٥١۔ كِتَابُ الدِّيَاتِ
[Machine] I read the book of the Messenger of Allah ﷺ that he wrote for Amr ibn Hazm when he sent him to Najran. The book was with Abu Bakr ibn Hazm, so the Messenger of Allah ﷺ wrote in it this statement from Allah and His Messenger: "O you who have believed, fulfill [all] contracts" [Al-Ma'idah 1]. He wrote the verses until he reached "Indeed, Allah is swift in account" [Al-Imran 199]. Then he wrote this book of medicine: a hundred camels in the vein, a hundred camels in the nostril when it becomes dry, fifty camels in the eye, fifty camels in the hand, fifty camels in the foot, ten camels in each finger, a third of the soul in the uterus, a third of the soul in the jaundice, fifteen in the shifting of nerves, five camels in the spot that digs, and five camels in the tooth. Ibn Shihab said, "This is what I read in the book that the Messenger of Allah ﷺ wrote at the house of Abu Bakr ibn Hazm, 16190." Abu Bakr, Abu Zakaria, and Abu Saeed informed us and they said, "Abu Abbas narrated to us, he heard from Bahir ibn Nasr, who heard from Ibn Wahb, who narrated to me that Malik ibn Anas informed him that Abdullah ibn Abu Bakr informed him about the book that the Messenger of Allah ﷺ wrote for Amr ibn Hazm, except that he did not mention the ears or the shifting of nerves."
قَرَأْتُ كِتَابَ رَسُولِ اللهِ ﷺ الَّذِي كَتَبَهُ لِعَمْرِو بْنِ حَزْمٍ حِينَ بَعَثَهُ عَلَى نَجْرَانَ وَكَانَ الْكِتَابُ عِنْدَ أَبِي بَكْرِ بْنِ حَزْمٍ فَكَتَبَ رَسُولُ اللهِ ﷺ فِيهِ هَذَا بَيَانٌ مِنَ اللهِ ﷻ وَرَسُولِهِ {يَا أَيُّهَا الَّذِينَ آمَنُوا أَوْفُوا بِالْعُقُودِ} [المائدة 1] فَكَتَبَ الْآيَاتِ حَتَّى بَلَغَ {إِنَّ اللهَ سَرِيعُ الْحِسَابِ} [آل عمران 199] ثُمَّ كَتَبَ هَذَا كِتَابُ الْجِرَاحِ فِي النَّفْسِ مِائَةٌ مِنَ الْإِبِلِ وَفِي الْأَنْفِ إِذَا أُوعِيَ جَدْعُهُ مِائَةٌ مِنَ الْإِبِلِ وَفِي الْعَيْنِ خَمْسُونَ مِنَ الْإِبِلِ وَفِي الْيَدِ خَمْسُونَ مِنَ الْإِبِلِ وَفِي الرِّجْلِ خَمْسُونَ مِنَ الْإِبِلِ وَفِي كُلِّ إِصْبَعٍ مِمَّا هُنَالِكَ عَشْرٌ مِنَ الْإِبِلِ وَفِي الْمَأْمُومَةِ ثُلُثُ النَّفْسِ وَفِي الْجَائِفَةِ ثُلُثُ النَّفْسِ وَفِي الْمُنَقِّلَةِ خَمْسَ عَشْرَةَ وَفِي الْمُوضِحَةِ خَمْسٌ مِنَ الْإِبِلِ وَفِي السِّنِّ خَمْسٌ مِنَ الْإِبِلِ قَالَ ابْنُ شِهَابٍ فَهَذَا الَّذِي قَرَأْتُ فِي الْكِتَابِ الَّذِي كَتَبَهُ رَسُولُ اللهِ ﷺ عِنْدَ أَبِي بَكْرِ بْنِ حَزْمٍ 16190 وَأَخْبَرَ نَا أَبُو بَكْرٍ وَأَبُو زَكَرِيَّا وَأَبُو سَعِيدٍ قَالُوا ثنا أَبُو الْعَبَّاسِ ثنا بَحْرُ بْنُ نَصْرٍ ثنا ابْنُ وَهْبٍ حَدَّثَنِي مَالِكُ بْنُ أَنَسٍ أَنَّ عَبْدَ اللهِ بْنَ أَبِي بَكْرٍ أَخْبَرَهُ أَنَّ أَبَاهُ أَخْبَرَهُ عَنِ الْكِتَابِ الَّذِي كَتَبَهُ رَسُولُ اللهِ ﷺ لِعَمْرِو بْنِ حَزْمٍ فِي الْعُقُولِ مِثْلَ حَدِيثِ ابْنِ شِهَابٍ إِلَّا أَنَّهُ لَمْ يَذْكُرِ الْأُذُنَيْنِ وَلَا الْمُنَقِّلَةَ
the Messenger of Allah wrote a letter to the people of Yemen, included in which were the rules of inheritance, the sunan and the (rules concerning) blood money. He sent it with 'Arm bin Hazm and it was read to the people of Yemen, Its contents were as follows: "From Muhammad the Prophet to Shurahbil bin 'Abd Kulal, Nu'aim bin 'Abd Kulal, Al-Harith bin' Abd Kulal, Qail dhil-Ru'ain, Mu'afir and Hamdan. To precede" - And in this letter it said that whoevewrkills a believer for no just reason is to be killed in return, unless the heirs of the victim agree to pardon him. For killing a person, the Diyah is one hundred camels. For the nose, if it is cut off completely, diyah must be paid, for the tongue, diyah must be paid; for the lips, Diyah must be paid; for the testicles, Diyah must be paid; for the ends, Diyah must be paid; for the backbone, Dynamist be paid; for the eyes, Diyah must be paid; for one leg, half the Diyah must be paid; for a blow to the head that reaches the brain, one-third of thediyah must be paid; for a stab wound that penetrates deeply into the body, one-third of the diyah must be paid; for a blow that breaks the bone, fifteen camels must be given; for every digit of the hands or feet, ten camels must be given; for a tooth five camels must be given; for an injury that exposes the bone, five camels must be given. A man may be killed in return for (killing) a woman and those who deal in gold must pay one thousand dinars. (Daif) (Using translation from Nasāʾī 4853)
عَنِ النَّبِيِّ ﷺ أَنَّهُ كَتَبَ إِلَى أَهْلِ الْيَمَنِ بِكَتَابٍ فِيهِ الْفَرَائِضُ وَالسُّنَنُ وَالدِّيَاتُ وَبَعَثَ بِهِ مَعَ عَمْرِو بْنِ حَزْمٍ فَقُرِئَتْ عَلَى أَهْلِ الْيَمَنِ وَهَذِهِ نُسْخَتُهَا فَذَكَرَ الْحَدِيثَ بِطُولِهِ وَفِيهِ وَإِنَّ فِي النَّفْسِ الدِّيَةَ مِائَةً مِنَ الْإِبِلِ وَفِي الْأَنْفِ إِذَا أُوعِبَ جَدْعُهُ الدِّيَةُ وَفِي اللِّسَانِ الدِّيَةُ وَفِي الشَّفَتَيْنِ الدِّيَةُ وَفِي الْبَيْضَتَيْنِ الدِّيَةُ وَفِي الذَّكَرِ الدِّيَةُ وَفِي الصُّلْبِ الدِّيَةُ وَفِي الْعَيْنَيْنِ الدِّيَةُ وَفِي الرِّجْلِ الْوَاحِدَةِ نِصْفُ الدِّيَةِ وَفِي الْمَأْمُومَةِ ثُلُثُ الدِّيَةِ وَفِي الْجَائِفَةِ ثُلُثُ الدِّيَةِ وَفِي الْمُنَقِّلَةِ خَمْسَ عَشْرَةَ مِنَ الْإِبِلِ وَفِي كُلِّ أُصْبُعٍ مِنَ الْأَصَابِعِ مِنَ الْيَدِ وَالرِّجْلِ عَشْرٌ مِنَ الْإِبِلِ وَفِي السِّنِّ خَمْسٌ مِنَ الْإِبِلِ وَفِي الْمُوضِحَةِ خَمْسٌ مِنَ الْإِبِلِ
