51. Chapter
٥١۔ كِتَابُ الدِّيَاتِ
[Machine] That the Messenger of Allah ﷺ did not pay attention to that which is unclear and considered that which is unclear as forgiveness between the Muslims.
أَنَّ رَسُولَ اللهِ ﷺ لَمْ يَعْقِلْ مَا دُونَ الْمُوضِحَةِ وَجَعَلَ مَا دُونَ الْمُوضِحَةِ عَفْوًا بَيْنَ الْمُسْلِمِينَ
[Machine] It is not within the realm of certainty that there is intelligence lower than clarification until clarification is reached. Rather, intelligence resides in clarification and what is beyond it. That is because the Messenger of Allah ﷺ reached clarification in his book to 'Amr ibn Hazm and included in it five of the camels.
أَنَّهُ لَيْسَ فِيمَا دُونَ الْمُوضِحَةِ مِنَ الشِّجَاجِ عَقْلٌ حَتَّى تَبْلُغَ الْمُوضِحَةَ وَإِنَّمَا الْعَقْلُ فِي الْمُوضِحَةِ فَمَا فَوْقَهَا وَذَلِكَ أَنَّ رَسُولَ اللهِ ﷺ انْتَهَى إِلَى الْمُوضِحَةِ فِي كِتَابِهِ لِعَمْرِو بْنِ حَزْمٍ فَجَعَلَ فِيهَا خَمْسًا مِنَ الْإِبِلِ
[Machine] Muadh bin Jabal is elevated, and in the place called Al-Mudhihah, there are five camels. Everything beyond that is according to its measure.
مُعَاذِ بْنِ جَبَلٍ ؓ مَرْفُوعًا وَفِي الْمُوضِحَةِ خَمْسٌ مِنَ الْإِبِلِ وَكُلُّ شَيْءٍ كَانَ دُونَ ذَلِكَ فَعَلَى قَدْرِهِ
[Machine] They settled in the miltat with half of the specified blood money 16212, and Abu Abdullah, Abu Bakr, and Abu Zakaria informed us that Abu Abbas reported that Rabee informed him that Shafi'i informed him that Muslim narrated from Ibn Jurayj from Thawri from Malik from Yazid bin Abdullah bin Qusayt from Ibn Maseeb from Umar and Uthman, a similar statement or similar in meaning. Shafi'i said and someone who heard Ibn Nafi' mention from Malik through this chain like him, Shafi'i said and we recited to Malik that we did not know anyone among the Imams from the past or from the Hadith who ruled on something less than the clear evidence.
ؓ قَضَيَا فِي الْمِلْطَاةِ بِنِصْفِ دِيَةِ الْمُوضِحَةِ 16212 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ وَأَبُو بَكْرٍ وَأَبُو زَكَرِيَّا قَالُوا ثنا أَبُو الْعَبَّاسِ أنبأ الرَّبِيعُ أنبأ الشَّافِعِيُّ أنبأ مُسْلِمٌ عَنِ ابْنِ جُرَيْجٍ عَنِ الثَّوْرِيِّ عَنْ مَالِكٍ عَنْ يَزِيدَ بْنِ عَبْدِ اللهِ بْنِ قُسَيْطٍ عَنِ ابْنِ الْمُسَيِّبِ عَنْ عُمَرَ وَعُثْمَانَ ؓ مِثْلَهُ أَوْ مِثْلَ مَعْنَاهُ قَالَ الشَّافِعِيُّ وَأَخْبَرَنِي مَنْ سَمِعَ ابْنَ نَافِعٍ يَذْكُرُ عَنْ مَالِكٍ بِهَذَا الْإِسْنَادِ مِثْلَهُ قَالَ الشَّافِعِيُّ وَقَرَأْنَا عَلَى مَالِكٍ إِنَّا لَمْ نَعْلَمْ أَحَدًا مِنَ الْأَئِمَّةِ فِي الْقَدِيمِ وَلَا الْحَدِيثِ قَضَى فِيمَا دُونَ الْمُوَضِّحَةِ بِشَيْءٍ
[Machine] They decided concerning the milta (a part of the sheep's stomach) and it is the wet tripe, with half of what is in the muwadhdha (another part of the stomach). Abdur-Razzaq said, then Sufyan came to us and we asked him about it, so he narrated to us about it from Malik. Then I met Malik and said, "Indeed, Sufyan narrated to me from you from Ibn Qusayt from Ibn al-Musayyib that Umar and Uthman decided concerning the milta with half of the muwadhdha." He said, "True, you have informed me." I said to him, "Inform me about it." He said, "I do not inform about it today." So Muslim ibn Khalid said to him, while he was next to him, "I have determined on you, O Abu Abdullah, that you do not narrate it to him." He said, "You have determined on me, if I were narrating it today, I would narrate it to him." I said, "Why do you not narrate it to me, while you have narrated it to others?" He said, "Indeed, the work with us is different, and the narrator is not here, meaning Ibn Qusayt, so this is the excuse of Malik bin Anas, may Allah have mercy on him and us, from inclining towards this narration." Al-Shafi'i said, may Allah have mercy on him, in what he stated in his statement, we were narrated that Zaid bin Thabit had decided in what is less than the muwadhdha, even in the dhamiya.
ؓ قَضَيَا فِي الْمِلْطَاةِ وَهِيَ السِّمْحَاقُ بِنِصْفِ مَا فِي الْمُوضِحَةِ قَالَ عَبْدُ الرَّزَّاقِ ثُمَّ قَدِمَ عَلَيْنَا سُفْيَانُ فَسَأَلْنَاهُ عَنْهُ فَحَدَّثَنَا بِهِ عَنْ مَالِكٍ ثُمَّ لَقِيتُ مَالِكًا فَقُلْتُ إِنَّ سُفْيَانَ ثنا عَنْكَ عَنِ ابْنِ قُسَيْطٍ عَنِ ابْنِ الْمُسَيِّبِ أَنَّ عُمَرَ وَعُثْمَانَ ؓ قَضَيَا فِي الْمِلْطَاةِ بِنِصْفِ الْمُوضِحَةِ؟ قَالَ صَدَقَ قَدْ حَدَّثْتُهُ قُلْتُ حَدِّثْنِي بِهِ قَالَ مَا أُحَدِّثُ بِهِ الْيَوْمَ فَقَالَ لَهُ مُسْلِمُ بْنُ خَالِدٍ وَهُوَ إِلَى جَنْبِهِ عَزَمْتُ عَلَيْكَ يَا أَبَا عَبْدِ اللهِ إِلَّا حَدَّثْتَهُ بِهِ قَالَ تَعْزِمُ عَلَيَّ لَوْ كُنْتُ مُحَدِّثًا بِهِ الْيَوْمَ لَحَدَّثْتُهُ بِهِ قُلْتُ لِمَ لَا تُحَدِّثُنِي بِهِ وَقَدْ حَدَّثْتَ بِهِ غَيْرِي؟ قَالَ إِنَّ الْعَمَلَ عِنْدَنَا عَلَى غَيْرِهِ وَرَجُلُهُ عِنْدَنَا لَيْسَ هُنَاكَ يَعْنِي ابْنَ قُسَيْطٍ فَهَذَا عُذْرُ مَالِكِ بْنِ أَنَسٍ رَحِمَنَا اللهُ وَإِيَّاهُ فِي الرَّغْبَةِ عَنْ هَذِهِ الرِّوَايَةِ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ فِيمَا سَاقَ كَلَامَهُ إِلَيْهِ رُوِّينَا أَنَّ زَيْدَ بْنَ ثَابِتٍ قَدْ قَضَى فِيمَا دُونَ الْمُوضِحَةِ حَتَّى فِي الدَّامِيَةِ
[Machine] He said, "In damiya there is one camel, in badie'a there are two camels, in mutalameha there are three camels, in samhaq there are four camels, and in mowdha there are five camels." Sheikh Muhammad bin Rashid said, "Although we narrated his hadith through the narration of the elders, he is not one of those whose testimony stands alone. We narrated from Hakam bin 'Utaybah from 'Ali that he said in samhaq there are four camels, and from Jabir al-Ju'fi from Abdullah bin Najayy from 'Ali, similar to that. The first chain is disconnected and the second chain is disconnected. Then if the narration is correct, it implies that they ruled on what is less than mowdha with a ruling that reached this extent. And Allah knows best."
أَنَّهُ قَالَ فِي الدَّامِيَةِ بَعِيرٌ وَفِي الْبَاضِعَةِ بَعِيرَانِ وَفِي الْمُتَلَاحِمَةِ ثَلَاثٌ وَفِي السِّمْحَاقِ أَرْبَعٌ وَفِي الْمُوضِحَةِ خَمْسٌ قَالَ الشَّيْخُ مُحَمَّدُ بْنُ رَاشِدٍ وَإِنْ كُنَّا نَرْوِي حَدِيثَهُ لِرِوَايَةِ الْكِبَارِ عَنْهُ فَلَيْسَ مِمَّنْ تَقُومُ الْحُجَّةُ بِمَا يَنْفَرِدُ بِهِ وَرُوِّينَا عَنِ الْحَكَمِ بْنِ عُتَيْبَةَ عَنْ عَلِيٍّ ؓ أَنَّهُ قَالَ فِي السِّمْحَاقِ أَرْبَعٌ مِنَ الْإِبِلِ وَعَنْ جَابِرٍ الْجُعْفِيِّ عَنْ عَبْدِ اللهِ بْنِ نُجَيٍّ عَنْ عَلِيٍّ ؓ مِثْلَهُ وَالْأَوَّلُ مُنْقَطِعٌ وَالثَّانِي مُنْقَطِعٌ ثُمَّ إِنْ صَحَّتْ هَذِهِ الرِّوَايَةُ فَهِيَ مَحْمُولَةٌ عَلَى أَنَّهُمْ حَكَمُوا فِيمَا دُونَ الْمُوَضِحَةِ بِحُكُومَةٍ بَلَغَتْ هَذَا الْمِقْدَارَ وَاللهُ أَعْلَمُ
