51. Chapter
٥١۔ كِتَابُ الدِّيَاتِ
[Machine] He wrote to me, Yahya bin Sa'id, a copy of the book that Abu Bakr bin Muhammad bin Amr bin Hazm had, which was written by the Messenger of Allah ﷺ to Amr bin Hazm. In it, it states that in the nose, when it is bleeding, the full blood money is owed. In the eye, half of the blood money is owed. In the injured finger, a third of the blood money is owed. In a fractured bone, a third of the blood money is owed. In the clear wound, five camels are owed. In a tooth, five camels are owed. And in each fingertip here, there are ten ten camels. And we have narrated it from other sources as well, both as a Mursal and Mawsul Hadith.
كَتَبَ إِلِيَّ يَحْيَى بْنُ سَعِيدٍ نُسْخَةَ الْكِتَابِ الَّذِي عِنْدَ أَبِي بَكْرِ بْنِ مُحَمَّدِ بْنِ عَمْرِو بْنِ حَزْمٍ الَّذِي كَتَبَهُ رَسُولُ اللهِ ﷺ لِعَمْرِو بْنِ حَزْمٍ فَإِذَا فِيهِ فِي الْأَنْفِ إِذَا أُوعِبَ جَدْعُهُ الدِّيَةُ كَامِلَةً وَفِي الْعَيْنِ نِصْفُ الدِّيَةِ وَفِي الْمَأْمُومَةِ ثُلُثُ الدِّيَةِ وَفِي الْجَائِفَةِ ثُلُثُ الدِّيَةِ وَفِي الْمُوضِحَةِ خَمْسٌ مِنَ الْإِبِلِ وَفِي السِّنِّ خَمْسٌ مِنَ الْإِبِلِ وَفِي كُلِّ إِصْبَعٍ هُنَا لِكَ عَشَرَةٌ عَشَرَةٌ وَقَدْ رُوِّينَاهُ مِنْ أَوْجُهٍ أُخَرَ مُرْسَلًا وَمَوْصُولًا
[Machine] He said about the leaders, "one third" and about the slaves, "one third".
أَنَّهُ قَالَ فِي الْجَائِفَةِ الثُّلُثُ وَفِي الْآمَّةِ الثُّلُثُ
[Machine] That a man threw a man and he was injured, then the wound appeared on the other side, and Abu Bakr ruled in it with two-thirds of the blood money.
أَنَّ رَجُلًا رَمَى رَجُلًا فَأَصَابَتْهُ جَائِفَةٌ فَخَرَجَتْ مِنَ الْجَانِبِ الْآخَرِ فَقَضَى فِيهَا أَبُو بَكْرٍ ؓ بِثُلُثَيِ الدِّيَةِ
[Machine] That Abu Bakr (may Allah be pleased with him) settled in Jāʼifah and was able to pay two-thirds of the blood money.
أَنَّ أَبَا بَكْرٍ ؓ قَضَى فِي الْجَائِفَةِ نَفَذَتْ بِثُلُثَيِ الدِّيَةِ
