57. Drinks
٥٧۔ كِتَابُ الْأَشْرِبَةِ وَالْحَدُّ فِيهَا
[Machine] "About this verse, 'You take from it (the bees) intoxication and a good provision' [An-Nahl 67], Al-Sakar (intoxication) refers to what is prohibited from its fruits, and Al-Rizq Al-Hasan (good provision) refers to what is permissible from its fruits."
عَنْ هَذِهِ الْآيَةِ {تَتَّخِذُونَ مِنْهُ سَكَرًا وَرِزْقًا حَسَنًا} [النحل 67] قَالَ السَّكَرُ مَا حُرِّمَ مِنْ ثَمَرَتِهَا وَالرِّزْقُ الْحَسَنُ مَا حَلَّ مِنْ ثَمَرَتِهَا
[Machine] In His saying, "{you take from it intoxication}" [An-Nahl 67], Allah prohibited intoxication after prohibiting alcohol because it is a form of it. He said, "{and good provision}" [An-Nahl 67], so it is permissible, such as vinegar, syrup, grape juice, and similar items. Allah affirmed it and made it permissible for Muslims. It has been narrated from Abu 'Ubaid that he said, "Intoxication is the soaking of dates." This is also indicated by the narration of Ibn Abi Talha from Ibn Abbas, which shows that it is included in the prohibition when alcohol was prohibited because it is a form of it.
فِي قَوْلِهِ {تَتَّخِذُونَ مِنْهُ سَكَرًا} [النحل 67] فَحَرَّمَ اللهُ بَعْدَ ذَلِكَ السَّكَرَ مَعَ تَحْرِيمِ الْخَمْرِ؛ لِأَنَّهُ مِنْهَا قَالَ {ورِزْقًا حَسَنًا} [النحل 67] فَهُوَ حَلَالُهُ مِنَ الْخَلِّ وَالرُّبِّ وَالنَّبِيذِ وَأَشْبَاهِ ذَلِكَ فَأَقَرَّهُ اللهُ وَجَعَلَهُ اللهُ حَلَالًا لِلْمُسْلِمِينَ وَقَدْ رُوِّينَا عَنْ أَبِي عُبَيْدٍ أَنَّهُ قَالَ السَّكَرُ نَقِيعُ التَّمْرِ وَعَلَيْهِ تَدُلُّ رِوَايَةُ ابْنِ أَبِي طَلْحَةَ عَنِ ابْنِ عَبَّاسٍ مَعَ الدَّلَالَةِ عَلَى دُخُولِهِ فِي التَّحْرِيمِ حِينَ حُرِّمَتِ الْخَمْرُ؛ لِأَنَّهُ مِنْهَا
[Machine] Sugar and alcohol are prohibited before they are forbidden, and good sustenance is its food.
السَّكَرُ الْخَمْرُ قَبْلَ تَحْرِيمِهَا وَالرِّزْقُ الْحَسَنُ طَعَامُهُ
[Machine] Ibrahim, Al-Sha'bi, and Abu Razin said about this verse "You take from it intoxication and good provision" [An-Nahl 67] it is abrogated.
عَنْ إِبْرَاهِيمَ وَالشَّعْبِيِّ وَأَبِي رَزِينٍ قَالُوا فِي هَذِهِ الْآيَةِ {تَتَّخِذُونَ مِنْهُ سَكَرًا وَرِزْقًا حَسَنًا} [النحل 67] هِيَ مَنْسُوخَةٌ
[Machine] Alcohol itself, in both small and large quantities, is prohibited, as well as any form of intoxication that may be found in any beverage. The mentioned intoxication refers to alcohol.
حُرِّمَتِ الْخَمْرُ بِعَيْنِهَا الْقَلِيلُ مِنْهَا وَالْكَثِيرُ وَالسَّكَرُ مِنْ كُلِّ شَرَابٍ وَالْمُرَادُ بِالسَّكَرِ الْمَذْكُورُ فِيهِ الْمُسْكِرُ
[Machine] The wine itself, in both small and large quantities, is forbidden, as well as any intoxicating drink. Abu Abdullah informed us that the teacher Abu Al-Walid Hassan bin Muhammad narrated to us that Abdullah bin Muhammad Al-Bagawi narrated to us that Ahmad bin Hanbal mentioned it with its chain of transmission, except that he did not mention "small and large quantities" like that.
حُرِّمَتِ الْخَمْرُ بِعَيْنِهَا قَلِيلُهَا وَكَثِيرُهَا وَالْمُسْكِرُ مِنْ كُلِّ شَرَابٍ 17406 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ ثنا الْأُسْتَاذُ أَبُو الْوَلِيدِ حَسَّانُ بْنُ مُحَمَّدٍ أَمْلَاهُ عَلَيْنَا ثنا عَبْدُ اللهِ بْنُ مُحَمَّدٍ الْبَغَوِيُّ ثنا أَحْمَدُ بْنُ حَنْبَلٍ فَذَكَرَهُ بِإِسْنَادِهِ إِلَّا أَنَّهُ لَمْ يَقُلْ قَلِيلُهَا وَكَثِيرُهَا وَكَذَلِكَ
The Prophet ﷺ said: If a large amount of anything causes intoxication, a small amount of it is prohibited. (Using translation from Abū Dāʾūd 3681)
قَلِيلُ مَا أَسْكَرَ كَثِيرُهُ حَرَامٌ
اشْرَبُوا وَلَا تَسْكَرُوا فَكَذَا
"The Prophet ﷺ had fixed the Mawaqit as follows: (No. 603) (Using translation from Bukhārī 1527)
عَنْ أَبِيهِ
I had forbidden you from the preparation of Nabidh except in a waterskin. But now you may drink in all vessels, but do not drink what is intoxicant. (Using translation from Muslim 977c)
قَالَ رَسُولُ اللهِ ﷺ نَهَيْتُكُمْ عَنِ النَّبِيذِ إِلَّا فِي سِقَاءٍ فَاشْرَبُوا فِي الْأَسْقِيَةِ كُلِّهَا وَلَا تَشْرَبُوا مُسْكِرًا
[Machine] Every intoxicant is prohibited. It is the drink that intoxicates you.
كُلُّ مُسْكِرٍ حَرَامٌ هِيَ الشَّرْبَةُ الَّتِي تُسْكِرُكَ
أَنْ يَعُودَ فِيهِ
[Machine] Zakariya ibn Adi said, when Ibn al-Mubarak arrived in Kufa, he was sick. Waki' and our companions, along with the people of Kufa, visited him and had a discussion with him until it was time for a drink. Ibn al-Mubarak began to present the narrations of the Messenger of Allah ﷺ, his companions, the Muhajirun, and the Ansar from the people of Madinah. They said, "No, but rather from our narrations." Ibn al-Mubarak then mentioned that Al-Hasan ibn 'Amr al-Fuqaymi narrated from Fudail ibn 'Amr, who narrated from Ibrahim, who said, "They used to say that if someone was intoxicated from a drink, it was forbidden for them to ever drink it again, so they would pour it over their heads." Ibn al-Mubarak said to the one who followed him, "Did you see how amazing these people are? I spoke to them about the Messenger of Allah ﷺ, his companions, and the followers, but they did not care. And I mentioned what Ibrahim said, and they poured the drink over their heads."
قَالَ زَكَرِيَّا بْنُ عَدِيٍّ لَمَّا قَدِمَ ابْنُ الْمُبَارَكِ الْكُوفَةَ كَانَتْ بِهِ عِلَّةٌ فَأَتَاهُ وَكِيعٌ وَأَصْحَابُنَا وَالْكُوفِيُّونَ فَتَذَاكَرُوا عِنْدَهُ حَتَّى بَلَغُوا الشَّرَابَ فَجَعَلَ ابْنُ الْمُبَارَكِ يَحْتَجُّ بِأَحَادِيثِ رَسُولِ اللهِ ﷺ وَأَصْحَابِ النَّبِيِّ ﷺ وَالْمُهَاجِرِينَ وَالْأَنْصَارِ مِنْ أَهْلِ الْمَدِينَةِ قَالُوا لَا وَلَكِنْ مِنْ حَدِيثِنَا فَقَالَ ابْنُ الْمُبَارَكِ أنبأ الْحَسَنُ بْنُ عَمْرٍو الْفُقَيْمِيُّ عَنْ فُضَيْلِ بْنِ عَمْرٍو عَنْ إِبْرَاهِيمَ قَالَ كَانُوا يَقُولُونَ إِذَا سَكِرَ مِنْ شَرَابٍ لَمْ يَحِلَّ لَهُ أَنْ يَعُودَ فِيهِ أَبَدًا فَنَكَّسُوا رُءُوسَهُمْ فَقَالَ ابْنُ الْمُبَارَكِ لِلَّذِي يَلِيهِ رَأَيْتَ أَعْجَبَ مِنْ هَؤُلَاءِ أُحَدِّثُهُمْ عَنْ رَسُولِ اللهِ ﷺ وَعَنْ أَصْحَابِهِ وَالتَّابِعِينَ فَلَمْ يَعْبَئُوا بِهِ وَأَذْكُرُ عَنْ إِبْرَاهِيمَ فَنَكَّسُوا رُءُوسَهُمْ؟
