٥١۔ كِتَابُ الدِّيَاتِ
[Machine] The Messenger of Allah ﷺ ruled in the case of a miscarriage, whether it was a male or female slave, a horse, or a mule. Abu Dawood narrated that this hadith was narrated by Muhammad bin Umar, Hammam bin Salamah, and Khalid bin Abdullah, who did not mention a horse or mule. The learned Sheikh, may Allah have mercy on him, did not mention it either, as did Az-Zuhri, who narrated from Abu Salamah and Sa'id bin Al-Musayyib.
قَضَى رَسُولُ اللهِ ﷺ فِي الْجَنِينِ بِغُرَّةٍ عَبْدٍ أَوْ أَمَةٍ أَوْ فَرَسٍ أَوْ بَغْلٍ قَالَ أَبُو دَاوُدَ رُوِيَ هَذَا الْحَدِيثُ عَنْ مُحَمَّدِ بْنِ عُمَرَ وَحَمَّادُ بْنُ سَلَمَةَ وَخَالِدُ بْنُ عَبْدِ اللهِ لَمْ يَذْكُرَا فَرَسًا وَلَا بَغْلًا قَالَ الشَّيْخُ الْفَقِيهُ رَحِمَهُ اللهُ وَلَمْ يَذْكُرْهُ أَيْضًا الزُّهْرِيُّ عَنْ أَبِي سَلَمَةَ وَسَعِيدِ بْنِ الْمُسَيِّبِ
[Machine] The Messenger of Allah ﷺ ruled for blood money in regards to women and fetuses, whether it is a free man, a slave, or a horse, in this manner.
فَقَضَى رَسُولُ اللهِ ﷺ بِالدِّيَةِ فِي الْمَرْأَةِ وَفِي الْجَنِينِ بِغُرَّةٍ عَبْدٍ أَوْ أَمَةٍ أَوْ فَرَسٍ كَذَا
[Machine] The Messenger of Allah ﷺ decided about the fetus and Tawus al-Faris said, "It is a fetus."
فَقَضَى رَسُولُ اللهِ ﷺ فِي الْجَنِينِ غُرَّةً وَقَالَ طَاوُسٌ الْفَرَسُ غُرَّةٌ
[Machine] That a woman threw rocks at another woman and caused her to fall. This matter was brought to the attention of the Messenger of Allah ﷺ, who ordered the woman to give the mother of the fallen woman 500 sheep as compensation. On that day, the Messenger of Allah ﷺ also prohibited throwing rocks. Abu Dawood said: "This hadith mentions 500 sheep, but the correct version is 100 sheep." The scholar Sheikh al-Faqih, may Allah have mercy on him, said that it was narrated from Ibn Sirin, Abu Qilabah, and Abu al-Malih that the Prophet ﷺ spoke about this incident. They said that he ruled that in the case of a miscarriage, a slave or a slave woman or 100 sheep should be given as compensation. This version is disseminated, and it was also narrated from Abu al-Malih through his father from the Prophet ﷺ, with the exception that in this version, it is mentioned that the compensation should be a slave or a slave woman or twenty or one hundred sheep. The chain of transmission of this narration is weak, and Allah knows best.
أَنَّ امْرَأَةً خَذَفَتِ امْرَأَةً فَأَسْقَطَتْ فَرُفِعَ ذَلِكَ إِلَى رَسُولِ اللهِ ﷺ فَجَعَلَ فِي وَلَدِهَا خَمْسَمِائَةِ شَاةٍ وَنَهَى يَوْمَئِذٍ عَنِ الْخَذْفِ قَالَ أَبُو دَاوُدَ كَذَا الْحَدِيثُ خَمْسُمِائَةٍ وَالصَّوَابُ مِائَةُ شَاةٍ قَالَ الشَّيْخُ الْفَقِيهُ رَحِمَهُ اللهُ وَرُوِيَ عَنِ ابْنِ سِيرِينَ وَأَبِي قِلَابَةَ وَأَبِي الْمَلِيحِ عَنِ النَّبِيِّ ﷺ فِي هَذِهِ الْقِصَّةِ قَالُوا وَقَضَى فِي الْجَنِينِ غُرَّةٌ عَبْدٌ أَوْ أَمَةٌ أَوْ مِائَةٌ مِنَ الشَّاءِ وَهَذَا مُرْسَلٌ وَرَوَى ذَلِكَ عَنْ أَبِي الْمَلِيحِ عَنْ أَبِيهِ عَنِ النَّبِيِّ ﷺ إِلَّا أَنَّهُ قَالَ فِيهِ غُرَّةٌ عَبْدٌ أَوْ أَمَةٌ أَوْ عِشْرُونَ وَمِائَةُ شَاةٍ وَإِسْنَادُهُ ضَعِيفٌ وَاللهُ أَعْلَمُ
