21. Marriage
٢١۔ كِتَابُ النِّكَاحِ
"Seek the permission of women with regard to marriage." It was said: "What if a virgin is too shy and remains silent?" He said: "That is her permission." (Using translation from Nasāʾī 3266)
عَنِ النَّبِيِّ ﷺ قَالَ «اسْتَأْمِرُوا النِّسَاءَ فِي أَبْضَاعِهِنَّ» قِيلَ فَإِنَّ الْبِكْرَ تَسْتَحِيِي فَتَسْكُتُ قَالَ «هُوَ إِذْنُهَا»
The Prophet ﷺ said, "A matron should not be given in marriage except after consulting her; and a virgin should not be given in marriage except after her permission." The people asked, "O Messenger of Allah ﷺ! How can we know her permission?" He said, "Her silence (indicates her permission). (Using translation from Bukhārī 5136)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ «لَا تُنْكَحُ الْأَيِّمُ حَتَّى تُسْتَأْمَرَ وَلَا تُنْكَحُ الْبِكْرُ حَتَّى تُسْتَأْذَنَ» قَالُوا يَا رَسُولَ اللهِ وَكَيْفَ إِذْنُهَا؟ قَالَ «أَنْ تَسْكُتَ»
