ذِكْرُ الْبَيَانِ بِأَنَّ الثَّيِّبَ أَحَقُّ بِنَفْسِهَا مِنْ وَلِيِّهَا عِنْدَ اسْتِئْمَارِهَا فِي الْإِذْنِ عَلَيْهَا

ibnhibban:4084Abū Khalīfah > al-Qaʿnabī > Mālik > ʿAbdullāh b. al-Faḍl > Nāfiʿ b. Jubayr > Ibn ʿAbbās

[Machine] Narrated Ibn Abbas: The Messenger of Allah ﷺ said, "A girl has more right to her own self than her guardian, and the virgin must seek permission for her marriage, and her silence is her permission."  

ابن حبّان:٤٠٨٤أَخْبَرَنَا أَبُو خَلِيفَةَ

حَدَّثَنَا الْقَعْنَبِيُّ عَنْ مَالِكٍ عَنْ عَبْدِ اللَّهِ بْنِ الْفَضْلِ عَنْ نَافِعِ بْنِ جُبَيْرٍ عَنِ ابْنِ عَبَّاسٍ قَالَ قَالَ رَسُولُ اللَّهِ ﷺ «الْأَيِّمُ أَحَقُّ بِنَفْسِهَا مِنْ وَلِيِّهَا وَالْبِكْرُ تُسْتَأْذَنُ وَإِذْنُهَا صُمَاتُهَا»

Ibn ‘Abbas reported the Apostle of Allaah ﷺ as saying “A woman without a husband has more right to her person than her guardian and a virgin’s permission must be asked, her permission being her silence. These are the words of Al Qa’nabi. (Using translation from Abū Dāʾūd 2098)  

الدارمي:٢٢٣٤حَدَّثَنَا خَالِدُ بْنُ مَخْلَدٍ حَدَّثَنَا مَالِكٌ عَنْ عَبْدِ اللَّهِ بْنِ الْفَضْلِ عَنْ نَافِعِ بْنِ جُبَيْرِ بْنِ مُطْعِمٍ عَنْ ابْنِ عَبَّاسٍ قَالَ

قَالَ رَسُولُ اللَّهِ ﷺ «الْأَيِّمُ أَحَقُّ بِنَفْسِهَا مِنْ وَلِيِّهَا وَالْبِكْرُ تُسْتَأْذَنُ فِي نَفْسِهَا وَإِذْنُهَا صُمَاتُهَا»
