ذِكْرُ الْحَالَةِ الثَّانِيَةِ الَّتِي أُبِيحَ اسْتِعْمَالُ هَذَا الْفِعْلِ الْمَزْجُورِ عَنْهُ فِيهِمَا

ibnhibban:4051Abū Yaʿlá > ʿAlī b. al-Jaʿd > Ṣakhr b. Jūwayriyah > Nāfiʿ > Ibn ʿUmar

[Machine] "From the Prophet of Allahﷺ he said, 'A man should not propose to his brother's betrothed until the first proposer either abandons his proposal or gives permission to the second proposer to proceed.'"  

ابن حبّان:٤٠٥١أَخْبَرَنَا أَبُو يَعْلَى قَالَ حَدَّثَنَا عَلِيُّ بْنُ الْجَعْدِ قَالَ أَنْبَأَنَا صَخْرُ بْنُ جُوَيْرِيَةَ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ

عَنْ رَسُولِ اللَّهِ ﷺ قَالَ «لَا يَخْطُبُ الرَّجُلُ عَلَى خِطْبَةِ أَخِيهِ حَتَّى يَتْرُكَ الْخَاطِبُ الْأَوَّلُ أَوْ يَأْذَنَ لَهُ فَيَخْطُبُ»

The Prophet ﷺ decreed that one should not try to cancel a bargain already agreed upon between some other persons (by offering a bigger price). And a man should not ask for the hand of a girl who is already engaged to his Muslim brother, unless the first suitor gives her up, or allows him to ask for her hand.  

البخاري:٥١٤٢حَدَّثَنَا مَكِّيُّ بْنُ إِبْرَاهِيمَ حَدَّثَنَا ابْنُ جُرَيْجٍ قَالَ سَمِعْتُ نَافِعًا يُحَدِّثُ

أَنَّ ابْنَ عُمَرَ ؓ كَانَ يَقُولُ نَهَى النَّبِيُّ ﷺ أَنْ يَبِيعَ بَعْضُكُمْ عَلَى بَيْعِ بَعْضٍ وَلاَ يَخْطُبَ الرَّجُلُ عَلَى خِطْبَةِ أَخِيهِ حَتَّى يَتْرُكَ الْخَاطِبُ قَبْلَهُ أَوْ يَأْذَنَ لَهُ الْخَاطِبُ

A person should not enter into a transaction when his brother (had already entered into but not finalised), and he should not make proposal of marriage upon the proposal already made by his brother, until he permits it.  

مسلم:١٤١٢bوَحَدَّثَنِي زُهَيْرُ بْنُ حَرْبٍ وَمُحَمَّدُ بْنُ الْمُثَنَّى جَمِيعًا عَنْ يَحْيَى الْقَطَّانِ قَالَ زُهَيْرٌ حَدَّثَنَا يَحْيَى عَنْ عُبَيْدِ اللَّهِ أَخْبَرَنِي نَافِعٌ عَنِ ابْنِ عُمَرَ

عَنِ النَّبِيِّ ﷺ قَالَ لاَ يَبِعِ الرَّجُلُ عَلَى بَيْعِ أَخِيهِ وَلاَ يَخْطُبْ عَلَى خِطْبَةِ أَخِيهِ إِلاَّ أَنْ يَأْذَنَ لَهُ

عَنِ النَّبِيِّ ﷺ قَالَ لاَ يَبِعِ الرَّجُلُ عَلَى بَيْعِ أَخِيهِ وَلاَ يَخْطُبْ عَلَى خِطْبَةِ أَخِيهِ إِلاَّ أَنْ يَأْذَنَ لَهُ  

ahmad:6036Abū al-Yamān > Shuʿayb > Nāfiʿ > ʿAbdullāh b. ʿUmar

[Machine] The Messenger of Allah ﷺ forbade a man from proposing to the same woman his brother has previously proposed to, unless the first proposer gives up his right or gives permission.  

أحمد:٦٠٣٦حَدَّثَنَا أَبُو الْيَمَانِ أَخْبَرَنَا شُعَيْبٌ أَخْبَرَنَا نَافِعٌ أَنَّ عَبْدَ اللهِ بْنَ عُمَرَ قَالَ

نَهَى رَسُولُ اللهِ ﷺ أَنْ يَخْطُبَ الرَّجُلُ عَلَى خِطْبَةِ أَخِيهِ حَتَّى يَدَعَهَا الَّذِي خَطَبَهَا أَوَّلَ مَرَّةٍ أَوْ يَأْذَنَ لَهُ

Abu Hurairah reported the Apostle of Allaah ﷺ as saying “ A man should not seek the hand of a woman in marriage when his brother has already sought her hand.” (Using translation from Abū Dāʾūd 2080)  

الطبراني:٦٨٩٨حَدَّثَنَا عَبْدُ اللهِ بْنُ أَحْمَدَ بْنِ حَنْبَلٍ حَدَّثَنِي أَبِي وَمُحَمَّدُ بْنُ أَبِي بَكْرٍ الْمُقَدَّمِيُّ ح وَحَدَّثَنَا الْحُسَيْنُ بْنُ إِسْحَاقَ التُّسْتَرِيُّ ثنا يَحْيَى الْحِمَّانِيُّ قَالُوا ثنا أَبُو دَاوُدَ الطَّيَالِسِيُّ ثنا عِمْرَانُ الْقَطَّانُ عَنْ قَتَادَةَ عَنِ الْحَسَنِ عَنْ سَمُرَةَ قَالَ

قَالَ رَسُولُ اللهِ ﷺ «لَا يَخْطُبِ الرَّجُلُ عَلَى خِطْبَةِ أَخِيهِ»

[Machine] The Messenger of Allah ﷺ prohibited a man from proposing to the sister of his brother until he is rejected or given permission.
