57. Drinks (6/7)
٥٧۔ كِتَابُ الْأَشْرِبَةِ وَالْحَدُّ فِيهَا ص ٦
A Muslim is a Muslim’s brother: he does not wrong him or abandon him. If anyone cares for his brother’s need, Allah will care for his need ; if anyone removes a Muslim’s anxiety, Allah will remove from him, on account of it, one of the anxieties of the Day of resurrection ; and if anyone conceals a Muslim’s fault, Allah will conceal his fault on the Day of resurrection. أَخْبَرَهُ أَنَّ رَسُولَ اللهِ ﷺ قَالَ الْمُسْلِمُ أَخُو الْمُسْلِمِ لَا يَظْلِمُهُ وَلَا يُسْلِمُهُ مَنْ كَانَ فِي حَاجَةِ أَخِيهِ كَانَ اللهُ فِي حَاجَتِهِ وَمَنْ فَرَّجَ عَنْ مُسْلِمٍ كُرْبَةً فَرَّجَ اللهُ عَنْهُ بِهَا كُرْبَةً مِنْ كُرَبِ يَوْمِ الْقِيَامَةِ وَمَنْ سَتَرَ عَلَى مُسْلِمٍ سَتَرَهُ اللهُ يَوْمَ الْقِيَامَةِ
[Machine] About the Prophet in the story of Ma'iz ibn Malik, he said to him, "O Hazal, if you had covered it with your garment, it would have been better for you than what you have done."
عَنِ النَّبِيِّ ﷺ فِي قِصَّةِ مَاعِزِ بْنِ مَالِكٍ قَالَ فِيهِ يَا هَزَّالُ لَوْ سَتَرْتَهُ بِثَوْبِكَ كَانَ خَيْرًا لَكَ مِمَّا صَنَعْتَ
[Machine] The Prophet ﷺ said, "If you had covered it with your garment, it would have been better for you like this."
لَهُ النَّبِيُّ ﷺ لَوْ كُنْتَ سَتَرْتَهُ بِثَوْبِكَ كَانَ خَيْرًا لَكَ كَذَا
[Machine] The Messenger of Allah ﷺ said to a man who had embraced Islam and was called Hazal: "If you cover him with your own garment, it would be better for you." Yahya narrated that he mentioned this hadith in a gathering which included Yazid ibn Nuaim ibn Hazal al-Aslami, who responded, "Hazal is my grandfather, and this hadith is correct. This is more authentic than what was said before."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لِرَجُلٍ مِنْ أَسْلَمَ يُدْعَى هَزَّالًا لَوْ سَتَرْتَهُ بِثَوْبِكَ لَكَانَ خَيْرًا لَكَ قَالَ يَحْيَى فَحَدَّثْتُ بِهَذَا الْحَدِيثِ فِي مَجْلِسٍ فِيهِ يَزِيدُ بْنُ نُعَيْمِ بْنِ هَزَّالٍ الْأَسْلَمِيُّ فَقَالَ هَزَّالٌ جَدِّي وَهَذَا الْحَدِيثُ حَقٌّ هَذَا أَصَحُّ مِمَّا قَبْلَهُ
[Machine] To come to the Prophet ﷺ and inform him, and Layth narrated it from Yahya ibn Sa'id, from Yazid ibn Nuaim, from his grandfather Hazal, and similarly.
أَنْ يَأْتِيَ النَّبِيَّ ﷺ فَيُخْبِرَهُ وَرَوَاهُ اللَّيْثُ عَنْ يَحْيَى بْنِ سَعِيدٍ عَنْ يَزِيدَ بْنِ نُعَيْمٍ عَنْ جَدِّهِ هَزَّالٍ وَكَذَلِكَ
The Prophet ﷺ said: He who sees something which should be kept hidden and conceals it will be like one who has brought to life a girl buried alive. (Using translation from Abū Dāʾūd 4891)
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَنْ رَأَى عَوْرَةً فَسَتَرَهَا كَانَ كَمَنْ أَحْيَا مَوْءُودَةً مِنْ قَبْرِهَا
[Machine] I heard the Messenger of Allah ﷺ saying, "Whoever conceals the faults of a believer, it is as if he revived a drowned corpse from its grave."
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَنْ سَتَرَ عَوْرَةَ مُؤْمِنٍ فَكَأَنَّمَا اسْتَحْيَا مَوْءُودَةً مِنْ قَبْرِهَا
The Prophet ﷺ said: Forgive the infliction of prescribed penalties among yourselves, for any prescribed penalty of which I hear must be carried out. (Using translation from Abū Dāʾūd 4376)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ تَعَافَوَا الْحُدُودَ فِيمَا بَيْنَكُمْ فَمَا بَلَغَنِي مِنْ حَدٍّ فَقَدْ وَجَبَ
[Machine] A man from the Muslims came to Abdullah bin Mas'ud with his drunk nephew. He mentioned the hadith about how to punish him, then said to his uncle, "By Allah, he is indeed my nephew, and I have no children of my own. I feel for him the same way I feel for my own child. But I did not neglect goodness." Abdullah said, "Indeed, Allah is Forgiving and He loves forgiveness. However, it is not appropriate for a leader to implement a punishment without establishing it first." Then he began to narrate to us from the Prophet ﷺ, who said, "The first person to have his hand cut off among the Muslims was a man from the Ansar. The Prophet ﷺ was brought to him and he had committed theft. The Prophet ﷺ said, 'Go with your companion and cut off his hand.' It was as if the face of the Prophet ﷺ became visibly upset. Then he signaled with his hand to hide it and said, 'Some of the people seem to think that this is difficult for you.' He said, 'You should not be helpers of Satan or Iblis. It is not appropriate for a leader to implement a punishment without establishing it. Allah is Forgiving and He loves forgiveness.' Then he recited the verse: 'And let them pardon and overlook.' (Quran 24:22) This narration was mentioned to us by Aḥmad, through Abū Nuʿaym, through Sufyān, through Yahyá al-Jābir, through Abū Mājid, through Abdullah, from the Prophet ﷺ, with a similar wording."
جَاءَ رَجُلٌ مِنَ الْمُسْلِمِينَ بِابْنِ أَخٍ لَهُ وَهُوَ سَكْرَانُ يَعْنِي إِلَى عَبْدِ اللهِ بْنِ مَسْعُودٍ فَذَكَرَ الْحَدِيثَ فِي كَيْفِيَّةِ جَلْدِهِ قَالَ ثُمَّ قَالَ لِعَمِّهِ بِئْسَ لَعَمْرُ اللهِ وَالِي الْيَتِيمِ أَنْتَ مَا أَدَّبْتَ فَأَحْسَنْتَ الْأَدَبَ وَلَا سَتَرْتَ الْخِزْيَةَ فَقَالَ يَا أَبَا عَبْدِ الرَّحْمَنِ أَمَا وَاللهِ إِنَّهُ لَابْنُ أَخِي وَمَا لِي وَلَدٌ وَإِنِّي لَأَجِدُ لَهُ مِنَ اللَّوْعَةِ مَا أَجِدُ لِوَلَدِي وَلَكِنْ لَمْ آلُ عَنِ الْخَيْرِ فَقَالَ عَبْدُ اللهِ إِنَّ اللهَ عَفُوٌّ يُحِبُّ الْعَفْوَ وَلَكِنْ لَا يَنْبَغِي لِوَالِي أَمْرٍ أَنْ يُؤْتَى بِحَدٍّ إِلَّا أَقَامَهُ ثُمَّ أَنْشَأَ يُحَدِّثُنَا عَنْ نَبِيِّ اللهِ ﷺ قَالَ إِنَّ أَوَّلَ رَجُلٍ قُطِعَ مِنَ الْمُسْلِمِينَ رَجُلٌ مِنَ الْأَنْصَارِ أُتِيَ بِهِ نَبِيَّ اللهِ ﷺ سَرَقَ فَقَالَ اذْهَبُوا بِصَاحِبِكُمْ فَاقْطَعُوهُ وَكَأَنَّمَا أُسِفَّ وَجْهُ نَبِيِّ اللهِ ﷺ رَمَادًا ثُمَّ أَشَارَ بِيَدِهِ يُخْفِيهِ فَقَالَ بَعْضُ الْقَوْمِ كَأَنَّ هَذَا شَقَّ عَلَيْكَ فَقَالَ لَا يَنْبَغِي أَنْ تَكُونُوا أَعْوَانَ الشَّيْطَانِ أَوْ إِبْلِيسَ فَإِنَّهُ لَا يَنْبَغِي لِوَالِي أَمْرٍ أَنْ يُؤْتَى بِحَدٍّ إِلَّا أَقَامَهُ وَاللهُ عَفُوٌّ يُحِبُّ الْعَفْوَ ثُمَّ قَرَأَ {وَلْيَعْفُوا وَلْيَصْفَحُوا} [النور 22] الْآيَةَ قَالَ 17613 وَحَدَّثَنَا أَحْمَدُ أنبأ أَبُو نُعَيْمٍ ثنا سُفْيَانُ عَنْ يَحْيَى الْجَابِرِ عَنْ أَبِي مَاجِدٍ عَنْ عَبْدِ اللهِ عَنِ النَّبِيِّ ﷺ نَحْوَهُ
[Machine] He said, "Whoever commits a sin, let them come to us so that we may purify them." So, a group came to him and he struck them. Salman al-Farisi came to him, angry, and said, "Should we make repentance for you from Allah?" He replied, "No." He then said, "Then take the whip and do not uncover what Allah has covered for you." It has been narrated to us that 'Ikrima said, "Ammar ibn Yasir had his garment stolen. He identified the thief and left him." And 'Ikrima also said, "Ibn Abbas was brought a thief who had stolen from his slave. He gave him more and released him."
أَنَّهُ قَالَ مَنْ أَذْنَبَ ذَنْبًا فَلْيَأْتِنَا فُلْنُطَهِّرْهُ فَأَتَاهُ قَوْمٌ فَضَرَبَهُمْ فَأَتَاهُ سَلْمَانُ الْفَارِسِيُّ ؓ مُغْضَبًا فَقَالَ أَجَعَلَ اللهُ إِلَيْكَ مِنَ التَّوْبَةِ شَيْئًا؟ قَالَ لَا قَالَ فَأَلْقِ السَّوْطَ وَلَا تَهْتِكْ سِتْرًا سَتَرَهُ اللهُ وَرُوِّينَا عَنْ عِكْرِمَةَ أَنَّ عَمَّارَ بْنَ يَاسِرٍ ؓ سُرِقَتْ لَهُ عَيْبَةٌ فَدُلَّ عَلَى صَاحِبِهَا فَتَرَكَهُ وَعَنْ عِكْرِمَةَ قَالَ أُتِيَ ابْنُ عَبَّاسٍ بِسَارِقٍ سَرَقَ مِنْ مَوْلَاةٍ لَهُ فَزَوَّدَهُ وَأَرْسَلَهُ
[Machine] Ali said, "I gave you advice and you ignored it, and now you have both lost. If you are truthful, we will kill your son, and if your son is truthful, we will stone you." Then Ali got up to pray, and the boy said to his mother, "Don't you see that they will either kill me or stone you? Let's go." So, they left. After Ali finished praying, he asked about them, and it was said that they had left.
عَلِيٌّ ؓ خِبْتُمَا وَخَسِرْتُمَا إِنْ تَكُونِي صَادِقَةً نَقْتُلِ ابْنَكِ وَإِنْ يَكُنِ ابْنُكِ صَادِقًا نَرْجُمْكِ ثُمَّ قَامَ عَلِيٌّ ؓ لِلصَّلَاةِ فَقَالَ الْغُلَامُ لِأُمِّهِ مَا تَنْظُرِينَ أَنْ يَقْتُلَنِي أَوْ يَرْجُمَكِ فَانْصَرَفَا فَلَمَّا صَلَّى سَأَلَ عَنْهُمَا فَقِيلَ انْطَلَقَا
57.30 [Machine] What is mentioned regarding intercession in regards to the punishments?
٥٧۔٣٠ بَابُ مَا جَاءَ فِي الشَّفَاعَةِ بِالْحُدُودِ
The Quraish were anxious about the Makhzumi woman who had committed theft, They said : Who will speak to the Messenger of Allah ﷺ about her ? Then they said: Who will be bold enough for it but Uasmah bin Zaid, the prophet’s ﷺ friend! So Usamah spoke to him, and the Messenger of Allah ﷺ said : Are you interceding regarding one of the punishments prescribed by Allah ? He then got up and gave an address, saying : What destroyed your predecessors was just that when a person of rank among them committed a theft, They left him alone , and when a weak one of them committed a theft, they inflicted the prescribed punishment on him . I swear by Allah that if Fatimah daughter of Muhammad should steal, I would have her hand cut off. (Using translation from Abū Dāʾūd 4373)
الْمَخْزُومِيَّةِ الَّتِي سَرَقَتْ فَقَالُوا مَنْ يُكَلِّمُ فِيهَا رَسُولَ اللهِ ﷺ؟ فَقَالُوا وَمَنْ يَجْتَرِئُ عَلَيْهِ إِلَّا أُسَامَةُ بْنُ زَيْدٍ حِبُّ رَسُولِ اللهِ ﷺ فَكَلَّمَهُ أُسَامَةُ فَقَالَ يَا أُسَامَةُ تَشْفَعُ فِي حَدٍّ مِنْ حُدُودِ اللهِ ثُمَّ قَامَ النَّبِيُّ ﷺ خَطِيبًا فَقَالَ إِنَّمَا أَهْلَكَ الَّذِينَ قَبْلَكُمْ أَنَّهُمْ كَانُوا إِذَا سَرَقَ فِيهُمُ الشَّرِيفُ تَرَكُوهُ وَإِذَا سَرَقَ فِيهُمُ الضَّعِيفُ أَقَامُوا عَلَيْهِ الْحَدَّ وَايْمُ اللهِ لَوْ أَنَّ فَاطِمَةَ بِنْتَ مُحَمَّدٍ سَرَقَتْ لَقَطَعْتُ يَدَهَا
[Machine] So I saw him wanting to sit with us until we said, "Come to the gathering, O Abu Abdullah." He said, "So I saw him sighing. He sat down and we became silent. None of us spoke. Then he said, 'Why are you not speaking? Do you not say SubhanAllah (Glory be to Allah) and Alhamdulillah (Praise be to Allah)? For indeed, one time is multiplied by ten, and ten times is multiplied by one hundred, and one hundred times is multiplied by one thousand, and whatever you add, Allah adds for you.' I heard the Messenger of Allah ﷺ saying, 'Whoever's intercession surpasses a limit of Allah's limit, then he has transgressed Allah in his affair. And whoever dies while he has a debt, then it is not with the dinar or dirham, but rather it is the good deeds and the bad deeds. And whoever argues in falsehood, knowingly, he remains in the wrath of Allah until he desists. And whoever says about a believer that which is not in him, then Allah lodges him in a pit of pus until he comes out of what he said.'"
فَمَا رَأَيْتُهُ أَرَادَ الْجُلُوسَ مَعَنَا حَتَّى قُلْنَا هَلُمَّ إِلَى الْمَجْلِسِ يَا أَبَا عَبْدِ الرَّحْمَنِ قَالَ فَرَأَيْتُهُ تَذَمَّمَ قَالَ فَجَلَسَ فَسَكَتْنَا فَلَمْ يَتَكَلَّمْ مِنَّا أَحَدٌ فَقَالَ مَا لَكُمْ لَا تَنْطِقُونَ أَلَا تَقُولُونَ سُبْحَانَ اللهِ وَبِحَمْدِهِ؟ فَإِنَّ الْوَاحِدَةَ بِعَشْرٍ وَالْعَشْرَ بِمِائَةٍ وَالْمِائَةَ بِأَلْفٍ وَمَا زِدْتُمْ زَادَكُمُ اللهُ سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَنْ حَالَتْ شَفَاعَتُهُ دُونَ حَدٍّ مِنْ حَدِّ اللهِ ﷻ فَقَدْ ضَادَّ اللهَ فِي أَمْرِهِ وَمَنْ مَاتَ وَعَلَيْهِ دَيْنٌ فَلَيْسَ بِالدِّينَارِ وَالدِّرْهَمِ وَلَكِنَّهَا الْحَسَنَاتُ وَالسَّيِّئَاتُ وَمَنْ خَاصَمَ فِي بَاطِلٍ وَهُوَ يَعْلَمُهُ لَمْ يَزَلْ فِي سَخَطِ اللهِ حَتَّى يَنْزِعَ وَمَنْ قَالَ فِي مُؤْمِنٍ مَا لَيْسَ فِيهِ أَسْكَنَهُ اللهُ ﷻ فِي رَدْغَةِ خَبَالٍ حَتَّى يَخْرُجَ مِمَّا قَالَ
[Machine] The Messenger of Allah ﷺ said to his companions while they were sitting, "Why do you not speak?" Whoever says, "Subhanallah wa bihamdihi" (Glory be to Allah and praise be to Him), Allah will write for him ten good deeds. And whoever says it ten times, Allah will write for him one hundred good deeds. And whoever says it one hundred times, Allah will write for him one thousand good deeds. And whoever increases beyond that, Allah will increase for him. And whoever seeks forgiveness, Allah will forgive him. And whoever intercedes beyond the limits set by Allah, he has transgressed against Allah in His judgment. And whoever falsely accuses an innocent person, Allah will turn him into a mound of dirt until he is able to provide proof for what he has said. And whoever exposes his children, Allah will disgrace him on the Day of Resurrection in front of all of creation.
قَالَ رَسُولُ اللهِ ﷺ لِأَصْحَابِهِ وَهُمْ جُلُوسٌ مَا لَكُمْ لَا تَتَكَلَّمُونَ؟ مَنْ قَالَ سُبْحَانَ اللهِ وَبِحَمْدِهِ كَتَبَ اللهُ ﷻ لَهُ عَشْرَ حَسَنَاتٍ وَمَنْ قَالَهَا عَشْرًا كَتَبَ اللهُ لَهُ مِائَةَ حَسَنَةٍ وَمَنْ قَالَهَا مِائَةَ مَرَّةٍ كَتَبَ اللهُ لَهُ أَلْفَ حَسَنَةٍ وَمَنْ زَادَ زَادَهُ اللهُ وَمَنِ اسْتَغْفَرَ غَفَرَ اللهُ لَهُ وَمَنْ حَالَتْ شَفَاعَتُهُ دُونَ حَدٍّ مِنْ حُدُودِ اللهِ فَقَدْ ضَادَّ اللهَ فِي حُكْمِهِ وَمَنِ اتَّهَمَ بَرِيئًا صَيَّرَهُ اللهُ إِلَى طِينَةِ الْخَبَالِ حَتَّى يَأْتِيَ بِالْمَخْرَجِ مِمَّا قَالَ وَمَنِ انْتَفَى مِنْ وَلَدِهِ يَفْضَحُهُ بِهِ فِي الدُّنْيَا فَضَحَهُ اللهُ عَلَى رُءُوسِ الْخَلَائِقِ يَوْمَ الْقِيَامَةِ
[Machine] Advocate for justice in matters that have not reached the ruler, but when the ruler becomes aware, do not intercede.
اشْفَعُوا فِي الْحُدُودِ مَا لَمْ تَبْلُغِ السُّلْطَانَ فَإِذَا بَلَغَتِ السُّلْطَانَ فَلَا تَشْفَعُوا
[Machine] Al-Zubair passed by us, and we had arrested a thief, so he started interceding for him. He said, "Send him away." We said, "O Abu Abdullah, are you commanding us to send him away?" He said, "Indeed, that is done without the authority. But once it reaches the authority, may Allah not forgive him if he forgives him."
مَرَّ عَلَيْنَا الزُّبَيْرُ ؓ وَقَدْ أَخَذْنَا سَارِقًا فَجَعَلَ يَشْفَعُ لَهُ فَقَالَ أَرْسِلُوهُ قَالَ قُلْنَا يَا أَبَا عَبْدِ اللهِ تَأْمُرُنَا أَنْ نُرْسِلَهُ؟ قَالَ إِنَّ ذَلِكَ يُفْعَلُ دُونَ السُّلْطَانِ فَإِذَا بَلَغَ السُّلْطَانَ فَلَا أَعْفَاهُ اللهُ إِنْ أَعْفَاهُ
57.31 [Machine] The man confesses to a boundary that he does not name, so the Imam hides it.
٥٧۔٣١ بَابُ الرَّجُلِ يَعْتَرِفُ بِحَدٍّ لَا يُسَمِّيهِ فَيَسْتُرُهُ الْإِمَامُ
[Machine] I was with the Prophet ﷺ when a man came to him and said, "O Messenger of Allah, I have committed a sin, so establish the punishment on me." The Prophet did not ask him about it. Then the prayer was held, so he prayed with the Prophet ﷺ . When the Prophet ﷺ finished the prayer, the man came to him and said, "O Messenger of Allah, I have committed a sin, so establish the punishment on me according to the Book of Allah." The Prophet ﷺ said, "Didn't you pray with us?" He said, "Yes." The Prophet ﷺ said, "Indeed, Allah has forgiven your sin."
كُنْتُ مَعَ النَّبِيِّ ﷺ فَجَاءَهُ رَجُلٌ فَقَالَ يَا رَسُولَ اللهِ إِنِّي أَصَبْتُ حَدًّا فَأَقِمْهُ عَلَيَّ قَالَ وَلَمْ يَسْأَلْهُ عَنْهُ فَحَضَرَتِ الصَّلَاةُ قَالَ فَصَلَّى مَعَ النَّبِيِّ ﷺ فَلَمَّا قَضَى النَّبِيُّ ﷺ الصَّلَاةَ قَامَ إِلَيْهِ الرَّجُلُ فَقَالَ يَا رَسُولَ اللهِ إِنِّي قَدْ أَصَبْتُ حَدًّا فَأَقِمْ عَلَيَّ كِتَابَ اللهِ قَالَ أَلَيْسَ قَدْ صَلَّيْتَ مَعَنَا؟ قَالَ نَعَمْ قَالَ فَإِنَّ اللهَ قَدْ غَفَرَ لَكَ ذَنْبَكَ
57.32 [Machine] What was mentioned in the prohibition of espionage
٥٧۔٣٢ بَابُ مَا جَاءَ فِي النَّهْيِ عَنِ التَّجَسُّسِ
Avoid suspicion, for suspicion is the gravest lie in talk and do not be inquisitive about one another and do not spy upon one another and do not feel envy with the other, and nurse no malice, and nurse no aversion and hostility against one another. And be fellow-brothers and servants of Allah. (Using translation from Muslim 2563a)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ إِيَّاكُمْ وَالظَّنَّ فَإِنَّ الظَّنَّ أَكْذَبُ الْحَدِيثِ وَلَا تَجَسَّسُوا وَلَا تَحَسَّسُوا وَلَا تَنَافَسُوا وَلَا تَحَاسَدُوا وَلَا تَبَاغَضُوا وَلَا تَدَابَرُوا وَكُونُوا عِبَادَ اللهِ إِخْوَانًا
I heard the Messenger of Allah ﷺ say: If you search for the faults of the people, you will corrupt them, or will nearly corrupt them. AbudDarda' said: These are the words which Mu'awiyah himself from the Messenger of Allah ﷺ, and Allah benefited him by them. (Using translation from Abū Dāʾūd 4888)
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ إِنَّكَ إِنِ اتَّبَعْتَ عَوْرَاتِ النَّاسِ أَوْ عَثَرَاتِ النَّاسِ أَفْسَدْتَهُمْ أَوْ كِدْتَ أَنْ تُفْسِدَهُمْ قَالَ يَقُولُ أَبُو الدَّرْدَاءِ كَلِمَةٌ سَمِعَهَا مُعَاوِيَةُ مِنْ رَسُولِ اللهِ ﷺ فَنَفَعَهُ اللهُ بِهَا
The Prophet ﷺ said: When a ruler seeks to make imputations against the people, he corrupts them. (Using translation from Abū Dāʾūd 4889)
عَنِ النَّبِيِّ ﷺ قَالَ إِنَّ الْأَمِيرَ إِذَا ابْتَغَى الرِّيبَةَ فِي النَّاسِ أَفْسَدَهُمْ
[Machine] "Abdul Rahman, I see that we have done what Allah has forbidden, 'and do not spy' (Surah Al-Hujurat, verse 12). Indeed, we have spied on them, so Umar withdrew from them and left them."
عَبْدُ الرَّحْمَنِ أَرَى قَدْ أَتَيْنَا مَا نَهَى الله عَنْهُ {وَلَا تَجَسَّسُوا} [الحجرات 12] فَقَدْ تَجَسَّسْنَا فَانْصَرَفَ عَنْهُمْ عُمَرُ ؓ وَتَرَكَهُمْ
[Machine] It was said to Abdullah, "Do you have any wine dripping from the beard of so-and-so?" He replied, "Indeed, Allah has forbidden us from spying, but if it becomes apparent to us, then we will take action."
قِيلَ لِعَبْدِ اللهِ هَلْ لَكَ فِي فُلَانٍ تَقْطُرُ لِحْيَتُهُ خَمْرًا؟ فَقَالَ إِنَّ اللهَ قَدْ نَهَانَا أَنْ نَتَجَسَّسَ فَإِنْ يَظْهَرْ لَنَا نَأْخُذْهُ
57.33 [Machine] The imam pardons the shortcomings of those with disabilities as long as they do not exceed a limit.
٥٧۔٣٣ بَابُ الْإِمَامِ يَعْفُو عَنْ ذَوِي الْهَيْئَاتِ زَلَّاتِهِمْ مَا لَمْ تَكُنْ حَدًّا
[Machine] The Messenger of Allah ﷺ said, "Lessen the mistakes of those who have disabilities."
قَالَ رَسُولُ اللهِ ﷺ أَقِيلُوا ذَوِي الْهَيْئَاتِ زَلَّاتِهِمْ
[Machine] She said, the Prophet ﷺ said, "Lessen the punishment for those with disabilities, except for a limit from Allah's limits, and likewise."
أَنَّهَا قَالَتْ قَالَ النَّبِيُّ ﷺ أَقِيلُوا ذَوِي الْهَيْئَاتِ عَثَرَاتِهِمْ إِلَّا حَدًّا مِنْ حُدُودِ اللهِ وَكَذَلِكَ
[Machine] "Al-Shafi'i and those with similar demeanors, who are said to stumble, even though they are not known for evil, one of them may slip up."
قَالَ الشَّافِعِيُّ وَذَوُوُ الْهَيْئَاتِ الَّذِينَ يُقَالُونَ عَثَرَاتِهِمُ الَّذِينَ لَيْسُوا يُعْرَفُونَ بِالشَّرِّ فَيَزِلُّ أَحَدُهُمُ الزَّلَّةَ
57.34 [Machine] The Battle of the Apostasy and what they have obtained from the belongings of the Muslims in their hands.
٥٧۔٣٤ بَابُ قِتَالِ أَهْلِ الرِّدَّةِ وَمَا أُصِيبَ فِي أَيْدِيهِمْ مِنْ مَتَاعِ الْمُسْلِمِينَ
[Machine] He will meet Khālid with those who remain with him from the people in the region of Khaybar, and that is not what he intended. It was only a trap that was revealed by his cunning, which he was more skillful with than Khālid. So Khālid went on until he met him and Ṭulayḥah on the day of Buẓākhah, by a water of Banī Asad called Qaṭan. 'Uyaynah bin Badr was also with him at seven hundred from Fazārah. When the war shook him, Ṭulayḥah would come to him and ask, "Has Gabriel come to you yet, O father?" He would say, "No, by Allah." He would then ask, "What does he want from you?" He said, "By Allah, we have made efforts until he came to me once." So he asked him and he said, "Yes, he has come to me." He said, "You have a millstone, like the one I have, and a conversation that you should not forget." He said, "I think that Allah knew that there would be a conversation that you would not forget, O sons of Fazārah. So go on with your affairs." The Shaykh, may Allah have mercy on him, said, "It has been narrated to us in the book of the battles of the rebels, from az-Zuhrī, the killing of Ṭulayḥah, 'Ukkāshah bin Miḥṣan, and Thābit bin Aqram, in this matter, and his embracing Islam when the truth prevailed and his performing the 'umrah, and his passing by Abū Bakr in Madīnah. But it has not reached us that he narrated anything from him or compelled him to accept faith."
أَنَّهُ سَيَلْقَى خَالِدًا بِمَنْ بَقِيَ مَعَهُ مِنَ النَّاسِ فِي نَاحِيَةِ خَيْبَرَ وَمَا يُرِيدُ ذَلِكَ إِنَّمَا أَظْهَرَهُ مَكِيدَةً قَدْ كَانَ أَوْعَبَ مَعَ خَالِدٍ بِالنَّاسِ فَمَضَى خَالِدٌ حَتَّى الْتَقَى هُوَ وَطُلَيْحَةُ فِي يَوْمِ بُزَاخَةَ عَلَى مَاءٍ مِنْ مِيَاهِ بَنِي أَسَدٍ يُقَالُ لَهُ قَطَنٌ وَقَدْ كَانَ مَعَهُ عُيَيْنَةُ بْنُ بَدْرٍ فِي سَبْعمِائَةٍ مِنْ فَزَارَةَ فَكَانَ حِينَ هَزَّتْهُ الْحَرْبُ يَأْتِي طُلَيْحَةَ فَيَقُولُ لَا أَبَا لَكَ هَلْ جَاءَكَ جِبْرِيلُ بَعْدُ؟ فَيَقُولُ لَا وَاللهِ فَيَقُولُ لَهُ مَا يُنْظِرُهُ؟ فَقَدْ وَاللهِ جَهَدْنَا حَتَّى جَاءَهُ مَرَّةً فَسَأَلَهُ فَقَالَ نَعَمْ قَدْ جَاءَنِي فَقَالَ إِنَّ لَكَ رَحًى كَرَحَاهُ وَحَدِيثًا لَا تَنْسَاهُ فَقَالَ أَظُنُّ قَدْ عَلِمَ اللهُ أَنَّهُ سَيَكُونُ لَكَ حَدِيثٌ لَا تَنْسَاهُ هَذَا وَاللهِ يَا بَنِي فَزَارَةَ كَذَّابٌ فَانْطَلِقُوا لِشَأْنِكُمْ قَالَ الشَّيْخُ رَحِمَهُ اللهُ وَقَدْ رُوِّينَا فِي كِتَابِ قِتَالِ أَهْلِ الْبَغِيِّ عَنِ الزُّهْرِيِّ قَتْلَ طُلَيْحَةَ عُكَّاشَةَ بْنَ مِحْصَنٍ وَثَابِتَ بْنَ أَقْرَمَ فِي هَذَا الْوَجْهِ ثُمَّ إِسْلَامَهُ حِينَ غَلَبَ الْحَقُّ وَإِحْرَامَهُ بِالْعُمْرَةِ وَمُرُورَهُ بِأَبِي بَكْرٍ ؓ بِالْمَدِينَةِ وَلَمْ يَبْلُغْنَا أَنَّهُ أَقَادَ مِنْهُ أَوْ أَلْزَمَهُ الْعَقْلَ
[Machine] From Abu Abdullah Al-Hafith, who I think, from what I have heard, or else in what he authorized me, that Aba Abdullah Al-Asbahani informed them that Al-Hassan ibn Al-Jahm narrated to them that Al-Hussein ibn Al-Faraj narrated to him from Al-Waqidi, who told me that Muhammad ibn Musa ibn Muhammad ibn Ibrahim Al-Taymi narrated from his father, who said: When the defeat occurred in the army of Tuleiha, he left among the defeated people until he reached Sham, then he arrived during the caliphate of Umar in Makkah. When Umar saw him, he said: "O Tuleiha, I don't love you after you killed the two righteous men, Ukasha ibn Mihsan and Thabit ibn Aqram." He replied: "O Amir Al-Mu'minin, may Allah honor them with my hands and not humiliate them with his hands. Not all houses are built upon love, but a beautiful face. Indeed, people shake hands with each other over hatred." And Tuleiha embraced Islam in a valid manner.
عَنْ أَبِي عَبْدِ اللهِ الْحَافِظِ وَأَظُنُّهُ فِيمَا سَمِعْتُهُ وَإِلَّا فَهُوَ فِيمَا أَجَازَ لِي أَنَّ أَبَا عَبْدِ اللهِ الْأَصْبَهَانِيَّ أَخْبَرَهُمْ أنبأ الْحَسَنُ بْنُ الْجَهْمِ ثنا الْحُسَيْنُ بْنُ الْفَرَجِ ثنا الْوَاقِدِيُّ حَدَّثَنِي مُحَمَّدُ بْنُ مُوسَى بْنِ مُحَمَّدِ بْنِ إِبْرَاهِيمَ التَّيْمِيُّ عَنْ أَبِيهِ قَالَ لَمَّا وَقَعَتِ الْهَزِيمَةُ فِي عَسْكَرِ طُلَيْحَةَ خَرَجَ فِي النَّاسِ مُنْهَزِمًا حَتَّى قَدِمَ الشَّامَ ثُمَّ قَدِمَ فِي خِلَافَةِ عُمَرَ ؓ مَكَّةَ فَلَمَّا رَآهُ عُمَرُ ؓ قَالَ يَا طُلَيْحَةُ لَا أُحِبُّكَ بَعْدَ قَتْلِكَ الرَّجُلَيْنِ الصَّالِحَيْنِ عُكَّاشَةَ بْنَ مِحْصَنٍ وَثَابِتَ بْنَ أَقْرَمَ فَقَالَ يَا أَمِيرَ الْمُؤْمِنِينَ أَكْرَمَهُمَا اللهُ بِيَدِي وَلَمْ يُهِنِّي بِأَيْدِيهِمَا وَمَا كُلُّ الْبُيُوتِ بُنِيَتْ عَلَى الْحُبِّ وَلَكِنْ صَفْحَةٌ جَمِيلَةٌ فَإِنَّ النَّاسَ يَتَصَافَحُونَ عَلَى الشَّنَآنِ وَأَسْلَمَ طُلَيْحَةُ إِسْلَامًا صَحِيحًا
[Machine] A delegation of Buzakhah, Asad, and Ghatafan came to Abu Bakr to ask for a peace agreement. Abu Bakr gave them the option between an honorable war or a disgraceful peace. They asked what is a disgraceful peace. Abu Bakr replied, "You will give us your horses and armor, and leave behind people who follow the tails of camels, until Allah shows His Prophet's caliphate and the Muslims an excuse to fight against you. And you kill our people, and we kill your people in Paradise, and you reject what we have taken from you and claim what we have gained from you." Umar then said, "You have seen an opinion, and we will inform you. If they give us their horses and armor, then that is what you have seen. And if they leave behind people who follow the tails of camels, until Allah shows His Prophet's caliphate and the Muslims an excuse to fight against them, then that is what you have seen. And if we take what we have gained from them and they reject what we have taken from them, then that is what you have seen. And if they kill our people in the Fire and we kill their people in Paradise, then that is what you have seen. And if they pay for our dead, then there is no killing, they were killed on the command of Allah, so they have no payment. And people followed that." Sheikh Rahimahullah said, "The words of Umar ibn Al-Khattab about wealth do not contradict his words about blood. He only intended by them, and Allah knows best, what has been destroyed in their hands of the best wealth of the Muslims. They do not include what they have destroyed."
جَاءَ وَفْدُ بُزَاخَةَ أَسَدٍ وَغَطَفَانَ إِلَى أَبِي بَكْرٍ ؓ يَسْأَلُونَهُ الصُّلْحَ فَخَيَّرَهُمْ أَبُو بَكْرٍ ؓ بَيْنَ الْحَرْبِ الْمُجْلِيَةِ أَوِ السَّلْمِ الْمُخْزِيَةِ قَالَ فَقَالُوا هَذَا الْحَرْبُ الْمُجْلِيَةُ قَدْ عَرَفْنَا فَمَا السَّلْمُ الْمُخْزِيَةُ؟ قَالَ أَبُو بَكْرٍ ؓ تُؤَدُّونَ الْحَلْقَةَ وَالْكُرَاعَ وَتَتْرُكُونَ أَقْوَامًا تَتَّبِعُونَ أَذْنَابَ الْإِبِلِ حَتَّى يُرِيَ اللهُ خَلِيفَةَ نَبِيِّهِ وَالْمُسْلِمِينَ أَمْرًا يَعْذِرُونَكُمْ بِهِ وَتَدُونَ قَتْلَانَا وَلَا نَدِي قَتْلَاكُمْ وَقَتْلَانَا فِي الْجَنَّةِ وَقَتْلَاكُمْ فِي النَّارِ وَتَرُدُّونَ مَا أَصَبْتُمْ مِنَّا وَنَغْنَمُ مَا أَصَبْنَا مِنْكُمْ قَالَ فَقَالَ عُمَرُ ؓ قَدْ رَأَيْتَ رَأْيًا وَسَنُشِيرُ عَلَيْكَ أَمَّا أَنْ يُؤَدُّوا الْحَلْقَةَ وَالْكُرَاعَ فَنِعِمَّا رَأَيْتَ وَأَمَّا أَنْ يَتْرُكُوا قَوْمًا يَتَّبِعُونَ أَذْنَابَ الْإِبِلِ حَتَّى يُرِيَ اللهُ خَلِيفَةَ نَبِيِّهِ وَالْمُسْلِمِينَ أَمْرًا يَعْذِرُونَهُمْ بِهِ فَنِعِمَّا رَأَيْتَ وَأَمَّا أَنْ نَغْنَمَ مَا أَصَبْنَا مِنْهُمْ وَيَرُدُّونَ مَا أَصَابُوا مِنَّا فَنِعِمَّا رَأَيْتَ وَأَمَّا أَنَّ قَتْلَاهُمْ فِي النَّارِ وَقَتْلَانَا فِي الْجَنَّةِ فَنِعِمَّا رَأَيْتَ وَأَمَّا أَنْ يَدُوا قَتْلَانَا فَلَا قَتْلَانَا قُتِلُوا عَلَى أَمْرِ اللهِ فَلَا دِيَاتَ لَهُمْ فَتَتَابَعَ النَّاسُ عَلَى ذَلِكَ قَالَ الشَّيْخُ رَحِمَهُ اللهُ وَقَوْلُ عُمَرَ بْنِ الْخَطَّابِ ؓ فِي الْأَمْوَالِ لَا يُخَالِفُ قَوْلَهُ فِي الدِّمَاءِ فَإِنَّهُ إِنَّمَا أَرَادَ بِهِ وَاللهُ أَعْلَمُ مَا أُصِيبَ فِي أَيْدِيهِمْ مِنْ أَعْيَانِ أَمْوَالِ الْمُسْلِمِينَ لَا تَضْمِينَ مَا أَتْلَفُوا
57.35 [Machine] What is included in the prohibition of a person himself, his women, and his wealth
٥٧۔٣٥ بَابُ مَا جَاءَ فِي مَنْعِ الرَّجُلِ نَفْسَهُ وَحَرِيمَهُ وَمَالَهُ
[Machine] The Messenger of Allah ﷺ said, "Whoever is afflicted in his wealth is a martyr, and whoever is afflicted in his family is a martyr, and whoever is afflicted in his religion is a martyr."
قَالَ رَسُولُ اللهِ ﷺ مَنْ أُصِيبَ دُونَ مَالِهِ فَهُوَ شَهِيدٌ وَمَنْ أُصِيبَ دُونَ أَهْلِهِ فَهُوَ شَهِيدٌ وَمَنْ أُصِيبَ دُونَ دِينِهِ فَهُوَ شَهِيدٌ
[Machine] "He said: I heard the Messenger of Allah ﷺ saying, 'Whoever is killed unjustly while defending his wealth, then Paradise is his. Their statements are the same.'"
أَنَّهُ قَالَ سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَنْ قُتِلَ دُونَ مَالِهِ مَظْلُومًا فَلَهُ الْجَنَّةُ لَفْظُهُمَا وَاحِدٌ
[Machine] That the Messenger of Allah ﷺ said, "Whoever is killed defending his wealth, he is a martyr."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنْ قُتِلَ دُونَ مَالِهِ فَهُوَ شَهِيدٌ
ʿwhoever is killed defending his wealth is a martyr.ʿ (Using translation from Aḥmad 590)
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَنْ قُتِلَ دُونَ مَالِهِ فَهُوَ شَهِيدٌ
A person came to the Messenger of Allah ﷺ and said: Messenger of Allah, what do you think if a man comes to me in order to appropriate my possession? He (the Holy Prophet) said: Don't surrender your possession to him. He (the inquirer) said: If he fights me? He (the Holy Prophet) remarked: Then fight (with him). He (the inquirer) again said: What do you think if I am killed? He (the Holy Prophet) observed: You would be a martyr. He (the inquirer) said: What do you think of him (Messenger of Allah) If I kill him. He (the Holy Prophet) said: he would be in the Fire. (Using translation from Muslim 140)
أَنَّ رَجُلًا جَاءَ إِلَى النَّبِيِّ ﷺ فَقَالَ يَا رَسُولَ اللهِ أَرَأَيْتَ إِنْ جَاءَنِي رَجُلٌ يُرِيدُ أَخْذَ مَالِي؟ قَالَ قَالَ فَلَا تُعْطِهِ مَالَكَ قَالَ فَرَأَيْتَ إِنْ قَاتَلَنِي؟ قَالَ فَقَاتِلْهُ قَالَ أَرَأَيْتَ إِنْ قَتَلَنِي؟ قَالَ فَأَنْتَ شَهِيدٌ قَالَ فَرَأَيْتَ إِنْ قَتَلْتُهُ؟ قَالَ هُوَ فِي النَّارِ
[Machine] A man came to the Prophet ﷺ and said, "O Prophet of Allah, there is a person who intends to harm me. What should I do?" The Prophet said, "Seek help from Allah." The man then asked, "What if I seek his help, but he refuses to stop?" The Prophet replied, "Seek help from the Muslim community." The man asked, "O Prophet of Allah, what if there is no one from the Muslim community to help me?" The Prophet said, "Then seek help from the rulers." The man asked, "O Prophet of Allah, what if I don't have any ruler to seek help from?" The Prophet said, "Fight against him. If he kills you, you will be a martyr in the hereafter, and if he is killed, you will have prevented him from taking your property."
جَاءَ رَجُلٌ إِلَى النَّبِيِّ ﷺ فَقَالَ يَا نَبِيَّ اللهِ آتٍ أَتَانِي يُرِيدُ أَنْ يَبُزَّنِي فَمَا أَصْنَعُ بِهِ؟ قَالَ تُنَاشِدُهُ اللهَ قَالَ أَرَأَيْتَ إِنْ نَاشَدْتُهُ فَأَبَى أَنْ يَنْتَهِيَ؟ قَالَ تَسْتَعِينُ الْمُسْلِمِينَ قَالَ يَا نَبِيَّ اللهِ أَرَأَيْتَ إِنْ لَمْ يَكُنْ أَحَدٌ مِنَ الْمُسْلِمِينَ أَسْتَعِينُهُ عَلَيْهِ؟ قَالَ اسْتَغَثْتَ السُّلْطَانَ قَالَ يَا نَبِيَّ اللهِ أَرَأَيْتَ إِنْ لَمْ يَكُنْ عِنْدِي سُلْطَانٌ أَسْتَغِيثُهُ عَلَيْهِ؟ قَالَ فَقَاتِلْه فَإِنْ قَتَلَكَ كُنْتَ فِي شُهَدَاءِ الْآخَرَةِ وَإِلَّا مَنَعْتَ مَالَكَ
[Machine] A questioner asked the Prophet ﷺ, "O Messenger of Allah, what should I do if someone wrongs me?" The Prophet ﷺ replied, "Remind him of Allah and command him to remember Him three times. If he refuses, then fight against him. And if he kills you, then you will be in Paradise. But if you kill him, then he will be in Hell."
سَأَلَ سَائِلٌ النَّبِيَّ ﷺ فَقَالَ يَا رَسُولَ اللهِ إِنْ عَدَا عَلَيَّ عَادٍ؟ فَقَالَ لَهُ النَّبِيُّ ﷺ ذَكِّرْهُ بِاللهِ وَأَمَرَهُ بِتَذْكِيرِهِ ثَلَاثَ مَرَّاتٍ فَإِنْ أَبَى فَقَاتِلْهُ فَإِنْ قَتَلَكَ فَإِنَّكَ فِي الْجَنَّةِ وَإِنْ قَتَلْتَهُ فَإِنَّهُ فِي النَّارِ كَذَا قَالَ
"A man came to the Messenger of Allah [SAW] and said: 'O Messenger of Allah, what do you think if someone comes to steal my wealth?' He said: 'Urge him by Allah.' He said: 'What if he persists?' He said: 'Urge him by Allah.' He said: 'What if he persists?' He said: 'Urge him by Allah.' He said: 'What if he persists?' He said: 'Then fight. If you are killed you will be in Paradise, and if you kill him, he will be in the Fire.'" (Using translation from Nasāʾī 4082)
أَنَّ رَجُلًا جَاءَ رَسُولَ اللهِ ﷺ فَقَالَ يَا رَسُولَ اللهِ إِنْ عُدِيَ عَلَى مَالِي؟ قَالَ فَانْشُدِ اللهَ قَالَ فَإِنْ أَبَوْا؟ قَالَ فَانْشُدِ اللهَ قَالَ فَإِنْ أَبَوْا؟ قَالَ فَانْشُدِ اللهَ قَالَ فَإِنْ أَبَوْا عَلَيَّ قَالَ فَقَاتِلْ فَإِنْ قُتِلْتَ فَفِي الْجَنَّةِ وَإِنْ قُتِلَ فَفِي النَّارِ كَذَا وَجَدْتُهُ وَالصَّوَابُ عَنِ ابْنِ الْهَادِ عَنْ عَمْرِو بْنِ أَبِي عَمْرٍو عَنْ قُهَيْدٍ
57.36 [Machine] What causes the scissors to fall deliberately?
٥٧۔٣٦ بَابُ مَا يُسْقِطُ الْقِصَاصَ مِنَ الْعَمْدِ
[Machine] I participated in the battle of Al-'Usrah with the Messenger of Allah ﷺ . It was one of my most diligent efforts and I had a companion who was fighting against another man. The companion bit his opponent, causing him to let go of his finger, and his thumb fell off. He then came to the Prophet ﷺ and he criticized his action, saying that he feared that Sa'd would say something. The Prophet ﷺ said, "Does he have his hand in your mouth, so you bite it off like a male camel?"
غَزَوْتُ مَعَ رَسُولِ اللهِ ﷺ غَزْوَةَ الْعُسْرَةِ وَكَانَتْ أَوْثَقَ أَعْمَالِي فِي نَفْسِي وَكَانَ لِي أَجِيرٌ فَقَاتَلَ إِنْسَانًا فَعَضَّ أَحَدُهُمَا صَاحِبَهُ فَانْتَزَعَ أُصْبُعَهُ فَسَقَطَتْ ثَنِيَّتُهُ فَجَاءَ إِلَى النَّبِيِّ ﷺ فَأَهْدَرَ ثَنِيَّتَهُ قَالَ عَطَاءٌ فَخَشِيتُ أَنَّ صَفْوَانَ قَالَ قَالَ رَسُولُ اللهِ ﷺ أَيَدَعُ يَدَهُ فِي فِيكِ فَتَقْضِمَهَا كَقَضْمِ الْفَحْلِ
[Machine] A man fought with another man and bit him, causing his finger to be severed and tooth to be dislodged. They then went to Abu Bakr As-Siddiq, who dismissed the matter.
أَنَّ رَجُلًا قَاتَلَ آخَرَ فَعَضَّهُ فَانْتَزَعَ أُصْبُعَهُ وَانْتُزِعَتْ سِنَّةٌ فَأَتَيَا أَبَا بَكْرٍ الصِّدِّيقَ ؓ فَأَهْدَرَهُ
[Machine] A man bit the hand of another man, so the bitten man pulled his hand out forcefully causing his two fingers to fall off. They then argued before the Prophet Muhammad ﷺ, and he said, "Let not any one of you bite his brother like a male camel bites, for there is no compensation for you."
أَنَّ رَجُلًا عَضَّ يَدَ رَجُلٍ فَنَزَعَ يَدَهُ مِنْ فِيهِ فَوَقَعَتْ ثَنِيَّتَاهُ فَاخْتَصَمُوا إِلَى النَّبِيِّ ﷺ فَقَالَ يَعَضُّ أَحَدُكُمْ أَخَاهُ كَمَا يَعَضُّ الْفَحْلُ لَا دِيَةَ لَكَ
57.37 [Machine] The man finds another man with his wife, so he kills him.
٥٧۔٣٧ بَابُ: الرَّجُلُ يَجِدُ مَعَ امْرَأَتِهِ الرَّجُلَ فَيَقْتُلُهُ
[Machine] "O Messenger of Allah, what if I find another man with my wife and I give him a chance until I bring forth four witnesses?" The Messenger of Allah ﷺ said, "Yes."
يَا رَسُولَ اللهِ أَرَأَيْتَ إِنْ وَجَدْتُ مَعَ امْرَأَتِي رَجُلًا أُمْهِلُهُ حَتَّى آتِيَ بِأَرْبَعَةِ شُهَدَاءَ؟ فَقَالَ رَسُولُ اللهِ ﷺ نَعَمْ
That Sa'd b. 'Ubadah said: Messenger of Allah! If a man finds a man with his wife, should he kill him ? The Messenger of Allah ﷺ said: No. Sa'd : Why not, by Him who has honoured you with truth ? The Prophet ﷺ said: Listen to what your chief is saying. The narrator 'Abd al-Wahhab said: (Listen) to what Sa'd is saying. (Using translation from Abū Dāʾūd 4532)
يَا رَسُولَ اللهِ الرَّجُلُ يَجِدُ مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ؟ قَالَ رَسُولُ اللهِ ﷺ لَا قَالَ سَعْدٌ بَلَى وَالَّذِي أَكْرَمَكَ بِالْحَقِّ فَقَالَ رَسُولُ اللهِ ﷺ اسْمَعُوا إِلَى مَا يَقُولُ سَيِّدُكُمْ
"We were in the mosque one Friday night when a man said: 'If a man finds a man with his wife and kills him, will you kill him, and if he speaks,will you flog him. By Allah I will mention that to the Prophet ﷺ. So he mentioned that to the Prophet ﷺ, and Allah revealed the Verses of Li'an. Then after that the man came and accused his wife, so the Prophet ﷺ told them to go through the procedure of Li'an and he said: 'Perhaps she will give birth to a black child.’ Then she gave birth to a black child with curly hair." أَنَّ رَجُلًا وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا فَقَتَلَهُ قَتَلْتُمُوهُ وَإِنْ تَكَلَّمَ بِهِ جَلَدْتُمُوهُ لَأَذْكُرَنَّ ذَلِكَ لِرَسُولِ اللهِ ﷺ قَالَ فَذَكَرَهُ لِلنَّبِيِّ ﷺ فَأَنْزَلَ اللهُ ﷻ آيَاتِ اللِّعَانِ ثُمَّ جَاءَ الرَّجُلُ فَقَذَفَ امْرَأَتَهُ فَلَاعَنَ رَسُولُ اللهِ ﷺ بَيْنَهُمَا وَقَالَ عَسَى أَنْ تَجِيءَ بِهِ أَسْوَدَ جَعْدًا فَجَاءَتْ بِهِ أَسْوَدَ جَعْدًا
[Machine] Ali, indeed, this is something that has never happened on my land. I have resolved to inform you of it. So Abu Musa wrote to Muawiya bin Abi Sufyan about it. Then Ali said, "I am Abu Hassan. If he does not bring four witnesses, then he should be punished according to his confession."
عَلِيٌّ إِنَّ هَذَا لَشَيْءٌ لَمْ يَكُنْ بِأَرْضِي عَزَمْتُ عَلَيْكَ لَتُخْبِرَنِّي فَقَالَ أَبُو مُوسَى كَتَبَ إِلِيَّ مُعَاوِيَةُ بْنُ أَبِي سُفْيَانَ فِي ذَلِكَ فَقَالَ عَلِيٌّ ؓ أَنَا أَبُو حَسَنٍ إِنْ لَمْ يَأْتِ بِأَرْبَعَةِ شُهَدَاءَ فَلْيُعْطَ بِرُمَّتِهِ
[Machine] Once, there was a man among the Arabs who had some guests, so he slaughtered a sheep for them. He had two daughters, and he told one of them, "Go and bring me something." She left, and when she was far away, one of the guests followed her and tried to seduce her. She said to him, "Fear God," and she pleaded with him, but he did not listen to her. So she said to him, "Wait until I ask permission for you." She went away and slept. Then she came back with a rock and struck him in the head, killing him. She went to her father and informed him of what had happened. Her father told her, "Keep silent and don't tell anyone." He prepared the food and placed it in front of his guests, telling them to eat. They replied, "We will wait until our companion comes." But the father said, "Eat, for he will come to you." When they finished eating, they praised and thanked God, saying, "He was cunning and deceptive." They said to the father, "O enemy of Allah, you have killed our companion. By Allah, we will kill you with it (referring to the rock)." They went to Umar and said, "What was the name of your companion?" They replied, "He was absentminded." Umar said, "That is his name, and his blood is invalid. This is a matter sent to me."
أَنَّ رَجُلًا كَانَ مِنَ الْعَرَبِ نَزَلَ عَلَيْهِ نَفَرٌ فَذَبَحَ لَهُمْ شَاةً وَلَهُ ابْنَتَانِ فَقَالَ لِإِحْدَاهُمَا اذْهَبِي فَاحْتَطِبِي قَالَ فَذَهَبَتْ فَلَمَّا تَبَاعَدَتْ تَبِعَهَا أَحَدُهُمْ فَرَاوَدَهَا عَنْ نَفْسِهَا فَقَالَتِ اتَّقِ اللهَ وَنَاشَدَتْهُ فَأَبَى عَلَيْهَا فَقَالَتْ رُوَيْدَكَ حَتَّى أَسْتَصْلِحَ لَكَ فَذَهَبَتْ وَنَامَ فَجَاءَتْ بِصَخْرَةٍ فَفَلَقَتْ رَأْسَهُ فَقَتَلَتْهُ فَجَاءَتْ إِلَى أَبِيهَا فَأَخْبَرَتْهُ الْخَبَرَ فَقَالَ اسْكُتِي لَا تُخْبِرِي أَحَدًا فَهَيَّأَ الطَّعَامَ فَوَضَعَهُ بَيْنَ يَدَيْ أَصْحَابِهِ فَقَالَ لِأَصْحَابِهِ كُلُوا فَقَالُوا حَتَّى يَجِيءَ صَاحِبُنَا فَقَالَ كُلُوا فَإِنَّهُ سَيَأْتِيكُمْ فَلَمَّا أَكَلُوا حَمِدَ اللهَ وَأَثْنَى عَلَيْهِ وَقَالَ إِنَّهُ كَانَ مِنَ الْأَمْرِ كَيْتَ وَكَيْتَ فَقَالُوا يَا عَدُوَّ اللهِ قَتَلْتَ صَاحِبَنَا وَاللهِ لَنَقْتُلَنَّكَ بِهِ فَارْتَفَعُوا إِلَى عُمَرَ ؓ فَقَالَ مَا كَانَ اسْمُ صَاحِبِكُمْ؟ فَقَالُوا غَفَلٌ قَالَ هُوَ كَاسْمِهِ وَأَبْطَلَ دَمَهُ فَهَذَا مُرْسَلٌ
[Machine] A man added people from these two, and his wife went to store for them. Then, a man from them desired her for himself, so she hit him with a tool and killed him. This matter was brought to Umar and he said, "That is a victim, by Allah, and he will never be harmed." It was reported to us by Abu Sa'id bin Abi Amr, narrated by Abu al-Abbas al-Amm, informed by Rabee'. He said, according to Shafi'i, "This is from Umar's actions, that the burden of proof is on the one who killed the victim. Or that the guardian of the victim acknowledged in front of him what obligates him to kill the victim."
أَنَّ رَجُلًا أَضَافَ نَاسًا مِنْ هُذَيْلٍ فَذَهَبَتْ جَارِيَةٌ لَهُمْ تَحْتَطِبُ فَأَرَادَهَا رَجُلٌ مِنْهُمْ عَنْ نَفْسِهَا فَرَمَتْهُ بِفِهْرٍ فَقَتَلَتْهُ فَرُفِعَ ذَلِكَ إِلَى عُمَرَ ؓ قَالَ ذَاكَ قَتِيلٌ اللهِ وَاللهِ لَا يُودَى أَبَدًا 17650 أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو ثنا أَبُو الْعَبَّاسِ الْأَصَمُّ أنبأ الرَّبِيعُ قَالَ قَالَ الشَّافِعِيُّ هَذَا عِنْدَنَا مِنْ عُمَرَ ؓ أَنَّ الْبَيِّنَةَ قَامَتْ عِنْدَهُ عَلَى الْمَقْتُولِ أَوْ عَلَى أَنَّ وَلِيَّ الْمَقْتُولِ أَقَرَّ عِنْدَهُ بِمَا يُوجِبُ لَهُ أَنْ يَقْتُلَ الْمَقْتُولَ
57.38 [Machine] Trespassing and Access
٥٧۔٣٨ بَابُ التَّعَدِّي وَالِاطِّلَاعِ
[Machine] Sahl ibn Saad al-Saadi heard a man saying: "I saw a man come out of a hole in the room of the Messenger of Allah ﷺ, and he had a comb with which he was combing his head. He said: 'If I had known that you were watching, I would have stabbed you in the eye with it.' The permission to ask for permission was only given for the purpose of looking. This is the wording of the hadith of al-Za'faraani, and in the narration of Ibn Hashim it says: 'If I had known that you were looking at me.'"
سَمِعَ سَهْلَ بْنَ سَعْدٍ السَّاعِدِيَّ يَقُولُ اطَّلَعَ رَجُلٌ مِنْ جُحْرٍ فِي حُجْرَةِ رَسُولِ اللهِ ﷺ وَمَعَهُ مِدْرًى يَحُكُّ بِهِ رَأْسَهُ فَقَالَ لَوْ أَعْلَمُ أَنَّكَ تَنْظُرُ لَطَعَنْتُ بِهِ فِي عَيْنِكَ إِنَّمَا جُعِلَ الِاسْتِئْذَانُ مِنْ أَجْلِ النَّظَرِ لَفْظُ حَدِيثِ الزَّعْفَرَانِيِّ وَفِي رِوَايَةِ ابْنِ هَاشِمٍ لَوْ عَلِمْتُ أَنَّكَ تَنْظُرُنِي
[Machine] A man peeked at the Prophet ﷺ from behind the curtain and there was a metal object in the hand of the Prophet ﷺ . The man said to him, "If I knew that he was looking at me until I came to him, I would have stabbed him in the eye with that metal object." Has seeking permission been made obligatory except for the purpose of seeing?
أَنَّ رَجُلًا اطَّلَعَ عَلَى النَّبِيِّ ﷺ مِنْ سِتْرِ الْحُجْرَةِ وَفِي يَدِ النَّبِيِّ ﷺ مِدْرًى فَقَالَ لَهُ لَوْ أَعْلَمُ أَنَّ هَذَا يَنْظُرُنِي حَتَّى أَتَيْتُهُ لَطَعَنْتُ بِالْمِدْرَى فِي عَيْنِهِ وَهَلْ جُعِلَ الِاسْتِئْذَانُ إِلَّا مِنْ أَجْلِ الْبَصَرِ؟
أَنَّ رَجُلًا اطَّلَعَ فِي بَعْضِ حُجَرِ النَّبِيِّ ﷺ فَقَامَ إِلَيْهِ رَسُولُ اللهِ ﷺ بِمِشْقَصٍ أَوْ بِمَشَاقِصَ فَذَهَبَ رَسُولُ اللهِ ﷺ نَحْوَ الرَّجُلِ يَخْتِلُهُ لِيَطْعَنَهُ وَقَالَ الْحَجَّاجُ فَكَأَنِّي أَنْظُرُ إِلَى رَسُولِ اللهِ ﷺ يَخْتِلُهُ لِيَطْعَنَهُ
[Machine] "A Bedouin man came to the Prophet ﷺ and hit his eye on the door latch. The Prophet ﷺ put a specific stick on it and the eye of the Bedouin man was cured. He said, 'If it had stayed, I would have taken out your eye.'"
أَنَّ أَعْرَابِيًّا أَتَى بَابَ النَّبِيِّ ﷺ فَأَلْقَمَ عَيْنَهُ خَصَاصَةَ الْبَابِ فَبَصُرَ بِهِ النَّبِيُّ ﷺ فَأَخَذَ عُودًا مُحَدَّدًا فَوَجَأَ عَيْنَ الْأَعْرَابِيِّ فَانْقَمَعَ فَقَالَ لَوْ ثَبَتَّ لَفَقَأْتُ عَيْنَكَ
[Machine] The Prophet ﷺ said: "If someone looks at you without permission, throw a stone at him and knock out his eye. There is no blame on you for doing so."
النَّبِيَّ ﷺ قَالَ لَوْ أَنَّ امْرَأً اطَّلَعَ عَلَيْكَ بِغَيْرِ إِذْنٍ فَحَذَفْتَهُ بِحَصَاةٍ فَفَقَأْتَ عَيْنَهُ مَا كَانَ عَلَيْكَ جُنَاحٌ
