57. Drinks
٥٧۔ كِتَابُ الْأَشْرِبَةِ وَالْحَدُّ فِيهَا
[Machine] Aisha, the wife of the Prophet ﷺ, said: The Messenger of Allah ﷺ said: Every intoxicating drink is forbidden. This is narrated in the hadith of Al-Shafi'i, may Allah have mercy on him, and in the narration of Al-Muḥarriymi, he said: Aisha narrated from the Prophet ﷺ, who said: Every intoxicant is forbidden.
عَنْ عَائِشَةَ زَوْجِ النَّبِيِّ ﷺ قَالَتْ قَالَ رَسُولُ اللهِ ﷺ كُلُّ شَرَابٍ أَسْكَرَ فَهُوَ حَرَامٌ لَفْظُ حَدِيثِ الشَّافِعِيِّ رَحِمَهُ اللهُ وَفِي رِوَايَةِ الْمُخَرِّمِيِّ قَالَ عَنْ عَائِشَةَ عَنِ النَّبِيِّ ﷺ قَالَ كُلُّ مُسْكِرٍ حَرَامٌ
Every intoxicant is Khamr and every intoxicant is forbidden. He who drinks wine in this world and dies while he is addicted to it, not having repented, will not be given a drink in the Hereafter. (Using translation from Muslim 2003a)
أَنَّ النَّبِيَّ ﷺ قَالَ كُلُّ مُسْكِرٍ خَمْرٌ وَكُلُّ مُسْكِرٍ حَرَامٌ وَمَنْ شَرِبَ الْخَمْرَ فِي الدُّنْيَا فَمَاتَ وَهُوَ يُدْمِنُهَا لَمْ يَتُبْ مِنْهَا لَمْ يَشْرَبْهَا فِي الْآخِرَةِ
[Machine] From the Prophet ﷺ , he said: "Every intoxicant is wine, and every intoxicant is forbidden."
عَنِ النَّبِيِّ ﷺ قَالَ كُلُّ مُسْكِرٍ خَمْرٌ وَكُلُّ مُسْكِرٍ حَرَامٌ
[Machine] Narrated by the Prophet ﷺ , "Every intoxicant is wine, and every wine is prohibited."
عَنِ النَّبِيِّ ﷺ قَالَ كُلُّ مُسْكِرٍ خَمْرٌ وَكُلُّ خَمْرٍ حَرَامٌ
[Machine] The Messenger of Allah ﷺ said, "Every intoxicant is wine, and every intoxicant is prohibited." Ahmad said, "This is how Rawh narrated it to us, from an elevated chain of transmission."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ كُلُّ مُسْكِرٍ خَمْرٌ وَكُلُّ مُسْكِرٍ حَرَامٌ قَالَ أَحْمَدُ هَكَذَا حَدَّثَنَا بِهِ رَوْحٌ مَرْفُوعًا
[Machine] He said, "Every intoxicant is wine, and every intoxicant is forbidden (haram)."
أَنَّهُ قَالَ كُلُّ مُسْكِرٍ خَمْرٌ وَكُلُّ مُسْكِرٍ حَرَامٌ كَذَا
Give good tidings to the (people). and make things easy (for them), teach (them), and do not repel (them) ; and I think he also said: Cooperate cheerfully with each other. When he (the Holy Prophet) turned his back, Abu Musa returned to him and said: Messenger of Allah, they (the people of Yemen) have a drink which is (made) from honey and which is prepared by cooking it until it coagulates, and Mizr is prepared from barley, whereupon Messenger of Allah ﷺ said: Every intoxicant that detains you from prayer is forbidden. أَنَّ النَّبِيَّ ﷺ بَعَثَهُ وَمُعَاذًا إِلَى الْيَمَنِ فَقَالَ لَهُمَا بَشِّرَا وَيَسِّرَا وَعَلِّمَا وَلَا تُنَفِّرَا وَأُرَاهُ قَالَ وَتَطَاوَعَا قَالَ فَلَمَّا وَلَّى رَجَعَ أَبُو مُوسَى فَقَالَ يَا رَسُولَ اللهِ إِنَّ لَهُمْ شَرَابًا مِنَ الْعَسَلِ يُطْبَخُ وَالْمِزْرَ يُصْنَعُ مِنَ الشَّعِيرِ فَقَالَ رَسُولُ اللهِ ﷺ كُلُّ مَا أَسْكَرَ عَنِ الصَّلَاةِ فَهُوَ حَرَامٌ
[Machine] The permissible and wholesome drink is not the forbidden and filthy one.
الشَّرَابُ الْحَلَالُ الطَّيِّبُ لَا الْحَرَامُ الْخَبِيثُ
[Machine] The Messenger of Allah ﷺ reached the Baathiq and anything that can intoxicate is haram. I said, "Inform me, may Allah have mercy on you, about the Baathiq, as we drink it." He said, "Muhammad ﷺ reached the Baathiq and anything that can intoxicate is haram." A man from the people said, "We ferment grapes and then cook it until it becomes halal and good." He ﷺ said, "Glory be to Allah, glory be to Allah. Drink what is halal and good, for there is nothing after what is halal and good except what is haram and wicked."
سَبَقَ رَسُولُ اللهِ ﷺ إِلَى الْبَاذَقِ مَا أَسْكَرَ فَهُوَ حَرَامٌ قَالَ قُلْتُ أَفْتِنِي رَحِمَكَ اللهُ فِي الْبَاذَقِ وَإِنَّا نَشْرَبُهُ قَالَ سَبَقَ مُحَمَّدٌ ﷺ إِلَى الْبَاذَقِ وَمَا أَسْكَرَ فَهُوَ حَرَامٌ قَالَ رَجُلٌ مِنَ الْقَوْمِ إِنَّا نَعْمِدُ إِلَى الْعِنَبِ فَنَعْصِرُهُ ثُمَّ نَطْبُخُهُ حَتَّى يَكُونَ حَلَالًا طَيِّبًا قَالَ سُبْحَانَ اللهِ سُبْحَانَ اللهِ اشْرَبِ الْحَلَالَ الطَّيِّبَ فَإِنَّهُ لَيْسَ بَعْدَ الْحَلَالِ الطَّيِّبِ إِلَّا الْحَرَامُ الْخَبِيثُ
[Machine] For it is not permissible to sell it, buy it, or trade in it for a Muslim. The example of anyone amongst you who does that is like that of the people of Israel when they were forbidden to eat fat, so they sold it and ate its price. Then they asked about the paint, and Ibn 'Abbas said: "What is your paint?" When you ask me, explain to me what you are asking me about. They said: "It is grapes that are squeezed and cooked, then put in a wine-skin." He said: "What is the wine-skin?" They said: "A container made of animal skin." He said: "Is it smeared? They said: "Yes." He said: "Does it intoxicate?" They said: "When a lot of it is consumed, it does intoxicate." He said: "Then every intoxicant is forbidden."
فَإِنَّهُ لَا يَصْلُحُ بَيْعُهُ وَلَا شِرَاؤُهُ وَلَا التِّجَارَةُ فِيهِ لِمُسْلِمٍ إِنَّمَا مَثَلُ مَنْ فَعَلَ ذَلِكَ مِنْكُمْ مَثَلُ بَنِي إِسْرَائِيلَ حُرِّمَتْ عَلَيْهِمُ الشُّحُومُ فَلَمْ يَأْكُلُوهَا فَبَاعُوهَا وَأَكَلُوا أَثْمَانَهَا ثُمَّ سَأَلُوا عَنِ الطِّلَاءِ فَقَالَ ابْنُ عَبَّاسٍ وَمَا طِلَاؤُكُمْ هَذَا؟ إِذَا سَأَلْتُمُونِي فَبَيِّنُوا لِيَ الَّذِي تَسْأَلُونِي عَنْهُ قَالُوا هُوَ الْعِنَبُ يُعْصَرُ ثُمَّ يُطْبَخُ ثُمَّ يُجْعَلُ فِي الدِّنَانِ قَالَ وَمَا الدِّنَانُ؟ قَالُوا دِنَانٌ مُقَيَّرَةٌ قَالَ مُزَفَّتَةٌ؟ فَقَالُوا نَعَمْ قَالَ أَيُسْكِرُ؟ قَالُوا إِذَا أُكْثِرَ مِنْهُ أَسْكَرَ قَالَ فَكُلُّ مُسْكِرٍ حَرَامٌ
[Machine] Indeed, the fire does not make anything permissible or forbidden.
إِنَّ النَّارَ لَا تُحِلُّ شَيْئًا وَلَا تُحَرِّمُهُ
[Machine] That Abu Muslim Al-Khawlanee performed Hajj and went to visit Aisha, the wife of the Prophet Muhammad ﷺ . She asked him about Sham (Syria) and its cold weather, and he informed her about it. She then asked him, "How do you bear its cold?" He replied, "O Mother of the Believers, they drink a drink called tilla', and she said, "Allah spoke the truth, and convey my love. I heard my beloved, the Messenger of Allah ﷺ , saying that some people from my nation will drink alcohol but call it by other names."
أَنَّ أَبَا مُسْلِمٍ الْخَوْلَانِيَّ حَجَّ فَدَخَلَ عَلَى عَائِشَةَ زَوْجِ النَّبِيِّ ﷺ فَجَعَلَتْ تَسْأَلُهُ عَنِ الشَّامِ وَعَنْ بَرْدِهَا فَجَعَلَ يُخْبِرُهَا فَقَالَتْ كَيْفَ تَصْبِرُونَ عَلَى بَرْدِهَا؟ فَقَالَ يَا أُمَّ الْمُؤْمِنِينَ إِنَّهُمْ يَشْرَبُونَ شَرَابًا لَهُمْ يُقَالُ لَهُ الطِّلَاءُ فَقَالَتْ صَدَقَ اللهُ وَبَلَّغَ حِبِّي سَمِعْتُ حِبِّي رَسُولَ اللهِ ﷺ يَقُولُ إِنَّ أُنَاسًا مِنْ أُمَّتِي يَشْرَبُونَ الْخَمْرَ يُسَمُّونَهَا بِغَيْرِ اسْمِهَا
“People among my nation will drink wine, calling it by another name, and musical instruments will be played for them and singing girls (will sing for them). Allah will cause the earth to swallow them up, and will turn them into monkeys and pigs.” (Using translation from Ibn Mājah 4020)
عَنْ رَسُولِ اللهِ ﷺ أَنَّهُ قَالَ لَيَشْرَبَنَّ أُنَاسٌ مِنْ أُمَّتِي الْخَمْرَ يُسَمُّونَهَا بِغَيْرِ اسْمِهَا وَتُضْرَبُ عَلَى رُءُوسِهِمُ الْمَعَازِفُ يَخْسِفُ اللهُ بِهُمُ الْأَرْضَ وَيَجْعَلُ مِنْهُمْ قِرَدَةً وَخَنَازِيرَ
[Machine] He drank the paint and I am asking about what he drank, if it caused him to get intoxicated, his punishment should be severe.
أَنَّهُ شَرِبَ الطِّلَاءَ وَأَنَا سَائِلٌ عَمَّا شَرِبَ فَإِنْ كَانَ يُسْكِرُ جَلَدْتُهُ فَجَلَدَهُ عُمَرُ ؓ الْحَدَّ تَامًّا
[Machine] Abu Ubayd said: Many different types of drinks have been mentioned in relation to the Prophet ﷺ and his companions, and each of them has an explanation. The first is alcohol, which is what is boiled from grape juice. There is no dispute among Muslims about its prohibition; the dispute is about other drinks. One of them is "sukkar" which is the juice of uncooked dates that has not been touched by fire. It has been narrated that Abdullah ibn Mas'ud said, "Sukkar is wine." Another is "bit'u" which is honey wine. Another is "ji'a" which is barley wine. Another is "mizr" which is made from corn.
قَالَ أَبُو عُبَيْدٍ قَدْ جَاءَتْ فِي الْأَشْرِبَةِ آثَارٌ كَثِيرَةٌ بِأَسْمَاءَ مُخْتَلِفَةٍ عَنِ النَّبِيِّ ﷺ وَأَصْحَابِهِ وَكُلٌّ لَهُ تَفْسِيرٌ فَأَوَّلُهَا الْخَمْرُ وَهِيَ مَا غَلَى مِنْ عَصِيرِ الْعِنَبِ فَهَذَا مَا لَا اخْتِلَافَ فِي تَحْرِيمِهِ بَيْنَ الْمُسْلِمِينَ إِنَّمَا الِاخْتِلَافُ فِي غَيْرِهِ وَمِنْهَا السَّكَرُ وَهُوَ نَقِيعُ التَّمْرِ الَّذِي لَمْ تَمَسَّهُ النَّارُ وَفِيهِ يُرْوَى عَنْ عَبْدِ اللهِ بْنِ مَسْعُودٍ ؓ أَنَّهُ قَالَ السَّكَرُ خَمْرٌ وَمِنْهَا الْبِتْعُ وَهُوَ نَبِيذُ الْعَسَلِ وَمِنْهَا الْجِعَةُ وَهُوَ نَبِيذُ الشَّعِيرِ وَمِنْهَا الْمِزْرُ وَهُوَ مِنَ الذُّرَةِ
[Machine] He explained these four beverages and added that wine is made from grapes and sugar is made from dates. Abu Ubaid said, and also sugar cane. It has been narrated from Al-Ash'ari that the interpretation is that it is made from corn.
أَنَّهُ فَسَّرَ هَذِهِ الْأَرْبَعَةَ الْأَشْرِبَةَ وَزَادَ وَالْخَمْرُ مِنَ الْعِنَبِ وَالسَّكَرُ مِنَ التَّمْرِ قَالَ أَبُو عُبَيْدٍ وَمِنْهَا السُّكْرُكَةُ وَقَدْ رُوِيَ عَنِ الْأَشْعَرِيِّ التَّفْسِيرُ فَقَالَ إِنَّهُ مِنَ الذُّرَةِ
[Machine] The wine of the city is made from grape juice and dates, and the wine of the people of Persia is made from grapes, and the wine of the people of Yemen is made from honey, and the wine of the Abyssinians is the sukruka. Abu Ubaid said: And among the drinks is also the fadih, which is extracted from grape juice without being touched by fire. It is narrated from Ibn Umar that it is not fadih, but it is fadukh.
خَمْرُ الْمَدِينَةِ مِنَ الْبُسْرِ وَالتَّمْرِ وَخَمْرُ أَهْلِ فَارِسَ مِنَ الْعِنَبِ وَخَمْرُ أَهْلِ الْيَمَنِ الْبِتْعُ وَهُوَ مِنَ الْعَسَلِ وَخَمْرُ الْحَبَشِ السُّكْرُكَةُ قَالَ أَبُو عُبَيْدٍ وَمِنَ الْأَشْرِبَةِ أَيْضًا الْفَضِيخُ وَهُوَ مَا افْتُضِخَ مِنَ الْبُسْرِ مِنْ غَيْرِ أَنْ تَمَسَّهُ النَّارُ وَفِيهِ يُرْوَى عَنِ ابْنِ عُمَرَ لَيْسَ بِالْفَضِيخِ وَلَكِنَّهُ الْفَضُوخُ
[Machine] Abu Ubaid, if there are dates mixed with dried grapes, it is called Khaleetain. Similarly, if there are raisins and dates, it is the same. As for Al-Ashruba Al-Mansaf, it is the juice of grapes that is cooked before boiling until half of it is gone. I have been informed that it causes intoxication, so if it causes intoxication, it is Haram. But if it is cooked until two-thirds of it is gone and one-third remains, it is called Tilaa. It is named so because it resembles the paint used on camel humps and its blackness. Some Arabs also consider Tilaa as wine, and it is narrated that Ubaid ibn Al-Abras said in a proverb [Al-Bahr Al-Mutqarib], "It is wine called Tilaa, just as the wolf is called Abu Ja'dah." He also said the same for Al-Badhaq, which is also called wine and Al-Matbukh, which is mentioned in the hadith from Ibn Abbas when he was asked about Al-Badhaq and he said, "Mohammed had preceded Al-Badhaq, and he did not consider it to be intoxicating." Ibn Abbas said that because Al-Badhaq is a Persian word that was Arabized and he did not understand it. Abu Ubaid mentioned other names as well. Then he said, "All these drinks that I mentioned are just euphemisms for wine, and I think they are included in the hadith of the Prophet ﷺ that some people from my ummah will drink wine under names they call it." He also mentioned Omar ibn Al-Khattab's statement, "Wine is what disturbs the mind."
أَبُو عُبَيْدٍ فَإِنْ كَانَ مَعَ الْبُسْرِ تَمْرٌ فَهُوَ الَّذِي يُسَمَّى الْخَلِيطَيْنِ وَكَذَلِكَ إِنْ كَانَ زَبِيبًا وَتَمْرًا فَهُوَ مِثْلُهُ وَمِنَ الْأَشْرِبَةِ الْمَنْصَفُ وَهُوَ أَنْ يُطْبَخَ عَصِيرُ الْعِنَبِ قَبْلَ أَنْ يَغْلِيَ حَتَّى يَذْهَبَ نِصْفُهُ وَقَدْ بَلَغَنِي أَنَّهُ يُسْكِرُ فَإِنْ كَانَ يُسْكِرُ فَهُوَ حَرَامٌ وَإِنْ طُبِخَ حَتَّى يَذْهَبَ ثُلُثَاهُ وَيَبْقَى ثُلُثُهُ فَهُوَ الطِّلَاءُ وَإِنَّمَا سُمِّيَ بِذَلِكَ لِأَنَّهُ شُبِّهُ بِطِلَاءِ الْإِبِلِ فِي ثِخَنِهِ وَسَوَادِهِ وَبَعْضُ الْعَرَبِ يَجْعَلُ الطِّلَاءَ الْخَمْرَ بِعَيْنِهَا يُرْوَى أَنَّ عَبِيدَ بْنَ الْأَبْرَصِ قَالَ فِي مَثَلٍ لَهُ [البحر المتقارب] هِيَ الْخَمْرُ تُكْنَى الطِّلَاءُ كَمَا الذِّئْبُ يُكْنَى أَبَا جَعْدَةَ قَالَ وَكَذَلِكَ الْبَاذَقُ وَقَدْ يُسَمَّى بِهِ الْخَمْرُ وَالْمَطْبُوخُ وَهُوَ الَّذِي يُرْوَى فِيهِ الْحَدِيثُ عَنِ ابْنِ عَبَّاسٍ أَنَّهُ سُئِلَ عَنِ الْبَاذَقِ فَقَالَ سَبَقَ مُحَمَّدٌ الْبَاذَقَ وَمَا أَسْكَرَ فَهُوَ حَرَامٌ وَإِنَّمَا قَالَ ابْنُ عَبَّاسٍ ذَلِكَ لِأَنَّ الْبَاذَقَ كَلِمَةٌ فَارِسِيَّةٌ عُرِّبَتْ فَلَمْ يَعْرِفْهَا وَذَكَرَ أَبُو عُبَيْدٍ أَسْمَاءَ سِوَاهَا ثُمَّ قَالَ وَهَذِهِ الْأَشْرِبَةُ الْمُسَمَّاةُ عِنْدِي كُلُّهَا كِنَايَةٌ عَنِ اسْمِ الْخَمْرِ وَلَا أَحْسَبُهَا إِلَّا دَاخِلَةً فِي حَدِيثِ النَّبِيِّ ﷺ أَنَّ أُنَاسًا مِنْ أُمَّتِي يَشْرَبُونَ الْخَمْرَ بِاسْمٍ يُسَمُّونَهَا بِهِ قَالَ وَمِمَّا يُبَيِّنُهُ قَوْلُ عُمَرَ بْنِ الْخَطَّابِ ؓ الْخَمْرُ مَا خَامَرَ الْعَقْلَ
