[Machine] The Messenger of Allah ﷺ said: "The orphan girl is consulted regarding herself, so if she remains silent, then it is her consent. But if she refuses, then it is not permissible for her." Abu Dawood said about the narration of Yazid: "And it is the same."  

البيهقي:١٣٧٠١ – أَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنبأ أَبُو بَكْرِ بْنُ دَاسَةَ ثنا أَبُو دَاوُدَ ثنا أَبُو كَامِلٍ ثنا يَزِيدُ بْنُ زُرَيْعٍ قَالَ أَبُو دَاوُدَ وَثَنَا مُوسَى بْنُ إِسْمَاعِيلَ ثنا حَمَّادٌ الْمَعْنِيُّ قَالَا حَدَّثَنِي مُحَمَّدُ بْنُ عُمَرَ وَحَدَّثَنِي أَبُو سَلَمَةَ عَنْ أَبِي هُرَيْرَةَ قَالَ

قَالَ رَسُولُ اللهِ ﷺ تُسْتَأْمَرُ الْيَتِيمَةُ فِي نَفْسِهَا فَإِنْ سَكَتَتْ فَهُوَ إِذْنُهَا وَإِنْ أَبَتْ فَلَا جَوَازَ عَلَيْهَا وَقَالَ أَبُو دَاوُدَ الْأَخْبَارُ فِي حَدِيثِ يَزِيدَ قَالَ وَكَذَلِكَ  

رَوَاهُ أَبُو خَالِدٍ سُلَيْمَانُ بْنُ حَيَّانَ وَمُعَاذُ بْنُ مُعَاذٍ عَنْ مُحَمَّدِ بْنِ عَمْرٍو قَالَ أَبُو دَاوُدَ وَثَنَا مُحَمَّدُ بْنُ الْعَلَاءِ ثنا ابْنُ إِدْرِيسَ عَنْ مُحَمَّدِ بْنِ عَمْرٍو بِهَذَا الْحَدِيثِ بِإِسْنَادِهِ وَزَادَ فِيهِ وَإِنْ بَكَتْ أَوْ سَكَتَتْ زَادَ بَكَتْ قَالَ أَبُو دَاوُدَ وَلَيْسَ بَكَتْ بِمَحْفُوظٍ هُوَ وَهْمٌ فِي الْحَدِيثِ الْوَهْمُ مِنِ ابْنِ إِدْرِيسَ أَوْ مُحَمَّدِ بْنِ الْعَلَاءِ
