٥١۔ كِتَابُ الدِّيَاتِ
[Machine] That in the book that the Prophet ﷺ wrote to Amr ibn Hazm and in the clarification, there are five things.
أَنَّ فِي الْكِتَابِ الَّذِي كَتَبَهُ النَّبِيُّ ﷺ لِعَمْرِو بْنِ حَزْمٍ وَفِي الْمُوضِحَةِ خَمْسٌ
[Machine] The prophet ﷺ ruled in Al-Mudhia that the compensation for killing a camel is five camels. Abdullah bin Az-Zubair narrated from Ma'mar and added in Al-Mamumah, the compensation is one-third of the blood money. In Al-Ja'ifah, the compensation is one-third of the blood money. He said: "In the nose, if the tip is amputated, the compensation is one hundred camels. In the eye, the compensation is fifty camels." He mentioned the blood money for the hand, foot, and fingers, as we have narrated in the hadith of Malik and others.
أَنَّ النَّبِيَّ ﷺ قَضَى فِي الْمُوضِحَةِ بِخَمْسٍ مِنَ الْإِبِلِ وَرَوَاهُ عَبْدُ الرَّزَّاقِ عَنْ مَعْمَرٍ وَزَادَ فِيهِ وَفِي الْمَأْمُومَةِ ثُلُثُ الدِّيَةِ وَفِي الْجَائِفَةِ بِثُلُثِ الدِّيَةِ قَالَ وَفِي الْأَنْفِ إِذَا أُوعِيَ جَدْعُهُ مِائَةٌ مِنَ الْإِبِلِ وَفِي الْعَيْنِ خَمْسُونَ وَذَكَرَ دِيَةَ الْيَدِ وَالرِّجْلِ وَالْأَصَابِعِ كَمَا رَوَيْنَا فِي حَدِيثِ مَالِكٍ وَغَيْرِهِ
The Prophet ﷺ said: Blood-wit for every wound which lays bare a bone is five camels. (Using translation from Abū Dāʾūd 4566)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ فِي الْمَوَاضِحِ خَمْسٌ
[Machine] From the Prophet ﷺ, he said about clarifications: there are five aspects that are equal in weight to five she-camels, and each finger is equal in weight to ten she-camels.
عَنِ النَّبِيِّ ﷺ أَنَّهُ قَالَ فِي الْمَوَاضِحِ خَمْسٌ خَمْسٌ مِنَ الْإِبِلِ وَالْأَصَابِعُ كُلُّهَا سَوَاءٌ عَشْرٌ عَشْرٌ مِنَ الْإِبِلِ
أَنَّهُ قَالَ فِي الْمُوضِحَةِ خَمْسَةٌ
[Machine] He said in al-Mowdhihah, "There are five (opinions), and this has also been narrated from a different perspective by Zaid in a raised manner."
أَنَّهُ قَالَ فِي الْمُوضِحَةِ خَمْسٌ وَقَدْ رُوِيَ هَذَا مِنْ وَجْهٍ آخَرَ عَنْ زَيْدٍ مَرْفُوعًا
[Machine] Bakr and Umar said in Al-Mudh'iah, "On the head and face are equal (in terms of importance)." 16199. He (Abu Bakr) said, and Abu Bakr ibn Abi Shaybah narrated to us, and Abu Muawiya narrated to us from Hujaj from Mak'hool from Zaid ibn Thabit, "On the face, head, and nose are equal (in terms of importance)."
بَكْرٍ وَعُمَرَ ؓ قَالَا فِي الْمُوضِحَةِ فِي الرَّأْسِ وَالْوَجْهِ سَوَاءٌ 16199 قَالَ وَحَدَّثَنَا أَبُو بَكْرٍ هُوَ ابْنُ أَبِي شَيْبَةَ ثنا أَبُو مُعَاوِيَةَ عَنْ حَجَّاجٍ عَنْ مَكْحُولٍ عَنْ زَيْدِ بْنِ ثَابِتٍ الْمُوضِحَةُ فِي الْوَجْهِ وَالرَّأْسِ وَالْأَنْفِ سَوَاءٌ
[Machine] About Shurayh and Al-Hasan, they said: "The clarity in the face is like the clarity in the head."
عَنْ شُرَيْحٍ وَالْحَسَنِ قَالَا الْمُوضِحَةُ فِي الْوَجْهِ مِثْلُ الْمُوضِحَةِ فِي الرَّأْسِ
[Machine] "He used to say that the wergeld for the face is equal to the wergeld for the head, except if there is a defect in the face, in which case the wergeld for the face is increased by the same amount as the defect between it and half of the wergeld is twenty-five dinars. And we have narrated this from Umar ibn Abdul Aziz and the faqihs of the people of Madinah from the Tabi'in."
أَنَّهُ كَانَ يَقُولُ الْمُوضِحَةُ فِي الْوَجْهِ مِثْلُ الْمُوضِحَةِ فِي الرَّأْسِ إِلَّا أَنْ يَكُونَ فِي الْوَجْهِ عَيْبٌ فَيُزَادُ فِي مُوضِحَةِ الْوَجْهِ بِقَدْرِ عَيْبِ الْوَجْهِ مَا بَيْنَهُ وَبَيْنَ نِصْفِ عَقْلِ الْمُوضِحَةِ خَمْسَةٌ وَعِشْرُونَ دِينَارًا وَرُوِّينَا فِي ذَلِكَ عَنْ عُمَرَ بْنِ عَبْدِ الْعَزِيزِ وَفُقَهَاءِ أَهْلِ الْمَدِينَةِ مِنَ التَّابِعِينَ
[Machine] About the jurists from the people of Madinah, they used to give the same value to muddled (unclear) parts on the face and head, with each of them being worth fifty dinars.
عَنِ الْفُقَهَاءِ مِنْ أَهْلِ الْمَدِينَةِ كَانُوا يَجْعَلُونَ الْمُوضِحَةَ فِي الْوَجْهِ وَالرَّأْسِ سَوَاءً فِي كُلِّ وَاحِدٍ مِنْهُمَا خَمْسُونَ دِينَارًا
