57. Drinks
٥٧۔ كِتَابُ الْأَشْرِبَةِ وَالْحَدُّ فِيهَا
[Machine] "That the Messenger of Allah ﷺ did not set a limit for drinking wine. Ibn 'Abbas said that a man drank wine and got drunk, so he was brought leaning towards the dawn and taken to the Prophet ﷺ . When he reached the house of al-'Abbas, he slipped away and entered the house of al-'Abbas. He held onto him, and that was mentioned to the Prophet ﷺ , so he laughed and said, 'He did it.' Then he did not command anything regarding him." 17510 Abu 'Ali al-Rudhbari informed us, Abu Bakr bin Dasa narrated to us, Abu Dawud narrated to us, al-Hasan bin 'Ali and Muhammad bin al-Muthanna mentioned it in the same way, except that he said, 'He did not seize him.' Abu Dawud said, 'This hadith is from the distinctive narrations of the people of Madinah.' 17511 Abu 'Abdullah al-Hafiz informed us, al-Hasan bin Muhammad al-Isfirayini narrated to us, Muhammad bin Ahmad bin al-Bara said, 'Ali bin al-Madinini was asked about Muhammad bin 'Ali bin Rukana who narrated this hadith from 'Ikrimah, so he said, 'He is unidentified.' The sheikh said, 'And Muhammad bin Ishaq bin Yasir narrated the meaning of this hadith from Muhammad bin Talhah bin Yazid bin Rukana.'"
أَنَّ رَسُولَ اللهِ ﷺ لَمْ يُوَقِّتْ فِي الْخَمْرِ حَدًّا قَالَ ابْنُ عَبَّاسٍ فَشَرِبَ رَجُلٌ فَسَكِرَ فَلُقِيَ يَمِيلُ فِي الْفَجِّ فَانْطُلِقَ بِهِ إِلَى النَّبِيِّ ﷺ فَلَمَّا حَاذَى بِدَارِ الْعَبَّاسِ انْفَلَتَ فَدَخَلَ عَلَى الْعَبَّاسِ فَالْتَزَمَهُ فَذُكِرَ ذَلِكَ لِلنَّبِيِّ ﷺ فَضَحِكَ وَقَالَ فَعَلَهَا ثُمَّ لَمْ يَأْمُرْ فِيهِ بِشَيْءٍ 17510 وَأَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنبأ أَبُو بَكْرِ بْنُ دَاسَةَ ثنا أَبُو دَاوُدَ ثنا الْحَسَنُ بْنُ عَلِيٍّ وَمُحَمَّدُ بْنُ الْمُثَنَّى فَذَكَرَهُ بِنَحْوِهِ إِلَّا أَنَّهُ قَالَ لَمْ يَقِتْ قَالَ أَبُو دَاوُدَ هَذَا الْحَدِيثُ مِمَّا تَفَرَّدَ بِهِ أَهْلُ الْمَدِينَةِ 17511 أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أَنْبَأَ الْحَسَنُ بْنُ مُحَمَّدٍ الْإِسْفِرَايِينِيُّ ثنا مُحَمَّدُ بْنُ أَحْمَدَ بْنِ الْبَرَاءِ قَالَ سُئِلَ عَلِيُّ بْنُ الْمَدِينِيِّ عَنْ مُحَمَّدِ بْنِ عَلِيِّ بْنِ رُكَانَةَ الَّذِي رَوَى هَذَا الْحَدِيثَ عَنْ عِكْرِمَةَ فَقَالَ مَجْهُولٌ قَالَ الشَّيْخُ وَقَدْ رَوَى مَعْنَى هَذَا الْحَدِيثِ مُحَمَّدُ بْنُ إِسْحَاقَ بْنِ يَسَارٍ عَنْ مُحَمَّدِ بْنِ طَلْحَةَ بْنِ يَزِيدَ بْنِ رُكَانَةَ
[Machine] The Messenger of Allah ﷺ did not strike anyone for drinking alcohol except in the end. He went on the expedition of Tabuk and his room was visited at night by Abu 'Alqamah ibn Al-A'war Al-Sulami, who was drunk. Abu 'Alqamah accidentally tore some of the curtains of the room. The Messenger of Allah ﷺ asked, "Who is this?" and he was told that it was Abu 'Alqamah who was drunk. The Messenger of Allah ﷺ said, "Let someone from among you go to him and hold his hand until he is taken back to his camp." It is correct according to the words of Ibn Abbas that the Prophet did not prescribe a specific punishment for drinking alcohol, meaning that he did not mention it explicitly, but he established it in practice. This incident is mentioned, and Allah knows best, because it was not brought up for him after entering the house of Al-Abbas, as it was not firmly established upon him through his admission or the testimony of witnesses. Rather, it happened on the way, and he leaned over, so he was thought to be drunk, but the Prophet did not expose him and left him. Allah knows best.
مَا ضَرَبَ رَسُولُ اللهِ ﷺ فِي الْخَمْرِ إِلَّا أَخِيرًا لَقَدْ غَزَا غَزْوَةَ تَبُوكَ فَغَشِيَ حُجْرَتَهُ مِنَ اللَّيْلِ أَبُو عَلْقَمَةَ بْنُ الْأَعْوَرِ السُّلَمِيُّ وَهُوَ سَكْرَانُ حَتَّى قَطَعَ بَعْضَ عُرَى الْحُجْرَةِ فَقَالَ مَنْ هَذَا؟ فَقِيلَ أَبُو عَلْقَمَةَ سَكْرَانُ فَقَالَ رَسُولُ اللهِ ﷺ لِيَقُمْ إِلَيْهِ رَجُلٌ مِنْكُمْ فَلْيَأْخُذْ بِيَدِهِ حَتَّى يَرُدَّهُ إِلَى رَحْلِهِ وَهَذَا إِنْ صَحَّ فَقَوْلُ ابْنِ عَبَّاسٍ لَمْ يَقِتْ فِي الْخَمْرِ حَدًّا يَعْنِي لَمْ يُوَقِّتْهُ لَفْظًا وَقَدْ وَقَّتَهُ فِعْلًا وَذَلِكَ يُرَدُّ وَإِنَّمَا لَمْ يَعْرِضْ لَهُ وَاللهُ أَعْلَمُ بَعْدَ دُخُولِهِ دَارَ الْعَبَّاسِ مِنْ أَجْلِ أَنَّهُ لَمْ يَكُنْ ثَبَتَ عَلَيْهِ الْحَدُّ بِإِقْرَارٍ مِنْهُ أَوْ بِشَهَادَةِ عُدُولٍ وَإِنَّمَا لُقِيَ فِي الطَّرِيقِ يَمِيلُ فَظُنَّ بِهِ السُّكْرُ فَلَمْ يَكْشِفْ عَنْهُ وَتَرَكَهُ وَاللهُ أَعْلَمُ
أَنَّهُ حَضَرَهُ يَحُدُّهُمْ
[Machine] Ata said, "Verily, the wind can be made from a beverage that is not harmful, so if they all gather together over one drink and one of them becomes intoxicated, then they should all be given the full punishment. Al-Shafi'i said, and the statement of Ata is like the statement of Umar ibn al-Khattab."
عَطَاءٌ إِنَّ الرِّيحَ لَتَكُونُ مِنَ الشَّرَابِ الَّذِي لَيْسَ بِهِ بَأْسٌ فَإِذَا اجْتَمَعُوا جَمِيعًا عَلَى شَرَابٍ وَاحِدٍ فَسَكِرَ أَحَدُهُمْ جُلِدُوا جَمِيعًا الْحَدَّ تَامًّا قَالَ الشَّافِعِيُّ وَقَوْلُ عَطَاءٍ مِثْلُ قَوْلِ عُمَرَ بْنِ الْخَطَّابِ ؓ
[Machine] Abdullah said, "I was sitting in Hims and they told me to read, so I recited Surah Yusuf. A man from the people said, 'By Allah, this is not how Allah revealed it.' So I said, 'Woe to you, I have recited it to the Messenger of Allah ﷺ .' He said, 'Well done, and you are saying to me what you are saying.' Then, while I was talking to him, I smelled the odor of alcohol from him. So I said, 'You deny the Book of Allah and drink alcohol? By Allah, you will not return to your family until you receive the punishment.' It was mentioned in the authentic narration of Al-A'mash. It is also possible that Abdullah bin Mas'ood did not whip him until it was proven to him that he had consumed enough to become intoxicated, either through clear evidence or confession. And Allah knows best."
قَالَ عَبْدُ اللهِ كُنْتُ جَالِسًا بِحِمْصَ فَقَالُوا لِي اقْرَأْ فَقَرَأْتُ سُورَةَ يُوسُفَ فَقَالَ رَجُلٌ مِنَ الْقَوْمِ وَاللهِ مَا هَكَذَا أَنْزَلَهَا اللهُ ﷻ فَقَالَ فَقُلْتُ وَيْحَكَ لَقَدْ قَرَأْتُهَا عَلَى رَسُولِ اللهِ ﷺ فَقَالَ أَحْسَنْتَ وَأَنْتَ تَقُولُ لِي مَا تَقُولُ قَالَ فَبَيْنَا أَنَا أُكَلِّمُهُ إِذْ وَجَدْتُ مِنْهُ رِيحَ الْخَمْرِ فَقُلْتُ تُكَذِّبُ بِكِتَابِ اللهِ ﷻ وَتَشْرَبُ الْخَمْرَ أَمَا وَاللهِ لَا تَرْجِعُ إِلَى أَهْلِكَ حَتَّى أَجْلِدَكَ الْحَدَّ أَخْرَجَاهُ فِي الصَّحِيحِ مِنْ حَدِيثِ الْأَعْمَشِ وَيُحْتَمَلُ أَنَّ عَبْدَ اللهِ بْنَ مَسْعُودٍ لَمْ يَجْلِدْهُ حَتَّى ثَبَتَ عِنْدَهُ شُرْبُهُ مَا يُسْكِرُ بِبَيِّنَةٍ أَوِ اعْتِرَافٍ وَاللهُ أَعْلَمُ
[Machine] O commander of the faithful, Qudamah drank and got intoxicated, and I witnessed him committing an act that is truly against the limits set by Allah, so it is my duty to report it to you. Umar asked, "Who witnessed this with you?" He replied, "Abu Hurairah." So Umar called Abu Hurairah and asked, "Why did you witness this?" Abu Hurairah answered, "I did not see him drink, but I saw him intoxicated and vomiting." Umar said, "You have taken a hasty decision in giving testimony." Then he wrote a letter to Qudamah, instructing him to come to him from Bahrain. Qudamah came and Garud came to him and said, "Abide by the Book of Allah." Umar said, "Are you his opponent or a witness?" Garud replied, "I am a witness." Umar said, "Then you have given your testimony." Garud remained quiet until he came to Umar. Umar said to him, "Abide by the limits set by Allah." Umar said, "I see no one except you as an opponent, and there was no one who witnessed with you except one man." Garud said, "I bear witness to Allah that if you do not hold your tongue, I will harm you." Abu Hurairah said, "If you doubt our testimony, send a message to the daughter of Al-Walid and ask her. She is the wife of Qudamah." So Umar sent a message to Hind bint Al-Walid to testify, and she confirmed the testimony against her husband. Umar said to Qudamah, "I am against you." Qudamah replied, "If I had drunk as people say, you would not have punished me." Umar asked, "Why?" Qudamah said, "Allah says: 'There is no sin upon those who believe and do righteous deeds for what they have eaten.'" Umar said, "You have interpreted it wrong. If you fear Allah, you would have abstained from what Allah has prohibited for you." Then Umar turned to the people and asked, "What do you think about punishing Qudamah?" They said, "We do not think he should be punished as he was sick." Umar remained silent on the matter for some time. Then one day he decided to punish him and asked his companions, "What do you think about punishing Qudamah?" The people said, "We do not think he should be punished as long as he is in pain." Umar said, "I would prefer to meet Allah under the whip than meet Him with it on my back. Bring me a full whip." So Umar ordered for Qudamah to be whipped. Umar was angry with Qudamah and did not speak to him for a while. Later, when they finished their Hajj, Umar went to As-Suqya and woke up from his sleep and said, "Hurry up and bring me Qudamah." So they came to him, but he refused to go. Umar ordered him to be brought to him. If he refused to be dragged, Umar addressed him and sought forgiveness for him. This was their first reconciliation in the beginning of this incident, which indicates that Umar did not completely accept their testimony as they did not agree on his drinking. When Umar punished Qudamah, it is likely that he was convinced of his drinking either by his confession or the testimony of others along with Garud.
يَا أَمِيرَ الْمُؤْمِنِينَ إِنَّ قُدَامَةَ شَرِبَ فَسَكِرَ وَإِنِّي رَأَيْتُ حَدًّا مِنْ حُدُودِ اللهِ حَقًّا عَلَيَّ أَنْ أَرْفَعَهُ إِلَيْكَ فَقَالَ عُمَرُ ؓ مَنْ شَهِدَ مَعَكَ؟ قَالَ أَبُو هُرَيْرَةَ فَدَعَا أَبَا هُرَيْرَةَ فَقَالَ بِمَ تَشْهَدُ؟ فَقَالَ لَمْ أَرَهُ شَرِبَ وَلَكِنِّي رَأَيْتُهُ سَكْرَانَ يَقِيءُ فَقَالَ عُمَرُ ؓ لَقَدْ تَنَطَّعْتَ فِي الشَّهَادَةِ قَالَ ثُمَّ كَتَبَ إِلَى قُدَامَةَ أَنْ يَقْدَمَ عَلَيْهِ مِنَ الْبَحْرَيْنِ فَقَدِمَ فَقَامَ إِلَيْهِ الْجَارُودُ فَقَالَ أَقِمْ عَلَى هَذَا كِتَابَ اللهِ فَقَالَ عُمَرُ ؓ أَخَصْمٌ أَنْتَ أَمْ شَهِيدٌ؟ قَالَ بَلْ شَهِيدٌ قَالَ فَقَدْ أَدَّيْتَ الشَّهَادَةَ فَصَمَتَ الْجَارُودُ حَتَّى غَدَا عَلَى عُمَرَ فَقَالَ أَقِمْ عَلَى هَذَا حَدَّ اللهِ فَقَالَ عُمَرُ ؓ مَا أَرَاكَ إِلَّا خَصْمًا وَمَا شَهِدَ مَعَكَ إِلَّا رَجُلٌ فَقَالَ الْجَارُودُ إِنِّي أَنْشُدُكَ اللهَ فَقَالَ عُمَرُ لَتُمْسِكَنَّ لِسَانَكَ أَوْ لَأَسُوءَنَّكَ فَقَالَ أَبُو هُرَيْرَةَ إِنْ كُنْتَ تَشُكُّ فِي شَهَادَتِنَا فَأَرْسِلْ إِلَى ابْنَةِ الْوَلِيدِ فَاسْأَلْهَا وَهِيَ امْرَأَةُ قُدَامَةَ فَأَرْسَلَ عُمَرُ إِلَى هِنْدَ بِنْتِ الْوَلِيدِ يَنْشُدُهَا فَأَقَامَتِ الشَّهَادَةَ عَلَى زَوْجِهَا فَقَالَ عُمَرُ لِقُدَامَةَ إِنِّي حَادُّكَ فَقَالَ لَوْ شَرِبْتُ كَمَا يَقُولُونَ مَا كَانَ لَكُمْ تَجْلِدُونِي فَقَالَ عُمَرُ ؓ لِمَ؟ قَالَ قُدَامَةُ قَالَ اللهُ ﷻ {لَيْسَ عَلَى الَّذِينَ آمَنُوا وَعَمِلُوا الصَّالِحَاتِ جُنَاحٌ فِيمَا طَعِمُوا} [المائدة 93] الْآيَةَ قَالَ عُمَرُ ؓ أَخْطَأْتَ التَّأْوِيلَ إِنِ اتَّقَيْتَ اللهَ اجْتَنَبْتَ مَا حَرَّمَ اللهُ عَلَيْكَ قَالَ ثُمَّ أَقْبَلَ عُمَرُ ؓ عَلَى النَّاسِ فَقَالَ مَاذَا تَرَوْنَ فِي جَلْدِ قُدَامَةَ قَالُوا لَا نَرَى أَنْ تَجْلِدَهُ مَا كَانَ مَرِيضًا فَسَكَتَ عَنْ ذَلِكَ أَيَّامًا ثُمَّ أَصْبَحَ يَوْمًا وَقَدْ عَزَمَ عَلَى جَلْدِهِ فَقَالَ لِأَصْحَابِهِ مَا تَرَوْنَ فِي جَلْدِ قُدَامَةَ فَقَالَ الْقَوْمُ مَا نَرَى أَنْ تَجْلِدَهُ مَا دَامَ وَجِعًا فَقَالَ عُمَرُ ؓ لَأَنْ يَلْقَى اللهَ ﷻ تَحْتَ السِّيَاطِ أَحَبُّ إِلِيَّ مِنْ أَنْ يَلْقَاهُ وَهُوَ فِي عُنُقِي ائْتُونِي بِسَوْطٍ تَامٍّ فَأَمَرَ عُمَرُ ؓ بِقُدَامَةَ فَجُلِدَ فَغَاضَبَ عُمَرُ ؓ قُدَامَةَ فَهَجَرَهُ فَحَجَّ وَحَجَّ قُدَامَةُ مَعَهُ مُغَاضِبًا لَهُ فَلَمَّا قَفَلَا مِنْ حَجِّهِمَا وَنَزَلَ عُمَرُ بِالسُّقْيَا وَاسْتَيْقَظَ عُمَرُ مِنْ نَوْمِهِ فَقَالَ عَجِّلُوا عَلَيَّ بِقُدَامَةَ فَأْتُونِي بِهِ فَوَاللهِ إِنِّي لَأَرَى أَنَّ آتِيًا أَتَانِي فَقَالَ سَالِمْ قُدَامَةَ فَإِنِّي أَخُوكَ فَعَجِّلُوا إِلِيَّ بِهِ فَلَمَّا أَتَوْهُ أَبَى أَنْ يَأْتِيَ فَأَمَرَ بِهِ عُمَرُ ؓ إِنْ أَبَى أَنْ يُجَرَّ إِلَيْهِ حَتَّى كَلَّمَهُ وَاسْتَغْفَرَ لَهُ وَكَانَ ذَلِكَ أَوَّلَ صُلْحِهِمَا فِي ابْتِدَاءِ هَذِهِ الْقِصَّةِ مَا دَلَّ عَلَى أَنَّ عُمَرَ ؓ تَوَقَّفَ فِي قَبُولِ شَهَادَتِهِمَا حَيْثُ لَمْ يَجْتَمِعَا عَلَى شُرْبِهِ وَحِينَ حَدَّهُ يُحْتَمَلُ أَنْ يَكُونَ ثَبَتَ عِنْدَهُ شُرْبُهُ بِإِقْرَارِهِ أَوْ شَهَادَةِ آخَرَ عَلَى شُرْبِهِ مَعَ الْجَارُودِ
[Machine] "When Jaruud came to Umar, he mentioned a hadith and Umar said, 'O Amirul Mu'minin, have you employed someone to drink alcohol?' Jaruud answered, 'Abu Hurairah is my witness.' Al-Ansari said, 'Your circumcision, your circumcision.' Umar asked, 'And who witnessed this?' Al-Aqrama replied, 'They both witnessed it.' Umar then said to Jaruud, 'By Allah, I will lash you with a whip.' Jaruud asked him, 'What is the justice in you drinking and me being whipped?' Umar asked, 'And who witnessed this?' Al-Aqrama said, 'Alqamah and his companions testified to it.' Umar ordered him to be whipped and said, 'I have not allowed anyone to disobey me since I was appointed, so I will not be blessed with it. Go, and lash him.'"
أَنَّ الْجَارُودَ لَمَّا قَدِمَ عَلَى عُمَرَ ؓ فَذَكَرَ الْحَدِيثَ قَالَ فَقَالَ يَا أَمِيرَ الْمُؤْمِنِينَ اسْتَعْمَلْتَ عَلَيْنَا مَنْ يَشْرَبُ الْخَمْرَ قَالَ وَمَنْ شُهُودُكَ؟ قَالَ أَبُو هُرَيْرَةَ قَالَ خَتَنُكَ خَتَنُكَ قَالَ الْأَنْصَارِيُّ وَكَانَتْ أُخْتُ الْجَارُودِ تَحْتَ أَبِي هُرَيْرَةَ قَالَ أَمَا وَاللهِ لَأُوجِعَنَّ مَتْنَهُ بِالسَّوْطِ قَالَ فَقَالَ لَهُ مَا ذَاكَ فِي الْحَقِّ أَنْ يَشْرَبَ خَتَنُكَ وَتَجْلِدَ خَتَنِي قَالَ وَمَنْ؟ قَالَ عَلْقَمَةُ فَشَهِدُوا عِنْدَهُ فَأَمَرَ بِجِلْدِهِ وَقَالَ مَا حَابَيْتُ فِي إِمَارَتِي أَحَدًا مُنْذُ وُلِّيتُ غَيْرَهُ فَمَا بُورِكَ لِي فِيهِ اذْهَبُوا فَاجْلِدُوهُ
[Machine] Allah, may He be exalted, did not vomit it until he drank it, so he said to Ali, "Give him the punishment." Ali said to Al-Hasan, "Give him the punishment." The one who leads her team grabbed her whip, and Ali took it and whipped him. Ali kept counting, and when it reached forty, he said, "The Prophet ﷺ whipped him forty times, I count them." And Abu Bakr whipped him forty times, and Umar eighty times, and each one is a sunnah, and this is dearer to me.
اللهُ عَنْهُ إِنَّهُ لَمْ يَتَقَيَّأْهَا حَتَّى شَرِبَهَا فَقَالَ لِعَلِيٍّ ؓ أَقِمْ عَلَيْهِ الْحَدَّ فَقَالَ عَلِيٌّ لِلْحَسَنِ ؓ أَقِمْ عَلَيْهِ الْحَدَّ فَقَالَ وَلِّ حَارَّهَا مَنْ تَوَلَّى قَارَّهَا فَقَالَ عَلِيٌّ ؓ لِعَبْدِ اللهِ بْنِ جَعْفَرٍ أَقِمْ عَلَيْهِ الْحَدَّ قَالَ فَأَخَذَ السَّوْطَ فَجَلَدَهُ وَعَلِيٌّ ؓ يَعُدُّ فَلَمَّا بَلَغَ أَرْبَعِينَ قَالَ حَسْبُكَ جَلَدَ النَّبِيُّ ﷺ أَرْبَعِينَ أَحْسَبُهُ قَالَ وَجَلَدَ أَبُو بَكْرٍ ؓ أَرْبَعِينَ وَعُمَرُ ؓ ثَمَانِينَ وَكُلٌّ سُنَّةٌ وَهَذَا أَحَبُّ إِلِيَّ
