٥١۔ كِتَابُ الدِّيَاتِ
[Machine] That Harith ibn Zaid was hostile towards the Prophet ﷺ , then he embraced Islam and Ayyash did not realize it. Ayyash ibn Abi Rabiah met him and attacked him, killing him. Allah revealed the verse: "And never should a believer kill another believer except by mistake." This was narrated from the hadith of Jabir ibn Abdullah, and it was connected. Ash-Shafi'i said, "Allah perfected the revelation of His book by stating that the killer of a believer must pay blood money to the family." The Prophet ﷺ also clarified the amount of the blood money.
أَنَّ الْحَارِثَ بْنَ زَيْدٍ كَانَ شَدِيدًا عَلَى النَّبِيِّ ﷺ فَجَاءَ إِلَى الْإِسْلَامِ وَعَيَّاشٌ لَا يَشْعُرُ فَلَقِيَهُ عَيَّاشُ بْنُ أَبِي رَبِيعَةَ فَحَمَلَ عَلَيْهِ فَقَتَلَهُ فَأَنْزَلَ اللهُ ﷻ {وَمَا كَانَ لِمُؤْمِنٍ أَنْ يَقْتُلَ مُؤْمِنًا إِلَّا خَطَأً} الْآيَةَ وَقَدْ رُوِّينَاهُ مِنْ حَدِيثِ جَابِرِ بْنِ عَبْدِ اللهِ مَوْصُولًا قَالَ الشَّافِعِيُّ فَأَحْكَمَ اللهُ فِي تَنْزِيلِ كِتَابِهِ أَنَّ عَلَى قَاتِلِ الْمُؤْمِنِ دِيَةً مُسَلَّمَةً إِلَى أَهْلِهِ وَأَبَانَ عَلَى لِسَانِ نَبِيِّهِ ﷺ كَمَّ الدِّيَةِ
[Machine] Narrated by a man from the companions of the Prophet ﷺ that the Prophet ﷺ gave a sermon on the day of the conquest of Mecca, and he said, "There is no god but Allah alone, He fulfilled His promise, granted victory to His servant, and defeated the factions alone. Know that every custom of the pre-Islamic era is null and void, and every act of bloodshed or claim is under my feet, except for the protection of the Kaaba and providing water for the pilgrims. And verily, the killer in deliberate error with a whip, stick, or stone is liable to pay a severe blood money, a hundred camels, of which forty are in their offspring."
عَنْ رَجُلٍ مِنْ أَصْحَابِ النَّبِيِّ ﷺ أَنَّ النَّبِيَّ ﷺ خَطَبَ يَوْمَ الْفَتْحِ فَقَالَ لَا إِلَهَ إِلَّا اللهُ وَحْدَهُ صَدَقَ وَعْدَهُ وَنَصَرَ عَبْدَهُ وَهَزَمَ الْأَحْزَابَ وَحْدَهُ أَلَا إِنَّ كُلَّ مَأْثُرَةٍ كَانَتْ فِي الْجَاهِلِيَّةِ تُعَدُّ وَتُدْعَى وَكُلَّ دَمٍ أَوْ دَعْوَى فَهُوَ مَوْضُوعٌ تَحْتَ قَدَمِيَّ هَاتَيْنِ إِلَّا سِدَانَةَ الْبَيْتِ وَسِقَايَةَ الْحَاجِّ أَلَا وَإِنَّ قَتِيلَ الْخَطَأِ الْعَمْدِ بِالسَّوْطِ أَوِ الْعَصَا أَوِ الْحَجَرِ دِيَةٌ مُغَلَّظَةٌ مِائَةٌ مِنَ الْإِبِلِ مِنْهَا أَرْبَعُونَ فِي بُطُونِهَا أَوْلَادُهَا
[Machine] About the Prophet ﷺ, in a narration similar to Khalid's statement except that he said, "A hundred camels, forty of which are pregnant with their young. Whoever adds a camel, he is one of the people of Paradise." It was narrated with this chain of transmission from Humaid Al-Tawil and also through Hammad ibn Zaid and Wahb from Khalid Al-Hudhaa'i, from Al-Qasim ibn Rabee'ah, from 'Uqbah bin 'Aws, from Abdullah bin 'Amr, from the Prophet ﷺ.
عَنِ النَّبِيِّ ﷺ بِنَحْوٍ مِنْ قَوْلِ خَالِدٍ إِلَّا أَنَّهُ قَالَ مِائَةٌ مِنَ الْإِبِلِ مِنْهَا أَرْبَعُونَ فِي بُطُونِهَا أَوْلَادُهَا فَمَنْ زَادَ بَعِيرًا فَهُوَ مِنْ أَهْلِ الْجَنَّةِ قَصَرَ بِإِسْنَادِهِ حُمَيْدٌ الطَّوِيلُ وَقَدْ رُوِّينَاهُ عَنْ حَمَّادِ بْنِ زَيْدٍ وَوُهَيْبٍ عَنْ خَالِدٍ الْحَذَّاءِ عَنِ الْقَاسِمِ بْنِ رَبِيعَةَ عَنْ عُقْبَةَ بْنِ أَوْسٍ عَنْ عَبْدِ اللهِ بْنِ عَمْرٍو عَنِ النَّبِيِّ ﷺ
[Machine] He informed him about the book that the Messenger of Allah ﷺ wrote to 'Amr ibn Hazm about the payment of one hundred camels.
أَخْبَرَهُ عَنِ الْكِتَابِ الَّذِي كَتَبَ رَسُولُ اللهِ ﷺ لِعَمْرِو بْنِ حَزْمٍ فِي النَّفْسِ مِائَةٌ مِنَ الْإِبِلِ
[Machine] About Abdullah ibn Abi Bakr in the transactions, in the book of the Prophet, ﷺ , for Amr ibn Hazm, and in the soul, there are one hundred camels. Ibn Juraij said, "I said to Abdullah ibn Abi Bakr, 'Are you doubtful that this is the book of the Prophet, ﷺ ?' He said, 'No, it has been transmitted with a continuous chain.'"
عَنْ عَبْدِ اللهِ بْنِ أَبِي بَكْرٍ فِي الدِّيَاتِ فِي كِتَابِ النَّبِيِّ ﷺ لِعَمْرِو بْنِ حَزْمٍ وَفِي النَّفْسِ مِائَةٌ مِنَ الْإِبِلِ قَالَ ابْنُ جُرَيْجٍ فقُلْتُ لِعَبْدِ اللهِ بْنِ أَبِي بَكْرٍ أَفِي شَكٍّ أَنْتُمْ مِنْ أَنَّهُ كِتَابُ النَّبِيِّ ﷺ؟ قَالَ لَا وَقَدْ رُوِيَ هَذَا مَوْصُولًا
[Machine] "He wrote to the people of Yemen in a letter that included the laws of inheritance, the traditions, and the compensation. He sent it with Amr ibn Hazm who mentioned the hadith and in it, it was mentioned that the compensation for a life is a hundred camels. We have narrated from Umar, Ali, Abdullah, and Zaid ibn Thabit that they said the compensation for a life is a hundred camels."
ﷺ أَنَّهُ كَتَبَ إِلَى أَهْلِ الْيَمَنِ بِكَتَابٍ فِيهِ الْفَرَائِضُ وَالسُّنَنُ وَالدِّيَاتُ وَبَعَثَ بِهِ مَعَ عَمْرِو بْنِ حَزْمٍ فَذَكَرَ الْحَدِيثَ وَفِيهِ وَإِنَّ فِي النَّفْسِ الدِّيَةَ مِائَةً مِنَ الْإِبِلِ وَرُوِّينَا عَنْ عُمَرَ وَعَلِيٍّ وَعَبْدِ اللهِ وَزَيْدِ بْنِ ثَابِتٍ ؓ أَنَّهُمْ قَالُوا فِي الدِّيَةِ مِائَةٌ مِنَ الْإِبِلِ
