١٤۔ كِتَابُ النِّكَاحِ ص ٢
ذِكْرُ الزَّجْرِ عَنْ أَنْ يُزَوِّجَ النِّسَاءَ إِلَّا الْأَوْلِيَاءُ الَّذِينَ جَعَلَ اللَّهُ جَلَّ وَعَلَا عُقْدَةَ النِّكَاحِ إِلَيْهِمْ دُونَهُنَّ
[Machine] The Messenger of Allah ﷺ said, "There is no marriage except with a guardian." Abu 'Amir (Salih bin Rustum)
قَالَ رَسُولُ اللَّهِ ﷺ «لَا نِكَاحَ إِلَّا بِوَلِيٍّ» أَبُو عَامِرٍ «صَالِحُ بْنُ رُسْتُمَ»
ذِكْرُ الْبَيَانِ بِأَنَّ الْوَلَايَةَ فِي الْإِنْكَاحِ إِنَّمَا هِيَ لِلْأَوْلِيَاءِ دُونَ النِّسَاءِ
the Messenger of Allah said: “There is no marriage except with a guardian.” (Using translation from Ibn Mājah 1881)
قَالَ رَسُولُ اللَّهِ ﷺ «لَا نِكَاحَ إِلَّا بِوَلِيٍّ»
ذِكْرُ نَفْيِ إِجَازَةِ عَقْدِ النِّسَاءِ النِّكَاحَ عَلَى أَنْفُسِهِنَّ بِأَنْفُسِهِنَّ دُونَ الْأَوْلِيَاءِ
the Messenger of Allah said: “There is no marriage except with a guardian.” (Using translation from Ibn Mājah 1881)
قَالَ رَسُولُ اللَّهِ ﷺ «لَا نِكَاحَ إِلَّا بِوَلِيٍّ»
ذِكْرُ الْإِخْبَارِ عَمَّا يَجِبُ عَلَى الْأَوْلِيَاءِ مِنَ اسْتِئْمَارِ النِّسَاءِ أَنْفُسِهِنَّ إِذَا أَرَادُوا عَقْدَ النِّكَاحِ عَلَيْهِنَّ
"The Messenger of Allah said: 'An orphan girl should be consulted with regard to marriage, and if she remains silent, that is her permission. If she refuses then she is not to be forced.'" (Using translation from Nasāʾī 3270)
عَنْ رَسُولِ اللَّهِ ﷺ قَالَ «تُسْتَأْمَرُ الْيَتِيمَةُ فِي نَفْسِهَا فَإِنْ سَكَتَتْ فَهُوَ رِضَاهَا وَإِنَّ أَبَتْ فَلَا جَوَازَ عَلَيْهَا»
ذِكْرُ الْأَمْرِ بِاسْتِئْمَارِ النِّسَاءِ فِي أَبْضَاعِهِنَّ عِنْدَ الْعَقْدِ عَلَيْهِنَّ
[Machine] The Messenger of Allah ﷺ said, "Seek the opinion of women in matters of their properties." It was said, "The virgin feels shy." He said, "Her silence is her affirmation."
قَالَ رَسُولُ اللَّهِ ﷺ «اسْتَأْمِرُوا النِّسَاءَ فِي أَبْضَاعِهِنَّ» قِيلَ إِنَّ الْبِكْرَ تَسْتَحْيِي قَالَ «سُكُوتُهَا إِقْرَارُهَا»
ذِكْرُ الْبَيَانِ بِأَنَّ عَائِشَةَ هِيَ الَّتِي سَأَلَتِ الْمُصْطَفَى ﷺ عَنْ هَذَا الْحُكْمِ
[Machine] She asked the Prophet ﷺ about a virgin girl proposing to a man, and the Prophet ﷺ said, "Women should consult each other regarding their needs." She said, "O Messenger of Allah, a virgin feels shy and remains silent." He said, "Her silence is her acceptance."
أَنَّهَا سَأَلَتِ النَّبِيَّ ﷺ عَنِ الْبِكْرِ تَخْطُبُ فَقَالَتْ قَالَ النَّبِيُّ ﷺ تُسْتَأْمَرُ النِّسَاءُ فِي أَبْضَاعِهِنَّ قَالَتْ يَا رَسُولَ اللَّهِ الْبِكْرُ تَسْتَحِي فَتَسْكُتُ قَالَ «سُكُوتُهَا إِقْرَارُهَا»
ذِكْرُ الْبَيَانِ بِأَنَّ الْإِقْرَارَ الَّذِي وَصَفْنَا إِنَّمَا هُوَ الرِّضَى بِمَا سُئِلَتْ
[Machine] "To the messenger of Allah, peace and blessings be upon him: Indeed, the virgin feels ashamed, so heﷺ said, 'Her acceptance is her silence.'"
لِرَسُولِ اللَّهِ ﷺ إِنَّ الْبِكْرَ تَسْتَحِي فَقَالَ ﷺ «رِضَاهَا صَمْتُهَا»
ذِكْرُ الْبَيَانِ بِأَنَّ عَقْدَ النِّسَاءِ إِلَى الْأَوْلِيَاءِ عَلَيْهِنَّ دُونَهُنَّ، وَإِنَّ الْإِذْنَ لِلْأَيِّمِ مِنْهُنَّ عِنْدَ ذَلِكَ
the Messenger of Allah said: “There is no marriage except with a guardian.” (Using translation from Ibn Mājah 1881)
قَالَ رَسُولُ اللَّهِ ﷺ «لَا نِكَاحَ إِلَّا بِوَلِيٍّ»
ذِكْرُ الْبَيَانِ بِأَنَّ الثَّيِّبَ أَحَقُّ بِنَفْسِهَا مِنْ وَلِيِّهَا عِنْدَ اسْتِئْمَارِهَا فِي الْإِذْنِ عَلَيْهَا
[Machine] Narrated Ibn Abbas: The Messenger of Allah ﷺ said, "A girl has more right to her own self than her guardian, and the virgin must seek permission for her marriage, and her silence is her permission."
حَدَّثَنَا الْقَعْنَبِيُّ عَنْ مَالِكٍ عَنْ عَبْدِ اللَّهِ بْنِ الْفَضْلِ عَنْ نَافِعِ بْنِ جُبَيْرٍ عَنِ ابْنِ عَبَّاسٍ قَالَ قَالَ رَسُولُ اللَّهِ ﷺ «الْأَيِّمُ أَحَقُّ بِنَفْسِهَا مِنْ وَلِيِّهَا وَالْبِكْرُ تُسْتَأْذَنُ وَإِذْنُهَا صُمَاتُهَا»
ذِكْرُ خَبَرٍ ثَانٍ يُصَرِّحُ بِصِحَّةِ مَا ذَكَرْنَاهُ
Ibn ‘Abbas reported the Apostle of Allaah ﷺ as saying “A woman without a husband has more right to her person than her guardian and a virgin’s permission must be asked, her permission being her silence. These are the words of Al Qa’nabi. (Using translation from Abū Dāʾūd 2098)
قَالَ رَسُولُ اللَّهِ ﷺ «الثَّيِّبُ أَحَقُّ بِنَفْسِهَا مِنْ وَلِيِّهَا وَالْبِكْرُ يَسْتَأْمِرُهَا أَبُوهَا فِي نَفْسِهَا وَإِذْنُهَا صُمَاتُهَا»
ذِكْرُ الْخَبَرِ الْمُدْحِضِ قَوْلَ مَنْ زَعَمَ أَنَّ هَذَا الْخَبَرَ تَفَرَّدَ بِهِ عَبْدُ اللَّهِ بْنُ الْفَضْلِ عَنْ نَافِعِ بْنِ جُبَيْرِ بْنِ مُطْعِمٍ
The Prophet ﷺ said: A guardian has no concern with a woman previously married and has no husband, and an orphan girl (i.e. virgin) must be consulted, her silence being her acceptance. (Using translation from Abū Dāʾūd 2100)
عَنِ النَّبِيِّ ﷺ أَنَّهُ قَالَ «لَيْسَ لِوَلِيٍّ مَعَ الثَّيِّبِ أَمْرٌ وَالْيَتِيمَةُ تُسْتَأْمَرُ وَصَمْتُهَا إِقْرَارُهَا»
ذِكْرُ الْخَبَرِ الدَّالِّ عَلَى صِحَّةِ مَا ذَهَبْنَا إِلَيْهِ فِي الْجَمْعِ بَيْنَ هَذِهِ الْأَخْبَارِ
the Messenger of Allah said: “There is no marriage except with a guardian.” (Using translation from Ibn Mājah 1881)
قَالَ رَسُولُ اللَّهِ ﷺ «لَا نِكَاحَ إِلَّا بِوَلِيٍّ»
14.2.14 Subsection
١٤۔٢۔١٤ ذِكْرُ نَفْيِ جَوَازِ عَقْدِ الْوَلِيِّ نِكَاحَ الْبَالِغَةِ عَلَيْهَا إِلَّا بِاسْتِئْمَارِهَا
"The Messenger of Allah said: 'An orphan girl should be consulted with regard to marriage, and if she remains silent, that is her permission. If she refuses then she is not to be forced.'" (Using translation from Nasāʾī 3270)
قَالَ رَسُولُ اللَّهِ ﷺ «تُسْتَأْمَرُ الْيَتِيمَةُ فِي نَفْسِهَا فَإِنْ سَكَتَتْ فَقَدْ أَذِنَتْ وَإِنْ أَبَتْ لَمْ تُكْرَهْ»
[Machine] "From the Prophetﷺ there is a narration similar to it."
عَنِ النَّبِيِّ ﷺ مِثْلَهُ
[Machine] Narrated Ibn Abbas: The Messenger of Allah ﷺ said, "A widow has more right to dispose of herself than her guardian, and a virgin must seek permission from her guardian, and her silence is the permission."
حَدَّثَنَا الْقَعْنَبِيُّ عَنْ مَالِكٍ عَنْ عَبْدِ اللَّهِ بْنِ الْفَضْلِ عَنْ نَافِعِ بْنِ جُبَيْرِ بْنِ مُطْعِمٍ عَنِ ابْنِ عَبَّاسٍ أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «الْأَيِّمُ أَحَقُّ بِنَفْسِهَا مِنْ وَلِيِّهَا وَالْبِكْرُ تُسْتَأْذَنُ فِي نَفْسِهَا وَإِذْنُهَا صُمَاتُهَا»
14.3 [Machine] Friendship
١٤۔٣ بَابُ الصَّدَاقِ
Anas bin ‘Malik said “The Prophet ﷺ manumitted Safiyyah and made her manumission her dower.” (Using translation from Abū Dāʾūd 2054)
أَنَّ النَّبِيَّ ﷺ «أَعْتَقَ صَفِيَّةَ وَجَعَلَ عِتْقَهَا صَدَاقَهَا»
that the Prophet said: “The conditions most deserving to be fulfilled are those by means of which the private parts become permissible for you.” (Using translation from Ibn Mājah 1954)
عَنِ النَّبِيِّ ﷺ قَالَ «أَحَقُّ الشُّرُوطِ أَنْ يُوَفَّى بِهِ مَا اسْتَحْلَلْتُمْ بِهِ الْفُرُوجَ»
ذِكْرُ الْبَيَانِ بِأَنَّ جَوَازَ الْمَهْرِ لِلنِّسَاءِ يَكُونُ عَلَى أَقَلِّ مِنْ عَشْرَةِ
A woman came to the Messenger of Allah ﷺ and said: Messenger of Allah, I have offered myself to you. When she stood for a long time, a man got up and said: Messenger of Allah, marry her to me if you have no need for her. The Messenger of Allah ﷺ asked: Have you anything to give her as dower ? He replied: I have nothing by this lower garment of mine. The Messenger of Allah ﷺ said: If you give your lower garment, you will sit while you have no lower garment. So look for something else. He said: I do not find anything. He said: Look for something, even though it should be an iron ring. The man sought it but found nothing. The Messenger of Allah ﷺ said: Do you know anything from the Qur'an ? He said: Yes, I know surah so and so, which he named. The Messenger of Allah ﷺ said: I have given you her in marriage for the part of the Qur'an which you know. (Using translation from Abū Dāʾūd 2111)
أَنَّ رَسُولَ اللَّهِ ﷺ جَاءَتْهُ امْرَأَةٌ فَقَالَتْ لَهُ يَا رَسُولَ اللَّهِ إِنِّي قَدْ وَهَبْتُ نَفْسِي لَكَ فَقَامَتْ طَوِيلًا فَقَامَ رَجُلٌ فَقَالَ يَا رَسُولَ اللَّهِ زَوِّجْنِيهَا إِنْ لَمْ يَكُنْ لَكَ حَاجَةٌ بِهَا فَقَالَ رَسُولُ اللَّهِ ﷺ «هَلْ عِنْدَكَ مِنْ شَيْءٍ تُصْدِقُهَا إِيَّاهُ» فَقَالَ مَا عِنْدِي إِلَّا إِزَارِي هَذَا فَقَالَ رَسُولُ اللَّهِ ﷺ «إِنَّ أَعْطَيْتَهُ إِيَّاهَا جَلَسْتَ لَا إِزَارَ لَكَ فَالْتَمِسْ شَيْئًا» فَقَالَ مَا أَجِدُ قَالَ «فَالْتَمِسْ فَلَمْ يَجِدْ شَيْئًا» فَقَالَ رَسُولُ اللَّهِ ﷺ «هَلْ مَعَكَ مِنَ الْقُرْآنِ شَيْءٌ» قَالَ نَعَمْ سُورَةُ كَذَا وَسُورَةُ كَذَا لِسُوَرٍ سَمَّاهَا فَقَالَ رَسُولُ اللَّهِ ﷺ «قَدْ زَوَّجْتُكَهَا بِمَا مَعَكَ مِنَ الْقُرْآنِ»
ذِكْرُ الْإِخْبَارِ عَنْ كَرَاهِيَةِ الْإِكْثَارِ فِي الصَّدَاقِ بَيْنَ الرَّجُلِ وَامْرَأَتِهِ
[Machine] A man came to the Messenger of Allahﷺ and said, "I have married a woman." He asked, "How much did you give as mahr (dowry)?" The man replied, "Four awqiya (a measurement of weight)." The Prophetﷺ said, "Four awqiya, it is as if you are carving silver from the width of this mountain."
جَاءَ رَجُلٌ إِلَى رَسُولِ اللَّهِ ﷺ فَقَالَ إِنِّي تَزَوَّجْتُ امْرَأَةً فَقَالَ «كَمْ أَصْدَقْتَهَا» فَقَالَ أَرْبَعَ أَوَاقٍ فَقَالَ ﷺ «أَرْبَعَ أَوَاقٍ كَأَنَّمَا تَنْحِتُونَ الْفِضَّةَ مِنْ عَرَضِ هَذَا الْجَبَلِ»
ذِكْرُ الْبَيَانِ بِأَنَّ تَسْهِيلَ الْأَمْرِ، وَقِلَّةَ الصَّدَاقِ مِنْ يُمْنِ الْمَرْأَةِ
[Machine] "According to the messenger of Allah ﷺ , the goodness of a woman lies in making her affairs easy and her dowry being modest." Urwah said, "I also say that from my observation, when a woman is unlucky, her matters become difficult and her dowry becomes large."
لِي رَسُولُ اللَّهِ ﷺ «مِنْ يُمْنِ الْمَرْأَةِ تَسْهِيلُ أَمْرِهَا وَقِلَّةُ صَدَاقِهَا» قَالَ عُرْوَةُ وَأَنَا أَقُولُ مِنْ عِنْدِي وَمِنْ شُؤْمِهَا تَعْسِيرُ أَمْرِهَا وَكَثْرَةُ صَدَاقِهَا «
ذِكْرُ الْإِبَاحَةِ لِلْمَرْءِ أَنْ يَجْعَلَ صَدَاقَ امْرَأَتِهِ ذَهَبًا
[Machine] The Prophet ﷺ met Abdurrahman ibn Awf while he had a small wound on his face due to a skin condition. The Prophet ﷺ said to him, "What happened, Abdurrahman?" He replied, "I married a woman from the Ansar." The Prophet ﷺ asked, "How much did you give as dowry?" He replied, "I gave her the weight of a date stone in gold." The Prophet ﷺ said, "You should have taught her even if it was just a sheep." Anas said, "I saw him later dividing one of his wives' wealth among a hundred thousand women, after his death."
لَقِيَ النَّبِيُّ ﷺ عَبْدَ الرَّحْمَنِ بْنَ عَوْفٍ وَبِهِ وَضَرٌ مِنْ خَلُوقٍ فَقَالَ لَهُ النَّبِيُّ ﷺ «مَهْيَمْ عَبْدَ الرَّحْمَنِ» قَالَ تَزَوَّجْتُ امْرَأَةً مِنَ الْأَنْصَارِ قَالَ «كَمْ أَصْدَقْتَهَا» قَالَ وَزْنَ نَوَاةٍ مِنْ ذَهَبٍ فَقَالَ النَّبِيُّ ﷺ «أَوْلِمْ وَلَوْ بِشَاةٍ» قَالَ أَنَسٌ فَلَقَدْ رَأَيْتُهُ قَسَّمَ لِكُلِّ امْرَأَةٍ مِنْ نِسَائِهِ بَعْدَ مَوْتِهِ مِائَةَ أَلْفٍ
ذِكْرُ الْإِبَاحَةِ لِلْمَرْءِ أَنْ يَجْعَلَ صَدَاقَ امْرَأَتِهِ أَرْبَعَ مِائَةِ دِرْهَمٍ
"The dowry, when the Messenger of Allah was among us, was ten Awaq." (Using translation from Nasāʾī 3348)
كَانَ «صَدَاقُنَا إِذْ كَانَ فِينَا رَسُولُ اللَّهِ ﷺ عَشْرَ أَوَاقٍ»
ذِكْرُ الْخَبَرِ الْمُدْحِضِ قَوْلَ مَنْ نَفَى تَصْحِيحَ هَذِهِ السُّنَّةِ الَّتِي ذَكَرْنَاهَا مِنْ جِهَةِ النَّقْلِ
[Machine] About a man who married a woman but died before consummating the marriage or establishing a dowry for her. He did not say anything on the matter and they went on repeating their marriage for a month. Then he said, "I will state my opinion, if it is right, it is from Allah, and if it is wrong, it is from me. I see that she should receive her husband's dowry and inherit from him, and she is in her waiting period." Fulan Al-Ashji stood up and said, "The Messenger of Allah ﷺ ruled in the case of Bura' bint Washiq with the same verdict." Upon hearing this, Abdullah was happy and praised Allah.
عَنْ رَجُلٍ تَزَوَّجَ امْرَأَةً فَمَاتَ عَنْهَا وَلَمْ يَدْخُلْ بِهَا وَلَمْ يَفْرِضْ لَهَا فَلَمْ يَقُلْ شَيْئًا وَرَدَّدَهُمْ شَهْرًا ثُمَّ قَالَ أَقُولُ بِرَأْيِي فَإِنْ كَانَ صَوَابًا فَمِنَ اللَّهِ وَإِنْ كَانَ خَطَأً فَمِنْ قِبَلِي أَرَى لَهَا صَدَاقَ نِسَائِهَا لَا وَكْسَ وَلَا شَطَطَ وَعَلَيْهَا الْعِدَّةُ وَلَهَا الْمِيرَاثُ فَقَامَ فُلَانٌ الْأَشْجَعِيُّ وَقَالَ «قَضَى رَسُولُ اللَّهِ ﷺ فِي بِرْوَعَ بِنْتِ وَاشِقٍ بِمِثْلِ» ذَلِكَ قَالَ فَفَرِحَ عَبْدُ اللَّهِ بِذَلِكَ وَكَبَّرَ
ذِكْرُ الْخَبَرِ الْمُدْحِضِ قَوْلَ مَنْ زَعَمَ أَنَّ الْإِمَامَ مِنَ الْأَئِمَّةِ لَا يَجُوزُ لَهُ أَنْ يُخْفَى عَلَيْهِ شَيْءٌ مِنْ أَحْكَامِ الدِّينِ الَّذِي لَابُدَّ لِلْمُسْلِمِينَ مِنْهُ
"A man among us married a woman, but he did not name a dowry for her, and he did not have intercourse with her before he died." 'Abdullah said: 'Since I left the Messenger of Allah I have never been asked a more difficult question than this. Go to someone else.' They kept coming to him for a month, then at the end of that they said: 'Who shall we ask if we do not ask you? You are one of the most prominent Companions of Muhammad in this land and we cannot find anyone else.' He said: 'I will say what I think, and if it is correct then it is from Allah alone, with no partner, and if it is wrong then it is from me and from the Shaitan, and Allah and His Messenger have nothing to do with it. I think she should be given a dowry like that of her peers and no less, with no injustice, and she may inherit from him, and she has to observe the 'Iddah, four months and ten days.'" He said: "And that was heard by some people from Ashja', who stood up and said: 'We bear witness that you have passed the same judgment as the Messenger of Allah did concerning a woman from among us who was called Birwa' bint Washiq.'" He said: "Abdullah was never seen looking so happy as he did on that day, except with having accepted Islam." (Using translation from Nasāʾī 3358)
عَنْ رَجُلٍ تَزَوَّجَ مِنَّا وَلَمْ يَفْرِضْ صَدَاقًا وَلَمْ يَجْمَعْهُمَا اللَّهُ حَتَّى مَاتَ فَقَالَ عَبْدُ اللَّهِ مَا سُئِلْتُ عَنْ شَيْءٍ مُنْذُ فَارَقْتُ رَسُولَ اللَّهِ ﷺ أَشَدَّ عَلَيَّ مِنْ هَذِهِ فَأْتُوا غَيْرِي فَاخْتَلَفُوا إِلَيْهِ شَهْرًا ثُمَّ قَالُوا لَهُ فِي آخِرِ ذَلِكَ مَنْ نَسْأَلُ إِنْ لَمْ نَسْأَلْكَ وَأَنْتَ أُخَيَّةُ أَصْحَابِ رَسُولِ اللَّهِ ﷺ فِي هَذِهِ الْبَلْدَةِ وَلَا نَجْدُ غَيْرَكَ فَقَالَ ابْنُ مَسْعُودٍ سَأَقُولُ فِيهَا بِجَهْدِ رَأْيِي إِنْ كَانَ صَوَابًا فَمِنَ اللَّهِ وَإِنْ كَانَ خَطَأً فَمِنِّي وَاللَّهُ وَرَسُولُهُ مِنْهُ بَرِيءٌ أَرَى أَنْ يُفْرَضَ لَهَا كَصَدَاقِ نِسَائِهَا وَلَا وَكْسَ وَلَا شَطَطَ وَلَهَا الْمِيرَاثُ وَعَلَيْهَا الْعِدَّةُ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا وَذَلِكَ بِحَضْرَةِ نَاسٍ مِنْ أَشْجَعَ فَقَامَ رَجُلٌ يُقَالُ لَهُ مَعْقِلُ بْنُ سِنَانٍ الْأَشْجَعِيُّ فَقَالَ «أَشْهَدُ أَنَّكَ قَضَيْتَ بِمِثْلِ الَّذِي قَضَى بِهِ رَسُولُ اللَّهِ ﷺ فِي امْرَأَةٍ مِنَّا يُقَالُ لَهَا بِرْوَعُ بِنْتُ وَاشِقٍ فَمَا رُئِيَ عَبْدُ اللَّهِ فَرِحَ بِشَيْءٍ بَعْدَ الْإِسْلَامِ كَفَرْحِهِ بِهَذِهِ الْقِصَّةِ»
14.3.6 Subsection
١٤۔٣۔٦ ذِكْرُ وَصْفِ الْحُكْمِ فِي الْمُتَوَفَّى عَنْهَا زَوْجُهَا حَيْثُ لَمْ يَفْرِضْ لَهَا الصَّدَاقَ فِي الْعَقْدِ وَلَمْ يَدْخُلْ
Masruq said on the authority of Abdullah ibn Mas'ud: Abdullah (ibn Mas'ud ) was asked about a man who had married a woman without cohabiting with her or fixing any dower for her till he died. Ibn Mas'ud said: She should receive the full dower (as given to women of her class), observe the waiting period ('Iddah), and have her share of inheritance. Thereupon Ma'qil ibn Sinan said: I heard the Messenger of Allah ﷺ giving the same decision regarding Birwa' daughter of Washiq (as the decision you have given). عَنْ عَبْدِ اللَّهِ فِي رَجُلٍ تَزَوَّجَ وَلَمْ يَدْخُلْ بِهَا وَلَمْ يَفْرِضْ فَقَالَ لَهَا الصَّدَاقُ كَامِلًا وَعَلَيْهَا الْعِدَّةُ وَلَهَا الْمِيرَاثُ قَالَ مَعْقِلُ بْنُ سِنَانٍ «شَهِدْتُ رَسُولَ اللَّهِ ﷺ قَضَى بِهِ فِي بِرْوَعَ بِنْتِ وَاشِقٍ»

14.4 [Machine] Proof of Lineage and What is Stated in the Record
١٤۔٤ بَابُ ثُبُوتِ النَّسَبِ وَمَا جَاءَ فِي الْقَائِفِ
"The Messenger of Allah came to me looking happy and cheerful, and he said: 'Did you not see that Mujazziz looked at Zaid bin Harithah and Usamah and said: These feet belong to one another.'" (Using translation from Nasāʾī 3493)
دَخَلَ عَلَيَّ رَسُولُ اللَّهِ ﷺ وَأَسَارِيرُ وَجْهِهِ تَبْرُقُ فَقَالَ «أَلَمْ تَرَيْ إِلَى مُجَزِّزٍ أَبْصَرَ آنِفًا زَيْدَ بْنَ حَارِثَةَ وَأُسَامَةَ بْنَ زَيْدٍ فَقَالَ إِنَّ بَعْضَ هَذِهِ الْأَقْدَامِ لِمَنْ بَعْضٍ»
ذِكْرُ الْبَيَانِ بِأَنَّ مُجَزِّزًا الْمُدْلِجِيَّ كَانَ قَائِفًا
[Machine] The Messenger of Allah ﷺ came to me with great joy and happiness. He looked at Usama bin Zaid lying down with his father and said, "These feet are similar to each other, and Usama has grown up well."
دَخَلَ عَلَيَّ رَسُولُ اللَّهِ ﷺ مَسْرُورًا فَرِحًا مِمَّا قَالَ مُجَزِّزٌ الْمُدْلِجِيُّ وَنَظَرَ إِلَى أُسَامَةَ بْنِ زَيْدٍ مُضْطَجِعًا مَعَ أَبِيهِ فَقَالَ «هَذِهِ الْأَقْدَامُ بَعْضُهَا مِنْ بَعْضٍ وَكَانَ مُجَزِّزٌ قَائِفًا»
ذِكْرُ نَفْيِ دُخُولِ الْجَنَّةِ عَنِ الْمَرْأَةِ الدَّاخِلَةِ عَلَى قَوْمٍ بِوَلَدٍ لَيْسَ مِنْهُمْ
AbuHurayrah heard the Messenger of Allah ﷺ say when the verse about invoking curses came down: Any woman who brings to her family one who does not belong to it has nothing to do with Allah (i.e. expects no mercy from Allah), and Allah will not bring her into His Paradise. Allah, the Exalted, will veil Himself from any man who disowns his child when he looks at him, and disgrace him in the presence of all creatures, first and last. أَنَّهُ سَمِعَ رَسُولَ اللَّهِ ﷺ يَقُولُ حِينَ أُنْزِلَتْ آيَةُ الْمُلَاعَنَةِ «أَيُّمَا امْرَأَةٍ أَدْخَلَتْ عَلَى قَوْمٍ مَنْ لَيْسَ مِنْهُمْ فَلَيْسَتْ مِنَ اللَّهِ فِي شَيْءٍ وَلَنْ يُدْخِلَهَا اللَّهُ جَنَّتَهُ وَأَيُّمَا رَجُلٍ جَحَدَ وَلَدَهُ وَهُوَ يَنْظُرُ إِلَيْهِ احْتَجَبَ اللَّهُ مِنْهُ وَفَضَحَهُ عَلَى رُءُوسِ الْأَوَّلِينَ وَالْآخِرِينَ»
14.4.2 Subsection
١٤۔٤۔٢ ذِكْرُ الْإِخْبَارِ عَنْ إِيجَابِ إِلْحَاقِ الْوَلَدَ مَنْ لَهُ الْفِرَاشُ إِذَا أَمْكَنَ وُجُودُهُ وَلَمْ يَسْتَحِلْ كَوْنُهُ
The Prophet ﷺ said, "The boy is for (the owner of) the bed and the stone is for the person who commits illegal sexual intercourse.' (Using translation from Bukhārī 6818)
قَالَ رَسُولُ اللَّهِ ﷺ «الْوَلَدُ لِلْفِرَاشِ وَلِلْعَاهِرِ الْحَجَرُ»
ʿUtba bin Abu Waqqas took a firm promise from his brother Saʿd bin Abu Waqqas to take the son of the slave-girl of Zamʿa into his custody as he was his (i.e. ʿUtba's) son. In the year of the Conquest (of Mecca) Saʿd bin Abu Waqqas took him, and said that he was his brother's son, and his brother took a promise from him to that effect. 'Abu bin Zamʿa got up and said, "He is my brother and the son of the slave-girl of my father and was born on my father's bed." Then they both went to the Prophet ﷺ Saʿd said, "O Messenger of Allah ﷺ! He is the son of my brother and he has taken a promise from me that I will take him." 'Abu bin Zamʿa said, "(He is) my brother and the son of my father's slave-girl and was born on my father's bed." Messenger of Allah ﷺ said, "The boy is for you. O 'Abu bin Zamʿa." Then the Prophet ﷺ said, "The son is for the bed (i.e. the man on whose bed he was born) and stones (disappointment and deprivation) for the one who has done illegal sexual intercourse." The Prophet ﷺ told his wife Sauda bint Zamʿa to screen herself from that boy as he noticed a similarity between the boy and ʿUtba. So, the boy did not see her till he died. أَخِي وَابْنُ وَلِيدَةَ أَبِي وُلِدَ عَلَى فِرَاشِهِ فَأَتَيَا رَسُولَ اللَّهِ ﷺ فَقَالَ سَعْدٌ يَا رَسُولَ اللَّهِ أَخِي كَانَ عَهِدَ إِلَيَّ فِيهِ وَقَالَ عَبْدُ بْنُ زَمْعَةَ أَخِي وَابْنُ وَلِيدَةَ أَبِي وُلِدَ عَلَى فِرَاشِهِ فَقَالَ رَسُولُ اللَّهِ ﷺ «هُوَ لَكَ يَا عَبْدُ بْنَ زَمْعَةَ الْوَلَدُ لِلْفِرَاشِ وَلِلْعَاهِرِ الْحَجَرُ» ثُمَّ قَالَ رَسُولُ اللَّهِ ﷺ لِسَوْدَةَ بِنْتِ زَمْعَةَ «احْتَجِبِي مِنْهُ» لَمَّا رَأَى مِنْ شَبَهِهِ بِعُتْبَةَ فَمَا رَآهَا حَتَّى لَقِيَ اللَّهَ
14.4.3 Subsection
١٤۔٤۔٣ ذِكْرُ الْخَبَرِ الدَّالِّ عَلَى أَنَّ الْحُكْمَ بِالتَّشْبِيهِ مِمَّا وَصَفْنَا غَيْرُ جَائِزٍ إِذَا كَانَ الْفِرَاشُ مَعْدُومًا
There came a person to the Prophet (may peace he upon him) ) from Banu Fazara and said: My wife has given birth to a child who is black, whereupon Allah's Apostle ﷺ said: Have you any camels? He said: Yes. He again said: What is this colour? He said: They are red. He said: Is there a dusky one among them? He said: Yes, there are dusky ones among them He said: How has it come about? He said: It is perhaps the strain to which it has reverted, whereupon he (the Holy Prophet) said: It is perhaps the strain to which he (the child) has reverted. (Using translation from Muslim 1500a)
جَاءَ رَجُلٌ مِنْ بَنِي فَزَارَةَ إِلَى النَّبِيِّ ﷺ فَقَالَ إِنَّ امْرَأَتِي وَضَعَتْ غُلَامًا أَسْوَدَ فَقَالَ لَهُ النَّبِيُّ ﷺ «هَلْ لَكَ مِنْ إِبِلٍ» قَالَ نَعَمْ قَالَ «فَمَا أَلْوَانُهَا» قَالَ حُمْرٌ قَالَ «هَلْ فِيهَا مِنْ أَوْرَقَ» قَالَ إِنَّ فِيهَا وُرْقًا قَالَ «فَأَنَّى أَتَاهُ ذَلِكَ» قَالَ عَسَى أَنْ يَكُونَ نَزَعَهُ عِرْقٌ قَالَ «وَهَذَا عَسَى أَنْ يَكُونَ نَزَعَهُ عِرْقٌ»
"My wife has given birth to a black boy." The Messenger of Allah said: "Do you have camels?" He said: "Yes." He said: "What color are they?" He said: "Red." He said: "Are there any gray ones among them?" He said: "There are some gray ones among them." He said: "Where do you think they come from?" He said: "Perhaps it is hereditary." He said: "Likewise, perhaps this is hereditary." (Using translation from Nasāʾī 3478)
أَنَّ رَجُلًا مِنْ بَنِي فَزَارَةَ أَتَى رَسُولَ اللَّهِ ﷺ فَقَالَ إِنَّ امْرَأَتِي وَلَدَتْ غُلَامًا أَسْوَدَ فَقَالَ رَسُولُ اللَّهِ ﷺ «هَلْ لَكَ مِنْ إِبِلٍ» قَالَ نَعَمْ قَالَ «فَمَا أَلْوَانُهَا» قَالَ حُمْرٌ قَالَ «فَهَلْ فِيهَا مِنْ أَوْرَقٍ» فَقَالَ إِنَّ فِيهَا لَوُرْقًا قَالَ «فَأَنَّى تَرَاهُ ذَلِكَ» فَقَالَ «عَسَى أَنْ يَكُونَ نَزَعَهُ عِرْقٌ فَقَالَ النَّبِيُّ ﷺ «وَهَذَا عَسَى أَنْ يَكُونَ نَزَعَهُ عِرْقٌ»
14.5 [Machine] The sanctity of marriage
١٤۔٥ بَابُ حُرْمَةِ الْمُنَاكَحَةِ
ذِكْرُ الْبَيَانِ بِأَنَّ الرَّضَاعَةَ يَحْرُمُ مِنْهَا مَا يَحْرُمُ مِنَ الْوِلَادَةِ سَوَاءٌ
[Machine] She said, "My uncle came from the fosterage and he sought permission from me, but I refused to grant him permission until I asked the Prophet ﷺ." She said, "So the Messenger of Allah ﷺ came, and I asked him, and he said, 'He is your uncle, so grant him permission.'" She said, "O Messenger of Allah, I was only breastfed by a woman and not by a man." So the Messenger of Allah ﷺ said, "The prohibitions of lineage are based on what is prohibited by birth."
أَنَّهَا قَالَتْ جَاءَ عَمِّي مِنَ الرَّضَاعَةَ فَاسْتَأْذَنَ عَلَيَّ فَأَبَيْتُ أَنْ آذَنَ لَهُ حَتَّى أَسْأَلَ النَّبِيَّ ﷺ قَالَتْ فَجَاءَ رَسُولُ اللَّهِ ﷺ فَسَأَلْتُهُ فَقَالَ «إِنَّهُ عَمُّكِ فَأَذَنِي لَهُ» فَقَالَتْ يَا رَسُولَ اللَّهِ إِنَّمَا أَرْضَعَتْنِي الْمَرْأَةٌ وَلَمْ يُرْضِعْنِي الرَّجُلُ فَقَالَ رَسُولُ اللَّهِ ﷺ «يَحْرُمُ مِنَ الرَّضَاعَةِ مَنْ يَحْرُمُ مِنَ الْوِلَادَةِ»
ذِكْرُ الْإِخْبَارِ عَنْ نَفْيِ جَوَازِ تَزْوِيجِ الْمَرْءِ أُخْتَهُ مِنَ الرَّضَاعِ
[Machine] She said, "O Messenger of Allah, can you have a relationship with Durrat bint Abi Sufyan?" He replied, "What will I do with her?" She said, "You can marry her." He said, "Is it permissible for me?" She said, "By Allah, I have been informed that you are engaged to Zainab bint Umm Salama." So the Messenger of Allah ﷺ said, "Indeed, Zainab is prohibited for me, and she breastfed me along with Thawbah. Therefore, do not present your daughters, sisters, aunts, or nieces to me, nor your mothers."
أَنَّهَا قَالَتْ يَا رَسُولَ اللَّهِ هَلْ لَكَ فِي دُرَّةَ بِنْتِ أَبِي سُفْيَانَ قَالَ «أَصْنَعُ بِهَا مَاذَا» قَالَتْ تَنْكِحُهَا قَالَ «وَهَلْ تَحِلُّ لِي» قَالَتْ وَاللَّهِ لَقَدْ أُخْبِرْتُ أَنَّكَ تَخْطِبُ زَيْنَبَ بِنْتَ أُمِّ سَلَمَةَ فَقَالَ رَسُولُ اللَّهِ ﷺ «إِنَّ زَيْنَبَ تَحْرُمُ عَلَيَّ وَإِنَّهَا فِي حِجْرِي وَأَرْضَعَتْنِي وَإِيَّاهَا ثُوَيْبَةُ فَلَا تَعْرِضْنَ عَلَيَّ بَنَاتِكُنَّ وَلَا أَخَوَاتِكُنَّ وَلَا عَمَّاتِكُنَّ وَلَا خَالَاتِكُنَّ وَلَا أُمَّهَاتِكُنَّ»
ذِكْرُ الْإِخْبَارِ عَنْ نَفْيِ جَوَازِ نِكَاحِ الْمَرْءِ بِنْتَ أَخِيهِ مِنَ الرَّضَاعِ
“Marry my sister 'Azzah.” The Messenger of Allah said: 'Would you like that? “She said: “Yes, O Messenger of Allah. I am not the only one living with you and the one who most deserves to share good thingswith me is my sister.” The Messenger of Allah said: “But that is not permissible for me.” She said: “But we throught that you wanted to marry Durrah bint Abi Salmah.” The Messenger of Allah said: The daughter of Umm Salamah?” She said: “Yes” The Messenger of Allah said: “Even if she were not my step-daughter who is under my care, she would not be permissible for me, because she is the daughter of my brother through breastfeeding. Tuwaibah breastfed both her father and I. So do not offer your sisters and daughters to me for marriage.” (Using translation from Ibn Mājah 1939)
يَا رَسُولَ اللَّهِ انْكِحْ بِنْتَ أَبِي سُفْيَانَ لِأُخْتِهَا فَقَالَ النَّبِيُّ ﷺ «وَتُحِبِّينَ ذَلِكَ» قَالَتْ نَعَمْ وَأَحَبُّ مَنْ يُشَارِكُنِي فِي خَيْرٍ أُخْتِي فَقَالَ رَسُولُ اللَّهِ ﷺ «فَإِنَّ ذَلِكَ لَا يَحِلُّ» قَالَتْ أُمُّ حَبِيبَةَ يَا رَسُولَ اللَّهِ وَاللَّهِ لَقَدْ حُدِّثْنَا أَنَّكَ تُنْكِحُ دُرَّةَ بِنْتَ أَبِي سَلَمَةَ قَالَ «ابْنَةُ أَبِي سَلَمَةَ ?» فَقَالَتْ أُمُّ حَبِيبَةَ نَعَمْ قَالَ رَسُولُ اللَّهِ ﷺ «لَوْ أَنَّهَا لَمْ تَكُنْ رَبِيبَتِي فِي حِجْرِي مَا حَلَّتْ لِي إِنَّهَا ابْنَةُ أَخِي مِنَ الرَّضَاعَةَ أَرْضَعَتْنِي وَأَبَا سَلَمَةَ ثُوَيْبَةُ فَلَا تَعْرِضْنَ عَلَيَّ بَنَاتِكُنَّ وَلَا أَخَوَاتِكُنَّ»
ذِكْرُ الزَّجْرِ عَنْ تَزَوَّجِ الْمَرْءِ امْرَأَةَ أَبِيهِ، أَوْ وَطْئِهِ جَارِيَتَهُ الَّتِي هِيَ فِي فِرَاشِهِ
"I met my maternal uncle who was carrying a flag (for an expedition) and I said: 'Where are you going?' He said: 'The Messenger of Allah is sending me to a man who has married his father's wife after he died, to strike his neck or kill him.'" (Using translation from Nasāʾī 3331)
لَقِيتُ خَالِي أَبَا بُرْدَةَ وَمَعَهُ الرَّايَةُ فَقُلْتُ إِلَى أَيْنَ فَقَالَ «أَرْسَلَنِي رَسُولُ اللَّهِ ﷺ إِلَى رَجُلٍ تَزَوَّجَ امْرَأَةَ أَبِيهِ أَنْ أَقْتُلَهُ أَوْ أَضْرِبَ عُنُقَهُ»
ذِكْرُ الزَّجْرِ عَنِ الْجَمْعِ بَيْنَ الْمَرْأَةِ وَعَمَّتِهَا، وَبَيْنَ الْمَرْأَةِ وَخَالَتِهَا
Messenger of Allah ﷺ said, "A woman and her paternal aunt should not be married to the same man; and similarly, a woman and her maternal aunt should not be married to the same man." (Using translation from Bukhārī 5109)
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «لَا يُجْمَعُ بَيْنَ الْمَرْأَةِ وَعَمَّتِهَا وَلَا بَيْنَ الْمَرْأَةِ وَخَالَتِهَا»
ذِكْرُ الزَّجْرِ عَنْ أَنْ تُنْكَحَ الْمَرْأَةُ عَلَى عَمَّتِهَا، أَوْ عَلَى خَالَتِهَا
"The Messenger of Allah forbade taking a woman as a co-wife to her paternal aunt or her maternal aunt." (Using translation from Nasāʾī 3293)
سَمِعْتُ جَابِرًا يَقُولُ «نَهَى رَسُولُ اللَّهِ ﷺ أَنْ تُنْكَحَ الْمَرْأَةُ عَلَى عَمَّتِهَا أَوْ عَلَى خَالَتِهَا»
ذِكْرُ الْبَيَانِ بِأَنَّ الْمُرَادَ مِنْ هَذَا الزَّجْرِ الْجَمْعُ بَيْنَهُمَا، لَا تَزَوَّجُ إِحْدَاهُمَا بَعْدَ مَوْتِ الْأُخْرَى
Messenger of Allah ﷺ said, "A woman and her paternal aunt should not be married to the same man; and similarly, a woman and her maternal aunt should not be married to the same man." (Using translation from Bukhārī 5109)
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «لَا يُجْمَعُ بَيْنَ الْمَرْأَةِ وَعَمَّتِهَا وَلَا بَيْنَ الْمَرْأَةِ وَخَالَتِهَا»
ذِكْرُ الْعِلَّةِ الَّتِي مِنْ أَجَلِهَا زُجِرَ عَنْ هَذَا الْفِعْلِ
[Machine] The Prophet ﷺ forbade marrying a woman and her aunt, saying, "Indeed, if you do so, you would sever your relations."
«نَهَى رَسُولُ اللَّهِ ﷺ أَنْ تُزَوَّجَ الْمَرْأَةُ عَلَى الْعَمَّةِ وَالْخَالَةِ قَالَ إِنَّكُنَّ إِذَا فَعَلْتُنَّ ذَلِكَ قَطَعْتُنَّ أَرْحَامَكُنَّ»
ذِكْرُ الزَّجْرِ عَنْ تَزْوِيجِ الْعَمَّةِ عَلَى ابْنَةَ أَخِيهَا، وَالْخَالَةِ عَلَى بِنْتِ أُخْتِهَا
Abu Hurairah reported The Apostle of Allaah ﷺ as saying “ A woman should not be married to one who had married her paternal aunt or a paternal aunt to one who had married her brother’s daughter or a woman to one who had married her maternal aunt or maternal aunt to one who had married her sister’s daughter. A woman who is elder (in relation) must not be married to one who had married a woman who is younger (in relation) to her nor a woman who is younger (in relation) must be married to one who has married a woman who is elder (in relation) to her.” (Using translation from Abū Dāʾūd 2065)
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «لَا تُنْكَحُ الْمَرْأَةُ عَلَى عَمَّتِهَا وَلَا الْعَمَّةُ عَلَى بِنْتِ أَخِيهَا وَلَا تُنْكَحُ الْمَرْأَةُ عَلَى خَالَتِهَا وَلَا الْخَالَةُ عَلَى بِنْتِ أُخْتِهَا»
ذِكْرُ الزَّجْرِ عَنْ أَنْ تُنْكَحَ الصُّغْرَى بِمَا ذَكَرْنَا عَلَى الْكُبْرَى مِنْهُنَّ، أَوِ الْكُبْرَى عَلَى الصُّغْرَى مِنْهُنَّ
Abu Hurairah reported The Apostle of Allaah ﷺ as saying “ A woman should not be married to one who had married her paternal aunt or a paternal aunt to one who had married her brother’s daughter or a woman to one who had married her maternal aunt or maternal aunt to one who had married her sister’s daughter. A woman who is elder (in relation) must not be married to one who had married a woman who is younger (in relation) to her nor a woman who is younger (in relation) must be married to one who has married a woman who is elder (in relation) to her.” (Using translation from Abū Dāʾūd 2065)
«نَهَى رَسُولُ اللَّهِ ﷺ أَنْ تُنْكَحَ الْمَرْأَةُ عَلَى عَمَّتِهَا وَعَلَى خَالَتِهَا وَعَلَى بِنْتِ أَخِيهَا وَعَلَى بِنْتِ أُخْتِهَا وَنَهَى أَنْ تُنْكَحَ الْكُبْرَى عَلَى الصُّغْرَى وَالصُّغْرَى عَلَى الْكُبْرَى»
ذِكْرُ الْبَيَانِ بِأَنَّ هَذَا الزَّجْرَ زَجْرُ حَتْمٍ، لَا زَجْرُ نَدْبٍ
[Machine] It is said that Rifaa'ah ibn Samaw'al divorced his wife, Tamimah bint Wahb, three times during the time of the Messenger of Allah ﷺ . Then, Abdul Rahman ibn Al-Zubair married her but was unable to consummate the marriage, so he divorced her. Rifaa'ah wanted to marry her again, despite being her first husband who had divorced her. He mentioned this to the Messenger of Allah ﷺ , who forbade him from marrying her and said, "She is not lawful for you until she has tasted the sweetness of marriage with another man."
أَنَّ رِفَاعَةَ بْنَ سَمَوْأَلٍ طَلَّقَ امْرَأَتَهُ تَمِيمَةَ بِنْتَ وَهْبٍ فِي عَهْدِ رَسُولِ اللَّهِ ﷺ ثَلَاثًا فَنَكَحَهَا عَبْدُ الرَّحْمَنِ بْنُ الزُّبَيْرِ فَلَمْ يَسْتَطِعْ أَنْ يَمَسَّهَا فَفَارَقَهَا فَأَرَادَ رِفَاعَةُ أَنْ يَنْكِحَهَا وَهُوَ زَوْجُهَا الْأَوَّلُ الَّذِي كَانَ طَلَّقَهَا فَذَكَرَ لِرَسُولِ اللَّهِ ﷺ فَنَهَاهُ أَنْ يَتَزَوَّجَهَا وَقَالَ «لَا تَحِلُّ لَكَ حَتَّى تَذُوقَ الْعُسَيْلَةَ»
ذِكْرُ الْإِخْبَارِ عَنْ نَفْيِ جَوَازِ تَزْوِيجِ الْمَرْءِ امْرَأَتَهُ الْمُطَلَّقَةَ قَبْلَ أَنْ تَذُوقَ عُسَيْلَةَ غَيْرَهُ وَإِنِ انْقَضَتْ عِدَّتُهَا
"The Messenger of Allah was asked about a man who divorced his wife, and she married another man who had a closed meeting with her then divorced her, before having intercourse with her. Is it permissible for her to remarry the first husband? The Messenger of Allah said: 'No, not until the second one tastes her sweetness and she tastes his sweetness.'" سُئِلَ رَسُولُ اللَّهِ ﷺ عَنْ رَجُلٍ طَلَّقَ امْرَأَتَهُ فَتَزَوَّجْتُ زَوْجًا غَيْرَهُ فَدَخَلَ بِهَا ثُمَّ طَلَّقَهَا قَبْلَ أَنْ يُوَاقِعَهَا أَتَحِلُّ لِلْأَوَّلِ؟ قَالَ «لَا حَتَّى يَذُوقَ عُسَيْلَتَهَا وَتَذُوقَ عُسَيْلَتَهُ»
ذِكْرُ الزَّجْرِ عَنْ أَنْ يَخْطُبَ الْمَرْءُ النِّسَاءَ وَهُوَ مُحْرِمٌ
[Machine] "From Nu'bayh ibn Wahb, one of the sons of Abd al-Dar, that he informed him about Umar ibn Ubaydullah, who sent a message to Aban ibn Uthman. And Aban at that time was the leader of the Hajj pilgrimage. They were both in the state of Ihram. Umar said, "I intended to marry Talha ibn Umar's daughter, the daughter of Shaybah ibn Jubayr. I wanted you to be present for that." However, Aban ibn Uthman disapproved of it and said, "I heard Uthman ibn Affan say that the Messenger of Allah ﷺ said, 'The one in Ihram should not marry, propose or be married.'"
عَنْ نُبَيْهِ بْنِ وَهْبٍ أَحَدِ بَنِي عَبْدِ الدَّارِ أَنَّهُ أَخْبَرَهُ عَنْ عُمَرَ بْنِ عُبَيْدِ اللَّهِ أَرْسَلَ إِلَى أَبَانَ بْنِ عُثْمَانَ وَأَبَانُ يَوْمَئِذٍ أَمِيرُ الْحَاجِّ وَهُمَا مُحْرِمَانِ إِنِّي أَرَدْتُ أَنْ أُنْكِحَ طَلْحَةَ بْنَ عُمَرَ ابْنَةَ شَيْبَةَ بْنِ جُبَيْرٍ فَأَرَدْتُ أَنْ تَحْضُرَ ذَلِكَ فَأَنْكَرَ ذَلِكَ عَلَيْهِ أَبَانُ بْنُ عُثْمَانَ وَقَالَ سَمِعْتُ عُثْمَانَ بْنَ عَفَّانَ يَقُولُ قَالَ رَسُولُ اللَّهِ ﷺ «لَا يَنْكِحُ الْمُحْرِمُ وَلَا يَخْطُبُ وَلَا يُنْكِحُ»
ذِكْرُ الْخَبَرِ الْمُدْحِضِ قَوْلَ مَنْ زَعَمَ أَنَّ هَذَا الْخَبَرِ مَا رَوَاهُ عَنْ نُبَيْهِ بْنِ وَهْبٍ إِلَّا نَافِعُ
ʿThe pilgrim in ihram should not get married, arrange a marriage or propose marriage.ʿ (Using translation from Aḥmad 401)
عَنْ عَبْدِ الْجَبَّارِ بْنِ نُبَيْهِ بْنِ وَهْبٍ عَنْ أَبِيهِ عَنْ أَبَانَ بْنِ عُثْمَانَ عَنْ عُثْمَانَ عَنِ النَّبِيِّ ﷺ قَالَ «لَا يَنْكِحُ الْمُحْرِمُ وَلَا يُنْكِحُ وَلَا يَخْطُبُ وَلَا يُخْطَبُ عَلَيْهِ»
ذِكْرُ خَبَرٍ ثَانٍ يُصَرِّحُ بِدَفْعِ قَوْلِ الْقَائِلِ الَّذِي بِهِ دَفْعُ الْخَبَرِ
[Machine] I was told by Abdul-A'ala and Abdul-Jabbar, the sons of Nubayh ibn Wahb, from their father Nubayh ibn Wahb, from Aban ibn Uthman, from Uthman ibn Affan, from the Prophet ﷺ , who said, "The one who is forbidden to marry shall not marry, nor be married, nor propose marriage."
حَدَّثَنِي عَبْدُ الْأَعْلَى وَعَبْدُ الْجَبَّارِ ابْنَا نُبَيْهِ بْنُ وَهْبٍ عَنْ أَبِيهِمَا نُبَيْهِ بْنِ وَهْبٍ عَنْ أَبَانَ بْنِ عُثْمَانَ عَنْ عُثْمَانَ بْنِ عَفَّانَ عَنِ النَّبِيِّ ﷺ قَالَ «لَا يَنْكِحُ الْمُحْرِمُ وَلَا يُنْكِحُ وَلَا يَخْطُبُ»

١٤۔٥۔١١ ذِكْرُ الزَّجْرِ عَنْ تَزْوِيجِ الْمُطَلَّقَةِ الْبَائِنَةِ بَعْدَ تَزْوِيجِهَا زَوْجًا آخَرَ الزَّوْجَ الْأَوَّلَ قَبْلَ أَنْ يَذُوقَ عُسَيْلَتَهَا الزَّوْجُ الثَّانِي
[Machine] The Messenger of Allah ﷺ was asked about a man who divorced his wife three times and then she married another man and he divorced her before having intercourse with her. Should she go back to her first husband? He said, "No, until she tastes the honey (intercourse) of her second husband just as her first husband had tasted."
سُئِلَ رَسُولُ اللَّهِ ﷺ عَنْ رَجُلٍ طَلَّقَ امْرَأَتَهُ الْبَتَّةَ فَتَزَوَّجَتْ زَوْجًا فَطَلَّقَهَا قَبْلَ أَنْ يَدْخُلَ بِهَا أَتَرْجِعُ إِلَى زَوْجِهَا الْأَوَّلِ قَالَ «لَا حَتَّى يَذُوقَ عُسَيْلَتَهَا مَا ذَاقَ صَاحِبُهَا»
[Machine] From the Prophet ﷺ regarding a man who divorced his wife three times, and then married another woman. He divorced her before having relations with her, and then the first man wanted to marry her again. He said, "No, until the second man tastes his wife and she tastes him."
عَنِ النَّبِيِّ ﷺ فِي رَجُلٍ طَلَّقَ امْرَأَتَهُ ثَلَاثًا ثُمَّ تَزَوَّجَتْ زَوْجًا غَيْرَهُ فَطَلَّقَهَا قَبْلَ أَنْ يَدْخُلَ بِهَا ثُمَّ أَرَادَ الْأَوَّلُ أَنْ يَتَزَوَّجَهَا قَالَ «لَا حَتَّى يَذُوقَ الْآخَرُ عُسَيْلَتَهَا وَتَذُوقَ عُسَيْلَتَهُ»
