٥١۔ كِتَابُ الدِّيَاتِ ص ٣
[Machine] If Umar had caught him, he would have ensured his payment of blood money.
لَوْ أَدْرَكَهُ عُمَرُ ؓ لَضَمَّنَهُ الدِّيَةَ
51.26 [Machine] The translation of the heading "دِيَةِ الْعَيْنَيْنِ" into English is "Blood money for both eyes.
٥١۔٢٦ بَابُ دِيَةِ الْعَيْنَيْنِ قَدْ رُوِّينَا فِي الْحَدِيثِ الْمَوْصُولِ عَنْ عَمْرِو بْنِ حَزْمٍ، عَنِ النَّبِيِّ ﷺ: وَفِي الْعَيْنَيْنِ الدِّيَةُ
[Machine] On the authority of the Messenger of Allah, ﷺ , he said about the ransom in case of a physical injury: "If his nose is severed, the compensation is one hundred camels; if it is a hand, it is fifty; if it is a leg, it is fifty; if it is an eye, it is fifty; if it is a bone, it is a third of the soul; if it is a joint, it is a third of the soul; if it is a shoulder, it is fifteen; if it is a jawbone, it is five; if it is a tooth, it is five; and for each finger, there are ten. Waki narrated it from Muhammad bin Abdul Rahman bin Abi Layla, who narrated it from Ikrimah bin Khalid, who narrated it from a man from the descendants of Umar ibn Al-Khattab. He said, "The Messenger of Allah, ﷺ , decided it and mentioned it with additions and subtractions."
عَنْ رَسُولِ اللهِ ﷺ أَنَّهُ قَالَ فِي الْأَنْفِ الدِّيَةُ إِذَا اسْتُوعِيَ جَدْعُهُ مِائَةٌ مِنَ الْإِبِلِ وَفِي الْيَدِ خَمْسُونَ وَفِي الرِّجْلِ خَمْسُونَ وَفِي الْعَيْنِ خَمْسُونَ وَفِي الْآمَّةِ ثُلُثُ النَّفْسِ وَفِي الْجَائِفَةِ ثُلُثُ النَّفْسِ وَفِي الْمُنَقِّلَةِ خَمْسَ عَشْرَةَ وَفِي الْمُوضِحَةِ خَمْسٌ وَفِي السِّنِّ خَمْسٌ وَفِي كُلِّ أُصْبُعٍ مِمَّا هُنَالِكَ عَشْرٌ وَرَوَاهُ وَكِيعٌ عَنْ مُحَمَّدِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ أَبِي لَيْلَى عَنْ عِكْرِمَةَ بْنِ خَالِدٍ عَنْ رَجُلٍ مِنْ آلِ عُمَرَ بْنِ الْخَطَّابِ ؓ قَالَ قَضَى رَسُولُ اللهِ ﷺ فَذَكَرَهُ بِزِيَادَاتٍ وَنُقْصَانٍ
أَنَّهُ قَالَ وَفِي الْعَيْنِ النِّصْفُ
51.27 [Machine] What is included in visual impairment?
٥١۔٢٧ بَابُ مَا جَاءَ فِي نَقْصِ الْبَصَرِ
[Machine] That a man injured the eye of another man, causing him to lose some of his eyesight while some remained. He took the matter to Ali, who ordered for the correct eye to be treated. It was treated and restored. Then Ali ordered a man to bring an egg, and he went with it while looking until his eyesight was completely restored. Then he drew a line as a sign at that spot, and looked at it, finding it to be equal. He said, "So he gave him an amount equal to what he had lost from his eyesight, then he drew on it from the wealth of the other."
أَنَّ رَجُلًا أَصَابَ عَيْنَ رَجُلٍ فَذَهَبَ بِبَعْضِ بَصَرِهِ وَبَقِيَ بَعْضٌ فَرَفَعَ ذَلِكَ إِلَى عَلِيٍّ ؓ فَأَمَرَ بِعَيْنِهِ الصَّحِيحَةِ فَعُصِبَتْ وَأَمَرَ رَجُلًا بِبَيْضَةٍ فَانْطَلَقَ بِهَا وَهُو يَنْظُرُ حَتَّى انْتَهَى بَصَرُهُ ثُمَّ خَطَّ عِنْدَ ذَلِكَ عَلَمًا ثُمَّ نَظَرَ فِي ذَلِكَ فَوَجَدَهُ سَوَاءً قَالَ فَأَعْطَاهُ بِقَدْرِ مَا نَقَصَ مِنْ بَصَرِهِ ثُمَّ خَطَّ عَلَيْهَا مِنْ مَالِ الْآخَرِ
51.28 [Machine] The Blood Money of the Two Eyes
٥١۔٢٨ بَابُ دِيَةِ أَشْفَارِ الْعَيْنَيْنِ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: وَفِي كُلِّ جَفْنٍ رُبُعُ الدِّيَةِ؛ لِأَنَّهَا أَرْبَعَةٌ فِي الْإِنْسَانِ، وَهِيَ مِنْ تَمَامِ خَلْقِهِ وَمِمَّا يَأْلَمُ بِقَطْعِهِ قِيَاسًا عَلَى أَنَّ النَّبِيَّ ﷺ جَعَلَ فِي بَعْضِ مَا فِي الْإِنْسَانِ مِنْهُ وَاحِدٌ الدِّيَةَ، وَفِي بَعْضِ مَا فِي الْإِنْسَانِ مِنْهُ اثْنَانِ الدِّيَةَ

51.29 [Machine] Diyyat al-'anfi
٥١۔٢٩ بَابُ دِيَةِ الْأَنْفِ
[Machine] Indeed, in the book that the Messenger of Allah ﷺ wrote for 'Amr ibn Hazm, it is mentioned that in the nose, if it becomes clogged, one should inhale the smoke of one hundred camels.
أَنَّ فِي الْكِتَابِ الَّذِي كَتَبَهُ رَسُولُ اللهِ ﷺ لِعَمْرِو بْنِ حَزْمٍ وَفِي الْأَنْفِ إِذَا أُوعِيَ جَدْعًا مِائَةٌ مِنَ الْإِبِلِ
[Machine] In the book of Amr ibn Hazm, when the Messenger of Allah ﷺ sent him to Najran, it is mentioned that when the vocal cords are completely removed from the nose, we have narrated in the continuous narration from Amr ibn Hazm from the Prophet ﷺ that when a camel's thigh is cooked, there should be marrow in it.
كَانَ فِي كِتَابِ عَمْرِو بْنِ حَزْمٍ حِينَ بَعَثَهُ رَسُولُ اللهِ ﷺ إِلَى نَجْرَانَ وَفِي الْأَنْفِ إِذَا اسْتُؤْصِلَتِ الْمَارِنُ الدِّيَةُ كَامِلَةً وَرُوِّينَا فِي الْحَدِيثِ الْمَوْصُولِ عَنْ عَمْرِو بْنِ حَزْمٍ عَنِ النَّبِيِّ ﷺ وَفِي الْأَنْفِ إِذَا أُوعِبَ جَدْعُهُ الدِّيَةُ
[Machine] The Messenger of Allah ﷺ has ruled that if someone is injured, they should receive full compensation. If their nose is injured, they should receive fifty camels or their equivalent in gold or silver.
قَضَى رَسُولُ اللهِ ﷺ فِي الْأَنْفِ إِذَا جُدِعَ بِالدِّيَةِ كَامِلَةً وَإِذَا جُدِعَتْ ثَنْدُوَتُهُ فَنِصْفُ الْعَقْلِ خَمْسُونَ مِنَ الْإِبِلِ أَوْ عِدْلُهَا مِنَ الذَّهَبِ أَوِ الْوَرِقِ
[Machine] About the Prophet ﷺ and about the nose, when the bridle of the camels is cut off, a hundred should be given.
عَنِ النَّبِيِّ ﷺ فِيهِ وَفِي الْأَنْفِ إِذَا قُطِعَ الْمَارِنُ مِائَةٌ مِنَ الْإِبِلِ
[Machine] The Messenger of Allah ﷺ said about the nose: "When its owner is aware of its scent, he should wash it." This was narrated to me by Abu Abdullah as his excuse from Abu Al-Walid. Ibn Zuhair narrated from Abdullah bin Hashim, who narrated from Waki' that he mentioned it, along with what we heard before about the eye.
قَضَى رَسُولُ اللهِ ﷺ فِي الْأَنْفِ إِذَا اسْتُوعِبَ مَارِنُهُ الدِّيَةَ وَهُوَ فِيمَا أَنْبَأَنِيهِ أَبُو عَبْدِ اللهِ إِجَازَةً أنبأ أَبُو الْوَلِيدِ ثنا ابْنُ زُهَيْرٍ ثنا عَبْدُ اللهِ بْنُ هَاشِمٍ ثنا وَكِيعٌ فَذَكَرَهُ وَذَكَرَ مَا رُوِّينَا قَبْلَ هَذَا فِي الْعَيْنِ
أَنَّهُ قَالَ وَفِي الْأَنْفِ الدِّيَةُ
أَنَّهُ كَانَ يَقُولُ فِي الْمَارِنِ الدِّيَةُ
[Machine] In the three turbinates of the nasal cavity, each one third of the total surface area is 16245. And it was narrated to us by Abbad, who narrated it from Haggag, who narrated it from Makhooul, who narrated it from Zaid ibn Thabit, similar to him.
فِي الْخَرَمَاتِ الثَّلَاثِ فِي الْأَنْفِ الدِّيَةُ وَفِي كُلِّ وَاحِدَةٍ ثُلُثُ الدِّيَةِ 16245 وَحَدَّثَنَا عَبَّادٌ ثنا حَجَّاجٌ عَنْ مَكْحُولٍ عَنْ زَيْدِ بْنِ ثَابِتٍ مِثْلَهُ
51.30 [Machine] Diyyah of the lips
٥١۔٣٠ بَابُ دِيَةِ الشَّفَتَيْنِ
[Machine] That the Messenger of Allah ﷺ wrote to the people of Yemen in a letter that included the stipulation of paying the diya (blood money).
أَنَّ رَسُولَ اللهِ ﷺ كَتَبَ إِلَى أَهْلِ الْيَمَنِ بِكِتَابٍ فِيهِ وَفِي الشَّفَتَيْنِ الدِّيَةُ
[Machine] Abu Bakr settled the dispute between the two parties with a hundred camels as blood money. It has been narrated to us that Al-Sha'bi said about the two parties: the blood money is half in each one.
قَضَى أَبُو بَكْرٍ ؓ فِي الشَّفَتَيْنِ بِالدِّيَةِ مِائَةٍ مِنَ الْإِبِلِ وَرُوِّينَا عَنِ الشَّعْبِيِّ أَنَّهُ قَالَ فِي الشَّفَتَيْنِ الدِّيَةُ وَفِي كُلِّ وَاحِدَةٍ مِنْهُمَا النِّصْفُ
51.31 [Machine] The ransom of the tongue
٥١۔٣١ بَابُ دِيَةِ اللِّسَانِ
[Machine] The Messenger of Allah wrote a letter to the people of Yemen, in which he mentioned the issue of blood money. It was narrated in a hadith by Mu'adh bin Jabal and in a hadith by a man from the family of Umar. We also heard it from Umar himself, which indicates that he used to rule in accordance with the concept of blood money.
أَنَّ رَسُولَ اللهِ ﷺ كَتَبَ إِلَى أَهْلِ الْيَمَنِ بِكِتَابٍ فِيهِ وَفِي اللِّسَانِ الدِّيَةُ وَهُوَ فِي حَدِيثِ مُعَاذِ بْنِ جَبَلٍ مَرْفُوعًا وَفِي حَدِيثِ رَجُلٍ مِنْ آلِ عُمَرَ ؓ عَنِ النَّبِيِّ ﷺ وَرُوِّينَا عَنْ عُمَرَ ؓ مَا دَلَّ عَلَى أَنَّهُ كَانَ يَقْضِي فِيهِ بِالدِّيَةِ
أَنَّهُ قَالَ فِي اللِّسَانِ الدِّيَةُ
[Machine] And in the tongue is life, and in the voice, when the fiber is severed.
وَفِي اللِّسَانِ الدِّيَةُ وَفِي الصَّوْتِ إِذَا انْقَطَعَ الدِّيَةُ
[Machine] "About the Messenger of Allah ﷺ , he said regarding the tongue the penalty is due when one refrains from speaking, and regarding the male genitals the penalty is due when the foreskin is cut, and regarding the lips the penalty is due when both lips are cut. This is a weak narration by Muhammad ibn Ubaydullah al-Arzami and Harith ibn Nabhan, both of them weak narrators."
عَنْ رَسُولِ اللهِ ﷺ قَالَ فِي اللِّسَانِ الدِّيَةُ إِذَا مَنَعَ الْكَلَامَ وَفِي الذَّكَرِ الدِّيَةُ إِذَا قُطِعَتِ الْحَشَفَةُ وَفِي الشَّفَتَيْنِ الدِّيَةُ هَذَا إِسْنَادٌ ضَعِيفٌ مُحَمَّدُ بْنُ عُبَيْدِ اللهِ الْعَرْزَمِيُّ وَالْحَارِثُ بْنُ نَبْهَانَ ضَعِيفَانِ
[Machine] To prevent speech, there is a diyya (blood money) involved. And whatever is less than that, it is based on estimation (with a value of) 16254. Wahb narrated to us from Abu Bakr, from Ibn Fudayl, from Ash'ath, from Al-Sha'bi, from Abdullah, who said: "Regarding the tongue, the diyya is paid when it is injured. And whatever is missing, it is based on estimation (with a value of) 16255." Abu Bakr narrated to us from Muhammad ibn Bakr, from Ibn Jurayj, from Amr ibn Shuayb, who said: "Abu Bakr made a ruling regarding the tongue that if it is severed, then when it is injured from its origin, and if it is cut, then he spoke that it is half of the diyya."
أَنْ يَمْنَعَ الْكَلَامَ فَفِيهِ الدِّيَةُ وَمَا كَانَ دُونَ ذَلِكَ فَبِحِسَابِهِ 16254 قَالَ وَحَدَّثَنَا أَبُو بَكْرٍ عَنِ ابْنِ فُضَيْلٍ عَنْ أَشْعَثَ عَنِ الشَّعْبِيِّ عَنْ عَبْدِ اللهِ قَالَ فِي اللِّسَانِ الدِّيَةُ إِذَا اسْتُوعِيَ فَمَا نَقَصَ فَبِحِسَابٍ 16255 قَالَ وَحَدَّثَنَا أَبُو بَكْرٍ عَنْ مُحَمَّدِ بْنِ بَكْرٍ عَنِ ابْنِ جُرَيْجٍ عَنْ عَمْرِو بْنِ شُعَيْبٍ قَالَ قَضَى أَبُو بَكْرٍ ؓ فِي اللِّسَانِ إِذَا قُطِعَ بِالدِّيَةِ إِذَا أُوعِيَ مِنْ أَصْلِهِ وَإِذَا قُطِعَ فَتَكَلَّمَ فَفِيهِ نِصْفُ الدِّيَةِ
أَنَّهُ قَالَ فِي ذَهَابِ الْكَلَامِ الدِّيَةُ
[Machine] The letters are twenty-eight letters, so whatever is cut from the tongue is based on what is lacking from the letters. It was narrated from Masrouq that he said about the tongue of the deaf and mute: "It is a form of governance."
الْحُرُوفُ ثَمَانِيَةٌ وَعِشْرُونَ حَرْفًا فَمَا قُطِعَ مِنَ اللِّسَانِ فَهُوَ عَلَى مَا نَقَصَ مِنَ الْحُرُوفِ وَرُوِيَ عَنْ مَسْرُوقٍ أَنَّهُ قَالَ فِي لِسَانِ الْأَخْرَسِ حُكُومَةٌ
51.32 [Machine] The tooth ransom
٥١۔٣٢ بَابُ دِيَةِ الْأَسْنَانِ قَدْ رُوِّينَا فِي الْحَدِيثِ الْمَوْصُولِ، عَنْ عَمْرِو بْنِ حَزْمٍ، عَنِ النَّبِيِّ ﷺ: وَفِي السِّنِّ خَمْسٌ مِنَ الْإِبِلِ
[Machine] That the Messenger of Allah ﷺ distributed (inheritance) in camels five by five, in sheep five by five, and in fingers ten by ten.
أَنَّ رَسُولَ اللهِ ﷺ قَضَى فِي الْمَوَاضِحِ خَمْسًا خَمْسًا مِنَ الْإِبِلِ وَفِي الْأَسْنَانِ خَمْسًا خَمْسًا وَفِي الْأَصَابِعِ عَشْرًا عَشْرًا
وَفِي السِّنِّ خَمْسٌ
[Machine] About the Prophet, ﷺ , for every year there are five camels, most abundant and famous.
عَنِ النَّبِيِّ ﷺ فِي كُلِّ سِنٍّ خَمْسٌ مِنَ الْإِبِلِ أَكْثَرُ وَأَشْهَرُ
[Machine] From Zaid, the like of him, 16261. And all of this Abu Abdullah Al-Hafiz informed me a permit. Abu Al-Walid informed me. Hassan bin Sufyan informed me. Abu Bakr bin Abi Shaybah informed me. Abu Khalid informed me from Hisham from Muhammad from Shuraib. So, he mentioned it, 16262. He said: Abu Bakr narrated to us. Abbād narrated us, from Husayn, from Ash-Sha'abi, from Al-Harith, from Ali. So, he mentioned it. And from Abbād, from Hujayj, from Makḥūl, from Zaid, the like of him.
عَنْ زَيْدٍ ؓ مِثْلَهُ 16261 وَهَذَا كُلُّهُ فِيمَا أَنْبَأَنِي أَبُو عَبْدِ اللهِ الْحَافِظُ إِجَازَةً أنبأ أَبُو الْوَلِيدِ ثنا الْحَسَنُ بْنُ سُفْيَانَ ثنا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ ثنا أَبُو خَالِدٍ عَنْ هِشَامٍ عَنْ مُحَمَّدٍ عَنْ شُرَيْحٍ فَذَكَرَهُ 16262 قَالَ وَحَدَّثَنَا أَبُو بَكْرٍ ثنا عَبَّادٌ عَنْ حُصَيْنٍ عَنِ الشَّعْبِيِّ عَنِ الْحَارِثِ عَنْ عَلِيٍّ ؓ فَذَكَرَهُ وَعَنْ عَبَّادٍ عَنْ حَجَّاجٍ عَنْ مَكْحُولٍ عَنْ زَيْدٍ ؓ مِثْلَهُ
51.33 [Machine] All teeth are the same
٥١۔٣٣ بَابٌ: الْأَسْنَانُ كُلُّهَا سَوَاءٌ
The Prophet ﷺ said: The teeth are equal, and the fingers are equal. (Using translation from Abū Dāʾūd 4560)
قَالَ رَسُولُ اللهِ ﷺ الْأَسْنَانُ وَالْأَصَابِعُ سَوَاءٌ
[Machine] The Prophet ﷺ said, "Fingers are equal, teeth are equal, the incisor and the molar teeth are equal, the middle finger and the thumb, and the molar and the incisor teeth are equal." Abu Qilabah narrated that the Prophet ﷺ said, "The middle finger and the thumb, the molar and the incisor teeth are equal." Abu Dawud said.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ الْأَصَابِعُ سَوَاءٌ وَالْأَسْنَانُ سَوَاءٌ الثَّنِيَّةُ وَالضِّرْسُ سَوَاءٌ هَذِهِ وَهَذِهِ سَوَاءٌ وَفِي رِوَايَةِ أَبِي قِلَابَةَ قَالَ عَنِ النَّبِيِّ ﷺ قَالَ هَذِهِ وَهَذِهِ سَوَاءٌ يَعْنِي الْخِنْصَرَ وَالْإِبْهَامَ وَالضِّرْسَ وَالثَّنِيَّةَ قَالَ أَبُو دَاوُدَ
[Machine] Al-Shafi'i and this is as Ibn Abbas said, "If Allah wills, and the temporary benefit or harm is based on the number, not on the utility."
الشَّافِعِيُّ وَهَذَا كَمَا قَالَهُ ابْنُ عَبَّاسٍ إِنْ شَاءَ اللهُ وَالدِّيَةُ الْمُوَقَّتَةُ عَلَى الْعَدَدِ لَا عَلَى الْمَنَافِعِ
[Machine] Al-Shafi'i, you have contradicted the hadith of Umar. You said that in the molar teeth, there are five teeth. And this is what we say about what came from the Prophet ﷺ regarding the molars, that there are five. The sheikh said, and Jabir al-Ju'fi narrated from 'Amir from Shurayh and Masruq from Umar, that the teeth are equal. And it is mentioned from Hasan from Umar, he said, "The teeth are equal, both the molar and the incisor."
الشَّافِعِيُّ فَقَدْ خَالَفْتُمْ حَدِيثَ عُمَرَ ؓ وَقُلْتُمْ فِي الْأَضْرَاسِ خَمْسٌ خَمْسٌ وَهَكَذَا نَقُولُ لِمَا جَاءَ عَنِ النَّبِيِّ ﷺ فِي السِّنِّ خَمْسٌ وَكَانَتِ الضِّرْسُ سِنًّا قَالَ الشَّيْخُ وَقَدْ رَوَى جَابِرٌ الْجُعْفِيُّ عَنْ عَامِرٍ عَنْ شُرَيْحٍ وَمَسْرُوقٍ عَنْ عُمَرَ ؓ الْأَسْنَانُ سَوَاءٌ وَيُذْكَرُ عَنِ الْحَسَنِ عَنْ عُمَرَ ؓ قَالَ الْأَسْنَانُ سَوَاءٌ الضِّرْسُ وَالثَّنِيَّةُ
51.34 [Machine] The tooth is hit, so it turns black and loses its benefit.
٥١۔٣٤ بَابُ السِّنِّ تُضْرَبُ فَتَسْوَدُّ وَتَذْهَبُ مَنْفَعَتُهَا
[Machine] I heard my father say about senility, when it turns black, then her entire mind falls into it completely. He said, and Bahrun narrated to us from Ibn Wahb, who informed me, Yahya bin Abdullah bin Salim said: It was mentioned to us that he was with the sword of Umar bin Al-Khattab, the order of intellects, and in senility, when her mind turns black completely, and when she is thrown after that, another time is in her mind. And this is the end.
سَمِعْتُ أَبِي يَقُولُ فِي السِّنِّ إِذَا أُصِيبَتْ فَاسْوَدَّتْ بَعْدَ ذَلِكَ فَسَقَطَتْ فِيهَا عَقْلُهَا كُلُّهُ كَامِلًا 16269 قَالَ وَحَدَّثَنَا بَحْرٌ ثنا ابْنُ وَهْبٍ أَخْبَرَنِي يَحْيَى بْنُ عَبْدِ اللهِ بْنِ سَالِمٍ قَالَ ذُكِرَ لَنَا أَنَّهُ كَانَ مَعَ سَيْفِ عُمَرَ بْنِ الْخَطَّابِ ؓ أَمْرُ الْعُقُولِ وَفِي السِّنِّ إِذَا اسْوَدَّتْ عَقْلُهَا كَامِلًا وَإِذَا طُرِحَتْ بَعْدَ ذَلِكَ فَفِي عَقْلِهَا مَرَّةٌ أُخْرَى وَهَذَا مُنْقَطِعٌ
[Machine] He said about the blind eye, the black tooth, and the paralyzed hand that its compensation is one-third of its value. And this is what he intended, and Allah knows best that he made a ruling in it that reached one-third of its value.
أَنَّهُ قَالَ فِي الْعَيْنِ الْقَائِمَةِ وَالسِّنِّ السَّوْدَاءِ وَالْيَدِ الشَّلَّاءِ ثُلُثُ دِيَتِهَا وَهَذَا إِنَّمَا أَرَادَ بِهِ وَاللهُ أَعْلَمُ أَنَّهُ أَوْجَبَ فِيهَا حُكُومَةً بَلَغَتْ ثُلُثَ دِيَتِهَا
[Machine] About Ali, when part of his tooth was broken, he would give its owner an amount equivalent to what was missing from it, and he would wait for it to turn black. If it turned black, it meant his mind had weakened, otherwise, nothing more would be added to that. And about Hajjaj, from Makhooul, from Zaid, the same thing happened.
عَنْ عَلِيٍّ ؓ فِي السِّنِّ إِذَا كُسِرَ بَعْضُهَا أُعْطِيَ صَاحِبُهَا بِحِسَابِ مَا نَقَصَ مِنْهَا وَيُتَرَبَّصُ بِهَا حَوْلًا فَإِنِ اسْوَدَّتْ تَمَّ عَقْلُهَا وَإِلَّا لَمْ يُزَدْ عَلَى ذَلِكَ وَعَنْ حَجَّاجٍ عَنْ مَكْحُولٍ عَنْ زَيْدٍ مِثْلَهُ
51.35 [Machine] The compensation for hands, feet, and fingers
٥١۔٣٥ بَابُ دِيَةِ الْيَدَيْنِ وَالرِّجْلَيْنِ وَالْأَصَابِعِ
[Machine] That in the book written by the Messenger of Allah, ﷺ , to 'Amr ibn Hazm, there were fifty in the hand and fifty in the foot, and in each finger there were ten camels.
أَنَّ فِي الْكِتَابِ الَّذِي كَتَبَهُ رَسُولُ اللهِ ﷺ لِعَمْرِو بْنِ حَزْمٍ وَفِي الْيَدِ خَمْسُونَ فِي الرِّجْلِ خَمْسُونَ وَفِي كُلِّ إِصْبَعٍ مِمَّا هُنَالِكَ عَشْرٌ مِنَ الْإِبِلِ
[Machine] The Prophet ﷺ ruled regarding the hand when half of the brain is severed, and regarding the leg when half of the brain is severed.
قَضَى النَّبِيُّ ﷺ فِي الْيَدِ إِذَا قُطِعَتْ نِصْفُ الْعَقْلِ وَفِي الرِّجْلِ نِصْفُ الْعَقْلِ
On his father's authority, said that his grandfather said: The Prophet ﷺ said in his address while he was leaning against the Ka'bah: (The blood-wit) for each finger is ten camels. (Using translation from Abū Dāʾūd 4562)
أَنَّ النَّبِيَّ ﷺ قَالَ فِي خُطْبَتِهِ وَهُوَ مُسْنِدٌ ظَهْرَهُ إِلَى الْكَعْبَةِ فِي الْأَصَابِعِ عَشْرٌ عَشْرٌ
51.36 [Machine] All fingers are equal
٥١۔٣٦ بَابٌ: الْأَصَابِعُ كُلُّهَا سَوَاءٌ
[Machine] The Messenger of Allah ﷺ said, "These two, meaning the middle finger and the thumb, are equal."
قَالَ رَسُولُ اللهِ ﷺ هَذِهِ وَهَذِهِ سَوَاءٌ يَعْنِي الْخِنْصَرَ وَالْإِبْهَامَ
[Machine] The Prophet ﷺ said about the fingers, "They are ten." Ali said, "We had this hadith as a connected and continuous chain of narration. But later, Muhammad ibn Bishr al-Abdi narrated it to us, mentioning the hadith."
عَنِ النَّبِيِّ ﷺ أَنَّهُ قَالَ فِي الْأَصَابِعِ عَشْرٌ عَشْرٌ قَالَ عَلِيٌّ كَانَ هَذَا الْحَدِيثُ عِنْدَنَا مُسْنَدًا مُتَّصِلَ الْإِسْنَادِ فَلَمَّا كَانَ بَعْدُ حَدَّثَنَا بِهِ مُحَمَّدُ بْنُ بِشْرٍ الْعَبْدِيُّ فَذَكَرَ الْحَدِيثَ الَّذِي
[Machine] From the Messenger of Allah ﷺ , it is narrated that he distributed ten camels equally among the fingers, and so on.
عَنْ رَسُولِ اللهِ ﷺ أَنَّهُ قَضَى فِي الْأَصَابِعِ بِعَشْرٍ عَشْرٍ مِنَ الْإِبِلِ وَكَذَلِكَ
[Machine] The Messenger of Allah ﷺ said, "The fingers are equal." I asked, "Even in the case of every finger having ten camels?" He replied, "Yes." And Ibrahim ibn Tahman narrated it from Hanzala ibn Abi Safiyya from Ghalib ibn Maimoun from Masruq ibn Aws from Abu Musa.
قَالَ رَسُولُ اللهِ ﷺ الْأَصَابِعُ سَوَاءٌ قُلْتُ فِي كُلِّ إِصْبَعٍ عَشْرٌ مِنَ الْإِبِلِ؟ قَالَ نَعَمْ وَرَوَاهُ إِبْرَاهِيمُ بْنُ طَهْمَانَ عَنْ حَنْظَلَةَ بْنِ أَبِي صَفِيَّةَ عَنْ غَالِبِ بْنِ مَيْمُونٍ عَنْ مَسْرُوقِ بْنِ أَوْسٍ عَنْ أَبِي مُوسَى ؓ
[Machine] Narrated by the Prophet ﷺ: "Regarding the marks on camels and fingers, all of them are equal, ten from each camel."
عَنِ النَّبِيِّ ﷺ أَنَّهُ قَالَ فِي الْمَوَاضِحِ خَمْسٌ خَمْسٌ مِنَ الْإِبِلِ وَالْأَصَابِعُ كُلُّهَا سَوَاءٌ عَشْرٌ عَشْرٌ مِنَ الْإِبِلِ
The Messenger of Allah ﷺ treated the fingers and toes as equal. (Using translation from Abū Dāʾūd 4561)
جَعَلَ رَسُولُ اللهِ ﷺ أَصَابِعَ الْيَدَيْنِ وَالرِّجْلَيْنِ سَوَاءً
[Machine] In the hand there is half, and in the leg there is half, and in the fingers there are ten, ten.
فِي الْيَدِ النِّصْفُ وَفِي الرِّجْلِ النِّصْفُ وَفِي الْأَصَابِعِ عَشْرٌ عَشْرٌ
The Prophet ﷺ said: The fingers are equal: ten camels for each finger. (Using translation from Abū Dāʾūd 4556)
فِي الْأَصَابِعِ عَشْرٌ عَشْرٌ مِنَ الْإِبِلِ
[Machine] "That the surgeon's compensation is completed in full from the blood money. The finger is like the finger of the five fingers, nothing is preferred over anything. He said: And Ibn Wahb informed us, and Makhrama narrated to me from his father, he said: I heard Sulaiman bin Yassar being asked: How many obligatory units are there in the finger of a man? He said: ten. Bukair said: That is what Yazid bin Abdullah said. And Yazid said: Uthman bin Affan judged by that."
أَنَّ الْجِرَاحَ تُودَى عَلَى حِسَابِهَا مِنَ الدِّيَةِ كَامِلَةً الْإِصْبَعُ كَالْإِصْبَعِ مِنَ الْخَمْسِ الْأَصَابِعِ لَا يُفَضَّلُ شَيْءٌ عَلَى شَيْءٍ 16284 قَالَ وَحَدَّثَنَا ابْنُ وَهْبٍ أَخْبَرَنِي مَخْرَمَةُ عَنْ أَبِيهِ قَالَ سَمِعْتُ سُلَيْمَانَ بْنَ يَسَارٍ وَسُئِلَ كَمْ فِي أُصْبُعِ الرِّجْلِ مِنَ الْعَقْلِ؟ فَقَالَ عَشْرُ فَرَائِضَ قَالَ بُكَيْرٌ وَقَالَ ذَلِكَ يَزِيدُ بْنُ عَبْدِ اللهِ وَقَالَ يَزِيدُ إِنَّ عُثْمَانَ بْنَ عَفَّانَ ؓ قَضَى بِذَلِكَ
[Machine] That Umar ibn al-Khattab spent fifteen in the thumb, ten in the one following it, ten in the middle finger, nine in the one following the pinky finger, and six in the pinky finger.
أَنَّ عُمَرَ بْنَ الْخَطَّابِ ؓ قَضَى فِي الْإِبْهَامِ بِخَمْسَ عَشْرَةَ وَفِي الَّتِي تَلِيهَا بِعَشْرٍ وَفِي الْوُسْطَى بِعَشْرٍ وَفِي الَّتِي تَلِي الْخِنْصَرَ بِتِسْعٍ وَفِي الْخِنْصَرِ بِسِتٍّ
[Machine] It is from the Messenger of Allah ﷺ that there are ten fingers on that hand. Sa'eed said, "So the fingers became ten."
أَنَّهُ مِنْ رَسُولِ اللهِ ﷺ وَفِيمَا هُنَالِكَ مِنَ الْأَصَابِعِ عَشْرٌ عَشْرٌ قَالَ سَعِيدٌ فَصَارَتِ الْأَصَابِعُ إِلَى عَشْرٍ عَشْرٍ
[Machine] The son of Abbas, may Allah have mercy on him, said: "The saying of the Messenger of Allah ﷺ is more deserving to be followed than the saying of Umar."
ابْنُ عَبَّاسٍ رَحِمَ اللهُ عُمَرَ قَوْلُ رَسُولِ اللهِ ﷺ أَحَقُّ أَنْ يُتَّبَعَ مِنْ قَوْلِ عُمَرَ ؓ
عَنْ عُمَرَ ؓ
[Machine] That Umar ibn Abdul Aziz wrote to the armies in every region, stating that for every piece of straw cut from a finger's width, a third of the finger's intellect is lost.
أَنَّ عُمَرَ بْنَ عَبْدِ الْعَزِيزِ كَتَبَ إِلَى الْأَجْنَادِ فِي كُلِّ قَصَبَةٍ قُطِعَتْ مِنْ قَصَبِ الْأَصَابِعِ ثُلُثُ عَقْلِ الْإِصْبَعِ
