١١۔ كِتَابُ النِّكَاحِ ص ١
[Machine] The Prophet Muhammad ﷺ said, "Whoever is capable of marriage but does not marry, then he is not from among us."
قَالَ رَسُولُ اللَّهِ ﷺ «مَنْ قَدَرَ عَلَى أَنْ يَنْكِحَ فَلَمْ يَنْكِحْ فَلَيْسَ مِنَّا»
11.2 [Machine] Whoever has the means should get married.
١١۔٢ بَابُ مَنْ كَانَ عِنْدَهُ طَوْلٌ فَلْيَتَزَوَّجْ
It was narrated that 'Abdullah said: "The Messenger of Allah said to us: 'O young men, whoever among you can afford it, let him get married, for it is more effective in lowering the gaze and guarding chastity, and whoever cannot then he should fast, for it will be a restraint (wija') for him.'" عَبْدُ اللَّهِ كُنَّا مَعَ رَسُولِ اللَّهِ ﷺ شَبَابًا لَيْسَ لَنَا شَيْءٌ فَقَالَ «يَا مَعْشَرَ الشَّبَابِ مَنِ اسْتَطَاعَ مِنْكُمُ الْبَاءَةَ فَلْيَتَزَوَّجْ فَإِنَّهُ أَغَضُّ لِلْبَصَرِ وَأَحْصَنُ لِلْفَرْجِ وَمَنْ لَمْ يَسْتَطِعْ فَعَلَيْهِ بِالصَّوْمِ فَإِنَّ الصَّوْمَ لَهُ وِجَاءٌ»
[Machine] Do you have a young virgin girl who reminds you of Abu Abdurrahman? So he said, "If you say that, then I have heard the Messenger of Allah ﷺ say, 'O youth, whoever among you is able to marry, let him do so, for it is more effective in guarding the gaze and preserving chastity. And whoever is not able, then let him fast, for it will be a shield for him.'"
لَهُ أَبَا عَبْدِ الرَّحْمَنِ هَلْ لَكَ فِي جَارِيَةٍ بِكْرٍ تُذَكِّرُكَ؟ فَقَالَ لَئِنْ قُلْتَ ذَاكَ فَقَدْ سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «يَا مَعْشَرَ الشَّبَابِ مَنِ اسْتَطَاعَ مِنْكُمُ الْبَاءَةَ فَلْيَتَزَوَّجْ فَإِنَّهُ أَغَضُّ لِلْبَصَرِ وَأَحْصَنُ لِلْفَرْجِ وَمَنْ لَمْ يَسْتَطِعْ فَلْيَصُمْ فَإِنَّ الصَّوْمَ لَهُ وِجَاءٌ»
11.3 [Machine] In the prohibition of hypocrisy
١١۔٣ بَابٌ فِي النَّهْيِ عَنِ التَّبَتُّلِ
The Prophet ﷺ prevented ʿUthman bin Mazun from that (not marrying), and had he allowed him, we would have got ourselves castrated. (Using translation from Bukhārī 5074)
أَنَّهُ سَمِعَ سَعْدَ بْنَ أَبِي وَقَّاصٍ يَقُولُ «لَقَدْ رَدَّ ذَلِكَ رَسُولُ اللَّهِ ﷺ عَلَى عُثْمَانَ وَلَوْ أَجَازَ لَهُ التَّبَتُّلَ لَاخْتَصَيْنَا»
[Machine] The translation of the given Arabic phrase "نَهَى رَسُولُ اللَّهِ ﷺ عَنِ التَّبَتُّلِ" into English is: "The Messenger of Allah (pbuh) forbade self-mutilation."
«نَهَى رَسُولُ اللَّهِ ﷺ عَنِ التَّبَتُّلِ»
[Machine] "When it came to the matter of Uthman ibn Madhun, who was known for his abstention from women, the Messenger of Allah ﷺ sent a messenger to him and said, 'O Uthman, I have not been commanded to adopt a monastic lifestyle. Have you turned away from my Sunnah?' Uthman replied, 'No, O Messenger of Allah.' The Prophet ﷺ said, 'Verily, it is from my Sunnah to pray, sleep, fast, give charity, get married, and divorce. Whoever turns away from my Sunnah is not of me, O Uthman. Indeed, your family has rights over you, and you have rights over yourself.' Saad said, 'By Allah, all the men among the Muslims were united in their acknowledgement that the Messenger of Allah ﷺ showed special preference to Uthman regarding his choice to abstain from women.'"
لَمَّا كَانَ مِنْ أَمْرِ عُثْمَانَ بْنِ مَظْعُونٍ الَّذِي كَانَ مِنْ تَرْكِ النِّسَاءِ بَعَثَ إِلَيْهِ رَسُولُ اللَّهِ ﷺ فَقَالَ «يَا عُثْمَانُ إِنِّي لَمْ أُومَرْ بِالرَّهْبَانِيَّةِ أَرَغِبْتَ عَنْ سُنَّتِي؟» قَالَ لَا يَا رَسُولَ اللَّهِ قَالَ «إِنَّ مِنْ سُنَّتِي أَنْ أُصَلِّيَ وَأَنَامَ وَأَصُومَ وَأَطْعَمَ وَأَنْكِحَ وَأُطَلِّقَ فَمَنْ رَغِبَ عَنْ سُنَّتِي فَلَيْسَ مِنِّي يَا عُثْمَانُ إِنَّ لِأَهْلِكَ عَلَيْكَ حَقًّا وَلِنَفْسِكَ عَلَيْكَ حَقًّا» قَالَ سَعْدٌ فَوَاللَّهِ لَقَدْ كَانَ أَجْمَعَ رِجَالٌ مِنَ الْمُسْلِمِينَ عَلَى أَنَّ رَسُولَ اللَّهِ ﷺ إِنْ هُوَ أَقَرَّ عُثْمَانَ عَلَى مَا هُوَ عَلَيْهِ أَنْ نَخْتَصِيَ فَنَتَبَتَّلَ
11.4 [Machine] The woman is married to four.
١١۔٤ بَابُ تُنْكَحُ الْمَرْأَةُ عَلَى أَرْبَعٍ
for her property, her ranks, her beauty and her religiosity. So get the one who is religious and prosper (lit. may your hands cleave to the dust).” (Using translation from Abū Dāʾūd 2047)
عَنِ النَّبِيِّ ﷺ قَالَ تُنْكَحُ النِّسَاءُ لِأَرْبَعٍ لِلدِّينِ وَالْجَمَالِ وَالْمَالِ وَالْحَسَبِ فَعَلَيْكَ بِذَاتِ الدِّينِ تَرِبَتْ يَدَاكَ
The tradition mentioned above has also been transmitted by Rukanah bin Yazid from the Prophet ﷺ through a different chain of narrators. (Using translation from Abū Dāʾūd 2207)
عَنِ النَّبِيِّ ﷺ بِهَذَا الْحَدِيثِ
11.5 [Machine] The license to look at a woman during the engagement.
١١۔٥ بَابُ الرُّخْصَةِ فِي النَّظَرِ إِلَى الْمَرْأَةِ عِنْدَ الْخِطْبَةِ
[Machine] His messenger ﷺ said to him, "Go and look at her, as it is more appropriate for reconciliation to take place between you."
لَهُ رَسُولُ اللَّهِ ﷺ «اذْهَبْ فَانْظُرْ إِلَيْهَا فَإِنَّهُ أَجْدَرُ أَنْ يُؤْدَمَ بَيْنَكُمَا»
11.6 [Machine] If a man gets married, what is said to him?
١١۔٦ بَابُ إِذَا تَزَوَّجَ الرَّجُلُ مَا يُقَالُ لَهُ
[Machine] "Do not say that, for the Messenger of Allah ﷺ forbade us from doing so and commanded us to say 'May Allah bless you and grant you blessings'."
لَا تَقُولُوا ذَلِكَ إِنَّ رَسُولَ اللَّهِ ﷺ نَهَانَا عَنْ ذَلِكَ وَأَمَرَنَا أَنْ نَقُولَ «بَارَكَ اللَّهُ لَكَ وَبَارَكَ عَلَيْكَ»
When the Prophet ﷺ congratulated a man on his marriage, he said: May Allah bless for you, and may He bless on you, and combine both of you in good (works). (Using translation from Abū Dāʾūd 2130)
عَنِ النَّبِيِّ ﷺ أَنَّهُ كَانَ إِذَا رَفَّأَ لِإِنْسَانٍ قَالَ «بَارَكَ اللَّهُ لَكَ وَبَارَكَ عَلَيْكَ وَجَمَعَ بَيْنَكُمَا فِي خَيْرٍ»
11.7 [Machine] Prohibition of a man's proposal to his brother's proposal
١١۔٧ بَابُ النَّهْيِ عَنْ خِطْبَةِ الرَّجُلِ عَلَى خِطْبَةِ أَخِيهِ
[Machine] About the Prophet ﷺ who said, "A man should not propose marriage to his brother's fiancée."
عَنِ النَّبِيِّ ﷺ أَنَّهُ «نَهَى عَنْ أَنْ يَخْطُبَ الرَّجُلُ عَلَى خِطْبَةِ أَخِيهِ»
The Prophet ﷺ said: One of you must not ask a woman in marriage when his brother has done so already, and one of you must not sell (his own goods) when his brother has already sold (his goods) except with his permission. (Using translation from Abū Dāʾūd 2081)
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «لَا يَخْطُبُ أَحَدُكُمْ عَلَى خِطْبَةِ أَخِيهِ وَلَا يَبِيعُ عَلَى بَيْعِ أَخِيهِ حَتَّى يَأْذَنَ لَهُ»
[Machine] She was under the authority of a man from the Quraysh tribe of Banu Makhzum, but he divorced her abruptly. She then sent a message to her family seeking financial support, but they informed her that they had no provision for her. The Messenger of Allah ﷺ was informed of this, and he said, "You have no financial support, but you have an 'iddah (waiting period). Move to the house of Umm Sharik and do not burden us with your presence." Then he said, "Umm Sharik is a woman who is visited by her brothers from the Muhajirin, but move to the house of Ibn Umm Maktum, for he is a blind man. If you take off your clothes, he will not see anything, and do not burden us with your presence." So she went to the house of Ibn Umm Maktum, and when she arrived, she remembered that Mu'awiyah and Abu Jahm had proposed to her. The Messenger of Allah ﷺ said, "As for Mu'awiyah, he is a man without wealth, and as for Abu Jahm, he does not take his cane off his shoulder. So where do you stand with regard to Usamah?" Her family seemed to dislike this, so she said, "By Allah, I will not marry anyone except the one whom the Messenger of Allah ﷺ has mentioned." Therefore, she married Usamah. Muhammad ibn Amr said that Muhammad ibn Ibrahim said, "O Fatimah, fear Allah, for you have known what this meant."
أَنَّهَا كَانَتْ تَحْتَ رَجُلٍ مِنْ قُرَيْشٍ مِنْ بَنِي مَخْزُومٍ فَطَلَّقَهَا الْبَتَّةَ فَأَرْسَلَتْ إِلَى أَهْلِهِ تَبْتَغِي مِنْهُمُ النَّفَقَةَ فَقَالُوا لَيْسَ لَكِ نَفَقَةٌ فَبَلَغَ ذَلِكَ رَسُولَ اللَّهِ ﷺ فَقَالَ «لَيْسَ لَكِ نَفَقَةٌ وَعَلَيْكِ الْعِدَّةُ وَانْتَقِلِي إِلَى بَيْتِ أُمِّ شَرِيكٍ وَلَا تُفَوِّتِينَا بِنَفْسِكِ» ثُمَّ قَالَ «إِنَّ أُمَّ شَرِيكٍ امْرَأَةٌ يَدْخُلُ عَلَيْهَا إِخْوَانُهَا مِنَ الْمُهَاجِرِينَ وَلَكِنِ انْتَقِلِي إِلَى بَيْتِ ابْنِ أُمِّ مَكْتُومٍ فَإِنَّهُ رَجُلٌ أَعْمَى إِنْ وَضَعْتِ ثِيَابَكِ لَمْ يَرَ شَيْئًا وَلَا تُفَوِّتِينَا بِنَفْسِكِ» فَانْطَلَقَتْ إِلَى بَيْتِ ابْنِ أُمِّ مَكْتُومٍ فَلَمَّا حَلَّتْ ذَكَرَتْ أَنَّ مُعَاوِيَةَ وَأَبَا جَهْمٍ خَطَبَاهَا فَقَالَ رَسُولُ اللَّهِ ﷺ «أَمَّا مُعَاوِيَةُ فَرَجُلٌ لَا مَالَ لَهُ وَأَمَّا أَبُو جَهْمٍ فَلَا يَضَعُ عَصَاهُ عَنْ عَاتِقِهِ فَأَيْنَ أَنْتَ مِنْ أُسَامَةَ؟» فَكَأَنَّ أَهْلَهَا كَرِهُوا ذَلِكَ فَقَالَتْ وَاللَّهِ لَا أَنْكِحُ إِلَّا الَّذِي قَالَ رَسُولُ اللَّهِ ﷺ فَنَكَحَتْ أُسَامَةَ قَالَ مُحَمَّدُ بْنُ عَمْرٍو قَالَ مُحَمَّدُ بْنُ إِبْرَاهِيمَ يَا فَاطِمَةُ اتَّقِي اللَّهَ فَقَدْ عَلِمْتِ فِي أَيِّ شَيْءٍ كَانَ هَذَا
11.8 [Machine] The conditions under which a man is allowed to propose.
١١۔٨ بَابُ الْحَالِ الَّتِي يَجُوزُ لِلرَّجُلِ أَنْ يَخْطُبَ فِيهَا
"The Messenger of Allah prohibited that a woman be married along with her paternal aunt, or the paternal aunt along with her brother's daughter, or a woman with her maternal aunt, or the maternal aunt along with her sister's daughter, and the younger is not to be married with the older, nor the older with the younger." (Using translation from Tirmidhī 1126)
أَنَّ رَسُولَ اللَّهِ ﷺ «نَهَى أَنْ تُنْكَحَ الْمَرْأَةُ عَلَى عَمَّتِهَا وَالْعَمَّةُ عَلَى ابْنَةِ أَخِيهَا أَوِ الْمَرْأَةُ عَلَى خَالَتِهَا أَوِ الْخَالَةُ عَلَى بِنْتِ أُخْتِهَا وَلَا تُنْكَحُ الصُّغْرَى عَلَى الْكُبْرَى وَلَا الْكُبْرَى عَلَى الصُّغْرَى»
"The Messenger of Allah said: '(A man should not be married to) a woman and her paternal aunt nor to a woman and her maternal aunt at the same time.'" (Using translation from Nasāʾī 3288)
أَنَّ رَسُولَ اللَّهِ ﷺ «نَهَى أَنْ يُجْمَعَ بَيْنَ الْمَرْأَةِ وَعَمَّتِهَا وَالْمَرْأَةِ وَخَالَتِهَا»
11.9 [Machine] In the prohibition of envy
١١۔٩ بَابٌ فِي النَّهْيِ عَنِ الشِّغَارِ
[Machine] "The Messenger of Allah ﷺ prohibited 'shighar'. Malik said, 'Shighar' is when a man gives his daughter in marriage to another man, while that man gives his daughter in marriage to the first man, without any dowry. Abu Muhammad was asked, 'Do you consider marriage between them valid?' He said, 'I do not approve of it.'"
«نَهَى رَسُولُ اللَّهِ ﷺ عَنِ الشِّغَارِ» قَالَ مَالِكٌ وَالشِّغَارُ أَنْ يُزَوِّجَ الرَّجُلُ الْآخَرَ ابْنَتَهُ عَلَى أَنْ يُزَوِّجَهُ الْآخَرُ ابْنَتَهُ بِغَيْرِ صَدَاقٍ قِيلَ لِأَبِي مُحَمَّدٍ تَرَى بَيْنَهُمَا نِكَاحًا قَالَ لَا يُعْجِبُنِي
11.10 [Machine] In the Marriage of the Pious Men and Women
١١۔١٠ بَابٌ فِي نِكَاحِ الصَّالِحِينَ وَالصَّالِحَاتِ
[Machine] On the authority of the Prophet ﷺ, he said, "Marry the righteous men and the righteous women." Abu Muhammad said, "And it was revealed to me from the Hadith, so whatever follows after them is good."
عَنِ النَّبِيِّ ﷺ قَالَ «أَنْكِحُوا الصَّالِحِينَ وَالصَّالِحَاتِ» قَالَ أَبُو مُحَمَّد «وَسَقَطَ عَلَيَّ مِنَ الْحَدِيثِ فَمَا تَبِعَهُمْ بَعْدُ فَحَسَنٌ»
11.11 [Machine] Prohibition of marriage without a guardian
١١۔١١ بَابُ النَّهْيِ عَنِ النِّكَاحِ بِغَيْرِ وَلِيٍّ
the Messenger of Allah said: “There is no marriage except with a guardian.” (Using translation from Ibn Mājah 1881)
قَالَ رَسُولُ اللَّهِ ﷺ «لَا نِكَاحَ إِلَّا بِوَلِيٍّ»
[Machine] From the Prophet ﷺ who said, "There is no marriage except with a guardian."
عَنِ النَّبِيِّ ﷺ قَالَ «لَا نِكَاحَ إِلَّا بِوَلِيٍّ»
[Machine] The Prophet ﷺ said: "Any woman who is married without the permission of her guardian, her marriage is invalid, her marriage is invalid, her marriage is invalid. If they dispute, Abu Asim said: and he said it once: if they argue, then the ruler is the guardian of the one who has no guardian. If he (the ruler) decides in her favor, then she has the dowry for what he has permitted from her private parts." Abu Asim said: He (the Prophet) repeated this statement forty-six times.
عَنِ النَّبِيِّ ﷺ قَالَ أَيُّمَا امْرَأَةٍ نُكِحَتْ بِغَيْرِ إِذْنِ وَلِيِّهَا فَنِكَاحُهَا بَاطِلٌ فَنِكَاحُهَا بَاطِلٌ فَنِكَاحُهَا بَاطِلٌ فَإِنِ اشْتَجَرُوا قَالَ أَبُو عَاصِمٍ وَقَالَ مَرَّةً فَإِنْ تَشَاجَرُوا فَالسُّلْطَانُ وَلِيُّ مَنْ لَا وَلِيَّ لَهُ فَإِنْ أَصَابَهَا فَلَهَا الْمَهْرُ بِمَا اسْتَحَلَّ مِنْ فَرْجِهَا قَالَ أَبُو عَاصِمٍ أَمْلَاهُ عَلَيَّ سَنَةَ سِتٍّ وَأَرْبَعِينَ وَمِائَةٍ
11.12 [Machine] In the orphan, getting married
١١۔١٢ بَابٌ فِي الْيَتِيمَةِ تُزَوَّجُ
"The Messenger of Allah said: 'An orphan girl should be consulted with regard to marriage, and if she remains silent, that is her permission. If she refuses then she is not to be forced.'" (Using translation from Nasāʾī 3270)
قَالَ رَسُولُ اللَّهِ ﷺ «تُسْتَأْمَرُ الْيَتِيمَةُ فِي نَفْسِهَا فَإِنْ سَكَتَتْ فَقَدْ أَذِنَتْ وَإِنْ أَبَتْ لَمْ تُكْرَهْ»
11.13 [Machine] In the permissible acts of the virgin and the non-virgin
١١۔١٣ بَابٌ فِي اسْتِئْمَارِِ الْبِكْرِ وَالثَّيِّبِ
the Messenger of Allah said: “A previously-married woman should not be married until she is consulted, and a virgin should not be married until her consent is sought, and her consent is her silence.” (Using translation from Ibn Mājah 1871)
قَالَ رَسُولُ اللَّهِ ﷺ «لَا تُنْكَحُ الثَّيِّبُ حَتَّى تُسْتَأْمَرَ وَلَا تُنْكَحُ الْبِكْرُ حَتَّى تُسْتَأْذَنَ وَإِذْنُهَا الصُّمُوتُ»
[Machine] About the Messenger of Allah ﷺ with this narration...
عَنْ رَسُولِ اللَّهِ ﷺ بِهَذَا الْحَدِيثِ
Ibn ‘Abbas reported the Apostle of Allaah ﷺ as saying “A woman without a husband has more right to her person than her guardian and a virgin’s permission must be asked, her permission being her silence. These are the words of Al Qa’nabi. (Using translation from Abū Dāʾūd 2098)
قَالَ رَسُولُ اللَّهِ ﷺ «الْأَيِّمُ أَحَقُّ بِنَفْسِهَا مِنْ وَلِيِّهَا وَالْبِكْرُ تُسْتَأْذَنُ فِي نَفْسِهَا وَإِذْنُهَا صُمَاتُهَا»
[Machine] The Messenger of Allah, peace be upon him, said: "The permission of a virgin is sought, and her silence is considered as her permission."
قَالَ رَسُولُ اللَّهِ ﷺ «تُسْتَأْذَنُ الْبِكْرُ وَإِذْنُهَا صُمَاتُهَا»
"A previously married woman has more right (to decide) about herself (with regard to marriage) than her guardian, and an orphan girl should be consulted with regard to marriage, and her permission is her silence." (Using translation from Nasāʾī 3262)
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «الْأَيِّمُ أَمْلَكُ بِأَمْرِهَا مِنْ وَلِيِّهَا وَالْبِكْرُ تُسْتَأْمَرُ فِي نَفْسِهَا وَصَمْتُهَا إِقْرَارُهَا»
11.14 [Machine] The bachelor marries her against her will, while she is unwilling.
١١۔١٤ بَابُ الثَّيِّبِ يُزَوِّجُهَا أَبُوهَا وَهِيَ كَارِهَةٌ
that a man among them who was called Khidam arranged a marriage for his daughter, and she did not like the marriage arranged by her father. She went to the Messenger of Allah and told him about that, and he annulled the marriage arranged by her father. Then she married Abu Lubabah bin Abdul-Mundhir. (Using translation from Ibn Mājah 1873)
أَنَّ رَجُلًا مِنْهُمْ مِنَ الْأَنْصَارِ يُدْعَى خِذَامًا «أَنْكَحَ بِنْتًا لَهُ فَكَرِهَتْ نِكَاحَ أَبِيهَا» فَأَتَتْ رَسُولَ اللَّهِ ﷺ فَذَكَرَتْ ذَلِكَ لَهُ فَرَدَّ عَنْهَا نِكَاحَ أَبِيهَا فَنَكَحَتْ أَبَا لُبَابَةَ بْنَ عَبْدِ الْمُنْذِرِ فَذَكَرَ يَحْيَى أَنَّهُ بَلَغَهُ أَنَّهَا كَانَتْ ثَيِّبًا
It was narrated from Khansa' bint Khidham that her father married her off when she had been previously married, and she was unwilling. She went to the Messenger of Allah and he annulled the marriage. (Using translation from Nasāʾī 3268)
أَنَّ خَنْسَاءَ بِنْتَ خِذَامٍ زَوَّجَهَا أَبُوهَا وَهِيَ ثَيِّبٌ فَكَرِهَتْ ذَلِكَ فَأَتَتْ رَسُولَ اللَّهِ ﷺ «فَرَدَّ نِكَاحَهَا»
11.15 [Machine] The woman is married by the guardians
١١۔١٥ بَابُ الْمَرْأَةِ يُزَوِّجُهَا الْوَلِيَّانِ
The Prophet ﷺ said: Any woman who is married by two guardians (to two different men) belongs to the first woman who is married by two guardians (to two different men) belongs to the first of them and anything sold by a man to two persons belongs to the first of them. (Using translation from Abū Dāʾūd 2088)
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «أَيُّمَا امْرَأَةٍ زَوَّجَهَا وَلِيَّانِ لَهَا فَهِيَ لِلْأَوَّلِ مِنْهُمَا وَأَيُّمَا رَجُلٍ بَاعَ بَيْعًا مِنْ رَجُلَيْنِ فَهُوَ لِلْأَوَّلِ مِنْهُمَا»
(Another chain) from Abu Sa'eed Al-Khudri, from the Messenger of Allah ﷺ with a similar report. (Using translation from Nasāʾī 568)
عَنْ رَسُولِ اللَّهِ ﷺ بِنَحْوِهِ
11.16 [Machine] Prohibition of women's pleasure
١١۔١٦ بَابُ النَّهْيِ عَنْ مُتْعَةِ النِّسَاءِ
"We went out with the Messenger of Allah on the Farewell pilgrimage, and they said : 'O Messenger of Allah, ﷺ celibacy has become too difficult for us'. He said : 'Then make temporary marriages with these women'. So we went to them, but they insisted on setting a fixed time between us and them. They mentioned that to the Prophet and he said : 'Set a fixed time between you and them.' So I went out with a cousin of mine. He had a cloak and I had a cloak, but his cloak was finer than mine, and I was younger than him. We came to a women and she said: 'One cloak is like another.' So I married her and stayed with her that night. Then the next day I saw the Messenger of Allah standing between the Rukn (corner) and the door (of the Ka'bah), saying : 'O people, I had permitted temporary marriage for you, but Allah has forbidden it until the Day of Resurrection. however had any temporary wives, he should let them go, and do not take back anything that you had given to them.' " (Using translation from Ibn Mājah 1962)
أَنَّهُمْ سَارُوا مَعَ رَسُولِ اللَّهِ ﷺ فِي حِجَّةِ الْوَدَاعِ فَقَالَ «اسْتَمْتِعُوا مِنْ هَذِهِ النِّسَاءِ» وَالِاسْتِمْتَاعُ عِنْدَنَا التَّزْوِيجُ فَعَرَضْنَا ذَلِكَ عَلَى النِّسَاءِ فَأَبَيْنَ أَنْ لَا يَضْرِبنَ بَيْنَنَا وَبَيْنَهُنَّ أَجَلًا فَقَالَ رَسُولُ اللَّهِ ﷺ «افْعَلُوا» فَخَرَجْتُ أَنَا وَابْنُ عَمٍّ لِي مَعَهُ بُرْدٌ وَمَعِي بُرْدٌ وَبُرْدُهُ أَجْوَدُ مِنْ بُرْدِي وَأَنَا أَشَبُّ مِنْهُ فَأَتَيْنَا عَلَى امْرَأَةٍ فَأَعْجَبَهَا شَبَابِي وَأَعْجَبَهَا بُرْدُهُ فَقَالَتْ بُرْدٌ كَبُرْدٍ وَكَانَ الْأَجَلُ بَيْنِي وَبَيْنَهَا عَشْرًا فَبِتُّ عِنْدَهَا تِلْكَ اللَّيْلَةَ ثُمَّ غَدَوْتُ فَإِذَا رَسُولُ اللَّهِ ﷺ قَائِمٌ بَيْنَ الرُّكْنِ وَالْبَابِ فَقَالَ «يَا أَيُّهَا النَّاسُ إِنِّي قَدْ كُنْتُ أَذِنْتُ لَكُمْ فِي الِاسْتِمْتَاعِ مِنَ النِّسَاءِ أَلَا وَإِنَّ اللَّهَ قَدْ حَرَّمَهُ إِلَى يَوْمِ الْقِيَامَةِ فَمَنْ كَانَ عِنْدَهُ مِنْهُنَّ شَيْءٌ فَلْيُخَلِّ سَبِيلَهَا وَلَا تَأْخُذُوا مِمَّا آتَيْتُمُوهُنَّ شَيْئًا»
[Machine] The Messenger of Allah, peace be upon him, prohibited temporary marriage during the Year of the Conquest.
نَهَى رَسُولُ اللَّهِ ﷺ عَنْ نِكَاحِ الْمُتْعَةِ عَامَ الْفَتْحِ
[Machine] I heard Ali say to Ibn Abbas, "The Messenger of Allah ﷺ forbade temporary marriage and the consumption of domesticated donkeys' meat during the Battle of Khaybar."
سَمِعْتُ عَلِيًّا يَقُولُ لِابْنِ عَبَّاسٍ إِنَّ رَسُولَ اللَّهِ ﷺ «نَهَى عَنِ الْمُتْعَةِ مُتْعَةِ النِّسَاءِ وَعَنْ لُحُومِ الْحُمُرِ الْأَهْلِيَّةِ عَامَ خَيْبَرَ»
11.17 [Machine] In the Forbidden Marriage
١١۔١٧ بَابٌ فِي نِكَاحِ الْمُحْرِمِ
ʿThe pilgrim in ihram should not get married, arrange a marriage or propose marriage.ʿ (Using translation from Aḥmad 401)
عَنْ نُبَيْهِ بْنِ وَهْبٍ عَنْ أَبَانَ بْنِ عُثْمَانَ عَنْ عُثْمَانَ عَنِ النَّبِيِّ ﷺ قَالَ «الْمُحْرِمُ لَا يَنْكِحُ وَلَا يُنْكِحُ»
11.18 [Machine] What were the dowries of the wives of the Prophet ﷺ and his daughters?
١١۔١٨ بَابُ كَمْ كَانَتْ مُهُورُ أَزْوَاجِ النَّبِيِّ ﷺ وَبَنَاتِهِ
[Machine] I asked Aisha, "How much was the dowry of the wives of the Messenger of Allah ﷺ ?" She said, "His dowry for his wives was twelve uqiyyas of silver and some sheeps." She also asked, "Do you know what sheeps are?" I said, "No." She said, "Half a uqiyya. So this was the dowry of the Messenger of Allah ﷺ for his wives."
سَأَلْتُ عَائِشَةَ كَمْ كَانَ صَدَاقُ أَزْوَاجِ رَسُولِ اللَّهِ ﷺ؟ قَالَتْ «كَانَ صَدَاقُهُ لِأَزْوَاجِهِ اثْنَتَيْ عَشْرَةَ أُوقِيَّةً وَنَشًّا» وَقَالَتْ «أَتَدْرِي مَا النَّشُّ؟» قَالَ قُلْتُ لَا قَالَتْ نِصْفُ أُوقِيَّةٍ فَهَذَا صَدَاقُ رَسُولِ اللَّهِ ﷺ لِأَزْوَاجِهِ
[Machine] Do not exaggerate in the dowry of women, for if it were honorable in this world or a means of righteousness before Allah, the Messenger of Allah, peace be upon him, would have been the most truthful in his attachment to his wives. No man has ever believed in a woman more than her own husband, and no woman has ever believed in a man more than her own father, even if she were given in marriage for twelve ounces of gold. And behold, one of you may exaggerate in the dowry of his wife until there remains animosity towards her in his heart, and he might even say, "I spent my dowry on you, whether it was the high status or the low status."
أَلَا لَا تُغَالُوا فِي صُدُقِ النِّسَاءِ فَإِنَّهَا لَوْ كَانَتْ مَكْرُمَةً فِي الدُّنْيَا أَوْ تَقْوَى عِنْدَ اللَّهِ كَانَ أَوْلَاكُمْ بِهَا رَسُولُ اللَّهِ ﷺ مَا أَصْدَقَ امْرَأَةً مِنْ نِسَائِهِ وَلَا أُصْدِقَتِ امْرَأَةٌ مِنْ بَنَاتِهِ فَوْقَ اثْنَتَيْ عَشْرَةَ أُوقِيَّةً أَلَا وَإِنَّ أَحَدَكُمْ لَيُغَالِي بِصَدَاقِ امْرَأَتِهِ حَتَّى يَبْقَى لَهَا فِي نَفْسِهِ عَدَاوَةٌ حَتَّى يَقُولَ «كَلِفْتُ لْكِ عَلَقَ الْقِرْبَةِ أَوْ عَرَقَ الْقِرْبَةِ»
11.19 [Machine] What is not allowed to be a dowry
١١۔١٩ بَابُ مَا يَجُوزُ أَنْ يَكُونَ مَهْرًا
[Machine] A woman came to the Prophet ﷺ and said, "Indeed, I have dedicated myself to Allah and His Messenger." The Messenger of Allah ﷺ said, "I have no need for women." A man said, "Marry her to me." He said, "Give her a garment." He replied, "I cannot find one." The Prophet ﷺ said, "Give her even if it is an iron ring." He said, "I do not have anything from the Quran." The Prophet ﷺ asked, "Do you possess any knowledge from the Quran?" He replied, "Yes, I do." The Prophet ﷺ then said, "Then I have married her to you based on the knowledge you have from the Quran."
أَتَتِ امْرَأَةٌ إِلَى النَّبِيِّ ﷺ فَقَالَتْ إِنَّهَا وَهَبَتْ نَفْسَهَا لِلَّهِ وَلِرَسُولِهِ فَقَالَ رَسُولُ اللَّهِ ﷺ «مَا لِي فِي النِّسَاءِ مِنْ حَاجَةٍ» فَقَالَ رَجُلٌ زَوِّجْنِيهَا فَقَالَ «أَعْطِهَا ثَوْبًا» فَقَالَ لَا أَجِدُ قَالَ «أَعْطِهَا وَلَوْ خَاتَمًا مِنْ حَدِيدٍ قَالَ فَاعْتَلَّ لَهُ» فَقَالَ «مَا مَعَكَ مِنَ الْقُرْآنِ» قَالَ كَذَا وَكَذَا قَالَ «فَقَدْ زَوَّجْتُكَهَا عَلَى مَا مَعَكَ مِنَ الْقُرْآنِ»
11.20 [Machine] In the sermon of marriage
١١۔٢٠ بَابٌ فِي خُطْبَةِ النِّكَاحِ
The Messenger of Allah ﷺ taught us the address in case of some need: Praise be to Allah from Whom we ask help and pardon, and in Whom we take refuge from the evils within ourselves. He whom Allah guides has no one who can lead him astray, and he whom He leads astray has no one to guide him. I testify that there is no god but Allah, and I testify that Muhammad is His servant and Apostle. "You who believe,...fear Allah by Whom you ask your mutual rights, and reverence the wombs. Allah has been watching you." ..."you who believe, fear Allah as He should be feared, and die only as Muslims" ...."you who believe, fear Allah as He should be feared, and die only as Muslims"....."you who believe, fear Allah and say what is true. He will make your deeds sound, and forgive your sins. He who obeys Allah and His Apostle has achieved a mighty success." The narrator, Muhammad ibn Sulayman, did mention the word "inna" (verily). عَلَّمَنَا رَسُولُ اللَّهِ ﷺ خُطْبَةَ الْحَاجَةِ «الْحَمْدُ لِلَّهِ أَوْ إِنَّ الْحَمْدَ لِلَّهِ نَحْمَدُهُ وَنَسْتَعِينُهُ وَنَسْتَغْفِرُهُ وَنَعُوذُ بِاللَّهِ مِنْ شُرُورِ أَنْفُسِنَا مَنْ يَهْدِهِ اللَّهُ فَلَا مُضِلَّ لَهُ وَمَنْ يُضْلِلْ فَلَا هَادِيَ لَهُ أَشْهَدُ أَنْ لَا إِلَهَ إِلَّا اللَّهُ وَأَشْهَدُ أَنَّ مُحَمَّدًا عَبْدُهُ وَرَسُولُهُ» ثُمَّ يَقْرَأُ ثَلَاثَ آيَاتٍ {يَا أَيُّهَا الَّذِينَ آمَنُوا اتَّقُوا اللَّهَ حَقَّ تُقَاتِهِ وَلَا تَمُوتُنَّ إِلَّا وَأَنْتُمْ مُسْلِمُونَ} [آل عمران 102] {يَا أَيُّهَا النَّاسُ اتَّقُوا رَبَّكُمُ الَّذِي خَلَقَكُمْ مِنْ نَفْسٍ وَاحِدَةٍ وَخَلَقَ مِنْهَا زَوْجَهَا وَبَثَّ مِنْهُمَا رِجَالًا كَثِيرًا وَنِسَاءً وَاتَّقُوا اللَّهَ الَّذِى تَسَاءَلُونَ بِهِ وَاْلْأَرْحَامِ إِنَّ اللَّهَ كَانَ عَلَيْكُمْ رَقِيبًا} {يَا أَيُّهَا الَّذِينَ آمَنُوا اتَّقُوا اللَّهَ وَقُولُوا قَوْلًا سَدِيدًا يُصْلِحْ لَكُمْ أَعْمَالَكُمْ وَيَغْفِرْ لَكُمْ ذُنُوبَكُمْ وَمَنْ يُطِعِ اللَّهَ وَرَسُولَهُ فَقَدْ فَازَ فَوْزًا عَظِيمًا} [الأحزاب 71] ثُمَّ يَتَكَلَّمُ بِحَاجَتِهِ
11.21 [Machine] Conditions in marriage
١١۔٢١ بَابُ الشَّرْطِ فِي النِّكَاحِ
that the Prophet said: “The conditions most deserving to be fulfilled are those by means of which the private parts become permissible for you.” (Using translation from Ibn Mājah 1954)
عَنِ النَّبِيِّ ﷺ قَالَ «إِنَّ أَحَقَّ الشُّرُوطِ أَنْ تُوفُوا بِهِ مَا اسْتَحْلَلْتُمْ بِهِ الْفُرُوجَ»
11.22 [Machine] At the feast
١١۔٢٢ بَابٌ فِي الْوَلِيمَةِ
the Prophet saw traces of yellow perfume on 'Abdur-Rahmaan bin 'Awf, and he asked him “What is this?” He said: “O Messenger of Allah, I married a women for the weight of a Nawah (Stone) of gold. He said: “May Allah bless you. Give a feast even if it is only with one sheep.” (Using translation from Ibn Mājah 1907)
أَنَّ النَّبِيَّ ﷺ رَأَى عَلَى عَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ صُفْرَةً فَقَالَ «مَا هَذِهِ الصُّفْرَةُ؟» قَالَ تَزَوَّجْتُ امْرَأَةً عَلَى وَزْنِ نَوَاةٍ مِنْ ذَهَبٍ قَالَ «بَارَكَ اللَّهُ لَكَ أَوْلِمْ وَلَوْ بِشَاةٍ»
11.23 [Machine] What came in the response of the banquet?
١١۔٢٣ بَابُ مَا جَاءَ فِي إِجَابَةِ الْوَلِيمَةِ
[Machine] The Messenger of Allah ﷺ said, "When one of you is invited to a feast, let him accept the invitation." Abu Muhammad said, "He should accept the invitation, but it is not obligatory for him to eat."
قَالَ رَسُولُ اللَّهِ ﷺ «إِذَا دُعِيَ أَحَدُكُمْ إِلَى وَلِيمَةٍ فَلْيُجِبْ» قَالَ أَبُو مُحَمَّد «يَنْبَغِي أَنْ يُجِيبَ وَلَيْسَ الْأَكْلُ عَلَيْهِ بِوَاجِبٍ»
11.24 [Machine] Injustice between women
١١۔٢٤ بَابٌ فِي الْعَدْلِ بَيْنَ النِّسَاءِ
The Prophet ﷺ said: When a man has two wives and he is inclined to one of them, he will come on the Day of resurrection with a side hanging down. (Using translation from Abū Dāʾūd 2133)
عَنِ النَّبِيِّ ﷺ قَالَ «مَنْ كَانَتْ لَهُ امْرَأَتَانِ فَمَالَ إِلَى إِحْدَاهُمَا جَاءَ يَوْمَ الْقِيَامَةِ وَشِقُّهُ مَائِلٌ»
11.25 [Machine] In the division among women
١١۔٢٥ بَابٌ فِي الْقِسْمَةِ بَيْنَ النِّسَاءِ
The Messenger of Allah ﷺ used to divide his time equally and said: O Allah, this is my division concerning what I control, so do not blame me concerning what You control and I do not. Abu Dawud said: By it meant the heart. (Using translation from Abū Dāʾūd 2134)
كَانَ رَسُولُ اللَّهِ ﷺ يَقْسِمُ فَيَعْدِلُ وَيَقُولُ «اللَّهُمَّ هَذِا قَسْمِي فِيمَا أَمْلِكُ فَلَا تَلُمْنِي فِيمَا تَمْلِكُ وَلَا أَمْلِكُ»
11.26 [Machine] The man has women.
١١۔٢٦ بَابُ الرَّجُلِ يَكُونُ عِنْدَهُ النِّسْوَةُ
[Machine] The translation of the given Arabic text into English is as follows: The Messenger of Allah ﷺ used to race with his wives while traveling, and whichever of them surpassed him, her arrow would go out with him.
كَانَ رَسُولُ اللَّهِ ﷺ «إِذَا سَافَرَ أَقْرَعَ بَيْنَ نِسَائِهِ فَأَيَّتُهُنَّ خَرَجَ سَهْمُهَا خَرَجَ بِهَا مَعَهُ»
11.27 [Machine] Residence with Thayyib and Bakr when building with them
١١۔٢٧ بَابُ الْإِقَامَةِ عِنْدَ الثَّيِّبِ وَالْبِكْرِ إِذَا بَنَى بِهِمَا
that the Messenger of Allah said: “Three days for a previously-married woman and seven days for a virgin.” (Using translation from Ibn Mājah 1916)
قَالَ رَسُولُ اللَّهِ ﷺ «لِلْبِكْرِ سَبْعٌ وَلِلثَّيِّبِ ثَلَاثٌ»
When the Messenger of Allah ﷺ married Umm Salamah, he stayed with her three night, and said: Your people (i.e. clan) are not being humbled for you in my estimation. If you wish I shall stay with you seven nights; and if I stay with you seven nights, I shall stay with my other wives seven nights. (Using translation from Abū Dāʾūd 2122)
أَنَّ رَسُولَ اللَّهِ ﷺ لَمَّا تَزَوَّجَ أُمَّ سَلَمَةَ أَقَامَ عِنْدَهَا ثَلَاثًا وَقَالَ «إِنَّهُ لَيْسَ بِكِ عَلَى أَهْلِكِ هَوَانٌ إِنْ شِئْتِ سَبَّعْتُ لَكِ وَإِنْ سَبَّعْتُ لَكِ سَبَّعْتُ لِسَائِرِ نِسَائِي»
11.28 [Machine] Building a man with his family in Shawwal
١١۔٢٨ بَابُ بِنَاءِ الرَّجُلِ بِأَهْلِهِ فِي شَوَّالٍ
It was narrated from 'Urwah, that 'Aishah said: "The Messenger of Allah married me in Shawwal and my marriage was consummated in Shawwal." --'Aishah liked for her women's marriages to be consummated in Shawwal --"and which of his wives was more beloved to him than me?" (Using translation from Nasāʾī 3236)
تَزَوَّجَنِي رَسُولُ اللَّهِ ﷺ فِي شَوَّالٍ وَأُدْخِلْتُ عَلَيْهِ فِي شَوَّالٍ فَأَيُّ نِسَائِهِ كَانَ أَحْظَى عِنْدَهُ مِنِّي؟ قَالَتْ «وَكَانَتْ تَسْتَحِبُّ أَنْ تُدْخِلَ عَلَى النِّسَاءِ فِي شَوَّالٍ»
11.29 [Machine] The saying during intercourse
١١۔٢٩ بَابُ الْقَوْلِ عِنْدَ الْجِمَاعِ
The Messenger of Allah said: "If anyone of you, when having sexual intercourse with his wife, says: (Bismillah, Allahumma jannibnash-Shaitana wa jannibish-Shaitana ma razaqtana) 'In the Name of Allah, O Allah! Protect me from Shaitan and protect what you bestow upon us from Shaitan' - then if Allah decrees that they should have a child, Shaitan will not be able to harm him.'" (Using translation from Tirmidhī 1092)
قَالَ رَسُولُ اللَّهِ ﷺ مَا يَمْنَعُ أَحَدَكُمْ أَنْ يَقُولَ حِينَ يُجَامِعُ أَهْلَهُ بِسْمِ اللَّهِ اللَّهُمَّ جَنِّبْنَا الشَّيْطَانَ وَجَنِّبِ الشَّيْطَانَ مَا رَزَقْتَنَا «فَإِنْ قَضَى اللَّهُ وَلَدًا لَمْ يَضُرَّهُ الشَّيْطَانُ»
11.30 [Machine] Prohibition of approaching women without their permission in their modesty.
١١۔٣٠ بَابُ النَّهْيِ عَنْ إِتْيَانِ النِّسَاءِ فِي أَعْجَازِهِنَّ
[Machine] I heard the Messenger of Allah ﷺ say: "Verily, Allah is not shy of the truth. Do not enter upon women in their private quarters."
سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «إِنَّ اللَّهَ لَا يَسْتَحْيِي مِنَ الْحَقِّ لَا تَأْتُوا النِّسَاءَ فِي أَعْجَازِهِنَّ»
