[Machine] Al-Shafi'i and this is as Ibn Abbas said, "If Allah wills, and the temporary benefit or harm is based on the number, not on the utility."

البيهقي:١٦٢٦٥ – أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ أنبأ الرَّبِيعُ بْنُ سُلَيْمَانَ أَخْبَرَنَا الشَّافِعِيُّ أنبأ مَالِكٌ عَنْ دَاوُدَ بْنِ الْحُصَيْنِ عَنْ أَبِي غَطَفَانَ بْنِ طَرِيفٍ الْمُرِّيِّ أَنَّ مَرْوَانَ بْنَ الْحَكَمِ بَعَثَهُ إِلَى عَبْدِ اللهِ بْنِ عَبَّاسٍ لِيَسْأَلَهُ مَاذَا فِي الضِّرْسِ؟ فَقَالَ ابْنُ عَبَّاسٍ فِيهِ خَمْسٌ مِنَ الْإِبِلِ قَالَ فَرَدَّنِي إِلَيْهِ مَرْوَانُ قَالَ أَتَجْعَلُ مُقَدَّمَ الْفَمِ مِثْلَ الْأَضْرَاسِ؟ فَقَالَ ابْنُ عَبَّاسٍ لَوْ لَمْ يُعْتَبَرْ ذَلِكَ إِلَّا بِالْأَصَابِعِ عَقْلُهَا سَوَاءٌ قَالَ

الشَّافِعِيُّ وَهَذَا كَمَا قَالَهُ ابْنُ عَبَّاسٍ إِنْ شَاءَ اللهُ وَالدِّيَةُ الْمُوَقَّتَةُ عَلَى الْعَدَدِ لَا عَلَى الْمَنَافِعِ
