٥٧۔ كِتَابُ الْأَشْرِبَةِ وَالْحَدُّ فِيهَا ص ٢
[Machine] The permissible and wholesome drink is not the forbidden and filthy one.
الشَّرَابُ الْحَلَالُ الطَّيِّبُ لَا الْحَرَامُ الْخَبِيثُ
[Machine] The Messenger of Allah ﷺ reached the Baathiq and anything that can intoxicate is haram. I said, "Inform me, may Allah have mercy on you, about the Baathiq, as we drink it." He said, "Muhammad ﷺ reached the Baathiq and anything that can intoxicate is haram." A man from the people said, "We ferment grapes and then cook it until it becomes halal and good." He ﷺ said, "Glory be to Allah, glory be to Allah. Drink what is halal and good, for there is nothing after what is halal and good except what is haram and wicked."
سَبَقَ رَسُولُ اللهِ ﷺ إِلَى الْبَاذَقِ مَا أَسْكَرَ فَهُوَ حَرَامٌ قَالَ قُلْتُ أَفْتِنِي رَحِمَكَ اللهُ فِي الْبَاذَقِ وَإِنَّا نَشْرَبُهُ قَالَ سَبَقَ مُحَمَّدٌ ﷺ إِلَى الْبَاذَقِ وَمَا أَسْكَرَ فَهُوَ حَرَامٌ قَالَ رَجُلٌ مِنَ الْقَوْمِ إِنَّا نَعْمِدُ إِلَى الْعِنَبِ فَنَعْصِرُهُ ثُمَّ نَطْبُخُهُ حَتَّى يَكُونَ حَلَالًا طَيِّبًا قَالَ سُبْحَانَ اللهِ سُبْحَانَ اللهِ اشْرَبِ الْحَلَالَ الطَّيِّبَ فَإِنَّهُ لَيْسَ بَعْدَ الْحَلَالِ الطَّيِّبِ إِلَّا الْحَرَامُ الْخَبِيثُ
[Machine] For it is not permissible to sell it, buy it, or trade in it for a Muslim. The example of anyone amongst you who does that is like that of the people of Israel when they were forbidden to eat fat, so they sold it and ate its price. Then they asked about the paint, and Ibn 'Abbas said: "What is your paint?" When you ask me, explain to me what you are asking me about. They said: "It is grapes that are squeezed and cooked, then put in a wine-skin." He said: "What is the wine-skin?" They said: "A container made of animal skin." He said: "Is it smeared? They said: "Yes." He said: "Does it intoxicate?" They said: "When a lot of it is consumed, it does intoxicate." He said: "Then every intoxicant is forbidden."
فَإِنَّهُ لَا يَصْلُحُ بَيْعُهُ وَلَا شِرَاؤُهُ وَلَا التِّجَارَةُ فِيهِ لِمُسْلِمٍ إِنَّمَا مَثَلُ مَنْ فَعَلَ ذَلِكَ مِنْكُمْ مَثَلُ بَنِي إِسْرَائِيلَ حُرِّمَتْ عَلَيْهِمُ الشُّحُومُ فَلَمْ يَأْكُلُوهَا فَبَاعُوهَا وَأَكَلُوا أَثْمَانَهَا ثُمَّ سَأَلُوا عَنِ الطِّلَاءِ فَقَالَ ابْنُ عَبَّاسٍ وَمَا طِلَاؤُكُمْ هَذَا؟ إِذَا سَأَلْتُمُونِي فَبَيِّنُوا لِيَ الَّذِي تَسْأَلُونِي عَنْهُ قَالُوا هُوَ الْعِنَبُ يُعْصَرُ ثُمَّ يُطْبَخُ ثُمَّ يُجْعَلُ فِي الدِّنَانِ قَالَ وَمَا الدِّنَانُ؟ قَالُوا دِنَانٌ مُقَيَّرَةٌ قَالَ مُزَفَّتَةٌ؟ فَقَالُوا نَعَمْ قَالَ أَيُسْكِرُ؟ قَالُوا إِذَا أُكْثِرَ مِنْهُ أَسْكَرَ قَالَ فَكُلُّ مُسْكِرٍ حَرَامٌ
[Machine] Indeed, the fire does not make anything permissible or forbidden.
إِنَّ النَّارَ لَا تُحِلُّ شَيْئًا وَلَا تُحَرِّمُهُ
[Machine] That Abu Muslim Al-Khawlanee performed Hajj and went to visit Aisha, the wife of the Prophet Muhammad ﷺ . She asked him about Sham (Syria) and its cold weather, and he informed her about it. She then asked him, "How do you bear its cold?" He replied, "O Mother of the Believers, they drink a drink called tilla', and she said, "Allah spoke the truth, and convey my love. I heard my beloved, the Messenger of Allah ﷺ , saying that some people from my nation will drink alcohol but call it by other names."
أَنَّ أَبَا مُسْلِمٍ الْخَوْلَانِيَّ حَجَّ فَدَخَلَ عَلَى عَائِشَةَ زَوْجِ النَّبِيِّ ﷺ فَجَعَلَتْ تَسْأَلُهُ عَنِ الشَّامِ وَعَنْ بَرْدِهَا فَجَعَلَ يُخْبِرُهَا فَقَالَتْ كَيْفَ تَصْبِرُونَ عَلَى بَرْدِهَا؟ فَقَالَ يَا أُمَّ الْمُؤْمِنِينَ إِنَّهُمْ يَشْرَبُونَ شَرَابًا لَهُمْ يُقَالُ لَهُ الطِّلَاءُ فَقَالَتْ صَدَقَ اللهُ وَبَلَّغَ حِبِّي سَمِعْتُ حِبِّي رَسُولَ اللهِ ﷺ يَقُولُ إِنَّ أُنَاسًا مِنْ أُمَّتِي يَشْرَبُونَ الْخَمْرَ يُسَمُّونَهَا بِغَيْرِ اسْمِهَا
“People among my nation will drink wine, calling it by another name, and musical instruments will be played for them and singing girls (will sing for them). Allah will cause the earth to swallow them up, and will turn them into monkeys and pigs.” (Using translation from Ibn Mājah 4020)
عَنْ رَسُولِ اللهِ ﷺ أَنَّهُ قَالَ لَيَشْرَبَنَّ أُنَاسٌ مِنْ أُمَّتِي الْخَمْرَ يُسَمُّونَهَا بِغَيْرِ اسْمِهَا وَتُضْرَبُ عَلَى رُءُوسِهِمُ الْمَعَازِفُ يَخْسِفُ اللهُ بِهُمُ الْأَرْضَ وَيَجْعَلُ مِنْهُمْ قِرَدَةً وَخَنَازِيرَ
[Machine] He drank the paint and I am asking about what he drank, if it caused him to get intoxicated, his punishment should be severe.
أَنَّهُ شَرِبَ الطِّلَاءَ وَأَنَا سَائِلٌ عَمَّا شَرِبَ فَإِنْ كَانَ يُسْكِرُ جَلَدْتُهُ فَجَلَدَهُ عُمَرُ ؓ الْحَدَّ تَامًّا
[Machine] Abu Ubayd said: Many different types of drinks have been mentioned in relation to the Prophet ﷺ and his companions, and each of them has an explanation. The first is alcohol, which is what is boiled from grape juice. There is no dispute among Muslims about its prohibition; the dispute is about other drinks. One of them is "sukkar" which is the juice of uncooked dates that has not been touched by fire. It has been narrated that Abdullah ibn Mas'ud said, "Sukkar is wine." Another is "bit'u" which is honey wine. Another is "ji'a" which is barley wine. Another is "mizr" which is made from corn.
قَالَ أَبُو عُبَيْدٍ قَدْ جَاءَتْ فِي الْأَشْرِبَةِ آثَارٌ كَثِيرَةٌ بِأَسْمَاءَ مُخْتَلِفَةٍ عَنِ النَّبِيِّ ﷺ وَأَصْحَابِهِ وَكُلٌّ لَهُ تَفْسِيرٌ فَأَوَّلُهَا الْخَمْرُ وَهِيَ مَا غَلَى مِنْ عَصِيرِ الْعِنَبِ فَهَذَا مَا لَا اخْتِلَافَ فِي تَحْرِيمِهِ بَيْنَ الْمُسْلِمِينَ إِنَّمَا الِاخْتِلَافُ فِي غَيْرِهِ وَمِنْهَا السَّكَرُ وَهُوَ نَقِيعُ التَّمْرِ الَّذِي لَمْ تَمَسَّهُ النَّارُ وَفِيهِ يُرْوَى عَنْ عَبْدِ اللهِ بْنِ مَسْعُودٍ ؓ أَنَّهُ قَالَ السَّكَرُ خَمْرٌ وَمِنْهَا الْبِتْعُ وَهُوَ نَبِيذُ الْعَسَلِ وَمِنْهَا الْجِعَةُ وَهُوَ نَبِيذُ الشَّعِيرِ وَمِنْهَا الْمِزْرُ وَهُوَ مِنَ الذُّرَةِ
[Machine] He explained these four beverages and added that wine is made from grapes and sugar is made from dates. Abu Ubaid said, and also sugar cane. It has been narrated from Al-Ash'ari that the interpretation is that it is made from corn.
أَنَّهُ فَسَّرَ هَذِهِ الْأَرْبَعَةَ الْأَشْرِبَةَ وَزَادَ وَالْخَمْرُ مِنَ الْعِنَبِ وَالسَّكَرُ مِنَ التَّمْرِ قَالَ أَبُو عُبَيْدٍ وَمِنْهَا السُّكْرُكَةُ وَقَدْ رُوِيَ عَنِ الْأَشْعَرِيِّ التَّفْسِيرُ فَقَالَ إِنَّهُ مِنَ الذُّرَةِ
[Machine] The wine of the city is made from grape juice and dates, and the wine of the people of Persia is made from grapes, and the wine of the people of Yemen is made from honey, and the wine of the Abyssinians is the sukruka. Abu Ubaid said: And among the drinks is also the fadih, which is extracted from grape juice without being touched by fire. It is narrated from Ibn Umar that it is not fadih, but it is fadukh.
خَمْرُ الْمَدِينَةِ مِنَ الْبُسْرِ وَالتَّمْرِ وَخَمْرُ أَهْلِ فَارِسَ مِنَ الْعِنَبِ وَخَمْرُ أَهْلِ الْيَمَنِ الْبِتْعُ وَهُوَ مِنَ الْعَسَلِ وَخَمْرُ الْحَبَشِ السُّكْرُكَةُ قَالَ أَبُو عُبَيْدٍ وَمِنَ الْأَشْرِبَةِ أَيْضًا الْفَضِيخُ وَهُوَ مَا افْتُضِخَ مِنَ الْبُسْرِ مِنْ غَيْرِ أَنْ تَمَسَّهُ النَّارُ وَفِيهِ يُرْوَى عَنِ ابْنِ عُمَرَ لَيْسَ بِالْفَضِيخِ وَلَكِنَّهُ الْفَضُوخُ
[Machine] Abu Ubaid, if there are dates mixed with dried grapes, it is called Khaleetain. Similarly, if there are raisins and dates, it is the same. As for Al-Ashruba Al-Mansaf, it is the juice of grapes that is cooked before boiling until half of it is gone. I have been informed that it causes intoxication, so if it causes intoxication, it is Haram. But if it is cooked until two-thirds of it is gone and one-third remains, it is called Tilaa. It is named so because it resembles the paint used on camel humps and its blackness. Some Arabs also consider Tilaa as wine, and it is narrated that Ubaid ibn Al-Abras said in a proverb [Al-Bahr Al-Mutqarib], "It is wine called Tilaa, just as the wolf is called Abu Ja'dah." He also said the same for Al-Badhaq, which is also called wine and Al-Matbukh, which is mentioned in the hadith from Ibn Abbas when he was asked about Al-Badhaq and he said, "Mohammed had preceded Al-Badhaq, and he did not consider it to be intoxicating." Ibn Abbas said that because Al-Badhaq is a Persian word that was Arabized and he did not understand it. Abu Ubaid mentioned other names as well. Then he said, "All these drinks that I mentioned are just euphemisms for wine, and I think they are included in the hadith of the Prophet ﷺ that some people from my ummah will drink wine under names they call it." He also mentioned Omar ibn Al-Khattab's statement, "Wine is what disturbs the mind."
أَبُو عُبَيْدٍ فَإِنْ كَانَ مَعَ الْبُسْرِ تَمْرٌ فَهُوَ الَّذِي يُسَمَّى الْخَلِيطَيْنِ وَكَذَلِكَ إِنْ كَانَ زَبِيبًا وَتَمْرًا فَهُوَ مِثْلُهُ وَمِنَ الْأَشْرِبَةِ الْمَنْصَفُ وَهُوَ أَنْ يُطْبَخَ عَصِيرُ الْعِنَبِ قَبْلَ أَنْ يَغْلِيَ حَتَّى يَذْهَبَ نِصْفُهُ وَقَدْ بَلَغَنِي أَنَّهُ يُسْكِرُ فَإِنْ كَانَ يُسْكِرُ فَهُوَ حَرَامٌ وَإِنْ طُبِخَ حَتَّى يَذْهَبَ ثُلُثَاهُ وَيَبْقَى ثُلُثُهُ فَهُوَ الطِّلَاءُ وَإِنَّمَا سُمِّيَ بِذَلِكَ لِأَنَّهُ شُبِّهُ بِطِلَاءِ الْإِبِلِ فِي ثِخَنِهِ وَسَوَادِهِ وَبَعْضُ الْعَرَبِ يَجْعَلُ الطِّلَاءَ الْخَمْرَ بِعَيْنِهَا يُرْوَى أَنَّ عَبِيدَ بْنَ الْأَبْرَصِ قَالَ فِي مَثَلٍ لَهُ [البحر المتقارب] هِيَ الْخَمْرُ تُكْنَى الطِّلَاءُ كَمَا الذِّئْبُ يُكْنَى أَبَا جَعْدَةَ قَالَ وَكَذَلِكَ الْبَاذَقُ وَقَدْ يُسَمَّى بِهِ الْخَمْرُ وَالْمَطْبُوخُ وَهُوَ الَّذِي يُرْوَى فِيهِ الْحَدِيثُ عَنِ ابْنِ عَبَّاسٍ أَنَّهُ سُئِلَ عَنِ الْبَاذَقِ فَقَالَ سَبَقَ مُحَمَّدٌ الْبَاذَقَ وَمَا أَسْكَرَ فَهُوَ حَرَامٌ وَإِنَّمَا قَالَ ابْنُ عَبَّاسٍ ذَلِكَ لِأَنَّ الْبَاذَقَ كَلِمَةٌ فَارِسِيَّةٌ عُرِّبَتْ فَلَمْ يَعْرِفْهَا وَذَكَرَ أَبُو عُبَيْدٍ أَسْمَاءَ سِوَاهَا ثُمَّ قَالَ وَهَذِهِ الْأَشْرِبَةُ الْمُسَمَّاةُ عِنْدِي كُلُّهَا كِنَايَةٌ عَنِ اسْمِ الْخَمْرِ وَلَا أَحْسَبُهَا إِلَّا دَاخِلَةً فِي حَدِيثِ النَّبِيِّ ﷺ أَنَّ أُنَاسًا مِنْ أُمَّتِي يَشْرَبُونَ الْخَمْرَ بِاسْمٍ يُسَمُّونَهَا بِهِ قَالَ وَمِمَّا يُبَيِّنُهُ قَوْلُ عُمَرَ بْنِ الْخَطَّابِ ؓ الْخَمْرُ مَا خَامَرَ الْعَقْلَ
57.6 [Machine] What causes intoxication, much or little of it is forbidden
٥٧۔٦ بَابُ مَا أَسْكَرَ كَثِيرُهُ فَقَلِيلُهُ حَرَامٌ
The Prophet [SAW] said: "I forbid to you small amounts of whatever intoxicates in large amounts." (Using translation from Nasāʾī 5608)
عَنْ رَسُولِ اللهِ ﷺ قَالَ أَنْهَاكُمْ عَنْ قَلِيلِ مَا أَسْكَرَ كَثِيرُهُ
The Prophet ﷺ said: If a large amount of anything causes intoxication, a small amount of it is prohibited. (Using translation from Abū Dāʾūd 3681)
قَالَ رَسُولُ اللهِ ﷺ مَا أَسْكَرَ كَثِيرُهُ فَقَلِيلُهُ حَرَامٌ
The Prophet ﷺ said: If a large amount of anything causes intoxication, a small amount of it is prohibited. (Using translation from Abū Dāʾūd 3681)
قَالَ رَسُولُ اللهِ ﷺ مَا أَسْكَرَ كَثِيرُهُ فَقَلِيلُهُ حَرَامٌ
The Prophet ﷺ said: If a large amount of anything causes intoxication, a small amount of it is prohibited. (Using translation from Abū Dāʾūd 3681)
أَنَّهُ قَالَ قَالَ رَسُولُ اللهِ ﷺ مَا أَسْكَرَ كَثِيرُهُ فَقَلِيلُهُ حَرَامٌ
The Prophet ﷺ said: If a large amount of anything causes intoxication, a small amount of it is prohibited. (Using translation from Abū Dāʾūd 3681)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ كُلُّ مُسْكِرٍ خَمْرٌ مَا أَسْكَرَ كَثِيرُهُ فَقَلِيلُهُ حَرَامٌ
[Machine] The Messenger of Allah ﷺ said, "Whatever intoxicates in large quantities, a little of it is prohibited, and likewise…"
أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَا أَسْكَرَ كَثِيرُهُ فَقَلِيلُهُ حَرَامٌ وَكَذَلِكَ
I heard the Messenger of Allah ﷺ say: Every intoxicant is forbidden; if a faraq of anything causes intoxication, a handful of it is forbidden. (Using translation from Abū Dāʾūd 3687)
النَّبِيِّ ﷺ أَنَّهُ قَالَ كُلُّ مُسْكِرٍ حَرَامٌ وَمَا أَسْكَرَ مِنْهُ الْفَرَقُ فَمِلْءُ الْكَفِّ مِنْهُ حَرَامٌ
[Machine] The Prophet ﷺ said: "Every intoxicant is forbidden, and whatever makes one drunk in large amounts, even a small amount of it is also forbidden."
عَنِ النَّبِيِّ ﷺ قَالَ كُلُّ مُسْكِرٍ حَرَامٌ وَمَا أَسْكَرَ مِنْهُ الْفَرَقُ فَالْحَسْوَةُ مِنْهُ حَرَامٌ
The Messenger of Allah ﷺ forbade every intoxicant and everything which produces languidness. (Using translation from Abū Dāʾūd 3686)
نَهَى رَسُولُ اللهِ ﷺ عَنْ كُلِّ مُسْكِرٍ وَمُفَتِّرٍ
57.7 [Machine] What is permissible in intoxicants if one does not consume enough to become intoxicated, and the answer is: Allah, may He be glorified and exalted, said: "You take from it intoxication and good provision." [Quran 16:67]
٥٧۔٧ بَابُ مَا يُحْتَجُّ بِهِ مِنْ رُخَصٍ فِي الْمُسْكِرِ إِذَا لَمْ يُشْرَبْ مِنْهُ مَا يُسْكِرُهُ، وَالْجَوَابُ عَنْهُ قَالَ اللهُ تَبَارَكَ وَتَعَالَى: {تَتَّخِذُونَ مِنْهُ سَكَرًا وَرِزْقًا حَسَنًا} [النحل: 67]
[Machine] "About this verse, 'You take from it (the bees) intoxication and a good provision' [An-Nahl 67], Al-Sakar (intoxication) refers to what is prohibited from its fruits, and Al-Rizq Al-Hasan (good provision) refers to what is permissible from its fruits."
عَنْ هَذِهِ الْآيَةِ {تَتَّخِذُونَ مِنْهُ سَكَرًا وَرِزْقًا حَسَنًا} [النحل 67] قَالَ السَّكَرُ مَا حُرِّمَ مِنْ ثَمَرَتِهَا وَالرِّزْقُ الْحَسَنُ مَا حَلَّ مِنْ ثَمَرَتِهَا
[Machine] In His saying, "{you take from it intoxication}" [An-Nahl 67], Allah prohibited intoxication after prohibiting alcohol because it is a form of it. He said, "{and good provision}" [An-Nahl 67], so it is permissible, such as vinegar, syrup, grape juice, and similar items. Allah affirmed it and made it permissible for Muslims. It has been narrated from Abu 'Ubaid that he said, "Intoxication is the soaking of dates." This is also indicated by the narration of Ibn Abi Talha from Ibn Abbas, which shows that it is included in the prohibition when alcohol was prohibited because it is a form of it.
فِي قَوْلِهِ {تَتَّخِذُونَ مِنْهُ سَكَرًا} [النحل 67] فَحَرَّمَ اللهُ بَعْدَ ذَلِكَ السَّكَرَ مَعَ تَحْرِيمِ الْخَمْرِ؛ لِأَنَّهُ مِنْهَا قَالَ {ورِزْقًا حَسَنًا} [النحل 67] فَهُوَ حَلَالُهُ مِنَ الْخَلِّ وَالرُّبِّ وَالنَّبِيذِ وَأَشْبَاهِ ذَلِكَ فَأَقَرَّهُ اللهُ وَجَعَلَهُ اللهُ حَلَالًا لِلْمُسْلِمِينَ وَقَدْ رُوِّينَا عَنْ أَبِي عُبَيْدٍ أَنَّهُ قَالَ السَّكَرُ نَقِيعُ التَّمْرِ وَعَلَيْهِ تَدُلُّ رِوَايَةُ ابْنِ أَبِي طَلْحَةَ عَنِ ابْنِ عَبَّاسٍ مَعَ الدَّلَالَةِ عَلَى دُخُولِهِ فِي التَّحْرِيمِ حِينَ حُرِّمَتِ الْخَمْرُ؛ لِأَنَّهُ مِنْهَا
[Machine] Sugar and alcohol are prohibited before they are forbidden, and good sustenance is its food.
السَّكَرُ الْخَمْرُ قَبْلَ تَحْرِيمِهَا وَالرِّزْقُ الْحَسَنُ طَعَامُهُ
[Machine] Ibrahim, Al-Sha'bi, and Abu Razin said about this verse "You take from it intoxication and good provision" [An-Nahl 67] it is abrogated.
عَنْ إِبْرَاهِيمَ وَالشَّعْبِيِّ وَأَبِي رَزِينٍ قَالُوا فِي هَذِهِ الْآيَةِ {تَتَّخِذُونَ مِنْهُ سَكَرًا وَرِزْقًا حَسَنًا} [النحل 67] هِيَ مَنْسُوخَةٌ
[Machine] Alcohol itself, in both small and large quantities, is prohibited, as well as any form of intoxication that may be found in any beverage. The mentioned intoxication refers to alcohol.
حُرِّمَتِ الْخَمْرُ بِعَيْنِهَا الْقَلِيلُ مِنْهَا وَالْكَثِيرُ وَالسَّكَرُ مِنْ كُلِّ شَرَابٍ وَالْمُرَادُ بِالسَّكَرِ الْمَذْكُورُ فِيهِ الْمُسْكِرُ
[Machine] The wine itself, in both small and large quantities, is forbidden, as well as any intoxicating drink. Abu Abdullah informed us that the teacher Abu Al-Walid Hassan bin Muhammad narrated to us that Abdullah bin Muhammad Al-Bagawi narrated to us that Ahmad bin Hanbal mentioned it with its chain of transmission, except that he did not mention "small and large quantities" like that.
حُرِّمَتِ الْخَمْرُ بِعَيْنِهَا قَلِيلُهَا وَكَثِيرُهَا وَالْمُسْكِرُ مِنْ كُلِّ شَرَابٍ 17406 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ ثنا الْأُسْتَاذُ أَبُو الْوَلِيدِ حَسَّانُ بْنُ مُحَمَّدٍ أَمْلَاهُ عَلَيْنَا ثنا عَبْدُ اللهِ بْنُ مُحَمَّدٍ الْبَغَوِيُّ ثنا أَحْمَدُ بْنُ حَنْبَلٍ فَذَكَرَهُ بِإِسْنَادِهِ إِلَّا أَنَّهُ لَمْ يَقُلْ قَلِيلُهَا وَكَثِيرُهَا وَكَذَلِكَ
The Prophet ﷺ said: If a large amount of anything causes intoxication, a small amount of it is prohibited. (Using translation from Abū Dāʾūd 3681)
قَلِيلُ مَا أَسْكَرَ كَثِيرُهُ حَرَامٌ
اشْرَبُوا وَلَا تَسْكَرُوا فَكَذَا
"The Prophet ﷺ had fixed the Mawaqit as follows: (No. 603) (Using translation from Bukhārī 1527)
عَنْ أَبِيهِ
I had forbidden you from the preparation of Nabidh except in a waterskin. But now you may drink in all vessels, but do not drink what is intoxicant. (Using translation from Muslim 977c)
قَالَ رَسُولُ اللهِ ﷺ نَهَيْتُكُمْ عَنِ النَّبِيذِ إِلَّا فِي سِقَاءٍ فَاشْرَبُوا فِي الْأَسْقِيَةِ كُلِّهَا وَلَا تَشْرَبُوا مُسْكِرًا
[Machine] Every intoxicant is prohibited. It is the drink that intoxicates you.
كُلُّ مُسْكِرٍ حَرَامٌ هِيَ الشَّرْبَةُ الَّتِي تُسْكِرُكَ
أَنْ يَعُودَ فِيهِ
[Machine] Zakariya ibn Adi said, when Ibn al-Mubarak arrived in Kufa, he was sick. Waki' and our companions, along with the people of Kufa, visited him and had a discussion with him until it was time for a drink. Ibn al-Mubarak began to present the narrations of the Messenger of Allah ﷺ, his companions, the Muhajirun, and the Ansar from the people of Madinah. They said, "No, but rather from our narrations." Ibn al-Mubarak then mentioned that Al-Hasan ibn 'Amr al-Fuqaymi narrated from Fudail ibn 'Amr, who narrated from Ibrahim, who said, "They used to say that if someone was intoxicated from a drink, it was forbidden for them to ever drink it again, so they would pour it over their heads." Ibn al-Mubarak said to the one who followed him, "Did you see how amazing these people are? I spoke to them about the Messenger of Allah ﷺ, his companions, and the followers, but they did not care. And I mentioned what Ibrahim said, and they poured the drink over their heads."
قَالَ زَكَرِيَّا بْنُ عَدِيٍّ لَمَّا قَدِمَ ابْنُ الْمُبَارَكِ الْكُوفَةَ كَانَتْ بِهِ عِلَّةٌ فَأَتَاهُ وَكِيعٌ وَأَصْحَابُنَا وَالْكُوفِيُّونَ فَتَذَاكَرُوا عِنْدَهُ حَتَّى بَلَغُوا الشَّرَابَ فَجَعَلَ ابْنُ الْمُبَارَكِ يَحْتَجُّ بِأَحَادِيثِ رَسُولِ اللهِ ﷺ وَأَصْحَابِ النَّبِيِّ ﷺ وَالْمُهَاجِرِينَ وَالْأَنْصَارِ مِنْ أَهْلِ الْمَدِينَةِ قَالُوا لَا وَلَكِنْ مِنْ حَدِيثِنَا فَقَالَ ابْنُ الْمُبَارَكِ أنبأ الْحَسَنُ بْنُ عَمْرٍو الْفُقَيْمِيُّ عَنْ فُضَيْلِ بْنِ عَمْرٍو عَنْ إِبْرَاهِيمَ قَالَ كَانُوا يَقُولُونَ إِذَا سَكِرَ مِنْ شَرَابٍ لَمْ يَحِلَّ لَهُ أَنْ يَعُودَ فِيهِ أَبَدًا فَنَكَّسُوا رُءُوسَهُمْ فَقَالَ ابْنُ الْمُبَارَكِ لِلَّذِي يَلِيهِ رَأَيْتَ أَعْجَبَ مِنْ هَؤُلَاءِ أُحَدِّثُهُمْ عَنْ رَسُولِ اللهِ ﷺ وَعَنْ أَصْحَابِهِ وَالتَّابِعِينَ فَلَمْ يَعْبَئُوا بِهِ وَأَذْكُرُ عَنْ إِبْرَاهِيمَ فَنَكَّسُوا رُءُوسَهُمْ؟
57.8 [Machine] What is mentioned about the description of their wine that they used to drink in the narration of Anas ibn Malik and others from the Prophet ﷺ and his companions?
٥٧۔٨ بَابُ مَا جَاءَ فِي صِفَةِ نَبِيذِهِمُ الَّذِي كَانُوا يَشْرَبُونَهُ فِي حَدِيثِ أَنَسِ بْنِ مَالِكٍ وَغَيْرِهِ عَنِ النَّبِيِّ ﷺ وَأَصْحَابِهِ
[Machine] I have indeed given the Messenger of Allah ﷺ a cup containing all of this drink, honey, wine, water, and milk.
لَقَدْ سَقَيْتُ رَسُولَ اللهِ ﷺ بِقَدَحِي هَذَا الشَّرَابَ كُلَّهُ الْعَسَلَ وَالنَّبِيذَ وَالْمَاءَ وَاللَّبَنَ
[Machine] Umar said, "Indeed, we drink wine that cuts the meat of camels in our stomachs before it harms us."
قَالَ عُمَرُ ؓ إِنَّا لَنَشْرَبُ مِنَ النَّبِيذِ نَبِيذًا يَقْطَعُ لُحُومَ الْإِبِلِ فِي بُطُونِنَا مِنْ أَنْ تُؤْذِيَنَا
I met 'A'isha and asked her about Nabidh (that was served to the Holy Prophet). 'A'isha called an Abyssinian maid (servant) and said: Ask her (about it) for it was he, who prepared the Nabidh for the Messenger of Allah ﷺ. The Abyssinian (maid-servant) said: I prepared Nabidh for him in a waterskin in the night and tied its mouth and then suspended it; and when it was morning he (the Holy Prophet) drank from it. النَّبِيذِ فَدَعَتْ عَائِشَةُ جَارِيَةً حَبَشِيَّةً فَقَالَتْ سَلْ هَذِهِ إِنَّهَا كَانَتْ تَنْبِذُ لِرَسُولِ اللهِ ﷺ فَقَالَتِ الْحَبَشِيَّةُ كُنْتُ أَنْبِذُ لَهُ فِي سِقَاءٍ مِنَ اللَّيْلِ وَأُوكِيهِ وَأُعَلِّقُهُ فَإِذَا أَصْبَحَ شَرِبَ مِنْهُ لَفْظُ حَدِيثِ شَيْبَانَ
Dates were steeped for the Apostel of Allah ﷺ in skin which was tied up at the top and had a mouth. What was steeped in the morning he would drink in the evening and what was steeped in the evening he would drink in the morning. (Using translation from Abū Dāʾūd 3711)
كُنَّا نَنْبِذُ لِرَسُولِ اللهِ ﷺ فِي سِقَاءٍ وُكِيَ أَعْلَاهُ وَلَهُ عَزْلَاءُ نَنْبِذُ غُدْوَةً فَيَشْرَبُهُ عِشَاءً وَنَنْبِذُ عِشَاءً فَيَشْرَبُهُ غُدْوَةً
Amrah said on the authority of Aisha that she would steep dates for the Messenger of Allah ﷺ in the morning. When the evening came, he took his dinner and drank it after his dinner. If anything remained, she poured it out. She then would steep for him at night. When the morning came, he took his morning meal and drank it after his morning meal. She said: The skin vessel was washed in the morning and in the evening. My father (Hayyan) said to her: Twice a day? She said: Yes. (Using translation from Abū Dāʾūd 3712)
كَانَتْ تَنْبِذُ لِرَسُولِ اللهِ ﷺ غُدْوَةً فَإِذَا كَانَ مِنَ الْعَشِيِّ فَتَعَشَّى شَرِبَ عَلَى عَشَائِهِ فَإِنْ فَضَلَ شَيْءٌ صَبَبْتُهُ أَوْ فَرَّغْتُهُ ثُمَّ تَنْبِذُ لَهُ بِاللَّيْلِ فَإِذَا أَصْبَحَ تَغَدَّى فَشَرِبَ عَلَى غَدَائِهِ قَالَتْ تَغْسِلُ السِّقَاءَ غُدْوَةً وَعَشِيَّةً فَقَالَ لَهَا أَبِي مَرَّتَيْنِ فِي يَوْمٍ؟ قَالَتْ نَعَمْ
[Machine] About wine, the Prophet ﷺ said: The Messenger of Allah ﷺ went on a journey and returned from his journey. Some of his companions had brought wine for themselves in water skins, gourds, and water bags. He ordered that it be poured out. Then he ordered a water vessel to be brought, and raisins and water were placed in it. It would be left for him at night, and in the morning he would drink from it throughout the day and night until the next evening. When the evening came, he would drink from it and give it to others to drink. If anything was left in it in the morning, he would order that it be poured out.
عَنِ النَّبِيذِ فَقَالَ خَرَجَ رَسُولُ اللهِ ﷺ فِي سَفَرٍ فَرَجَعَ مِنْ سَفَرِهِ وَأُنَاسٌ مِنْ أَصْحَابِهِ قَدِ انْتَبَذُوا نَبِيذًا لَهُمْ فِي نَقِيرٍ وَحَنَاتِمَ وَدُبَّاءٍ فَأَمَرَ بِهَا فَأُهْرِيقَتْ قَالَ فَأَمَرَ بِسِقَاءٍ فَجُعِلَ فِيهِ زَبِيبٌ وَمَاءٌ وَكَانَ يُنْبَذُ لَهُ مِنَ اللَّيْلِ فَيُصْبِحُ فَيَشْرَبُ يَوْمَهُ ذَلِكَ وَلَيْلَتَهُ الَّتِي تُسْتَقْبَلُ وَمِنَ الْغَدِ حَتَّى يُمْسِيَ فَإِذَا أَمْسَى شَرِبَ مِنْهُ وَسَقَى فَإِنْ أَصْبَحَ فِيهِ شَيْءٌ أَمَرَ بِهِ فَأُهْرِيقَ
[Machine] The Prophet ﷺ used to have raisins thrown for him at night in a bowl. When morning came, he would drink its juice throughout the day and night. And if there was any leftover by the following evening, he would drink it or have his servants give him a drink. If there was an excess, he would pour it out.
كَانَ رَسُولُ اللهِ ﷺ يُنْبَذُ لَهُ الزَّبِيبُ مِنَ اللَّيْلِ فِي السِّقَاءِ فَإِذَا أَصْبَحَ شَرِبَهُ يَوْمَهُ وَلَيْلَتَهُ وَمِنَ الْغَدِ فَإِذَا كَانَ مَسَاءُ الثَّالِثِ شَرِبَهُ أَوْ سَقَاهُ الْخَدَمَ فَإِنْ فَضَلَ شَيْءٌ أَهْرَاقَهُ
[Machine] " When Abu Usaid got married, the Prophet ﷺ and his companions were invited, but no food was prepared for them except by his wife, Umm Usaid. She spread dates for them at night on a stone tray. When the Prophet ﷺ finished eating, she collected the leftover food and poured it into a container."
أَنَّهُ لَمَّا عَرَّسَ أَبُو أُسَيْدٍ دَعَا النَّبِيُّ ﷺ وَأَصْحَابَهُ فَمَا صَنَعَ لَهُمْ طَعَامًا وَلَا قَرَّبَهُ إِلَيْهِمْ إِلَّا امْرَأَتُهُ أُمُّ أُسَيْدٍ وَبَلَّتْ تَمَرَاتٍ مِنَ اللَّيْلِ فِي تَوْرٍ مِنْ حِجَارَةٍ فَلَمَّا فَرَغَ رَسُولُ اللهِ ﷺ مِنَ الطَّعَامِ أَمَاثَتْهُ فَسَقَتْهُ
We came to the Prophet ﷺ and said to him: Messenger of Allah, you know who we are, from where we are and to whom we have come. He said: To Allah and His Apostle. We said: Messenger of Allah, we have grapes; what should we do with them? He said: Make them raisins. We then asked: What should we do with raisins? He replied: Steep them in the morning and drink in the evening, and steep them in the evening and drink in the morning. Steep them in skin vessels and do not steep them in earthen jar, for it it is delayed in pressing, it becomes vinegar. (Using translation from Abū Dāʾūd 3710)
أَتَيْنَا النَّبِيَّ ﷺ فَقُلْنَا يَا رَسُولَ اللهِ قَدْ عَلِمْتَ مَنْ نَحْنُ وَمِنْ أَيْنَ نَحْنُ فَإِلَى مَنْ نَحْنُ؟ قَالَ إِلَى اللهِ ﷻ وَإِلَى رَسُولِهِ فَقُلْنَا يَا رَسُولَ اللهِ إِنَّ لَنَا أَعْنَابًا مَا نَصْنَعُ بِهَا؟ قَالَ زَبِّبُوهَا قُلْنَا مَا نَصْنَعُ بِالزَّبِيبِ؟ قَالَ انْبِذُوهُ عَلَى غَدَائِكُمْ وَاشْرَبُوهُ عَلَى عَشَائِكُمْ وَانْبِذُوهُ عَلَى عَشَائِكُمْ وَاشْرَبُوهُ عَلَى غَدَائِكُمْ وَانْبِذُوهُ فِي الشِّنَانِ وَلَا تَنْبِذُوهُ فِي الْقُلَلِ فَإِنَّهُ إِذَا تَأَخَّرَ عَنْ عَصْرِهِ صَارَ خَلًّا
[Machine] "If the wine of the Prophet ﷺ becomes strong, I will add raisins to it to absorb its acidity," said the sheikh. "And like this quality, the wine of Umar ibn Al-Khattab and other companions was. Don't you see that Umar only allowed painting after his drunkenness and evil had subsided and the influence of his Satan had decreased?"
إِذَا اشْتَدَّ نَبِيذُ النَّبِيِّ ﷺ جَعَلْتُ فِيهِ زَبِيبًا يَلْتَقِطُ حُمُوضَتَهُ قَالَ الشَّيْخُ وَعَلَى مِثْلِ هَذِهِ الصِّفَةِ كَانَ نَبِيذُ عُمَرَ بْنِ الْخَطَّابِ وَغَيْرِهِ مِنَ الصَّحَابَةِ ؓ أَلَا تَرَى أَنَّ عُمَرَ ؓ إِنَّمَا أَحَلَّ الطِّلَاءَ حِينَ ذَهَبَ سُكْرُهُ وَشَرُّهُ وَحَظُّ شَيْطَانِهِ؟
[Machine] Umar ordered them to drink it. Ubadah bin As-Samit said, "O leader of the believers, have you made it permissible?" Umar replied, "No, by Allah, I will not make anything permissible for them that Allah has forbidden, nor will I make anything forbidden for them that Allah has made permissible for them."
عُمَرُ ؓ اشْرَبُوا الْعَسَلَ فَقَالُوا لَا يُصْلِحُنَا الْعَسَلُ فَقَالَ رَجُلٌ مِنْ أَهْلِ الْأَرْضِ هَلْ لَكَ أَنْ نَجْعَلَ لَكَ مِنْ هَذَا الشَّرَابِ شَيْئًا لَا يُسْكِرُ؟ فَقَالَ نَعَمْ فَطَبَخُوهُ حَتَّى ذَهَبَ مِنْهُ الثُّلُثَانِ وَبَقِيَ الثُّلُثُ فَأَتَوْا بِهِ عُمَرَ ؓ فَأَدْخَلَ عُمَرُ ؓ فِيهِ أُصْبُعَهُ ثُمَّ رَفَعَ يَدَهُ فَتَبِعَهَا يَتَمَطَّطُ فَقَالَ هَذَا الطِّلَاءُ هَذَا مِثْلُ طِلَاءِ الْإِبِلِ فَأَمَرَهُمْ عُمَرُ ؓ أَنْ يَشْرَبُوهُ فَقَالَ لَهُ عُبَادَةُ بْنُ الصَّامِتِ أَحْلَلْتَهَا وَاللهِ فَقَالَ عُمَرُ ؓ كَلَّا وَاللهِ اللهُمَّ إِنِّي لَا أُحِلُّ لَهُمْ شَيْئًا حَرَّمْتَهُ عَلَيْهِمْ وَلَا أُحَرِّمُ عَلَيْهِمْ شَيْئًا أَحْلَلْتَهُ لَهُمْ
[Machine] Cook your drink until the portion of the devil in it disappears, for the devil has two portions and you have one.
أَنِ اطْبُخُوا شَرَابَكُمْ حَتَّى يَذْهَبَ نَصِيبُ الشَّيْطَانِ مِنْهُ فَإِنَّ لِلشَّيْطَانِ اثْنَيْنِ وَلَكُمْ وَاحِدَةً
[Machine] The wine that Umar would drink would be soaked with raisins in the morning and he would drink it in the evening, and it would be soaked with raisins in the evening and he would drink it in the morning, and it does not have any sediment in it.
كَانَ النَّبِيذُ الَّذِي يَشْرَبُ عُمَرُ ؓ كَانَ يُنْقَعُ لَهُ الزَّبِيبُ غُدْوَةً فَيَشْرَبُهُ عَشِيَّةً وَيُنْقَعُ لَهُ عَشِيَّةً فَيَشْرَبُهُ غُدْوَةً وَلَا يُجْعَلُ فِيهِ دُرْدِيٌّ
[Machine] I came to the Messenger of Allah ﷺ with a jar containing wine, so he forbade me from it. I then broke it. Swayd said, "Abstain from it at the beginning of the night and drink it at the end of the night, and abstain from it at the beginning of the day and drink it at the end of the day." This is the wording of the hadith of As-Saghani, and in the narration of Al-Hasan, he said it was narrated from Hilal Al-Mazini.
أَتَيْتُ رَسُولَ اللهِ ﷺ بِجَرَّةٍ فِيهَا نَبِيذٌ فَنَهَانِي عَنْهُ فَكَسَرْتُهَا قَالَ وَقَالَ سُوَيْدٌ انْتَبِذْ أَوَّلَ اللَّيْلِ وَاشْرَبْهُ آخِرَ اللَّيْلِ وَانْتَبِذْ أَوَّلَ النَّهَارِ وَاشْرَبْهُ آخِرَ النَّهَارِ لَفْظُ حَدِيثِ الصَّغَانِيِّ وَفِي رِوَايَةِ الْحَسَنِ قَالَ عَنْ هِلَالٍ الْمَازِنِيِّ
57.9 [Machine] What is in the fraction in water?
٥٧۔٩ بَابُ مَا جَاءَ فِي الْكَسْرِ بِالْمَاءِ
[Machine] A man from us, O Messenger of Allah, indeed our land is barren and our environment does not allow anything except drinking. So what is permissible for us in terms of utensils and what is forbidden for us? He said, "Do not drink from a gourd, a dried animal skin, or a flask. Drink from a water skin or a Moroccan water bag, and if it becomes strong, break it with water, and if it becomes difficult, pour it out." The scholar, may Allah have mercy on him, said: The authentic narrations in the story of the delegation of Abdul Qais do not include this wording. And in this chain, the condition of one narrator is unknown, and Allah knows best. And it has been narrated from Abu Hurayrah in this story that he said, "If you fear its harm or its strength, pour water onto it."
رَجُلٌ مِنَّا يَا رَسُولَ اللهِ إِنَّ أَرْضَنَا أَرْضٌ وَبِيئَةٌ وَإِنَّهُ لَا يُوَافِقُهَا إِلَّا الشَّرَابُ فَمَا الَّذِي يَحِلُّ لَنَا مِنَ الْآنِيَةِ وَمَا الَّذِي يَحْرُمُ عَلَيْنَا؟ قَالَ لَا تَشْرَبُوا فِي الدُّبَّاءِ وَلَا النَّقِيرِ وَلَا الْمُزَفَّتِ وَاشْرَبُوا فِي الْجِلَالِ أَوْ قَالَ الْجِلْدِ الْمُوكَى عَلَيْهِ فَإِنِ اشْتَدَّ مَتْنُهُ فَاكْسِرُوهُ بِالْمَاءِ فَإِنْ أَعْيَاكُمْ فَاهِرِيقُوهُ قَالَ الشَّيْخُ رَحِمَهُ اللهُ الرِّوَايَاتُ الثَّابِتَةُ فِي قِصَّةِ وَفْدِ عَبْدِ الْقَيْسِ خَالِيَةٌ عَنْ هَذِهِ اللَّفْظَةِ وَفِي هَذَا الْإِسْنَادِ مَنْ يُجْهَلُ حَالُهُ وَاللهُ أَعْلَمُ وَقَدْ رُوِيَ عَنْ أَبِي هُرَيْرَةَ ؓ فِي هَذِهِ الْقِصَّةِ أَنَّهُ قَالَ فَإِنْ خَشِيَ شِرَّتَهُ أَوْ قَالَ شِدَّتَهُ فَلْيَصُبَّ عَلَيْهِ الْمَاءَ
[Machine] From the Hadith of the Messenger of Allah, ﷺ , that he said to the delegation of Abdul Qays: "Do not drink from a bottle, a pitcher, a gourd, a waterskin, or a wooden drinking cup. Rather, drink from the cup of one of you, but not if it intoxicates. If it is feared that it may intoxicate, then pour water over it." This wording is attributed to Ibn Mani' and it was narrated by a group of narrators, except they did not mention this wording. It is likely that it is from the statement of some of the narrators. It is also narrated in a different way that pouring water over it means breaking it, and this is narrated from another angle from Abu Huraira, and its chain of narration is weak.
عَنْ رَسُولِ اللهِ ﷺ أَنَّهُ قَالَ لِوَفْدِ عَبْدِ الْقَيْسِ لَا تَشْرَبُوا فِي نَقِيرٍ وَلَا مُقَيَّرٍ وَلَا دُبَّاءٍ وَلَا حَنْتَمٍ وَلَا مَزَادَةٍ وَلَكِنِ اشْرَبُوا فِي سِقَاءِ أَحَدِكُمْ غَيْرَ مُسْكِرٍ فَإِنْ خُشِيَ شِرَّتُهُ فَلْيَصُبَّ عَلَيْهِ الْمَاءَ لَفْظُ ابْنِ مَنِيعٍ وَرَوَاهُ جَمَاعَةٌ عَنْ نُوحِ بْنِ قَيْسٍ لَمْ يَذْكُرُوا فِيهِ هَذِهِ اللَّفْظَةَ فَيُشْبِهُ أَنْ تَكُونَ مِنْ قَوْلِ بَعْضِ الرُّوَاةِ وَرُوِيَ فِي الْكَسْرِ بِالْمَاءِ مِنْ وَجْهٍ آخَرَ عَنْ أَبِي هُرَيْرَةَ وَإِسْنَادُهُ ضَعِيفٌ
[Machine] The first person to ask the Messenger of Allah ﷺ about wine was 'Abd al-Qays. They said, "O Messenger of Allah, we live in a rural area and we receive a portion of barley. Command us to drink a beverage." He said, "Drink from the pitchers and do not drink from the jar, the wine press, the Nabiq, and I have forbidden you from intoxicants, khamr, and instruments of gambling, and that is the drum. Every intoxicant is prohibited." They said, "O Messenger of Allah, what if it becomes intense?" He said, "Pour water on it." They said, "And if it becomes even more intense?" He said, "Pour water on it." He said in the third or fourth [instance], "Then empty it out." Abu Jamrah differs from Ibn Abbas and the mention of breaking it with water is from the statement of Ibn Abbas. 17432 Abu Nasr ibn Qatadah informed us that Abu 'Amr ibn Matar and Abu al-Hasan al-Siraj said, Muhammad ibn Yahya ibn Sulayman informed us that 'Asim ibn Ali narrated to us, Shu'bah informed me, Abu Jamrah said, "Ibn Abbas used to make me sit on his bed and he mentioned the hadith." I said, "What if 'Abd al-Qays buys very strong wine in a market?" He said, "If he fears its strength, break it with water." Then he said, "When 'Abd al-Qays came to the Messenger of Allah ﷺ, he mentioned the hadith and there was no command to break it with water. And this is subject to the will of Allah. Ibn Abbas intended breaking it with water in this situation and in others when he feared its intensity before reaching the level of intoxication, as indicated by his statement, 'And every intoxicant is prohibited, and what is prohibited does not become permissible by adding water to it.'"
إِنَّ أَوَّلَ مَنْ سَأَلَ رَسُولَ اللهِ ﷺ عَنِ النَّبِيذِ عَبْدُ الْقَيْسِ أَتَوْهُ فَقَالُوا يَا رَسُولَ اللهِ إِنَّا بِأَرْضِ رِيفٍ وَإِنَّا نُصِيبُ مِنَ الْبَقْلِ فَأْمُرْنَا بِشَرَابٍ فَقَالَ اشْرَبُوا فِي الْأَسْقِيَةِ وَلَا تَشْرَبُوا فِي الْجَرِّ وَلَا فِي الدُّبَّاءِ وَلَا الْمُزَفَّتِ وَلَا النَّقِيرِ وَإِنِّي نَهَيْتُ عَنِ الْخَمْرِ وَالْمَيْسِرِ وَالْكُوبَةِ وَهِيَ الطَّبْلُ وَكُلُّ مُسْكِرٍ حَرَامٌ قَالُوا يَا رَسُولَ اللهِ فَإِذَا اشْتَدَّ؟ قَالَ فَقَالَ صُبُّوا عَلَيْهِ الْمَاءَ قَال فَإِذَا اشْتَدَّ؟ قَالَ صُبُّوا عَلَيْهِ الْمَاءَ قَالَ فِي الثَّالِثَةِ أَوِ الرَّابِعَةِ فَإِذَا اشْتَدَّ فَاهَرِيقُوهُ خَالَفَهُ أَبُو جَمْرَةَ عَنِ ابْنِ عَبَّاسٍ فَذِكْرُ الْكَسْرِ بِالْمَاءِ مِنْ قَوْلِ ابْنِ عَبَّاسٍ 17432 أَخْبَرَنَاهُ أَبُو نَصْرِ بْنُ قَتَادَةَ أنبأ أَبُو عَمْرِو بْنُ مَطَرٍ وَأَبُو الْحَسَنِ السِّرَاجُ قَالَا ثنا مُحَمَّدُ بْنُ يَحْيَى بْنِ سُلَيْمَانَ ثنا عَاصِمُ بْنُ عَلِيٍّ ثنا شُعْبَةُ أَخْبَرَنِي أَبُو جَمْرَةَ قَالَ كَانَ ابْنُ عَبَّاسٍ يُقْعِدُنِي عَلَى سَرِيرِهِ فَذَكَرَ الْحَدِيثَ قَالَ قُلْتُ فَإِنَّ عَبْدَ الْقَيْسِ تَنْتَبِذُ فِي مَزَادٍ لَهَا نَبِيذًا شَدِيدًا قَالَ فَإِذَا خَشِيتَ شِدَّتَهُ فَاكْسِرْهُ بِالْمَاءِ ثُمَّ قَالَ إِنَّ عَبْدَ الْقَيْسِ لَمَّا أَتَوْا رَسُولَ اللهِ ﷺ فَذَكَرَ الْحَدِيثَ لَيْسَ فِيهِ الْأَمْرُ بِالْكَسْرِ بِالْمَاءِ وَذَلِكَ يَرِدُ إِنْ شَاءَ اللهُ وَإِنَّمَا أَرَادَ بِالْكَسْرِ بِالْمَاءِ فِي هَذَا وَفِي غَيْرِهِ إِذَا خَشِيَ شِدَّتَهُ قَبْلَ بُلُوغِهِ حَدَّ الْإِسْكَارِ بِدَلِيلِ قَوْلِهِ وَكُلُّ مُسْكِرٍ حَرَامٌ وَالْحَرَامُ لَا يُحِلُّهُ دُخُولُ الْمَاءِ فِيهِ
