11. Book of Marriage
١١۔ كِتَابُ النِّكَاحِ
the Messenger of Allah said: “A previously-married woman should not be married until she is consulted, and a virgin should not be married until her consent is sought, and her consent is her silence.” (Using translation from Ibn Mājah 1871)
قَالَ رَسُولُ اللَّهِ ﷺ «لَا تُنْكَحُ الثَّيِّبُ حَتَّى تُسْتَأْمَرَ وَلَا تُنْكَحُ الْبِكْرُ حَتَّى تُسْتَأْذَنَ وَإِذْنُهَا الصُّمُوتُ»

عَنْ رَسُولِ اللَّهِ ﷺ بِهَذَا الْحَدِيثِ
Ibn ‘Abbas reported the Apostle of Allaah ﷺ as saying “A woman without a husband has more right to her person than her guardian and a virgin’s permission must be asked, her permission being her silence. These are the words of Al Qa’nabi. (Using translation from Abū Dāʾūd 2098)
قَالَ رَسُولُ اللَّهِ ﷺ «الْأَيِّمُ أَحَقُّ بِنَفْسِهَا مِنْ وَلِيِّهَا وَالْبِكْرُ تُسْتَأْذَنُ فِي نَفْسِهَا وَإِذْنُهَا صُمَاتُهَا»
[Machine] The Messenger of Allah, peace be upon him, said: "The permission of a virgin is sought, and her silence is considered as her permission."
قَالَ رَسُولُ اللَّهِ ﷺ «تُسْتَأْذَنُ الْبِكْرُ وَإِذْنُهَا صُمَاتُهَا»
"A previously married woman has more right (to decide) about herself (with regard to marriage) than her guardian, and an orphan girl should be consulted with regard to marriage, and her permission is her silence." (Using translation from Nasāʾī 3262)
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «الْأَيِّمُ أَمْلَكُ بِأَمْرِهَا مِنْ وَلِيِّهَا وَالْبِكْرُ تُسْتَأْمَرُ فِي نَفْسِهَا وَصَمْتُهَا إِقْرَارُهَا»
