٥١۔ كِتَابُ الدِّيَاتِ

51.34 [Machine] The tooth is hit, so it turns black and loses its benefit.

٥١۔٣٤ بَابُ السِّنِّ تُضْرَبُ فَتَسْوَدُّ وَتَذْهَبُ مَنْفَعَتُهَا

[Machine] I heard my father say about senility, when it turns black, then her entire mind falls into it completely. He said, and Bahrun narrated to us from Ibn Wahb, who informed me, Yahya bin Abdullah bin Salim said: It was mentioned to us that he was with the sword of Umar bin Al-Khattab, the order of intellects, and in senility, when her mind turns black completely, and when she is thrown after that, another time is in her mind. And this is the end.  

البيهقي:١٦٢٦٧أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو ثنا أَبُو الْعَبَّاسِ الْأَصَمُّ أنبأ بَحْرُ بْنُ نَصْرٍ ثنا عَبْدُ اللهِ بْنُ وَهْبٍ أَخْبَرَنِي يُونُسُ عَنِ ابْنِ شِهَابٍ عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ أَنَّهُ قَالَ إِنَّ السِّنَّ إِذَا اسْوَدَّتْ تَمَّ عَقْلُهَا قَالَ لِي مَالِكٌ وَالْأَمْرُ عِنْدَنَا عَلَى ذَلِكَ 16268 قَالَ وَحَدَّثَنَا عَبْدُ اللهِ بْنُ وَهْبٍ قَالَ وَأَخْبَرَنِي مَخْرَمَةُ بْنُ بُكَيْرٍ عَنْ أَبِيهِ قَالَ

سَمِعْتُ أَبِي يَقُولُ فِي السِّنِّ إِذَا أُصِيبَتْ فَاسْوَدَّتْ بَعْدَ ذَلِكَ فَسَقَطَتْ فِيهَا عَقْلُهَا كُلُّهُ كَامِلًا 16269 قَالَ وَحَدَّثَنَا بَحْرٌ ثنا ابْنُ وَهْبٍ أَخْبَرَنِي يَحْيَى بْنُ عَبْدِ اللهِ بْنِ سَالِمٍ قَالَ ذُكِرَ لَنَا أَنَّهُ كَانَ مَعَ سَيْفِ عُمَرَ بْنِ الْخَطَّابِ ؓ أَمْرُ الْعُقُولِ وَفِي السِّنِّ إِذَا اسْوَدَّتْ عَقْلُهَا كَامِلًا وَإِذَا طُرِحَتْ بَعْدَ ذَلِكَ فَفِي عَقْلِهَا مَرَّةٌ أُخْرَى وَهَذَا مُنْقَطِعٌ

[Machine] He said about the blind eye, the black tooth, and the paralyzed hand that its compensation is one-third of its value. And this is what he intended, and Allah knows best that he made a ruling in it that reached one-third of its value.  

البيهقي:١٦٢٧٠أَخْبَرَنَا أَبُو نَصْرِ بْنُ قَتَادَةَ أنبأ أَبُو الْفَضْلِ بْنُ خَمِيرَوَيْهِ ثنا أَحْمَدُ بْنُ نَجْدَةَ ثنا سَعِيدُ بْنُ مَنْصُورٍ ثنا أَبُو عَوَانَةَ عَنْ قَتَادَةَ عَنْ عَبْدِ اللهِ بْنِ بُرَيْدَةَ عَنْ يَحْيَى بْنِ يَعْمَرَ عَنِ ابْنِ عَبَّاسٍ عَنْ عُمَرَ بْنِ الْخَطَّابِ ؓ

أَنَّهُ قَالَ فِي الْعَيْنِ الْقَائِمَةِ وَالسِّنِّ السَّوْدَاءِ وَالْيَدِ الشَّلَّاءِ ثُلُثُ دِيَتِهَا وَهَذَا إِنَّمَا أَرَادَ بِهِ وَاللهُ أَعْلَمُ أَنَّهُ أَوْجَبَ فِيهَا حُكُومَةً بَلَغَتْ ثُلُثَ دِيَتِهَا

[Machine] About Ali, when part of his tooth was broken, he would give its owner an amount equivalent to what was missing from it, and he would wait for it to turn black. If it turned black, it meant his mind had weakened, otherwise, nothing more would be added to that. And about Hajjaj, from Makhooul, from Zaid, the same thing happened.  

البيهقي:١٦٢٧١أَخْبَرَنَا الْإِمَامُ أَبُو عُثْمَانَ أنبأ زَاهِرُ بْنُ أَحْمَدَ ثنا أَبُو الْقَاسِمِ الْبَغَوِيُّ ثنا أَحْمَدُ بْنُ حَنْبَلٍ ثنا عَبَّادٌ أنبأ حَجَّاجٌ عَنْ حُصَيْنِ بْنِ عَبْدِ الرَّحْمَنِ عَنِ الشَّعْبِيِّ عَنِ الْحَارِثِ

عَنْ عَلِيٍّ ؓ فِي السِّنِّ إِذَا كُسِرَ بَعْضُهَا أُعْطِيَ صَاحِبُهَا بِحِسَابِ مَا نَقَصَ مِنْهَا وَيُتَرَبَّصُ بِهَا حَوْلًا فَإِنِ اسْوَدَّتْ تَمَّ عَقْلُهَا وَإِلَّا لَمْ يُزَدْ عَلَى ذَلِكَ وَعَنْ حَجَّاجٍ عَنْ مَكْحُولٍ عَنْ زَيْدٍ مِثْلَهُ
