[Machine] While I and Ibn Mas'ud were walking in the city, Uthman ibn Affan met us and took Ibn Mas'ud's hand. So they both stood up and I stepped aside. When Abdullah saw that he had no need for me to accompany him, he said, "Come, O Alqamah." I then approached him while he was saying, "Should we not marry you, Abdullah, to a girl who may remind you of what you have missed?" Abdullah replied, "If you say that, then indeed we were young with the Messenger of Allah ﷺ , and he said to us, 'Whoever is able to marry, let him marry, for it will help him lower his gaze and guard his chastity. And whoever is unable to marry, let him fast, for it will be a shield for him." And this is the Islamic castration.  

ابن حبّان:٤٠٢٦أَخْبَرَنَا الْحُسَيْنُ بْنُ عَبْدِ اللَّهِ بْنِ يَزِيدَ الْقَطَّانُ بِالرَّقَّةِ قَالَ حَدَّثَنَا حَكِيمُ بْنُ سَيْفٍ الرَّقِّيُّ قَالَ حَدَّثَنَا عُبَيْدُ اللَّهِ بْنُ عَمْرٍو عَنْ زَيْدِ بْنِ أَبِي أُنَيْسَةَ عَنْ سُلَيْمَانَ بْنِ مِهْرَانَ عَنْ إِبْرَاهِيمَ النَّخَعِيِّ عَنْ عَلْقَمَةَ بْنِ قَيْسٍ قَالَ

بَيْنَا أَنَا وَابْنُ مَسْعُودٍ نَمْشِي بِالْمَدِينَةِ قَالَ فَلَقِيَ عُثْمَانُ بْنُ عَفَّانَ فَأَخَذَ بِيَدِهِ قَالَ فَقَامَا وَتَنَحَّيْتُ عَنْهُمَا فَلَمَّا رَأَى عَبْدُ اللَّهِ أَنْ لَيْسَ لَهُ حَاجَةٌ يَسِرُّهَا قَالَ ادْنُ عَلْقَمَةُ قَالَ فَانْتَهَيْتُ إِلَيْهِ وَهُوَ يَقُولُ أَلَا نُزَوِّجُكَ يَا عَبْدَ اللَّهِ جَارِيَةً لَعَلَّهَا أَنْ تُذَكِّرَكَ مَا فَاتَكَ؟ قَالَ فَقَالَ عَبْدُ اللَّهِ لَئِنْ قُلْتَ ذَلِكَ فَإِنَّا قَدْ كُنَّا مَعَ رَسُولِ اللَّهِ ﷺ شَبَابًا فَقَالَ لَنَا رَسُولُ اللَّهِ ﷺ «مَنِ اسْتَطَاعَ مِنْكُمُ الْبَاءَةَ فَلْيَتَزَوَّجْ فَإِنَّهُ أَغَضُّ لِلْبَصَرِ وَأَحْصَنُ لِلْفَرْجِ وَمَنْ لَمْ يَسْتَطِعْ مِنْكُمُ الْبَاءَةَ فَلْيَصُمْ فَإِنَّهُ لَهُ وَجَاءٌ» وَهُوَ الْإِخْصَاءُ

[Machine] "To excel in his art, the Messenger of Allah ﷺ forbade him from it." Sa'd said, "If the Messenger of Allah ﷺ had given him permission, we would have sought excellence in it."  

ابن حبّان:٤٠٢٧أَخْبَرَنَا مُحَمَّدُ بْنُ الْحَسَنِ بْنِ قُتَيْبَةَ قَالَ حَدَّثَنَا حَرْمَلَةُ بْنُ يَحْيَى قَالَ حَدَّثَنَا ابْنُ وَهْبٍ قَالَ أَخْبَرَنَا يُونُسُ عَنِ ابْنِ شِهَابٍ عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ أَنَّ سَعْدَ بْنَ أَبِي وَقَّاصٍ أَخْبَرَهُ قَالَ «أَرَادَ عُثْمَانُ بْنُ مَظْعُونٍ

أَنْ يَتَبَتَّلَ فَنَهَاهُ رَسُولُ اللَّهِ ﷺ عَنْهُ» قَالَ سَعْدٌ «فَلَوْ أَجَازَ لَهُ ذَلِكَ رَسُولُ اللَّهِ ﷺ لَاخْتَصَيْنَا»  

ذِكْرُ الْعِلَّةِ الَّتِي مِنْ أَجَلِهَا نَهَى عَنِ التَّبَتُّلِ

[Machine] "The Messenger of Allah ﷺ used to command for relieving oneself and prohibit urinating in standing position strictly. He also used to say, 'Marry the gentle and fertile women, for I will surpass the other prophets in number on the Day of Resurrection.'"

«كَانَ رَسُولُ اللهِ ﷺ يَأْمُر بِالباءَةِ وَيَنْهَى عَنِ التَّبَتُّلِ نَهْياً شَدِيداً وَيَقُولُ «تَزَوَّجُوا الوَدُودَ الوَلُودَ فَإِنِّي مُكَاثِرٌ الأنبِياءَ يَوْمَ الْقِيَامَةِ»  

ذِكْرُ الْخَبَرِ الْمُدْحِضِ قَوْلَ مَنْ زَعَمَ أَنَّ قَوْلَهُ جَلَّ وَعَلَا {ذَلِكَ أَدْنَى أَلَّا تَعُولُوا} أَرَادَ بِهِ كَثْرَةَ الْعِيَالِ

[Machine] This is a quote from the Prophet ﷺ in which he said, "The closest meaning of not trusting (someone) is 'Do not commit injustice.'"  

ابن حبّان:٤٠٢٩أَخْبَرَنَا ابْنُ سَلْمٍ قَالَ حَدَّثَنَا عَبْدُ الرَّحْمَنِ بْنُ إِبْرَاهِيمَ قَالَ حَدَّثَنَا مُحَمَّدُ بْنُ شُعَيْبٍ عَنْ عُمَرَ بْنِ مُحَمَّدِ بْنِ زَيْدٍ الْعُمَرِيِّ عَنْ هِشَامِ بْنِ عُرْوَةَ عَنْ أَبِيهِ عَنْ عَائِشَةَ

عَنِ النَّبِيِّ ﷺ فِي قَوْلِهِ ذَلِكَ أَدْنَى أَنْ لَا تَعُولُوا قَالَ «أَنْ لَا تَجُورُوا»  

ذِكْرُ مَعُونَةِ اللَّهِ جَلَّ وَعَلَا الْقَاصِدَ فِي نِكَاحِهِ الْعَفَافَ، وَالنَّاوِيَ فِي كِتَابَتِهِ الْأَدَاءَ

"There are three, all of whom have a promise of help from Allah: 'The Mujahid who strives in the cause of Allah, the Mighty and Sublime; the man who gets married, seeking to keep himself chaste; and the slave who has a contract of manumission and wants to buy his freedom.'" (Using translation from Nasāʾī 3120)   

ابن حبّان:٤٠٣٠أَخْبَرَنَا مُحَمَّدُ بْنُ إِسْحَاقَ بْنِ خُزَيْمَةَ قَالَ حَدَّثَنَا مُحَمَّدُ بْنُ بَشَّارٍ قَالَ حَدَّثَنِي يَحْيَى بْنُ سَعِيدٍ قَالَ حَدَّثَنَا ابْنُ عَجْلَانَ عَنْ سَعِيدِ بْنِ أَبِي سَعِيدٍ عَنْ أَبِي هُرَيْرَةَ

عَنِ النَّبِيِّ ﷺ قَالَ «ثَلَاثَةٌ حَقٌّ عَلَى اللَّهِ أَنْ يُعِينَهُمُ الْمُجَاهِدُ فِي سَبِيلِ اللَّهِ وَالنَّاكِحُ يُرِيدُ أَنْ يَسْتَعِفَّ وَالْمُكَاتَبُ يُرِيدُ الْأَدَاءَ»  

ذِكْرُ الْبَيَانِ بِأَنَّ الْمَرْأَةَ الصَّالِحَةَ لِلْمُؤْمِنِ خَيْرُ مَتَاعِ الدُّنْيَا

It was narrated from 'Abdullah bin 'Amr bin Al-'As that the Messenger of Allah said: "This world is all temporary conveniences, and the best temporary convenience of this world is a righteous woman." (Using translation from Nasāʾī 3232)  

ابن حبّان:٤٠٣١أَخْبَرَنَا ابْنُ خُزَيْمَةَ قَالَ حَدَّثَنَا الْحُسَيْنُ بْنُ عِيسَى الْبِسْطَامِيُّ قَالَ حَدَّثَنَا الْمُقْرِئُ حَدَّثَنَا حَيْوَةُ وَذَكَرَ ابْنُ خُزَيْمَةَ آخَرَ مَعَهُ قَالَا حَدَّثَنَا شُرَحْبِيلُ بْنُ شَرِيكٍ أَنَّهُ سَمِعَ أَبَا عَبْدِ الرَّحْمَنِ الْحُبُلِيَّ يُحَدِّثُ عَنْ عَبْدِ اللَّهِ بْنِ عَمْرٍو

عَنْ رَسُولِ اللَّهِ ﷺ قَالَ «إِنَّ الدُّنْيَا كُلَّهَا مَتَاعٌ وَخَيْرُ مَتَاعِ الدُّنْيَا الْمَرْأَةُ الصَّالِحَةُ»  

ذِكْرُ الْإِخْبَارِ عَنِ الْأَشْيَاءِ الَّتِي هِيَ مِنْ سَعَادَةِ الْمَرْءِ فِي الدُّنْيَا

[Machine] The Messenger of Allah ﷺ said, "Four things bring happiness: a righteous woman, a spacious dwelling, a righteous neighbor, and a pleasant means of transportation. And four things bring misery: a bad neighbor, a wicked woman, a cramped dwelling, and a bad means of transportation."  

ابن حبّان:٤٠٣٢أَخْبَرَنَا مُحَمَّدُ بْنُ إِسْحَاقَ بْنِ إِبْرَاهِيمَ مَوْلَى ثَقِيفٍ قَالَ حَدَّثَنَا مُحَمَّدُ بْنُ عَبْدِ الْعَزِيزِ بْنِ أَبِي رِزْمَةَ قَالَ حَدَّثَنَا الْفَضْلُ بْنُ مُوسَى عَنْ عَبْدِ اللَّهِ بْنِ سَعِيدِ بْنِ أَبِي هِنْدٍ عَنْ إِسْمَاعِيلَ بْنِ مُحَمَّدِ بْنِ سَعْدِ بْنِ أَبِي وَقَّاصٍ عَنْ أَبِيهِ عَنْ جَدِّهِ قَالَ

قَالَ رَسُولُ اللَّهِ ﷺ «أَرْبَعٌ مِنَ السَّعَادَةِ الْمَرْأَةُ الصَّالِحَةُ وَالْمَسْكَنُ الْوَاسِعُ وَالْجَارُ الصَّالِحُ وَالْمَرْكَبُ الْهَنِيءُ وَأَرْبَعٌ مِنَ الشَّقَاوَةِ الْجَارُ السُّوءُ وَالْمَرْأَةُ السُّوءُ وَالْمَسْكَنُ الضِّيقُ وَالْمَرْكَبُ السُّوءُ»  

ذِكْرُ الْإِخْبَارِ بِأَنَّ فِي أَشْيَاءَ مَعْلُومَةٍ يُوجَدُ الشُّؤْمُ وَالْبَرَكَةُ مَعًا

If there is bad luck in anything, it is the horse, the abode and the woman. (Using translation from Muslim 2225f)   

ابن حبّان:٤٠٣٣أَخْبَرَنَا عَبْدُ اللَّهِ بْنُ أَحْمَدَ بْنِ مُوسَى بِعَسْكَرِ مُكْرَمٍ قَالَ حَدَّثَنَا عَمْرُو بْنُ عَلِيِّ بْنِ بَحْرٍ قَالَ حَدَّثَنَا أَبُو عَاصِمٍ قَالَ حَدَّثَنَا ابْنُ جُرَيْجٍ قَالَ أَخْبَرَنِي أَبُو الزُّبَيْرِ أَنَّهُ سَمِعَ جَابِرَ بْنَ عَبْدِ اللَّهِ يَقُولُ

سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «إِنْ كَانَ فِي شَيْءٍ فَفِي الرَّبْعِ وَالْفَرَسِ وَالْمَرْأَةِ» يَعْنِي الشُّؤْمَ  

ذِكْرُ الْإِخْبَارِ عَنْ وَصْفِ خَيْرِ النِّسَاءِ لِلْمُتَزَوِّجِ مِنَ الرِّجَالِ

[Machine] The Messenger of Allah ﷺ said, "The best among them is the easiest in terms of dowry."  

ابن حبّان:٤٠٣٤أَخْبَرَنَا ابْنُ خُزَيْمَةَ قَالَ حَدَّثَنَا أَبُو عَمَّارٍ قَالَ حَدَّثَنَا الْفَضْلُ بْنُ مُوسَى عَنْ رَجَاءِ بْنِ الْحَارِثِ عَنْ مُجَاهِدٍ عَنِ ابْنِ عَبَّاسٍ قَالَ

قَالَ رَسُولُ اللَّهِ ﷺ «خَيْرُهُنَّ أَيْسَرُهُنَّ صَدَاقًا»  

ذِكْرُ مَا يُسْتَحَبُّ لِلْمَرْءِ عِنْدَ التَّزْوِيجِ أَنْ يَطْلُبَ الدِّينَ دُونَ الْمَالِ فِي الْعَقْدِ عَلَى وَلَدِهِ أَوْ عَلَى نَفْسِهِ

[Machine] Jalibib was a man from the Ansar who used to visit women and talk to them. Abu Barzah said, "I told my wife, 'Jalibib should not enter upon you.'" The companions of the Prophet ﷺ used to not marry off their daughters until they knew whether the Messenger ﷺ wanted them or not. One day, the Prophet ﷺ said to a man from the Ansar, 'O so-and-so, marry your daughter to me.' He said, 'Yes, and may our eyes find rest.' The man asked, 'Is it for myself or someone else?' He replied, 'For Jalibib.' The man said, 'O Messenger of Allah, should I consult her mother?' He then went to her mother and said, 'Indeed, the Messenger of Allah ﷺ is proposing to marry your daughter.' She replied, 'Yes, and may our eyes find rest.' He asked, 'Is it for himself or someone else?' She said, 'For Jalibib.' He questioned, 'For Jalibib?' She responded, 'By Allah, I will not marry Jalibib.' When her father stood up to go to the Prophet ﷺ , the girl asked her mother, 'Who proposed to you?' She said, 'The Messenger of Allah ﷺ .' The girl then said, 'Will you reject the proposal of the Messenger of Allah ﷺ or me? Accompany me to the Messenger of Allah ﷺ as he will not disappoint me.' So her father went to the Prophet ﷺ and said, 'What is your opinion regarding her?' The Prophet ﷺ replied, 'Marry her to Jalibib.' Hammaad said, 'And do you know what he supplicated for her?' Ishaq ibn Abdullah ibn Abi Talhah narrated, 'What did he supplicate?' He said, 'O Allah, pour blessings on them abundantly and do not make their lives difficult.' Thabit said, 'So he married her to him.' While the Prophet ﷺ was in a battle, he asked, 'Is anyone missing?' They said, 'No.' He inquired, 'But I am missing Jalibib. Look for him among the martyrs.' They found him lying beside seven fallen enemies. Then they killed him. The Prophet ﷺ said, 'So he killed seven and they killed him? This act was from me, and I am pleased with him.' He mentioned this seven times, and the Messenger of Allah ﷺ placed him on his arm. There was no bed that did not have the Messenger of Allah's ﷺ arm except for Jalibib's, until he was placed in his grave.' Thabit said, 'He was one of the Ansar who spent in charity whatever he possessed.'  

ابن حبّان:٤٠٣٥أَخْبَرَنَا أَحْمَدُ بْنُ عَلِيِّ بْنِ الْمُثَنَّى قَالَ حَدَّثَنَا إِبْرَاهِيمُ بْنُ الْحَجَّاجِ السَّامِيُّ قَالَ حَدَّثَنَا حَمَّادُ بْنُ سَلَمَةَ عَنْ ثَابِتٍ الْبُنَانِيِّ عَنْ كِنَانَةَ بْنِ نُعَيْمٍ الْعَدَوِيِّ عَنْ أَبِي بَرْزَةَ الْأَسْلَمِيِّ

أَنَّ جُلَيْبِيبًا كَانَ امْرَأً مِنَ الْأَنْصَارِ وَكَانَ يَدْخُلُ عَلَى النِّسَاءِ وَيَتَحَدَّثُ إِلَيْهِنَّ قَالَ أَبُو بَرْزَةَ فَقُلْتُ لِامْرَأَتِي لَا يَدْخُلَنَّ عَلَيْكُمْ جُلَيْبِيبٌ قَالَ فَكَانَ أَصْحَابُ النَّبِيِّ ﷺ إِذَا كَانَ لِأَحَدِهِمْ أَيِّمٌ لَمْ يُزَوِّجْهَا حَتَّى يَعْلَمَ أَلِرَسُولِ ﷺ فِيهَا حَاجَةٌ أَمْ لَا؟ فَقَالَ رَسُولُ اللَّهِ ﷺ ذَاتَ يَوْمٍ لِرَجُلٍ مِنَ الْأَنْصَارِ «يَا فُلَانُ زَوِّجْنِي ابْنَتَكَ» قَالَ نَعَمْ وَنُعْمَى عَيْنٍ قَالَ «إِنِّي لَسْتُ لِنَفْسِي أُرِيدُهَا» قَالَ فَلِمَنْ؟ قَالَ «لِجُلَيْبِيبٍ» قَالَ يَا رَسُولَ اللَّهِ حَتَّى أَسْتَأْمِرَ أُمَّهَا فَأَتَاهَا فَقَالَ إِنَّ رَسُولَ اللَّهِ ﷺ يَخْطُبُ ابْنَتَكِ قَالَتْ نَعَمْ وَنُعْمَى عَيْنٍ قَالَ إِنَّهُ لَيْسَتْ لِنَفْسِهِ يُرِيدُهَا قَالَتْ فَلِمَنْ يُرِيدُهَا؟ قَالَ لِجُلَيْبِيبٍ قَالَتْ حَلْقَى أَلِجُلَيْبِيبٍ؟ قَالَتْ لَا لَعَمْرُ اللَّهِ لَا أُزَوِّجُ جُلَيْبِيبًا فَلَمَّا قَامَ أَبُوهَا لَيَأْتِي النَّبِيَّ ﷺ قَالَتِ الْفَتَاةُ مِنْ خِدْرِهَا لِأُمِّهَا مَنْ خَطَبَنِي إِلَيْكُمَا قَالَا رَسُولُ اللَّهِ ﷺ قَالَتْ أَتَرُدُّونَ عَلَى رَسُولِ اللَّهِ ﷺ أَمْرَهُ ادْفَعُونِي إِلَى رَسُولِ اللَّهِ ﷺ فَإِنَّهُ لَنْ يُضَيِّعَنِي فَذَهَبَ أَبُوهَا إِلَى النَّبِيِّ ﷺ فَقَالَ شَأْنُكَ بِهَا فَزَوَّجَهَا جُلَيْبِيبًا قَالَ حَمَّادٌ قَالَ إِسْحَاقُ بْنُ عَبْدِ اللَّهِ بْنِ أَبِي طَلْحَةَ هَلْ تَدْرِي مَا دَعَا لَهَا بِهِ قَالَ وَمَا دَعَا لَهَا بِهِ؟ قَالَ «اللَّهُمَّ صُبَّ الْخَيْرَ عَلَيْهِمَا صَبًّا وَلَا تَجْعَلْ عَيْشَهُمَا كَدًّا» قَالَ ثَابِتٌ فَزَوَّجَهَا إِيَّاهُ فَبَيْنَا رَسُولُ اللَّهِ ﷺ فِي غَزَاةٍ قَالَ «تَفْقِدُونَ مِنْ أَحَدٍ؟ » قَالُوا لَا قَالَ «لَكِنِّي أَفْقِدُ جُلَيْبِيبًا فَاطْلُبُوهُ فِي الْقَتْلَى» فَوَجَدُوهُ إِلَى جَنْبِ سَبْعَةٍ قَدْ قَتَلَهُمْ ثُمَّ قَتَلُوهُ فَقَالَ رَسُولُ اللَّهِ ﷺ «أَقَتَلَ سَبْعَةً ثُمَّ قَتَلُوهُ ? هَذَا مِنِّي وَأَنَا مِنْهُ» يَقُولُهَا سَبْعًا فَوَضَعَهُ رَسُولُ اللَّهِ ﷺ عَلَى سَاعِدَيْهِ مَا لَهُ سَرِيرٌ إِلَّا سَاعِدَيْ رَسُولِ اللَّهِ ﷺ حَتَّى وَضَعَهُ فِي قَبْرِهِ قَالَ ثَابِتٌ وَمَا كَانَ فِي الْأَنْصَارِ أَيِّمٌ أَنْفَقُ مِنْهَا  

ذِكْرُ الْأَمْرِ لِلْمُتَزَوِّجِ أَنْ يَقْصِدَ ذَوَاتَ الدِّينِ مِنَ النِّسَاءِ

[Machine] The Messenger of Allah ﷺ said, "A woman is married for her wealth, her beauty, and her religion. So, marry the one who is religious and has good character. May your right hand be blessed with Zainab bint Ka'b ibn Ujrah as your wife."

[Machine] It was said, "O Messenger of Allah, will you not marry among the Ansar?" He said, "Indeed, there is something in their hearts."

ذِكْرُ الْإِبَاحَةِ لِلْمَرْءِ أَنْ يَذْكُرَ الَّتِي يُرِيدُ أَنْ يَخْطُبَهَا لِإِخْوَانِهِ قَبْلَ أَنْ يَخْطُبَهَا إِلَى وَلِيِّهَا

Hafsah bint 'Umar became the widow of Khunais or Hudhaifah bin Hudhafah - 'Abdur-Razzaq was not certain. He was one of the Companions of the Prophet ﷺ who were present at Badr, and he died in Madinah, I met 'Uthman bin ʿAffan and offered I Hafsah to him in marriage, I said: If you wish, I will marry Hafsah to you. He said: I will think about it. A few days passed, then he met me and said: I do not want to get married at present. 'Umar said: Then I met Abu Bakr and I said: If you wish, I will marry Hafsah the daughter of ‘Umar to you. He did not give any response to me, and I was more upset with him than with 'Uthman. A few days passed, then the Messenger of Allah ﷺ proposed marriage to her and he gave her in marriage to him. Abu Bakr met me and said: Perhaps you felt upset with me when you offered Hafsah to me in marriage and I did not give you any response? I said: Yes. He said: Nothing prevented me from giving you an answer when you offered her to me in marriage except that I heard the Messenger of Allah ﷺ mention her and I did not want to disclose the private matters of the Messenger of Allah ﷺ. If he had not married her, I would have married her. (Using translation from Aḥmad 74)

عُمَرُ بْنُ الْخَطَّابِ تَأَيَّمَتْ حَفْصَةُ بِنْتُ عُمَرَ مِنْ خُنَيْسِ بْنِ حُذَافَةَ السَّهْمِيِّ رَجُلٌ مِنْ أَصْحَابِ النَّبِيِّ ﷺ مِمَّنْ شَهِدَ بَدْرًا وَتُوُفِّيَ بِالْمَدِينَةِ قَالَ عُمَرُ فَلَقِيتُ عُثْمَانَ بْنَ عَفَّانَ فَعَرَضْتُ عَلَيْهِ حَفْصَةَ فَقُلْتُ إِنْ شِئْتَ أَنْكَحْتُكَ حَفْصَةَ بِنْتَ عُمَرَ فَقَالَ سَأَنْظُرُ فِي ذَلِكَ قَالَ فَلَبِثْتُ لَيَالِيَ فَلَقِيَنِي فَقَالَ مَا أُرِيدُ النِّكَاحَ يَوْمِي هَذَا قَالَ عُمَرُ فَلَقِيتُ أَبَا بَكْرٍ فَقُلْتُ إِنْ شِئْتَ أَنْكَحْتُكَ حَفْصَةَ بِنْتَ عُمَرَ قَالَ فَلَمْ يَرْجِعْ إِلَيَّ شَيْئًا فَكُنْتُ أَوْجَدَ عَلَيْهِ مِنِّي عَلَى عُثْمَانَ فَلَبِثْتُ لَيَالِيَ فَخَطَبَهَا إِلَيَّ رَسُولُ اللَّهِ ﷺ فَأَنْكَحْتُهَا إِيَّاهُ فَلَقِيَنِي أَبُو بَكْرٍ فَقَالَ لَعَلَّكَ وَجَدْتَ فِي نَفْسِكَ حِينَ عَرَضْتَ عَلَيَّ حَفْصَةَ فَلَمْ أَرْجِعْ إِلَيْكَ شَيْئًا قَالَ قُلْتُ نَعَمْ قَالَ فَإِنَّهُ «لَمْ يَمْنَعْنِي أَنْ أَرْجِعَ إِلَيْكَ شَيْئًا لَمَّا عَرَضْتَ عَلَيَّ إِلَّا أَنِّي سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَذْكُرُهَا وَلَمْ أَكُنْ أُفْشِي سِرَّ رَسُولِ اللَّهِ ﷺ وَلَوْ تَرَكَهَا لَنَكَحْتُهَا*»  

ذِكْرُ الْأَمْرِ بِكِتْمَانِ الْخِطْبَةِ، وَاسْتِعْمَالِ دُعَاءِ الِاسْتِخَارَةِ بَعْدَ الْوضُوءِ، وَالصَّلَاةِ، وَالتَّحْمِيدِ، وَالتَّمْجِيدِ لِلَّهِ جَلَّ وَعَلَا عِنْدَهَا

Then praise and glorify your Lord, and say, 'O Allah, You have power, and I have no power. You have knowledge, and I have no knowledge. And You are the Knower of the unseen. So if you see fit for me in so-and-so, mentioning her by name, to be good for me in my religion, my worldly life, and my Hereafter, then decree it for me. And if You see fit that someone other than her is better for me in my religion, my worldly life, and my Hereafter, then fulfill it for me."

لَهُ النَّبِيُّ ﷺ «انْظُرْ إِلَيْهَا فَإِنَّ فِي أَعْيُنِ الْأَنْصَارِ شَيْئًا» يَعْنِي صَغَرًا

[Machine] I saw Muhammad ibn Muslimah chasing the daughter of Al-Dhahak on a running horse from the outskirts of the city, observing her. So I said to him, "Are you doing this while you are the companion of the Messenger of Allah ﷺ ?" He replied, "Yes, I heard the Messenger of Allah ﷺ saying, 'When Allah places a speech of desire in the heart of a person towards a woman, it is not wrong for him to look at her.'"  

ابن حبّان:٤٠٤٢أَخْبَرَنَا أَبُو يَعْلَى قَالَ حَدَّثَنَا أَبُو خَيْثَمَةَ قَالَ حَدَّثَنَا مُحَمَّدُ بْنُ خَازِمٍ عَنْ سَهْلِ بْنِ مُحَمَّدِ بْنِ أَبِي حَثْمَةَ عَنْ عَمِّهِ سُلَيْمَانِ بْنِ أَبِي حَثْمَةَ قَالَ

رَأَيْتُ مُحَمَّدَ بْنَ مَسْلَمَةَ يُطَارِدُ ابْنَةَ الضَّحَّاكِ عَلَى إِنْجَارٍ مِنْ أَنَاجِيرِ الْمَدِينَةِ يُبْصِرُهَا فَقُلْتُ لَهُ أَتَفْعَلُ هَذَا وَأَنْتَ صَاحِبُ رَسُولِ اللَّهِ ﷺ؟ قَالَ نَعَمْ سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «إِذَا أَلْقَى اللَّهُ فِي قَلْبِ امْرِئٍ خِطْبَةَ امْرَأَةٍ فَلَا بَأْسَ أَنْ يَنْظُرَ إِلَيْهَا»

[Machine] The Prophet ﷺ said, "Go and look at her, as it is more appropriate for a decision to be made between you two."  

ابن حبّان:٤٠٤٣أَخْبَرَنَا عِمْرَانُ بْنُ مُوسَى قَالَ حَدَّثَنَا الْعَبَّاسُ بْنُ عَبْدِ الْعَظِيمِ قَالَ حَدَّثَنَا عَبْدُ الرَّزَّاقِ قَالَ أَخْبَرَنَا مَعْمَرٌ عَنْ ثَابِتٍ عَنْ أَنَسٍ أَنَّ الْمُغِيرَةَ بْنَ شُعْبَةَ خَطَبَ امْرَأَةً فَقَالَ

لَهُ النَّبِيُّ ﷺ «اذْهَبْ فَانْظُرْ إِلَيْهَا فَإِنَّهُ أَجْدَرُ أَنْ يُؤْدَمَ بَيْنَكُمَا»

[Machine] A man came to the Prophet (PBUH) and mentioned a woman from the Ansar whom he wanted to marry. The Prophet (PBUH) said, "Look at her, for indeed the Ansar have something in their eyes."

قَالَ رَسُولُ اللَّهِ ﷺ لِفَاطِمَةَ بِنْتِ قَيْسٍ «اذْهَبِي إِلَى أُمِّ شَرِيكٍ وَلَا تُفَوِّتِينَا بِنَفْسِكِ»  

ذِكْرُ الْخَبَرِ الْمُدْحِضِ قَوْلَ مَنْ زَعَمَ أَنَّ هَذَا إِخْبَارٌ دُونَ النَّهْيِ

[Machine] The Prophet ﷺ prohibited a person from outbidding his brother in a transaction, or proposing to marry the woman his brother has proposed to.

عَنِ النَّبِيِّ ﷺ أَنَّهُ «نَهَى أَنْ يَسْتَامَ الرَّجُلُ عَلَى سَوْمِ أَخِيهِ أَوْ يَخْطُبَ عَلَى خِطْبَةِ أَخِيهِ»  

ذِكْرُ الْخَبَرِ الدَّالِّ عَلَى أَنَّ هَذَا الزَّجْرَ إِنَّمَا زَجَرَ إِذَا رَكَنَ أَحَدُهُمَا إِلَى صَاحِبِهِ، وَهُوَ الْعِلَّةُ الَّتِي ذَكَرْنَاهَا

Abu Salamah bin ‘Abd Al Rahman reported on the authority of Fatimah daughter of Qais Abu ‘Amr bin Hafs divorced her (Fatimah daughter of Qais) absolutely when he was away from home and his agent sent her home barley. She was displeased with it. He said “I swear by Allah, you have no claim on us. She then came to Apostle of Allah ﷺ and mentioned that to him. He said to her “No maintenance is due to you from him. He ordered her to spend the waiting period in the house of Umm Sharik but he said afterwards “that is a woman whom my Companions visit. Spend the waiting period in the house of Ibn Umm Maktum for he is blind and you can undress. Then when you are in a position of being remarried, tell me.” She said “When I was in a position to remarry, I mentioned to him that Mu’awiyah bin Abi Sufyan and Abu Jahm had asked me in marriage. The Apostle of Allah ﷺsaid “As for Abu Jahm, he does not put down his stick from his shoulder, and as for Mu’awiyah he is a poor man who has no property; marry Usamah bin Zaid. I disliked him but he said “Marry Usamah bin Zaid. So, I married him. And Allah prospered him very much and I was envied.” (Using translation from Abū Dāʾūd 2284)  

ابن حبّان:٤٠٤٩أَخْبَرَنَا الْحُسَيْنُ بْنُ إِدْرِيسَ الْأَنْصَارِيُّ قَالَ أَخْبَرَنَا أَحْمَدُ بْنُ أَبِي بَكْرٍ عَنْ مَالِكٍ عَنْ عَبْدِ اللَّهِ بْنِ يَزِيدَ مَوْلَى الْأَسْوَدِ بْنِ سُفْيَانَ عَنْ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ عَنْ فَاطِمَةَ بِنْتِ قَيْسٍ أَنَّ أَبَا عَمْرِو بْنَ حَفْصٍ طَلَّقَهَا الْبَتَّةَ وَهُوَ غَائِبٌ بِالشَّامِ فَأَرْسَلَ إِلَيْهَا وَكِيلَهُ بِشَعِيرٍ فَسَخِطَتْهُ فَقَالَ

وَاللَّهِ مَا لَكَ عَلَيْنَا مِنْ شَيْءٍ فَجَاءَتْ رَسُولَ اللَّهِ ﷺ فَذَكَرَتْ ذَلِكَ لَهُ فَقَالَ «لَيْسَ لَكِ عَلَيْهِ نَفَقَةٌ» وَأَمَرَهَا أَنْ تَعْتَدَّ فِي بَيْتِ أُمِّ شَرِيكٍ ثُمَّ قَالَ «تِلْكَ امْرَأَةٌ يَغْشَاهَا أَصْحَابِي فَاعْتَدِّي عِنْدَ ابْنِ أُمِّ مَكْتُومٍ فَإِنَّهُ رَجُلٌ أَعْمَى فَإِذَا حَلَلْتِ فَآذِنِينِي» قَالَتْ فَلَمَّا حَلَلْتُ ذَكَرْتُ لَهُ أَنَّ مُعَاوِيَةَ بْنَ أَبِي سُفْيَانَ وَأَبَا جَهْمٍ خَطَبَانِي فَقَالَ رَسُولُ اللَّهِ ﷺ «أَمَا أَبُو جَهْمٍ فَلَا يَضَعُ عَصَاهُ عَنْ عَاتِقِهِ وَأَمَّا مُعَاوِيَةُ فَصُعْلُوكٌ لَا مَالُ لَهُ انْكِحِي أُسَامَةَ بْنَ زَيْدٍ» قَالَتْ فَكَرِهْتُهُ ثُمَّ قَالَ «انْكِحِي أُسَامَةَ» فَنَكَحْتُهُ فَجَعَلَ اللَّهُ فِيهِ خَيْرًا وَاغْتَبَطْتُ بِهِ  

ذِكْرُ إِحْدَى الْحَالَتَيْنِ اللَّتَيْنِ قَدْ أُبِيحَ هَذَا الْفِعْلُ الْمَزْجُورُ عَنْهُ فِيهِمَا

[Machine] The Messenger of Allah ﷺ said, "A person should not outbid his brother in buying until he either buys or leaves, and should not propose for marriage to the woman his brother has proposed to until he marries her or gives up."

قَالَ رَسُولُ اللَّهِ ﷺ «لَا يَسْتَامُ الرَّجُلُ عَلَى سَوْمِ أَخِيهِ حَتَّى يَشْتَرِيَ أَوْ يَتْرُكَ وَلَا يَخْطُبُ عَلَى خِطْبَةِ أَخِيهِ حَتَّى يَنْكِحَ أَوْ يَذَرَ»  

ذِكْرُ الْحَالَةِ الثَّانِيَةِ الَّتِي أُبِيحَ اسْتِعْمَالُ هَذَا الْفِعْلِ الْمَزْجُورِ عَنْهُ فِيهِمَا

[Machine] "From the Prophet of Allahﷺ he said, 'A man should not propose to his brother's betrothed until the first proposer either abandons his proposal or gives permission to the second proposer to proceed.'"

عَنْ رَسُولِ اللَّهِ ﷺ قَالَ «لَا يَخْطُبُ الرَّجُلُ عَلَى خِطْبَةِ أَخِيهِ حَتَّى يَتْرُكَ الْخَاطِبُ الْأَوَّلُ أَوْ يَأْذَنَ لَهُ فَيَخْطُبُ»  

ذِكْرُ مَا يُقَالُ لِلْمُتَزَوِّجِ إِذَا تَزَوَّجَ أَوْ عَزَمَ عَلَى الْعَقْدِ عَلَيْهِ

[Machine] Indeed, the Prophet ﷺ used to say to a man who intended to get married, "May Allah bless you and shower His blessings upon you."

أَنَّ النَّبِيَّ ﷺ كَانَ إِذَا أَرَادَ الرَّجُلُ أَنْ يَتَزَوَّجَ قَالَ لَهُ «بَارَكَ اللَّهُ لَكَ وَبَارَكَ عَلَيْكَ»  

ذِكْرُ تَضْعِيفِ الْأَجْرِ لِمَنْ تَزَوَّجَ بِجَارِيَتِهِ بَعْدَ حُسْنِ تَأْدِيبِهَا وَعِتْقِهَا، وَلِمَنْ أَسْلَمَ مِنْ أَهْلِ الْكِتَابِ

[Machine] "To the common people, we say that when a man frees his slave, marries her, and treats her well, he will be rewarded like the one who owns a mount. Sha'bi told me that Abu Burdah informed him from Abu Musa who said that the Messenger of Allah ﷺ said: 'When a man educates his slave woman and teaches her well, then frees her and marries her, he will receive double reward. And if a man believes in Jesus and then believes in me, he will receive double reward. And when a servant fears his Lord and obeys his master, he will receive double reward.'"  

ابن حبّان:٤٠٥٣أَخْبَرَنَا الْحَسَنُ بْنُ سُفْيَانَ قَالَ حَدَّثَنَا حِبَّانُ بْنُ مُوسَى قَالَ أَخْبَرَنَا عَبْدُ اللَّهِ قَالَ أَخْبَرَنَا صَالِحُ بْنُ حَيٍّ أَنَّ رَجُلًا مِنْ أَهْلِ خُرَاسَانَ قَالَ

لِلشَّعْبِيِّ إِنَّا نَقُولُ عِنْدَنَا إِنَّ الرَّجُلَ إِذَا أَعْتَقَ أُمَّ وَلَدِهِ ثُمَّ تَزَوَّجَهَا فَهُوَ كَالرَّاكِبِ هَدْيَهُ قَالَ الشَّعْبِيُّ أَخْبَرَنِي أَبُو بُرْدَةَ عَنْ أَبِي مُوسَى قَالَ قَالَ رَسُولُ اللَّهِ ﷺ «إِذَا أَدَّبَ الرَّجُلُ أَمَتَهُ وَأَحْسَنَ تَأْدِيبَهَا وَعَلَّمَهَا فَأَحْسَنَ تَعْلِيمَهَا ثُمَّ أَعْتَقَهَا وَتَزَوَّجَهَا كَانَ لَهُ أَجْرَانِ وَإِذَا آمَنَ الرَّجُلُ بِعِيسَى ثُمَّ آمَنَ بِي فَلَهُ أَجْرَانِ وَالْعَبْدُ إِذَا اتَّقَى رَبَّهُ وَأَطَاعَ مَوَالِيَهُ فَلَهُ أَجْرَانِ»  

ذِكْرُ الْإِبَاحَةِ لِلْإِمَامِ أَنْ يُزَوِّجَ بِالْمُكَاتَبَةِ إِذَا جَعَلَ صَدَاقَهَا أَدَاءَ مَا كُوتِبَتْ عَلَيْهِ

[Machine] When the Prophet ﷺ captured the captives of Banu Mustaliq, Juwayriyah bint al-Harith fell into the share of Thabit bin Qais bin Shammas or his cousin. She wrote a document on herself, as she was a beautiful and captivating woman whom no one could see without desiring her. She went to seek the help of the Prophet ﷺ in writing her release. I swear by Allah, I only went and stood at the door of the Prophet's room because I hated being seen by him. I knew that if he saw her, he would feel the same way I felt. Juwayriyah said, "O Messenger of Allah! It was a matter that you already know about, so I wrote a document on myself and came to seek your help." The Prophet ﷺ said, "Is there anything better than that?" She asked, "What is it?" He said, "I will marry you and release you from writing the document." She said, "Yes." He said, "I have done so." The Muslims heard about this and said, "The Prophet's in-laws have sent what they had in their hands from the captives of Banu Mustaliq." Juwayriyah said, "Indeed, the marriage with the Prophet ﷺ liberated one hundred households of Banu Mustaliq." She said, "I do not know of any woman who brought more blessings to her people than me."  

ابن حبّان:٤٠٥٤أَخْبَرَنَا عَبْدُ اللَّهِ بْنُ مُحَمَّدٍ الْأَزْدِيُّ قَالَ حَدَّثَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ* قَالَ أَخْبَرَنَا وَهْبُ بْنُ جَرِيرٍ قَالَ حَدَّثَنَا أَبِي قَالَ سَمِعْتُ مُحَمَّدَ بْنَ إِسْحَاقَ يَقُولُ حَدَّثَنِي مُحَمَّدُ بْنُ جَعْفَرِ بْنِ الزُّبَيْرِ عَنْ عُرْوَةَ عَنْ عَائِشَةَ قَالَتْ

لَمَّا سَبَى رَسُولُ اللَّهِ ﷺ سَبَايَا بَنِي الْمُصْطَلِقِ وَقَعَتْ جُوَيْرِيَةُ بِنْتُ الْحَارِثِ فِي السَّهْمِ لِثَابِتِ بْنِ قَيْسِ بْنِ الشَّمَّاسِ أَوْ لِابْنِ عَمِّهِ فَكَاتَبَتْ عَلَى نَفْسِهَا وَكَانَتِ امْرَأَةً حُلْوَةً مُلَاحَةً لَا يَكَادُ يَرَاهَا أَحَدٌ إِلَّا أَخَذَتْ بِنَفْسِهِ فَأَتَتْ رَسُولَ اللَّهِ ﷺ تَسْتَعِينُهُ فِي كِتَابَتِهَا فَوَاللَّهِ مَا هُوَ إِلَّا أَنْ وَقَفَتْ عَلَى بَابِ الْحُجْرَةِ فَرَأَيْتُهَا كَرِهْتُهَا وَعَرَفْتُ أَنَّ رَسُولَ اللَّهِ ﷺ سَيَرَى مِنْهَا مِثْلَ مَا رَأَيْتُ فَقَالَتْ جُوَيْرِيَةُ يَا رَسُولَ اللَّهِ ? كَانَ مِنَ الْأَمْرِ مَا قَدْ عَرَفْتَ فَكَاتَبْتُ نَفْسِي فَجِئْتُ رَسُولَ اللَّهِ ﷺ أَسْتَعِينُهُ فَقَالَ رَسُولُ اللَّهِ ﷺ «أَوَ مَا هُوَ خَيْرٌ مِنْ ذَلِكَ؟ » فَقَالَتْ وَمَا هُوَ؟ قَالَ «أَتَزَوَّجُكِ وَأَقْضِيَ عَنْكِ كِتَابَتَكِ» فَقَالَتْ نَعَمْ قَالَ «قَدْ فَعَلْتُ» قَالَتْ فَبَلَغَ الْمُسْلِمِينَ ذَلِكَ قَالُوا أَصْهَارُ رَسُولِ اللَّهِ ﷺ فَأَرْسَلُوا مَا كَانَ فِي أَيْدِيهِمْ مِنْ سَبَايَا بَنِي الْمُصْطَلِقِ قَالَتْ فَلَقَدْ عُتِقَ بِتَزْوِيجِهِ مِائَةُ أَهْلِ بَيْتٍ مِنْ بَنِي الْمُصْطَلِقِ قَالَتْ فَمَا أَعْلَمُ امْرَأَةً كَانَتْ أَعْظَمَ بَرَكَةً عَلَى قَوْمِهَا مِنْهَا «  

ذِكْرُ السَّبَبِ الَّذِي مِنْ أَجْلِهِ تَزَوَّجَ رَسُولُ اللَّهِ ﷺ جُوَيْرِيَةَ بِنْتَ الْحَارِثِ

[Machine] When the Messenger of Allah ﷺ captured the prisoners of Banu al-Mustaliq, Juwayriyah bint al-Harith fell into the portion of Thabit ibn Qays ibn Shammash or his cousin. She wrote a contract for her freedom and she was a very beautiful woman whom hardly anyone could resist. She went to the Messenger of Allah ﷺ seeking his assistance in the matter. By Allah, it was not long before she stood by the door of his room and I disliked her for that, and I knew that the Messenger of Allah ﷺ would see in her what I saw. Juwayriyah said, "O Messenger of Allah, there is something you may not know about, so I wrote a contract for myself and came to you seeking your help." The Messenger of Allah ﷺ said, "Is there anything better than that?" She asked, "What is it?" He replied, "I will marry you and pay off your contract." She said, "Yes." He said, "I have done so." When the news reached the Muslims, they said, "The Messenger of Allah's in-laws" and they immediately released the prisoners they had from Banu al-Mustaliq. The Messenger of Allah ﷺ indeed emancipated a hundred families of Banu al-Mustaliq through marrying Juwayriyah. She said, "I do not know of any woman who brought greater blessing to her people than me."  

ابن حبّان:٤٠٥٥أَخْبَرَنَا عَبْدُ اللَّهِ بْنُ مُحَمَّدٍ الْأَزْدِيُّ قَالَ حَدَّثَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ الْحَنْظَلِيُّ قَالَ أَخْبَرَنَا وَهْبُ بْنُ جَرِيرٍ قَالَ حَدَّثَنَا أَبِي قَالَ سَمِعْتُ ابْنَ إِسْحَاقَ يَقُولُ حَدَّثَنِي مُحَمَّدُ بْنُ جَعْفَرِ بْنِ الزُّبَيْرِ عَنْ عُرْوَةَ عَنْ عَائِشَةَ قَالَتْ

لَمَّا سَبَى رَسُولُ اللَّهِ ﷺ سَبَايَا بَنِي الْمُصْطَلِقِ وَقَعَتْ جُوَيْرِيَةُ بِنْتُ الْحَارِثِ فِي سَهْمٍ لِثَابِتِ بْنِ قَيْسِ بْنِ شَمَّاسٍ أَوْ لِابْنِ عَمِّهِ فَكَاتَبَتْ عَلَى نَفْسِهَا وَكَانَتِ امْرَأَةً حُلْوَةً لَا يَكَادُ يَرَاهَا أَحَدٌ إِلَّا أَخَذَتْ بِنَفْسِهِ فَأَتَتْ رَسُولَ اللَّهِ ﷺ تَسْتَعِينُهُ فِي كِتَابَتِهَا فَوَاللَّهِ مَا هُوَ إِلَّا أَنْ وَقَفَتْ عَلَى بَابِ الْحُجْرَةِ فَرَأَيْتُهَا كَرِهْتُهَا وَعَرَفْتُ أَنَّ رَسُولَ اللَّهِ ﷺ سَيَرَى مِنْهَا مَا رَأَيْتُ فَقَالَتْ جُوَيْرِيَةُ يَا رَسُولَ اللَّهِ كَانَ مِنَ الْأَمْرِ مَا قَدْ عَرَفْتَ فَكَاتَبْتُ عَلَى نَفْسِي فَجِئْتُ رَسُولَ اللَّهِ ﷺ أَسْتَعِينُهُ فَقَالَ رَسُولُ اللَّهِ ﷺ «أَوَ مَا هُوَ خَيْرٌ مِنْ ذَلِكَ؟ » فَقَالَتْ وَمَا هُوَ؟ فَقَالَ «أَتَزَوَّجُكِ وَأَقْضِي عَنْكِ كِتَابَتَكِ» فَقَالَتْ نَعَمْ قَالَ «قَدْ فَعَلْتُ» فَلَمَّا بَلَغَ الْمُسْلِمِينَ ذَلِكَ قَالُوا أَصْهَارُ رَسُولِ اللَّهِ ﷺ فَأَرْسَلُوا مَا كَانَ فِي أَيْدِيهِمْ مِنْ سَبَايَا بَنِي الْمُصْطَلِقِ فَلَقَدْ عُتِقَ بِتَزْوِيجِهِ مِائَةُ أَهْلِ بَيْتٍ مِنْ بَنِي الْمُصْطَلِقِ قَالَتْ «فَمَا أَعْلَمُ امْرَأَةً كَانَتْ أَعْظَمَ بَرَكَةً عَلَى قَوْمِهَا مِنْهَا» *  

ذِكْرُ الزَّجْرِ عَنْ تَزْوِيجِ الرَّجُلِ مِنَ النِّسَاءِ مَنْ لَا تَلِدُ

A man came to the Prophet ﷺ and said: I have found a woman of rank and beauty, but she does not give birth to children. Should I marry her? He said: No. He came again to him, but he prohibited him. He came to him third time, and he (the Prophet) said: Marry women who are loving and very prolific, for I shall outnumber the peoples by you. (Using translation from Abū Dāʾūd 2050)   

ابن حبّان:٤٠٥٦أَخْبَرَنَا أَحْمَدُ بْنُ مُكْرَمِ بْنِ خَالِدٍ الْبِرْتِيُّ قَالَ حَدَّثَنَا عَلِيُّ بْنُ الْمَدِينِيِّ قَالَ حَدَّثَنَا يَزِيدُ بْنُ هَارُونَ قَالَ أَخْبَرَنَا الْمُسْتَلِمُ بْنُ سَعِيدٍ عَنْ مَنْصُورِ بْنِ زَاذَانَ عَنْ مُعَاوِيَةَ بْنِ قُرَّةَ عَنْ مَعْقِلِ بْنِ يَسَارٍ قَالَ

جَاءَ رَجُلٌ إِلَى رَسُولِ اللَّهِ ﷺ فَقَالَ يَا رَسُولَ اللَّهِ إِنِّي أَصَبْتُ امْرَأَةً ذَاتَ حَسَبٍ وَجَمَالٍ وَلَكِنَّهَا لَا تَلِدُ أَفَأَتَزَوَّجُهَا؟ فَنَهَاهُ ثُمَّ أَتَاهُ الثَّانِيَةَ فَقَالَ مِثْلَ ذَلِكَ فَنَهَاهُ ثُمَّ أَتَاهُ الثَّالِثَةَ فَقَالَ مِثْلَ ذَلِكَ فَقَالَ ﷺ «تَزَوَّجُوا الْوَدُودَ الْوَلُودَ فَإِنِّي مُكَاثِرٌ بِكُمْ»  

ذِكْرُ الزَّجْرِ عَنْ أَنْ يَتَزَوَّجَ الْمَرْءُ مِنَ النِّسَاءِ مَنْ لَا تَلِدُ

A man came to the Prophet ﷺ and said: I have found a woman of rank and beauty, but she does not give birth to children. Should I marry her? He said: No. He came again to him, but he prohibited him. He came to him third time, and he (the Prophet) said: Marry women who are loving and very prolific, for I shall outnumber the peoples by you. (Using translation from Abū Dāʾūd 2050)

ذِكْرُ إِبَاحَةِ تَزْوِيجِ الْمَرْءِ الْمَرْأَةَ فِي شَوَّالٍ ضِدَّ قَوْلِ مَنْ كَرِهَهُ

[Machine] That the Messenger of Allah ﷺ married her in Shawwal and consummated the marriage in Shawwal, so she became the most beloved of his wives.

أَنَّ رَسُولَ اللَّهِ ﷺ «تَزَوَّجَهَا فِي شَوَّالٍ وَبَنَى بِهَا فِي شَوَّالٍ فَأَيُّ نِسَائِهِ كَانَ أَحْظَى عِنْدَهُ»  

ذِكْرُ إِبَاحَةِ الْإِمَامِ أَنْ يَخْطُبَ إِلَى مَنْ أَحَبَّ عَلَى مَنْ أَحَبَّ مِنْ رَعِيَّتِهِ

[Machine] The Messenger of Allah ﷺ proposed to a woman from the Ansar, and her father agreed. However, her mother refused. So, the Prophet ﷺ went to his wife and mentioned it to her, and she said, "By Allah, will you do that when we have forbidden her to marry such and such men?" The Prophet ﷺ asked the young girl if she would accept his proposal if he agreed. She replied, "If the Messenger of Allah ﷺ desires it, then I will marry him." Her father went to the Prophet ﷺ and said, "If you are pleased with her, we are pleased with her." The Prophet ﷺ replied, "I am pleased with her," and he married her. Later, the people of Madinah were startled when the wife of Juleibib went out and found her husband killed, with slain disbelievers lying beside him. Anas ibn Malik said, "I have never seen anyone in Madinah who spent more in charity than Thayyib."

«خَطَبَ رَسُولُ اللَّهِ ﷺ عَلَى جُلَيْبِيبٍ امْرَأَةً مِنَ الْأَنْصَارِ إِلَى أَبِيهَا قَالَ حَتَّى أَسْتَأْمِرَ أُمَّهَا قَالَ فَنَعَمْ إِذًا فَذَهَبَ إِلَى امْرَأَتِهِ فَذَكَرَ ذَلِكَ لَهَا فَقَالَتْ لَا هَا اللَّهِ إِذًا وَقَدْ مَنَعْنَاهَا فُلَانًا وَفُلَانًا قَالَ وَالْجَارِيَةُ فِي سِتْرِهَا تَسْمَعُ فَقَالَتِ الْجَارِيَةُ أَتَرُدُّونَ عَلَى رَسُولِ اللَّهِ ﷺ أَمْرَهُ إِنْ كَانَ قَدْ رَضِيَهُ لَكُمْ فَأَنْكِحُوهُ قَالَ فَكَأَنَّهَا حَلَّتْ عَنْ أَبَوَيْهَا فَقَالَا صَدَقْتِ فَذَهَبَ أَبُوهَا إِلَى رَسُولِ اللَّهِ ﷺ فَقَالَ إِنْ رَضِيتَهُ لَنَا رَضِينَاهُ فَقَالَ إِنِّي أَرْضَاهُ فَزَوَّجَهَا فَفَزِعَ أَهْلُ الْمَدِينَةِ وَخَرَجَتْ امْرَأَةُ جُلَيْبِيبٍ فِيهَا فَوَجَدَتْ زَوْجَهَا وَقَدْ قُتِلَ وَتَحْتَهُ قَتْلَى مِنَ الْمُشْرِكِينَ قَدْ قَتَلَهُمْ قَالَ أَنَسُ بْنُ مَالِكٍ فَمَا رَأَيْتُ بِالْمَدِينَةِ ثَيِّبًا أَنْفَقَ مِنْهَا  

ذِكْرُ الْأَمْرِ لِلْمُتَزَوِّجِ بِالْوَلِيمَةِ وَلَوْ بِشَاةٍ

"How much did you give her?" He said: "A Nawah (five Dirhams) of gold." The Messenger of Allah said: "Give a Walimah (wedding feast) even if it is with one sheep." (Using translation from Nasāʾī 3351)  

ابن حبّان:٤٠٦٠أَخْبَرَنَا عُمَرُ بْنُ سَعِيدِ بْنِ سِنَانٍ وَالْحُسَيْنُ بْنُ إِدْرِيسَ قَالَا حَدَّثَنَا أَحْمَدُ بْنُ أَبِي بَكْرٍ عَنْ مَالِكٍ عَنْ حُمَيْدٍ الطَّوِيلِ عَنْ أَنَسِ بْنِ مَالِكٍ

أَنَّ عَبْدَ الرَّحْمَنِ بْنَ عَوْفٍ جَاءَ إِلَى رَسُولِ اللَّهِ ﷺ وَبِهِ أَثَرُ صُفْرَةٍ فَسَأَلَهُ رَسُولُ اللَّهِ ﷺ فَأَخْبَرَهُ أَنَّهُ تَزَوَّجَ امْرَأَةً مِنَ الْأَنْصَارِ فَقَالَ لَهُ رَسُولُ اللَّهِ ﷺ «كَمْ سُقْتَ إِلَيْهَا» قَالَ زِنَةُ نَوَاةٍ مِنْ ذَهَبٍ فَقَالَ لَهُ رَسُولُ اللَّهِ ﷺ «أَوْلِمْ وَلَوْ بِشَاةٍ»  

ذِكْرُ الْخَبَرِ الدَّالِّ عَلَى أَنَّ هَذَا الْأَمْرَ أَمْرُ نَدْبٍ لَا حَتْمٍ

The Prophet ﷺ held a wedding feast for Safiyyah with meal and dates. (Using translation from Abū Dāʾūd 3744)

أَنَّ النَّبِيَّ ﷺ «أَوْلَمَ عَلَى صَفِيَّةَ بِسَوِيقٍ وَتَمْرٍ»  

ذِكْرُ مَا أَوْلَمَ بِهِ ﷺ عَلَى زَيْنَبَ بِنْتِ جَحْشٍ حِينَ بَنَى بِهَا

[Machine] "Did not the Messenger of Allah ﷺ make provision for the Muslims with bread and meat, just as he used to do when he got married and visited the homes of the Mothers of the Believers, greeted them, and prayed for them? Then he returned and I was with him. When we reached the house, we saw two men discussing a matter near the house. When they saw him, they turned away and Allah revealed the verse of the hijab."  

ابن حبّان:٤٠٦٢أَخْبَرَنَا الْفَضْلُ بْنُ الْحُبَابِ قَالَ حَدَّثَنَا مُسَدَّدٌ عَنْ يَحْيَى عَنْ حُمَيْدٍ عَنْ أَنَسٍ قَالَ

«أَوْلَمَ رَسُولُ اللَّهِ ﷺ فَأَوْسَعَ الْمُسْلِمِينَ خُبْزًا وَلَحْمًا كَمَا كَانَ يَصْنَعُ إِذَا تَزَوَّجَ فَأَتَى حُجْرَ أُمِّهَاتِ الْمُؤْمِنِينَ فَسَلَّمَ عَلَيْهِنَّ وَيَدْعُونَ لَهُ ثُمَّ رَجَعَ وَأَنَا مَعَهُ فَلَمَّا انْتَهَيْنَا إِلَى الْبَيْتِ إِذَا رَجُلَانِ يَذْكُرَانِ بَيْنَهُمَا الْحَدِيثَ فِي نَاحِيَةِ الْبَيْتِ فَلَمَّا أَبْصَرَهُمَا وَلَّى رَاجِعًا وَأَنْزَلَ اللَّهُ آيَةَ الْحِجَابِ»  

ذِكْرُ اسْتِعْمَالِ الْمُصْطَفَى ﷺ الْحَيْسَ عِنْدَ تَزْوِيجِهِ صَفِيَّةَ

ibnhibban:4063al-Faḍl b. al-Ḥubāb > ʿImrān b. Maysarah > ʿAbd al-Wārith b. Saʿīd > Shuʿayb b. al-Ḥabḥāb > Anas b. Mālik

Messenger of Allah ﷺ manumitted Safiyya and then married her, and her Mahr was her manumission, and he gave a wedding banquet with Hais (a sort of sweet dish made from butter, cheese and dates). (Using translation from Bukhārī 5169)

أَنَّ رَسُولَ اللَّهِ ﷺ «أَعْتَقَ صَفِيَّةَ وَجَعَلَ عِتْقَهَا صَدَاقَهَا وَأَوْلَمَ عَلَيْهَا بِحَيْسٍ»

[Machine] The Prophet ﷺ said, "O sons of Bayadhah, marry Abu Hind and give your daughters in marriage to him." He was a cupper.

أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «يَا بَنِي بَيَاضَةَ أَنْكِحُوا أَبَا هِنْدٍ وَانْكِحُوا إِلَيْهِ» وَكَانَ حَجَّامًا  

ذِكْرُ الزَّجْرِ عَنْ سُؤَالِ الْمَرْأَةِ الرَّجُلَ طَلَاقَ أُخْتِهَا لِتَكْتَفِئَ مَا فِي صَحْفَتِهَا

One should not combine in marriage a woman with her father's sister, or her mother's sister. (Using translation from Muslim 1408e)  

ابن حبّان:٤٠٦٨أَخْبَرَنَا عَبْدُ اللَّهِ بْنُ مُحَمَّدِ بْنِ سَلْمٍ قَالَ حَدَّثَنَا مُحَمَّدُ بْنُ عَبْدِ الْأَعْلَى الصَّنْعَانِيُّ بِمَكَّةَ قَالَ حَدَّثَنَا الطُّفَاوِيُّ قَالَ حَدَّثَنَا أَيُّوبُ عَنْ مُحَمَّدٍ عَنْ أَبِي هُرَيْرَةَ قَالَ

قَالَ رَسُولُ اللَّهِ ﷺ «لَا تُنْكَحُ الْمَرْأَةُ عَلَى عَمَّتِهَا وَلَا عَلَى خَالَتِهَا وَلَا تَسْأَلُ الْمَرْأَةُ طَلَاقَ أُخْتِهَا لِتَكْتَفِئَ مَا فِي صَحْفَتِهَا فَإِنَّ لَهَا مَا كُتِبَ لَهَا»  

ذِكْرُ الْبَيَانِ بِأَنَّ الْمَرْأَةَ إِذَا وَقَعَ فِي خَلَدِهَا بَعْضُ مَا ذَكَرْتُ لَهَا، أَنْ تَنْكِحَ دُونَ سُؤَالِهَا طَلَاقَ أُخْتِهَا

Messenger of Allah ﷺ said, "No woman should ask for the divorce of her sister (Muslim) so as to take her place, but she should marry the man (without compelling him to divorce his other wife), for she will have nothing but what Allah has written for her." (Using translation from Bukhārī 6601)  

ابن حبّان:٤٠٦٩أَخْبَرَنَا الْحُسَيْنُ بْنُ إِدْرِيسَ قَالَ أَخْبَرَنَا أَحْمَدُ بْنُ أَبِي بَكْرٍ عَنْ مَالِكٍ عَنْ أَبِي الزِّنَادِ عَنِ الْأَعْرَجِ عَنْ أَبِي هُرَيْرَةَ

أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «لَا تَسْأَلِ الْمَرْأَةُ طَلَاقَ أُخْتِهَا لِتَسْتَفْرِغَ مَا فِي صَحْفَتِهَا وَلِتُنْكَحَ فَإِنَّ لَهَا مَا قُدِّرَ لَهَا»  

ذِكْرُ الْعِلَّةِ الَّتِي مِنْ أَجَلِهَا زَجَرَ عَنْ هَذَا الْفِعْلِ

[Machine] The Messenger of Allah ﷺ said, "A woman should not ask for the divorce of her sister in order to empty what is in her dowry, for indeed, a Muslim woman is the sister of a Muslim woman."  

ابن حبّان:٤٠٧٠أَخْبَرَنَا ابْنُ سَلْمٍ* قَالَ حَدَّثَنَا عَبْدُ الرَّحْمَنِ بْنُ إِبْرَاهِيمَ قَالَ حَدَّثَنَا الْوَلِيدُ بْنُ مُسْلِمٍ قَالَ أَخْبَرَنَا الْأَوْزَاعِيُّ قَالَ حَدَّثَنَا أَبُو كَثِيرٍ السُّحَيْمِيُّ أَنَّهُ سَمِعَ أَبَا هُرَيْرَةَ يَقُولُ

قَالَ رَسُولُ اللَّهِ ﷺ «لَا تَسْأَلِ الْمَرْأَةُ طَلَاقَ أُخْتِهَا لِتَسْتَفْرِغَ مَا فِي صَحْفَتِهَا فَإِنَّ الْمُسْلِمَةَ أُخْتُ الْمُسْلِمَةِ»

[Machine] The Messenger of Allah ﷺ said, "A man should not be envious of his brother's fasting, nor should he propose to marry the woman his brother has proposed to, and a woman should not ask for the divorce of her sister in order to benefit from what is in her dowry."  

ابن حبّان:٤٠٤٦أَخْبَرَنَا أَحْمَدُ بْنُ يَحْيَى بْنِ زُهَيْرٍ قَالَ حَدَّثَنَا مُحَمَّدُ بْنُ أَحْمَدَ بْنِ زَيْدٍ قَالَ أَخْبَرَنَا عُمَرُ بْنُ عَاصِمٍ قَالَ حَدَّثَنَا شُعْبَةُ عَنْ دَاوُدَ بْنِ فَرَاهِيجَ عَنْ أَبِي هُرَيْرَةَ قَالَ

قَالَ رَسُولُ اللَّهِ ﷺ «لَا يَسْتَامُ الرَّجُلُ عَلَى سَوْمِ أَخِيهِ وَلَا يَخْطُبُ الرَّجُلُ عَلَى خِطْبَةِ أَخِيهِ وَلَا تَسْأَلُ الْمَرْأَةَ طَلَاقَ أُخْتِهَا لِتَكْتَفِئَ مَا فِي صَحْفَتِهَا»

It was narrated from Abu Hurairah that the Prophet said: "None of you should propose marriage to a woman when someone else has already proposed to her." (Using translation from Nasāʾī 3240)

أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «لَا يَخْطُبْ أَحَدُكُمْ عَلَى خِطْبَةِ أَخِيهِ»

[Machine] Um Salama, the wife of the Prophet ﷺ , informed him that when she arrived in Madinah, she told the people that she was the daughter of Abu Umamah ibn al-Mughirah. However, they accused her of lying and said, "What strange lies!" Then, some people from them started to perform Hajj, and they said to her, "Write to your family." So, she wrote with them, and they returned to Madinah, believing her. Consequently, their respect for her increased. She said, "When I gave birth to Zainab, the Prophet ﷺ came to me proposing marriage. I said, 'Women like me are not married. Moreover, I am jealous and have children.' He ﷺ said, 'I am older than you, and as for the jealousy, Allah will remove it, and as for the children, it is up to Allah and His Messenger.' Therefore, the Messenger of Allah ﷺ married her and said, 'I will visit you tonight.' She said, 'I took out some barley grains from my bag and some fat, and I separated them for him.' He spent the night there, and in the morning he said, 'You have brought honor to your family. If you wish, I will maintain you and if you wish, I will maintain your spouse.'"  

ابن حبّان:٤٠٦٥أَخْبَرَنَا أَحْمَدُ بْنُ عَلِيِّ بْنِ الْمُثَنَّى حَدَّثَنَا أَبُو خَيْثَمَةَ حَدَّثَنَا رَوْحُ بْنُ عُبَادَةَ حَدَّثَنَا ابْنُ جُرَيْجٍ أَخْبَرَنِي حَبِيبُ بْنُ أَبِي ثَابِتٍ أَنَّ عَبْدَ الْحَمِيدِ بْنَ عَبْدِ اللَّهِ بْنِ أَبِي عُمَرَ وَالْقَاسِمَ بْنَ مُحَمَّدِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ هِشَامٍ أَخْبَرَاهُ أَنَّهُمَا سَمِعَا أَبَا بَكْرِ بْنَ عَبْدِ الرَّحْمَنِ بْنِ الْحَارِثِ بْنِ هِشَامٍ يُخْبِرُ

أَنَّ أُمَّ سَلَمَةَ زَوْجَ النَّبِيِّ ﷺ أَخْبَرَتْهُ أَنَّهَا لَمَّا قَدِمَتِ الْمَدِينَةَ أَخْبَرَتْهُمْ أَنَّهَا بِنْتُ أَبِي أُمَيَّةَ بْنِ الْمُغِيرَةَ فَكَذَّبُوهَا وَجَعَلُوا يَقُولُونَ مَا أَكْذَبَ الْغَرَائِبَ ثُمَّ أَنْشَأَ نَاسٌ مِنْهُمُ الْحَجَّ فَقَالُوا تَكْتُبِينَ إِلَى أَهْلِكِ فَكَتَبْتُ مَعَهُمْ فَرَجَعُوا إِلَى الْمَدِينَةِ فَصَدَّقُوهَا فَازْدَادَتْ عَلَيْهِمْ كَرَامَةً فَقَالَتْ لَمَّا وَضَعْتُ زَيْنَبَ جَاءَنِي النَّبِيُّ ﷺ يَخْطُبُنِي فَقُلْتُ مَثَلِي لَا يُنْكَحُ أَمَا أَنَّا فَلَا وَلَدَ فِيَّ وَأَنَا غَيُورٌ ذَاتُ عِيَالٍ قَالَ ﷺ «أَنَا أَكْبَرُ مِنْكِ وَأَمَّا الْغَيْرَةُ فَيُذْهِبُهَا اللَّهُ وَأَمَّا الْعِيَالُ فَإِلَى اللَّهِ وَإِلَى رَسُولِهِ» فَتَزَوَّجَهَا رَسُولُ اللَّهِ ﷺ وَقَالَ «إِنِّي آتِيكُمُ اللَّيْلَةَ» قَالَتْ فَأَخْرَجْتُ حَبَّاتٍ مِنْ شَعِيرٍ كَانَتْ فِي جَرَّتِي وَأَخْرَجْتُ شَحْمًا فَعَصَدْتُ لَهُ قَالَ فَبَاتَ ثُمَّ أَصْبَحَ فَقَالَ حِينَ أَصْبَحَ «إِنَّ بِكِ عَلَى أَهْلِكِ كَرَامَةً إِنْ شِئْتِ سَبَّعْتُ لَكِ وَإِنَّ أُسَبِّعْ لَكِ أُسَبِّعُ لِنِسَائِي»

أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «أَعْلِنُوا النِّكَاحَ»

[Machine] His sister was under a man, then he divorced her and kept away from her until her waiting period expired. Then he approached to propose to her, but a fortification prevented him from it, and he said, "He kept away from her while he was able to marry her." So, something happened between him and her, and Allah revealed (And when you divorce women and they have fulfilled their term, do not prevent them from remarrying their [former] husbands if they agree among themselves on an acceptable basis) [Quran 2:232].

كَانَتْ أُخْتُهُ تَحْتَ رَجُلٍ فَطَلَّقَهَا ثُمَّ خَلَّى عَنْهَا حَتَّى انْقَضَتْ عِدَّتُهَا ثُمَّ قَرَّبَ يَخْطُبُهَا فَحَمِيَ مَعْقِلٌ مِنْ ذَلِكَ وَقَالَ خَلَّى عَنْهَا وَهُوَ يَقْدِرُ عَلَيْهَا فَحَالَ بَيْنَهُ وَبَيْنَهَا فَأَنْزَلَ اللَّهُ {وَإِذَا طَلَّقْتُمِ النِّسَاءَ فَبَلَغْنَ أَجَلَهُنَّ فَلَا تَعْضُلُوهُنَّ أَنْ يَنْكِحْنَ أَزْوَاجَهُنَّ إِذَا تَرَاضَوْا بَيْنَهُمْ بِالْمَعْرُوفِ}  

ذِكْرُ الْإِبَاحَةِ لِلْإِمَامِ أَنْ يُزَوِّجَ الْمَرْأَةَ الَّتِي لَا يَكُونُ لَهَا وَلِيٌّ غَيْرُهُ مَنْ رَضِيَتْ مِنَ الرِّجَالِ، وَإِنْ لَمْ يَفْرِضِ الصَّدَاقَ فِي وَقْتِ الْعَقْدِ

[Machine] The Messenger of Allah ﷺ said, "The best marriage is the easiest one." And the Prophet ﷺ said to a man, "Would you be pleased if I married you to so-and-so?" He replied, "Yes." Then he asked her, "Would you be pleased if I married you to so-and-so?" She replied, "Yes." So the Messenger of Allah ﷺ married them without imposing a dowry. He entered upon her but did not give her anything. When her death approached, she said, "Indeed, the Messenger of Allah ﷺ married me to so-and-so and did not give me anything, while I was given my share from Khaybar. He had a share in Khaybar, so she took it and sold it for a hundred thousand."  

ابن حبّان:٤٠٧٢أَخْبَرَنَا أَبُو عَرُوبَةَ بِحَرَّانَ قَالَ حَدَّثَنَا هَاشِمُ بْنُ الْقَاسِمِ الْحَرَّانِيُّ قَالَ حَدَّثَنَا مُحَمَّدُ بْنُ سَلَمَةَ عَنْ أَبِي عَبْدِ الرَّحِيمِ عَنْ زَيْدِ بْنِ أَبِي أُنَيْسَةَ عَنْ يَزِيدَ بْنِ أَبِي حَبِيبٍ عَنْ مَرْثَدِ بْنِ عَبْدِ اللَّهِ الْيَزَنِيُّ عَنْ عُقْبَةَ بْنِ عَامِرٍ قَالَ

قَالَ رَسُولُ اللَّهِ ﷺ «خَيْرُ النِّكَاحِ أَيْسَرُهُ وَقَالَ النَّبِيُّ ﷺ لِرَجُلٍ » أَتَرْضَى أَنْ أُزَوِّجَكَ فُلَانَةً «قَالَ نَعَمْ قَالَ لَهَا أَتَرْضَيْنَ أَنْ أُزَوِّجَكَ فُلَانًا» قَالَتْ نَعَمْ فَزَوَّجَهَا رَسُولُ اللَّهِ ﷺ وَلَمْ يَفْرِضْ صَدَاقًا فَدَخَلَ بِهَا فَلَمْ يُعْطِهَا شَيْئًا فَلَمَّا حَضَرَتْهُ الْوَفَاةُ قَالَ إِنَّ رَسُولَ اللَّهِ ﷺ زَوَّجَنِي فُلَانَةً وَلَمْ أَعْطِهَا شَيْئًا وَقَدْ أُعْطِيتُهَا سَهْمِي مِنْ خَيْبَرَ فَكَانَ لَهُ سَهْمٌ بِخَيْبَرَ فَأَخَذَتْهُ فَبَاعَتْهُ فَبَلَغَ مِائَةَ أَلْفٍ «  

ذِكْرُ الزَّجْرِ عَنْ أَنْ يُزَوِّجَ الْوَلِيُّ الْمَرْأَةَ بِغَيْرِ صَدَاقِ عَدْلٍ يَكُونُ بَيْنَهُمَا

" If you fear that you will not be able to maintain equity amongst the orphan girls, then marry (those) you like from amongst the women two, three or four." She said: O, the son of my sister, the orphan girl is one who is under the patronage of her guardian and she shares with him in his property and her property and beauty fascinate him and her guardian makes up his mind to marry her without giving her due share of the wedding money and is not prepared (to pay so much amount) which anyone else is prepared to pay and so Allah has forbidden to marry these girls but in case when equity is observed as regards the wedding money and they are prepared to pay them the full amount of the wedding money and Allah commanded to marry other women besides them according to the liking of their heart. 'Urwa reported that 'A'isha said that people began to seek verdict from Messenger of Allah ﷺ after the revelation of this verse about them (orphan girls) and Allah, the Exalted and Glorious, revealed this verse:" They asked thee verdict about women; say: Allah gives verdict to you in regard to them and what is recited to you in the Book about orphan woman, whom you give not what is ordained for them while you like to marry them" (iv. 126). She said: The wording of Allah" what is recited to you" in the Book means the first verse, i. e." if you fear that you may not be able to observe equity in case of an orphan woman, marry what you like in case of woman" (iv. 3). 'A'isha said: (And as for this verse [iv. 126], i. e. and you intend" to marry one of them from amongst the orphan girls" it pertains to one who is in charge (of orphans) having small amount of wealth and less beauty and they have been forbidden that they should marry what they like of her wealth and beauty out of the orphan girls, but with equity, because of their disliking for them. ابن حبّان:٤٠٧٣أَخْبَرَنَا ابْنُ قُتَيْبَةَ قَالَ حَدَّثَنَا حَرْمَلَةُ قَالَ حَدَّثَنَا ابْنُ وَهْبٍ قَالَ أَخْبَرَنَا يُونُسُ عَنِ ابْنِ شِهَابٍ قَالَ حَدَّثَنِي عُرْوَةُ بْنُ الزُّبَيْرِ أَنَّهُ سَأَلَ عَائِشَةَ

عَنْ قَوْلِ اللَّهِ {وَإِنْ خِفْتُمْ أَلَّا تُقْسِطُوا فِي الْيَتَامَى فَانْكِحُوا مَا طَابَ لَكُمْ مِنَ النِّسَاءِ مَثْنَى وَثَلَاثَ وَرُبَاعَ} قَالَتْ «يَا ابْنَ أُخْتِي هَذِهِ الْيَتِيمَةُ تَكُونُ فِي حِجْرِ وَلِيِّهَا تُشَارِكُهُ فِي مَالِهِ فَيُعْجِبُهُ مَالُهَا وَجَمَالُهَا فَيُرِيدُ وَلِيِّهَا أَنْ يَتَزَوَّجَهَا بِغَيْرِ أَنْ يُقْسِطَ فِي صَدَاقِهَا فَيُعْطِيَهَا مِثْلَ مَا يُعْطِيَهَا غَيْرُهُ فَنُهُوا أَنْ يَنْكِحُوهُنَّ إِلَّا أَنْ يُقْسِطُوا لَهُنَّ مَهْرًا أَعْلَى سُنَّتِهِنَّ مِنَ الصَّدَاقِ وَأُمِرُوا أَنْ يَنْكِحُوا مَا طَابَ لَهُمْ مِنَ النِّسَاءِ سِوَاهُنَّ» قَالَ عُرْوَةُ قَالَتْ عَائِشَةُ ثُمَّ إِنَّ النَّاسَ اسْتَفْتَوْا بَعْدَ هَذِهِ الْآيَةِ فِيهِمْ فَأَنْزَلَ اللَّهُ {يَسْتَفْتُونَكَ فِي النِّسَاءِ قُلِ اللَّهُ يُفْتِيكُمْ فِيهِنَّ وَمَا يُتْلَى عَلَيْكُمْ فِي الْكِتَابِ فِي يَتَامَى النِّسَاءِ اللَّاتِي لَا تُؤْتُونَهُنَّ مَا كُتِبَ لَهُنَّ وَتَرْغَبُونَ أَنْ تَنْكِحُوهُنَّ} قَالَتْ «وَالَّذِي ذَكَرَ اللَّهُ أَنَّهُ يُتْلَى عَلَيْكُمْ فِي الْكِتَابِ الْآيَةِ الْأُولَى الَّتِي قَالَ فِيهَا {وَإِنْ خِفْتُمْ أَلَّا تُقْسِطُوا فِي الْيَتَامَى فَانْكِحُوا مَا طَابَ لَكُمْ مِنَ النِّسَاءِ} » قَالَتْ عَائِشَةُ «وَقَالَ اللَّهُ فِي الْآيَةِ الْأُخْرَى رَغْبَةَ أَحَدُكُمْ عَنْ يَتِيمَتِهِ الَّتِي فِي حِجْرِهِ حِينَ تَكُونُ قَلِيلَةَ الْمَالِ وَالْجَمَالِ فَنُهُوا أَنْ يَنْكِحُوا مَا رَغِبُوا فِي مَالِهَا وَجَمَالِهَا مِنَ النِّسَاءِ إِلَّا بِالْقِسْطِ مِنْ أَجْلِ رَغْبَتِهِمْ عَنْهُنَّ»  

ذِكْرُ بُطْلَانِ النِّكَاحِ الَّذِي نُكِحَ بِغَيْرِ وَلِيٍّ

[Machine] The Messenger of Allah ﷺ said, "Any woman who is married without the permission of her guardian, her marriage is invalid, her marriage contract is invalid twice, and she is entitled to what she was given from the dowry. If there is a dispute between them, then that is taken to the ruler, and the ruler is a guardian for the one who has no guardian."  

ابن حبّان:٤٠٧٤أَخْبَرَنَا ابْنُ خُزَيْمَةَ حَدَّثَنَا عَبْدُ الْأَعْلَى بْنُ وَاصِلِ بْنِ عَبْدِ الْأَعْلَى حَدَّثَنَا يَعْلَى بْنُ عُبَيْدٍ عَنْ يَحْيَى بْنِ سَعِيدٍ الْأَنْصَارِيُّ عَنِ ابْنِ جُرَيْجٍ عَنْ سُلَيْمَانَ بْنِ مُوسَى عَنِ الزُّهْرِيِّ عَنْ عُرْوَةَ عَنْ عَائِشَةَ قَالَتْ

قَالَ رَسُولُ اللَّهِ ﷺ «أَيُّمَا امْرَأَةٍ نُكِحَتْ بِغَيْرِ إِذَنِ وَلِيِّهَا فَنِكَاحُهَا بَاطِلٌ مَرَّتَيْنِ وَلَهَا مَا أَعْطَاهَا بِمَا أَصَابَ مِنْهَا فَإِنْ كَانَتْ بَيْنَهُمَا خُصُومَةٌ فَذَاكَ إِلَى السُّلْطَانِ وَالسُّلْطَانُ وَلِيُّ مَنْ لَا وَلِيَّ لَهُ»  

ذِكْرُ نَفْيِ إِجَازَةِ عَقْدِ النِّكَاحِ بِغَيْرِ وَلِيٍّ وَشَاهِدَيْ عَدْلٍ

[Machine] The Prophet Muhammad ﷺ said, "There is no marriage without a guardian and two just witnesses. Any marriage without these is invalid. If they dispute, the authority is the guardian of the one who has no guardian."

أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «لَا نِكَاحَ إِلَّا بِوَلِيٍّ وَشَاهِدَيْ عَدْلٍ وَمَا كَانَ مِنْ نِكَاحٍ عَلَى غَيْرِ ذَلِكَ فَهُوَ بَاطِلٌ فَإِنْ تَشَاجَرُوا فَالسُّلْطَانُ وَلِيُّ مَنْ لَا وَلِيَّ لَهُ»
