51. Chapter
٥١۔ كِتَابُ الدِّيَاتِ
“Whoever kills deliberately, he will be handed over to the heirs of the victim. If they want, they may kill him, or if they want, they may accept the blood money, which is thirty Hiqqah, thirty Jadha'ah and forty Khalifah. This is the blood money for deliberate slaying. Whatever is settled by reconciliation belongs to them, and that is a binding covenant.” (Using translation from Ibn Mājah 2626)
قَالَ النَّبِيُّ ﷺ مَنْ قَتَلَ عَمْدًا دُفِعَ إِلَى وَلِيِّ الْمَقْتُولِ فَإِنْ شَاءَ قَتَلَهُ وَإِنْ شَاءَ أَخَذَ الدِّيَةَ وَهِيَ ثَلَاثُونَ حِقَّةً وَثَلَاثُونَ جَذَعَةً وَأَرْبَعُونَ خَلِفَةً وَذَلِكَ عَقْلُ الْعَمْدِ وَمَا صُولِحُوا عَلَيْهِ فَهُوَ لَهُمْ وَذَلِكَ تَشْدِيدُ الْعَقْلِ
[Machine] His son from her until when his mother would make an oath (to not marry) and by Allah, she would not make the oath more than what you made her make, so he felt pain in his neck and was stabbed in his waist and died. So Surahqa bin Malik bin Ju'shum mentioned that to Umar bin Al-Khattab and he said to him, "Come to me from Qabil and bring with you forty or he said twenty and one hundred camels." He said, "So he did and Umar took thirty Hikas, thirty Jathas, and forty between Thaniya and Bazil in its entirety as a Khilafa (inheritance) and gave it to his brothers and did not bequeath anything to his father from it. And he said, "If I had not heard the Messenger of Allah ﷺ saying, 'A father should not be punished because of his child,' I would have killed you or harmed you."
لَهُ ابْنُهُ مِنْهَا حَتَّى مَتَى تَسْتَأْمِي أُمِّي وَاللهِ لَا تَسْتَأْمِيهَا أَكْثَرَ مِمَّا اسْتَأْمَيْتَهَا فَأَصَابَ عُرْقُوبَهُ فَطُعِنَ فِي خَاصِرَتِهِ فَمَاتَ قَالَ فَذَكَرَ ذَلِكَ سُرَاقَةُ بْنُ مَالِكِ بْنِ جُعْشُمٍ لِعُمَرَ بْنِ الْخَطَّابِ ؓ فَقَالَ لَهُ وَائْتِنِي مِنْ قَابِلٍ وَمَعَكَ أَرْبَعُونَ أَوْ قَالَ عِشْرُونَ وَمِائَةٌ مِنَ الْإِبِلِ قَالَ فَفَعَلَ فَأَخَذَ عُمَرُ ؓ مِنْهَا ثَلَاثِينَ حِقَّةً وَثَلَاثِينَ جَذَعَةً وَأَرْبَعِينَ مَا بَيْنَ ثَنِيَّةٍ إِلَى بَازِلِ عَامِهَا كُلُّهَا خَلِفَةٌ فَأَعْطَاهَا إِخْوَتَهُ وَلَمْ يُوَرِّثْ مِنْهَا أَبَاهُ شَيْئًا وَقَالَ لَوْلَا أَنِّي سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ لَا يُقَادُ وَالِدٌ بِوَلَدٍ لَقَتَلْتُكَ أَوْ لَضَرَبْتُ عُنُقَكَ
[Machine] He is Omar. I prepared for him twenty hundred camels to present to you. So when Omar arrived, he took thirty female camels, thirty male camels, and forty young camels from those camels. Then he said, "Where is the brother of the murdered person?" So he said, "Here I am." So he (Omar) said, "Take them as compensation, for I heard the Messenger of Allah ﷺ saying: The killer has no right."
لَهُ عُمَرُ ؓ أَعْدِدْ لِي عَلَى قُدَيْدٍ عِشْرِينَ وَمِائَةَ بَعِيرٍ حَتَّى أَقْدَمَ عَلَيْكَ فَلَمَّا قَدِمَ عَلَيْهِ عُمَرُ ؓ أَخَذَ مِنْ تِلْكَ الْإِبِلِ ثَلَاثِينَ حِقَّةً وَثَلَاثِينَ جَذَعَةً وَأَرْبَعِينَ خَلِفَةً ثُمَّ قَالَ أَيْنَ أَخُو الْمَقْتُولِ؟ فَقَالَ هَا أَنَذَا فَقَالَ خُذْهَا دِيَةً فَإِنِّي سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ لَيْسَ لِقَاتِلٍ شَيْءٌ
