١٤۔ كِتَابُ النِّكَاحِ ص ٣
ذِكْرُ خَبَرٍ ثَالِثٍ يَدْحِضُ تَأْوِيلَ هَذَا الْمُتَأَوِّلِ لِهَذَا الْخَبَرِ
"The Muhrim should not get or propose marriage." (Using translation from Nasāʾī 2844)
عَنْ نُبَيْهِ بْنِ وَهْبٍ أَنَّ عُمَرَ بْنَ عُبَيْدِ اللَّهِ بْنِ مَعْمَرٍ أَرَادَ أَنْ يَنْكِحَ وَهُوَ مُحْرِمٌ فَأَرْسَلَ إِلَى أَبَانَ بْنِ عُثْمَانَ فَقَالَ أَبَانُ إِنَّ عُثْمَانَ حَدَّثَ أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «الْمُحْرِمُ لَا يَنْكِحُ وَلَا يَخْطُبُ وَلَا يُنْكِحُ»
ذِكْرُ خَبَرٍ أَوْهَمَ عَالَمًا مِنَ النَّاسِ أَنَّهُ يُضَادُ الْأَخْبَارَ الَّتِي تَقَدَّمَ ذِكْرُنَا لَهَا
Ibn ‘Abbas said The Prophet ﷺ married Maimunah while he was in the sacred state(wearing ihram). (Using translation from Abū Dāʾūd 1844)
أَنَّ النَّبِيَّ ﷺ «تَزَوَّجَ مَيْمُونَةَ وَهُوَ مُحْرِمٌ»
ذِكْرُ الْبَيَانِ بِأَنَّ الْمُصْطَفَى ﷺ تَزَوَّجَ مَيْمُونَةَ وَهُمَا حَلَالَانِ
"The Messenger of Allah married Maimunah while he was Halal, and he stayed with her while he was Halal, and I was the messenger between the two of them." (Using translation from Tirmidhī 841)
أَنَّ رَسُولَ اللَّهِ ﷺ «تَزَوَّجَ مَيْمُونَةَ حَلَالًا وَبَنَى بِهَا حَلَالًا وَكُنْتُ الرَّسُولَ بَيْنَهُمَا»
ذِكْرُ خَبَرٍ قَدْ أَوْهَمَ غَيْرِ الْمُتَبَحِّرِ فِي صِنَاعَةِ الْعِلْمِ أَنَّ نِكَاحَ الْمُحْرِمِ، وَإِنْكَاحَهُ جَائِزٌ
Ibn ‘Abbas said The Prophet ﷺ married Maimunah while he was in the sacred state(wearing ihram). (Using translation from Abū Dāʾūd 1844)
أَنَّ النَّبِيَّ ﷺ «تَزَوَّجَ مَيْمُونَةَ وَهُوَ مُحْرِمٌ»
ذِكْرُ خَبَرٍ ثَانٍ يُصَرِّحُ بِصِحَّةِ مَا ذَكَرْنَاهُ
[Machine] The Prophet ﷺ married some of his wives while he was in a state of ihram and he performed the practice of taharah while in a state of ihram.
«تَزَوَّجَ رَسُولُ اللَّهِ ﷺ بَعْضَ نِسَائِهِ وَهُوَ مُحْرِمٌ وَاحْتَجَمَ وَهُوَ مُحْرِمٌ»
ذِكْرُ الْوَقْتِ الَّذِي تَزَوَّجَ الْمُصْطَفَى ﷺ فِيهِ مَيْمُونَةَ

أَنَّ النَّبِيَّ ﷺ «تَزَوَّجَ مَيْمُونَةَ وَهُوَ مُحْرِمٌ فِي عَمْرَةِ الْقَضَاءِ»
ذِكْرُ الْبَيَانِ بِأَنْ تَزَوَّجَ الْمُصْطَفَى ﷺ مَيْمُونَةَ كَانَ وَهُوَ حَلَالٌ لَا حَرَامٌ
[Machine] That the Messenger of Allah ﷺ married her lawfully and built with her lawfully and she died of illness, so we buried her in the shade he had built for her. I and Ibn Abbas descended into her grave, and when we laid her in the burial pit, her head leaned to the side. I took off my cloak and placed it under her head, but Ibn Abbas pulled it and threw it away. Her head was shaved during the Hajj, and her head was still red.
أَنَّ رَسُولَ اللَّهِ ﷺ «تَزَوَّجَهَا حَلَالًا وَبَنَى بِهَا حَلَالًا وَمَاتَتْ بِسَرِفَ فَدَفَنَّاهَا فِي الظُّلَّةِ الَّتِي بَنَى بِهَا فِيهَا فَنَزَلْتُ فِي قَبْرِهَا أَنَا وَابْنُ عَبَّاسٍ فَلَمَّا وَضَعْنَاهَا فِي اللَّحْدِ مَالَ رَأْسُهَا وَأَخَذْتُ رِدَائِي فَوَضَعْتُهُ تَحْتَ رَأْسِهَا فَاجْتَذَبَهُ ابْنُ عَبَّاسٍ فَأَلْقَاهُ وَكَانَتْ حَلَقَتْ فِي الْحَجِّ رَأْسَهَا فَكَانَ رَأْسُهَا مُحَمَّمًا»
ذِكْرُ شَهَادَةِ الرَّسُولِ الَّذِي كَانَ بَيْنَ الْمُصْطَفَى ﷺ وَبَيْنَ مَيْمُونَةَ حَيْثُ تَزَوَّجَ بِهَا، أَنَّهُ ﷺ كَانَ حَلَالًا حِينَئِذٍ لَا مُحْرِمًا
"The Messenger of Allah married Maimunah while he was Halal, and he stayed with her while he was Halal, and I was the messenger between the two of them." (Using translation from Tirmidhī 841)
أَنَّ رَسُولَ اللَّهِ ﷺ «تَزَوَّجَ مَيْمُونَةَ وَهُوَ حَلَالٌ وَبَنَى بِهَا وَهُوَ حَلَالٌ وَكُنْتُ الرَّسُولَ بَيْنَهُمَا»
ذِكْرُ شَهَادَةِ مَيْمُونَةِ عَلَى أَنَّ هَذَا الْفِعْلَ كَانَ مِنَ الْمُصْطَفَى ﷺ بِهَا وَهُوَ حَلَالٌ لَا حَرَامٌ
[Machine] "That the Messenger of Allah ﷺ married her, and it was lawful."
أَنَّ رَسُولَ اللَّهِ ﷺ «تَزَوَّجَهَا وَهُوَ حَلَالٌ»
ذِكْرُ الْمَوْضِعِ الَّذِي بَنَى بِهَا ﷺ حَيْثُ تَزَوَّجَهَا
[Machine] The Prophet SAW married her secretly while they were both permissible.
أَنَّ النَّبِيَّ ﷺ «تَزَوَّجَهَا بِسَرِفَ وَهُمَا حَلَالَانِ»
ذِكْرُ الْبَيَانِ بِأَنَّ تَزَوُّجَ الْمُصْطَفَى ﷺ مَيْمُونَةَ كَانَ ذَلِكَ بَعْدَ انْصِرَافِهَا مِنْ عُمْرَةِ الْقَضَاءِ
[Machine] The Messenger of Allah ﷺ married me with gentleness, and they were both lawful (halal) after they returned from Mecca.
«تَزَوَّجَنِي رَسُولُ اللَّهِ ﷺ بِسَرِفَ وَهُمَا حَلَالَانِ بَعْدَمَا رَجَعَا مِنْ مَكَّةَ»
ذِكْرُ الْخَبَرِ الْمُصَرِّحِ بِنَفْيِ جَوَازِ نِكَاحِ الْمُحْرِمِ وَإِنْكَاحِهِ
[Machine] About Nu'aibah ibn Wahb, the brother of Banu Abdul-Dar, he informed him that Umar ibn Ubaydullah sent a message to Aban ibn Uthman, and Aban was the commander of Hajj at that time. They were both in a state of Ihram (pilgrimage). I intended to marry Talhah ibn Umar, the daughter of Shaybah ibn Jubayr, and I wanted Aban to be present for that. However, Aban objected to it and said, "I heard Uthman ibn Affan may Allah be pleased with him saying, 'The forbidden person cannot marry, nor can he propose or be married.'"
عَنْ نُبَيْهِ بْنِ وَهْبٍ أَخِي بَنِي عَبْدِ الدَّارِ أَنَّهُ أَخْبَرَهُ أَنَّ عُمَرَ بْنَ عُبَيْدِ اللَّهِ أَرْسَلَ إِلَى أَبَانَ بْنِ عُثْمَانَ وَأَبَانُ يَوْمَئِذٍ أَمِيرُ الْحَاجِّ وَهُمَا مُحْرِمَانِ قَدْ أَرَدْتُ أَنْ أَنْكِحَ طَلْحَةَ بْنَ عُمَرَ بِنْتَ شَيْبَةَ بْنِ جُبَيْرٍ وَأَرَدْتُ أَنْ تَحْضُرَ ذَلِكَ فَأَنْكَرَ ذَلِكَ عَلَيْهِ أَبَانُ بْنُ عُثْمَانَ وَقَالَ سَمِعْتُ عُثْمَانَ بْنَ عَفَّانَ رِضْوَانُ اللَّهِ عَلَيْهِ يَقُولُ قَالَ رَسُولُ اللَّهِ ﷺ «لَا يَنْكِحُ الْمُحْرِمُ وَلَا يَخْطُبُ وَلَا يُنْكِحُ»
14.5.18 Subsection
١٤۔٥۔١٨ ذِكْرُ خَبَرٍ رَابِعٍ يَدْفَعُ قَوْلَ هَذَا الْمُتَأَوَّلِ الدَّاخِلِ فِيمَا لَيْسَ مِنْ صِنَاعَتِهِ
"The Messenger of Allah said: 'The Muhrim should not get married, or propose marriage, or arrange a marriage for some else.'" (Using translation from Nasāʾī 2842)
سَمِعْتُ نُبَيْهَ بْنَ وَهْبٍ يَقُولُ قَالَ أَبَانُ بْنُ عُثْمَانَ سَمِعْتُ عُثْمَانَ بْنَ عَفَّانَ يَقُولُ قَالَ رَسُولُ اللَّهِ ﷺ «لَا يَنْكِحُ الْمُحْرِمُ وَلَا يُنْكِحُ»
ʿThe pilgrim in ihram should not get married, arrange a marriage or propose marriage.ʿ (Using translation from Aḥmad 401)
عَنْ نُبَيْهِ بْنِ وَهْبٍ عَنْ أَبَانَ بْنِ عُثْمَانَ عَنْ عُثْمَانَ بْنِ عَفَّانَ قَالَ قَالَ النَّبِيُّ ﷺ «لَا يَنْكِحُ الْمُحْرِمُ وَلَا يُنْكِحُ»
14.6 [Machine] Nikah al-Mut'ah
١٤۔٦ بَابٌ نِكَاحُ الْمُتْعَةِ
[Machine] "The Messenger of Allah ﷺ forbade the usage of women for pleasure."
«نَهَى رَسُولُ اللَّهِ ﷺ عَنْ مُتْعَةِ النِّسَاءِ»
[Machine] I heard Ibn Mas'ud saying, "We used to go for battles with the Messenger of Allah ﷺ, and we did not have any women with us." So, they said, "O Messenger of Allah, should we not castrate ourselves?" He prohibited us from doing so and commanded us to marry women with a dowry. Then Abdullah recited this verse, "O you who have believed, do not prohibit the good things which Allah has made lawful to you."
سَمِعْتُ ابْنَ مَسْعُودٍ يَقُولُ كُنَّا نَغْزُو مَعَ رَسُولِ اللَّهِ ﷺ لَيْسَ لَنَا نِسَاءٌ فَقَالُوا يَا رَسُولَ اللَّهِ أَلَا نَسْتَخْصِي فَنَهَانَا عَنْ ذَلِكَ وَأَمَرَنَا أَنْ نَنْكِحَ الْمَرْأَةَ بِالثَّوْبِ ثُمَّ قَرَأَ عَبْدُ اللَّهِ هَذِهِ الْآيَةَ {يَا أَيُّهَا الَّذِينَ آمَنُوا لَا تُحَرِّمُوا طَيِّبَاتِ مَا أَحَلَّ اللَّهُ لَكُمْ}
ذِكْرُ الْبَيَانِ بِأَنَّ هَذَا الْأَمْرَ بِالتَّمَتُّعِ أَمْرُ رُخْصَةٍ كَانَ مِنَ الْمُصْطَفَى ﷺ لَا أَمْرُ حَتْمٍ
We used to fight in the holy battles in the company of the Prophet ﷺ and we had no wives with us. So we said, "O Messenger of Allah ﷺ! Shall we get castrated?" The Prophet ﷺ forbade us to do so. (Using translation from Bukhārī 5071)
كُنَّا نَغْزُو مَعَ رَسُولِ اللَّهِ ﷺ وَلَيْسَ مَعَنَا نِسَاءٌ فَقُلْنَا يَا رَسُولَ اللَّهِ أَلَا نَسْتَخْصِي؟ «فَنَهَانَا عَنْ ذَلِكَ وَرَخَّصَ لَنَا أَنْ نَنْكِحَ الْمَرْأَةَ بِالثَّوْبِ إِلَى أَجْلٍ ثُمَّ قَرَأَ {يَا أَيُّهَا الَّذِينَ آمَنُوا لَا تُحَرِّمُوا طَيِّبَاتِ مَا أَحَلَّ اللَّهُ لَكُمْ وَلَا تَعْتَدُوا إِنَّ اللَّهَ لَا يُحِبُّ الْمُعْتَدِينَ} »
ذِكْرُ الْوَقْتِ الَّذِي نَهَى ﷺ عَنِ الْمُتْعَةِ فِيهِ
The Messenger of Allah forbade on the Day of Khaibar, the temporary marriage of women and (he forbade) the flesh of domestic donkeys. (Using translation from Ibn Mājah 1961)
أَنَّ رَسُولَ اللَّهِ ﷺ «نَهَى عَنْ مُتْعَةِ النِّسَاءِ يَوْمَ خَيْبَرَ وَعَنْ أَكْلِ لُحُومِ الْحُمُرِ الْإِنْسِيَّةِ»
ذِكْرُ الْبَيَانِ بِأَنَّ الْمُصْطَفَى ﷺ رَخَّصَ لَهُمْ فِي الْمُتْعَةِ مُدَّةً مَعْلُومَةً بَعْدَ هَذَا الزَّجْرِ الْمُطْلَقِ
[Machine] "The Messenger of Allahﷺ allowed the pleasure of women, so I approached him after three (occasions), and he forbade it even more strictly and said the harshest words about it."
أَنَّ رَسُولَ اللَّهِ ﷺ «رَخَّصَ فِي مُتْعَةِ النِّسَاءِ فَأَتَيْتُهُ بَعْدَ ثَلَاثٍ فَإِذَا هُوَ يُحَرِّمُهَا أَشَدَّ التَّحْرِيمِ وَيَقُولُ فِيهَا أَشَدَّ الْقَوْلِ»
ذِكْرُ الْبَيَانِ بِأَنَّ الْمُتْعَةَ حَرَّمَهَا الْمُصْطَفَى ﷺ يَوْمَ خَيْبَرَ بَعْدَ هَذَا الْأَمْرِ الْمُطْلَقِ
'Ali b. AbiTalib reported that Messenger of Allah ﷺ prohibited on the Day of Khaibar the contracting of temporary marriage with women and the eating of the flesh of domestic asses. (Using translation from Muslim 1407a)
أَنَّ رَسُولَ اللَّهِ ﷺ «نَهَى عَنْ مُتْعَةِ النِّسَاءِ يَوْمَ خَيْبَرَ وَعَنْ أَكْلِ لُحُومِ الْحُمُرِ الْأَهْلِيَّةِ»
ذِكْرُ الْبَيَانِ بِأَنَّ الْمُصْطَفَى ﷺ أَبَاحَ لَهُمْ فِي الْمُتْعَةِ ثَلَاثَةَ أَيَّامٍ يَوْمَ الْفَتْحِ بَعْدَ نَهْيِهِ عَنْهَا يَوْمَ خَيْبَرَ ثُمَّ نَهَى عَنْهَا مَرَّةً ثَانِيَةً
[Machine] He said, "The Messenger of Allah ﷺ permitted us to have temporary marriage during the year of the Conquest. So I and another man went to a young woman who appeared to be a virgin, in order to engage in temporary marriage with her. We sat in front of her, and there was some fabric between her and me, and some fabric between her and the other man. We spoke to her and offered her two pieces of fabric as a dowry. I was younger than the other man, and his fabric was finer than mine. She looked at me and his fabric, then she chose me and I married her. I stayed with her for three days. Then the Messenger of Allah ﷺ prohibited temporary marriage, so I separated from her."
أَنَّهُ قَالَ «أَذِنَ لَنَا رَسُولُ اللَّهِ ﷺ فِي الْمُتْعَةِ عَامَ الْفَتْحِ فَانْطَلَقْتُ أَنَا وَرَجُلٌ آخَرُ إِلَى امْرَأَةٍ شَابَّةٍ كَأَنَّهَا بَكْرَةٌ عَيْطَاءُ لِنَسْتَمْتِعَ بِهَا فَجَلَسْنَا بَيْنَ يَدَيْهَا وَعَلَيْهِ بُرْدٌ وَعَلَيَّ بُرْدٌ فَكَلَّمْنَاهَا وَمَهَرْنَاهَا بُرْدَيْنَا وَكُنْتُ أَشَبَّ مِنْهُ وَكَانَ بُرْدُهُ أَجْوَدَ مِنْ بُرْدِي فَجَعَلَتْ تَنْظُرُ إِلَيَّ مَرَّةً وَإِلَى بُرْدِهِ مَرَّةً ثُمَّ اخْتَارَتْنِي فَنَكَحْتُهَا فَأَقَمْتُ مَعَهَا ثَلَاثًا ثُمَّ إِنَّ رَسُولَ اللَّهِ ﷺ نَهَى عَنْهَا فَفَارَقْتُهَا»
ذِكْرُ الْبَيَانِ بِأَنَّ الْمُصْطَفَى ﷺ حَرَّمَ الْمُتْعَةَ عَامَ حَجَّةِ الْوَدَاعِ تَحْرِيمَ الْأَبَدِ إِلَى يَوْمِ الْقِيَامَةِ
[Machine] We accompanied the Messenger of Allah ﷺ and when we completed our Umrah, he said to us, "Enjoy yourselves with these women." He said, "And enjoyment for us at that time is marriage." So we proposed to those women to set a fixed term between us and them. We mentioned that to the Prophet ﷺ and he said, "Do it." So I went out, along with my cousin who had a cloak with him, and I had a cloak too, but his cloak was better than mine, and I was younger than him. Then we approached a woman and presented our proposal to her. She liked my youthfulness and she liked the cloak of my cousin, so she said, "A cloak like a cloak." I married her and the duration between me and her was for ten nights. I stayed with her that night and in the morning, I went to the Prophet ﷺ. The Prophet ﷺ was standing between the pillar and the gate, delivering a sermon to the people, and he was saying, "O people, I have given permission to you to enjoy yourselves with these women. And behold, Allah has forbade that until the Day of Resurrection. So whoever has anything with them, he should remove his way, and do not take anything from what you have given to them."
خَرَجْنَا مَعَ رَسُولِ اللَّهِ ﷺ فَلَمَّا قَضَيْنَا عُمْرَتَنَا قَالَ لَنَا «اسْتَمْتِعُوا مِنْ هَذِهِ النِّسَاءِ» قَالَ وَالِاسْتِمْتَاعُ عِنْدَنَا يَوْمَئِذٍ التَّزْوِيجُ فَعَرَضْنَا بِذَلِكَ النِّسَاءُ أَنْ نَضْرِبَ بَيْنَنَا وَبَيْنَهُنَّ أَجَلًا قَالَ فَذَكَرْنَا ذَلِكَ لِلنَّبِيِّ ﷺ فَقَالَ «افْعَلُوا ذَلِكَ» فَخَرَجْتُ أَنَا وَابْنُ عَمٍّ لِي مَعِي بُرْدَةٌ وَمَعَهُ بُرْدَةٌ وَبُرْدُهُ أَجْوَدُ مِنْ بُرْدِي وَأَنَا أَشَبُّ مِنْهُ فَأَتَيْنَا امْرَأَةً فَعَرَضْنَا ذَلِكَ عَلَيْهَا فَأَعْجَبَهَا شَبَابِي وَأَعْجَبَهَا بُرْدُ ابْنِ عَمِّي فَقَالَتْ بُرْدٌ كَبُرْدٍ فَتَزَوَّجْتُهَا وَكَانَ الْأَجَلُ بَيْنِي وَبَيْنَهَا عَشْرًا فَلَبِثْتُ عِنْدَهَا تِلْكَ اللَّيْلَةَ ثُمَّ أَصْبَحْتُ غَادِيًا إِلَى رَسُولِ اللَّهِ ﷺ وَرَسُولُ اللَّهِ ﷺ بَيْنَ الْحَجَرِ وَالْبَابِ قَائِمٌ يَخْطُبُ النَّاسَ وَهُوَ يَقُولُ «أَيُّهَا النَّاسُ إِنِّي قَدْ أَذِنْتُ لَكُمْ فِي الِاسْتِمْتَاعِ فِي هَذِهِ النِّسَاءِ أَلَا وَإِنَّ اللَّهَ قَدْ حَرَّمَ ذَلِكَ إِلَى يَوْمِ الْقِيَامَةِ فَمَنْ كَانَ عِنْدَهُ مِنْهُنَّ شَيْئًا فَلْيُخَلِّ سَبِيلَهُ وَلَا تَأْخُذُوا مِمَّا آتَيْتُمُوهُنَّ شَيْئًا»
ذِكْرُ الْبَيَانِ بِأَنَّ الزَّجْرَ عَنِ الْمُتْعَةِ يَوْمَ الْفَتْحِ كَانَ زَجْرَ تَحْرِيمٍ لَا زَجْرَ نَدْبٍ
[Machine] "His father said, 'He (referring to the person speaking) marched (or went out) with the Messenger of Allah ﷺ .' He continued, 'So one day, I and a man from my tribe went forth, and I had an advantage in beauty over him. He was close to adolescence. Each of us had coldness, and my coldness was a natural coldness, while the coldness of my cousin's son was new and biting. Until when we reached the bottom or the top of Makkah, we met a girl who resembled the moon. So we asked her, 'May we enjoy your company?' She replied, 'And what will you give in return?' Each of us spread his coldness in front of her. She looked at the man, and when the man saw her looking, he glanced at me compassionately and said, 'This coldness is natural, and my coldness is new and biting.' So she said, 'There is nothing wrong with this coldness.' Then I enjoyed her company, and we did not leave until the Messenger of Allah ﷺ prohibited her (from such activities)."
أَنَّ أَبَاهُ «غَزَا مَعَ رَسُولِ اللَّهِ ﷺ قَالَ فَخَرَجْتُ أَنَا وَرَجُلٌ مِنْ قَوْمِي لِي عَلَيْهِ فَضْلٌ فِي الْجَمَالِ وَهُوَ قَرِيبٌ مِنَ الدَّمَامَةِ مَعَ كُلِّ وَاحِدٍ مِنَّا بُرْدٌ أَمَا بُرْدِي فَبُرْدٌ خَلَقٌ وَأَمَّا بُرْدُ ابْنِ عَمِّي فَبُرْدٌ جَدِيدٌ غَضٌّ حَتَّى إِذَا كُنَّا أَسْفَلَ مَكَّةَ أَوْ بِأَعْلَاهَا فَلَقَيْنَا فَتَاةً مِثْلُ الْبَكْرَةِ فَقُلْنَا هَلْ نَسْتَمْتِعُ مِنْكِ قَالَتْ وَمَاذَا تَبْذُلَانِ فَنَشَرَ كُلُّ وَاحِدٍ مِنَّا بُرْدَهُ فَجَعَلَتْ تَنْظُرُ إِلَى الرَّجُلِ فَإِذَا رَآهَا الرَّجُلُ تَنْظُرُ إِلَيَّ عِطْفِهَا وَقَالَ بُرْدُ هَذَا خَلَقٌ وَبُرْدِي جَدِيدٌ غَضٌّ فَتَقُولُ بُرْدُ هَذَا لَا بَأْسَ بِهِ ثُمَّ اسْتَمْتَعْتُ مِنْهَا فَلَمْ نَخْرُجْ حَتَّى حَرَّمَهَا رَسُولُ اللَّهِ ﷺ»
ذِكْرُ الْأَسْبَابِ الَّتِي حَرَّمَتِ الْمُتْعَةَ الَّتِي كَانَتْ مُطْلَقَةً قَبْلَهَا
[Machine] When the Prophet ﷺ left, he stayed at the Thaniyyah Al-Wada'a and saw some lamps and heard women crying. He asked, "What is this?" They replied, "O Messenger of Allah, these are the women who were enjoying their time with their husbands." The Messenger of Allah ﷺ then said, "He has abolished or prohibited temporary marriage, divorce, waiting period after divorce, and inheritance."
أَنَّ النَّبِيَّ ﷺ لَمَّا خَرَجَ نَزَلَ ثَنِيَّةَ الْوَدَاعِ فَرَأَى مَصَابِيحَ وَسَمِعَ نِسَاءً يَبْكِينَ فَقَالَ «مَا هَذَا» قَالُوا يَا رَسُولَ اللَّهِ نِسَاءٌ كَانُوا تَمَتَّعُوا مِنْهُنَّ أَزْوَاجُهُنَّ فَقَالَ رَسُولُ اللَّهِ ﷺ «هَدَمَ أَوْ قَالَ حَرَّمَ الْمُتْعَةَ النِّكَاحُ وَالطَّلَاقُ وَالْعُدَّةُ وَالْمِيرَاثُ»
ذِكْرُ الْبَيَانِ بِأَنَّ الْمُتْعَةَ حَرَّمَهَا الْمُصْطَفَى ﷺ يَوْمَ الْفَتْحِ تَحْرِيمَ الْأَبَدِ
Messenger of Allah ﷺ prohibited the contracting of temporary marriage and said: Behold, it is forbidden from this very day of yours to the Day of Resurrection, and he who has given something (as a dower) should not take it back. (Using translation from Muslim 1406l)
أَنَّ رَسُولَ اللَّهِ ﷺ نَهَى عَنِ الْمُتْعَةِ وَقَالَ «إِنَّهَا حَرَامٌ مِنْ يَوْمِكُمْ هَذَا إِلَى يَوْمِ الْقِيَامَةِ وَمَنْ كَانَ أَعْطَى شَيْئًا فَلَا يَأْخُذْهُ»
ذِكْرُ خَبَرٍ أَوْهَمَ مَنْ جَهِلَ صِنَاعَةَ الْحَدِيثِ أَنَّهُ مُضَادٌّ لِلْأَخْبَارِ الَّتِي تَقَدَّمَ ذِكْرُنَا لَهَا
[Machine] "The Messenger of Allah ﷺ allowed us to participate in pleasure for one year and then prohibited it for us."
«رَخَّصَ لَنَا رَسُولُ اللَّهِ ﷺ عَامَ أَوْطَاسٍ فِي الْمُتْعَةِ ثَلَاثًا ثُمَّ نَهَانَا عَنْهَا»
14.7 [Machine] The Translation of "الشِّغَارِ" in English is "Jealousy
١٤۔٧ بَابُ الشِّغَارِ
ذِكْرُ الزَّجْرِ عَنْ أَنْ يُجْعَلَ بُضْعَ بَعْضَ النِّسَاءِ صَدَاقًا لِبَعْضِهِنَّ
"The Prophet prohibited Shighar." (Using translation from Tirmidhī 1124)
أَنَّ النَّبِيَّ ﷺ «نَهَى عَنِ الشِّغَارِ»
ذِكْرُ وَصْفِ الشِّغَارِ الَّذِي نُهِيَ عَنِ اسْتِعْمَالِهِ
Al-Abbas ibn Abdullah ibn al-Abbas married his daughter to Abdur Rahman ibn al-Hakam, and AbdurRahman married his daughter to him. And they made this (exchange) their dower. Mu'awiyah wrote to Marwan commanding him to separate them. He wrote in his letter: This is the shighar which the Messenger of Allah ﷺ has forbidden. (Using translation from Abū Dāʾūd 2075)
وَقَالَ فِي كِتَابِهِ «هَذَا الشِّغَارُ قَدْ نَهَى رَسُولُ اللَّهِ ﷺ عَنْهُ»
ذِكْرُ الزَّجْرِ عَنْ أَنْ يُزَوِّجَ الْمَرْءُ ابْنَتَهُ أَخَاهُ الْمُسْلِمَ عَلَى أَنْ يُزَوِّجَهُ إِيَّاهُ ابْنَتَهُ مِنْ غَيْرِ صَدَاقٍ يَكُونُ بَيْنَهُمَا إِلَّا بُضْعَ كُلِّ وَاحِدٍ مِنْهُمَا
There is no Shighar in islam. (Using translation from Muslim 1415d)
عَنِ النَّبِيِّ ﷺ قَالَ «لَا شِغَارَ فِي الْإِسْلَامِ»
14.8 [Machine] Marriage of the disbelievers
١٤۔٨ بَابُ نِكَاحِ الْكُفَّارِ
I said: Messenger of Allah, I have embraced Islam and two sisters are my wives. He said: Divorce any one of them you wish. (Using translation from Abū Dāʾūd 2243)
قُلْتُ يَا رَسُولَ اللَّهِ إِنِّي أَسْلَمْتُ وَعِنْدِي أُخْتَانِ فَقَالَ رَسُولُ اللَّهِ ﷺ «طَلِّقْ أَيَّتَهُمَا شِئْتَ»
[Machine] The Messenger of Allah ﷺ said to him, "Choose four of them." When it was during the time of Umar, he divorced his wives and divided his wealth among his children. When Umar heard about it, he met him and said, "I think that Satan influenced you in what you overheard about your death, so it affected you. Perhaps you will not live for long. By Allah, you will return to your wives, and they will inherit from you, or I will order that you be stoned to death, just as the grave of Abu Righal was stoned."
لَهُ رَسُولُ اللَّهِ ﷺ «اخْتَرْ مِنْهُنَّ أَرْبَعًا» فَلَمَّا كَانَ فِي عَهْدِ عُمَرَ طَلَّقَ نِسَاءَهُ وَقَسَّمَ مَالَهُ بَيْنَ بَنِيهِ فَبَلَغَ ذَلِكَ عُمَرَ فَلَقِيَهُ فَقَالَ إِنِّي أَظُنُّ الشَّيْطَانَ فِيمَا يَسْتَرِقُ مِنَ السَّمَعِ سَمِعَ بِمَوْتِكَ فَقَذَفَهُ فِي نَفْسِكَ وَلَعَلَّكَ أَنْ لَا تَمْكُثَ إِلَّا قَلِيلًا وَايْمُ اللَّهِ لَتَرُدَّنَّ نِسَاءَكَ وَلَتَرْجِعَنَّ فِي مَالِكِ أَوْ لَأُوَرِّثُهُنَّ مِنْكَ وَلَآمُرَنَّ بِقَبْرِكَ فَيُرْجَمُ كَمَا رُجِمَ قَبْرُ أَبِي رِغَالٍ
ذِكْرُ الْخَبَرِ الْمُدْحِضِ قَوْلَ مَنْ زَعَمَ أَنَّ هَذَا الْخَبَرَ حَدَّثَ بِهِ مَعْمَرٌ بِالْبَصْرَةِ
[Machine] Ghaylan Al-Thaqafi embraced Islam, and he had ten women with him. The Messenger of Allah ﷺ said, "Keep four of them and separate from the rest."
أَسْلَمَ غَيْلَانُ الثَّقَفِيُّ وَعِنْدَهُ عَشْرُ نِسْوَةٍ فَقَالَ رَسُولُ اللَّهِ ﷺ «أَمْسِكْ أَرْبَعًا وَفَارِقْ سَائِرَهُنَّ»
ذِكْرُ خَبَرٍ ثَانٍ يُصَرِّحُ بِصِحَّةِ مَا ذَكَرْنَاهُ
[Machine] "Gaylan bin Salamah Al-Thaqafi embraced Islam and he had ten women with him. So the Messenger of Allah ﷺ commanded him to choose four of them and leave the rest."
أَسْلَمَ غَيْلَانُ بْنُ سَلَمَةَ الثَّقَفِيُّ وَعِنْدَهُ عَشْرُ نِسْوَةٍ «فَأَمَرَهُ رَسُولُ اللَّهِ ﷺ أَنْ يَتَخَيَّرَ مِنْهُنَّ أَرْبَعًا وَيَتْرُكَ سَائِرَهُنَّ»
ذِكْرُ الْبَيَانِ بِأَنَّ الذِّمِّيَّيْنِ إِذَا أَسْلَمَا يَجِبُ أَنْ يُقَرَّا عَلَى نِكَاحِهِمَا
A man came after embracing Islam during the time of the Messenger of Allah ﷺ. Afterwards his wife came after embracing Islam. He said: Messenger of Allah, she embraced Islam along with me; so restore her to me. (Using translation from Abū Dāʾūd 2238)
أَنَّ امْرَأَةً أَسْلَمَتْ عَلَى عَهْدِ رَسُولِ اللَّهِ ﷺ فَجَاءَ زَوْجُهَا فَقَالَ يَا رَسُولَ اللَّهِ «إِنَّهَا قَدْ كَانَتْ أَسْلَمَتْ مَعِي فَرَدَّهَا عَلَيْهِ»
14.9 [Machine] The companionship of married couples
١٤۔٩ بَابُ مُعَاشَرَةِ الزَّوْجَيْنِ
Ibn Masu’d reported the Apostle of Allaah ﷺ as saying “ A woman should not rub her body directly with the body of another woman so that she describes it to her husband as if he were looking at her.” (Using translation from Abū Dāʾūd 2150)
قَالَ رَسُولُ اللَّهِ ﷺ «لَا تُبَاشِرِ الْمَرْأَةُ الْمَرْأَةَ كَأَنَّهَا تَنْعَتُهَا لِزَوْجِهَا أَوْ تَصِفُهَا لِرَجُلٍ كَأَنَّهُ يَنْظُرُ إِلَيْهَا»
ذِكْرُ خَبَرٍ ثَانٍ يُصَرِّحُ بِصِحَّةِ مَا ذَكَرْنَاهُ
that the Messenger of Allah ﷺ said: "A woman is not to touch a woman such that she can describe her to her husband as if he is looking at her." (Using translation from Tirmidhī 2792)
عَنْ رَسُولِ اللَّهِ ﷺ قَالَ «لَا تُبَاشِرِ الْمَرْأَةُ الْمَرْأَةَ فَتَصِفُهَا لِزَوْجِهَا حَتَّى كَأَنَّهُ يَنْظُرُ إِلَيْهَا»
ذِكْرُ تَعْظِيمِ اللَّهِ جَلَّ وَعَلَا حَقَّ الزَّوْجِ عَلَى زَوْجَتِهِ
[Machine] The Prophet Muhammad ﷺ entered a wall of the Ansar, and behold, there were two camels fighting and thundering. The Messenger of Allah ﷺ approached them and put their reins on the ground. He said, "Whoever has anything with him should prostrate to him." The Messenger of Allah ﷺ said, "It is not appropriate for anyone to prostrate to anyone else. Even if there was someone who should prostrate to someone, I would have commanded women to prostrate to their husbands because of the great right Allah has placed upon them."
أَنَّ رَسُولَ اللهِ ﷺ دَخَلَ حَائِطًا مِنْ حَوَائِطِ الأَنْصَارِ فَإِذَا فِيهِ جَمَلانِ يَضْرِبَانِ وَيَرْعَدَانِ فَاقْتَرَبَ رَسُولُ اللهِ ﷺ مِنْهُمَا فَوَضَعَا جِرَانَهُمَا بِالأَرْضِ فَقَالَ مَنْ مَعَهُ سَجَدَ لَهُ فَقَالَ رَسُولُ اللهِ ﷺ مَا يَنْبَغِي لأَحَدٍ أَنْ يَسْجُدَ لأَحَدٍ وَلَوْ كَانَ أَحَدٌ يَنْبَغِي أَنْ يَسْجُدَ لأَحَدٍ لأَمَرْتُ الْمَرْأَةَ أَنْ تَسْجُدَ لِزَوْجِهَا لِمَا عَظَّمَ اللَّهُ عَلَيْهَا مِنْ حَقِّهِ
ذِكْرُ إِيجَابِ الْجَنَّةِ لِلْمَرْأَةِ إِذَا أَطَاعَتْ زَوْجَهَا مَعَ إِقَامَةِ الْفَرَائِضِ لِلَّهِ جَلَّ وَعَلَا
[Machine] The Messenger of Allah ﷺ said, "When a woman prays her five daily prayers, fasts her month (Ramadan), guards her chastity, and obeys her husband, she will enter Paradise through whichever gate she pleases."
قَالَ رَسُولُ اللَّهِ ﷺ «إِذَا صَلَّتِ الْمَرْأَةُ خُمُسَهَا وَصَامَتْ شَهْرَهَا وَحَصَّنَتْ فَرْجَهَا وَأَطَاعَتْ بَعْلَهَا دَخَلَتْ مِنْ أَيِّ أَبْوَابِ الْجَنَّةِ شَاءَتْ»
ذِكْرُ اسْتِحْبَابِ تَحَمُّلِ الْمَكَارِهِ لِلْمَرْأَةِ عَنْ زَوْجِهَا رَجَاءَ الْإِبْلَاغِ فِي قَضَاءِ حُقُوقِهِ
[Machine] A man came to the Messenger of Allah ﷺ with his daughter and said, "O Messenger of Allah, my daughter refuses to get married." The Prophet ﷺ said to her, "Obey your father." She said, "By the One who sent you with the truth, I will not get married until you inform me of the rights of the husband over his wife." The Prophet ﷺ said, "The right of the husband over his wife is that if he has a wound, she should lick it (i.e., give him her full attention)." She said, "By the One who sent you with the truth, I will never get married." The Prophet ﷺ said, "Do not marry them without their guardian's permission."
جَاءَ رَجُلٌ إِلَى رَسُولِ اللَّهِ ﷺ بِابْنَةٍ لَهُ فَقَالَ يَا رَسُولَ اللَّهِ هَذِهِ ابْنَتِي قَدْ أَبَتْ أَنْ تَتَزَوَّجَ فَقَالَ لَهَا النَّبِيُّ ﷺ «أَطِيعِي أَبَاكِ» فَقَالَتْ وَالَّذِي بَعَثَكَ بِالْحَقِّ لَا أَتَزَوَّجُ حَتَّى تُخْبِرَنِي مَا حَقُّ الزَّوْجِ عَلَى زَوْجَتِهِ فَقَالَ النَّبِيُّ ﷺ «حَقُّ الزَّوْجِ عَلَى زَوْجَتِهِ أَنْ لَوْ كَانَتْ قَرْحَةٌ فَلَحَسَتْهَا مَا أَدَّتْ حَقَّهُ» قَالَتْ وَالَّذِي بَعَثَكَ بِالْحَقِّ لَا أَتَزَوَّجُ أَبَدًا فَقَالَ النَّبِيُّ ﷺ «لَا تَنْكِحُوهُنَّ إِلَّا بِإِذْنِ أَهْلِهِنَّ»
ذِكْرُ الْأَمْرِ لِلْمَرْأَةِ بِإِجَابَةِ الزَّوْجِ عَلَى أَيِّ حَالَةٍ كَانَتْ إِذَا كَانَتْ طَاهِرَةً
[Machine] I heard the Prophet Muhammad ﷺ saying, "If a man calls his wife for his need, she should respond to him even if she is busy at the grinding stone."
سَمِعْتُ نَبِيَّ اللَّهِ ﷺ يَقُولُ «إِذَا دَعَا الرَّجُلُ زَوْجَتَهُ لِحَاجَتِهِ فَلْتُجِبْهُ وَإِنْ كَانَتْ عَلَى التَّنُّورِ»
ذِكْرُ الْإِخْبَارِ عَنْ جَوَازِ مُوَاقَعَةِ الْمَرْءِ أَهْلَهُ عَلَى أَيِّ حَالٍ أَحَبَّ إِذَا قَصَدَ فِيهِ مَوْضِعَ الْحَرْثِ
[Machine] The Jews said, "Indeed, when a man approaches his wife and she is on her period, if their child is conceived, it is closer related to the wife. But if their child is not conceived, then they are equal in relationship, as they share the same lineage."
قَالَتِ الْيَهُودُ «إِنَّ الرَّجُلَ إِذَا أَتَى امْرَأَتَهُ وَهِيَ مُجَبِّيَةٌ جَاءَ وَلَدُهُ أَحْوَلَ فَنَزَلَتْ {نِسَاؤُكُمْ حَرْثٌ لَكُمْ فَأْتُوا حَرْثَكُمْ أَنَّى شِئْتُمْ} إِنْ شَاءَ مُجَبِّيَةً وَإِنْ شَاءَ غَيْرَ مُجَبِّيَةٍ إِذَا كَانَ فِي صِمَامٍ وَاحِدٍ»
ذِكْرُ كِتَابَةِ اللَّهِ جَلَّ وَعَلَا الصَّدَقَةَ لِلْمُسْلِمِ بِمُوَاقَعَةِ أَهْلِهِ
[Machine] The Prophet ﷺ said, "In the body of each one of you, there is a charity." They said, "O Messenger of Allah, if one of us satisfies his sexual desire, will he receive a reward for that?" He said, "Do you not see that if he were to do it in a prohibited manner, he would be sinful? Likewise, if he were to do it in a permissible manner, he would receive a reward."
عَنِ النَّبِيِّ ﷺ قَالَ «فِي بُضْعِ أَحَدِكُمْ صَدَقَةٌ» قَالُوا يَا رَسُولَ أَيَأْتِي أَحَدُنَا شَهْوَتَهُ وَيَكُونُ لَهُ فِيهِ أَجْرٌ فَقَالَ «أَرَأَيْتُمْ لَوْ وَضَعَهَا فِي الْحَرَامِ أَكَانَ عَلَيْهِ فِيهِ وِزْرٌ فَكَذَلِكَ إِذَا وَضَعَهَا فِي الْحَلَالِ كَانَ لَهُ أَجْرٌ»
ذِكْرُ الزَّجْرِ عَنْ أَنْ تَأْذَنَ الْمَرْأَةُ لِأَحَدٍ فِي بَيْتِهَا إِلَّا بِإِذْنِ زَوْجِهَا
[Machine] And the Messenger of Allah ﷺ said, "A woman should not allow anyone into her husband's house while he is present, except with his permission."
وَقَالَ رَسُولُ اللَّهِ ﷺ «لَا تَأْذَنِ الْمَرْأَةُ فِي بَيْتِ زَوْجِهَا وَهُوَ شَاهِدٌ إِلَّا بِإِذْنِهِ»
ذِكْرُ بَعْضِ السَّبَبِ الَّذِي مِنْ أَجْلِهِ تَخُونُ النِّسَاءُ أَزْوَاجَهُنَّ
[Machine] The Messenger of Allah ﷺ said, "If it weren't for the Children of Israel, food would not spoil, and if it weren't for Eve, a woman would not betray her husband."
قَالَ رَسُولُ اللَّهِ ﷺ «لَوْلَا بَنُو إِسْرَائِيلَ لَمْ يَخْنَزِ الطَّعَامُ وَلَمْ يَخْنَزِ اللَّحْمُ وَلَوْلَا حَوَّاءُ لَمْ تَخُنْ أُنْثَى زَوْجَهَا»
ذِكْرُ الْبَيَانِ بِأَنَّ الزَّجْرَ عَنِ الشَّيْئَيْنِ اللَّذَيْنِ ذَكَرْنَاهُمَا قَبْلُ إِنَّمَا هُوَ زَجْرُ تَحْرِيمٍ لَا زَجَرَ تَأْدِيبٍ
[Machine] He heard the Messenger of Allah ﷺ saying, "It is not permissible for a woman to fast while her husband is present without his permission, and no man should enter her house if he dislikes it. Whatever she gives in charity, she will have half of its reward, and she was created from a rib."
أَنَّهُ سَمِعَ رَسُولَ اللَّهِ ﷺ يَقُولُ «لَا يَحِلُّ لِامْرَأَةٍ أَنْ تَصُومَ وَزَوْجُهَا شَاهِدٌ إِلَّا بِإِذْنِهِ وَلَا تَأْذَنُ لِرَجُلٍ فِي بَيْتِهَا وَهُوَ لَهُ كَارِهٌ وَمَا تَصَدَّقَتْ مِنْ صَدَقَةٍ فَلَهُ نِصْفُ صَدَقَتِهَا وَإِنَّمَا خُلِقَتْ مِنْ ضِلَعٍ»
ذِكْرُ اسْتِحْبَابِ الِاجْتِهَادِ لِلْمَرْأَةِ فِي قَضَاءِ حُقُوقِ زَوْجِهَا بِتَرْكِ الِامْتِنَاعِ عَلَيْهِ فِيمَا أَحَبَّ
Abdullah bin Abu Awfa said “When Muadh bin Jabal came from Sham, he prostrated to the Prophet who said: 'What is this, O Muadh?' He said: 'I went to Sham and saw them prostrating to their bishops and patricians and I wanted to do that for you.' The messenger of Allah said: 'Do not do that. If I were to command anyone to prostrate to anyone other than Allah, I would have commanded women to prostrate to their husbands. By the One in Whose Hand is the soul of Muhammad! No woman can fulfill her duty towards Allah until she fulfills her duty towards her husband. If he asks her (for intimacy) even if she is on her camel saddle, she should not refuse.' ” (Using translation from Ibn Mājah 1853)
لَمَّا قَدِمَ مُعَاذُ بْنُ جَبَلٍ مِنَ الشَّامِ سَجَدَ لِرَسُولِ اللَّهِ ﷺ فَقَالَ رَسُولُ اللَّهِ ﷺ «مَا هَذَا؟ » قَالَ يَا رَسُولَ اللَّهِ قَدِمْتُ الشَّامَ فَرَأَيْتُهُمْ يَسْجُدُونَ لِبَطَارِقَتِهِمْ وَأَسَاقِفَتِهِمْ فَأَرَدْتُ أَنْ أَفْعَلَ ذَلِكَ بِكَ قَالَ «فَلَا تَفْعَلْ فَإِنِّي لَوْ أَمَرْتُ شَيْئًا أَنْ يَسْجُدَ لِشَيْءٍ لَأَمَرْتُ الْمَرْأَةَ أَنْ تَسْجُدَ لِزَوْجِهَا وَالَّذِي نَفْسِي بِيَدِهِ لَا تُؤَدِّي الْمَرْأَةُ حَقَّ رَبِّهَا حَتَّى تُؤَدِّيَ حَقَّ زَوْجِهَا حَتَّى لَوْ سَأَلَهَا نَفْسَهَا وَهِيَ عَلَى قَتَبٍ لَمْ تَمْنَعْهُ»
ذِكْرُ لَعْنِ الْمَلَائِكَةِ الْمَرْأَةَ الَّتِي لَمْ تُجِبْ زَوْجَهَا إِلَى مَا دَعَاهَا إِلَيْهِ
[Machine] From the Prophet ﷺ, he said, "Whichever man calls his wife and she does not respond to him, he will go to sleep angry with her until the angels curse her until morning."
عَنِ النَّبِيِّ ﷺ قَالَ «أَيُّمَا رَجُلٍ دَعَا امْرَأَتَهُ فَلَمْ تُجِبْهُ فَبَاتَ سَاخِطًا عَلَيْهَا حَتَّى يُصْبِحَ لَعَنَتْهَا الْمَلَائِكَةُ حَتَّى تُصْبِحَ»
ذِكْرُ الْبَيَانِ بِأَنَّ قَوْلَهُ ﷺ «فَلَمْ تُجِبْهُ» أَرَادَ بِهِ: إِذَا دَعَاهَا إِلَى فِرَاشِهِ دُونَ أَمْرِهِ إِيَّاهَا لِسَائِرِ الْحَوَائِجِ
[Machine] The Messenger of Allah ﷺ said, "If one of you calls his wife to his bed and she refuses, then the angels curse her until morning."
قَالَ رَسُولُ اللَّهِ ﷺ «إِذَا دَعَا أَحَدُكُمِ امْرَأَتَهُ إِلَى فِرَاشِهِ فَأَبَتْ أَنْ تَجِيءَ لَعَنَتْهَا الْمَلَائِكَةُ حَتَّى تُصْبِحَ»
ذِكْرُ الْبَيَانِ بِأَنَّ قَوْلَهُ ﷺ «حَتَّى تُصْبِحَ» أَرَادَ بِهِ إِنْ لَمْ تُجِبْهُ فِي بَعْضِ اللَّيْلِ إِلَى مَا رَامَ مِنْهَا
[Machine] From the Messenger of Allahﷺ he said, "When a woman migrates to her husband's bed without any valid reason, the angels curse her until she returns."
عَنْ رَسُولِ اللَّهِ ﷺ قَالَ «إِذَا كَانَتِ الْمَرْأَةُ هَاجِرَةً لِفِرَاشِ زَوْجِهَا لَعَنَتْهَا الْمَلَائِكَةُ حَتَّى تَرْجِعَ»
ذِكْرُ الْإِخْبَارِ عَمَّا يَجِبُ عَلَى الْمَرْءِ مِنْ حَقِّ زَوْجَتِهِ عَلَيْهِ
a man asked the Prophet ﷺ: “What are the right of the woman over her husband?” He said: “That he should feed her as he feeds himself and clothe her as he clothes himself; he should not strike her on the face nor disfigure her, and he should not abandon her except in the house (as a form of discipline).” (Hassan) (Using translation from Ibn Mājah 1850)
أَنَّ رَجُلًا سَأَلَ رَسُولَ اللَّهِ ﷺ مَا حَقُّ الْمَرْأَةِ عَلَى الزَّوْجِ؟ قَالَ «يُطْعِمُهَا إِذَا طَعِمَ وَيَكْسُوَهَا إِذَا اكْتَسَى ثُمَّ لَا يَضْرِبُ الْوَجْهَ وَلَا يُقَبِّحُ وَلَا يَهْجُرُ إِلَّا فِي الْبَيْتِ»
