57. Drinks
٥٧۔ كِتَابُ الْأَشْرِبَةِ وَالْحَدُّ فِيهَا
A Muslim is a Muslim’s brother: he does not wrong him or abandon him. If anyone cares for his brother’s need, Allah will care for his need ; if anyone removes a Muslim’s anxiety, Allah will remove from him, on account of it, one of the anxieties of the Day of resurrection ; and if anyone conceals a Muslim’s fault, Allah will conceal his fault on the Day of resurrection. أَخْبَرَهُ أَنَّ رَسُولَ اللهِ ﷺ قَالَ الْمُسْلِمُ أَخُو الْمُسْلِمِ لَا يَظْلِمُهُ وَلَا يُسْلِمُهُ مَنْ كَانَ فِي حَاجَةِ أَخِيهِ كَانَ اللهُ فِي حَاجَتِهِ وَمَنْ فَرَّجَ عَنْ مُسْلِمٍ كُرْبَةً فَرَّجَ اللهُ عَنْهُ بِهَا كُرْبَةً مِنْ كُرَبِ يَوْمِ الْقِيَامَةِ وَمَنْ سَتَرَ عَلَى مُسْلِمٍ سَتَرَهُ اللهُ يَوْمَ الْقِيَامَةِ
[Machine] About the Prophet in the story of Ma'iz ibn Malik, he said to him, "O Hazal, if you had covered it with your garment, it would have been better for you than what you have done."
عَنِ النَّبِيِّ ﷺ فِي قِصَّةِ مَاعِزِ بْنِ مَالِكٍ قَالَ فِيهِ يَا هَزَّالُ لَوْ سَتَرْتَهُ بِثَوْبِكَ كَانَ خَيْرًا لَكَ مِمَّا صَنَعْتَ
[Machine] The Prophet ﷺ said, "If you had covered it with your garment, it would have been better for you like this."
لَهُ النَّبِيُّ ﷺ لَوْ كُنْتَ سَتَرْتَهُ بِثَوْبِكَ كَانَ خَيْرًا لَكَ كَذَا
[Machine] The Messenger of Allah ﷺ said to a man who had embraced Islam and was called Hazal: "If you cover him with your own garment, it would be better for you." Yahya narrated that he mentioned this hadith in a gathering which included Yazid ibn Nuaim ibn Hazal al-Aslami, who responded, "Hazal is my grandfather, and this hadith is correct. This is more authentic than what was said before."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لِرَجُلٍ مِنْ أَسْلَمَ يُدْعَى هَزَّالًا لَوْ سَتَرْتَهُ بِثَوْبِكَ لَكَانَ خَيْرًا لَكَ قَالَ يَحْيَى فَحَدَّثْتُ بِهَذَا الْحَدِيثِ فِي مَجْلِسٍ فِيهِ يَزِيدُ بْنُ نُعَيْمِ بْنِ هَزَّالٍ الْأَسْلَمِيُّ فَقَالَ هَزَّالٌ جَدِّي وَهَذَا الْحَدِيثُ حَقٌّ هَذَا أَصَحُّ مِمَّا قَبْلَهُ
[Machine] To come to the Prophet ﷺ and inform him, and Layth narrated it from Yahya ibn Sa'id, from Yazid ibn Nuaim, from his grandfather Hazal, and similarly.
أَنْ يَأْتِيَ النَّبِيَّ ﷺ فَيُخْبِرَهُ وَرَوَاهُ اللَّيْثُ عَنْ يَحْيَى بْنِ سَعِيدٍ عَنْ يَزِيدَ بْنِ نُعَيْمٍ عَنْ جَدِّهِ هَزَّالٍ وَكَذَلِكَ
The Prophet ﷺ said: He who sees something which should be kept hidden and conceals it will be like one who has brought to life a girl buried alive. (Using translation from Abū Dāʾūd 4891)
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَنْ رَأَى عَوْرَةً فَسَتَرَهَا كَانَ كَمَنْ أَحْيَا مَوْءُودَةً مِنْ قَبْرِهَا
[Machine] I heard the Messenger of Allah ﷺ saying, "Whoever conceals the faults of a believer, it is as if he revived a drowned corpse from its grave."
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَنْ سَتَرَ عَوْرَةَ مُؤْمِنٍ فَكَأَنَّمَا اسْتَحْيَا مَوْءُودَةً مِنْ قَبْرِهَا
The Prophet ﷺ said: Forgive the infliction of prescribed penalties among yourselves, for any prescribed penalty of which I hear must be carried out. (Using translation from Abū Dāʾūd 4376)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ تَعَافَوَا الْحُدُودَ فِيمَا بَيْنَكُمْ فَمَا بَلَغَنِي مِنْ حَدٍّ فَقَدْ وَجَبَ
[Machine] A man from the Muslims came to Abdullah bin Mas'ud with his drunk nephew. He mentioned the hadith about how to punish him, then said to his uncle, "By Allah, he is indeed my nephew, and I have no children of my own. I feel for him the same way I feel for my own child. But I did not neglect goodness." Abdullah said, "Indeed, Allah is Forgiving and He loves forgiveness. However, it is not appropriate for a leader to implement a punishment without establishing it first." Then he began to narrate to us from the Prophet ﷺ, who said, "The first person to have his hand cut off among the Muslims was a man from the Ansar. The Prophet ﷺ was brought to him and he had committed theft. The Prophet ﷺ said, 'Go with your companion and cut off his hand.' It was as if the face of the Prophet ﷺ became visibly upset. Then he signaled with his hand to hide it and said, 'Some of the people seem to think that this is difficult for you.' He said, 'You should not be helpers of Satan or Iblis. It is not appropriate for a leader to implement a punishment without establishing it. Allah is Forgiving and He loves forgiveness.' Then he recited the verse: 'And let them pardon and overlook.' (Quran 24:22) This narration was mentioned to us by Aḥmad, through Abū Nuʿaym, through Sufyān, through Yahyá al-Jābir, through Abū Mājid, through Abdullah, from the Prophet ﷺ, with a similar wording."
جَاءَ رَجُلٌ مِنَ الْمُسْلِمِينَ بِابْنِ أَخٍ لَهُ وَهُوَ سَكْرَانُ يَعْنِي إِلَى عَبْدِ اللهِ بْنِ مَسْعُودٍ فَذَكَرَ الْحَدِيثَ فِي كَيْفِيَّةِ جَلْدِهِ قَالَ ثُمَّ قَالَ لِعَمِّهِ بِئْسَ لَعَمْرُ اللهِ وَالِي الْيَتِيمِ أَنْتَ مَا أَدَّبْتَ فَأَحْسَنْتَ الْأَدَبَ وَلَا سَتَرْتَ الْخِزْيَةَ فَقَالَ يَا أَبَا عَبْدِ الرَّحْمَنِ أَمَا وَاللهِ إِنَّهُ لَابْنُ أَخِي وَمَا لِي وَلَدٌ وَإِنِّي لَأَجِدُ لَهُ مِنَ اللَّوْعَةِ مَا أَجِدُ لِوَلَدِي وَلَكِنْ لَمْ آلُ عَنِ الْخَيْرِ فَقَالَ عَبْدُ اللهِ إِنَّ اللهَ عَفُوٌّ يُحِبُّ الْعَفْوَ وَلَكِنْ لَا يَنْبَغِي لِوَالِي أَمْرٍ أَنْ يُؤْتَى بِحَدٍّ إِلَّا أَقَامَهُ ثُمَّ أَنْشَأَ يُحَدِّثُنَا عَنْ نَبِيِّ اللهِ ﷺ قَالَ إِنَّ أَوَّلَ رَجُلٍ قُطِعَ مِنَ الْمُسْلِمِينَ رَجُلٌ مِنَ الْأَنْصَارِ أُتِيَ بِهِ نَبِيَّ اللهِ ﷺ سَرَقَ فَقَالَ اذْهَبُوا بِصَاحِبِكُمْ فَاقْطَعُوهُ وَكَأَنَّمَا أُسِفَّ وَجْهُ نَبِيِّ اللهِ ﷺ رَمَادًا ثُمَّ أَشَارَ بِيَدِهِ يُخْفِيهِ فَقَالَ بَعْضُ الْقَوْمِ كَأَنَّ هَذَا شَقَّ عَلَيْكَ فَقَالَ لَا يَنْبَغِي أَنْ تَكُونُوا أَعْوَانَ الشَّيْطَانِ أَوْ إِبْلِيسَ فَإِنَّهُ لَا يَنْبَغِي لِوَالِي أَمْرٍ أَنْ يُؤْتَى بِحَدٍّ إِلَّا أَقَامَهُ وَاللهُ عَفُوٌّ يُحِبُّ الْعَفْوَ ثُمَّ قَرَأَ {وَلْيَعْفُوا وَلْيَصْفَحُوا} [النور 22] الْآيَةَ قَالَ 17613 وَحَدَّثَنَا أَحْمَدُ أنبأ أَبُو نُعَيْمٍ ثنا سُفْيَانُ عَنْ يَحْيَى الْجَابِرِ عَنْ أَبِي مَاجِدٍ عَنْ عَبْدِ اللهِ عَنِ النَّبِيِّ ﷺ نَحْوَهُ
[Machine] He said, "Whoever commits a sin, let them come to us so that we may purify them." So, a group came to him and he struck them. Salman al-Farisi came to him, angry, and said, "Should we make repentance for you from Allah?" He replied, "No." He then said, "Then take the whip and do not uncover what Allah has covered for you." It has been narrated to us that 'Ikrima said, "Ammar ibn Yasir had his garment stolen. He identified the thief and left him." And 'Ikrima also said, "Ibn Abbas was brought a thief who had stolen from his slave. He gave him more and released him."
أَنَّهُ قَالَ مَنْ أَذْنَبَ ذَنْبًا فَلْيَأْتِنَا فُلْنُطَهِّرْهُ فَأَتَاهُ قَوْمٌ فَضَرَبَهُمْ فَأَتَاهُ سَلْمَانُ الْفَارِسِيُّ ؓ مُغْضَبًا فَقَالَ أَجَعَلَ اللهُ إِلَيْكَ مِنَ التَّوْبَةِ شَيْئًا؟ قَالَ لَا قَالَ فَأَلْقِ السَّوْطَ وَلَا تَهْتِكْ سِتْرًا سَتَرَهُ اللهُ وَرُوِّينَا عَنْ عِكْرِمَةَ أَنَّ عَمَّارَ بْنَ يَاسِرٍ ؓ سُرِقَتْ لَهُ عَيْبَةٌ فَدُلَّ عَلَى صَاحِبِهَا فَتَرَكَهُ وَعَنْ عِكْرِمَةَ قَالَ أُتِيَ ابْنُ عَبَّاسٍ بِسَارِقٍ سَرَقَ مِنْ مَوْلَاةٍ لَهُ فَزَوَّدَهُ وَأَرْسَلَهُ
[Machine] Ali said, "I gave you advice and you ignored it, and now you have both lost. If you are truthful, we will kill your son, and if your son is truthful, we will stone you." Then Ali got up to pray, and the boy said to his mother, "Don't you see that they will either kill me or stone you? Let's go." So, they left. After Ali finished praying, he asked about them, and it was said that they had left.
عَلِيٌّ ؓ خِبْتُمَا وَخَسِرْتُمَا إِنْ تَكُونِي صَادِقَةً نَقْتُلِ ابْنَكِ وَإِنْ يَكُنِ ابْنُكِ صَادِقًا نَرْجُمْكِ ثُمَّ قَامَ عَلِيٌّ ؓ لِلصَّلَاةِ فَقَالَ الْغُلَامُ لِأُمِّهِ مَا تَنْظُرِينَ أَنْ يَقْتُلَنِي أَوْ يَرْجُمَكِ فَانْصَرَفَا فَلَمَّا صَلَّى سَأَلَ عَنْهُمَا فَقِيلَ انْطَلَقَا
