21. Marriage
٢١۔ كِتَابُ النِّكَاحِ
[Machine] "That the Prophet ﷺ married Maimuna when it was prohibited, and she handed her matter over to Abbas and he married her to him." Abu Abdur-Rahman told us that this chain of narration is good, and the statement "she handed her matter over to Abbas and he married her to him" is a rejected saying. It is possible that this word is from some of those who narrated this hadith and was included in the narration."
أَنَّ النَّبِيَّ ﷺ «نَكَحَ مَيْمُونَةَ وَهُوَ حَرَامٌ جَعَلَتْ أَمْرَهَا إِلَى الْعَبَّاسِ فَأَنْكَحَهَا إِيَّاهُ» قَالَ لَنَا أَبُو عَبْدِ الرَّحْمَنِ هَذَا إِسْنَادٌ جَيِّدٌ وَقَوْلُهُ جَعَلَتْ أَمْرَهَا إِلَى الْعَبَّاسِ فَأَنْكَحَهَا إِيَّاهُ كَلَامٌ مُنْكَرٌ وَيُشْبِهُ أَنْ يَكُونَ هَذَا الْحَرْفُ مِنْ بَعْضِ مَنْ رَوَى هَذَا الْحَدِيثَ فَأُدْرِجَ فِي الْحَدِيثِ
[Machine] The Messenger of Allah ﷺ said, "Any woman who is married without the permission of her guardian, then her marriage is null and void. And the one who gave her permission from what he has made lawful for her, then if they quarrel, it is to be resolved by the ruler. And the ruler is the guardian of one who does not have a guardian."
قَالَ رَسُولُ اللهِ ﷺ «أَيُّمَا امْرَأَةٍ نُكِحَتْ بِغَيْرِ أَمْرِ مَوْلَاهَا فَإِنَّمَا نِكَاحُهَا بَاطِلٌ وَإِنَّمَا الَّذِي أَعْطَاهَا بِمَا اسْتَحَلَّ مِنْهَا فَإِنِ اشْتَجَرُوا فَذَلِكَ إِلَى السُّلْطَانِ وَالسُّلْطَانُ وَلِيُّ مَنْ لَا وَلِيَّ لَهُ»
