٥١۔ كِتَابُ الدِّيَاتِ
[Machine] The harsh penalty is thirty lashes, thirty severe beatings, and forty scars, resembling a tree trunk.
الدِّيَةُ الْمُغَلَّظَةُ ثَلَاثُونَ حِقَّةً وَثَلَاثُونَ جَذَعَةً وَأَرْبَعُونَ خَلِفَةً وَهِيَ شِبْهُ الْعَمْدِ
[Machine] In the Mohalzah, there were thirty rights, thirty roots, and forty branches that date back to Basel in the year 16123. Hushaym reported from Mu'gheera, who reported from Sha'bi, who reported from Mu'gheera bin Shu'ba and Abu Musa al-Ash'ari, both of whom said about the Mohalzah, just as Zaid bin Thabit said. It is also narrated from Uthman bin Affan and Zaid bin Thabit that there is no disagreement among them.
فِي الْمُغَلَّظَةِ ثَلَاثُونَ حِقَّةً وَثَلَاثُونَ جَذَعَةً وَأَرْبَعُونَ ثَنِيَّةً خَلِفَةً إِلَى بَازِلِ عَامِهَا
16123 قَالَ وَحَدَّثَنَا هُشَيْمٌ أنبأ مُغِيرَةُ عَنِ الشَّعْبِيِّ عَنِ الْمُغِيرَةِ بْنِ شُعْبَةَ وَأَبِي مُوسَى الْأَشْعَرِيِّ أَنَّهُمَا قَالَا فِي الْمُغَلَّظَةِ كَمَا قَالَ زَيْدُ بْنُ ثَابِتٍ وَرُوِيَ عَنْ عُثْمَانَ بْنِ عَفَّانَ وَزَيْدِ بْنِ ثَابِتٍ ؓ مَا يُخَالِفُ بَعْضَهُ
[Machine] Zaid ibn Thabit in the fierce battle mentioned someone similar to him.
زَيْدِ بْنِ ثَابِتٍ فِي الدِّيَةِ الْمُغَلَّظَةِ فَذَكَرَ مِثْلَهُ سَوَاءً
[Machine] Abu Al-Abbas Al-Asamm narrated that Ar-Rabi' said that Ash-Shafi'i, may Allah have mercy on him, said: "It has been narrated from Ali ibn Abi Talib, may Allah be pleased with him, that similar to what we mentioned regarding the branches of the camel's hump, there are thirty branches, thirty main parts, and forty-six joints. And from another narration, there are thirty-three branches, thirty-three main parts, and thirty-four joints."
ثنا أَبُو الْعَبَّاسِ الْأَصَمُّ أنبأ الرَّبِيعُ أنبأ الشَّافِعِيُّ رَحِمَهُ اللهُ قَالَ وَرُوِيَ عَنْ عَلِيِّ بْنِ أَبِي طَالِبٍ ؓ مِثْلُ مَا قُلْنَا فِي شِبْهِ الْعَمْدِ ثَلَاثُونَ حِقَّةً وَثَلَاثُونَ جَذَعَةً وَأَرْبَعُونَ خَلِفَةً وَمِنْ حَدِيثٍ آخَرَ ثَلَاثٌ وَثَلَاثُونَ حِقَّةً وَثَلَاثٌ وَثَلَاثُونَ جَذَعَةً وَأَرْبَعٌ وَثَلَاثُونَ خَلِفَةً
The bloodwit for unintentional murder which resembles intentional is twenty-five she camels which entered their fourth year, twenty five she-camels which had entered their fifth year, twenty five she-camels which had entered their third year, and twenty five camels which had entered their second year. أَنَّهُ قَالَ فِي شِبْهِ الْعَمْدِ أثَلَاثٌ ثَلَاثٌ وَثَلَاثُونَ حِقَّةً وَثَلَاثٌ وَثَلَاثُونَ جَذَعَةً وَأَرْبَعٌ وَثَلَاثُونَ ثَنِيَّةً إِلَى بَازِلِ عَامِهَا كُلُّهَا خَلِفَةٌ
The bloodwit for unintentional murder is in four parts: twenty five she-camels in their fourth year, twenty five she-camels in their fifth year, twenty five she-camels in their third year, and twenty twenty five she-camels in their second year. (Using translation from Abū Dāʾūd 4552)
عَبْدُ اللهِ هُوَ ابْنُ مَسْعُودٍ ؓ فِي شِبْهِ الْعَمْدِ خَمْسٌ وَعِشْرُونَ حِقَّةً وَخَمْسٌ وَعِشْرُونَ جَذَعَةً وَخَمْسٌ وَعِشْرُونَ بَنَاتُ لَبُونٍ وَخَمْسٌ وَعِشْرُونَ بَنَاتِ مَخَاضٍ
[Machine] Abdullah narrated that in the outskirts, there are four portions: a quarter for Laboon's daughters, a quarter for Hiqaq, a quarter for Jiza, and a quarter for Thaniyyah to Bazel. They have differed in this matter, and the statement of those who agree with the saying of the Prophet ﷺ mentioned in the chapter before him is more deserving of being followed. And with Allah is the facilitation.
عَنْ عَبْدِ اللهِ ؓ فِي شِبْهِ الْعَمْدِ أَرْبَاعٌ رُبُعٌ بَنَاتُ لَبُونٍ وَرُبُعٌ حِقَاقٌ وَرُبُعٌ جِذَاعٌ وَرُبُعٌ ثَنِيَّةٌ إِلَى بَازِلِ عَامِهَا قَدِ اخْتَلَفُوا هَذَا الِاخْتِلَافَ وَقَوْلُ مَنْ يُوَافِقُ قَوْلُهُ سُنَّةَ النَّبِيِّ ﷺ الْمَذْكُورَةَ فِي الْبَابِ قَبْلَهُ أَوْلَى بِالِاتِّبَاعِ وَبِاللهِ التَّوْفِيقُ
[Machine] The Prophet ﷺ said: "Whoever deliberately kills someone, it is the responsibility of the relatives of the victim to decide whether to kill the perpetrator or to accept blood money. The blood money is thirty camels, thirty cows, and forty young sheep. This is the compensation for intentional murder. Whatever agreement they come to is valid and binding. This is to ensure fairness. The Messenger of Allah ﷺ also said: "The intellect of the one who acts like a madman becomes firm, just like the intellect of a sane person. However, the one who acts like a madman should not be killed. This is because the devil may influence people and cause them to act foolishly, without anger or carrying a weapon."
أَنَّ النَّبِيَّ ﷺ قَالَ مَنْ قَتَلَ مُتَعَمِّدًا دُفِعَ إِلَى أَوْلِيَاءِ الْمَقْتُولِ فَإِنْ شَاءُوا قَتَلُوهُ وَإِنْ شَاءُوا أَخَذُوا الدِّيَةَ وَهِيَ ثَلَاثُونَ حِقَّةً وَثَلَاثُونَ جَذَعَةً وَأَرْبَعُونَ خَلِفَةً وَذَلِكَ عَقْلُ الْعَمْدِ وَمَا صُولِحُوا عَلَيْهِ فَهُوَ لَهُمْ وَذَلِكَ تَشْدِيدُ الْعَقْلِ وَأَنَّ رَسُولَ اللهِ ﷺ قَالَ عَقْلُ شِبْهِ الْعَمْدِ مُغَلَّظَةٌ مِثْلُ عَقْلِ الْعَمْدِ وَلَا يُقْتَلُ صَاحِبُهُ وَذَلِكَ أَنْ يَنْزُوَ الشَّيْطَانُ بَيْنَ النَّاسِ فَيَكُونَ رِمِّيَّا فِي عِمِّيَّا فِي غَيْرِ ضَغِينَةٍ وَلَا حَمْلِ سِلَاحٍ
