٦٥۔ كِتَابُ آدَابِ الْقَاضِي ص ٥
[Machine] Allah, may His praise be exalted, said: "Indeed, Allah commands you to render trusts to whom they are due and when you judge between people to judge with justice." (Quran 4:58) And He said to His Prophet, peace be upon him: "And judge between them by what Allah has revealed and do not follow their inclinations." (Quran 5:49) And the Messenger of Allah, peace be upon him, appointed workers and judges, and so did the caliphs after him. They serve as examples in the Sharia. Success and protection are from Allah alone.
قَالَ اللهُ جَلَّ ثَنَاؤُهُ: {إِنَّ اللهَ يَأْمُرُكُمْ أَنْ تُؤَدُّوا الْأَمَانَاتِ إِلَى أَهْلِهَا وَإِذَا حَكَمْتُمْ بَيْنَ النَّاسِ أَنْ تَحْكُمُوا بِالْعَدْلِ} [النساء: 58] , وَقَالَ لِنَبِيِّهِ ﷺ: {وَأَنِ احْكُمْ بَيْنَهُمْ بِمَا أَنْزَلَ اللهُ وَلَا تَتَّبِعْ أَهْوَاءَهُمْ} [المائدة: 49] , وَبَعَثَ رَسُولُ اللهِ ﷺ الْعُمَّالَ وَالْقُضَاةَ , وَكَذَلِكَ الْخُلَفَاءُ بَعْدَهُ , وَبِهِمُ الْقُدْوَةُ فِي الشَّرِيعَةِ , وَبِاللهِ التَّوْفِيقُ وَالْعِصْمَةُ
[Machine] In His statement, "And (mention) David and Solomon, when they judged concerning the field – when the sheep of a people overran it [at night], and We were witnesses to their judgement. And We gave understanding of the case to Solomon, and to each (of them) We gave judgement and knowledge." (Quran 21: 79), it is narrated from Masrooq and Mujahid the meaning of this (verse). And Allah (swt) returned the judgement in this incident and similar incidents to what the Messenger of Allah ﷺ ruled in the case of the camel of Bara' ibn Azib when it entered the farmland of some of the Ansar and caused damage. He ruled that during the day, the owners are responsible for safeguarding their wealth, and during the night, the owners of the livestock are responsible for any damage caused by the livestock. Ash-Shafi'i said, al-Hasan ibn Abi al-Hasan said, "If it were not for this verse, I would have thought that the judges have perished. However, Allah praised this (judgement) for its correctness and commended it for its effort."
فِي قَوْلِهِ ﷻ {وَدَاوُدَ وَسُلَيْمَانَ إِذْ يَحْكُمَانِ فِي الْحَرْثِ إِذْ نَفَشَتْ فِيهِ غَنْمُ الْقَوْمِ} قَالَ كَرْمٌ وَقَدْ أَنْبَتَتْ عَنَاقِيدُهُ فَأَفْسَدَتْهُ قَالَ فَقَضَى دَاوُدُ عَلَيْهِ السَّلَامُ بِالْغَنَمِ لِصَاحِبِ الْكَرْمِ فَقَالَ سُلَيْمَانُ غَيْرَ هَذَا يَا نَبِيَّ اللهِ ﷺ قَالَ وَمَا ذَاكَ؟ قَالَ تَدْفَعُ الْكَرْمَ إِلَى صَاحِبِ الْغَنَمِ فَيَقُومُ عَلَيْهِ حَتَّى يَعُودَ كَمَا كَانَ وَتَدْفَعُ الْغَنَمَ إِلَى صَاحِبِ الْكَرْمِ فَيُصِيبُ مِنْهَا حَتَّى إِذَا كَانَ الْكَرْمُ كَمَا كَانَ دَفَعْتَ الْكَرْمَ إِلَى صَاحِبِهِ وَدَفَعْتَ الْغَنَمَ إِلَى صَاحِبِهَا قَالَ اللهُ ﷻ {فَفَهَّمْنَاهَا سُلَيْمَانَ وَكُلًّا آتَيْنَا حُكْمًا وَعِلْمًا} [الأنبياء 79] وَرُوِّينَا عَنْ مَسْرُوقٍ وَمُجَاهِدٍ مَعْنَى هَذَا وَقَدْ رَدَّ اللهُ تَعَالَى الْحُكْمَ فِي هَذِهِ الْحَادَثةِ وَأَشْبَاهِهَا إِلَى مَا حَكَمَ بِهِ رَسُولُ اللهِ ﷺ فِي نَاقَةِ الْبَرَاءِ بْنِ عَازِبٍ حِينَ دَخَلَتْ حَائِطًا لِقَوْمٍ مِنَ الْأَنْصَارِ فَأَفْسَدَتْ فَقَضَى أَنَّ حِفْظَ الْأَمْوَالِ عَلَى أَهْلِهَا بِالنَّهَارِ وَعَلَى أَهْلِ الْمَوَاشِي مَا أَفْسَدَتِ الْمَوَاشِي بِاللَّيْلِ قَالَ الشَّافِعِيُّ قَالَ الْحَسَنُ بْنُ أَبِي الْحَسَنِ لَوْلَا هَذِهِ الْآيَةُ لَرَأَيْتُ أَنَّ الْحُكَّامَ قَدْ هَلَكُوا وَلَكِنَّ اللهَ حَمِدَ هَذَا بِصَوَابِهِ وَأَثْنَى عَلَى هَذَا بِاجْتِهَادِهِ
[Machine] He heard the Messenger of Allah ﷺ say: "When the judge judges and makes an effort and is correct, he will have two rewards. And when the judge judges and makes an effort and makes a mistake, he will have one reward." Ibn Al-Hadd said: I narrated this Hadith to Abu Bakr bin Muhammad bin Amr bin Hazm, and he said: Thus Abu Salamah bin Abdur-Rahman narrated to me from Abu Hurairah from the Prophet ﷺ .
أَنَّهُ سَمِعَ رَسُولَ اللهِ ﷺ يَقُولُ إِذَا حَكْمَ الْحَاكِمُ فَاجْتَهَدَ فَأَصَابَ فَلَهُ أَجْرَانِ وَإِذَا حَكْمَ الْحَاكِمُ فَاجْتَهَدَ فَأَخْطَأَ فَلَهُ أَجْرٌ قَالَ يَعْنِي ابْنَ الْهَادِ فَحَدَّثْتُ بِهَذَا الْحَدِيثِ أَبَا بَكْرِ بْنَ مُحَمَّدِ بْنِ عَمْرِو بْنِ حَزْمٍ فَقَالَ هَكَذَا حَدَّثَنِي أَبُو سَلَمَةَ بْنُ عَبْدِ الرَّحْمَنِ عَنْ أَبِي هُرَيْرَةَ ؓ عَنِ النَّبِيِّ ﷺ
[Machine] About the Prophet ﷺ , he said: "When a judge makes a decision and strives hard, and he is correct, he will have two rewards. And if he makes a decision and strives hard, but he is mistaken, he will still have a reward. This is reported only by Ma'mar, who narrated it from Sufyan and no one else."
عَنِ النَّبِيِّ ﷺ قَالَ إِذَا حَكَمَ الْحَاكِمُ فَاجْتَهَدَ فَأَصَابَ فَلَهُ أَجْرَانِ وَإِذَا حَكَمَ فَاجْتَهَدَ فَأَخْطَأَ فَلَهُ أَجْرٌ لَمْ يَرْوِهِ عَنْ سُفْيَانَ إِلَّا مَعْمَرٌ تَفَرَّدَ بِهِ عَنْهُ عَبْدُ الرَّزَّاقِ
[Machine] The Messenger of Allah ﷺ said, "Whoever seeks knowledge and obtains it, he will have such and such reward. And if he does not obtain it, he will have such and such reward."
قَالَ رَسُولُ اللهِ ﷺ مَنْ طَلَبَ عِلْمًا فَأَدْرَكَهُ كَانَ لَهُ كِفْلَانِ مِنَ الْأَجْرِ فَإِنْ لَمْ يُدْرِكْهُ كَانَ لَهُ كِفْلٌ مِنَ الْأَجْرِ
On the day he returned from the Battle of Ahzab, the Messenger of Allah ﷺ made for us an announcement that nobody would say his Zuhr prayer but in the quarters of Banu Quraiza (Some) people, being afraid that the time for prayer would expire, said their prayers before reaching the street of Banu Quraiza. The others said: We will not say our prayer except where the Messenger of Allah ﷺ has ordered us to say it even if the time expires. When he learned of the difference in the view of the two groups of the people, the Messenger of Allah (may peace be tipon him) did not blame anyone from the two groups. نَادَى فِينَا رَسُولُ اللهِ ﷺ يَوْمَ انْصَرَفَ مِنَ الْأَحْزَابِ أَلَا لَا يُصَلِّيَنَّ أَحَدٌ الظُّهْرَ إِلَّا فِي بَنِي قُرَيْظَةَ قَالَ فَتَخَوَّفَ نَاسٌ فَوْتَ الْوَقْتِ فَصَلَّوْا دُونَ بَنِي قُرَيْظَةَ وَقَالَ آخَرُونَ لَا نُصَلِّي إِلَّا حَيْثُ أَمَرَنَا رَسُولُ اللهِ ﷺ وَإِنْ فَاتَنَا الْوَقْتُ قَالَ فَمَا عَنَّفَ وَاحِدًا مِنَ الْفَرِيقَيْنِ
65.24 [Machine] Whoever strives and then realizes that his effort contradicts a text, consensus, or its intended meaning, he should retract it both for himself and for others.
٦٥۔٢٤ بَابُ مَنِ اجْتَهَدَ , ثُمَّ رَأَى أَنَّ اجْتِهَادَهُ خَالَفَ نَصًّا أَوْ إجْمَاعًا أَوْ مَا فِي مَعْنَاهُ , رَدَّهُ عَلَى نَفْسِهِ , وَعَلَى غَيْرِهِ
[Machine] The Messenger of Allah ﷺ said, "Whoever introduces into our matter (religion) that which is not from it, it will be rejected."
قَالَ رَسُولُ اللهِ ﷺ مَنْ أَحْدَثَ فِي أَمْرِنَا مَا لَيْسَ مِنْهُ فَهُوَ رَدٌّ
[Machine] Sufyan and they said in the speech, "A ruling that you ruled yesterday should not prevent you from revisiting it, and you have reconsidered and been guided to the right path, so you should reconsider the truth. Indeed, the truth is ancient and nothing can invalidate it. And revisiting the truth is better than persisting in falsehood."
سُفْيَانَ وَقَالُوا فِي الْحَدِيثِ لَا يَمْنَعْكَ قَضَاءٌ قَضَيْتَهُ بِالْأَمْسِ رَاجَعْتَ فِيهِ نَفْسَكَ وَهُدِيتَ فِيهِ لِرُشْدِكَ أَنْ تُرَاجِعَ الْحَقَّ فَإِنَّ الْحَقَّ قَدِيمٌ وَإِنَّ الْحَقَّ لَا يُبْطِلُهُ شَيْءٌ وَمُرَاجَعَةُ الْحَقِّ خَيْرٌ مِنَ التَّمَادِي فِي الْبَاطِلِ
[Machine] Indeed, I cancelled it because the truth lies elsewhere.
أَنَّ الْحَقَّ فِي غَيْرِهِ فَفَسَخْتُهُ
65.25 [Machine] Anyone who exerted effort from the judges, then their exertion changed, or the exertion of others in what is permissible to exert in it, he does not invalidate what was ruled by using evidence from what was previously mentioned in the book of prayer concerning the mistake of the qibla
٦٥۔٢٥ بَابُ مَنِ اجْتَهَدَ مِنَ الْحُكَّامِ , ثُمَّ تَغَيَّرَ اجْتِهَادُهُ , أَوِ اجْتِهَادُ غَيْرِهِ فِيمَا يَسُوغُ فِيهِ الِاجْتِهَادُ , لَمْ يَرُدَّ مَا قَضَى بِهِ اسْتِدْلَالًا بِمَا مَضَى فِي خَطَأِ الْقِبْلَةِ فِي كِتَابِ الصَّلَاةِ
[Machine] You made it for the siblings from the father and the mother, and you did not make anything for the siblings from the mother. He said, "This is based on what we have decreed, and this is based on what we have decreed."
جَعَلْتَهُ لِلْإِخْوَةِ مِنَ الْأَبِ وَالْأُمِّ وَلَمْ تَجْعَلْ لِلْإِخْوَةِ مِنَ الْأُمِّ شَيْئًا قَالَ تِلْكَ عَلَى مَا قَضَيْنَا وَهَذِهِ عَلَى مَا قَضَيْنَا
[Machine] Ali was critical of Umar one day when the people of Najran came to him. Ali wrote the book between the people of Najran and the Prophet ﷺ , and they increased in number during Umar's reign until he feared them and they disagreed with each other. They came to Umar and asked him for a replacement, so he replaced them. Then they regretted it and put something between them, but Umar refused to remove them. When Ali became the caliph, they came to him and said, "O Amir al-Mu'minin, your intercession with your words and your writing." Ali said, "Woe to you! Umar was a wise ruler."
كَانَ عَلِيٌّ طَاعِنًا عَلَى عُمَرَ ؓ يَوْمًا مِنَ الدَّهْرِ لطَعَنَ عَلَيْهِ يَوْمَ أَتَاهُ أَهْلُ نَجْرَانَ وَكَانَ عَلِيٌّ ؓ كَتَبَ الْكِتَابَ بَيْنَ أَهْلِ نَجْرَانَ وَبَيْنِ النَّبِيِّ ﷺ فَكَثُرُوا فِي عَهْدِ عُمَرَ ؓ حَتَّى خَافَهُمْ عَلَى النَّاسِ فَوَقَعَ بَيْنَهَمُ الِاخْتِلَافُ فَأَتَوْا عُمَرَ ؓ فَسَأَلُوهُ الْبَدَلَ فَأَبْدَلَهُمْ قَالَ ثُمَّ نَدِمُوا وَوَضَعَ بَيْنَهُمْ شَيئًا فَأَبَوْهُ فَاسْتَقَالُوهُ فَأَبَى أَنْ يُقِيلَهُمْ فَلَمَّا وَلِيَ عَلِيٌّ ؓ أَتَوْهُ فَقَالُوا يَا أَمِيرَ الْمُؤْمِنِينَ شَفَاعَتُكَ بِلِسَانِكَ وَخَطُّكَ بِيَمِينِكَ فَقَالَ عَلِيٌّ ؓ وَيْحَكُمْ إِنَّ عُمَرَ ؓ كَانَ رَشِيدَ الْأَمْرِ
[Machine] Abdul Khair, I was close to Ali when the people of Najran came to him. He said, I said, "If you have any disagreement with Umar, today is the day to express it." He said, "So they saluted and stood before him. Some of them put their hands inside his sleeve and he took out a book and handed it to Ali. They said, "O Amir al-Mu'minin, your right hand is writing and the messenger of Allah is dictating to you." Ali said, "Then I saw Ali, and tears were streaming down his cheeks. He said, "Then he raised his head towards them and said, "O people of Najran, this is the last book that I have written with the Messenger of Allah's guidance." They said, "Give us what is in it." He said, "I will inform you about that. Indeed, Umar, who took from you, did not take it for himself. He took it for a group of Muslims, and what he took from you was better than what he gave you. By Allah, I will not change anything of what Umar did. Indeed, Umar was wise in his leadership."
عَبْدُ خَيْرٍ كُنْتُ قَرِيبًا مِنْ عَلِيٍّ ؓ حِينَ جَاءَهُ أَهْلُ نَجْرَانَ قَالَ قُلْتُ إِنْ كَانَ رَادًّا عَلَى عُمَرَ شَيْئًا فَالْيَوْمَ قَالَ فَسَلَّمُوا وَاصْطَفُّوا بَيْنَ يَدَيْهِ قَالَ ثُمَّ أَدْخَلَ بَعْضُهُمْ يَدَهُ فِي كُمِّهِ فَأَخْرَجَ كِتَابًا فَوَضَعَهُ فِي يَدِ عَلِيٍّ ؓ قَالُوا يَا أَمِيرَ الْمُؤْمِنِينَ خَطُّكُ بِيَمِينِكَ وَإِمْلَاءُ رَسُولِ اللهِ ﷺ عَلَيْكَ قَالَ فَرَأَيْتُ عَلِيًّا ؓ وَقَدْ جَرَتِ الدُّمُوعُ عَلَى خَدِّهِ قَالَ ثُمَّ رَفَعَ رَأْسَهُ إِلَيْهِمْ فَقَالَ يَا أَهْلَ نَجْرَانَ إِنَّ هَذَا لَآخِرُ كِتَابٍ كَتَبْتُهُ بَيْنَ يَدَيْ رَسُولِ اللهِ ﷺ قَالُوا فَأَعْطِنَا مَا فِيهِ قَالَ سَأُخْبِرُكُمْ عَنْ ذَاكَ إِنَّ الَّذِي أَخَذَ مِنْكُمْ عُمَرُ ؓ لَمْ يَأْخُذْهُ لِنَفْسِهِ إِنَّمَا أَخَذَهُ لِجَمَاعَةٍ مِنَ الْمُسْلِمِينَ وَكَانَ الَّذِي أَخَذَ مِنْكُمْ خَيْرًا مِمَّا أَعْطَاكُمْ وَاللهِ لَا أَرُدُّ شَيْئًا مِمَّا صَنَعَهُ عُمَرُ ؓ إِنَّ عُمَرَ ؓ كَانَ رَشِيدَ الْأَمْرِ
[Machine] He has his cousins and his wife's cousins. If your wife doesn't love you, and if you want to know that, choose her. He said, "O Barzah, daughter of freedom, choose me." She said, "Woe to you, I have chosen and you are not the best." She said that three times. They said, "She is forbidden for you." He said, "You lied." So he went to Ali and told him about it. Ali said, "If you approach her until she marries someone other than you, I will make you disappear with stones." Or he said, "I will stone you." When Muawiyah was appointed, he came to him and said, "Abu Turab has separated between me and my wife, with this and that." He said, "We have decreed his ruling against you." Or he said, "We would not refuse to enforce a decree made against you."
لَهُ بَنُو عَمِّهِ وَبَنُو عَمِّ امْرَأَتِهِ إِنَّ امْرَأَتَكَ لَا تُحِبُّكَ فَإِنْ أَحْبَبْتَ أَنْ تَعْلَمَ ذَلِكَ فَخَيِّرْهَا فَقَالَ يَا بَرْزَةَ بِنْتَ الْحُرِّ اخْتَارِي فَقَالَتْ وَيْحَكَ اخْتَرْتُ وَلَسْتَ بِخِيَارٍ قَالَتْ ذَلِكَ ثَلَاثَ مَرَّاتٍ فَقَالُوا حَرُمَتْ عَلَيْكَ فَقَالَ كَذَبْتُمْ فَأَتَى عَلِيًّا َؓ فَذَكَرَ ذَلِكَ لَهُ فَقَالَ لَئِنْ قَرَبْتَهَا حَتَّى تُنْكِحَ زَوْجًا غَيْرَكَ لَأُغُيِّبَنَكَ بِالْحِجَارَةِ أَوْ قَالَ أَرْضَخُكَ بِالْحِجَارَةِ قَالَ فلَمَّا اسْتُخْلِفَ مُعَاوِيَةُ ؓ أَتَاهُ فَقَالَ إِنَّ أَبَا تُرَابٍ فَرَّقَ بَيْنِي وَبَيْنَ امْرَأَتِي بِكَذَا وَكَذَا قَالَ قَدْ أَجَزْنَا قَضَاءَهُ عَلَيْكَ أَوْ قَالَ مَا كُنَّا لَنَرُدُ قَضَاءً قَضَاهُ عَلَيْكَ
[Machine] The man used to make a contract with another man and say, "You inherit me and I inherit you." When this verse was revealed, he abandoned that practice. Maysarah bin Yazeed came with the book to Shuraik and when he recited it, Shuraik refused to invalidate his decision. He said, "I only emancipated her because of the intention in her womb."
شَأْنِ الْعَصَبَةِ كَانَ الرَّجُلُ يُعَاقِدُ الرَّجُلَ فَيَقُولُ تَرِثُنِي وَأَرِثُكَ فَلَمَّا نَزَلَتْ تُرِكَ ذَلِكَ قَالَ فَجَاءَ مَيْسَرَةُ بْنُ يَزِيدَ بِالْكِتَابِ إِلَى شُرَيْحٍ فَلَمَّا قَرَأَهُ أَبَى أَنْ يَرُدَّ قَضَاءَهُ وَقَالَ إِنَّمَا أَعْتَقَهَا حِيتَانُ بَطْنِهَا
[Machine] To invalidate any rulings made by Abdullah ibn Zubayr and that Aban ibn Uthman wrote to Abd al-Malik regarding this matter. Abd al-Malik replied to him stating that we did not take revenge on Ibn Zubayr for the rulings he made, rather we took revenge on him for his aspirations for leadership. So, when you receive my letter, carry out what Ibn Zubayr ruled and do not reject it, for our invalidation of rulings is a serious matter.
أَنْ يَنْقُضَ مَا كَانَ عَبْدُ اللهِ بْنُ الزُّبَيْرِ قَضَى فِيهِ فَكَتَبَ أَبَانُ بْنُ عُثْمَانَ فِي ذَلِكَ إِلَى عَبْدِ الْمَلِكِ فَكَتَبَ إِلَيْهِ عَبْدُ الْمَلِكِ إِنَّا لَمْ نَنْقِمْ عَلَى ابْنِ الزُّبَيْرِ مَا كَانَ يَقْضِي بِهِ وَلَكِنْ نَقَمْنَا عَلَيْهِ مَا كَانَ أَرَادَ مِنَ الْإِمَارَةِ فَإِذَا جَاءَكَ كِتَابِي هَذَا فَأَمْضِ مَا كَانَ قَضَى بِهِ ابْنُ الزُّبَيْرِ وَلَا تَرُدَّهُ فَإِنَّ نَقَضْنَا الْقَضَاءَ عَنَاءٌ مُعَنًّى
65.26 [Machine] The Preaching of the Judge to the Witnesses, and Intimidating and Informing them about False Testimony, and the Magnitude of the Sin and the Serious Consequences
٦٥۔٢٦ بَابُ وَعْظِ الْقَاضِي الشُّهُودَ , وَتَخْوِيفِهِمْ وَتَعْرِيفِهِمْ عِنْدَ الرِّيبَةِ , بِمَا فِي شَهَادَةِ الزُّورِ مِنْ كَبِيرِ الْإِثْمِ , وَعَظِيمِ الْوِزْرِ
[Machine] The Messenger of Allah ﷺ said, "Shall I not inform you of the greatest of sins?" They said, "Yes, O Messenger of Allah." He said, "Associating partners with Allah, disobedience to parents." Then he sat up and was reclining, and continued to repeat, "And false testimony." The Messenger of Allah ﷺ repeated it so many times that we wished he would stop. In the narration of Ibn Ulayyah, he said, "We were sitting with the Prophet ﷺ and he said, 'Shall I not inform you?' And he said, 'False testimony.'"
قَالَ رَسُولُ اللهِ ﷺ أَلَا أُخْبِرُكُمْ بِأَكْبَرِ الْكَبَائِرِ؟ ثَلَاثًا قَالُوا بَلَى يَا رَسُولَ اللهِ قَالَ الْإِشْرَاكُ بِاللهِ وَعُقُوقُ الْوَالِدَيْنِ قَالَ وَجَلَسَ وَكَانَ مُتَّكِئًا أَلَا وَقَوْلُ الزُّورِ فَمَا زَالَ رَسُولُ اللهِ ﷺ يُكَرِّرُهَا حَتَّى قُلْنَا لَيْتَهُ سَكَتَ لَفْظُ حَدِيثِ بِشْرٍ وَفِي رِوَايَةِ ابْنِ عُلَيَّةَ قَالَ كُنَّا جُلُوسًا عِنْدَ النَّبِيِّ ﷺ فَقَالَ أَلَا أُنَبِّئُكُمْ وَقَالَ شَهَادَةُ الزُّورِ ثَلَاثًا
[Machine] The Prophet ﷺ mentioned the major sins and said: "Associating partners with Allah, killing a soul, disobedience to parents, and bearing false witness or speaking falsely." Abu Zakariya ibn Abi Ishaq al-Muzakki narrated to us, Abu al-Fadl Muhammad ibn Ibrahim ibn al-Fadl al-Muzakki informed us, Yusuf ibn Ya'qub al-Qadi narrated to us, and Amr ibn Marzouq informed us, Shu'bah mentioned him with a similar chain of narration, except that he said: "The greatest of the major sins is associating partners with Allah." Then he mentioned it.
أَنَّ النَّبِيَّ ﷺ ذُكِرَ عِنْدَهُ الْكَبَائِرَ فَقَالَ الشِّرْكُ بِاللهِ وَقَتْلُ النَّفْسِ وَعُقُوقُ الْوَالِدَيْنِ وَشَهَادَةُ الزُّورِ أَوْ قَوْلُ الزُّورِ 20382 وَأَخْبَرَنَا أَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ الْمُزَكِّي أنبأ أَبُو الْفَضْلِ مُحَمَّدُ بْنُ إِبْرَاهِيمَ بْنِ الْفَضْلِ الْمُزَكِّي ثنا يُوسُفُ بْنُ يَعْقُوبَ الْقَاضِي ثنا عَمْرُو بْنُ مَرْزُوقٍ أنبأ شُعْبَةُ فَذَكَرَهُ بِإِسْنَادِهِ نَحْوَهُ إِلَّا أَنَّهُ قَالَ أَكْبَرُ الْكَبَائِرِ الْإِشْرَاكُ بِاللهِ ثُمَّ ذَكَرَهُ
The Messenger of Allah ﷺ offered the morning prayer. When he finished it, he stood up and said three times: False witness has been made equivalent to attributing a partner to Allah. He then recited: "So avoid the abomination of idols and avoid speaking falsehood as people pure of faith to Allah, not associating anything with Him. (Using translation from Abū Dāʾūd 3599)
صَلَّى رَسُولُ اللهِ ﷺ صَلَاةَ الصُّبْحِ فَلَمَّا انْصَرَفَ قَامَ قَائِمًا فَقَالَ عُدِلَتْ شَهَادَةُ الزُّورِ بِالشِّرْكِ بِاللهِ ثَلَاثَ مَرَّاتٍ ثُمَّ تَلَا هَذِهِ الْآيَةَ {فَاجْتَنِبُوا الرِّجْسَ مِنَ الْأَوْثَانِ وَاجْتَنِبُوا قَوْلَ الزُّورِ حُنَفَاءَ لِلَّهِ غَيْرَ مُشْرِكِينَ بِهِ} [الحج 31]
[Machine] The Messenger of Allah ﷺ said: The witness to falsehood will have his feet fixed until the fire is obligatory for him. And the Messenger of Allah ﷺ said: On the Day of Resurrection, the birds will raise their wings, strike with their tails, and throw out what is in their stomachs, and they will not have any offspring with them. Muhammad ibn Al-Furatt Al-Kufi, a weak narrator, informed me that Abu Abdullah Al-Hafiz narrated to me that Abu Al-Walid informed me, who narrated to me from Al-Hassan ibn Sufyan, who narrated to me from Abu Bakr ibn Abi Shaybah, who narrated to me from Ali ibn Hashim, from Muharrar ibn Salih, that Ali spread out the testimonies.
قَالَ رَسُولُ اللهِ ﷺ شَاهِدُ الزُّورِ لَا تَزُولُ قَدَمَاهُ حَتَّى تُوجَبَ لَهُ النَّارُ وَقَالَ رَسُولُ اللهِ ﷺ الطَّيْرُ يَوْمَ الْقِيَامَةِ تَرْفَعُ مَنَاقِيرَهَا وَتَضْرِبُ بِأَذْنَابِهَا وَتَطْرَحُ مَا فِي بُطُونِهَا وَلَيْسَ عِنْدَهَا طَلِبَةٌ فَاتِقَةٌ مُحَمَّدُ بْنُ الْفُرَاتِ الْكُوفِيُّ ضَعِيفٌ أَنْبَأَنِي أَبُو عَبْدِ اللهِ الْحَافِظُ أنبأ أَبُو الْوَلِيدِ ثنا الْحَسَنُ بْنُ سُفْيَانَ ثنا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ ثنا عَلِيُّ بْنُ هَاشِمٍ عَنْ أَبِيهِ عَنْ مُحَرَّرِ بْنِ صَالِحٍ أَنَّ عَلِيًّا ؓ فَرَّقَ بَيْنَ الشُّهُودِ
65.27 [Machine] The Problem of the Judge Regarding the Status of Witnesses: Among People There Are the Righteous and the Wicked, the Trustworthy and the Treacherous, and Allah Almighty has said: "Choose from among the witnesses whom you approve." [Al-Baqarah: 282]
٦٥۔٢٧ بَابُ مَسْأَلَةِ الْقَاضِي عَنْ أَحْوَالِ الشُّهُودِ فَفِي النَّاسِ بَرٌّ وَفَاجِرٌ وَأَمِينٌ وَخَائِنٌ , وَقَدْ قَالَ اللهُ تَعَالَى: {مِمَّنْ تَرْضَوْنَ مِنَ الشُّهَدَاءِ} [البقرة: 282]
Messenger of Allah ﷺ narrated to us two narrations, one of which I have seen (happening) and I am waiting for the other. He narrated that honesty was preserved in the roots of the hearts of men (in the beginning) and then they learnt it (honesty) from the Qur'an, and then they learnt it from the (Prophet's) Sunna (tradition). He also told us about its disappearance, saying, "A man will go to sleep whereupon honesty will be taken away from his heart, and only its trace will remain, resembling the traces of fire. He then will sleep whereupon the remainder of the honesty will also be taken away (from his heart) and its trace will resemble a blister which is raised over the surface of skin, when an ember touches one's foot; and in fact, this blister does not contain anything. So there will come a day when people will deal in business with each other but there will hardly be any trustworthy persons among them. Then it will be said that in such-and-such a tribe there is such-and-such person who is honest, and a man will be admired for his intelligence, good manners and strength, though indeed he will not have belief equal to a mustard seed in his heart."
The narrator added: There came upon me a time when I did not mind dealing with anyone of you, for if he was a Muslim, his religion would prevent him from cheating; and if he was a Christian, his Muslim ruler would prevent him from cheating; but today I cannot deal except with so-and-so and so-and-so. حَدَّثَنَا رَسُولُ اللهِ ﷺ بِحَدِيثَيْنِ وَقَدْ رَأَيْتُ أَحَدَهُمَا وَأَنَا أَنْتَظِرُ الْآخَرَ حَدَّثَنَا أَنَّ الْأَمَانَةَ نَزَلَتْ فِي جَذْرِ قُلُوبِ الرِّجَالِ فَنَزَلَ الْقُرْآنُ فَعَلِمُوا مِنَ الْقُرْآنِ وَعَلِمُوا مِنَ السُّنَّةِ ثُمَّ حَدَّثَنَا عَنَ رَفْعِهَا فَقَالَ يَنَامُ الرَّجُلُ نَوْمَةً فَتُقْبَضُ الْأَمَانَةُ مِنْ قَلْبِهِ فَيَبْقَى أَثَرُهَا مِثْلَ أَثَرِ الْوَكْتِ ثُمَّ يَنَامُ الرَّجُلُ نَوْمَةً فَتُقْبَضُ الْأَمَانَةُ مِنْ قَلْبِهِ فَيَبْقَى أَثَرُهَا مِثْلَ أَثَرِ الْمَجْلِ كَجَمْرٍ دَحْرَجْتَهُ عَلَى رِجْلِكَ فَنَفِطَ فَتَرَاهُ مُنْتَبِرًا وَلَيْسَ فِيهِ شَيْءٌ فَيُصْبِحُ النَّاسُ يَتَبَايَعُونَ وَلَا يَكَادُ أَحَدٌ يُؤَدِّي حَتَّى يُقَالَ إِنَّ فِي بَنِي فُلَانٍ رَجُلًا أَمِينًا وَحَتَّى يُقَالَ لِرَجُلٍ مَا أَجْلَدَهُ وَأَظْرَفَهُ وَأَعْقَلَهُ وَلَيْسَ فِي قَلْبِهِ مِثْقَالُ حَبَّةِ خَرْدَلٍ مِنْ خَيْرٍ قَالَ حُذَيْفَةُ ؓ وَلَقَدْ أَتَى عَلَيَّ زَمَانٌ وَمَا أُبَالِي أَيُّكُمْ بَايَعْتُهُ لَئِنْ كَانَ مُؤْمِنًا لَيَرُدَّنَّ عَلَيَّ دِينُهُ وَلَئِنْ كَانَ يَهُودِيًّا أَوْ نَصْرَانِيًّا لَيَرُدَّنَّ عَلَيَّ سَاعِيهِ فَأَمَّا الْيَوْمُ فَمَا كُنْتُ أُبَايِعُ إِلَّا فُلَانًا وَفُلَانًا لَفْظُ حَدِيثِ أَبِي صَالِحٍ
[Machine] On the authority of the Prophet ﷺ, he said: "The righteous ones will depart one after another, until only a handful will remain, like a handful of barley or dates, and Allah will not care about them at all."
عَنِ النَّبِيِّ ﷺ قَالَ يَذْهَبُ الصَّالِحُونَ الْأَوَّلُ فَالْأَوَّلُ وَيَبْقَى حُفَالَةٌ مِثْلُ حُفَالَةِ الشَّعِيرِ أَوِ التَّمْرِ وَلَا يُبَالِيهِمُ اللهُ بَالًا
The Prophet ﷺ said, "The best people are those of my generation, and then those who will come after them (the next generation), and then those who will come after them (i.e. the next generation), and then after them, there will come people whose witness will precede their oaths, and whose oaths will precede their witness." قَالَ رَسُولُ اللهِ ﷺ خَيْرُ النَّاسِ قَرْنِي ثُمَّ الَّذِينَ يَلُونَهُمْ ثُمَّ الَّذِينَ يَلُونَهُمْ ثُمَّ يَجِيءُ قَوْمٌ تَسْبِقُ أَيْمَانُهُمْ شَهَادَتَهُمْ وَشَهَادَتُهُمْ أَيْمَانَهُمْ
I heard ʿImran bin Husain saying, "The Prophet ﷺ said, 'The best people are those living in my generation, then those coming after them, and then those coming after (the second generation)." ʿImran said "I do not know whether the Prophet ﷺ mentioned two or three generations after your present generation. The Prophet ﷺ added, 'There will be some people after you, who will be dishonest and will not be trustworthy and will give witness (evidences) without being asked to give witness, and will vow but will not fulfill their vows, and obesity will appear among them." قَالَ رَسُولُ اللهِ ﷺ خَيْرُكُمْ قَرْنِي ثُمَّ الَّذِينَ يَلُونَهُمْ ثُمَّ الَّذِينَ يَلُونَهُمْ ثُمَّ الَّذِينَ يَلُونَهُمْ قَالَ عِمْرَانُ بْنُ حُصَيْنٍ لَا أَدْرِي أَذَكَرَ رَسُولُ اللهِ ﷺ بَعْدَ قَرْنِهِ قَرْنَيْنِ أَوْ ثَلَاثَةً ثُمَّ قَالَ رَسُولُ اللهِ ﷺ إِنَّ بَعْدَكُمْ قَوْمًا يَخُونُونَ وَلَا يُؤْتَمَنُونَ وَيَشْهَدُونَ وَلَا يُسْتَشْهَدُونَ وَيَنْذِرُونَ وَلَا يَفُونَ وَيَظْهَرُ فِيهِمُ السِّمَنُ
65.28 [Machine] The reliance of the judge on the endorsement and criticism of witnesses
٦٥۔٢٨ بَابُ اعْتِمَادِ الْقَاضِي عَلَى تَزْكِيَةِ الْمُزَكِّينَ وَجَرْحِهِمْ
“A funeral (procession) passed by the Prophet ﷺ and they praised (the deceased) and spoke well of him. He said: ‘(Paradise is) guaranteed for him.’ Then another funeral passed by and they spoke badly of him, and he (the Prophet ﷺ) said: ‘(Hell is) guaranteed for him.’ It was said: ‘O Messenger of Allah, you said that (Paradise was) guaranteed for this one and that (Hell was) guaranteed for the other one.’ He said: ‘It is the testimony of the people, and the believers are the witnesses of Allah on earth.’” (Using translation from Ibn Mājah 1491)
أَنَّهُ مُرَّ عَلَى النَّبِيِّ ﷺ بِجِنَازَةٍ فَأُثْنِيَ عَلَيْهَا خَيْرًا فَقَالَ وَجَبَتْ ثُمَّ مُرَّ عَلَيْهِ بِجِنَازَةٍ فَأُثْنِيَ عَلَيْهِ شَرًّا فَقَالَ وَجَبَتْ فَقِيلَ يَا رَسُولَ اللهِ قُلْتَ لِهَذِهِ وَجَبَتْ وَلِهَذِهِ وَجَبَتْ قَالَ شَهَادَةُ الْقَوْمِ وَالْمُؤْمِنُونَ شُهَدَاءُ اللهِ فِي الْأَرْضِ
[Machine] I heard the Prophet ﷺ saying, "You will soon come to know the people of Paradise from the people of Hell, or he said, the best among you and the worst among you." It was said, "O Messenger of Allah, how can we know that?" He said, "By their good and bad praises (or by praising and blaming each other)."
سَمِعْتُ النَّبِيَّ ﷺ بِالنَّبَاةِ أَوْ قَالَ النَّبَاوَةِ يَقُولُ تُوشِكُوا أَنْ تَعْرِفُوا أَهْلَ الْجَنَّةِ مِنْ أَهْلِ النَّارِ أَوْ قَالَ خِيَارَكُمْ مِنْ شِرَارِكُمْ قِيلَ يَا رَسُولَ اللهِ بِمَاذَا؟ قَالَ بِالثَّنَاءِ الْحَسَنِ وَالثَّنَاءِ السَّيِّئِ أَنْتُمْ شُهَدَاءُ بَعْضُكُمْ عَلَى بَعْضٍ
65.29 [Machine] The number of winners
٦٥۔٢٩ بَابُ عَدَدِ الْمُزَكِّينَ
I came to Madinah and found that sickness was occurring in it and death was widespread. I sat with 'Umar bin al-Khattab and a funeral passed by him. People spoke well of the deceased and ‘Umar said: It is guaranteed. Then another funeral passed by and people spoke well of the deceased and ‘Umar said: It is guaranteed. Then a third funeral passed by and people spoke badly of the deceased and ‘Umar said: It is guaranteed. Abul-Aswad said: What is guaranteed, O Ameer al-Mu'mineen? He said: I am saying what the Messenger of Allah ﷺ said: ʿAny Muslim in whose favour four people testify, Allah will admit him to Paradise.ʿ We said: And three? He said: ʿAnd three.ʿ We said: And two? He said: ʿAnd two ʿ Then we did not ask him about one. (Using translation from Aḥmad 139)
عُمَرُ ؓ وَجَبَتْ ثُمَّ مُرَّ بِأُخْرَى فَأُثْنِيَ عَلَيْهَا خَيْرًا فَقَالَ عُمَرُ وَجَبَتْ ثُمَّ مُرَّ بِالثَّالِثَةِ فَأُثْنِيَ عَلَى صَاحِبِهَا شَرًّا فَقَالَ عُمَرُ ؓ وَجَبَتْ قَالَ أَبُو الْأَسْوَدِ فَقُلْتُ مَا وَجَبَتْ يَا أَمِيرَ الْمُؤْمِنِينَ؟ قَالَ قُلْتُ كَمَا قَالَ رَسُولُ اللهِ ﷺ أَيُّمَا مُسْلِمٍ شَهِدَ لَهُ أَرْبَعَةٌ بِخَيْرٍ أَدْخَلَهُ اللهُ الْجَنَّةَ قَالَ قُلْنَا وَثَلَاثَةٌ؟ قَالَ وَثَلَاثَةٌ قَالَ قُلْنَا وَاثْنَانِ؟ قَالَ وَاثْنَانِ ثُمَّ لَمْ نَسْأَلْهُ عَنِ الْوَاحِدِ
65.30 [Machine] An injury is not accepted in someone whose justice has been established except by showing him what hurts him with it." Al-Shafi'i, may Allah have mercy on him, said: "Because people differ and diverge in their desires
٦٥۔٣٠ بَابُ: لَا يُقْبَلُ الْجَرْحَ فِيمَنْ ثَبَتَتْ عَدَالَتُهُ إِلَّا بِأَنْ يَقِفَهُ عَلَى مَا يَجْرَحُهُ بِهِ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: لِأَنَّ النَّاسَ يَخْتَلِفُونَ وَيَتبَايَنُونَ فِي الْأَهْوَاءِ
who was one of the companions of Messenger of Allah ﷺ and one of the Ansar's who took part in the battle of Badr: I came to Messenger of Allah ﷺ and said, "O Messenger of Allah ﷺ I have weak eyesight and I lead my people in prayers. When it rains the water flows in the valley between me and my people so I cannot go to their mosque to lead them in prayer. O Messenger of Allah ﷺ! I wish you would come to my house and pray in it so that I could take that place as a Musalla. Messenger of Allah ﷺ said. "Allah willing, I will do so." Next day after the sun rose high, Messenger of Allah ﷺ and Abu Bakr came and Messenger of Allah ﷺ asked for permission to enter. I gave him permission and he did not sit on entering the house but said to me, "Where do you like me to pray?" I pointed to a place in my house. So Messenger of Allah ﷺ stood there and said, 'Allahu Akbar', and we all got up and aligned behind him and offered a two-rakʿat prayer and ended it with Taslim. We requested him to stay for a meal called "Khazira" which we had prepared for him. Many members of our family gathered in the house and one of them said, "Where is Malik bin Al-Dukhaishin or Ibn Al-Dukhshun?" One of them replied, "He is a hypocrite and does not love Allah and His Apostle." Hearing that, Messenger of Allah ﷺ said, "Do not say so. Haven't you seen that he said, 'None has the right to be worshipped but Allah' for Allah's sake only?" He said, "Allah and His Apostle know better. We have seen him helping and advising hypocrites." Messenger of Allah ﷺ said, "Allah has forbidden the (Hell) fire for those who say, 'None has the right to be worshipped but Allah' for Allah's sake only." (Using translation from Bukhārī 425)
أَنَّ عِتْبَانَ بْنَ مَالِكٍ وَهُوَ مِنْ أَصْحَابِ النَّبِيِّ ﷺ مِمَّنْ شَهِدَ بَدْرًا أَخْبَرَهُ أَنَّهُ أَتَى رَسُولَ اللهِ ﷺ فَقَالَ يَا رَسُولَ اللهِ قَدْ أَنْكَرْتُ بَصَرِي وَأَنَا أُصَلِّي لِقَوْمِي فَإِذَا كَانَتِ الْأَمْطَارُ سَالَ الْوَادِي الَّذِي بَيْنِي وَبَيْنَهُمْ وَلَمْ أَسْتَطِعْ أَنْ آتِيَ مَسْجِدَهُمْ فَأُصَلِّيَ لَهُمْ وَدِدْتُ يَا رَسُولَ اللهِ أَنَّكَ تَأْتِي فَتُصَلِّيَ فِي بَيْتِي فَأَتَّخِذَهُ مُصَلًّى قَالَ فَقَالَ لَهُ رَسُولُ اللهِ ﷺ سَأَفْعَلُ إِنْ شَاءَ اللهُ قَالَ عِتْبَانُ فَغَدَا رَسُولُ اللهِ ﷺ وَأَبُو بَكْرٍ ؓ حِينَ ارْتَفَعَ النَّهَارُ فَاسْتَأْذَنَ رَسُولُ اللهِ ﷺ فَأَذِنْتُ لَهُ فَلَمْ يَجْلِسْ حَتَّى دَخَلَ الْبَيْتَ فَقَالَ لِي أَيْنَ تُحِبُّ أَنْ أُصَلِّيَ مِنْ بَيْتِكَ؟ قَالَ فَأَشَرْتُ إِلَى نَاحِيَةٍ مِنَ الْبَيْتِ فَقَامَ رَسُولُ اللهِ ﷺ فَكَبَّرَ فَقُمْنَا فَصَفَفْنَا فَصَلَّى رَكْعَتَيْنِ ثُمَّ سَلَّمَ قَالَ وَحَبَسْنَاهُ عَلَى خَزِيرَةٍ صَنَعْنَاهَا لَهُ قَالَ فَثَابَ فِي الْبَيْتَ رِجَالٌ مِنْ أَهْلِ الدَّارِ ذَوُو عَدَدٍ وَاجْتَمَعُوا فَقَالَ قَائِلٌ مِنْهُمْ أَيْنَ مَالِكُ بْنُ الدُّخْشُنِ؟ فَقَالَ بَعْضُهُمْ ذَلِكَ مُنَافِقٌ لَا يُحِبُّ اللهَ وَرَسُولَهُ قَالَ فَقَالَ رَسُولُ اللهِ ﷺ لَا تَقُلْ لَهُ ذَلِكَ أَلَا تَرَاهُ وَقَدْ قَالَ لَا إِلَهَ إِلَّا اللهُ يُرِيدُ بِذَلِكَ وَجْهَ اللهِ؟ قَالَ اللهُ وَرَسُولُهُ أَعْلَمُ قَالَ فَإِنَّا نَرَى وَجْهَهُ وَنَصِيحَتَهُ إِلَى الْمُنَافِقِينَ قَالَ فَقَالَ رَسُولُ اللهِ ﷺ إِنَّ اللهَ قَدْ حَرَّمَ عَلَى النَّارِ مَنْ قَالَ لَا إِلَهَ إِلَّا اللهُ يَبْتَغِي بِذَلِكَ وَجْهَ اللهِ قَالَ ابْنُ شِهَابٍ ثُمَّ سَأَلْتُ الْحُصَيْنَ بْنَ مُحَمَّدٍ الْأَنْصَارِيَّ وَهُوَ أَحَدُ بَنِي سَالِمٍ كَانَ مِنْ سَرَاتِهِمْ عَنِ حَدِيثِ مَحْمُودِ بْنِ الرَّبِيعِ فَصَدَّقَهُ بِذَلِكَ
[Machine] The Sheikh, may Allah have mercy upon him, said: "This is in our view for those whose justice has been established, as long as there is no doubt about it. And Allah knows best."
الشَّيْخُ رَحِمَهُ اللهُ وَهَذَا عِنْدَنَا فِيمَنْ ثَبَتَتْ عَدَالَتُهُ فَهُوَ عَلَى أَصْلِ الْعَدَالَةِ مَا لَمْ يَظْهَرْ مِنْهُ رِيبَةٌ وَاللهُ أَعْلَمُ
65.31 [Machine] What does he say about the term "ta'dil"?
٦٥۔٣١ بَابُ مَا يَقُولُ فِي لَفْظِ التَّعْدِيلِ
[Machine] The Messenger of Allah ﷺ and Umar ibn al-Khattab cut off a certain piece of land for me. Zubayr went to the family of Umar and bought his share from them. Then he came to Uthman ibn Affan and said, "Abdul Rahman claims that the Messenger of Allah ﷺ cut off a certain piece of land for him." Uthman replied, "His testimony and yours are acceptable, but it has already been mentioned in the hadith regarding forgetfulness in prayer from Umar ibn al-Khattab that he said to Abdul Rahman ibn Awf, 'You are known for your fairness and contentment, so what did you hear?'"
أَقْطَعَنِي رَسُولُ اللهِ ﷺ وَعُمَرَ بْنَ الْخَطَّابِ ؓ أَرْضَ كَذَا وَكَذَا فَذَهَبَ الزُّبَيْرُ إِلَى آلِ عُمَرَ فَاشْتَرَى نَصِيبَهُ مِنْهُمْ ثُمَّ أَتَى عُثْمَانَ بْنَ عَفَّانَ ؓ فَقَالَ إِنَّ عَبْدَ الرَّحْمَنِ زَعَمَ أَنَّ رَسُولَ اللهِ ﷺ أَقْطَعَهُ أَرْضَ كَذَا وَكَذَا فَقَالَ هُوَ جَائِزُ الشَّهَادَةِ لَهُ وَعَلَيْهِ وَقَدْ مَضَى فِي حَدِيثِ السَّهْوِ فِي الصَّلَاةِ عَنْ عُمَرَ بْنِ الْخَطَّابَ ؓ أَنَّهُ قَالَ لِعَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ ؓ فَأَنْتَ عِنْدَنَا الْعَدْلُ الرِّضَا فَمَاذَا سَمِعْتَ؟
[Machine] The Messenger of Allah ﷺ said: "When a man is asked about his brother, he has two options: if he chooses to remain silent, then he is in the right. And if he chooses to speak, then he is truthful." Abu Bakr Al-Sulaimani informed us, who was informed by Abu Al-Husayn Al-Fasawi, who was informed by Abu Ali Al-Lu'lu'i, who was informed by Abu Dawood. He mentioned it and said that one of them said about the man.
قَالَ رَسُولُ اللهِ ﷺ إِذَا سُئِلَ الرَّجُلُ عَنْ أَخِيهِ فَهُوَ بِالْخِيَارِ إِنْ شَاءَ سَكَتَ وَإِنْ شَاءَ قَالَ فَصَدَقَ أَخْبَرَنَاهُ أَبُو بَكْرٍ السُّلَيْمَانِيُّ أنبأ أَبُو الْحُسَيْنِ الْفَسَوِيُّ ثنا أَبُو عَلِيٍّ اللُّؤْلُؤِيُّ ثنا أَبُو دَاوُدَ فَذَكَرَهُ قَالَ وَقَالَ أَحَدُهُمَا عَنِ الرَّجُلِ
65.32 [Machine] Who is being referred to in the question, their knowledge must be advanced.
٦٥۔٣٢ بَابُ مَنَ يُرْجَعُ إِلَيْهِ فِي السُّؤَالِ , يَجِبُ أَنْ تَكُونَ مَعْرِفَتُهُ بَاطِنَةً مُتَقَادِمَةً
“A man said to the Messenger of Allah ﷺ: ‘How can I know when I have done well and when I have done something bad?’ The Prophet ﷺ said: ‘If you hear your neighbors saying that you have done well, then you have done well, and if you hear them saying that you have done something bad, then you have done something bad.’” (Using translation from Ibn Mājah 4223)
قَالَ رَجُلٌ لِلنَّبِيِّ ﷺ يَا رَسُولَ اللهِ كَيْفَ أَعْلَمُ إِذَا أَحْسَنْتُ وَإِذَا أَسَأْتُ؟ فَقَالَ النَّبِيُّ صَلَّى اللهَ عَلَيْهِ وَسَلَّمَ إِذَا سَمِعْتَ جِيرَانَكَ يَقُولُونَ قَدْ أَحْسَنْتَ فَقَدْ أَحْسَنْتَ وَإِذَا سَمِعْتَهُمْ يَقُولُونَ قَدْ أَسَأْتَ فَقَدْ أَسَأْتَ
“A man came to the Prophet ﷺ and said: ‘O Messenger of Allah, how can I know, when I have done something good, that I have done well, and if I have done something bad, that I have done a bad deed?’ The Messenger of Allah ﷺ said: ‘If your neighbors say that you have done something good, then you have done well, and if they say that you have done something bad, then you have done something bad.’” (Using translation from Ibn Mājah 4222)
أَتَى النَّبِيَّ ﷺ رَجُلٌ فَقَالَ يَا رَسُولَ اللهِ كَيْفَ لِي أَنْ أَعْلَمَ إِذَا أَحْسَنْتُ أَنِّي قَدْ أَحْسَنْتُ وَإِذَا أَسَأْتُ أَنِّي قَدْ أَسَأْتُ؟ فَقَالَ رَسُولُ اللهِ ﷺ إِذَا قَالَ لَكَ جِيرَانُكَ قَدْ أَحْسَنْتَ فَقَدْ أَحْسَنْتَ وَإِذَا قَالَ لَكَ جِيرَانُكَ قَدْ أَسَأْتَ فَقَدْ أَسَأْتَ
[Machine] I was with the Messenger of Allah ﷺ when a man passed by him and asked him, "How are you, O Abdullah? Do you know him?" I said, "Yes." He asked, "What is his name?" I said, "I do not know." He asked, "Where is his house?" I said, "I do not know." He said, "Then this is not knowledge." It was narrated by Abu Dawood in Al-Marasil from Sulaiman ibn Harb, from Ibn Uyaynah, from Ibn Abi Najih, who said, "A man passed by the Prophet ﷺ and said, 'Who knows him?' A man said, 'I know him by his face but not by his name.' The Prophet said, 'That is not knowledge.' Abu Bakr Muhammad ibn Muhammad informed us, narrating from Abu Al-Husayn Al-Fasawi, from Abu Ali Al-Lu'lu'i, from Abu Dawood, who mentioned it as a Marfu' Hadith (a narration attributed to the Prophet)."
كُنْتُ مَعَ رَسُولِ اللهِ ﷺ فَمَرَّ رَجُلٌ بِرَسُولِ اللهِ ﷺ يَسْأَلُهُ فَقَالَ كَيْفَ أَنْتَ يَا عَبْدَ اللهِ أَتَعْرِفُهُ؟ قُلْتُ نَعَمْ قَالَ مَا اسْمُهُ؟ قُلْتُ لَا أَدْرِي قَالَ فَأَيْنَ مَنْزِلُهُ؟ قَالَ قُلْتُ لَا أَدْرِي قَالَ فَلَيْسَ هَذِهِ بِمَعْرِفَةٍ كَذَا قَالَ 20399 وَرَوَاهُ أَبُو دَاوُدَ فِي الْمَرَاسِيلِ عَنْ سُلَيْمَانَ بْنِ حَرْبٍ عنِ ابنِ عُيَيْنَةَ عنِ ابنِ أَبِي نَجِيحٍ قَالَ مَرَّ رَجُلٌ عَلَى النَّبِيِّ ﷺ فَقَالَ مَنْ يَعْرِفُهُ فَقَالَ رَجُلٌ أَنَا أَعْرِفُهُ بِوَجْهِهِ وَلَا أَعْرِفُهُ بِاسْمِهِ قَالَ لَيْسَتْ تِلْكَ بِمَعْرِفَةٍ أَخْبَرَنَاهُ أَبُو بَكْرٍ مُحَمَّدُ بْنُ مُحَمَّدٍ ثنا أَبُو الْحُسَيْنِ الْفَسَوِيُّ ثنا أَبُو عَلِيٍّ اللُّؤْلُؤِيُّ ثنا أَبُو دَاوُدَ فَذَكَرَهُ مُرْسَلًا وَهُوَ الصَّحِيحُ
[Machine] "So, is he your closest neighbor whom you know his day and night, his entrance and exit?" He said, "No." He said, "So, is he the one you deal with using dinars and dirhams, which are used as evidence for his integrity?" He said, "No." He said, "So, is he your companion in travel who is known for his noble manners?" He said, "No." He then said to the man, "Bring someone who knows you."
فَهُوَ جَارُكَ الْأَدْنَى الَّذِي تَعْرِفُ لَيْلَهَ وَنَهَارَهَ وَمَدْخَلَهُ وَمَخْرَجَهُ؟ قَالَ لَا قَالَ فَمُعَامِلُكَ بِالدِّينَارِ وَالدِّرْهَمِ اللَّذَيْنِ بِهِمَا يُسْتَدَلُّ عَلَى الْوَرَعِ؟ قَالَ لَا قَالَ فَرَفيِقُكَ فِي السَّفَرِ الَّذِي يُسْتَدَلُّ عَلَى مَكَارِمِ الْأَخْلَاقِ؟ قَالَ لَا قَالَ لَسْتَ تَعْرِفُهُ ثُمَّ قَالَ لِلرَّجُلِ ائْتِ بِمَنْ يَعْرِفُكَ

٦٥۔٣٣ بَابُ اتِّخَاذِ الْكُتَّابِ
The Prophet ﷺ has a secretary named Sijill. (Using translation from Abū Dāʾūd 2935)
فِي قَوْلِهِ تَعَالَى {يَوْمَ نَطْوِي السَّمَاءَ كَطِيِّ السِّجِلِّ لِلْكُتُبِ} [الأنبياء 104] قَالَ كَانَ لِلنَّبِيِّ ﷺ كَاتِبٌ يُدْعَى السِّجِلَّ

السِّجِلُّ كَاتِبٌ كَانَ لِلنَّبِيِّ ﷺ
[Machine] The Prophet ﷺ received a letter from a man. He said to Abdullah ibn Arqam, "Answer it for me." So he wrote down his response and then read it to him. The Prophet ﷺ said, "You have done well and done good. O Allah, grant him success." When Umar became the leader, he would consult him.
أَتَى النَّبِيَّ ﷺ كِتَابُ رَجُلٍ فَقَالَ لِعَبْدِ اللهِ بْنِ الْأَرْقَمِ أَجِبْ عَنِّي فَكَتَبَ جَوَابَهُ ثُمَّ قَرَأَهُ عَلَيْهِ فَقَالَ أَصَبْتَ وَأَحْسَنْتَ اللهُمَّ وَفِّقْهُ فَلَمَّا وَلِيَ عُمَرُ ؓ كَانَ يُشَاوِرُهُ
[Machine] I asked a brother, "Who was the scribe of the Messenger of Allah ﷺ?" He said, "Abdullah ibn Arqam, and he brought us a book from Abu Bakr in Al-Qadisiyyah, and Abdullah ibn Arqam wrote in it."
قُلْتُ لِشَقِيقٍ مَنْ كَانَ كَاتِبَ رَسُولِ اللهِ ﷺ؟ قَالَ عَبْدُ اللهِ بْنُ أَرْقَمَ وَقَدْ أَتَانَا كِتَابُ أَبِي بَكْرٍ ؓ بِالْقَادِسِيَّةِ وَفِي أَسْفَلِهِ وَكَتَبَ عَبْدُ اللهِ بْنُ أَرْقَمَ
[Machine] The Prophet ﷺ appointed Abdullah ibn Arqam as his scribe, and Abdullah would write for him and answer for him to the kings. It was known from his honesty that he would command him to write to some of the kings, so he would write, then he would command him to write and seal, and not read it due to his trust in him. Then, he also appointed Zaid ibn Thabit as a scribe. He would write the revelations and also write to the kings. Whenever Abdullah ibn Arqam and Zaid ibn Thabit were absent or needed to write to some commanders of the armies and the kings, or write a letter to a person that Jafar ibn Abu Talib would dictate, they would write it. Omar and Uthman had written for him, and Zaid, Al-Mughira, Muawiyah, Khalid ibn Sa'eed ibn al-'Aas, and others from the Arabs who were named.
أَنَّ النَّبِيَّ ﷺ اسْتَكْتَبَ عَبْدَ اللهِ بْنَ أَرْقَمَ فَكَانَ يَكْتُبُ عَبْدُ اللهِ بْنُ أَرْقَمَ وَكَانَ يُجِيبُ عَنْهُ الْمُلُوكَ فَبَلَغَ مِنْ أَمَانَتِهِ أَنَّهُ كَانَ يَأْمُرُهُ أَنْ يَكْتُبَ إِلَى بَعْضِ الْمُلُوكِ فَيَكْتُبَ ثُمَّ يَأْمُرُهُ أَنْ يَكْتُبَ وَيَخْتِمَ وَلَا يَقْرَأَه لِأَمَانَتِهِ عِنْدَهُ ثُمَّ اسْتَكْتَبَ أَيْضًا زَيْدَ بْنَ ثَابِتٍ فَكَانَ يَكْتُبُ الْوَحْيَ وََيَكْتُبُ إِلَى الْمُلُوكِ أَيْضًا وَكَانَ إِذَا غَابَ عَبْدُ اللهِ بْنُ أَرْقَمَ وَزَيْدُ بْنُ ثَابِتٍ وَاحْتَاجَ أَنْ يَكْتُبَ إِلَى بَعْضِ أُمَرَاءِ الْأَجْنَادِ وَالْمُلُوكِ أَوْ يَكْتُبَ لِإِنْسَانٍ كِتَابًا يُقْطِعَهُ أَمَرَ جَعْفَرًا أَنْ يَكْتُبَ وَقَدْ كَتَبَ لَهُ عُمَرُ وَعُثْمَانُ وَكَانَ زَيْدٌ وَالْمُغِيرَةُ وَمُعَاوِيَةُ وَخَالِدُ بْنُ سَعِيدِ بْنِ الْعَاصِ وَغَيْرُهُمْ مِمَّنْ قَدْ سُمِيَّ مِنَ الْعَرَبِ
65.34 [Machine] A writer should not be chosen for people's affairs until he possesses justice, wisdom, and understanding, away from greed.
٦٥۔٣٤ بَابُ: لَا يَتَّخِذُ كَاتِبًا لِأُمُورِ النَّاسِ حَتَّى يَجْمَعَ أَنْ يَكُونَ عَدْلًا عَاقِلًا فَقِيهًا بَعِيدًا مِنَ الطَّمَعِ
[Machine] Abu Bakr said, "Indeed, you are a young, intelligent man. We will not accuse you, and you used to write down the revelation for the Messenger of Allah ﷺ. So, collect the Quran (scriptures) together."
قَالَ أَبُو بَكْرٍ ؓ إِنَّكَ رَجُلٌ شَابٌّ عَاقِلٌ لَا نَتَّهِمُكَ وَقَدْ كُنْتَ تَكْتُبُ الْوَحْيَ لِرَسُولِ اللهِ ﷺ فَتَتَبَّعِ الْقُرْآنَ فَاجْمَعْهُ
65.35 [Machine] It is not appropriate for a judge or a governor to appoint a non-Muslim as a scribe, nor should a Muslim put a non-Muslim in a position of authority. There is a narration in the book Al-Siyar that mentions a statement from Aisha, narrated by Urwa, from the Prophet ﷺ : "I will not seek assistance from a polytheist." And the wording is general.
٦٥۔٣٥ بَابُ لَا يَنْبَغِي لِلْقَاضِي وَلَا لِلْوَالِي أَنْ يَتَّخِذَ كَاتِبًا ذِمِّيًّا وَلَا يَضَعُ الذِّمِّيَّ فِي مَوْضِعٍ يَتَفَضَّلُ فِيهِ مُسْلِمًا رُوِّينَا فِي كِتَابِ السِّيَرِ عَنْ عُرْوَةَ عَنْ عَائِشَةَ، عَنِ النَّبِيِّ ﷺ: " لَنْ أَسْتَعِينَ بِمُشْرِكٍ " وَاللَّفْظُ عَامٌّ
The Messenger of Allah ﷺ ordered me (to learn the writing of the Jews), so I learnt for him the writing of the Jews. He said: I swear by Allah, I do not trust Jews in respect of writing for me. So I learnt it, and only a fortnight passed before I mastered it. I would write for him when he wrote (to them), and read to him when something was written to him. (Using translation from Abū Dāʾūd 3645)
قَالَ زَيْدُ بْنُ ثَابِتٍ أَمَرَنِي رَسُولُ اللهِ ﷺ فَتَعَلَّمْتُ لَهُ كِتَابَ يَهُودَ وَقَالَ إِنِّي وَاللهِ مَا آمَنُ يَهُودَ عَلَى كِتَابِي فَتَعَلَّمْتُهُ فَلَمْ يَمُرَّ بِي نِصْفُ شَهْرٍ وَقَالَ أَبُو دَاوُدَ إِلَّا نِصْفُ شَهْرٍ حَتَّى حَذَقْتُهُ قَالَ أَبِي فَكُنْتُ أَكْتُبُ لَهُ إِذَا كَتَبَ وَأَقْرَأُ لَهُ إِذَا كُتِبَ إِلَيْهِ
[Machine] The Messenger of Allah ﷺ said, "Do not seek guidance from the fire of the polytheists, and do not inscribe anything in Arabic on your rings." So they went to Al-Hassan and said to him, "Indeed, Anas has narrated to us today a hadith that we do not know what it is." He asked them, "And what did he narrate to you?" So they mentioned it to him. He said, "Yes, as for his statement 'Do not inscribe anything in Arabic on your rings,' it means do not inscribe 'Muhammad' on your rings. And as for his statement 'Do not seek guidance from the fire of the polytheists,' it means do not seek consultation from the polytheists in any of your matters. And the confirmation of that is in the book of Allah (glorified and exalted be He), 'O you who have believed, do not take as intimates those other than yourselves, for they will not spare you [any] ruin.' [Surah Al-Imran, 3:118]."
قَالَ رَسُولُ اللهِ ﷺ لَا تَسْتَضِيئُوا بِنَارِ الْمُشْرِكِينَ وَلَا تَنْقُشُوا فِي خَوَاتِيمِكُمْ عَرَبِيًّا فَأَتَوَا الْحَسَنَ فَقَالُوا إِنَّ أَنَسًا حَدَّثَنَا الْيَوْمَ بِحَدِيثٍ لَا نَدْرِي مَا هُوَ؟ قَالَ وَمَا حَدَّثَكُمْ؟ فَذَكَرُوهُ قَالَ نَعَمْ أَمَّا قَوْلُهُ لَا تَنْقُشُوا فِي خَوَاتِيمِكُمْ عَرَبِيًّا فَإِنَّهُ يَقُولُ لَا تَنْقُشُوا فِي خَوَاتِيمِكُمْ مُحَمَّدًا وَأَمَّا قَوْلُهُ لَا تَسْتَضِيئُوا بِنَارِ الْمُشْرِكِينَ فَإِنَّهُ يَقُولُ لَا تَسْتَشِيرُوا الْمُشْرِكِينَ فِي شَيْءٍ مِنْ أُمُورِكُمْ وَتَصْدِيقُ ذَلِكَ فِي كِتَابِ اللهِ ﷻِّ {يَا أَيُّهَا الَّذِينَ آمَنُوا لَا تَتَّخِذُوا بِطَانَةً مِنْ دُونِكُمْ لَا يَأْلُونَكُمْ خَبَالًا} [آل عمران 118]
[Machine] He is a Christian who does not enter the mosque, so Umar reprimanded him, suspected him, and said, "Do not honor them when Allah has humiliated them, do not get close to them when Allah has distanced them, and do not trust them when Allah has betrayed them." Abu Al-Qasim Zaid ibn Abi Hashim Al-Alawi and Abu Al-Qasim Abdul Wahid bin Muhammad bin Al-Najjar Al-Muqri' Al-Kufi informed us that Abu Ja'far bin Duhaim narrated to us that Ahmad bin Hazim narrated to us that Amr bin Hammad narrated to us that Asbat narrated to us from Simak from Iyad al-Ash'ari from Abu Musa that Umar commanded him to present to him everything he took and gave in a single record, and Abu Musa had a Christian scribe who recorded that for him. Umar was astounded and said, "Indeed, this is a guardian." He said, "Indeed, we have a book in the mosque, and it came from Sham, so invite him to read it." Abu Musa said, "He is not able to enter the mosque." Umar said, "Is he impure?" He said, "No, but he is a Christian." Umar reprimanded me, slapped my thigh, and said, "Take him out." He recited, "O you who have believed, do not take the Jews and the Christians as allies. They are allies of one another. And whoever is an ally to them among you, then indeed, he is one of them. Indeed, Allah does not guide the wrongdoing people." [Al-Ma'idah 51] Abu Musa said, "By Allah, I did not take him as an ally. He was only writing for me." Umar said, "Did you not find among the people of Islam someone to write for you? Do not get close to them when Allah has distanced them, and do not trust them when Allah has betrayed them, and do not honor them after Allah has humiliated them. So, take him out."
إِنَّهُ نَصْرَانِيٌّ لَا يَدْخُلُ الْمَسْجِدَ فَانْتَهَرَهُ عُمَرُ ؓ وَهَمَّ بِهِ وَقَالَ لَا تُكْرِمُوهُمْ إِذْ أَهَانَهُمُ اللهُ وَلَا تُدْنُوهُمْ إِذْ أَقْصَاهُمُ اللهُ وَلَا تَأْتَمِنُوهُمْ إِذْ خَوَّنَهُمُ اللهُ ﷻ وَأَخْبَرَنَا أَبُو الْقَاسِمِ زَيْدُ بْنُ أَبِي هَاشِمٍ الْعَلَوِيُّ وَأَبُو الْقَاسِمِ عَبْدُ الْوَاحِدِ بْنُ مُحَمَّدِ بْنِ النَّجَّارِ الْمُقْرِئُ بِالْكُوفَةِ قَالَا أنبأ أَبُو جَعْفَرِ بنُ دُحَيْمٍ ثنا أَحْمَدُ بْنُ حَازِمٍ ثنا عَمْرُو بْنُ حَمَّادٍ عَنْ أَسْبَاطٍ عَنْ سِمَاكٍ عَنْ عِيَاضٍ الْأَشْعَرِيِّ عَنْ أَبِي مُوسَى ؓ أَنَّ عُمَرَ ؓ أَمَرَهُ أَنْ يَرْفَعَ إِلَيْهِ مَا أَخَذَ وَمَا أَعْطَى فِي أَدِيمٍ وَاحِدٍ وَكَانَ لِأَبِي مُوسَى كَاتِبٌ نَصْرَانِيٌّ يَرْفَعُ إِلَيْهِ ذَلِكَ فَعَجِبَ عُمَرُ ؓ وَقَالَ إِنَّ هَذَا لَحَافِظٌ وَقَالَ إِنَّ لَنَا كِتَابًا فِي الْمَسْجِدِ وَكَانَ جَاءَ مِنَ الشَّامِ فَادْعُهُ فَلْيَقْرَأْ قَالَ أَبُو مُوسَى إِنَّهُ لَا يَسْتَطِيعُ أَنْ يَدْخُلَ الْمَسْجِدَ فَقَالَ عُمَرُ ؓ أَجُنُبٌ هُوَ؟ قَالَ لَا بَلْ نَصْرَانِيٌّ قَالَ فَانْتَهَرَنِي وَضَرَبَ فَخِذِي وَقَالَ أَخْرِجْهُ وَقَرَأَ {يَا أَيُّهَا الَّذِينَ آمَنُوا لَا تَتَّخِذُوا الْيَهُودَ وَالنَّصَارَى أَوْلِيَاءَ بَعْضُهُمْ أَوْلِيَاءُ بَعْضٍ وَمَنْ يَتَوَلَّهُمْ مِنْكُمْ فَإِنَّهُ مِنْهُمْ إِنَّ اللهَ لَا يَهْدِي الْقَوْمَ الظَّالِمِينَ} [المائدة 51] قَالَ أَبُو مُوسَى وَاللهِ مَا تَوَلِّيتُهُ إِنَّمَا كَانَ يَكْتُبُ قَالَ أَمَا وَجَدْتَ فِي أَهْلِ الْإِسْلَامِ مَنْ يَكْتُبُ لَكَ؟ لَا تُدْنِهِمْ إِذْ أَقْصَاهُمُ اللهُ وَلَا تَأْمَنْهُمْ إِذْ خَوَّنَهُمُ اللهُ وَلَا تُعِزَّهُمْ بَعْدَ إِذْ أَذَلَّهُمُ اللهُ فَأَخْرِجْهُ
65.36 [Machine] The Book of the Judge to the Judge, and the Judge to the Prince, and the Prince to the Judge.
٦٥۔٣٦ بَابُ كِتَابِ الْقَاضِي إِلَى الْقَاضِي , وَالْقَاضِي إِلَى الْأَمِيرِ , وَالْأَمِيرِ إِلَى الْقَاضِي
[Machine] So the Messenger of Allah ﷺ wrote to them about that, and they wrote back saying, "By Allah, we did not kill him."
فَكَتَبَ إِلَيْهِمْ رَسُولُ اللهِ ﷺ فِي ذَلِكَ فَكَتَبُوا أَنَّهُ وَاللهِ مَا قَتَلْنَاهُ
[Machine] "That Abu Bakr wrote this book when he went to Bahrain, in the name of Allah, the Most Gracious, the Most Merciful. These are the obligations of charity that Allah has commanded upon the Muslims, which Allah ordered His Messenger ﷺ to do. So whoever is asked for them among the Muslims, should give them, and whoever is asked above them, should not give. And he mentioned the narration."
أَنَّ أَبَا بَكْرٍ ؓ كَتَبَ هَذَا الْكِتَابَ لَمَّا وَجَّهَهُ إِلَى الْبَحْرَيْنِ بِسْمِ اللهِ الرَّحْمَنِ الرَّحِيمِ هَذِهِ فَرَائِضُ الصَّدَقَةِ الَّتِي فَرَضَهَا اللهُ عَلَى الْمُسْلِمِينَ الَّتِي أَمَرَ اللهُ بِهَا رَسُولَهَ ﷺ فَمَنْ سُئِلَهَا مِنَ الْمُسْلِمِينَ عَلَى وَجْهِهَا فَلْيُعْطَهَا وَمَنْ سُئِلَ فَوْقَهَا فَلَا يُعْطَ وَذَكَرَ الْحَدِيثَ
[Machine] How satisfied are Muslims in their journeys with this? So the Messenger of Allah said, "O Allah, no." Then Umar said, "No, I do not want." And he wrote to Uthba saying, "Afterwards, it is not from your efforts, nor from the efforts of your father, nor from the efforts of your mother. So satisfy those Muslims who came before you in their journeys with what you satisfied from it in your journey. Then he said, "Wear your clothes, cover yourselves, put on shoes, discard long garments and sandals, throw away belongings and discard baggage, go in groups and rely on preparedness and skill, and abandon luxury and the dress of non-Arabs. And beware of wearing silk, for indeed the Messenger of Allah ﷺ forbade us from wearing silk except like this." And he placed his index finger and middle finger together.
عُمَرُ ؓ أَيَشْبَعُ الْمُسْلِمُونَ فِي رِحَالِهِمْ مِنْ هَذَا؟ فَقَالَ الرَّسُولُ اللهُمَّ لَا فَقَالَ عُمَرُ ؓ لَا أُرِيدُ وَكَتَبَ إِلَى عُتْبَةَ أَمَّا بَعْدُ فَإِنَّهُ لَيْسَ مِنْ كَدِّكَ وَلَا مِنْ كَدِّ أَبِيكَ وَلَا مِنْ كَدِّ أُمِّكَ فَأَشْبِعْ مَنْ قِبَلَكَ مِنَ الْمُسْلِمِينَ فِي رِحَالِهِمْ مِمَّا تَشْبَعُ مِنْهُ فِي رَحْلِكَ ثُمَّ قَالَ ائْتَزِرُوا وَارْتَدُوا وَانْتَعِلُوا وَأَلْقُوا السَّرَاوِيلَاتِ وَالْخِفَافَ وَارْمُوا الْأَغْرَاضَ وَأَلْقُوا الرُّكَبَ وَانْزُوا نَزْوًا وَعَلَيْكُمْ بِالْمَعَدِّيَّةِ وَالْعَرَبِيَّةِ وَذَرُوا التَّنَعُّمَ وَزِيَّ الْعَجَمِ وَإِيَّاكُمْ وَلِبْسَ الْحَرِيرِ فَإِنَّ رَسُولَ اللهِ ﷺ نَهَانَا عَنْ لِبْسِ الْحَرِيرِ إِلَّا هَكَذَا وَوَضَعَ أُصْبُعَهُ السَّبَابَةَ وَالْوُسْطَى
65.37 [Machine] The completion of the book
٦٥۔٣٧ بَابُ خَتْمِ الْكِتَابِ
When the Prophet ﷺ intended to write to the Byzantines, it was said to him, "Those people do not read your letter unless it is stamped." So the Prophet ﷺ took a silver ring and got 'Muhammad, the Apostle of Allah' engraved on it .... as if I am now looking at its glitter in his hand. (Using translation from Bukhārī 5875)
لَمَّا أَرَادَ رَسُولُ اللهِ ﷺ أَنْ يَكْتُبَ إِلَى الرُّومِ قِيلَ لَهُ إِنَّهُمْ لَنْ يَقْرَءُوا كِتَابَكَ إِذَا لَمْ يَكُنْ مَخْتُومًا فَاتَّخَذَ خَاتَمًا مِنْ فِضَّةٍ وَنَقَشَهُ مُحَمَّدٌ رَسُولُ اللهِ قَالَ أَنَسٌ فَكَأَنَّمَا أَنْظُرُ إِلَى بَيَاضِهِ فِي يَدِهِ
"The Messenger of Allah ﷺ had a ring made from silver, so he had 'Muhammad, the Messenger of Allah' engraved on it. Then he said: 'Do not engrave with it.' (Using translation from Tirmidhī 1745)
أَنَّ النَّبِيَّ ﷺ صَنَعَ خَاتَمًا مِنْ وَرِقٍ فَنَقَشَ فِيهِ مُحَمَّدٌ رَسُولُ اللهِ ﷺ وَقَالَ لَا تَنْقُشُوا عَلَيْهِ
Messenger of Allah ﷺ took a silver ring and had 'Muhammad, the Apostle' of Allah' engraved on it. The Prophet then said (to us), 'I have a silver ring with 'Muhammad, the Messenger of Allah engraved on it, so none of you should have the same engraving on his ring." أَنَّ رَسُولَ اللهِ ﷺ اتَّخَذَ خَاتَمًا مِنْ فِضَّةٍ وَنَقَشَ فِيهِ مُحَمَّدٌ رَسُولُ اللهِ وَقَالَ إِنِّي اتَّخَذْتُ خَاتَمًا مِنْ فِضَّةٍ وَنَقَشْتُ فِيهِ مُحَمَّدٌ رَسُولُ اللهِ فَلَا يَنْقُشْ أَحَدٌ عَلَى نَقْشِهِ
65.38 [Machine] Precautions in reading, testifying, and sealing the book, so that it is not forged. And Muttarif ibn Abdullah said: "Beware of people with ill intentions.
٦٥۔٣٨ بَابُ الِاحْتِيَاطِ فِي قِرَاءَةِ الْكِتَابِ وَالْإِشْهَادِ عَلَيْهِ وَخَتْمِهِ لِئَلَّا يُزَوَّرَ عَلَيْهِ وَقَدْ قَالَ مُطَرِّفُ بْنُ عَبْدِ اللهِ: " احْتَرِسُوا مِنَ النَّاسِ بِسُوءِ الظَّنِّ "
[Machine] Narrated by Anas bin Malik, may Allah be pleased with him, and caution should be taken from similar ones, it is a followed Sunnah.
عَنْ أَنَسِ بْنِ مَالِكٍ مَرْفُوعًا وَالْحَذَرُ مِنْ أَمْثَالِهِ سُنَّةٌ متَّبَعَةٌ
The Messenger of Allah ﷺ called me. He intended to send me with some goods to AbuSufyan to distribute among the Quraysh at Mecca after the conquest. He said: Search for a companion. Then Amr ibn Umayyah ad-Damri came to me and said: I have been told that you are intending to make a journey and are seeking a companion. I said: Yes. He said: I am your companion. I then went to the Messenger of Allah ﷺ and said: I have found a companion. He asked: Who is he? I replied: Amr ibn Umayyah ad-Damri. He said: When you come down to the territory of his people, be careful of him, for a maxim says: If one is your real brother, do not feel safe with him. So we proceeded, and when I reached al-Abwa', he said to me: I have some work with my people at Waddan, so stay here till I come back. I said: Do not lose your way. When he turned his back, I recalled the words of the Prophet ﷺ. So I rode my camel and galloped without stopping. When I reached al-Asafir, he was pursuing me with a group of men. So I galloped and forged ahead of him. When he saw me that I had outstripped him, they returned and he came to me. He said to me: I had some work with my people. I said: Yes. We then went on until we reached Mecca, and I gave the goods to AbuSufyan. (Using translation from Abū Dāʾūd 4861)
دَعَانِي رَسُولُ اللهِ ﷺ وَقَدْ أَرَادَ أَنْ يَبْعَثَنِي بِمَالٍ إِلَى أَبِي سُفْيَانَ يَقْسِمُهُ فِي قُرَيْشٍ بِمَكَّةَ بَعْدَ الْفَتْحِ فَقَالَ الْتَمِسْ صَاحِبًا قَالَ فَجَاءَنِي عَمْرُو بْنُ أُمَيَّةَ الضَّمْرِيُّ فَقَالَ بَلَغَنِي أَنَّكَ تُرِيدُ الْخُرُوجَ وَتَلْتَمِسُ صَاحِبًا قَالَ قُلْتُ أَجَلْ قَالَ فَأَنَا لَكَ صَاحِبٌ قَالَ فَجِئْتُ رَسُولَ اللهِ ﷺ فَقُلْتُ قَدْ وَجَدْتُ صَاحِبًا قَالَ فَقَالَ لِيَ مَنْ؟ فَقُلْتُ عَمْرُو بْنُ أُمَيَّةَ الضَّمْرِيُّ قَالَ إِذَا هَبَطْتَ بِلَادَ قَوْمِهِ فَاحْذَرْهُ فَإِنَّهُ قَدْ قَالَ الْقَائِلُ أَخُوكَ الْبَكْرِيُّ فَلَا تَأْمَنْهُ قَالَ فَخَرَجْنَا حَتَّى إِذَا كُنَّا بِالْأَبْوَاءِ قَالَ إِنِّي أُرِيدُ حَاجَةً إِلَى قَوْمِي بِوَدَّانَ فَتَلَبَّثْ لِي قُلْتُ رَاشِدًا فَلَمَّا وَلَّى ذَكَرْتُ قَوْلَ النَّبِيِّ ﷺ فَشَدَدْتُ عَلَى بَعِيرِي حَتَّى خَرَجْتُ أُوضِعُهُ حَتَّى إِذَا كُنْتُ بِالْأَصَافِرِ إِذَا هُوَ يُعَارِضُنِي فِي رَهْطٍ قَالَ وَأَوْضَعْتُ فَسَبَقْتُهُ فَلَمَّا رَآنِي أَنْ قَدْ فُتُّهُ انْصَرَفُوا وَجَاءَنِي فَقَالَ كَانَتْ لِي إِلَى قَوْمِي حَاجَةٌ قَالَ قُلْتُ أَجَلْ وَمَضَيْنَا حَتَّى إِذَا قَدِمْنَا مَكَّةَ فَدَفَعْتُ الْمَالَ إِلَى أَبِي سُفْيَانَ
