21. Marriage
٢١۔ كِتَابُ النِّكَاحِ
"The Messenger of Allah said: 'An orphan girl should be consulted with regard to marriage, and if she remains silent, that is her permission. If she refuses then she is not to be forced.'" (Using translation from Nasāʾī 3270)
قَالَ رَسُولُ اللهِ ﷺ «تُسْتَأْمَرُ الْيَتِيمَةُ فِي نَفْسِهَا فَإِنْ سَكَتَتْ فَهُوَ إِذْنُهَا وَإِنْ أَبَتْ فَلَا جَوَازَ عَلَيْهَا»
[Machine] My father married me off, but I disliked it and I am still a virgin. So, I complained to the Prophet ﷺ, and he said, "Do not marry her if she dislikes it." Malik ibn Anas disagreed with him in his narration and in his wording.
أَنْكَحَنِي أَبِي وَأَنَا كَارِهَةٌ وَأَنَا بِكْرٌ فَشَكَوْتُ ذَلِكَ لِلنَّبِيِّ ﷺ فَقَالَ «لَا تُنْكِحْهَا وَهِيَ كَارِهَةٌ» خَالَفَهُ مَالِكُ بْنُ أَنَسٍ فِي إِسْنَادِهِ وَفِي لَفْظِهِ
that her father gave her in marriage when she was a matron and she disliked that marriage. So she went to Messenger of Allah ﷺ and he declared that marriage invalid. (Using translation from Bukhārī 5138)
أَنَّ أَبَاهَا زَوَّجَهَا وَهِيَ ثَيِّبٌ فَكَرِهَتْ ذَلِكَ فَأَتَتْ رَسُولَ اللهِ ﷺ فَرَدَّ نِكَاحَهُ
[Machine] A man married off his daughter while she was a virgin without consulting her. So she went to the Prophet ﷺ and he separated them. Abu Hafs, meaning 'Umar ibn Abi Salamah, an-Niyssi narrated to us, saying, I heard al-Awza'e say, Ibrahim ibn Murrah narrated to me from 'Ata' ibn Abi Rabah, who said, a man married off his daughter while she was a virgin, and this is the continuation of the hadith.
أَنَّ رَجُلًا زَوَّجَ ابْنَتَهُ وَهِيَ بِكْرٌ مِنْ غَيْرِ أَمْرِهَا فَأَتَتِ النَّبِيَّ ﷺ «فَفَرَّقَ بَيْنَهُمَا» [176] 5364 أَخْبَرَنَا أَحْمَدُ بْنُ عَبْدِ الْوَاحِدِ الدِّمَشْقِيُّ قَالَ حَدَّثَنَا أَبُو حَفْصٍ يَعْنِي عَمْرَو بْنَ أَبِي سَلَمَةَ التِّنِّيسِيَّ قَالَ سَمِعْتُ الْأَوْزَاعِيَّ قَالَ حَدَّثَنِي إِبْرَاهِيمُ بْنُ مُرَّةَ عَنْ عَطَاءِ بْنِ أَبِي رَبَاحٍ قَالَ زَوَّجَ رَجُلٌ ابْنَتَهُ وَهِيَ بِكْرٌ وَسَاقَ الْحَدِيثَ
[Machine] "A man came to the Prophet ﷺ with his daughter and said, 'This is my daughter, she refuses to get married.' The Prophet ﷺ said, 'Obey your father.' She kept repeating her statement, so he said to her, 'By the One who sent you with the truth, I will not get married until you inform me of the rights of the husband over his wife.' The Prophet ﷺ said, 'The husband's right over his wife is that if he has a wound, she licks it until she fulfills his right.' She then said, 'By the One who sent you with the truth, I will never get married.' The Prophet ﷺ said, 'Do not marry them without their consent.' Abu Abdur-Rahman (i.e., Prophet's companion) said, 'Abu Haroon Al-Abdi, whose hadith is abandoned, and his name is Umara bin Jowain, and Abu Haroon Al-Ghanawi, whose hadith is acceptable, and his name is Ibrahim bin Al-Ala,' and both of them are from the people of Basra."
جَاءَ رَجُلٌ بِابْنَةٍ لَهُ إِلَى النَّبِيِّ ﷺ فَقَالَ هَذِهِ ابْنَتِي أَبَتْ أَنْ تَزَوَّجَ فَقَالَ «أَطِيعِي أَبَاكِ» كُلُّ ذَلِكَ تُرَدِّدُ عَلَيْهِ مَقَالَتَهَا فَقَالَتْ وَالَّذِي بَعَثَكَ بِالْحَقِّ لَا أَتَزَوَّجُ حَتَّى تُخْبِرَنِي مَا حَقُّ الزَّوْجِ عَلَى زَوْجَتِهِ فَقَالَ «حَقُّ الزَّوْجِ عَلَى زَوْجَتِهِ لَوْ كَانَتْ بِهِ قُرْحَةٌ فَلَحَسَتْهَا مَا أَدَّتْ حَقَّهُ» فَقَالَتْ وَالَّذِي بَعَثَكَ بِالْحَقِّ لَا أَتَزَوَّجُ أَبَدًا فَقَالَ «لَا تُنْكِحُوهُنَّ إِلَّا بِإِذْنِهِنَّ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ أَبُو هَارُونَ الْعَبْدِيُّ مَتْرُوكُ الْحَدِيثِ وَاسْمُهُ عُمَارَةُ بْنُ جُوَيْنٍ وَأَبُو هَارُونَ الْغَنَوِيُّ لَا بَأْسَ بِهِ وَاسْمُهُ إِبْرَاهِيمُ بْنُ الْعَلَاءِ وَكِلَاهُمَا مِنْ أَهْلِ الْبَصْرَةِ
[Machine] A young virgin girl came to the Prophet Muhammad and said, "My father has married me off while I dislike it." So the Prophet Muhammad annulled her marriage.
أَنَّ جَارِيَةً بِكْرًا أَتَتِ النَّبِيَّ ﷺ فَقَالَتْ إِنَّ أَبِي زَوَّجَنِي وَهِيَ كَارِهَةٌ «فَرَدَّ النَّبِيُّ ﷺ نِكَاحَهَا»
[Machine] "A man from the Banu Mudhar married off his daughter while she was unwilling, so she went to the Prophet ﷺ. He annulled the marriage for her."
«أَنْكَحَ رَجُلٌ مِنْ بَنِي الْمُنْذِرِ ابْنَتَهُ وَهِيَ كَارِهَةٌ فَأَتَى النَّبِيُّ ﷺ» فَرَدَّ نِكَاحَهَا 5368 أَخْبَرَنِي أَيُّوبُ بْنُ مُحَمَّدٍ قَالَ حَدَّثَنَا مَعْمَرٌ قَالَ حَدَّثَنَا زَيْدٌ عَنْ أَيُّوبَ عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ عَنِ النَّبِيِّ ﷺ مِثْلَهُ
"A girl came to her and said: 'My father married me to his brother's son so that he might raise his own status thereby, and I was unwilling.' She said: 'Sit here until the Prophet comes.' Then the Messenger of Allah came, and I told him (what she had said). He sent word to her father, calling him, and he left the matter up to her. She said: 'O Messenger of Allah, I accept what my father did, but I wanted to know whether women have any say in the matter.'" (Using translation from Nasāʾī 3269)
اجْلِسِي حَتَّى يَأْتِيَ النَّبِيُّ ﷺ فَجَاءَ رَسُولُ اللهِ ﷺ فَأَخْبَرْتُهُ فَأَرْسَلَ إِلَى أَبِيهَا «فَدَعَاهُ فَجَعَلَ الْأَمْرَ إِلَيْهَا» فَقَالَتْ يَا رَسُولَ اللهِ قَدْ أَجَزْتُ مَا صَنَعَ أَبِي وَلَكِنِّي أَرَدْتُ أَنْ أَعْلَمَ أَلِلنِّسَاءِ مِنَ الْأَمْرِ شَيْءٌ؟ قَالَ أَبُو عَبْدِ الرَّحْمَنِ هَذَا الْحَدِيثُ يُرْسِلُونَهُ
