The Prophet ﷺ said: An orphan virgin girl should be consulted about herself; if she says nothing that indicates her permission, but if she refuses, the authority of the guardian cannot be exercised against her will.

قَالَ رَسُولُ اللَّهِ ﷺ تُسْتَأْمَرُ الْيَتِيمَةُ فِي نَفْسِهَا فَإِنْ سَكَتَتْ فَهُوَ إِذْنُهَا وَإِنْ أَبَتْ فَلاَ جَوَازَ عَلَيْهَا وَالإِخْبَارُ فِي حَدِيثِ يَزِيدَ

"A previously married woman has more right to decide about herself (with regard to marriage) than her guardian, and a virgin should be asked for permission with regard to marriage, and her permission is her silence."

أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ الأَيِّمُ أَحَقُّ بِنَفْسِهَا مِنْ وَلِيِّهَا وَالْبِكْرُ تُسْتَأْذَنُ فِي نَفْسِهَا وَإِذْنُهَا صُمَاتُهَا

"A previously married woman has more right (to decide) about herself (with regard to marriage) than her guardian, and an orphan girl should be consulted with regard to marriage, and her permission is her silence."

أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ الأَيِّمُ أَوْلَى بِأَمْرِهَا وَالْيَتِيمَةُ تُسْتَأْمَرُ فِي نَفْسِهَا وَإِذْنُهَا صُمَاتُهَا

"A previously married woman has more right (to decide) about herself (with regard to marriage), and a virgin should be consulted by her father, and her permission is her silence."

أَنَّ النَّبِيَّ ﷺ قَالَ الثَّيِّبُ أَحَقُّ بِنَفْسِهَا وَالْبِكْرُ يَسْتَأْمِرُهَا أَبُوهَا وَإِذْنُهَا صُمَاتُهَا

"The Messenger of Allah said: 'An orphan girl should be consulted with regard to marriage, and if she remains silent, that is her permission. If she refuses then she is not to be forced.'"

قَالَ رَسُولُ اللَّهِ ﷺ تُسْتَأْمَرُ الْيَتِيمَةُ فِي نَفْسِهَا فَإِنْ سَكَتَتْ فَهُوَ إِذْنُهَا وَإِنْ أَبَتْ فَلاَ جَوَازَ عَلَيْهَا

قَالَ رَسُولُ اللَّهِ ﷺ «تُسْتَأْمَرُ الْيَتِيمَةُ فِي نَفْسِهَا فَإِنْ سَكَتَتْ فَقَدْ أَذِنَتْ وَإِنْ أَبَتْ لَمْ تُكْرَهْ»

"A previously married woman has more right (to decide) about herself (with regard to marriage) than her guardian, and an orphan girl should be consulted with regard to marriage, and her permission is her silence." (Using translation from Nasāʾī 3262)

أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «الْأَيِّمُ أَمْلَكُ بِأَمْرِهَا مِنْ وَلِيِّهَا وَالْبِكْرُ تُسْتَأْمَرُ فِي نَفْسِهَا وَصَمْتُهَا إِقْرَارُهَا»

Ibn ‘Abbas reported the Apostle of Allaah ﷺ as saying “A woman without a husband has more right to her person than her guardian and a virgin’s permission must be asked, her permission being her silence. These are the words of Al Qa’nabi. (Using translation from Abū Dāʾūd 2098)

قَالَ رَسُولُ اللهِ ﷺ الْأَيِّمُ أَحَقُّ بِنَفْسِهَا مِنْ وَلِيِّهَا وَالْبِكْرُ تُسْتَأْمَرُ فِي نَفْسِهَا وَإِذْنُهَا صُمَاتُهَا

"A previously married woman has more right (to decide) about herself (with regard to marriage) than her guardian, and an orphan girl should be consulted with regard to marriage, and her permission is her silence." (Using translation from Nasāʾī 3262)

أَنَّ رَسُولَ اللهِ ﷺ قَالَ الْأَيِّمُ أَوْلَى بِأَمْرِهَا وَالْيَتِيمَةُ تُسْتَأْمَرُ فِي نَفْسِهَا وَإِذْنُهَا صُمَاتُهَا

[AI] From the Messenger of Allah, ﷺ , that he said: "The widow has more control over her affairs than her guardian, and the virgin seeks permission in herself, and her silence is her consent."

عَنْ رَسُولِ اللهِ ﷺ أَنَّهُ قَالَ الْأَيِّمُ أَمْلَكُ بِأَمْرِهَا مِنْ وَلِيِّهَا وَالْبِكْرُ تُسْتَأْمَرُ فِي نَفْسِهَا وَصُمَاتُهَا إِقْرَارُهَا

The Prophet ﷺ said: A guardian has no concern with a woman previously married and has no husband, and an orphan girl (i.e. virgin) must be consulted, her silence being her acceptance. (Using translation from Abū Dāʾūd 2100)

أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَيْسَ لِلوَلِيِّ مَعَ الثَّيِّبِ أَمْرٌ وَالْيَتِيمَةُ تُسْتَأْمَرُ فَصَمْتُهَا إِقْرَارُهَا

[AI] The Messenger of Allahﷺ said: The widow has more right to her own self than her guardian, and the virgin woman should seek permission regarding herself, and her silence is considered as her consent.

قَالَ رَسُولُ اللهِ ﷺ الْأَيِّمُ أَوْلَى بِنَفْسِهَا مِنْ وَلِيِّهَا وَالْبِكْرُ تُسْتَأْمَرُ فِي نَفْسِهَا وَصَمْتُهَا إِقْرَارُهَا

[AI] The Messenger of Allah (peace and blessings be upon him) said: A widow has a greater right over herself than her guardian, and a virgin seeks permission for herself, and her silence is her acceptance.

قَالَ رَسُولُ اللهِ ﷺ الْأَيِّمُ أَوْلَى بِنَفْسِهَا مِنْ وَلِيِّهَا وَالْبِكْرُ تُسْتَأْمَرُ فِي نَفْسِهَا وَصَمْتُهَا إِقْرَارُهَا

[AI] That he proposed to a relative of his for his daughter. He said: The mother of the woman desired Ibn ʿUmar, while her father desired an orphan of his. So the father married her to that orphan of his. Then she came to the Prophet ﷺ and mentioned that to him, and the Prophet ﷺ said: “Let women have a say regarding their daughters.”

أَنَّهُ خَطَبَ إِلَى نَسِيبٍ لَهُ ابْنَتَهُ قَالَ فَكَانَ هَوَى أُمِّ الْمَرْأَةِ فِي ابْنِ عُمَرَ وَكَانَ هَوَى أَبِيهَا فِي يَتِيمٍ لَهُ قَالَ فَزَوَّجَهَا الْأَبُ يَتِيمَهُ ذَلِكَ فَجَاءَتْ إِلَى النَّبِيِّ ﷺ فَذَكَرَتْ ذَلِكَ لَهُ فَقَالَ النَّبِيُّ ﷺ أَمِّرُوا النِّسَاءَ فِي بَنَاتِهِنَّ

"The Messenger of Allah said: 'An orphan girl should be consulted with regard to marriage, and if she remains silent, that is her permission. If she refuses then she is not to be forced.'" (Using translation from Nasāʾī 3270)

"The Messenger of Allah said: 'An orphan girl should be consulted with regard to marriage, and if she remains silent, that is her permission. If she refuses then she is not to be forced.'" (Using translation from Nasāʾī 3270)

قَالَ رَسُولُ اللهِ ﷺ تُسْتَأْمَرُ الْيَتِيمَةُ فِي نَفْسِهَا فَإِنْ سَكَتَتْ فَقَدْ أَذِنَتْ وَإِنْ أَبَتْ لَمْ تُكْرَهْ

[AI] The orphan girl is being ordered within herself, so if she remains silent, then she has agreed, and if she refuses, then she should not be married.

تُسْتَأْمَرُ الْيَتِيمَةُ فِي نَفْسِهَا فَإِنْ سَكَتَتْ فَقَدْ أَذِنَتْ وَإِنْ أَبَتْ فَلَا تُزَوَّجْ

[AI] The Messenger of Allah ﷺ said, "The orphan girl is consulted regarding herself. If she remains silent, it is permission. And if she refuses, she is not forced." I said to Yunus, "Did you hear this from him, or did you hear it from Abu Burdah?" He said, "Yes."

قَالَ رَسُولُ اللهِ ﷺ تُسْتَأْمَرُ الْيَتِيمَةُ فِي نَفْسِهَا فَإِنْ سَكَتَتْ فَقَدْ أَذِنَتْ وَإِنْ أَنْكَرَتْ لَمْ تُكْرَهْ قُلْتُ لِيُونُسَ سَمِعْتَهُ مِنْهُ أَوْ سَمِعْتَهُ مِنْ أَبِي بُرْدَةَ قَالَ نَعَمْ

Malik related to me from Abdullah ibn al-Fadl from Nafi ibn Jubayr ibn Mutim from Abdullah ibn Abbas that the Messenger of Allah ﷺ said, "A woman who has been previously married is more entitled to her person than her guardian, and a virgin must be asked for her consent for herself, and her consent is her silence "

أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ الأَيِّمُ أَحَقُّ بِنَفْسِهَا مِنْ وَلِيِّهَا وَالْبِكْرُ تُسْتَأْذَنُ فِي نَفْسِهَا وَإِذْنُهَا صُمَاتُهَا

[AI] The Prophet ﷺ heard saying, "The orphan girl is consulted regarding herself. If she remains silent, it is her consent. And if she disagrees, no compulsion is on her."

سَمِعَ النَّبِيَّ ﷺ يَقُولُ «تُسْتَأْمَرُ الْيَتِيمَةُ فِي نَفْسِهَا فَإِنْ سَكَتَتْ فَهُوَ رِضَاهَا وَإِنْ كَرِهَتْ فَلَا كُرْهَ عَلَيْهَا»

"The Messenger of Allah said: 'An orphan girl should be consulted with regard to marriage, and if she remains silent, that is her permission. If she refuses then she is not to be forced.'" (Using translation from Nasāʾī 3270)

عَنْ رَسُولِ اللَّهِ ﷺ قَالَ «تُسْتَأْمَرُ الْيَتِيمَةُ فِي نَفْسِهَا فَإِنْ سَكَتَتْ فَهُوَ رِضَاهَا وَإِنَّ أَبَتْ فَلَا جَوَازَ عَلَيْهَا»

"The Messenger of Allah said: 'An orphan girl should be consulted with regard to marriage, and if she remains silent, that is her permission. If she refuses then she is not to be forced.'" (Using translation from Nasāʾī 3270)

قَالَ رَسُولُ اللَّهِ ﷺ «تُسْتَأْمَرُ الْيَتِيمَةُ فِي نَفْسِهَا فَإِنْ سَكَتَتْ فَقَدْ أَذِنَتْ وَإِنْ أَبَتْ لَمْ تُكْرَهْ»

عَنِ النَّبِيِّ ﷺ قَالَ تُسْتَأْمَرُ الْيَتِيمَةُ فِي نَفْسِهَا فَإِنْ سَكَتَتْ فَقَدْ أَذِنَتْ وَإِنْ كَرِهَتْ فَلَا كُرْهَ عَلَيْهَا وَلَا جَوَازَ عَلَيْهَا

عَنِ النَّبِيِّ ﷺ قَالَ تُسْتَأْمَرُ الْيَتِيمَةُ فِي نَفْسِهَا فَإِنْ سَكَتَتْ فَقَدْ أَذِنَتْ وَإِنْ كَرِهَتْ فَلَا كُرْهَ عَلَيْهَا

عَن النَّبِيّ ﷺ قال تستأمر اليتيمة في نفسها فإن صمتت فهو إذنها أو إذن منها

قَالَ قَالَ رَسُول اللهِ ﷺ اليتيمة تستأمر في نفسها فإن سكتت فهو إذنها فإن أبت فلا جواز عليها

قَالَ قَالَ رَسُول اللهِ ﷺ تستأمر اليتيمة في نفسها فإن سكتت فهو إذنها وَإن أبت فلا جواز عليها

[AI] The Messenger of Allah ﷺ said, "The divorced woman has more right over herself than her guardian, and the virgin is to be asked for her consent, and her silence is considered as consent."

قَالَ رَسُولُ اللهِ ﷺ «الثَّيِّبُ أَحَقُّ بِنَفْسِهَا مِنْ وَلِيِّهَا وَالْبِكْرُ تُسْتَأْمَرُ وَصَمْتُهَا إِقْرَارُهَا»

A woman without a husband has more right to her person than her guardian, and a virgin's consent must be asked from her, and her silence implies her consent. (Using translation from Muslim 1421a)

أَنَّ رَسُولَ اللهِ ﷺ قَالَ «الْأَيِّمُ أَحَقُّ بِنَفْسِهَا مِنْ وَلِيِّهَا وَالْبِكْرُ تُسْتَأْذَنُ فِي نَفْسِهَا وَإِذْنُهَا صُمَاتُهَا»

[AI] The Prophet ﷺ said, "The widow has more right to her own self than her guardian, and the orphaned girl should be consulted and her consent sought for her marriage."

أَنَّ النَّبِيَّ ﷺ قَالَ «الْأَيِّمُ أَحَقُّ بِنَفْسِهَا مِنْ وَلِيِّهَا وَالْيَتِيمَةُ تُسْتَأْمَرُ وَإِذْنُهَا صُمَاتُهَا»

"A previously married woman has more right (to decide) about herself (with regard to marriage) than her guardian, and an orphan girl should be consulted with regard to marriage, and her permission is her silence." (Using translation from Nasāʾī 3262)

أَنَّ رَسُولَ اللهِ ﷺ قَالَ «الْأَيِّمُ أَوْلَى بِأَمْرِهَا وَالْيَتِيمَةُ تُسْتَأْمَرُ فِي نَفْسِهَا وَإِذْنُهَا صُمَاتُهَا»

The Prophet ﷺ said: An orphan virgin girl should be consulted about herself; if she says nothing that indicates her permission, but if she refuses, the authority of the guardian cannot be exercised against her will. The full information rest with the tradition narrated by Yazid. Abu Dawud said: This tradition has also been transmitted in a similar way by Abu Khalid Sulaiman b. Hayyan and Mu'adh b. قَالَ رَسُولُ اللهِ ﷺ تُسْتَأْمَرُ الْيَتِيمَةُ فِي نَفْسِهَا فَإِنْ سَكَتَتْ فَهُوَ إِذْنُهَا وَإِنْ أَبَتْ فَلَا جَوَازَ عَلَيْهَا

[AI] The Messenger of Allah ﷺ said: "The orphan girl is to be consulted regarding herself. If she remains silent, it has been accepted from her, and if she refuses, she should not be compelled."

قَالَ رَسُولُ اللهِ ﷺ تُسْتَأْمَرُ الْيَتِيمَةُ فِي نَفْسِهَا فَإِنْ سَكَتَتْ فَقَدْ أَذِنَتْ وَإِنْ أَنْكَرَتْ لَمْ تُكْرَهْ

[AI] The Messenger of Allah ﷺ said: "The orphan girl is consulted regarding herself, so if she remains silent, then it is her consent. But if she refuses, then it is not permissible for her." Abu Dawood said about the narration of Yazid: "And it is the same."

قَالَ رَسُولُ اللهِ ﷺ تُسْتَأْمَرُ الْيَتِيمَةُ فِي نَفْسِهَا فَإِنْ سَكَتَتْ فَهُوَ إِذْنُهَا وَإِنْ أَبَتْ فَلَا جَوَازَ عَلَيْهَا وَقَالَ أَبُو دَاوُدَ الْأَخْبَارُ فِي حَدِيثِ يَزِيدَ قَالَ وَكَذَلِكَ

[AI] The Prophet ﷺ heard saying: "Permission is sought for a young orphan in regards to herself. If she remains silent, it is deemed as consent. And if she dislikes it, she is not to be forced."

سَمِعَ النَّبِيَّ ﷺ يَقُولُ تُسْتَأْمَرُ الْيَتِيمَةُ فِي نَفْسِهَا فَإِنْ سَكَتَتْ فَهُوَ رِضًى وَإِنْ كَرِهَتْ فَلَا كُرْهَ عَلَيْهَا

[AI] "On the authority of Ursa bin Amira Al-Kindi, a man from the companions of the Prophet Muhammad ﷺ , that the Prophet Muhammad ﷺ said, 'Command women with regard to themselves, for a non-virgin woman expresses herself, and the pleasure of a virgin lies in her silence.'"

عَنْ عُرْسِ بْنِ عَمِيرَةَ الْكِنْدِيِّ رَجُلٌ مِنْ أَصْحَابِ النَّبِيِّ ﷺ أَنَّ النَّبِيَّ ﷺ قَالَ وَآمِرُوا النِّسَاءَ فِي أَنْفُسِهِنَّ فَإِنَّ الثَّيِّبَ تُعْرِبُ عَنْ نَفْسِهَا وَالْبِكْرُ رِضَاهَا صَمْتُهَا

[AI] "From the Messenger of Allah, ﷺ , that he said: Consult with women in their affairs. It was said to him, O Messenger of Allah, the virgin feels shy. He said, the widow can express herself, and the virgin's acceptance is her silence, and he did not mention marriage in its chain of narration."

عَنْ رَسُولِ اللهِ ﷺ أَنَّهُ قَالَ شَاوِرُوا النِّسَاءَ فِي أَنْفُسِهِنَّ فَقِيلَ لَهُ يَا رَسُولَ اللهِ إِنَّ الْبِكْرَ تَسْتَحِي قَالَ الثَّيِّبُ تُعْرِبُ عَنْ نَفْسِهَا وَالْبِكْرُ رِضَاهَا صَمْتُهَا وَلَمْ يَذْكُرِ الْعُرْسَ فِي إِسْنَادِهِ

آمِّرُوا النَّساءَ في أَنْفُسِهِنَّ فإنّ الثَّيِّبَ تُعْرِبُ عن نفسِها والبكرَ رضاها صَمْتها".

“Consult the orphan girl about herself, and her consent is her silence.”

"آمِّرُوا الْيَتِيمَةَ في نَفْسِها وإِذْنُها صمَاتُها ".

" اليَتِيمَةُ تُسْتَأمَرُ في نَفْسِهَا، فَإِنْ صَمَتَتْ فَهُوَ إِذنُها، فَإِنْ أَبْتَ فَلَا جَوَازَ عَلَيهَا".

"تُستَأمَرُ اليَتِيمَة في نفْسِهَا؛ فإِنْ سَكَتَتْ، فَهُوَ إِذنهَا، وَإِن أبَتْ فَلَا جَوَازَ عَلَيهَا".

"تُسْتَأمَرُ اليَتِيمَة في نَفْسِهَا، فإِن سَكَتَتْ فَقَدْ أَذِنَت، وإن أَنكَرَتْ، لَم تُزَوَّج".

"تُسْتَأمَرُ اليَتيمَة في نَفْسِهَا، وَصَمْتُهَا: إِقْرَارُهَا".

"شَاوِروا النِّساءَ فِى أَنْفُسِهِن، الثَّيْب تُعْرِبُ عن نَفْسِهَا، والْبِكْر رِضَاها صمْتُها".

"عن الشعبى عن عمر وعلى قالا: تُسْتَأمَرُ الْيَتِيمَةُ فِى نَفْسِهَا، وَرِضَاهَا أَنْ تَسْكُتَ".
