51. Chapter
٥١۔ كِتَابُ الدِّيَاتِ
[Machine] In it is the ransom of the woman, and there is no ransom for her pregnancy if it causes her death. We do not know if there is a ruling regarding it. Malik said that, and Ibn Mundhir reported the expiation for the embryo from Ata', Al-Hasan, and Al-Nakhai.
فِيهَا دِيَةُ الْمَرْأَةِ وَلَيْسَ لِحَمْلِهَا مَعَهَا إِذَا هَلَكَ بِهَلَاكِهَا دِيَةٌ وَلَا نَعْلَمُ سَبَقَ فِيهَا قَضَاءٌ وَقَالَ ذَلِكَ مَالِكٌ وَحَكَى ابْنُ الْمُنْذِرِ الْكَفَّارَةَ فِي الْجَنِينِ عَنْ عَطَاءٍ وَالْحَسَنِ وَالنَّخَعِيِّ
[Machine] Regarding the scholars among the followers of the people of Medina, they used to say about a man who strikes a woman and causes her to miscarry: if the fetus falls out dead, then the "ghurra" (compensation) rests with him, but if it falls out alive then dies, then the "diyah" (full compensation) rests with him. And they used to say: whoever kills a pregnant woman, the intellect of what is in her womb does not count as the intellect of the deceased woman, and nor is there a fetus inside her womb.
عَنِ الْفُقَهَاءِ التَّابِعِينَ مِنْ أَهْلِ الْمَدِينَةِ كَانُوا يَقُولُونَ فِي الرَّجُلِ يَضْرِبُ الْمَرْأَةَ فَتَطْرَحُ جَنِينَهَا إِنْ سَقَطَ مَيِّتًا فَفِيهِ الْغُرَّةُ وَإِنْ سَقَطَ حَيًّا فَمَاتَ فَفِيهِ الدِّيَةِ كَامِلَةً وَكَانُوا يَقُولُونَ مَنْ قَتَلَ امْرَأَةً حَامِلًا فَلَا عَقْلَ لِمَا فِي بَطْنِهَا يَكُونُ عَقْلَ الْمَقْتُولَةِ وَلَا جَنِينَ فِي بَطْنِهَا
[Machine] If the fall occurs while the person is still alive, his blood money is to be paid whether the assailant had intended it or not. This is according to what I have been informed by Zaher, from Al-Baghawi, from Ahmad, from Al-Abbad bin Al-Awwam, from Hajjaj, and there is a disagreement on this matter.
إِذَا وَقَعَ السِّقْطُ حَيًّا كَمُلَتْ دِيَتُهُ اسْتَهَلَّ أَوْ لَمْ يَسْتَهِلَّ وَهُوَ فِيمَا أُخْبِرْتُ عَنْ زَاهِرٍ عَنِ الْبَغَوِيِّ عَنْ أَحْمَدَ عَنِ الْعَبَّادِ بْنِ الْعَوَّامِ عَنْ حَجَّاجٍ وَفِيهِ انْقِطَاعٌ
[Machine] Qays ibn 'Asim al-Tamimi came to the Prophet ﷺ and said, "In the pre-Islamic period, I have fulfilled the obligation of freeing eight slave girls. The Prophet replied, "Free one slave girl for each of them, and this witness can testify from another perspective."
جَاءَ قَيْسُ بْنُ عَاصِمٍ التَّمِيمِيُّ إِلَى النَّبِيِّ ﷺ فَقَالَ إِنِّي وَأَدْتُ فِي الْجَاهِلِيَّةِ ثَمَانَ بَنَاتٍ فَقَالَ أَعْتِقْ عَنْ كُلِّ وَاحِدَةٍ مِنْهُنَّ نَسَمَةً وَلِهَذَا شَاهِدٌ مِنْ وَجْهٍ آخَرَ
[Machine] He (the man) came to the Messenger of Allah, ﷺ , and said, "Indeed, I had fathered twelve or thirteen daughters for myself in the time of ignorance (pre-Islamic period)." So the Messenger of Allah, ﷺ , said, "Free them the same number as the breaths."
أَنَّهُ قَدِمَ عَلَى رَسُولِ اللهِ ﷺ فَقَالَ إِنِّي وَأَدْتُ اثْنَتَيْ عَشْرَةَ أَوْ ثَلَاثَ عَشْرَةَ بِنْتًا لِي فِي الْجَاهِلِيَّةِ فَقَالَ رَسُولُ اللهِ ﷺ أَعْتِقْ عَدَدَهُنَّ نَسَمًا
[Machine] That Omar shouted at a woman, causing her to fall, and Omar granted her freedom, but the chain of narration is incomplete.
أَنَّ عُمَرَ ؓ صَاحَ بِامْرَأَةٍ فَأَسْقَطَتْ فَأَعْتَقَ عُمَرُ ؓ غُرَّةً إِسْنَادُهُ مُنْقَطِعٌ
