[Machine] Regarding the scholars among the followers of the people of Medina, they used to say about a man who strikes a woman and causes her to miscarry: if the fetus falls out dead, then the "ghurra" (compensation) rests with him, but if it falls out alive then dies, then the "diyah" (full compensation) rests with him. And they used to say: whoever kills a pregnant woman, the intellect of what is in her womb does not count as the intellect of the deceased woman, and nor is there a fetus inside her womb.

عَنِ الْفُقَهَاءِ التَّابِعِينَ مِنْ أَهْلِ الْمَدِينَةِ كَانُوا يَقُولُونَ فِي الرَّجُلِ يَضْرِبُ الْمَرْأَةَ فَتَطْرَحُ جَنِينَهَا إِنْ سَقَطَ مَيِّتًا فَفِيهِ الْغُرَّةُ وَإِنْ سَقَطَ حَيًّا فَمَاتَ فَفِيهِ الدِّيَةِ كَامِلَةً وَكَانُوا يَقُولُونَ مَنْ قَتَلَ امْرَأَةً حَامِلًا فَلَا عَقْلَ لِمَا فِي بَطْنِهَا يَكُونُ عَقْلَ الْمَقْتُولَةِ وَلَا جَنِينَ فِي بَطْنِهَا
