Umar b. Ubaidullah b. Ma'mar sent me to Aban b. Uthman as he wanted to make the proposal of the marriage of his son with the daughter of Shaiba b. Uthman. He (Aban b. Uthman) was at that time (busy) in the season of Pilgrimage. He said: I deem him to be a man of the desert (for it is a common thing) that a Muhrim can neither marry, nor is he allowed to be married to anyone. It is Uthman (b. Affan) who reported this to us from Messenger of Allah ﷺ.

حَدَّثَنِي نُبَيْهُ بْنُ وَهْبٍ قَالَ بَعَثَنِي عُمَرُ بْنُ عُبَيْدِ اللَّهِ بْنِ مَعْمَرٍ وَكَانَ يَخْطُبُ بِنْتَ شَيْبَةَ بْنِ عُثْمَانَ عَلَى ابْنِهِ فَأَرْسَلَنِي إِلَى أَبَانِ بْنِ عُثْمَانَ وَهُوَ عَلَى الْمَوْسِمِ فَقَالَ أَلاَ أُرَاهُ أَعْرَابِيًّا إِنَّ الْمُحْرِمَ لاَ يَنْكِحُ وَلاَ يُنْكَحُ أَخْبَرَنَا بِذَلِكَ عُثْمَانُ عَنْ رَسُولِ اللَّهِ ﷺ

I intend to marry Talha b. 'Umar and I earnestly desire you to be present there (in this ceremony of marriage). Aban said to him: I find you a block-headed 'Iraqi. I heard 'Uthman b. 'Affan say that Messenger of Allah ﷺ said: A Muhrim should not marry.

عَنْ نُبَيْهِ بْنِ وَهْبٍ أَنَّ عُمَرَ بْنَ عُبَيْدِ اللَّهِ بْنِ مَعْمَرٍ أَرَادَ أَنْ يُنْكِحَ ابْنَهُ طَلْحَةَ بِنْتَ شَيْبَةَ بْنِ جُبَيْرٍ فِي الْحَجِّ وَأَبَانُ بْنُ عُثْمَانَ يَوْمَئِذٍ أَمِيرُ الْحَاجِّ فَأَرْسَلَ إِلَى أَبَانٍ إِنِّي قَدْ أَرَدْتُ أَنْ أُنْكِحَ طَلْحَةَ بْنَ عُمَرَ فَأُحِبُّ أَنْ تَحْضُرَ ذَلِكَ فَقَالَ لَهُ أَبَانٌ أَلاَ أُرَاكَ عِرَاقِيًّا جَافِيًا إِنِّي سَمِعْتُ عُثْمَانَ بْنَ عَفَّانَ يَقُولُ قَالَ رَسُولُ اللَّهِ ﷺ لاَ يَنْكِحُ الْمُحْرِمُ

"The Muhrim should not get or propose marriage."

عَنْ نُبَيْهِ بْنِ وَهْبٍ قَالَ أَرْسَلَ عُمَرُ بْنُ عُبَيْدِ اللَّهِ بْنِ مَعْمَرٍ إِلَى أَبَانَ بْنِ عُثْمَانَ يَسْأَلُهُ أَيَنْكِحُ الْمُحْرِمُ فَقَالَ أَبَانُ إِنَّ عُثْمَانَ بْنَ عَفَّانَ حَدَّثَ أَنَّ النَّبِيَّ ﷺ قَالَ لاَ يَنْكِحُ الْمُحْرِمُ وَلاَ يَخْطُبُ

ʿThe pilgrim in ihram should not get married, arrange a marriage or propose marrіage.”

عَنْ نُبَيْهِ بْنِ وَهْبٍأَنَّ عُمَرَ بْنَ عُبَيْدِ اللهِ أَرَادَ أَنْ يُزَوِّجَ ابْنَهُ وَهُوَ مُحْرِمٌ فَنَهَاهُ أَبَانُ وَزَعَمَ أَنَّ عُثْمَانَ حَدَّثَ عَنْ رَسُولِ اللهِ ﷺ قَالَ الْمُحْرِمُ لَا يَنْكِحُ وَلا يُنْكِحُ

ʿUmar bin Ubaidullah bin Ma’mar proposed marriage on behalf of his son to the daughter of Shaibah bin ʿUthman. He sent me to Aban bin ʿUthman, who was the leader of the Hajj, and he [Aban] said: I think he must be a Bedouin. ʿThe pilgrim in ihram should not get married or arrange a marriage.ʿ ‘Uthman ؓ told me that from the Prophet ﷺ , and Nubaih told me something similar from his father.

حَدَّثَنِي نُبَيْهُ بْنُ وَهْبٍ قَالَبَعَثَنِي عُمَرُ بْنُ عُبَيْدِ اللهِ بْنِ مَعْمَرٍ وَكَانَ يَخْطُبُ بِنْتَ شَيْبَةَ بْنِ عُثْمَانَ عَلَى ابْنِهِ فَأَرْسَلَ إِلَى أَبَانَ بْنِ عُثْمَانَ وَهُوَ عَلَى الْمَوْسِمِ فَقَالَ أَلا أُرَاهُأَعْرَابِيًّا إِنَّ الْمُحْرِمَ لَا يَنْكِحُ وَلا يُنْكِحُ أَخْبَرَنِي بِذَلِكَ عُثْمَانُ عَنِ النَّبِيِّ ﷺ وحَدَّثَنِي نُبَيْهٌ عَنْ أَبِيهِ بِنَحْوِهِ

"The Muhrim should not get or propose marriage." (Using translation from Nasāʾī 2844)

عَنْ نُبَيْهِ بْنِ وَهْبٍ أَنَّ عُمَرَ بْنَ عُبَيْدِ اللَّهِ بْنِ مَعْمَرٍ أَرَادَ أَنْ يَنْكِحَ وَهُوَ مُحْرِمٌ فَأَرْسَلَ إِلَى أَبَانَ بْنِ عُثْمَانَ فَقَالَ أَبَانُ إِنَّ عُثْمَانَ حَدَّثَ أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «الْمُحْرِمُ لَا يَنْكِحُ وَلَا يَخْطُبُ وَلَا يُنْكِحُ»

[AI] About Nu'aibah ibn Wahb, the brother of Banu Abdul-Dar, he informed him that Umar ibn Ubaydullah sent a message to Aban ibn Uthman, and Aban was the commander of Hajj at that time. They were both in a state of Ihram (pilgrimage). I intended to marry Talhah ibn Umar, the daughter of Shaybah ibn Jubayr, and I wanted Aban to be present for that. However, Aban objected to it and said, "I heard Uthman ibn Affan may Allah be pleased with him saying, 'The forbidden person cannot marry, nor can he propose or be married.'"

عَنْ نُبَيْهِ بْنِ وَهْبٍ أَخِي بَنِي عَبْدِ الدَّارِ أَنَّهُ أَخْبَرَهُ أَنَّ عُمَرَ بْنَ عُبَيْدِ اللَّهِ أَرْسَلَ إِلَى أَبَانَ بْنِ عُثْمَانَ وَأَبَانُ يَوْمَئِذٍ أَمِيرُ الْحَاجِّ وَهُمَا مُحْرِمَانِ قَدْ أَرَدْتُ أَنْ أَنْكِحَ طَلْحَةَ بْنَ عُمَرَ بِنْتَ شَيْبَةَ بْنِ جُبَيْرٍ وَأَرَدْتُ أَنْ تَحْضُرَ ذَلِكَ فَأَنْكَرَ ذَلِكَ عَلَيْهِ أَبَانُ بْنُ عُثْمَانَ وَقَالَ سَمِعْتُ عُثْمَانَ بْنَ عَفَّانَ رِضْوَانُ اللَّهِ عَلَيْهِ يَقُولُ قَالَ رَسُولُ اللَّهِ ﷺ «لَا يَنْكِحُ الْمُحْرِمُ وَلَا يَخْطُبُ وَلَا يُنْكِحُ»

[AI] Abu Abdullah Al-Hafiz informed us that Abu Al-Nasr Al-Faqih and Abu Al-Hasan Al-Anazi said: Othman Ibn Sa'id Al-Darmi narrated to us that Al-Qa'nabi recited to Malik and said: Abu Ali Al-Hussein Ibn Ali Al-Hafiz informed me that Ali Ibn Al-Hussein Al-Saffar narrated to me that Yahya Ibn Yahya said: I recited to Malik from Nafi', the freed slave of Abdullah Ibn Umar, from his father, Wahb Ibn Huzb, that Umar Ibn Ubaidullah wanted to marry Talha Ibn Umar Ibn Shaybah Ibn Jubeir's daughter, so he sent for Aban Ibn Uthman to attend to it, while he was the Amir of Hajj. Aban said: I heard Uthman Ibn Affan saying: I heard the Messenger of Allah ﷺ saying: "The forbidden person should not marry, nor should he be married, nor should he be sought in marriage."

أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنبأ أَبُو النَّصْرِ الْفَقِيهُ وَأَبُو الْحَسَنِ الْعَنَزِيُّ قَالَ ثنا عُثْمَانُ بْنُ سَعِيدٍ الدَّارِمِيُّ ثنا الْقَعْنَبِيُّ فِيمَا قَرَأَهُ عَلَى مَالِكٍ ح قَالَ وَأَخْبَرَنِي أَبُو عَلِيٍّ الْحُسَيْنُ بْنُ عَلِيٍّ الْحَافِظُ أنبأ عَلِيُّ بْنُ الْحُسَيْنِ الصَّفَّارُ ثنا يَحْيَى بْنُ يَحْيَى قَالَ قَرَأْتُ عَلَى مَالِكٍ عَنْ نَافِعٍ مَوْلَى عَبْدِ اللهِ بْنِ عُمَرَ عَنْ نَبِيهِ بْنِ وَهْبٍ أَنَّ عُمَرَ بْنَ عُبَيْدِ اللهِ أَرَادَ أَنْ يُزَوِّجَ طَلْحَةَ بْنَ عُمَرَ بِنْتَ شَيْبَةَ بْنِ جُبَيْرٍ فَأَرْسَلَ إِلَى أَبَانَ بْنِ عُثْمَانَ لِيَحْضُرَ لِذَلِكَ وَهُوَ أَمِيرُ الْحَاجِّ فَقَالَ أَبَانُ سَمِعْتُ عُثْمَانَ بْنَ عَفَّانَ ؓ يَقُولُ سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ لَا يَنْكِحُ الْمُحْرِمُ وَلَا يُنْكَحُ وَلَا يَخْطُبُ
