٤٩۔ كِتَابُ النَّفَقَاتِ ص ٢
[Machine] "He ﷺ said: The child of a man is from his earnings, from the best of his earnings. So eat from their wealth." Imam Ahmad (may Allah have mercy upon him) narrated it, and Hammad ibn Abi Sulayman narrated it from Ibrahim, from Al-Aswad, from Aisha. And he added: "When you need to cite it, even though it is a rejected Hadith." Abu Dawud Al-Sijistani said it.
ﷺ قَالَ وَلَدُ الرَّجُلِ مِنْ كَسْبِهِ مِنْ أَطْيَبِ كَسْبِهِ فَكُلُوا مِنْ أَمْوَالِهِمْ قَالَ الْإِمَامُ أَحْمَدُ رَحِمَهُ اللهُ وَرَوَاهُ حَمَّادُ بْنُ أَبِي سُلَيْمَانَ عَنْ إِبْرَاهِيمَ عَنِ الْأَسْوَدِ عَنْ عَائِشَةَ ؓ وَزَادَ فِيهِ إِذَا احْتَجْتُمْ إِلَيْهِ وَهُوَ مُنْكَرٌ قَالَهُ أَبُو دَاوُدَ السِّجِسْتَانِيُّ
[Machine] "Inna awladakum hibatullahi lakum, yahabu liman yasha'u inathan wayahabu liman yasha'u aldhukoor. Fahum wa'amwaluhum lakum idha ihtajtum ilayha." [Ash-Shura 49] 15746 Abu Abdullah Al-Hafiz informed us, Abu Bakr Muhammad ibn Abdullah Al-Jarrahhi narrated to us, Marwan narrated to us, Yahya ibn Sasawayh narrated to us, Abdul Karim As-Sukkari narrated to us, Wahb ibn Zam'ah narrated to me, Sufyan ibn Abd Al-Malik said: I questioned Abdullah ibn Al-Mubarak about the hadith of Aisha. "Fahum wa'amwaluhum lakum idha ihtajtum ilayha." He told me that Sufyan narrated it to him from Hammad, from Ibrahim, from Al-Aswad, from Aisha. Sufyan said: "This is a fabrication by Hammad." Abdullah said: "I asked the companions of Sufyan about this hadith, but they did not remember it." Abdullah said: "This is from Abdullah's hadith, narrated from Umara ibn Umair, which does not contain Al-Aswad and does not include the phrase 'idha ihtajtum.' The Sheikh said: "It has also been narrated from Al-A'mash, from Ibrahim, from Al-Aswad, from Aisha, without this wording, and it is not preserved in this chain."
ﷺ إِنَّ أَوْلَادَكُمْ هِبَةُ اللهِ لَكُمْ {يَهَبُ لِمَنْ يَشَاءُ إِنَاثًا وَيَهَبُ لِمَنْ يَشَاءُ الذُّكُورَ} [الشورى 49] فَهُمْ وَأَمْوَالُهُمْ لَكُمْ إِذَا احْتَجْتُمْ إِلَيْهَا 15746 أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ حَدَّثَنِي أَبُو بَكْرٍ مُحَمَّدُ بْنُ عَبْدِ اللهِ الْجَرَّاحِيُّ بِمَرْوَ نا يَحْيَى بْنُ سَاسَوَيْهِ نا عَبْدُ الْكَرِيمِ السُّكَّرِيُّ نا وَهْبُ بْنُ زَمْعَةَ أنا سُفْيَانُ بْنُ عَبْدِ الْمَلِكِ قَالَ سَأَلْتُ عَبْدَ اللهِ بْنَ الْمُبَارَكِ عَنْ حَدِيثِ عَائِشَةَ ؓ فَهُمْ وَأَمْوَالُهُمْ لَكُمْ إِذَا احْتَجْتُمْ إِلَيْهَا فَقَالَ حَدَّثَنِي بِهِ سُفْيَانُ عَنْ حَمَّادٍ عَنْ إِبْرَاهِيمَ عَنِ الْأَسْوَدِ عَنْ عَائِشَةَ قَالَ سُفْيَانُ وَهَذَا وَهْمٌ مِنْ حَمَّادٍ قَالَ عَبْدُ اللهِ سَأَلْتُ أَصْحَابَ سُفْيَانَ عَنْ هَذَا الْحَدِيثِ فَلَمْ يَحْفَظُوا قَالَ عَبْدُ اللهِ وَهَذَا مِنْ حَدِيثِهِ عَنْ عُمَارَةَ بْنِ عُمَيْرٍ لَيْسَ فِيهِ الْأَسْوَدُ وَلَيْسَ فِيهِ إِذَا احْتَجْتُمْ قَالَ الشَّيْخُ وَقَدْ رُوِيَ عَنِ الْأَعْمَشِ عَنْ إِبْرَاهِيمَ عَنِ الْأَسْوَدِ عَنْ عَائِشَةَ ؓ دُونَ هَذِهِ اللَّفْظَةِ وَهُوَ بِهَذَا الْإِسْنَادِ غَيْرُ مَحْفُوظٍ
[Machine] By Allah, indeed the best thing a man eats is from his own earnings, and his children also eat from his own earnings, and likewise.
اللهِ ﷺ إِنَّ أَطْيَبَ مَا أَكَلَ الرَّجُلُ مِنْ كَسْبِهِ وَوَلَدُهُ مِنْ كَسْبِهِ وَكَذَلِكَ
[Machine] "A Bedouin man came to the Messenger of Allah ﷺ and said, 'Verily, my father intends to seize my wealth.' He ﷺ said, 'You and your wealth belong to your father. Indeed, the best of what you eat from your earnings, then consume it happily.'"
أَنَّ أَعْرَابِيًّا أَتَى رَسُولَ اللهِ ﷺ فَقَالَ إِنَّ أَبِي يُرِيدُ أَنْ يَجْتَاحَ مَالِي قَالَ أَنْتَ وَمَالُكَ لِوَالِدِكَ إِنَّ أَطْيَبَ مَا أَكَلْتُمْ مِنْ كَسْبِكُمْ فَكُلُوهُ هَنِيئًا
[Machine] A Bedouin man came to the Prophet ﷺ and said, "I have wealth and children, and my father wants to take away my wealth." The Prophet ﷺ said, "You and your wealth belong to your father. Indeed, your children are the best of your earnings."
أَنَّ أَعْرَابِيًّا أَتَى النَّبِيَّ ﷺ قَالَ إِنَّ لِي مَالًا وَوَلَدًا وَإِنَّ وَالِدِي يُرِيدُ أَنْ يَجْتَاحَ مَالِي فَقَالَ أَنْتَ وَمَالُكَ لِأَبِيكَ إِنَّ أَوْلَادَكُمْ مِنْ أَطْيَبِ كَسْبِكُمْ
A man came to the Prophet ﷺ and said: Messenger of Allah, I have property and children, and my father finishes my property. He replied; You and your property belong to your father; your children come from the pleasantest of what you earn; so enjoy from the earning of your children. (Using translation from Abū Dāʾūd 3530)
أَنَّ رَجُلًا أَتَى النَّبِيَّ ﷺ فَقَالَ يَا رَسُولَ اللهِ إِنَّ لِي مَالًا وَوَلَدًا وَإِنَّ وَالِدِي يَجْتَاحُ مَالِي قَالَ أَنْتَ وَمَالُكَ لِوَالِدِكَ إِنَّ أَوْلَادَكُمْ مِنْ أَطْيَبِ كَسْبِكُمْ فَكُلُوا مِنْ كَسْبِ أَوْلَادِكُمْ
[Machine] A man came to the Prophet ﷺ and said, "O Messenger of Allah, I have wealth and children, and my father also has wealth and children. He wants to take my wealth to provide for his children." The Messenger of Allah ﷺ said, "You and your wealth belong to your father. This has been narrated as connected from various sources, and its like is not established except for 15752. Abu Abdullah Al-Hafiz informed us, Abu Bakr Ahmad ibn Kamel Al-Qadi narrated to me, Ahmad ibn Saeed Al-Jammal narrated to me, Abdullah ibn Nafi' Al-Saigh narrated to me, Al-Munkadir ibn Muhammad narrated to me from his father from Jabir that a man said, "O Messenger of Allah!" Then he mentioned it. The Sheikh (referring to the one who narrated this story) said, "May Allah have mercy on him, whoever claims that the wealth of the child belongs to his father uses the apparent meaning of this hadith, and whoever claims that he has enough of his own wealth when needed, but if he becomes independent of it, then the father has no right to his wealth should use the reports that have been mentioned concerning the prohibition of taking the property of others. If a person dies and has a son, the father would only be entitled to one-sixth of his wealth. And if the father owned his son's wealth, he would inherit all of it."
أَنَّ رَجُلًا جَاءَ إِلَى النَّبِيِّ ﷺ فَقَالَ يَا رَسُولَ اللهِ إِنَّ لِي مَالًا وَعِيَالًا وَإِنَّ لِأَبِي مَالًا وَعِيَالًا يُرِيدُ أَنْ يَأْخُذَ مَالِي فُيُطْعِمَهُ عِيَالَهُ فَقَالَ رَسُولُ اللهِ ﷺ أَنْتَ وَمَالُكَ لِأَبِيكَ هَذَا مُنْقَطِعٌ وَقَدْ رُوِيَ مَوْصُولًا مِنْ أَوْجُهٍ أُخَرَ وَلَا يَثْبُتُ مِثْلُهَا 15752 أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنا أَبُو بَكْرٍ أَحْمَدُ بْنُ كَامِلٍ الْقَاضِي نا أَحْمَدُ بْنُ سَعِيدٍ الْجَمَّالُ نا عَبْدُ اللهِ بْنُ نَافِعٍ الصَّائِغُ حَدَّثَنِي الْمُنْكَدِرُ بْنُ مُحَمَّدٍ عَنْ أَبِيهِ عَنْ جَابِرٍ أَنَّ رَجُلًا قَالَ يَا رَسُولَ اللهِ فَذَكَرَهُ قَالَ الشَّيْخُ رَحِمَهُ اللهُ مَنْ زَعَمَ أَنَّ مَالَ الْوَلَدِ لِأَبِيهِ احْتَجَّ بِظَاهِرِ هَذَا الْحَدِيثِ وَمَنْ زَعَمَ أَنَّ لَهُ مِنْ مَالِهِ مَا يَكْفِيهِ إِذَا احْتَاجَ إِلَيْهِ فَإِذَا اسْتَغْنَى عَنْهُ لَمْ يَكُنْ لِلْأَبِ مِنْ مَالِهِ شَيْءٌ احْتَجَّ بِالْأَخْبَارِ الَّتِي وَرَدَتْ فِي تَحْرِيمِ مَالِ الْغَيْرِ وَأَنَّهُ لَوْ مَاتَ وَلَهُ ابْنٌ لَمْ يَكُنْ لِلْأَبِ مِنْ مَالِهِ إِلَّا السُّدُسُ وَلَوْ كَانَ أَبُوهُ يَمْلِكُ مَالَ ابْنِهِ لَحَازَهُ كُلَّهُ
[Machine] On the authority of the Prophet ﷺ that he said, "Every person is entitled to his wealth more than his father, his children, and all people." It was narrated to us by Abu Abdullah Al-Sulami, narrated by Abu Al-Hasan Al-Karizi, narrated by Ali Ibn Abdul Aziz, narrated by Abu Ubaid, narrated by Hushaim, narrated by Abdul Rahman Ibn Yahya, narrated by Hibban Ibn Abi Jablah, narrated by the Prophet ﷺ with that.
عَنِ النَّبِيِّ ﷺ أَنَّهُ قَالَ كُلُّ أَحَدٍ أَحَقُّ بِمَالِهِ مِنْ وَالِدِهِ وَوَلَدِهِ وَالنَّاسِ أَجْمَعِينَ أَخْبَرَنَاهُ أَبُو عَبْدِ الرَّحْمَنِ السُّلَمِيُّ أنا أَبُو الْحَسَنِ الْكَارِزِيُّ نا عَلِيُّ بْنُ عَبْدِ الْعَزِيزِ عَنْ أَبِي عُبَيْدٍ نا هُشَيْمٌ أنا عَبْدُ الرَّحْمَنِ بْنُ يَحْيَى عَنْ حِبَّانَ بْنِ أَبِي جَبَلَةَ عَنِ النَّبِيِّ ﷺ بِذَلِكَ
[Machine] There was a man who said to the Khalifa of the Messenger of Allah, "This person wants to take all my wealth and conquer me." Abu Bakr said, "You have only enough of his wealth that will suffice for you." The man said to the Khalifa of the Messenger of Allah, "Did not the Messenger of Allah ﷺ say that you and your wealth belong to your father?" Abu Bakr said, "Be content with what Allah is pleased with." This narration has been mentioned by others from Al-Mundhir ibn Ziyad and it is said that it refers to expenditure, and Al-Mundhir ibn Ziyad is weak.
لَهُ رَجُلٌ يَا خَلِيفَةَ رَسُولِ اللهِ هَذَا يُرِيدُ أَنْ يَأْخُذَ مَالِي كُلَّهُ وَيَجْتَاحَهُ فَقَالَ أَبُو بَكْرٍ ؓ إِنَّمَا لَكَ مِنْ مَالِهِ مَا يَكْفِيكَ فَقَالَ يَا خَلِيفَةَ رَسُولِ اللهِ ﷺ أَلَيْسَ قَالَ رَسُولُ اللهِ ﷺ أَنْتَ وَمَالُكَ لِأَبِيكَ فَقَالَ أَبُو بَكْرٍ ؓ ارْضَ بِمَا رَضِيَ اللهُ بِهِ وَرَوَاهُ غَيْرُهُ عَنِ الْمُنْذِرِ بْنِ زِيَادٍ وَقَالَ فِيهِ إِنَّمَا يَعْنِي بِذَلِكَ النَّفَقَةَ وَالْمُنْذِرُ بْنُ زِيَادٍ ضَعِيفٌ
49.12 [Machine] Who deserves better companionship?
٤٩۔١٢ بَابُ مَنْ أَحَقُّ مِنْهُمَا بِحُسْنِ الصُّحْبَةِ
أَنَّ رَجُلًا سَأَلَ النَّبِيَّ ﷺ قَالَ يَا رَسُولَ اللهِ أِيُّ النَّاسِ أَحَقُّ مِنِّي بِحُسْنِ الصُّحْبَةِ؟ قَالَ أُمُّكَ قَالَ ثُمَّ مَنْ؟ قَالَ ثُمَّ أُمُّكَ قَالَ ثُمَّ مَنْ؟ قَالَ ثُمَّ أُمُّكَ قَالَ ثُمَّ مَنْ؟ قَالَ ثُمَّ أَبُوكَ أَخْرَجَاهُ فِي الصَّحِيحِ مِنْ حَدِيثِ ابْنِ شُبْرُمَةَ
"I said: 'O Messenger of Allah! Who most deserves(my) reverence?' He said: 'Your mother.'" He said: "I said: 'Then who?' He said: 'Your mother.'" He said: "I said: 'Then who?' He said: 'Your mother.'" He said: "I said: 'Then who?' He said: 'Then your father, then the nearest relatives, then the nearest relatives.'" (Using translation from Tirmidhī 1897)
قُلْتُ يَا رَسُولَ اللهِ مَنْ أَبِرُّ؟ قَالَ أُمَّكَ قَالَ قُلْتُ ثُمَّ مَنْ؟ قَالَ ثُمَّ أُمَّكَ قَالَ قُلْتُ ثُمَّ مَنْ؟ قَالَ ثُمَّ أُمَّكَ قَالَ قُلْتُ ثُمَّ مَنْ؟ قَالَ ثُمَّ أَبَاكَ ثُمَّ الْأَقْرَبَ فَالْأَقْرَبَ
49.13 [Machine] When parents separate while they are in the same village, the mother has the right to her child as long as she is unmarried, and they are young. But when one of them reaches the age of seven or eight and is of sound mind, they are given the choice between their father and mother, and they can choose anyone they prefer.
٤٩۔١٣ بَابُ الْأَبَوَيْنِ إِذَا افْتَرَقَا وَهُمَا فِي قَرْيَةٍ وَاحِدَةٍ، فَالْأُمُّ أَحَقُّ بِوَلَدِهَا مَا لَمْ تَتَزَوَّجْ، وَكَانُوا صِغَارًا، فَإِذَا بَلَغَ أَحَدُهُمَ سَبْعَ أَوْ ثَمَانِ سِنِينَ وَهُوَ يَعْقِلُ خُيِّرَ بَيْنَ أَبِيهِ وَأُمِّهِ، وَكَانَ عِنْدَ أَيِّهِمَا اخْتَارَ
[Machine] That the Prophet ﷺ chose a boy between his father and his mother.
أَنَّ النَّبِيَّ ﷺ خَيَّرَ غُلَامًا بَيْنَ أَبِيهِ وَأُمِّهِ
While I was sitting with AbuHurayrah, a Persian woman came to him along with a son of hers. She had been divorced by her husband and they both claimed him. She said: AbuHurayrah, speaking to him in Persian, my husband wishes to take my son away. AbuHurayrah said: Cast lots for him, saying it to her in a foreign language. Then her husband came and asked: Who is disputing with me about my son? AbuHurayrah said: O Allah, I do not say this, except that I heard a woman who came to the Messenger of Allah ﷺ while I was sitting with him, and she said: My husband wishes to take away my son, Messenger of Allah, and he draws water for me from the well of AbuInabah, and he has been good to me. The Messenger of Allah ﷺ said: Cast lots for him. Her husband said: Who is disputing with me about my son? The Prophet ﷺ said: This is your father and this your mother, so take whichever of them you wish by the hand. So he took his mother's hand and she went away with him. (Using translation from Abū Dāʾūd 2277)
أَنَّ أَبَا مَيْمُونَةَ سُلَيْمًا مَوْلًى مِنْ أَهْلِ الْمَدِينَةِ رَجُلَ صِدْقٍ قَالَ بَيْنَمَا أَنَا جَالِسٌ مَعَ أَبِي هُرَيْرَةَ جَاءَتِ امْرَأَةٌ فَارِسِيَّةٌ مَعَهَا ابْنٌ لَهَا فَادَّعَيَاهُ وَقَدْ طَلَّقَهَا زَوْجُهَا فَقَالَتْ يَا أَبَا هُرَيْرَةَ رَطَنَتْ بِالْفَارِسِيَّةِ زَوْجِي يُرِيدُ أَنْ يَذْهَبَ بِابْنِي فَقَالَ أَبُو هُرَيْرَةَ اسْتَهِمَا عَلَيْهِ وَرَطَنَ لَهَا بِذَلِكَ فَجَاءَ زَوْجُهَا فَقَالَ مَنْ يُحَاقُّنِي فِي وَلَدِي؟ فَقَالَ أَبُو هُرَيْرَةَ اللهُمَّ إِنِّي لَا أَقُولُ هَذَا إِلَّا أَنِّي سَمِعْتُ امْرَأَةً جَاءَتْ إِلَى رَسُولِ اللهِ ﷺ وَأَنَا قَاعِدٌ عِنْدَهُ فَقَالَتْ يَا رَسُولَ اللهِ إِنَّ زَوْجِي يُرِيدُ أَنْ يَذْهَبَ بِابْنِي وَقَدْ سَقَانِي مِنْ بِئْرِ أَبِي عِنَبَةَ وَقَدْ نَفَعَنِي فَقَالَ النَّبِيُّ ﷺ اسْتَهِمَا عَلَيْهِ فَقَالَ زَوْجُهَا مَنْ يُحَاقُّنِي فِي وَلَدِي؟ فَقَالَ النَّبِيُّ ﷺ هَذَا أَبُوكَ وَهَذِهِ أُمُّكَ فَخُذْ بِيَدِ أَيِّهِمَا شِئْتَ فَأَخَذَ بِيَدِ أُمِّهِ فَانْطَلَقَتْ بِهِ لَفْظُ حَدِيثِ الرُّوذْبَارِيِّ وَحَدِيثُ ابْنِ بِشْرَانَ أَقْصَرُ مِنْهُ وَالْمَعْنَى وَاحِدٌ
[Machine] A woman came to the Prophet ﷺ after her husband divorced her, and she wanted to take custody of her child. The Messenger of Allah ﷺ asked for advice, and the man said, "Who would prevent me from being with my child?" The Messenger of Allah ﷺ said to the son, "Choose whichever of them you want." So, he chose his mother, and she went away with him.
جَاءَتِ امْرَأَةٌ إِلَى النَّبِيِّ ﷺ قَدْ طَلَّقَهَا زَوْجُهَا فَأَرَادَتْ أَنْ تَأْخُذَ وَلَدَهَا فَقَالَ رَسُولُ اللهِ ﷺ اسْتَهِمَا فَقَالَ الرَّجُلُ مَنْ يَحُولُ بَيْنِي وَبَيْنَ وَلَدِي؟ فَقَالَ رَسُولُ اللهِ ﷺ لِلِابْنِ اخْتَرْ أَيَّهُمَا شِئْتَ فَاخْتَارَ أُمَّهُ فَذَهَبَتْ بِهِ
My daughter; she is weaned or about to wean. Rafi' said: My daughter. The Prophet ﷺ said to him: Be seated on a side. And he said to her: Be seated on a side. He then seated the girl between them, and said to them: Call her. The girl inclined to her mother. The Prophet ﷺ said: O Allah! guide her. The daughter then inclined to her father, and he took her. أَنْ تُسْلِمَ فَأَتَتِ النَّبِيَّ ﷺ فَقَالَتِ ابْنَتِي وَهِيَ فَطِيمٌ وَقَالَ رَافِعٌ ابْنَتِي فَقَالَ النَّبِيُّ ﷺ لِرَافِعٍ اقْعُدْ نَاحِيَةً وَقَالَ لِامْرَأَتِهِ اقْعُدِي نَاحِيَةً قَالَ وَأَقْعَدَ الصَّبِيَّةَ بَيْنَهُمَا ثُمَّ قَالَ ادْعُوَاهَا فَمَالَتِ الصَّبِيَّةُ إِلَى أُمِّهَا فَقَالَ النَّبِيُّ ﷺ اللهُمَّ اهْدِهَا فَمَالَتْ إِلَى أَبِيهَا فَأَخَذَهَا رَافِعُ بْنُ سِنَانٍ جَدُّ عَبْدِ الْحَمِيدِ بْنِ جَعْفَرٍ
خَيَّرَنِي عَلِيٌّ ؓ بَيْنَ أُمِّي وَعَمِّي ثُمَّ قَالَ لِأَخٍ لِي أَصْغَرَ مِنِّي وَهَذَا أَيْضًا لَوْ قَدْ بَلَغَ مَبْلَغَ هَذَا لَخَيَّرْتُهُ قَالَ الشَّافِعِيُّ قَالَ إِبْرَاهِيمُ عَنْ يُونُسَ عَنْ عُمَارَةَ عَنْ عَلِيٍّ ؓ مِثْلَهُ وَقَالَ فِي الْحَدِيثِ وَكُنْتُ ابْنَ سَبْعٍ أَوْ ثَمَانِ سِنِينَ 15762 وَرَوَى الشَّافِعِيُّ فِي الْقَدِيمِ وَلَيْسَ ذَلِكَ فِي مَسْمُوعِنَا عَنْ سُفْيَانَ بْنِ عُيَيْنَةَ عَنْ يَزِيدَ بْنِ يَزِيدَ بْنِ جَابِرٍ عَنْ إِسْمَاعِيلَ بْنِ عُبَيْدِ اللهِ بْنِ أَبِي الْمُهَاجِرِ عَنْ عَبْدِ الرَّحْمَنِ بْنِ غَنْمٍ أَنَّ عُمَرَ بْنَ الْخَطَّابِ ؓ خَيَّرَ غُلَامًا بَيْنَ أَبِيهِ وَأُمِّهِ
49.14 [Machine] The mother gets married and her right to the child's custody is revoked and transferred to the grandmother.
٤٩۔١٤ بَابُ الْأُمِّ تَتَزَوَّجُ فَيَسْقُطُ حَقُّهَا مِنْ حَضَانَةِ الْوَلَدِ وَيَنْتَقِلُ إِلَى جَدَّتِهِ
A woman said: Messenger of Allah, my womb is a vessel to this son of mine, my breasts, a water-skin for him, and my lap a guard for him, yet his father has divorced me, and wants to take him away from me. The Messenger of Allah ﷺ said: You have more right to him as long as you do not marry. (Using translation from Abū Dāʾūd 2276)
يَا رَسُولَ اللهِ إِنَّ ابْنِي هَذَا كَانَ بَطْنِي لَهُ وِعَاءً وَثَدْيِي لَهُ سِقَاءً وَحِجْرِي لَهُ حِوَاءً وَإِنَّ أَبَاهُ طَلَّقَنِي وَأَرَادَ أَنْ يَنْزِعَهُ مِنِّي فَقَالَ لَهَا رَسُولُ اللهِ ﷺ أَنْتِ أَحَقُّ بِهِ مَا لَمْ تَنْكِحِي
[Machine] "Those who claim that Abu Bakr Al-Siddiq had decided for Umar ibn Al-Khattab to take custody of his grandson, Asim ibn Umar, until he reaches maturity, and Asim's mother at the time was alive and married."
الَّذِينَ يُنْتَهَى إِلَى قَوْلِهِمْ مِنْ أَهْلِ الْمَدِينَةِ أَنَّهُمْ كَانُوا يَقُولُونَ قَضَى أَبُو بَكْرٍ الصِّدِّيقُ عَلَى عُمَرَ بْنِ الْخَطَّابِ ؓ لِجَدَّةِ ابْنِهِ عَاصِمِ بْنِ عُمَرَ بِحَضَانَتِهِ حَتَّى يَبْلُغَ وَأُمُّ عَاصِمٍ يَوْمَئِذٍ حَيَّةٌ مُتَزَوِّجَةٌ
[Machine] Abu Bakr intervened between her and him, so Umar did not pursue the matter further.
أَبُو بَكْرٍ ؓ خَلِّ بَيْنَهَا وَبَيْنَهُ فَمَا رَاجَعَهُ عُمَرُ الْكَلَامَ
[Machine] "And Abu Abdur Rahman As-Sulami informed us that Abu Al-Hasan Al-Mahmoudi Al-Marwazi narrated to us, who narrated to us Abu Abdullah Muhammad ibn Ali Al-Hafiz, who narrated to us Abu Musa, from Yahya ibn Sa'id, from Mujalid, from 'Aamir, from Masrooq, that Umar divorced Umm Asim and she was in the house of her grandmother. So I argued with him until I went to Abu Bakr, and he ruled that the child should be with his grandmother and the maintenance would be upon Umar. And he said, 'She has more right to him.'"
وَأَخْبَرَنَا أَبُو عَبْدِ الرَّحْمَنِ السُّلَمِيُّ أنبأ أَبُو الْحَسَنِ الْمَحْمُودِيُّ الْمَرْوَزِيُّ ثنا أَبُو عَبْدِ اللهِ مُحَمَّدُ بْنُ عَلِيٍّ الْحَافِظُ ثنا أَبُو مُوسَى عَنْ يَحْيَى بْنِ سَعِيدٍ عَنْ مُجَالِدٍ عَنْ عَامِرٍ عَنْ مَسْرُوقٍ أَنَّ عُمَرَ ؓ طَلَّقَ أُمَّ عَاصِمٍ فَكَانَ فِي حِجْرِ جَدَّتِهِ فَخَاصَمْتُهُ إِلَى أَبِي بَكْرٍ ؓ فَقَضَى أَنْ يَكُونَ الْوَلَدُ مَعَ جَدَّتِهِ وَالنَّفَقَةُ عَلَى عُمَرَ ؓ وَقَالَ هِيَ أَحَقُّ بِهِ
[Machine] I heard the Messenger of Allah ﷺ saying, "Do not cause a mother to be separated from her child."
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ لَا تُولَهْ وَالِدَةٌ عَنْ وَلَدِهَا
49.15 [Machine] Aunt is entitled to custody more than the tribe
٤٩۔١٥ بَابُ الْخَالَةِ أَحَقُّ بِالْحَضَانَةِ مِنَ الْعَصَبَةِ
When the Prophet ﷺ intended to perform ʿUmra in the month of Dhul-Qada, the people of Mecca did not let him enter Mecca till he settled the matter with them by promising to stay in it for three days only. When the document of treaty was written, the following was mentioned: 'These are the terms on which Muhammad, Messenger of Allah ﷺ agreed (to make peace).' They said, "We will not agree to this, for if we believed that you are Messenger of Allah ﷺ we would not prevent you, but you are Muhammad bin ʿAbdullah." The Prophet ﷺ said, "I am Messenger of Allah ﷺ and also Muhammad bin ʿAbdullah." Then he said to ʿAli, "Rub off (the words) 'Messenger of Allah ﷺ' ", but ʿAli said, "No, by Allah, I will never rub off your name." So, Messenger of Allah ﷺ took the document and wrote, 'This is what Muhammad bin ʿAbdullah has agreed upon: No arms will be brought into Mecca except in their cases, and nobody from the people of Mecca will be allowed to go with him (i.e. the Prophet ﷺ ) even if he wished to follow him and he (the Prophet ﷺ ) will not prevent any of his companions from staying in Mecca if the latter wants to stay.' When the Prophet ﷺ entered Mecca and the time limit passed, the Meccans went to ʿAli and said, "Tell your Friend (i.e. the Prophet ﷺ ) to go out, as the period (agreed to) has passed." So, the Prophet ﷺ went out of Mecca. The daughter of Hamza ran after them (i.e. the Prophet ﷺ and his companions), calling, "O Uncle! O Uncle!" ʿAli received her and led her by the hand and said to Fatima, "Take your uncle's daughter." Zaid and Jaʿfar quarreled about her. ʿAli said, "I have more right to her as she is my uncle's daughter." Jaʿfar said, "She is my uncle's daughter, and her aunt is my wife." Zaid said, "She is my brother's daughter." The Prophet ﷺ judged that she should be given to her aunt, and said that the aunt was like the mother. He then said to 'All, "You are from me and I am from you", and said to Jaʿfar, "You resemble me both in character and appearance", and said to Zaid, "You are our brother (in faith) and our freed slave." رَسُولُ اللهِ ﷺ فِي ذِي الْقِعْدَةِ فَأَبَى أَهْلُ مَكَّةَ أَنْ يَدَعُوهُ يَدْخُلُ مَكَّةَ حَتَّى قَاضَاهُمْ عَلَى أَنْ يُقِيمَ بِهَا ثَلَاثَةَ أَيَّامٍ فَلَمَّا كَتَبُوا الْكِتَابَ كَتَبُوا هَذَا مَا قَاضَى عَلَيْهِ مُحَمَّدٌ رَسُولُ اللهِ فَقَالُوا لَا نُقِرُّ بِهَذَا وَلَوْ نَعْلَمُ أَنَّكَ رَسُولُ اللهِ مَا مَنَعْنَاكَ شَيْئًا وَلَكِنْ أَنْتَ مُحَمَّدُ بْنُ عَبْدِ اللهِ قَالَ أَنَا رَسُولُ اللهِ وَأَنَا مُحَمَّدُ بْنُ عَبْدِ اللهِ يَا عَلِيُّ امْحُ رَسُولُ اللهِ قَالَ وَاللهِ لَا أَمْحُوكَ أَبَدًا فَأَخَذَ رَسُولُ اللهِ ﷺ الْكِتَابَ وَلَيْسَ يُحْسِنُ يَكْتُبُ مَكَانَ رَسُولُ اللهِ فَكَتَبَ هَذَا مَا قَاضَى عَلَيْهِ مُحَمَّدُ بْنُ عَبْدِ اللهِ أَنْ لَا يُدْخِلَ مَكَّةَ السِّلَاحَ إِلَّا السَّيْفَ فِي الْقِرَابِ وَأَنْ لَا يُخْرِجَ مِنْ أَهْلِهَا أَحَدًا أَرَادَ أَنْ يَتَّبِعَهُ وَأَنْ لَا يَمْنَعَ أَحَدًا مِنْ أَصْحَابِهِ أَرَادَ أَنْ يُقِيمَ بِهَا فَلَمَّا دَخَلَهَا وَمَضَى الْأَجَلُ أَتَوْا عَلِيًّا ؓ فَقَالُوا قُلْ لِصَاحِبِكَ فَلْيَخْرُجْ عَنَّا فَقَدْ مَضَى الْأَجَلُ فَخَرَجَ رَسُولُ اللهِ ﷺ تَتْبَعُهُمْ ابْنَةُ حَمْزَةَ فَنَادَتْ يَا عَمُّ يَا عَمُّ فَتَنَاوَلَهَا عَلِيٌّ ؓ فَأَخَذَ بِيَدِهَا وَقَالَ لِفَاطِمَةَ عَلَيْهَا السَّلَامُ دُونَكِ فَحَمَلَتْهَا فَاخْتَصَمَ فِيهَا عَلِيٌّ وَزَيْدٌ وَجَعْفَرٌ ؓ فَقَالَ عَلِيٌّ أَنَا أَخَذْتُهَا وَهِيَ بِنْتُ عَمِّي قَالَ جَعْفَرٌ ابْنَةُ عَمِّي وَخَالَتُهَا تَحْتِي وَقَالَ زَيْدٌ ابْنَةُ أَخِي فَقَضَى رَسُولُ اللهِ ﷺ لِخَالَتِهَا وَقَالَ الْخَالَةُ بِمَنْزِلَةِ الْأُمِّ وَقَالَ لِعَلِيٍّ ؓ أَنْتَ مِنِّي وَأَنَا مِنْكَ وَقَالَ لِجَعْفَرٍ ؓ أَشْبَهْتَ خَلْقِي وَخُلُقِي وَقَالَ لِزَيْدٍ ؓ أَنْتَ أَخُونَا وَمَوْلَانَا
[Machine] The Messenger of Allah ﷺ stayed in Makkah for three days during the Umrah al-Qadaa (the compensatory Umrah). When the third day came, they said to Ali ibn Abi Talib, "This is the last day according to the condition of your companion, so tell him to leave." Ali informed him about it, and he responded, "Yes," and he left.
أَقَامَ رَسُولُ اللهِ ﷺ بِمَكَّةَ ثَلَاثَةَ أَيَّامٍ فِي عُمْرَةِ الْقَضَاءِ فَلَمَّا كَانَ الْيَوْمُ الثَّالِثُ قَالُوا لِعَلِيِّ بْنِ أَبِي طَالِبٍ ؓ إِنَّ هَذَا آخِرُ يَوْمٍ مِنْ شَرْطِ صَاحِبِكَ فَمُرْهُ فَلْيَخْرُجْ فَحَدَّثَهُ بِذَلِكَ فَقَالَ نَعَمْ فَخَرَجَ
ابْنَةُ حَمْزَةَ تُنَادِي يَا عَمُّ يَا عَمُّ فَتَنَاوَلَهَا عَلِيٌّ ؓ فَأَخَذَ بِيَدِهَا وَقَالَ لِفَاطِمَةَ عَلَيْهَا السَّلَامُ دُونَكِ ابْنَةَ عَمِّكِ فَحَمَلَتْهَا فَاخْتَصَمَ فِيهَا عَلِيٌّ وَزَيْدُ بْنُ حَارِثَةَ وَجَعْفَرُ بْنُ أَبِي طَالِبٍ ؓ فَقَالَ عَلِيٌّ ؓ أَنَا أَخَذْتُهَا وَبِنْتُ عَمِّي وَقَالَ جَعْفَرٌ بِنْتُ عَمِّي وَخَالَتُهَا عِنْدِي وَقَالَ زَيْدٌ ابْنَةُ أَخِي فَقَضَى بِهَا رَسُولُ اللهِ ﷺ لِخَالَتِهَا وَقَالَ الْخَالَةُ بِمَنْزِلَةِ الْأُمِّ وَقَالَ لِزَيْدٍ أَنْتَ أَخُونَا وَمَوْلَانَا فَحَجَلَ وَقَالَ لِجَعْفَرٍ أَنْتَ أَشْبَهُهُمْ بِي خَلْقًا وَخُلُقًا فَحَجَلَ وَرَاءَ حَجْلِ زَيْدٍ ثُمَّ قَالَ لِي أَنْتَ مِنِّي وَأَنَا مِنْكَ فَحَجَلْتُ وَرَاءَ حَجْلِ جَعْفَرٍ قَالَ وَقُلْتُ لِلنَّبِيِّ ﷺ أَلَا تَتَزَوَّجُ بِنْتَ حَمْزَةَ؟ قَالَ إِنَّهَا ابْنَةُ أَخِي مِنَ الرَّضَاعَةِ وَيُحْتَمَلُ أَنْ تَكُونَ رِوَايَةُ أَبِي إِسْحَاقَ عَنِ الْبَرَاءِ فِي قِصَّةِ ابْنَةِ حَمْزَةَ مُخْتَصِرَةً كَمَا رُوِّينَا ثُمَّ رَوَاهَا عَنْهُمَا عَنْ عَلِيٍّ ؓ أَتَمَّ مِنْ ذَلِكَ كَمَا رُوِّينَا فَقَصَّةُ الْحَجْلِ فِي رِوَايَتِهِمَا دُونَ رِوَايَةِ الْبَرَاءِ وَاللهُ أَعْلَمُ وَرُوِّينَا هَذِهِ الْقِصَّةُ أَيْضًا عَنْ مُحَمَّدِ بْنِ نَافِعِ بْنِ عُجَيْرٍ عَنْ أَبِيهِ عَنْ عَلِيِّ بْنِ أَبِي طَالِبٍ ؓ
[Machine] Ja'far, I deserve her more than you do, for her aunt is with me," so the Messenger of Allah ﷺ said, "As for the young girl, I will give her to Ja'far, for her aunt is with him, and indeed the aunt is like a mother."
جَعْفَرٌ ؓ أَنَا أَحَقُّ بِهَا فَإِنَّ خَالَتَهَا عِنْدِي فَقَالَ رَسُولُ اللهِ ﷺ أَمَّا الْجَارِيَةُ فَأَقْضِي بِهَا لِجَعْفَرٍ فَإِنَّ خَالَتَهَا عِنْدَهُ وَإِنَّمَا الْخَالَةُ أُمٌّ هَكَذَا حَدَّثَنَاهُ وَكَذَلِكَ
49.16 [Machine] The Assembly of the Mamluk Financial Expenditure Gates.
٤٩۔١٦ جُمَّاعُ أَبْوَابِ نَفَقَةِ الْمَمَالِيكِ
49.17 [Machine] What is owed by the owner of the slave from the food and clothing of the slave
٤٩۔١٧ بَابُ مَا عَلَى مَالِكِ الْمَمْلُوكِ مِنْ طَعَامِ الْمَمْلُوكِ وَكِسْوَتِهِ
[Machine] "From the Messenger of Allah, ﷺ , that he said to a slave, his food and clothing are his responsibilities, and he should not be burdened with work that he cannot bear."
عَنْ رَسُولِ اللهِ ﷺ أَنَّهُ قَالَ لِلْمَمْلُوكِ طَعَامُهُ وَكِسْوَتُهُ وَلَا يُكَلَّفُ مِنَ الْعَمَلِ مَا لَا يُطِيقُ
It is essential to feed the slave, clothe him (properly) and not burden him with work which is beyond his power. (Using translation from Muslim 1662)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لِلْمَمْلُوكِ طَعَامُهُ وَكِسْوَتُهُ بِالْمَعْرُوفِ وَلَا يُكَلَّفُ مِنَ الْعَمَلِ إِلَّا مَا يُطِيقُ
[Machine] The Messenger of Allah ﷺ said, "It is sufficient for a believer to be sinful if he withholds the livelihood of someone who is under his authority."
وَقَالَ قَالَ رَسُولُ اللهِ ﷺ كَفَى بِالْمُؤْمِنِ إِثْمًا أَنْ يَحْبِسَ عِنْدَهُ عَمَّنْ يَمْلِكُ قُوتَهُ
49.18 [Machine] What is mentioned in the settlement of the owner between his food and the food of his servant, and between his clothing and the clothing of his servant.
٤٩۔١٨ بَابُ مَا جَاءَ فِي تَسْوِيَةِ الْمَالِكِ بَيْنَ طَعَامِهِ وَطَعَامِ رَقِيقِهِ، وَبَيْنَ كَسَوْتِهِ وَكِسْوَةِ رَقِيقِهِ
[Machine] We met Abu Dharr wearing a robe, and his servant was wearing a similar one. A man said to him, "O Abu Dharr, if you took this robe from your servant and wore it, it would be elegant, and you could dress your servant in another robe." Abu Dharr said, "Indeed, the Messenger of Allah ﷺ said, 'They are your brothers, Allah has put them under your care. So whoever's brother is under his care, let him feed him from what he eats, and let him dress him with what he wears, and do not burden him with what overwhelms him. If you give him a task, then help him.'" This hadith is narrated in Sahih from the hadith of Al-A'mash.
لَقِينَا أَبَا ذَرٍّ بِالرَّبَذَةِ عَلَيْهِ ثَوْبٌ وَعَلَى غُلَامِهِ مِثْلُهُ فَقَالَ لَهُ رَجُلٌ يَا أَبَا ذَرٍّ لَوْ أَخَذْتَ هَذَا الثَّوْبَ مِنْ غُلَامِكَ فَلَبِسْتَهُ فَكَانَتْ حُلَّةً وَكَسَوْتَ غُلَامَكَ ثَوْبًا آخَرَ فَقَالَ إِنَّ رَسُولَ اللهِ ﷺ قَالَ هُمْ إِخْوَانُكُمْ جَعَلَهُمُ اللهُ تَحْتَ أَيْدِيكُمْ فَمَنْ كَانَ أَخُوهُ تَحْتَ يَدَيْهِ فَلْيُطْعِمْهُ مِمَّا يَأْكُلُ وَلْيَكْسُهُ مِمَّا يَلْبَسُ وَلَا يُكَلِّفْهُ مَا يَغْلِبُهُ فَإِنْ كَلَّفَهُ فَلْيُعِنْهُ أَخْرَجَاهُ فِي الصَّحِيحِ مِنْ حَدِيثِ الْأَعْمَشِ
قَدِمْنَا الرَّبَذَةَ فَأَتَيْنَا أَبَا ذَرٍّ فَإِذَا عَلَيْهِ حُلَّةٌ وَإِذَا عَلَى غُلَامِهِ أُخْرَى قَالَ فَقُلْنَا لَوْ كَسَوْتَ غُلَامَكَ غَيْرَ هَذَا وَجَمَعْتَ بَيْنَهُمَا فَكَانَتْ حُلَّةً قَالَ فَقَالَ سَأُحَدِّثُكُمْ عَنْ هَذَا إِنِّي سَابَبْتُ رَجُلًا وَكَانَتْ أُمُّهُ أَعْجَمِيَّةً فَنِلْتُ مِنْهَا فَأَتَى رَسُولَ اللهِ ﷺ فَشَكَانِي إِلَيْهِ فَقَالَ لِي أَسَابَبْتَ فُلَانًا قُلْتُ نَعَمْ قَالَ فَهَلْ ذَكَرْتَ أُمَّهُ؟ فَقُلْتُ مَنْ يُسَابِبِ الرِّجَالَ ذُكِرَ أَبُوهُ وَأُمُّهُ يَا رَسُولَ اللهِ قَالَ إِنَّكَ امْرُؤٌ فِيكَ جَاهِلِيَّةٌ قَالَ قُلْتُ عَلَى سَاعَتِي مِنَ الْكِبْرِ؟ قَالَ نَعَمْ إِنَّمَا هُمْ إِخْوَانُكُمْ جَعَلَهُمُ اللهُ تَحْتَ أَيْدِيكُمْ فَمَنْ كَانَ أَخُوهُ تَحْتَ يَدِهِ فَلْيُطْعِمْهُ مِنْ طَعَامِهِ وَلْيُلْبِسْهُ مِنْ لِبَاسِهِ وَلَا يُكَلِّفْهُ مَا يَغْلِبُهُ فَإِنْ كَلَّفَهُ مَا يَغْلِبُهُ فَلْيُعِنْهُ عَلَيْهِ
I saw Abu Dhar Al-Ghifari wearing a cloak, and his slave, too, was wearing a cloak. We asked him about that (i.e. how both were wearing similar cloaks). He replied, "Once I abused a man and he complained of me to the Prophet ﷺ . The Prophet ﷺ asked me, 'Did you abuse him by slighting his mother?' He added, 'Your slaves are your brethren upon whom Allah has given you authority. So, if one has one's brethren under one's control, one should feed them with the like of what one eats and clothe them with the like of what one wears. You should not overburden them with what they cannot bear, and if you do so, help them (in their hard job). (Using translation from Bukhārī 2545)
إِنِّي سَابَبْتُ رَجُلًا فَشَكَانِي إِلَى رَسُولِ اللهِ ﷺ فَقَالَ لِي رَسُولُ اللهِ ﷺ أَعَيَّرْتَهُ بِأُمِّهِ؟ ثُمَّ قَالَ لِي إِنَّ إِخْوَانَكُمْ جَعَلَهُمُ اللهُ تَحْتَ أَيْدِيكُمْ فَمَنْ كَانَ أَخُوهُ تَحْتَ يَدِهِ فَلْيُطْعِمْهُ مِمَّا يَأْكُلُ وَلْيُلْبِسْهُ مِمَّا يَلْبَسُ وَلَا تُكَلِّفُوهُمْ مَا يَغْلِبُهُمْ فَإِنْ كَلَّفْتُمُوهُمْ مَا يَغْلِبُهُمْ فَأَعِينُوهُمْ عَلَيْهِ
The Prophet ﷺ said: Feed those of your slaves who please you from what you eat and clothe them with what you clothe yourselves, but sell those who do not please you and do not punish Allah's creatures. (Using translation from Abū Dāʾūd 5161)
قَالَ رَسُولُ اللهِ ﷺ مَنْ لَايَمَكُمْ مِنْ مَمْلُوكِيكُمْ فَأَطْعِمُوهُ مِمَّا تَأْكُلُونَ وَاكْسُوهُ مِمَّا تَكْتَسُونَ وَمَنْ لَمْ يُلَايِمْكُمْ مِنْهُمْ فَبِيعُوهُ وَلَا تُعَذِّبُوا خَلْقَ اللهِ
[Machine] The Prophet ﷺ said, "His expenditure and clothing should be according to what is customary, and what is customary for us is considered customary for someone similar to him in his country where he resides."
قَالَ النَّبِيُّ ﷺ نَفَقَتُهُ وَكِسْوَتُهُ بِالْمَعْرُوفِ وَالْمَعْرُوفُ عِنْدَنَا الْمَعْرُوفُ لِمِثْلِهِ فِي بَلَدِهِ الَّذِي يَكُونُ بِهِ
[Machine] The Messenger of Allah ﷺ said, "When the servant of any one of you brings him food, he should make him sit with him. If he does not do so, then he should give him a morsel or two. For indeed, he is his companion in smoke and heat."
قَالَ رَسُولُ اللهِ ﷺ إِذَا جَاءَ خَادِمُ أَحَدِكِمْ بِطَعَامِهِ فَلْيُجْلِسْهُ مَعَهُ فَإِنْ لَمْ يَفْعَلْ فَلْيُنَاوِلْهُ أُكْلَةً أَوْ أُكْلَتَيْنِ؛ فَإِنَّهُ وَلِيَ دُخَانَهُ وَحَرَّهُ
49.19 [Machine] What should a slave owner who follows his food do?
٤٩۔١٩ بَابُ مَا يَنْبَغِي لِمَالِكِ الْمَمْلُوكِ الَّذِي يَلِي طَعَامَهُ أَنْ يَفْعَلَهُ
[Machine] P: The Prophet ﷺ said, "When a servant of yours prepares food and brings it to you, having cooked it and smoked it, let him sit with you and eat. If the food is not sufficient, he should put a morsel or two in his hand." Dawud bin Qais said, "The 'morsel' is a small mouthful."
عَنِ النَّبِيِّ ﷺ أَنَّهُ قَالَ إِذَا صَنَعَ خَادِمُ أَحَدِكِمْ لَهُ طَعَامًا فَجَاءَ بِهِ قَدْ وَلِيَ حَرَّهُ وَدُخَانَهُ فَلْيُقْعِدْهُ مَعَهُ فَلْيَأْكُلْ فَإِنْ كَانَ الطَّعَامُ مَشْفُوهًا قَلِيلًا فَلْيَضَعْ فِي يَدِهِ أُكْلَةً أَوْ أُكْلَتَيْنِ قَالَ دَاوُدُ بْنُ قَيْسٍ الْأُكْلَةُ اللُّقْمَةُ
[Machine] That the Messenger of Allah ﷺ said: "When one of you finishes his servant's food and drink, he should dismiss him and have him sit. If he refuses, then he should feed him a morsel and give it to him, or give him a word that carries the same meaning."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ إِذَا كَفَى أَحَدَكُمْ خَادِمُهُ طَعَامَهُ حَرَّهُ وَدُخَانَهُ فَلْيَدْعُهُ فَلْيُجْلِسْهُ فَإِنْ أَبَى فَلْيُرَوِّغْ لَهُ لُقْمَةً فَلْيُنَاوِلْهُ إِيَّاهَا أَوْ يُعْطِهِ إِيَّاهَا أَوْ كَلِمَةً هَذَا مَعْنَاهَا
49.20 [Machine] Slaves are not burdened with work beyond their capacity, and the proven narration in this regard is in the past.
٤٩۔٢٠ بَابُ لَا يُكَلَّفُ الْمَمْلُوكُ مِنَ الْعَمَلِ إِلَّا مَا يُطِيقُ الدَّوَامَ عَلَيْهِ قَدْ مَضَى الْحَدِيثُ الْمُسْنَدُ فِي هَذَا
It is essential to feed the slave, clothe him (properly) and not burden him with work which is beyond his power. (Using translation from Muslim 1662)
قَالَ رَسُولُ اللهِ ﷺ لِلْمَمْلُوكِ طَعَامُهُ وَكِسْوَتُهُ وَلَا يُكَلَّفُ مِنَ الْعَمَلِ مَا لَا يُطِيقُ
49.21 [Machine] What is forbidden in regard to earning from the people if it is not in a lawful and righteous manner
٤٩۔٢١ بَابُ مَا جَاءَ فِي النَّهْيِ عَنْ كَسْبِ الْأَمَةِ إِذَا لَمْ تَكُنْ فِي عَمَلٍ وَاصِبٍ
[Machine] The Messenger of Allah ﷺ prohibited the exploitation of slaves unless they have a specific skill or a well-known profession. This narration was reported by Ali ibn al-Ja'd from al-Zinji ibn Khalid from Haram ibn Uthman from Abu Atiq from Jabir in a raised hadith.
نَهَى رَسُولُ اللهِ ﷺ عَنْ كَسْبِ الْأَمَةِ إِلَّا أَنْ يَكُونَ لَهَا عَمَلٌ وَاصِبٌ أَوْ كَسْبٌ يُعْرَفُ وَجْهُهُ وَرَوَاهُ عَلِيُّ بْنُ الْجَعْدِ عَنِ الزَّنْجِيِّ بْنِ خَالِدٍ عَنْ حَرَامِ بْنِ عُثْمَانَ عَنْ أَبِي عَتِيقٍ عَنْ جَابِرٍ مَرْفُوعًا
[Machine] From the narration of Thawri, it is weak ascribed to Uthman.
عَنْ عُثْمَانَ ؓ مِنْ حَدِيثِ الثَّوْرِيِّ وَرَفْعُهُ ضَعِيفٌ
49.22 [Machine] The servant's contentment with his earnings
٤٩۔٢٢ بَابُ مُخَارَجَةِ الْعَبْدِ بِرِضَاهُ إِذَا كَانَ لَهُ كَسْبٌ
[Machine] "Abu Taybah, the Messenger of Allah ﷺ, measured his portion and gave him two or a saa's worth of dates, and instructed his family to reduce their share of his dues."
حَجَمَ أَبُو طَيْبَةَ رَسُولَ اللهِ ﷺ فَأَعْطَاهُ صَاعَيْنِ أَوْ صَاعًا مِنْ تَمْرٍ وَأَمَرَ أَهْلَهُ أَنْ يُخَفِّفُوا عَنْهُ مِنْ خَرَاجِهِ
[Machine] Zubayr ibn al-Awwam had a thousand slaves who paid him tribute, but he did not allow any of their tributes to enter his house.
كَانَ لِلزُّبَيْرِ بْنِ الْعَوَّامِ ؓ أَلْفُ مَمْلُوكٍ يُؤَدِّي إِلَيْهِ الْخَرَاجَ فَلَا يُدْخِلُ بَيْتَهُ مِنْ خَرَاجِهِمْ شَيْئًا
[Machine] My master used to give me a dirham every day, so I went to Abu Hurairah and he said, "Fear Allah and fulfill the rights of Allah and the rights of your master."
ضَرَبَ عَلَيَّ مَوْلَايَ كُلَّ يَوْمٍ دِرْهَمًا فَأَتَيْتُ أَبَا هُرَيْرَةَ فَقَالَ اتَّقِ اللهَ وَأَدِّ حَقَّ اللهِ وَحَقَّ مَوْلَاكَ
49.23 [Machine] Prohibition of earning wrongdoing.
٤٩۔٢٣ بَابُ النَّهْيِ عَنْ كَسْبِ الْبَغِيِّ
[Machine] "The Messenger of Allah ﷺ prohibited them from the price of the dog, the dowry of a rebellious woman, and the earnings of a fortune-teller. Except that Yunus said in the narration three things that are invalid. This was reported in the authentic Hadith from the narration of Malik and also reported by Muslim from the narration of Layth."
أَنَّ رَسُولَ اللهِ ﷺ نَهَاهُمْ عَنْ ثَمَنِ الْكَلْبِ وَمَهْرِ الْبَغِيِّ وَحُلْوَانِ الْكَاهِنِ إِلَّا أَنَّ يُونُسَ قَالَ فِي الْحَدِيثِ ثَلَاثَةٌ هُنَّ سُحْتٌ أَخْرَجَاهُ فِي الصَّحِيحِ مِنْ حَدِيثِ مَالِكٍ وَأَخْرَجَهُ مُسْلِمٌ مِنْ حَدِيثِ اللَّيْثِ
[Machine] It is said that her name was Ummaymah, and he intended to force them into committing adultery. So they complained about this to the Prophet ﷺ, and Allah ﷻ revealed the verse {And do not compel your maidens to prostitution} [An-Nur 33] until His saying {Forgiving and Merciful} [Al-Baqarah 173].
يُقَالُ لَهَا أُمَيْمَةُ وَكَانَ يُرِيدُهُمَا عَلَى الزِّنَا فَشَكَتَا ذَلِكَ إِلَى النَّبِيِّ ﷺ فَأَنْزَلَ اللهُ ﷻ {وَلَا تُكْرِهُوا فَتَيَاتِكُمْ عَلَى الْبِغَاءِ} [النور 33] إِلَى قَوْلِهِ {غَفُورٌ رَحِيمٌ} [البقرة 173]
[Machine] Abu Ubaid is forgiven for them, not for the master.
أَبُو عُبَيْدٍ فَالْمَغْفِرَةُ لَهُنَّ لَا لِلْمَوْلَى
لَهُنَّ وَاللهِ لَهُنَّ وَاللهِ
Mu’tamir reported on the authority of his father Sa’id bin Al Hassan explain the Qur’anic verse “But if anyone compels them, yet after such compulsion is Allaah oft-forgiving most merciful(to them), said Allaah is oft-forgiving to those (slave girls) who were compelled (to prostitution) (Using translation from Abū Dāʾūd 2312)
عَنْ أَبِيهِ {وَمَنْ يُكْرِهْهُنَّ فَإِنَّ اللهَ مِنْ بَعْدِ إِكْرَاهِهِنَّ غَفُورٌ رَحِيمٌ} [النور 33] قَالَ سَعِيدُ بْنُ أَبِي الْحَسَنِ غَفُورٌ لَهُنَّ الْمُكْرَهَاتِ
49.24 [Machine] The context of the intensification and mistreatment of the Mamluks and their slander
٤٩۔٢٤ بَابُ سِيَاقِ مَا وَرَدَ مِنَ التَّشْدِيدِ فِي ضَرْبِ الْمَمَالِيكِ وَالْإِسَاءَةِ إِلَيْهِمْ وَقَذْفِهِمْ
I was beating my slave with a whip when I heard a voice behind me: Understand, Abu Masud; but I did not recognise the voice due to intense anger. He (Abu Mas'ud) reported: As he came near me (I found) that he was the Messenger of Allah ﷺ and he was saying: Bear in mind, Abu Mas'ud; bear in mind. Abu Mas'ud. He (Aba Maslad) said: threw the whip from my hand. Thereupon he (the Holy Prophet) said: Bear in mind, Abu Mas'ud; verily Allah has more dominance upon you than you have upon your slave. I (then) said: I would never beat my servant in future. (Using translation from Muslim 1659a)
فَسَمِعْتُ صَوْتًا مِنْ خَلْفِي اعْلَمْ أَبَا مَسْعُودٍ فَلَمْ أَفْهَمِ الصَّوْتَ مِنَ الْغَضَبِ فَقَالَ اعْلَمْ أَبَا مَسْعُودٍ فَلَمَّا دَنَا مِنِّي إِذَا هُوَ رَسُولُ اللهِ ﷺ فَقَالَ اعْلَمْ أَبَا مَسْعُودٍ أَنَّ اللهَ ﷻ أَقْدَرُ عَلَيْكَ مِنْكَ عَلَى هَذَا الْغُلَامِ فَأَلْقَيْتُ السَّوْطَ مِنْ يَدِي وَقُلْتُ لَا أَضْرِبُ غُلَامًا بَعْدَ الْيَوْمِ أَبَدًا
when I was beating a servant of mine, I heard a voice behind me saying: know, Abu Mas’ud-Ibn al-Muthanna said: “twice”-that Allah has more power over you than you have over him. I turned round and saw that it was that it was the prophet (May peace be upon him). I said : Messenger of Allah! He is free for Allah’s sake. He said : If you had not done it, fire would have burned you or the fire would have touched you. (Using translation from Abū Dāʾūd 5159)
فَسَمِعْتُ مِنْ خَلْفِي صَوْتًا اعْلَمْ أَبَا مَسْعُودٍ اعْلَمْ أَبَا مَسْعُودٍ اعْلَمْ أَبَا مَسْعُودٍ لَلَّهُ أَقْدَرُ عَلَيْكَ مِنْكَ عَلَيْهِ فَالْتَفَتُ فَإِذَا هُوَ النَّبِيُّ ﷺ فَقُلْتُ يَا رَسُولَ اللهِ هُوَ حُرٌّ لِوَجْهِ اللهِ قَالَ أَمَا لَوْ لَمْ تَفْعَلْ لَلَفَعَتْكَ النَّارُ أَوْ لَمَسَّتْكَ النَّارُ
[Machine] What reward do I have in it that is worth the same? Then he said, I heard the Messenger of Allah ﷺ say, "Whoever slaps his slave or beats him, the expiation for him is to set him free."
مَا لِي فِيهِ مِنَ الْأَجْرِ مَا يُسَاوِي ذَا ثُمَّ قَالَ سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَنْ لَطَمَ مَمْلُوكَهُ أَوْ ضَرَبَهُ حَدًّا لَمْ يَأْتِهِ فَكَفَّارَتُهُ أَنْ يَعْتِقَهُ
