٢١۔٢٨ بَابُ اسْتِئْذَانِ الْبِكْرِ فِي نَفْسِهَا، وَذِكْرِ اخْتِلَافِ أَلْفَاظِ النَّاقِلِينَ لِخَبَرِ ابْنِ عَبَّاسٍ فِيهِ

A woman without a husband has more right to her person than her guardian, and a virgin's consent must be asked from her, and her silence implies her consent. (Using translation from Muslim 1421a)  

الكبرى للنسائي:٥٣٥١أَخْبَرَنَا قُتَيْبَةُ بْنُ سَعِيدٍ قَالَ حَدَّثَنَا مَالِكٌ عَنْ عَبْدِ اللهِ بْنِ الْفَضْلِ عَنْ نَافِعِ بْنِ جُبَيْرٍ عَنِ ابْنِ عَبَّاسٍ

أَنَّ رَسُولَ اللهِ ﷺ قَالَ «الْأَيِّمُ أَحَقُّ بِنَفْسِهَا مِنْ وَلِيِّهَا وَالْبِكْرُ تُسْتَأْذَنُ فِي نَفْسِهَا وَإِذْنُهَا صُمَاتُهَا»

[Machine] The Prophet ﷺ said, "The widow has more right to her own self than her guardian, and the orphaned girl should be consulted and her consent sought for her marriage."  

الكبرى للنسائي:٥٣٥٢أَخْبَرَنَا مَحْمُودُ بْنُ غَيْلَانَ قَالَ حَدَّثَنَا أَبُو دَاوُدَ قَالَ حَدَّثَنَا شُعْبَةُ عَنْ مَالِكِ بْنِ أَنَسٍ قَالَ سَمِعْتُ مِنْهُ بَعْدَ مَوْتِ نَافِعٍ بِسَنَةٍ وَلَهُ يَوْمَئِذٍ حَلْقَةٌ قَالَ حَدَّثَنِي عَبْدُ اللهِ بْنُ الْفَضْلِ عَنْ نَافِعِ بْنِ جُبَيْرٍ عَنِ ابْنِ عَبَّاسٍ

أَنَّ النَّبِيَّ ﷺ قَالَ «الْأَيِّمُ أَحَقُّ بِنَفْسِهَا مِنْ وَلِيِّهَا وَالْيَتِيمَةُ تُسْتَأْمَرُ وَإِذْنُهَا صُمَاتُهَا»

"A previously married woman has more right (to decide) about herself (with regard to marriage) than her guardian, and an orphan girl should be consulted with regard to marriage, and her permission is her silence." (Using translation from Nasāʾī 3262)  

الكبرى للنسائي:٥٣٥٣أَخْبَرَنِي أَحْمَدُ بْنُ سَعِيدٍ الرِّبَاطِيُّ قَالَ حَدَّثَنَا يَعْقُوبُ وَهُوَ ابْنُ إِبْرَاهِيمَ قَالَ حَدَّثَنَا أَبِي عَنِ ابْنِ إِسْحَاقَ قَالَ حَدَّثَنِي صَالِحُ بْنُ كَيْسَانَ عَنْ عَبْدِ اللهِ بْنِ الْفَضْلِ بْنِ الْعَبَّاسِ بْنِ رَبِيعَةَ عَنْ نَافِعِ بْنِ جُبَيْرِ بْنِ مُطْعِمٍ عَنِ عَبْدِ اللهِ بْنِ عَبَّاسٍ

أَنَّ رَسُولَ اللهِ ﷺ قَالَ «الْأَيِّمُ أَوْلَى بِأَمْرِهَا وَالْيَتِيمَةُ تُسْتَأْمَرُ فِي نَفْسِهَا وَإِذْنُهَا صُمَاتُهَا»

The Prophet ﷺ said: A guardian has no concern with a woman previously married and has no husband, and an orphan girl (i.e. virgin) must be consulted, her silence being her acceptance. (Using translation from Abū Dāʾūd 2100)  

الكبرى للنسائي:٥٣٥٤أَخْبَرَنِي مُحَمَّدُ بْنُ رَافِعٍ قَالَ حَدَّثَنَا عَبْدُ الرَّزَّاقِ قَالَ أَخْبَرَنَا مَعْمَرٌ عَنْ صَالِحِ بْنِ كَيْسَانَ عَنْ نَافِعِ بْنِ جُبَيْرٍ عَنِ ابْنِ عَبَّاسٍ

عَنِ النَّبِيِّ ﷺ قَالَ «لَيْسَ لِلْوَلِيِّ مَعَ الثَّيِّبِ أَمْرٌ وَالْيَتِيمَةُ تُسْتَأْمَرُ فَصَمْتُهَا إِقْرَارُهَا»
