ubaidullah bin Umar said to Abu Hanifa regarding the wine, and Abu Hanifa said, 'We take it from your father.' He said, 'And who is my father?' He said, 'If it becomes vinegar, then break it with water.' Ubaidullah Al-Umari said, 'When you are certain about it and you are not able to ascertain how to deal with it?' Abu Hanifa remained silent."
عُبَيْدُ اللهِ بْنُ عُمَرَ لِأَبِي حَنِيفَةَ فِي النَّبِيذِ فَقَالَ أَبُو حَنِيفَةَ أَخَذْنَاهُ مِنْ قِبَلِ أَبِيكَ قَالَ وَأَبِي مَنْ هُوَ قَالَ إِذَا رَابَكُمْ فَاكْسِرُوهُ بِالْمَاءِ قَالَ عُبَيْدُ اللهِ الْعُمَرِيُّ إِذَا تَيَقَّنْتَ بِهِ وَلَمْ تَرْتَبْ كَيْفَ تَصْنَعُ؟ قَالَ فَسَكَتَ أَبُو حَنِيفَةَ
[Machine] I heard Sulaiman Al-Taymi saying that a man does not risk his religion for a sip of wine.
سَمِعْتُ سُلَيْمَانَ التَّيْمِيَّ يَقُولُ مَا فِي شَرْبَةٍ مِنْ نَبِيذٍ مَا يُخَاطِرُ رَجُلٌ بِدِينِهِ
[Machine] I heard Abdullah bin Idris al-Kufi saying, "I said to the people of Kufa, 'O people of Kufa, your talk about leniency in regards to wine with the blind, the crippled, and the senile, where are you in relation to the sons of the Muhajireen and the Ansar?' Muhammad bin Amr bin Alqamah bin Waqqas Al-Laythi narrated to me from Abu Salama bin Abdur Rahman bin Auf, who narrated from Abdullah bin Umar bin Khattab, who said, 'I heard the Messenger of Allah ﷺ saying, 'Every intoxicant is wine, and every intoxicant is forbidden.'"
سَمِعْتُ عَبْدَ اللهِ بْنَ إِدْرِيسَ الْكُوفِيَّ يَقُولُ قُلْتُ لِأَهْلِ الْكُوفَةِ يَا أَهْلَ الْكُوفَةِ إِنَّمَا حَدِيثُكُمُ الَّذِي تُحَدِّثُونَهُ فِي الرُّخْصَةِ فِي النَّبِيذِ عَنِ الْعِمْيَانِ وَالْعُورَانِ وَالْعِمْشَانِ أَيْنَ أَنْتُمْ عَنْ أَبْنَاءِ الْمُهَاجِرِينَ وَالْأَنْصَارِ؟ حَدَّثَنِي مُحَمَّدُ بْنُ عَمْرِو بْنِ عَلْقَمَةَ بْنِ وَقَّاصٍ اللَّيْثِيُّ عَنْ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ عَنْ عَبْدِ اللهِ بْنِ عُمَرَ بْنِ الْخَطَّابِ ؓ قَالَ سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ كُلُّ مُسْكِرٍ خَمْرٌ وَكُلُّ مُسْكِرٍ حَرَامٌ
57.10 [Machine] The two mixtures
٥٧۔١٠ بَابُ الْخَلِيطَيْنِ
[Machine] On the authority of the Messenger of Allah ﷺ , he prohibited discarding raisins and dates altogether, and he prohibited discarding olives and fresh dates altogether.
عَنْ رَسُولِ اللهِ ﷺ أَنَّهُ نَهَى أَنْ يُنْتَبَذَ الزَّبِيبُ وَالتَّمْرُ جَمِيعًا وَنَهَى أَنْ يُنْتَبَذَ الْبُسْرُ وَالرُّطَبُ جَمِيعًا
[Machine] The Prophet ﷺ forbade combining dates and grapes in the same dish, and also combining dates and raisins, and he ordered that each one of them should be eaten separately.
أَنَّ النَّبِيَّ ﷺ نَهَى أَنْ يُجْمَعَ بَيْنَ التَّمْرِ وَالزَّهْوِ وَبَيْنَ التَّمْرِ وَالزَّبِيبِ وَأَمَرَ أَنْ يُنْبَذَ كُلُّ وَاحِدٍ مِنْهَما عَلَى حِدَةٍ
[Machine] The Messenger of Allah ﷺ said, "Do not mix together dates and raisins, but rather eat each of them separately." Yahya asked Abdullah ibn Abi Qatadah about this, and he informed him of it from his father.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا تَنْتَبِذُوا الرُّطَبَ وَالزَّهْوَ جَمِيعًا وَالتَّمْرَ وَالزَّبِيبَ جَمِيعًا وَانْبِذُوا كُلَّ وَاحِدَةٍ مِنْهُمَا عَلَى حِدَتِهِ قَالَ يَحْيَى فَسَأَلْتُ عَنْ ذَلِكَ عَبْدَ اللهِ بْنَ أَبِي قَتَادَةَ فَأَخْبَرَنِي بِذَلِكَ عَنْ أَبِيهِ
[Machine] It was narrated that the Prophet ﷺ prohibited the mixture of butter and dates, as well as the mixture of raisins and dates, and the mixture of cucumber and dates. He said, "Eat each one separately." (Narrated by Ibn Abbas, reported by Abu Salama bin Abdul Rahman, reported by Abu Qatadah)
أَنَّ النَّبِيَّ ﷺ نَهَى عَنْ خَلِيطِ الْبُسْرِ وَالتَّمْرِ وَعَنْ خَلِيطِ الزَّبِيبِ وَالتَّمْرِ وَعَنْ خَلِيطِ الزَّهْوِ وَالرُّطَبِ وَقَالَ انْتَبِذُوا كُلَّ وَاحِدٍ عَلَى حِدَتِهِ 17459 قَالَ وَحَدَّثَنِي أَبُو سَلَمَةَ بْنُ عَبْدِ الرَّحْمَنِ عَنْ أَبِي قَتَادَةَ عَنِ النَّبِيِّ ﷺ بِهَذَا
[Machine] The Messenger of Allah ﷺ said, "Indeed, mixing the juice of grapes with dates, dates with raisins is forbidden, is forbidden."
قَالَ رَسُولُ اللهِ ﷺ أَلَا إِنَّ الْمَزَاةَ حَرَامٌ أَلَا إِنَّ الْمَزَاةَ حَرَامٌ خَلْطُ الْبُسْرِ وَالتَّمْرِ وَالتَّمْرِ وَالزَّبِيبِ
[Machine] I asked Umm Salamah what the Prophet ﷺ used to forbid us from doing. She said, he used to forbid us from cooking the nawa and mixing raisins and dates together. The Sheikh, may Allah have mercy on him, said it is similar to him only forbidding excessive ripening of the nawa because it ruins the taste of the dates, or because it is chicken feed and its nutrients are lost when it ripens. Abu Sulaiman Al-Khattabi, may Allah have mercy on him, said this.
سَأَلْتُ أُمَّ سَلَمَةَ مَا كَانَ النَّبِيُّ ﷺ يَنْهَى عَنْهُ؟ قَالَتْ كَانَ يَنْهَانَا أَنْ نَعْجُمَ النَّوَى طَبْخًا وَنَخْلِطَ الزَّبِيبَ وَالتَّمْرَ قَالَ الشَّيْخُ رَحِمَهُ اللهُ يُشْبِهُ أَنَّهُ إِنَّمَا نَهَى عَنِ الْمُبَالَغَةِ فِي نَضْجِ النَّوَى مِنْ أَجْلِ أَنَّهُ يُفْسِدُ طَعْمَ التَّمْرِ أَوْ لِأَنَّهُ عَلَفُ الدَّوَاجِنِ فَتَذْهَبُ قُوَّتُهُ إِذَا نَضَجَ قَالَهُ أَبُو سُلَيْمَانَ الْخَطَّابِيُّ رَحِمَهُ اللهُ
[Machine] She heard the Messenger of Allah ﷺ say, "Do not mix dates and raisins together, but mix each of them separately." The Shaykh (may Allah have mercy on him) said, "The prohibition of the Prophet ﷺ regarding these two mixtures implies two possibilities. One is that he forbade mixing them together, whether it reaches the degree of intoxication or not, but he allowed drinking them separately when they are mixed freshly. The second possibility is that he prohibited it because it is closer to intensification, but when mixed freshly, it is further away from intensification. As long as it does not reach the degree of intoxication in both cases, it is not forbidden. This second meaning is indicated by what..."
أَنَّهَا سَمِعَتْ رَسُولَ اللهِ ﷺ يَقُولُ لَا تَنْتَبِذُوا التَّمْرَ وَالزَّبِيبَ جَمِيعًا انْبِذُوا كُلَّ وَاحِدٍ مِنْهُمَا وَحْدَهُ قَالَ الشَّيْخُ رَحِمَهُ اللهُ نَهْيُ النَّبِيِّ ﷺ عَنِ الْخَلِيطَيْنِ يَحْتَمِلُ أَمْرَيْنِ أَحَدُهُمَا أَنْ يَكُونَ إِنَّمَا نَهَى عَنْهُ لِخَلْطِهِمَا سَوَاءً بَلَغَ حَدَّ الْإِسْكَارِ أَوْ لَمْ يَبْلُغْ وَأَبَاحَ شُرْبَهُ إِذَا نُبِذَ عَلَى حِدَتِهِ وَالْآخَرُ أَنْ يَكُونَ إِنَّمَا نَهَى عَنْهُ؛ لِأَنَّهُ أَقْرَبُ إِلَى الِاشْتِدَادِ وَإِذَا نُبِذَ عَلَى حِدَتِهِ كَانَ أَبْعَدَ عَنِ الِاشْتِدَادِ فَمَا لَمْ يَبْلُغْ حَالَةَ الِاشْتِدَادِ فِي الْمَوْضِعَيْنِ جَمِيعًا لَا يَحْرُمُ وَعَلَى هَذَا الْمَعْنَى الثَّانِي يَدُلُّ مَا
Raisins were steeped for the Messenger of Allah ﷺ and then dried dates were infused in them, or dried dates were steeped and then raisins were infused in them. (Using translation from Abū Dāʾūd 3707)
رَسُولَ اللهِ ﷺ كَانَ يُنْبَذُ لَهُ زَبِيبٌ فَيُلْقَى فِيهِ تَمْرٌ أَوْ تَمْرٌ فَيُلْقَى فِيهِ زَبِيبٌ
Safiyyah, daughter of Atiyyah, said: I entered upon Aisha with some women of AbdulQays, and asked her about mixing dried dates and raisins (for drink). She replied: I used to take a handful of dried dates and a handful or raisins and put them in a vessel, and then crush them (and soak in water). Then I would give it to the Prophet ﷺ to drink. مَعَ نِسْوَةٍ مِنْ عَبْدِ الْقَيْسِ عَلَى عَائِشَةَ ؓ فَسَأَلْنَاهَا عَنِ التَّمْرِ وَالزَّبِيبِ فَقَالَتْ كُنْتُ آخُذُ قَبْضَةً مِنْ تَمْرٍ وَقَبْضَةً مِنْ زَبِيبٍ فَأُلْقِيهِ فِي إِنَاءٍ فَأَمْرُسُهُ ثُمَّ أَسْقِيهِ النَّبِيَّ ﷺ
[Machine] He heard Anas ibn Malik saying that the Messenger of Allah ﷺ forbade mixing dates with apple juice, then drinking it. And that was in general the practice of their alcoholic beverages on the day when alcohol was prohibited. Al-Bukhari said: 'Amr ibn al-Harith mentioned it, and Muslim narrated it from Abu al-Tahir, from Ibn Wahb. In this narration, there is evidence that he forbade it because it is a form of alcohol. And alcohol is what befogs the mind. And also, it is recommended to avoid mixing the two even if it is not intoxicating, due to the affirmation of the prohibition in the report without any exceptions. And it is proven from what we reported on the permissibility. And with Allah is the Tawfiq.
أَنَّهُ سَمِعَ أَنَسَ بْنَ مَالِكٍ يَقُولُ إِنَّ رَسُولَ اللهِ ﷺ نَهَى أَنْ يُخْلَطَ التَّمْرُ وَالزَّهْوُ ثُمَّ يُشْرَبُ وَإِنَّ ذَلِكَ كَانَ عَامَّةَ خُمُورِهِمْ يَوْمَ حُرِّمَتِ الْخَمْرُ قَالَ الْبُخَارِيُّ وَقَالَ عَمْرُو بْنُ الْحَارِثِ فَذَكَرَهُ وَرَوَاهُ مُسْلِمٌ عَنْ أَبِي الطَّاهِرِ عَنِ ابْنِ وَهْبٍ وَفِي هَذَا الْحَدِيثِ مَا دَلَّ عَلَى أَنَّهُ إِنَّمَا نَهَى عَنْهُ لِكَوْنِهِ خَمْرًا وَالْخَمْرُ مَا خَامَرَ الْعَقْلَ وَعَلَى أَنَّهُ يُسْتَحَبُّ تَرْكُ الْخَلِيطَيْنِ وَإِنْ لَمْ يَكُنْ مُسْكِرًا لِثُبُوتِ الْإِخْبَارِ فِي النَّهْيِ عَنْهُ مُطْلَقًا وَإِنَّهَا أَثْبَتُ مِمَّا رُوِّينَا فِي الْإِبَاحَةِ وَبِاللهِ التَّوْفِيقُ
57.11 [Machine] The vessels
٥٧۔١١ بَابُ الْأَوْعِيَةِ
[Machine] The Messenger of Allah ﷺ prohibited the use of the whip and the slingshot.
نَهَى رَسُولُ اللهِ ﷺ عَنِ الدُّبَّاءِ وَالْمُزَفَّتِ
Messenger of Allah ﷺ addressed people in one of his expeditions. Ibn 'Umar said: I went forward to him but he went away before I reached him. I asked (the people present there): What did he say? They said that he (the Holy Prophet) had forbidden the preparation of Nabidh in gourd and varnished jar. (Using translation from Muslim 1997c)
أَنَّ رَسُولَ اللهِ ﷺ خَطَبَ النَّاسَ فِي بَعْضِ مَغَازِيهِ قَالَ ابْنُ عُمَرَ فَأَقْبَلْتُ نَحْوَهُ فَانْصَرَفَ قَبْلَ أَنْ أَبْلُغَهُ فَسَأَلْتُ مَاذَا قَالَ؟ قَالُوا نَهَى أَنْ يُنْبَذَ فِي الدُّبَّاءِ وَالْمُزَفَّتِ
[Machine] It is prohibited by the Messenger of Allah ﷺ to consume a type of meat called "dubbah", as well as a plant called "hantam", and two specific methods of slaughtering: "nadeer" and "muzaffat".
أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنِ الدُّبَّاءِ وَالْحَنْتَمِ وَالنَّقِيرِ وَالْمُزَفَّتِ
I asked Ibn 'Umar about (the preparation of) Nabidh in a green pitcher (besmeared with pitch), whereupon he said that Messenger of Allah ﷺ forbade the (preparation of) Nabidh in green pitcher (besmeared with pitch). I then came to Ibn Abbas and said: Do you hear what Ibn 'Umar has said? Thereupon he said: What does he say? I said: He stated that Messenger of Allah ﷺ has forbidden the (preparation of) Nabidh in a green pitcher (besmeared with pitch), whereupon he said: Ibn 'Umar has told the truth. Messenger of Allah ﷺ declared unlawful the preparation of Nabidh in a green pitcher (besmeared with pitch). I said: What is this thing, the Nabidh of a pitcher (Nabidh prepared in a pitcher)? Thereupon, he said: Everything that is prepared in earthen pitcher. (Using translation from Muslim 1997b)
حَرَّمَ رَسُولُ اللهِ ﷺ نَبِيذَ الْجَرِّ قَالَ فَأَتَيْتُ ابْنَ عَبَّاسٍ فَقُلْتُ أَلَا تَسْمَعُ مَا يَقُولُ ابْنُ عُمَرَ؟ قَالَ وَمَا يَقُولُ؟ قُلْتُ قَالَ حَرَّمَ رَسُولُ اللهِ ﷺ نَبِيذَ الْجَرِّ فَقَالَ صَدَقَ ابْنُ عُمَرَ حَرَّمَ رَسُولُ اللهِ ﷺ نَبِيذَ الْجَرِّ فَقُلْتُ وَأِيُّ شَيْءٍ نَبِيذُ الْجَرِّ؟ فَقَالَ كُلُّ شَيْءٍ يُصْنَعُ مِنَ الْمَدَرِ لَفْظُ حَدِيثِ شَيْبَانَ
Messenger of Allah ﷺ said, "Do not make drinks in Ad-Dubba' nor in Al-Muzaffat. Abu Huraira used to add to them Al-Hantam and An-Naqir. (Using translation from Bukhārī 5587)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا تَنْبِذُوا فِي الدُّبَّاءِ وَلَا الْمُزَفَّتِ وَكَانَ أَبُو هُرَيْرَةَ يُلْحِقُ مَعَهَا الْحَنْتَمَ وَالنَّقِيرَ
It was narrated from ʿAli ؓ that The Messenger of Allah ﷺ forbade gourds and varnished jars. (Using translation from Aḥmad 1180)
أَنَّ النَّبِيَّ ﷺ نَهَى عَنِ الدُّبَّاءِ وَالْمُزَفَّتِ أَنْ يُنْبَذَ فِيهِمَا
The above hadith is narrated through a different chain with slight variation in wording. (Using translation from Muslim 1992b)
سَمِعْتُ أَنَسًا يَقُولُ نَهَى رَسُولُ اللهِ ﷺ عَنِ الدُّبَّاءِ وَالْمُزَفَّتِ أَنْ يُنْتَبَذَ فِيهِ
[Machine] The Messenger of Allah ﷺ said, "Do not revile the Dhubba' and the Muzaffat." He then said, "And avoid the Hanatim and the Naqir."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا تَنْبِذُوا فِي الدُّبَّاءِ وَالْمُزَفَّتِ قَالَ ثُمَّ يَقُولُ أَبُو هُرَيْرَةَ وَاجْتَنِبُوا الْحَنَاتِمَ وَالنَّقِيرَ
[Machine] From the Prophet ﷺ , he said to the delegation of Abd Al-Qays: "I prohibit you from performing the nadeer, mukayyir, hantam, dubba, and the pre-arranged auction. However, you may drink from your water sources and give your animals water."
عَنِ النَّبِيِّ ﷺ أَنَّهُ قَالَ لِوَفْدِ عَبْدِ الْقَيْسِ أَنْهَاكُمْ عَنِ النَّقِيرِ وَالْمُقَيَّرِ وَالْحَنْتَمِ وَالدُّبَّاءِ وَالْمَزَادَةِ الْمَجْبُوبَةِ وَلَكِنِ اشْرَبْ فِي سِقَائِكَ وَأَوْكِهِ
[Machine] I heard Abdullah ibn Abi Awfa saying that the Messenger of Allah ﷺ prohibited the drinking of green barley wine. I asked, "Can I drink from a white pitcher?" He said, "No."
سَمِعْتُ عَبْدَ اللهِ بْنَ أَبِي أَوْفَى يَقُولُ نَهَى رَسُولُ اللهِ ﷺ عَنْ نَبِيذِ الْجَرِّ الْأَخْضَرِ قُلْتُ أَشْرَبُ فِي جِرَارِ الْبِيضِ؟ قَالَ لَا
[Machine] Abu al-Abbas al-Asamm narrated that al-Rabee' narrated that al-Shafi'i narrated that Sufyan narrated from Abu Ishaq who narrated from Ibn Abi Aufa who said: The Messenger of Allah ﷺ forbade drinking the green, white, and red wine.
ثنا أَبُو الْعَبَّاسِ الْأَصَمُّ أنبأ الرَّبِيعُ أنبأ الشَّافِعِيُّ أنبأ سُفْيَانُ عَنْ أَبِي إِسْحَاقَ عَنِ ابْنِ أَبِي أَوْفَى قَالَ نَهَى رَسُولُ اللهِ ﷺ عَنْ نَبِيذِ الْجَرِّ الْأَخْضَرِ وَالْأَبْيَضِ وَالْأَحْمَرِ
[Machine] The Messenger of Allah ﷺ prohibited natiqir, muzaffat, and dubba'. Jabir reported that people used to throw things at the Messenger of Allah ﷺ in a well, and if they couldn't find a well, they would throw stones at him. Some people said, "I heard Abu Zubair say this from Braham." He said, "From Braham."
أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنِ النَّقِيرِ وَالْمُزَفَّتِ وَالدُّبَّاءِ وَعَنْ جَابِرٍ قَالَ كَانَ يُنْبَذُ لِرَسُولِ اللهِ ﷺ فِي سِقَاءٍ فَإِذَا لَمْ يَجِدُوا لَهُ سِقَاءً يُنْبَذُ لَهُ فِي تَوْرٍ مِنْ حِجَارَةٍ فَقَالَ بَعْضُ الْقَوْمِ وَأَنَا أَسْمَعُ لِأَبِي الزُّبَيْرِ مِنْ بِرَامٍ؟ قَالَ مِنْ بِرَامٍ
[Machine] Tell us about what the Messenger of Allah, ﷺ , prohibited us from regarding vessels. Tell us in your language and explain it to us in our language. He prohibited the use of ḥantam, which is a jug, and he prohibited the use of muzaffat, which is a measure. He also prohibited the use of dubbaa, which is a round container, and he prohibited the use of naqeer, which is the top of a palm tree that is plucked and woven. He commanded that it be thrown into the water containers.
أَخْبِرْنَا بِمَا نَهَى عَنْهُ رَسُولُ اللهِ ﷺ مِنَ الْأَوْعِيَةِ أَخْبِرْنَا بِلُغَتِكُمْ وَفَسِّرْهُ لَنَا بِلُغَتِنَا قَالَ نَهَى عَنِ الْحَنْتَمِ وَهِيَ الْجَرَّةُ وَنَهَى عَنِ الْمُزَفَّتِ وَهِيَ الْمُقَيَّرُ وَنَهَى عَنِ الدُّبَّاءِ وَهُوَ الْقَرْعُ وَنَهَى عَنِ النَّقِيرِ وَهِيَ أَصْلُ النَّخْلَةِ تُنْقَرُ نَقْرًا وَتُنْسَجُ نَسْجًا وَأَمَرَ أَنْ يُنْتَبَذَ فِي الْأَسْقِيَةِ
[Machine] Abu Bakrah used to hide himself in a jar. Abu Barzah came from a long absence and stayed at Abu Bakrah's house before going to his own house. He mentioned the hadith, denying what had been hidden from him in the jar, and his words to his wife: "I wish you had put it in a container." And when Abu Bakrah came, he said, "We have known what we were forbidden from: we were forbidden from beer, distilled wine, Hantham, and muzaffat." As for the beer, we, the people of Ta'if, used to take beer, then we would press grapes into it, bury it, and leave it until it fermented and died. As for the distilled wine, the people of Yamamah used to tap the palm tree until its liquid dripped out, then they would leave it until it fermented and died. As for Hantham, it was a container in which we used to bring alcohol. As for muzaffat, it is these vessels that contain this tar." The Sheikh said: "This was narrated in this way from Abu Bakrah, and a group of scholars said: The meaning of being forbidden from hiding in these vessels is that the wine in them quickly spoils and becomes stronger, until it becomes intoxicating, whereas in containers it is further away from that. Then the permission was granted for all vessels if they are not used to drink intoxicants. And Allah knows best."
كَانَ أَبُو بَكْرَةَ يُنْتَبَذُ لَهُ فِي جَرَّةٍ فَقَدِمَ أَبُو بَرْزَةَ مِنْ غَيْبَةٍ كَانَ غَابَهَا فَنَزَلَ بِمَنْزِلِ أَبِي بَكْرَةَ قَبْلَ أَنْ يَأْتِيَ مَنْزِلَهُ فَذَكَرَ الْحَدِيثَ فِي إِنْكَارِ مَا نُبِذَ لَهُ فِي جَرَّةٍ وَقَوْلِهِ لِامْرَأَتِهِ وَدِدْتُ أَنَّكِ جَعَلْتِيهِ فِي سِقَاءٍ وَأَنَّ أَبَا بَكْرَةَ حِينَ جَاءَ قَالَ قَدْ عَرَفْنَا الَّذِي نُهِينَا عَنْهُ نُهِينَا عَنِ الدُّبَّاءِ وَالنَّقِيرِ وَالْحَنْتَمِ وَالْمُزَفَّتِ فَأَمَّا الدُّبَّاءُ فَإِنَّا مَعْشَرَ ثَقِيفٍ بِالطَّائِفِ كُنَّا نَأْخُذُ الدُّبَّاءَ فَنَخْرِطُ فِيهَا عَنَاقِيدَ الْعِنَبِ ثُمَّ نَدْفِنُهَا ثُمَّ نَتْرُكُهَا حَتَّى تَهْدُرَ ثُمَّ تَمُوتُ وَأَمَّا النَّقِيرُ فَإِنَّ أَهْلَ الْيَمَامَةِ كَانُوا يَنْقِرُونَ أَصْلَ النَّخْلَةِ فَيَشْدَخُونَ فِيهِ الرُّطَبَ وَالْبُسْرَ ثُمَّ يَدَعُونَهُ حَتَّى يَهْدُرَ ثُمَّ يَمُوتُ وَأَمَّا الْحَنْتَمُ فَجِرَارٌ كَانَ يُحْمَلُ إِلَيْنَا فِيهَا الْخَمْرُ وَأَمَّا الْمُزَفَّتُ فَهِيَ هَذِهِ الْأَوْعِيَةُ الَّتِي فِيهَا هَذَا الزِّفْتُ قَالَ الشَّيْخُ كَذَا رُوِيَ عَنْ أَبِي بَكْرَةَ وَقَدْ قَالَ جَمَاعَةٌ مِنْ أَهْلِ الْعِلْمِ إِنَّ الْمَعْنَى فِي النَّهْيِ عَنِ الِانْتِبَاذِ فِي هَذِهِ الْأَوْعِيَةِ أَنَّ النَّبِيذَ فِيهَا يَكُونُ أَسْرَعَ إِلَى الْفَسَادِ وَالِاشْتِدَادِ حَتَّى يَصِيرَ مُسْكِرًا وَهُوَ فِي الْأَسْقِيَةِ أَبْعَدُ مِنْهُ ثُمَّ وَرَدَتِ الرُّخْصَةُ فِي الْأَوْعِيَةِ كُلِّهَا إِذَا لَمْ يَشْرَبُوا مُسْكِرًا وَاللهُ أَعْلَمُ
57.12 [Machine] The License in Containers after the Prohibition
٥٧۔١٢ بَابُ الرُّخْصَةِ فِي الْأَوْعِيَةِ بَعْدَ النَّهْيِ
[Machine] When the Prophet ﷺ prohibited the use of certain utensils, they said, "Not everyone can afford to have a pitcher, so let us use a jar other than the earthenware one." This narration is from Ahmad, and in another narration from Shafi'i, he allowed them to use a jar other than the earthenware one. There is a missing link in the chain of this narration, Abu 'Iyad, and he is criticized for it.
لَمَّا نَهَى النَّبِيُّ ﷺ عَنِ الْأَوْعِيَةِ قَالُوا لَيْسَ كُلُّ النَّاسِ يَجِدُ سِقَاءً فَأَرْخَصَ فِي الْجَرِّ غَيْرِ الْمُزَفَّتِ لَفْظُ حَدِيثِ أَحْمَدَ وَفِي رِوَايَةِ الشَّافِعِيِّ فَأَذِنَ لَهُمْ فِي الْجَرِّ غَيْرِ الْمُزَفَّتِ وَسَقَطَ مِنْ إِسْنَادِ حَدِيثِهِ أَبُو عِيَاضٍ وَهُوَ فِيهِ
The Prophet ﷺ mentioned the vessels: pumpkins, green jarrs, vessels smeared with pitch and hollow stumps. A desert Arab said: We have no vessels(except these). He said: Drink(from them) what is lawful. (Using translation from Abū Dāʾūd 3700)
ذَكَرَ النَّبِيُّ ﷺ الْأَوْعِيَةَ الدُّبَّاءَ وَالْحَنْتَمَ وَالْمُزَفَّتَ وَالنَّقِيرَ فَقَالَ أَعْرَابِيٌّ إِنَّهُ لَا ظُرُوفَ قَالَ اشْرَبُوا مَا حَلَّ
Avoid that which produces intoxication. (Using translation from Abū Dāʾūd 3701)
اجْتَنِبُوا مَا أَسْكَرَ
[Machine] The Messenger of Allah ﷺ forbade the use of containers, then the Ansar (helpers) said: "But it is necessary for us." He replied: "In that case, no."
نَهَى رَسُولُ اللهِ ﷺ عَنِ الظُّرُوفِ فَقَالَتِ الْأَنْصَارُ إِنَّهُ لَا بَدَلَ لَنَا مِنْهَا قَالَ فَلَا إِذًا
[Machine] "That the Messenger of Allah ﷺ said: I had forbidden you from seeking omens by means of shooting stars, divining arrows, and the like. Therefore, abstain from it, and it is not permissible to drink intoxicants."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ إِنِّي كُنْتُ نَهَيْتُكُمْ أَنْ تَنْتَبِذُوا فِي الدُّبَّاءِ وَالْحَنْتَمِ وَالْمُزَفَّتِ فَانْبِذُوا وَلَا أُحِلُّ مُسْكِرًا
I had forbidden you from the drinking (and preparation of) Nabidh in the vessels made out of leather, but (now) you may drink in all vessels, but you do not drink an intoxicant. (Using translation from Muslim 977g)
قَالَ رَسُولُ اللهِ ﷺ كُنْتُ نَهَيْتُكُمْ عَنِ الْأَشْرِبَةِ فِي ظُرُوفِ الْأَدَمِ فَاشْرَبُوا فِي كُلِّ وِعَاءً غَيْرَ أَنْ لَا تَشْرَبُوا مُسْكِرًا
[Machine] The Messenger of Allah ﷺ said, "I used to forbid you from visiting graves, but now permission has been granted for me to visit the grave of my mother, so visit it, as it reminds you of the Hereafter. I used to forbid you from consuming meat from sacrificial animals that are three years old or older, in order to accommodate those who are unable to afford such animals. So eat whatever appears to you and feed others, and store some for later. And I used to forbid you from selling fruits on trees until they are ripe, although there is no prohibition on this. And every intoxicant is forbidden." This is the wording of the hadith of Abu Asim.
قَالَ رَسُولُ اللهِ ﷺ كُنْتُ نَهَيْتُكُمْ عَنْ زِيَارَةِ الْقُبُورِ فَقَدْ أُذِنَ لِمُحَمَّدٍ فِي زِيَارَةِ قَبْرِ أُمِّهِ فَزُورُوهَا فَإِنَّهَا تُذَّكِرُ الْآخِرَةَ وَكُنْتُ نَهَيْتُكُمْ عَنْ لُحُومِ الْأَضَاحِيِّ فَوْقَ ثَلَاثٍ؛ لِيَتَّسِعَ ذُو الطَّوْلِ عَلَى مَنْ لَا طَوْلَ لَهُ فَكُلُوا مَا بَدَا لَكُمْ وَأَطْعِمُوا وَادَّخِرُوا وَنَهَيْتُكُمْ عَنِ الظُّرُوفِ وَإِنَّ الظُّرُوفَ لَا تُحَرِّمُ شَيْئًا وَلَا تُحَلِّلُهُ وَكُلُّ مُسْكِرٍ حَرَامٌ لَفْظُ حَدِيثِ أَبِي عَاصِمٍ
[Machine] The Messenger of Allah ﷺ said, "I have forbidden you from drinking wine, so stay away from it and do not consume any intoxicants."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ نَهَيْتُكُمْ عَنِ النَّبِيذِ أَلَا فَانْتَبِذُوا وَلَا أُحِلُّ مُسْكِرًا
“I used to forbid you from making Nabidh in certain vessels, but a vessel does not make something unlawful. All intoxicants are unlawful.” (Using translation from Ibn Mājah 3406)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ إِنِّي كُنْتُ نَهَيْتُكُمْ عَنْ نَبِيذِ الْأَوْعِيَةِ أَلَا إِنَّ وِعَاءً لَا يُحَرِّمُ شَيْئًا وَكُلُّ مُسْكِرٍ حَرَامٌ
