9.27 [Machine] Ayyad bin Hamaar

٩۔٢٧ حديث عياض بن حمار

ahmad:18336Ismāʿīl > Khālid > Abū al-ʿAlāʾ b. al-Shikhhīr > Akhīh Muṭarrif > ʿIyāḍ b. Ḥimār

“Whoever finds lost property, let him ask one or two men of good character to witness it, then he should not alter it nor conceal it. If its owner comes along, then he has more right to it, otherwise it belongs to Allah (SWT), Who gives it to whomsoever He wills.” (Using translation from Ibn Mājah 2505)   

أحمد:١٨٣٣٦حَدَّثَنَا إِسْمَاعِيلُ حَدَّثَنَا خَالِدٌ عَنْ أَبِي الْعَلَاءِ بْنِ الشِّخِّيرِ عَنْ أَخِيهِ مُطَرِّفٍ عَنْ عِيَاضِ بْنِ حِمَارٍ قَالَ

سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَنِ الْتَقَطَ لُقَطَةً فَلْيُشْهِدْ ذَا عَدْلٍ أَوْ ذَوَيْ عَدْلٍ ثُمَّ لَا يَكْتُمْ وَلَا يُغَيِّبْ فَإِنْ جَاءَ رَبُّهَا فَهُوَ أَحَقُّ بِهَا وَإِلَّا فَإِنَّمَا هُوَ مَالُ اللهِ يُؤْتِيهِ مَنْ يَشَاءُ

When two persons indulge in hurling (abuses) upon one another, it would be the first one who would be the sinner so long as the oppressed does not transgress the limits. (Using translation from Muslim 2587)   

أحمد:١٨٣٣٧حَدَّثَنَا عَبْدُ الصَّمَدِ قَالَ حَدَّثَنَا هَمَّامٌ حَدَّثَنَا قَتَادَةُ عَنْ يَزِيدَ بْنِ عَبْدِ اللهِ عَنْ عِيَاضِ بْنِ حِمَارٍ

أَنَّ رَسُولَ اللهِ ﷺ قَالَ الْمُسْتَبَّانِ مَاقَالَا عَلَى الْبَادِئِ مَا لَمْ يَعْتَدِ الْمَظْلُومُ وَالْمُسْتَبَّانِ شَيْطَانَانِ يَتَكَاذَبَانِ وَيَتَهَاتَرَانِ

[Machine] The Prophet Muhammad ﷺ said: "Verily, Allah has commanded me to teach you what you did not know from what He taught me on this day. And He said: 'Indeed, every property that I have made available for My servants is lawful for them.' So he mentioned a hadith similar to the narration of Hisham from Qatadah, and he said: 'The people of Hellfire are five: the weak one who has no protection, those who follow you and do not seek any relatives or wealth.'"  

أحمد:١٨٣٣٨حَدَّثَنَا عَبْدُ الرَّزَّاقِ حَدَّثَنَا مَعْمَرٌ عَنْ قَتَادَةَ عَنْ مُطَرِّفِ بْنِ عَبْدِ اللهِ بْنِ الشِّخِّيرِ عَنْ عِيَاضِ بْنِ حِمَارٍ الْمُجَاشِعِيِّ رَفَعَ الْحَدِيثَ قَالَ

قَالَ النَّبِيُّ ﷺ إِنَّ اللهَ ﷻ أَمَرَنِي أَنْ أُعَلِّمَكُمْ مَا جَهِلْتُمْ مِمَّا عَلَّمَنِي يَوْمِي هَذَا وَإِنَّهُ قَالَ إِنَّ كُلَّ مَالٍ نَحَلْتُهُ عِبَادِي فَهُوَ لَهُمْ حَلَالٌ فَذَكَرَ نَحْوَ حَدِيثِ هِشَامٍ عَنْ قَتَادَةَوَقَالَ وَأَهْلُ النَّارِ خَمْسَةٌ الضَّعِيفُ الَّذِي لَا زَبْرَ لَهُ الَّذِينَ هُمْ فِيكُمْ تَبَعٌ لَا يَبْتَغُونَ أَهْلًا وَلَا مَالًا

[Machine] The Messenger of Allah ﷺ said in a sermon he delivered, "Verily, Allah has commanded me to teach you what you are ignorant of from what He has taught me today." He said, "And verily, every property obtained by my servants is permissible for them." Then he mentioned the hadith.  

أحمد:١٨٣٣٩حَدَّثَنَا رَوْحٌ حَدَّثَنَا عَوْفٌ عَنْ حَكِيمٍ الْأَثْرَمِ عَنِ الْحَسَنِ قَالَ حَدَّثَنِي مُطَرِّفُ بْنُ عَبْدِ اللهِ حَدَّثَنِي عِيَاضُ بْنُ حِمَارٍ الْمُجَاشِعِيُّ قَالَ

قَالَ رَسُولُ اللهِ ﷺ فِي خُطْبَةٍ خَطَبَهَا قَالَ إِنَّ اللهَ ﷻ أَمَرَنِي أَنْ أُعَلِّمَكُمْ مَاجَهِلْتُمْ مِمَّا عَلَّمَنِي يَوْمِي هَذَا قَالَ وَإِنَّ كُلَّ مَالٍ نَحَلْتُهُ عِبَادِي فَهُوَ لَهُمْ حَلَالٌ فَذَكَرَ الْحَدِيثَ

[Machine] He (the narrator) heard the Prophet, ﷺ , say in his sermon: "Indeed, Allah has commanded me to teach you what you do not know." So he mentioned the Hadith and said, "The weak one who has no followers among you, seeking neither family nor wealth." A man said to Muṭarrif, "O Abu Abdullah, is the loyal one (referring to the loyal follower) from his people or from the Arabs?" He said, "It is the one who follows. It is for a man to have sexual intercourse with his servant without marrying her." And the people of Paradise are three: a just ruler, a truthful person, and a person who is certain. And a man who is merciful and gentle to every relative and Muslim, and a man who is chaste, poor, and charitable. Humam said, "Some of the companions of Qatadah said, and I do not know except that Yunus al-Iskaf said, 'Qatadah did not hear the Hadith of 'Iyad ibn Himar from Muṭarrif.' I said, 'He narrated to us from Muṭarrif, and you say that he did not hear it from Muṭarrif.' He said, 'Then an Arab came and he started asking him (Qatadah), and he was bold towards him.' So we said to the Bedouin, 'Ask him (Qatadah), did he hear the Hadith of 'Iyad ibn Himar from Muṭarrif?' So he asked him and he said, 'No, but four people narrated to me from Muṭarrif,' and he named three of them, the same ones I mentioned to you."  

أحمد:١٨٣٤٠حَدَّثَنَا عَفَّانُ حَدَّثَنَا هَمَّامٌ حَدَّثَنَا قَتَادَةُ حَدَّثَنَا الْعَلَاءُ بْنُ زِيَادٍ الْعَدَوِيُّ قَالَ وَحَدَّثَنِي يَزِيدُ أَخُو مُطَرِّفٍ قَالَ وَحَدَّثَنِي عُقْبَةُ كُلُّ هَؤُلَاءِ يَقُولُ حَدَّثَنِي مُطَرِّفٌ أَنَّ عِيَاضَ بْنَ حِمَارٍ حَدَّثَهُ

أَنَّهُ سَمِعَ النَّبِيَّ ﷺ يَقُولُ فِي خُطْبَتِهِ إِنَّ اللهَ ﷻ أَمَرَنِي أَنْ أُعَلِّمَكُمْ مَا جَهِلْتُمْ فَذَكَرَ الْحَدِيثَ وَقَالَ الضَّعِيفُ الَّذِي لَا زَبْرَ لَهُ الَّذِينَ هُمْ فِيكُمْ تَبَعٌلَا يَبْتَغُونَ أَهْلًا وَلَا مَالًا قَالَ قَالَ رَجُلٌ لِمُطَرِّفٍ يَا أَبَا عَبْدِ اللهِ أَمِنَ الْمَوَالِي هُوَ أَوْ مِنَ الْعَرَبِ؟ قَالَ هُوَ التَّابِعَةُ يَكُونُ لِلرَّجُلِ يُصِيبُ مِنْ خَدَمِهِ سِفَاحًا غَيْرَ نِكَاحٍ وَقَالَ أَهْلُ الْجَنَّةِ ثَلَاثَةٌ ذُو سُلْطَانٍ مُقْسِطٌ مُصَدِّقٌ مُوقِنٌ وَرَجُلٌ رَحِيمٌ رَقِيقُ الْقَلْبِ بِكُلِّ ذِي قُرْبَى وَمُسْلِمٍ وَرَجُلٌ عَفِيفٌ فَقِيرٌ مُتَصَدِّقٌ قَالَ هَمَّامٌ قَالَ بَعْضُ أَصْحَابِ قَتَادَةَ وَلَا أَعْلَمُهُ إِلَّا قَالَ يُونُسُ الْإِسْكَافُ قَالَ لِي إِنَّ قَتَادَةَ لَمْ يَسْمَعْ حَدِيثَ عِيَاضِ بْنِ حِمَارٍ مِنْ مُطَرِّفٍ قُلْتُ هُوَ حَدَّثَنَا عَنْ مُطَرِّفٍ وَتَقُولُ أَنْتَ لَمْ يَسْمَعْهُ مِنْ مُطَرِّفٍ قَالَ فَجَاءَ أَعْرَابِيٌّ فَجَعَلَ يَسْأَلُهُ وَاجْتَرَأَ عَلَيْهِ قَالَ فَقُلْنَا لِلْأَعْرَابِيِّ سَلْهُ هَلْ سَمِعَ حَدِيثَ عِيَاضِ بْنِ حِمَارٍ مِنْ مُطَرِّفٍ فَسَأَلَهُ فَقَالَ لَا حَدَّثَنِي أَرْبَعَةٌ عَنْ مُطَرِّفٍ فَسَمَّى ثَلَاثَةً الَّذِي قُلْتُ لَكُمْ

[Machine] The Prophet ﷺ said, "The sin of the aggressor is what the oppressed says until the oppressed retaliates, or until the oppressed does not retaliate."  

أحمد:١٨٣٤١حَدَّثَنَا عَفَّانُ حَدَّثَنَا هَمَّامٌ حَدَّثَنَا قَتَادَةُ عَنْ يَزِيدَ أَخِي مُطَرِّفٍ عَنْ عِيَاضِ بْنِ حِمَارٍ

أَنَّ النَّبِيَّ ﷺ قَالَ إِثْمُ الْمُسْتَبَّيْنِ مَا قَالَا عَلَى الْبَادِئِ حَتَّى يَعْتَدِيَ الْمَظْلُومُ أَوْ مَا لَمْ يَعْتَدِ الْمَظْلُومُ

[Machine] The Messenger of Allah ﷺ said, "There are two devils that accuse and dispute with each other."  

أحمد:١٨٣٤٢حَدَّثَنَا عَفَّانُ حَدَّثَنَا هَمَّامٌ بِهَذَا الْإِسْنَادِ قَالَ

قَالَ رَسُولُ اللهِ ﷺ الْمُسْتَبَّانِ شَيْطَانَانِ يَتَكَاذَبَانِ وَيَتَهَاتَرَانِ

[Machine] Narrated by the Prophet ﷺ , "Whoever finds lost property should make a public proclamation, seeking its rightful owner, for a year. If the owner does not appear, then the finder may take possession of it, for it is the property of Allah, and He gives it to whom He wills."  

أحمد:١٨٣٤٣حَدَّثَنَا مُحَمَّدُ بْنُ جَعْفَرٍ حَدَّثَنَا شُعْبَةُ قَالَ سَمِعْتُ خَالِدًا يُحَدِّثُ عَنْ يَزِيدَ بْنِ عَبْدِ اللهِ بْنِ الشِّخِّيرِ عَنْ مُطَرِّفِ بْنِ الشِّخِّيرِ عَنْ عِيَاضِ بْنِ حِمَارٍ

عَنِ النَّبِيِّ ﷺ أَنَّهُ قَالَ مَنِ الْتَقَطَ لُقَطَةً فَلْيُشْهِدْ ذَوَيْ عَدْلٍ أَوْ ذَا عَدْلٍ خَالِدٌ الشَّاكُّ وَلَا يَكْتُمْ وَلَا يُغَيِّبْ فَإِنْ جَاءَ صَاحِبُهَا فَهُوَ أَحَقُّ بِهَا وَإِلَّا فَهُوَ مَالُ اللهِ يُؤْتِيهِ مَنْ يَشَاءُ

[Machine] On the authority of Abu Aqeel Al-Dawraqi, with this is the narration of Hanzala Al-Katib Al-Usaydi.  

أحمد:١٨٣٤٤حَدَّثَنَا عَبْدُ اللهِ حَدَّثَنِي أَبِي قَالَ سَمِعْتُ يَحْيَى بْنَ سَعِيدٍ يَقُولُ مُطَرِّفٌ أَكْبَرُ مِنَ الْحَسَنِ بِعِشْرِينَ سَنَةً وَأَبُو الْعَلَاءِ أَكْبَرُ مِنَ الْحَسَنِ بِعَشْرِ سِنِينَ قَالَ عَبْدُ اللهِ قَالَ أَبِي حَدَّثَنِيهِ أَخٌّ لِأَبِي بَكْرِ بْنِ أَبِي الْأَسْوَدِ عَنْ يَحْيَى بْنِ سَعِيدٍ

عَنْ أَبِي عَقِيلٍ الدَّوْرَقِيِّ بِهَذَا حَدِيثُ حَنْظَلَةَ الْكَاتِبِ الْأُسَيْدِيِّ
