٥٧۔ كِتَابُ الْأَشْرِبَةِ وَالْحَدُّ فِيهَا ص ٥
[Machine] Someone dies within the limits of the boundaries, and I find in myself no objection to it except for the one who dies in the limits of alcohol. Indeed, it is something that we mentioned after the Prophet ﷺ. So whoever dies from it, his blood money is either said to be in the Beit al-Mal or said to be on the discretion of the Imam. I doubt it refers to Imam Ash-Shafi'i. Ash-Shafi'i said and it has reached us that Umar ibn Al-Khattab sent to a woman who got scared and miscarried her fetus. She consulted Ali, and he gestured that she should be killed. Umar commanded Ali and said, "I have made up my mind about you to decide the matter for your people."
أَحَدٌ يَمُوتُ فِي حَدٍّ مِنَ الْحُدُودِ فَأَجِدُ فِي نَفْسِي مِنْهُ شَيْئًا إِلَّا الَّذِي يَمُوتُ فِي حَدِّ الْخَمْرِ فَإِنَّهُ شَيْءٌ أَحْدَثْنَاهُ بَعْدَ النَّبِيِّ ﷺ فَمَنْ مَاتَ مِنْهُ فَدِيَتُهُ إِمَّا قَالَ فِي بَيْتِ الْمَالِ وَإِمَّا قَالَ عَلَى عَاقِلَةِ الْإِمَامِ أَشُكُّ يَعْنِي الشَّافِعِيَّ قَالَ الشَّافِعِيُّ ؓ وَبَلَغَنَا أَنَّ عُمَرَ بْنَ الْخَطَّابِ ؓ أَرْسَلَ إِلَى امْرَأَةٍ فَفَزِعَتْ فَأَجْهَضَتْ ذَا بَطْنِهَا فَاسْتَشَارَ عَلِيًّا ؓ فَأَشَارَ عَلَيْهِ أَنْ يَدِيَهُ فَأَمَرَ عُمَرُ عَلِيًّا ؓ فَقَالَ عَزَمْتُ عَلَيْكَ لَتَقْسِمَنَّهَا عَلَى قَوْمِكَ
[Machine] That Ali hit a man with force, so the executioner increased his punishment with two lashes, and Ali endured it.
أَنَّ عَلِيًّا ؓ ضَرَبَ رَجُلًا حَدًّا فَزَادَهُ الْجَلَّادُ سَوْطَيْنِ فَأَقَادَهُ مِنْهُ عَلِيٌّ ؓ
57.20 [Machine] The Imam in disciplining someone, if he sees it abandoned, he leaves it Imam Ash-Shafi'i, may Allah have mercy upon him, said: Do you not see that the Messenger of Allah ﷺ appeared to a group who were excessive in the path of Allah, yet he did not punish them? And if punishment were obligatory, he would not have left them, as the Messenger of Allah ﷺ said, "If Fatima (his daughter) stole, I would cut off her hand.
٥٧۔٢٠ بَابُ الْإِمَامِ فِيمَا يُؤَدِّبُ إِنْ رَأَى تَرْكَهُ تَرَكَهُ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: أَلَا تَرَى أَنَّ رَسُولَ اللهِ ﷺ قَدْ ظَهَرَ عَلَى قَوْمٍ أَنَّهُمْ غَلُّوا فِي سَبِيلِ اللهِ , فَلَمْ يُعَاقِبْهُمْ , وَلَوْ كَانَتِ الْعُقُوبَةُ تَلْزَمُ لُزُومَ الْحَدِّ مَا تَرَكَهُمْ , كَمَا قَالَ رَسُولُ اللهِ ﷺ , وَقَطَعَ امْرَأَةً لَهَا شَرَفٌ فَكُلِّمَ فِيهَا: لَوْ سَرَقَتْ فُلَانَةٌ لِامْرَأَةٍ شَرِيفَةٍ لَقَطَعْتُ يَدَهَا
[Machine] The Prophet, ﷺ , when he obtained spoils of war, he would command Bilal to make an announcement three times, and the people would bring forth what they had obtained. Then, he would command Bilal to distribute it among them. A man came to him bringing a handful of hair and said, "Did you hear Bilal making the announcement three times?" He replied, "Yes." The man said, "Then what prevented you from bringing it?" The Prophet apologized to him and said, "You be the one who distributes it on the Day of Resurrection, for I will not accept it from you." And so on.
كَانَ النَّبِيُّ ﷺ إِذَا أَصَابَ غَنِيمَةً أَمَرَ بِلَالًا فَنَادَى ثَلَاثًا فَيَرْفَعُ النَّاسُ مَا أَصَابُوا ثُمَّ يَأْمُرُ بِهِ فَيُخَمَّسُ فَأَتَاهُ رَجُلٌ بِزِمَامٍ مِنْ شَعْرٍ وَقَدْ قُسِّمَتِ الْغَنِيمَةُ فَقَالَ هَلْ سَمِعْتَ بِلَالًا يُنَادِي ثَلَاثًا؟ قَالَ نَعَمْ قَالَ فَمَا مَنَعَكَ أَنْ تَأْتِيَ بِهِ؟ فَاعْتَذَرَ إِلَيْهِ فَقَالَ لَهُ كُنْ أَنْتَ الَّذِي تُوَافِي بِهِ يَوْمَ الْقِيَامَةِ فَإِنِّي لَنْ أَقْبَلَهُ مِنْكَ وَكَذَلِكَ
[Machine] A man had relations with a woman without engaging in indecency. He then went to Umar, seeking counsel. Umar rebuked him, and then he went to Abu Bakr, who also admonished him. Finally, he went to the Prophet ﷺ , and I do not know if the Prophet rebuked him or not. He said, "Then Allah revealed, 'Establish prayer at the two ends of the day and at the approach of the night. Indeed, good deeds do away with misdeeds.'"
The man asked, "Is this verse for me, O Messenger of Allah?" The Prophet replied, "It is for anyone who follows it from my nation."
أَصَابَ رَجُلٌ مِنِ امْرَأَةٍ شَيْئًا دُونَ الْفَاحِشَةِ فَأَتَى عُمَرَ ؓ فَعَظُمَ عَلَيْهِ ثُمَّ أَتَى أَبَا بَكْرٍ ؓ فَعَظُمَ عَلَيْهِ ثُمَّ أَتَى النَّبِيَّ ﷺ فَلَا أَدْرِي أَعَظُمَ عَلَيْهِ أَمْ لَا قَالَ فَأَنْزَلَ اللهُ ﷻ {أَقِمِ الصَّلَاةَ طَرَفَيِ النَّهَارِ وَزُلَفًا مِنَ اللَّيْلِ إِنَّ الْحَسَنَاتِ يُذْهِبْنَ السَّيِّئَاتِ} [هود 114] فَقَالَ الرَّجُلُ أَلِي هَذِهِ يَا رَسُولَ اللهِ؟ فَقَالَ هِيَ لِمَنْ أَخَذَ بِهَا مِنْ أُمَّتِي
[Machine] Abdul Razzaq, Ibn Jurayj, and Ibn Abi Sabrah narrated that two men insulted each other in front of Abu Bakr, but he did not say anything to them. However, when they insulted each other in front of Umar, he disciplined them.
ثنا عَبْدُ الرَّزَّاقِ وَأنا ابْنُ جُرَيْجٍ وَابْنُ أَبِي سَبْرَةَ قَالَا تَشَاتَمَ رَجُلَانِ عِنْدَ أَبِي بَكْرٍ ؓ فَلَمْ يَقُلْ لَهُمَا شَيْئًا وَتَشَاتَمَا عِنْدَ عُمَرَ فَأَدَّبَهُمَا
57.21 [Machine] The Sultan Forces a Man to Enter a River, Descend into a Well, or Climb a Palm Tree.
٥٧۔٢١ بَابُ السُّلْطَانِ يُكْرِهُ رَجُلًا عَلَى أَنْ يَدْخُلَ نَهْرًا أَوْ يَنْزِلَ بِئْرًا , أَوْ يَرْقَى نَخْلَةً
[Machine] Umar came out with his hands in his ears saying, "Here I am, here I am." People asked, "What is the matter with him?" They found out that a river obstructed their way and they had no ships to cross it. So, Umar ordered a man to find someone who could guide them through the water. They brought a man who said, "I fear the cold and it is cold now." Umar disliked it and sent him back. The man was drowned. Umar wrote a letter to him after he died and said to himself, "Whenever I come upon any of them I will do like this (i.e. I will question him)." When the man who was ordered to collect Zakat collected it and brought it, Umar further asked him, "What did you do with our companion (the man who was ordered to guide us to the water)? Umar told me the whole story (as above). Then Umar said, "Surely, Allah's Messenger ﷺ made this man a guardian over us in our property and in guiding us. Therefore, he should be questioned about his management. Al-Akhnas bin Shariq got up and said, "He was honest in his management." Umar then said, "I never doubted about him after knowing about his honesty." (O Al-Akhnas!) Don't stop criticizing him. Go on criticizing him."
خَرَجَ عُمَرُ ؓ وَيَدَاهُ فِي أُذُنَيْهِ وَهُوَ يَقُولُ يَا لَبَّيْكَاهُ يَا لَبَّيْكَاهُ قَالَ النَّاسُ مَا لَهُ؟ قَالَ جَاءَهُ بَرِيدٌ مِنْ بَعْضِ أُمَرَائِهِ أَنَّ نَهْرًا حَالَ بَيْنَهُمْ وَبَيْنَ الْعُبُورِ وَلَمْ يَجِدُوا سُفَنًا فَقَالَ أَمِيرُهُمُ اطْلُبُوا لَنَا رَجُلًا يَعْلَمُ غَوْرَ الْمَاءِ فَأُتِيَ بِشَيْخٍ فَقَالَ إِنِّي أَخَافُ الْبَرْدَ وَذَاكَ فِي الْبَرْدِ فَأَكْرَهَهُ فَأَدْخَلَهُ فَلَمْ يُلْبِثْهُ الْبَرْدُ فَجَعَلَ يُنَادِي يَا عُمَرَاهُ يَا عُمَرَاهُ فَغَرِقَ فَكَتَبَ إِلَيْهِ فَأَقْبَلَ فَمَكَثَ أَيَّامًا مُعْرِضًا عَنْهُ وَكَانَ إِذَا وَجَدَ عَلَى أَحَدٍ مِنْهُمْ فَعَلَ بِهِ ذَلِكَ ثُمَّ قَالَ مَا فَعَلَ الرَّجُلُ الَّذِي قَتَلْتَهُ؟ قَالَ يَا أَمِيرَ الْمُؤْمِنِينَ مَا تَعَمَّدْتُ قَتْلَهُ لَمْ نَجِدْ شَيْئًا يُعْبَرُ فِيهِ وَأَرَدْنَا أَنْ نَعْلَمَ غَوْرَ الْمَاءِ فَفَتَحْنَا كَذَا وَكَذَا وَأَصَبْنَا كَذَا وَكَذَا فَقَالَ عُمَرُ ؓ لَرَجُلٌ مُسْلِمٌ أَحَبُّ إِلِيَّ مِنْ كُلِّ شَيْءٍ جِئْتَ بِهِ لَوْلَا أَنْ تَكُونَ سُنَّةً لَضَرَبْتُ عُنُقَكَ اذْهَبْ فَأَعْطِ أَهْلَهُ دِيَتَهُ وَاخْرُجْ فَلَا أَرَاكَ
57.22 [Machine] The Sultan forces circumcision or the boy, and the Master of the Mamluks orders it, and what is mentioned in circumcision.
٥٧۔٢٢ بَابُ السُّلْطَانِ يُكْرِهُ عَلَى الِاخْتِتَانِ أَوِ الصَّبِيُّ وَسَيِّدُ الْمَمْلُوكِ يُأْمَرَانِ بِهِ , وَمَا وَرَدَ فِي الْخِتَانِ
[Machine] The Messenger of Allah ﷺ said: "The fitrah (natural state of man) consists of five things: circumcision, shaving the pubic hair, trimming the mustache, cutting nails, and plucking hair from the armpits."
عَنْ رَسُولِ اللهِ ﷺ أَنَّهُ قَالَ الْفِطْرَةُ خَمْسٌ الِاخْتِتَانُ وَالِاسْتِحْدَادُ وَقَصُّ الشَّارِبِ وَتَقْلِيمُ الْأَظْفَارِ وَنَتْفُ الْإِبْطِ
[Machine] He came to the Prophet ﷺ and embraced Islam, then the Prophet ﷺ said, "Shed the hair of disbelief and be circumcised." Abu Ahmad said, "This is what Ibn Juraij said in this chain of narration. I was informed about it by Uthaymeen bin Kulayb. He said that it was narrated to him by Ibrahim bin Abi Yahya, who concealed his name."
أَنَّهُ جَاءَ إِلَى النَّبِيِّ ﷺ فَأَسْلَمَ فَقَالَ النَّبِيُّ ﷺ أَلْقِ عَنْكَ شَعْرَ الْكُفْرِ وَاخْتَتِنْ قَالَ أَبُو أَحْمَدَ وَهَذَا الَّذِي قَالَهُ ابْنُ جُرَيْجٍ فِي هَذَا الْإِسْنَادِ أُخْبِرْتُ عَنْ عُثَيْمِ بْنِ كُلَيَبٍ إِنَّمَا حَدَّثَهُ إِبْرَاهِيمُ بْنُ أَبِي يَحْيَى فَكَنَّى عَنِ اسْمِهِ
[Machine] "We found in the list of the Prophet Muhammad's ﷺ weapons that circumcision is not left in Islam, even if one reaches the age of eighty. This is a hadith that is specifically known by the Ahl al-Bayt (the Prophet's household) with this chain of narration."
وَجَدْنَا فِي قَائِمِ سَيْفِ رَسُولِ اللهِ ﷺ فِي الصَّحِيفَةِ إِنَّ الْأَقْلَفَ لَا يُتْرَكُ فِي الْإِسْلَامِ حَتَّى يُخْتَتَنُ وَلَوْ بَلَغَ ثَمَانِينَ سَنَةً وَهَذَا حَدِيثٌ يَنْفَرِدُ بِهِ أَهْلُ الْبَيْتِ عَلَيْهِمُ السَّلَامُ بِهَذَا الْإِسْنَادِ
[Machine] The Prophet of Allah, ﷺ , ordered circumcision for women, and he said: "When you circumcise, do not overdo it, as that is better for the woman and more beloved to the husband."
أَنَّ رَسُولَ اللهِ ﷺ أَمَرَ خَاتِنَةً تَخْتِنُ فَقَالَ إِذَا خَتَنْتِ فَلَا تَنْهِكِي فَإِنَّ ذَلِكَ أَحْظَى لِلْمَرْأَةِ وَأَحَبُّ إِلَى الْبَعْلِ
[Machine] The prophet ﷺ says to her, "Do not prevent yourself from that, as it is best for the woman and most beloved to her husband." Abu Dawood said, "Muhammad bin Hassan is unknown and this hadith is weak."
لَهَا النَّبِيُّ ﷺ لَا تَنْهِكِي فَإِنَّ ذَلِكَ أَحْظَى لِلْمَرْأَةِ وَأَحَبُّ إِلَى الْبَعْلِ قَالَ أَبُو دَاوُدَ مُحَمَّدُ بْنُ حَسَّانَ مَجْهُولٌ وَهَذَا الْحَدِيثُ ضَعِيفٌ
[Machine] She has the messenger of Allah ﷺ saying, "O Umm Atiyyah, lower yourself and do not exhaust yourself, for that is bewitching to the face and most beneficial in marriage." Al-Ghalabi said, Abu Zakariya, who is Yahya bin Ma'in ad-Dahhak bin Qays, said, "This is not from al-Fihri."
لَهَا رَسُولُ اللهِ ﷺ يَا أُمَّ عَطِيَّةَ اخْفِضِي وَلَا تَنْهِكِي فَإِنَّهُ أَسْرَى لِلْوَجْهِ وَأَحْظَى عِنْدَ الزَّوَاجِ قَالَ الْغَلَابِيُّ فَقَالَ أَبُو زَكَرِيَّا وَهُوَ يَحْيَى بْنُ مَعِينٍ الضَّحَّاكُ بْنُ قَيْسٍ هَذَا لَيْسَ بِالْفِهْرِيِّ
[Machine] About the Prophet ﷺ , when you lower yourself, smell and do not overexert yourself, for indeed it is captivating to the face and favored by the spouse. Abu Ahmad said: "This is narrated by Thabit, Zaidah bin Abi Rukad. I do not know anyone else who narrates it from him."
عَنِ النَّبِيِّ ﷺ إِذَا خَفَضْتِ فَأَشِمِّي وَلَا تَنْهِكِي فَإِنَّهُ أَسْرَى لِلْوَجْهِ وَأَحْظَى عِنْدَ الزَّوْجِ قَالَ أَبُو أَحْمَدَ هَذَا يَرْوِيهِ عَنْ ثَابِتٍ زَائِدَةُ بْنُ أَبِي الرُّقَادِ لَا أَعْلَمُ يَرْوِيهِ عَنْهُ غَيْرُهُ
[Machine] The Messenger of Allah ﷺ advised regarding the circumcision of Hasan and Husayn, to perform it after seven days.
عَقَّ رَسُولُ اللهِ ﷺ عَنِ الْحَسَنِ وَالْحُسَيْنِ وَخَتَنَهُمَا لِسَبْعَةِ أَيَّامٍ
عَنِ النَّبِيِّ ﷺ فِي الْأَقْلَفِ يَحُجُّ بَيْتَ اللهِ قَالَ لَا حَتَّى يَخْتَتِنَ لَفْظُ حَدِيثِ تَمْتَامٍ وَفِي رِوَايَةِ الْأَسْفَاطِيِّ قَالَ سَمِعْتُ مُنْيَةَ قَالَتْ سَمِعْتُ أَبَا بَرْزَةَ قَالَ سَأَلْنَا رَسُولَ اللهِ ﷺ عَنْ رَجُلٍ أَقْلَفَ يَحُجُّ بَيْتَ اللهِ قَالَ لَا حَتَّى يَخْتَتِنَ
[Machine] The Prophet ﷺ said, "Circumcision is a Sunnah for men and an honor for women." This chain of narration is weak, and what is preserved (in terms of hadith) is suspended.
عَنِ النَّبِيِّ ﷺ قَالَ الْخِتَانُ سُنَّةٌ لِلرِّجَالِ مَكْرُمَةٌ لِلنِّسَاءِ هَذَا إِسْنَادٌ ضَعِيفٌ وَالْمَحْفُوظُ مَوْقُوفٌ
[Machine] Circumcision is a sunnah for men and an honor for women.
الْخِتَانُ سُنَّةٌ لِلرِّجَالِ وَمَكْرُمَةٌ لِلنِّسَاءِ
[Machine] The Prophet ﷺ said, "Circumcision is a Sunnah for men and an honor for women." Hajjaj bin Arta'ah is not cited as a reliable source for it. It is also said to be narrated by Mak'hul from Abu Ayyub, but it is a disconnected chain of narration.
قَالَ النَّبِيُّ ﷺ الْخِتَانُ سُنَّةٌ لِلرِّجَالِ وَمَكْرُمَةٌ لِلنِّسَاءِ الْحَجَّاجُ بْنُ أَرْطَاةَ لَا يُحْتَجُّ بِهِ وَقِيلَ عَنْهُ عَنْ مَكْحُولٍ عَنْ أَبِي أَيُّوبَ وَهُوَ مُنْقَطِعٌ
[Machine] The Prophet ﷺ said, "Circumcision is a Sunnah for men and an honor for women."
قَالَ النَّبِيُّ ﷺ الْخِتَانُ سُنَّةٌ لِلرِّجَالِ وَمَكْرُمَةٌ لِلنِّسَاءِ
[Machine] His prayer is not accepted, and his testimony is not valid.
لَا تُقْبَلُ صَلَاتُهُ وَلَا تَجُوزُ شَهَادَتُهُ
[Machine] The prayer of a man who has not been circumcised is not accepted, which indicates that it was obligatory and that his saying "circumcision is a sunnah" means the recommended sunnah of the Prophet ﷺ, and the best evidence for this matter is what
لَا تُقْبَلُ صَلَاةُ رَجُلٍ لَمْ يَخْتَتِنْ وَهَذَا يَدُلُّ عَلَى أَنَّهُ كَانَ يُوجِبُهُ وَأَنَّ قَوْلَهُ الْخِتَانُ سُنَّةٌ أَرَادَ بِهِ سُنَّةَ النَّبِيِّ ﷺ الْمُوجِبَةَ وَأَحْسَنُ مَا يُسْتَدَلُّ بِهِ فِي هَذِهِ الْمَسْأَلَةِ مَا
[Machine] The Messenger of Allah ﷺ said that Prophet Ibrahim ﷺ was circumcised when he was eighty years old upon his arrival.
قَالَ رَسُولُ اللهِ ﷺ اخْتَتَنَ إِبْرَاهِيمُ النَّبِيُّ عَلَيْهِ السَّلَامُ وَهُوَ ابْنُ ثَمَانِينَ سَنَةً بِالْقَدُومِ
[Machine] Abu Tahir Al-Faqih informed us that Abu Tahir Al-Muhammad ibn Abadhiyyu informed us that Abu Qilabah narrated to us that Yahya ibn Abi Bukayr narrated to us that Abu Shihab Abdur-Rabbi narrated to us from Hamzah Al-Jazari from Abdul Karim from Ibrahim from Alqamah that Ali used to not allow the testimony of al-Aqlif. Hamzah Al-Jazari left him and it is not permissible to argue based on his narration.
أَخْبَرَنَا أَبُو طَاهِرٍ الْفَقِيهُ أنبأ أَبُو طَاهِرٍ الْمُحَمَّدْ آبَاذِيُّ أنبأ أَبُو قِلَابَةَ ثنا يَحْيَى بْنُ أَبِي بُكَيْرٍ ثنا أَبُو شِهَابٍ عَبْدُ رَبِّهِ عَنْ حَمْزَةَ الْجَزَرِيِّ عَنْ عَبْدِ الْكَرِيمِ عَنْ إِبْرَاهِيمَ عَنْ عَلْقَمَةَ أَنَّ عَلِيًّا ؓ كَانَ لَا يُجِيزُ شَهَادَةَ الْأَقْلَفِ حَمْزَةُ الْجَزَرِيُّ تَرَكُوهُ لَا يَجُوزُ الِاحْتِجَاجُ بِخَبَرِهِ
[Machine] And Ismail ﷺ was circumcised at the age of thirteen, and Isaac ﷺ was circumcised at the age of seven days.
وَخُتِنَ إِسْمَاعِيلُ عَلَيْهِ السَّلَامُ وَهُوَ ابْنُ ثَلَاثَ عَشْرَةَ سَنَةً وَخُتِنَ إِسْحَاقُ عَلَيْهِ السَّلَامُ وَهُوَ ابْنُ سَبْعَةِ أَيَّامٍ
57.23 [Machine] Collection of the qualities of kindness
٥٧۔٢٣ جُمَّاعُ أَبْوَابِ صِفَةِ السَّوْطِ
57.24 [Machine] What is mentioned in the description of whipping and striking?
٥٧۔٢٤ بَابُ مَا جَاءَ فِي صِفَةِ السَّوْطِ وَالضَّرْبِ
[Machine] A man confessed to himself for committing adultery, so the Messenger of Allah ﷺ called for a whip. A broken whip was brought, so he said, "Bring a new whip that has not been used yet." Then he said, "Bring a whip that has been ridden by Fulan." So it was brought, and he ordered for the man to be whipped. Then he said, "O people, it is time for you to refrain from the prohibitions of Allah. Whoever among you is affected by this impurity, let him cover himself with Allah's covering. For whoever exposes his sin to us, we will impose upon him the punishment prescribed by Allah's Book." Al-Shafi'i (may Allah have mercy on him) said, "This is a disconnected hadith, it is not one of the proofs. However, I have seen scholars among us who know it and speak of it, and we also speak of it."
أَنَّ رَجُلًا اعْتَرَفَ عَلَى نَفْسِهِ بِالزِّنَا فَدَعَا لَهُ رَسُولُ اللهِ ﷺ بِسَوْطٍ فَأُتِيَ بِسَوْطٍ مَكْسُورٍ فَقَالَ فَوْقَ هَذَا فَأُتِيَ بِسَوْطٍ جَدِيدٍ لَمْ تُقْطَعْ ثَمَرَتُهُ فَقَالَ بَيْنَ هَذَيْنِ فَأُتِيَ بِسَوْطٍ قَدْ رُكِّبَ بِهِ فُلَانٌ فَأَمَرَ بِهِ فَجُلِدَ ثُمَّ قَالَ أَيُّهَا النَّاسُ قَدْ آنَ لَكُمْ أَنْ تَنْتَهُوَا عَنْ مَحَارِمِ اللهِ فَمَنْ أَصَابَ مِنْكُمْ مِنْ هَذِهِ الْقَاذُورَةِ شَيْئًا فَلْيَسْتَتِرْ بِسِتْرِ اللهِ فَإِنَّه مَنْ يُبْدِ لَنَا صَفْحَتَهُ نُقِمْ عَلَيْهِ كِتَابَ اللهِ ﷻ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ هَذَا حَدِيثٌ مُنْقَطِعٌ لَيْسَ مِمَّا يَثْبُتُ بِهِ هُوَ نَفْسُهُ حُجَّةٌ وَقَدْ رَأَيْتُ مِنْ أَهْلِ الْعِلْمِ عِنْدَنَا مَنْ يَعْرِفُهُ وَيَقُولُ بِهِ فَنَحْنُ نَقُولُ بِهِ
[Machine] I want a whip that is soft, then bring a whip that's even softer. He said, "I want one that's stronger than this," so a whip was brought that was between the two whips. He said, "Strike and do not let your armpit be seen, and give each body part its right."
أُرِيدُ أَلْيَنَ مِنْ هَذَا ثُمَّ أُتِيَ بِسَوْطٍ فِيهِ لِينٌ فَقَالَ أُرِيدُ أَشَدَّ مِنْ هَذَا فَأُتِيَ بِسَوْطٍ بَيْنَ السَّوْطَيْنِ فَقَالَ اضْرِبْ وَلَا يُرَى إِبْطُكَ وَأَعْطِ كُلَّ عُضْوٍ حَقَّهُ
[Machine] Let him use his hands to protect himself with them.
دَعْ لَهُ يَدَيْهِ يَتَّقِي بِهِمَا
[Machine] Stripping, extending, coveting, and hoarding are not permissible in this nation.
لَا يَحِلُّ فِي هَذِهِ الْأُمَّةِ تَجْرِيدٌ وَلَا مَدٌّ وَلَا غُلٌّ وَلَا صَفْدٌ
[Machine] A man from the Muslims came with his drunk nephew and said, "O Abu Abdur-Rahman, indeed my nephew is drunk." He replied, "Tie him up and beat him, admonish him, and humiliate him." So they did as instructed and brought him to the prison. Then the man called for him the next day and brought a whip. He ordered his fruits to be pounded between two stones until it turned into a liquid. Ubaidullah pointed with his finger like this and gathered them. Then he said to the executioner, "Whip him and do not refrain from hitting softly. Give each body part its right." I said, "Should I repeat?" He said, "It should not be visible that his armpit is white." So he struck him with a non-severe and non-light strike. I said, "What is a non-light strike?" He said, "It is a strike that is not severe nor soft." He struck him on his shirt and trousers or his shirt and lower garment and mentioned the narration.
جَاءَ رَجُلٌ مِنَ الْمُسْلِمِينَ بِابْنِ أَخٍ لَهُ وَهُوَ سَكْرَانُ فَقَالَ يَا أَبَا عَبْدِ الرَّحْمَنِ إِنَّ ابْنَ أَخِي سَكْرَانُ فَقَالَ تَرْتِرُوهُ وَمَزْمِزُوهُ وَاسْتَنْكِهُوهُ فَفَعَلُوا فَرَفَعَهُ إِلَى السِّجْنِ ثُمَّ دَعَاهُ مِنَ الْغَدِ وَدَعَا بِسَوْطٍ ثُمَّ أَمَرَ بِثَمَرَتِهِ فَدُقَّتْ بَيْنَ حَجَرَيْنِ حَتَّى صَارَتْ دِرَّةً قَالَ عُبَيْدُ اللهِ يُشِيرُ بِإِصْبَعِهِ هَكَذَا وَجَمَعَهُمَا ثُمَّ قَالَ لِلْجَلَّادِ اجْلِدْ وَأَرْجِعْ يَدَكَ وَأَعْطِ كُلَّ عُضْوٍ حَقَّهُ قُلْتُ مَا أَرْجِعُ؟ قَالَ لَا يُرَى بَيَاضُ إِبْطِهِ فَضَرَبَهُ ضَرْبًا غَيْرَ مُبَرِّحٍ قُلْتُ مَا غَيْرُ مُبَرِّحٍ؟ قَالَ ضَرْبٌ لَيْسَ بِالشَّدِيدِ وَلَا بِالْهَيِّنِ وَضَرَبَهُ فِي قَمِيصٍ وَإِزَارٍ أَوْ قَمِيصٍ وَسَرَاوِيلَ وَذَكَرَ الْحَدِيثَ
[Machine] The people of Iraq say that the whip does not cause severe pain. Saad said, and I bear witness on my father's behalf, that he told me that when Abu Bakrah was whipped, his mother was ordered to slaughter a sheep, then it was skinned and its skin was put on him. Is that not from severe skin pain?
إِنَّ أَهْلَ الْعِرَاقِ يَقُولُونَ إِنَّ الْقَاذِفَ لَا يُجْلَدُ جَلْدًا شَدِيدًا قَالَ سَعْدٌ وَأَشْهَدُ عَلَى أَبِي أَنَّهُ حَدَّثَنِي أَنَّهُ لَمَّا جُلِدَ أَبُو بَكْرَةَ أَمَرَتْ أُمُّهُ بِشَاةٍ فَذُبِحَتْ ثُمَّ سُلِخَتْ فَأَلْبَسَتْهُ جِلْدَهَا فَهَلْ ذَاكَ إِلَّا مِنْ جَلْدٍ شَدِيدٍ؟
[Machine] That the Prophet ﷺ said: "When one of you strikes, let him avoid the face."
أَنَّ النَّبِيَّ ﷺ قَالَ إِذَا ضَرَبَ أَحَدُكُمْ فَلْيَجْتَنِبِ الْوَجْهَ
[Machine] He witnessed Ali establishing a punishment on a man, so he said to the punisher, "Strike and give each body part its right, and fear his face and his belongings."
أَنَّهُ شَهِدَ عَلِيًّا ؓ أَقَامَ عَلَى رَجُلٍ حَدًّا فَقَالَ لِلْجَالِدِ اضْرِبْ وَأَعْطِ كُلَّ عُضْوٍ حَقَّهُ وَاتَّقِ وَجْهَهُ وَمَذَاكِيرَهُ
[Machine] Ali used to say that a man should be struck while standing and a woman should be struck while sitting.
أَنَّ عَلِيًّا ؓ كَانَ يَقُولُ يُضْرَبُ الرَّجُلُ قَائِمًا وَالْمَرْأَةُ قَاعِدَةً
[Machine] That the Messenger of Allah ﷺ ordered it, so her clothes were tightened on her, and in another narration, they were tightened even more, then the Messenger of Allah ﷺ ordered her to be stoned.
أَنَّ رَسُولَ اللهِ ﷺ أَمَرَ بِهَا فَشُدَّتْ عَلَيْهَا ثِيَابُهَا وَفِي رِوَايَةٍ فَشُكَّتْ ثُمَّ أَمَرَ بِهَا فَرُجِمَتْ
57.25 [Machine] What is mentioned in the punishment and that it does not exceed forty
٥٧۔٢٥ بَابُ مَا جَاءَ فِي التَّعْزِيرِ وَأَنَّهُ لَا يُبْلَغُ بِهِ أَرْبَعِينَ
[Machine] The Messenger of Allah ﷺ said: "Whoever strikes [another person], and in another narration by al-Asbahani, whoever goes beyond the limits without justification, then he is one of the transgressors. And this hadith is mursal."
قَالَ رَسُولُ اللهِ ﷺ مَنْ ضَرَبَ وَفِي رِوَايَةِ الْأَصْبَهَانِيِّ مَنْ بَلَغَ حَدًّا فِي غَيْرِ حَدٍّ فَهُوَ مِنَ الْمُعْتَدِينَ وَالْمَحْفُوظُ هَذَا الْحَدِيثُ مُرْسَلٌ
[Machine] The Prophet ﷺ said, "Whoever exceeds a limit without a justifiable reason, then he is among the aggressors."
قَالَ النَّبِيُّ ﷺ مَنْ بَلَغَ حَدًّا فِي غَيْرِ حَدٍّ فَهُوَ مِنَ الْمُعْتَدِينَ
[Machine] The minimum punishment for amputation is to be given forty lashes, and it has been narrated from the companions that there are various interpretations of this. The best course of action in this matter is what has been confirmed from the Prophet ﷺ.
يُبْلَغَ فِي التَّعْزِيرِ أَدْنَى الْحُدُودِ أَرْبَعِينَ سَوْطًا وَقَدْ رُوِيَ عَنِ الصَّحَابَةِ ؓ فِي مِقْدَارِ ذَلِكَ آثَارٌ مُخْتَلِفَةٌ وَأَحْسَنُ مَا يُصَارُ إِلَيْهِ فِي هَذَا مَا ثَبَتَ عَنِ النَّبِيِّ ﷺ
[Machine] The Messenger of Allah ﷺ said, "No one should be lashed with more than ten stripes, except in a punishment prescribed by Allah's limits." This is the narration of Abu Amr, and in the narration of Ibn Abdan it is mentioned from someone.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا يُجْلَدُ أَحَدٌ فَوْقَ عَشَرَةِ أَسْوَاطٍ إِلَّا فِي حَدٍّ مِنْ حُدُودِ اللهِ لَفْظُ حَدِيثِ أَبِي عَمْرٍو وَفِي رِوَايَةِ ابْنِ عَبْدَانَ عَنْ عَنْ
[Machine] That the Messenger of Allah ﷺ used to say, "No one should be flogged more than ten times, except in the case of a punishment prescribed by Allah."
أَنَّ رَسُولَ اللهِ ﷺ كَانَ يَقُولُ لَا يُجْلَدُ فَوْقَ عَشْرِ جَلْدَاتٍ إِلَّا فِي حَدٍّ مِنْ حُدُودِ اللهِ
[Machine] The Prophet ﷺ said, "Do not strike with more than ten lashes except in a punishment legislated by Allah, and he shall have a trustworthy witness."
عَنِ النَّبِيِّ ﷺ قَالَ لَا يُضْرَبُ فَوْقَ عَشَرَةِ أَسْوَاطٍ إِلَّا فِي حَدٍّ مِنْ حُدُودِ اللهِ وَلَهُ شَاهِدٌ مُرْسَلٌ
[Machine] He ﷺ said: "It is not permissible for a man who believes in Allah and the Last Day to flog with more than ten lashes, except in the case of a prescribed punishment." And Ya'qub narrated it, but some who are not trustworthy in their narrations also narrated it, and he said: "Indeed, Abdullah ibn Abi Bakr As-Siddiq reported it, and it is only Abdullah ibn Abi Bakr ibn 'Amr ibn Hazm."
ﷺ قَالَ لَا يَحِلُّ لِرَجُلٍ يُؤْمِنُ بِاللهِ وَالْيَوْمِ الْآخِرِ أَنْ يَجْلَدَ فَوْقَ عَشَرَةِ أَسْوَاطٍ إِلَّا فِي حَدٍّ وَقَالَ يَعْقُوبُ وَرَوَاهُ بَعْضُ مَنْ لَا يُوثَقُ بِرِوَايَتِهِ فَقَالَ إِنَّ عَبْدَ اللهِ بْنَ أَبِي بَكْرٍ الصِّدِّيقِ ؓ حَدَّثَهُ وَإِنَّمَا هُوَ عَبْدُ اللهِ بْنُ أَبِي بَكْرِ بْنِ عَمْرِو بْنِ حَزْمٍ
57.26 [Machine] Boundaries are not enforced in mosques.
٥٧۔٢٦ بَابُ لَا تُقَامُ الْحُدُودُ فِي الْمَسَاجِدِ
The Messenger of Allah ﷺ forbade to take retaliation in the mosque, to recite verses in it and to inflict the prescribed punishments in it. (Using translation from Abū Dāʾūd 4490)
نَهَى رَسُولُ اللهِ ﷺ أَنْ يُسْتَقَادَ فِي الْمَسَاجِدِ وَأَنْ يُنْشَدَ فِيهَا الْأَشْعَارُ أَوْ تُقَامَ فِيهَا الْحُدُودُ
57.27 [Machine] The boundaries are expiations.
٥٧۔٢٧ بَابُ: الْحُدُودُ كَفَّارَاتٌ
[Machine] We were with the Messenger of Allah ﷺ in a gathering when he said, "Pledge allegiance to me that you will not associate anything with Allah." And he recited the verse to them and said, "Whoever fulfills it will have his reward with Allah, and whoever commits anything of it will be punished, which will be an expiation for him. And whoever commits anything of it and Allah conceals it for him, then it is up to Allah, if He wills, to forgive him, and if He wills, to punish him." This is the narration of Imam al-Shafi'i, recorded in Saheeh from a group of narrators from Sufyan ibn Uyaynah. Al-Shafi'i said in the narration of Abu Sa'eed, "I have not heard a narration regarding the prescribed punishments clearer than this, and it has been narrated from the Prophet ﷺ that he said, 'Who knows, perhaps the prescribed punishments were revealed as an expiation for sins."
كُنَّا مَعَ رَسُولِ اللهِ ﷺ فِي مَجْلِسٍ فَقَالَ بَايِعُونِي عَلَى أَنْ لَا تُشْرِكُوا بِاللهِ شَيْئًا وَقَرَأَ عَلَيْهِمُ الْآيَةَ وَقَالَ فَمَنْ وَفَى مِنْكُمْ فَأَجْرُهُ عَلَى اللهِ وَمَنْ أَصَابَ مِنْ ذَلِكَ شَيْئًا فَعُوقِبَ فَهُوَ كَفَّارَةٌ لَهُ وَمَنْ أَصَابَ مِنْ ذَلِكَ شَيْئًا فَسَتَرَهُ اللهُ عَلَيْهِ فَهُوَ إِلَى اللهِ إِنْ شَاءَ غَفَرَ لَهُ وَإِنْ شَاءَ عَذَّبَهُ لَفْظُ حَدِيثِ الشَّافِعِيِّ وَأَخْرَجَاهُ فِي الصَّحِيحِ عَنْ جَمَاعَةٍ عَنْ سُفْيَانَ بْنِ عُيَيْنَةَ قَالَ الشَّافِعِيُّ فِي رِوَايَةِ أَبِي سَعِيدٍ لَمْ أَسْمَعْ فِي الْحُدُودِ حَدِيثًا أَبْيَنَ مِنْ هَذَا وَقَدْ رُوِيَ عَنِ النَّبِيِّ ﷺ أَنَّهُ قَالَ وَمَا يُدْرِيكَ لَعَلَّ الْحُدُودَ نَزَلَتْ كَفَّارَةً لِلذُّنُوبِ
The Messenger of Allah ﷺ said: ʿWhoever commits a sin in this world and is punished therein. Allah is too generous to repeat His punishment of His slave [in the Hereafter], whoever commits a sin in this world and Allah conceals it and pardons him, Allah is too generous to retract His pardon when He has granted it.ʿ (Using translation from Aḥmad 775)
قَالَ رَسُولُ اللهِ ﷺ مَنْ أَصَابَ فِي الدُّنْيَا ذَنْبًا فَعُوقِبَ بِهِ فَاللهُ أَعْدَلُ مِنْ أَنْ يُثَنِّي عُقُوبَتَهُ عَلَى عِبَادِهِ وَمَنْ أَذْنَبَ ذَنْبًا فِي الدُّنْيَا فَسَتَرَهُ الله عَلَيْهِ وَعَفَا عَنْهُ فَاللهُ أَكْرَمُ مِنْ أَنْ يَعُودَ فِي شَيْءٍ قَدْ عَفَا عَنْهُ
[Machine] Narrated by the Prophet ﷺ: "Whoever commits a sin and the prescribed punishment for that sin is carried out on them, then it serves as an expiation for that sin."
عَنِ النَّبِيِّ ﷺ قَالَ مَنْ أَصَابَ ذَنْبًا فَأُقِيمَ عَلَيْهِ حَدُّ ذَلِكَ الذَّنْبِ فَهُوَ كَفَّارَتُهُ
[Machine] The Messenger of Allah, ﷺ , said, "I don't know if Tubba was blind or not. And I don't know if Dhul-Qarnayn was a prophet or not. And I don't know if the prescribed punishments are expiations for those who commit them or not. This is how it is."
قَالَ رَسُولُ اللهِ ﷺ مَا أَدْرِي تُبَّعٌ أَلَعِينًا كَانَ أَمْ لَا؟ وَمَا أَدْرِي ذُو الْقَرْنَيْنِ أَنَبِيًّا كَانَ أَمْ لَا؟ وَمَا أَدْرِي الْحُدُودَ كَفَّارَاتٌ لِأَهْلِهَا أَمْ لَا فَهَكَذَا
[Machine] When Ali stoned (someone) for adultery, I said, "She died due to the severity of the punishment sometimes." He then took hold of my garment and said, "Indeed, whoever commits an offense that warrants the punishment, the punishment shall be carried out upon him, and it will serve as an expiation for him."
حِينَ رَجَمَ عَلِيٌّ ؓ شَرَاحَةَ قُلْتُ مَاتَتْ عَلَى شَرِّ أَحْيَانِهَا قَالَ فَأَخَذَ بِثَوْبِي ثُمَّ قَالَ إِنَّهُ مَنْ أَتَى شَيْئًا مِنْ حَدٍّ فَأُقِيمَ عَلَيْهِ الْحَدُّ فَهُوَ كَفَّارَتُهُ
[Machine] Ali imposed a limit on a man, and the people started cursing and insulting him. Ali said, "As for his sin, he will not be questioned."
أَنَّ عَلِيًّا ؓ أَقَامَ عَلَى رَجُلٍ حَدًّا فَجَعَلَ النَّاسُ يَسُبُّونَهُ وَيَلْعَنُونَهُ فَقَالَ عَلِيٌّ ؓ أَمَّا عَنْ ذَنْبِهِ هَذَا فَلَا يُسْأَلُ
57.28 [Machine] What is written on the banner about the protection of Allah ﷻ
٥٧۔٢٨ بَابُ مَا جَاءَ فِي الِاسْتِتَارِ بِسِتْرِ اللهِ ﷻ
[Machine] I heard the Messenger of Allah ﷺ say, "All of my ummah (followers) will be forgiven except for those who openly commit sins. And verily, one form of open sinning is when a person does something at night and then wakes up in the morning while Allah has kept his action hidden. He says, 'O so-and-so, I did such and such last night,' when Allah had concealed him under His cover. But in the morning, he removes Allah's cover from himself."
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ كُلُّ أُمَّتِي مُعَافًى إِلَّا الْمُجَاهِرِينَ وَإِنَّ مِنَ الْإِجْهَارِ أَنْ يَعْمَلَ الرَّجُلُ فِي اللَّيْلِ عَمَلًا ثُمَّ يُصْبِحُ وَقَدْ سَتَرَهُ رَبُّهُ فَيَقُولُ يَا فُلَانُ عَمِلْتُ الْبَارِحَةَ كَذَا وَكَذَا وَقَدْ بَاتَ يَسْتُرُهُ رَبُّهُ يَبِيتُ فِي سِتْرِ رَبِّهِ وَيُصْبِحُ يَكْشِفُ سِتْرَ اللهِ عَنْهُ
[Machine] The Prophet ﷺ once stoned a person who had committed adultery and then said, "Stay away from this filth that Allah has forbidden. Whoever has sinned, let them conceal it with the concealment of Allah." 17602 Abu Al-Hasan bin Abdan informed us that Ahmad bin Ubaid narrated to him from Umar bin Ahmad bin Bishr from Harun bin Musa Al-Farwi from Abu Damrah from Yahya bin Said from Abdullah bin Dinar who mentioned it with similar words: "Increase in repentance to Allah, for whoever shows us his sins, we will enforce the punishment of Allah's Book upon him." Ash-Shafi'i may Allah have mercy on him stated that it has been narrated that during the time of the Prophet ﷺ , Abu Bakr (may Allah be pleased with him) instructed a man who had been punished with stoning to hide himself, and Umar (may Allah be pleased with him) also instructed the same. The Sheikh, may Allah have mercy on him, said, "The chain of narration for this hadith in the chapter of confessing adultery has already passed." 17603 Abu Zakariya bin Abi Ishaq informed us that Abu Abdullah Muhammad bin Ya'qub narrated to him from Muhammad bin Abdul Wahhab, who narrated from Jafar bin Awn, who narrated from Abdul Rahman bin Abdullah, who narrated from Wasil, who said, "Umar (may Allah be pleased with him) entered upon a woman who had committed adultery and mentioned the hadith." He said, "Then Umar (may Allah be pleased with him) said, 'Indeed, Allah has made four witnesses a concealment for you from your indecencies, so do not infringe upon the concealment of Allah. Verily, if Allah willed, He could have made it one true witness or one false witness." Ash-Shafi'i (may Allah have mercy on him) said, "We prefer for the one who has been punished to hide himself and fear Allah, and not to return to the disobedience of Allah. Verily, Allah accepts repentance from His servants."
أَنَّ رَسُولَ اللهِ ﷺ بَعْدَ أَنْ رَجَمَ الْأَسْلَمِيَّ قَالَ اجْتَنِبُوا هَذِهِ الْقَاذُورَةَ الَّتِي نَهَى الله عَنْهَا فَمَنْ أَلَمَّ فَلْيَسْتَتِرْ بِسِتْرِ اللهِ ﷻ 17602 وَأَخْبَرَنَا أَبُو الْحَسَنِ بْنُ عَبْدَانَ أنبأ أَحْمَدُ بْنُ عُبَيْدٍ ثنا عُمَرُ بْنُ أَحْمَدَ بْنِ بِشْرٍ ثنا هَارُونُ بْنُ مُوسَى الْفَرْوِيُّ ثنا أَبُو ضَمْرَةَ عَنْ يَحْيَى بْنِ سَعِيدٍ عَنْ عَبْدِ اللهِ بْنِ دِينَارٍ فَذَكَرَهُ بِمِثْلِهِ زَادَ وَلْيَتُبْ إِلَى اللهِ فَإِنَّهُ مَنْ يُبْدِ لَنَا صَفْحَتَهُ نُقِمْ كِتَابَ اللهِ عَلَيْهِ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ وَرُوِيَ أَنَّ أَبَا بَكْرٍ ؓ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ أَمَرَ رَجُلًا أَصَابَ حَدًّا بِالِاسْتِتَارِ وَأَنَّ عُمَرَ ؓ أَمَرَهُ بِهِ قَالَ الشَّيْخُ رَحِمَهُ اللهُ قَدْ مَضَى إِسْنَادُ هَذَا الْحَدِيثِ فِي بَابِ الِاعْتِرَافِ بِالزِّنَا 17603 وَأَخْبَرَنَا أَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ أنبأ أَبُو عَبْدِ اللهِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا مُحَمَّدُ بْنُ عَبْدِ الْوَهَّابِ أنبأ جَعْفَرُ بْنُ عَوْنٍ أنبأ عَبْدُ الرَّحْمَنِ بْنُ عَبْدِ اللهِ عَنْ وَاصِلٍ عَنِ الْمَعْرُورِ قَالَ أُتِيَ عُمَرُ ؓ بِامْرَأَةٍ قَدْ زَنَتْ فَذَكَرَ الْحَدِيثَ قَالَ ثُمَّ قَالَ عُمَرُ ؓ إِنَّمَا جَعَلَ اللهُ أَرْبَعَةَ شُهَدَاءَ سِتْرًا يَسْتُرُكُمْ دُونَ فَوَاحِشِكُمْ فَلَا يَتَطَلَّعَنَّ سِتْرَ اللهِ أَحَدٌ أَلَا وَإِنَّ اللهَ لَوْ شَاءَ لَجَعَلَهُ وَاحِدًا صَادِقًا أَوْ كَاذِبًا قَالَ الشَّافِعِيُّ وَنَحْنُ نُحِبُّ لِمَنْ أَصَابَ الْحَدَّ أَنْ يَسْتَتِرَ وَأَنْ يَتَّقِيَ اللهَ وَلَا يَعُودَ لِمَعْصِيَةِ اللهِ فَإِنَّ اللهَ يَقْبَلُ التَّوْبَةَ عَنْ عِبَادِهِ
