26. Chapter of Wāw (Male)

٢٦۔ بَابُ الْوَاوِ

26.8 [Machine] Simak ibn Harb, from Alqamah ibn Wail-

٢٦۔٨ سِمَاكُ بْنُ حَرْبٍ، عَنْ عَلْقَمَةَ بْنِ وَائِلٍ

[Machine] While I was with the Prophet ﷺ, a man entered leading another man by a rope. He came to the Messenger of Allah ﷺ and said, "O Messenger of Allah, this person has killed my brother." The Prophet ﷺ asked, "Did you kill him?" The man replied, "Yes." The Prophet ﷺ asked, "How did you kill him?" The man said, "We were gathering wood from a tree, and he insulted me, so I struck him on the head with an axe and killed him." The Prophet ﷺ asked, "Do you have anything to pay as compensation for his life?" The man replied, "No, by Allah, I have nothing except for my axe and clothes." The Prophet ﷺ then asked, "Does your family support you?" The man said, "I am more insignificant to my family than he was." The other man then threw the rope towards him and said, "Take your companion." When the man left, the Messenger of Allah ﷺ said, "If he killed him, then he is like him." Another man came to the Prophet ﷺ and said, "May you be ruined! The Messenger of Allah ﷺ said, 'If he killed him, then he is like him.'" The man then said, "O Messenger of Allah, I did not kill him except by your command." The Prophet ﷺ said, "Do you want to bear his sin and the sin of your companion?" The man said, "Yes, O Messenger of Allah." The Prophet ﷺ then said, "Indeed, it is so." The man threw the rope and said, "Go wherever you want."  

الطبراني:١٨٣١٧حَدَّثَنَا أَحْمَدُ بْنُ زُهَيْرٍ التُّسْتَرِيُّ ثنا مُحَمَّدُ بْنُ بَشَّارٍ بُنْدَارٍ ثنا مُحَمَّدُ بْنُ عَبْدِ اللهِ الْأَنْصَارِيُّ ثنا أَبُو يُونُسَ الْقُشَيْرِيُّ ثنا سِمَاكُ بْنُ حَرْبٍ أَنَّ عَلْقَمَةَ بْنَ وَائِلٍ حَدَّثَهُ عَنْ أَبِيهِ قَالَ

بَيْنَمَا أَنَا عِنْدَ النَّبِيِّ ﷺ إِذْ دَخَلَ رَجُلٌ يَقُودُ رَجُلًا بِنِسْعَةٍ حَتَّى أَتَى رَسُولَ اللهِ ﷺ فَقَالَ يَا رَسُولَ اللهِ هَذَا قَتَلَ أَخِي قَالَ «أَقَتَلْتَهُ؟» قَالَ نَعَمْ قَالَ «كَيْفَ قَتَلْتَهُ؟» قَالَ كُنَّا نَحْتَطِبُ مِنْ شَجَرَةٍ فَسَبَّنِي فَضَرَبْتُهُ بِالْفَأْسِ عَلَى قَرْنِهِ فَقَتَلْتُهُ فَقَالَ «عِنْدَكَ مَالٌ تَدِيهِ عَنْ نَفْسِكَ» قَالَ لَا وَاللهِ مَا لِي مَالٌ إِلَّا فَأْسِي وَكِسَائِي قَالَ «أَتَرَى قَوْمَكَ يَدُونَكَ؟» قَالَ أَنَا أَهْوَنُ عَلَى قَوْمِي مِنْ ذَاكَ فَرَمَى بِنِسْعَتِهِ إِلَيْهِ فَقَالَ «دُونَكَ صَاحِبَكَ» فَلَمَّا وَلَّى قَالَ رَسُولُ اللهِ ﷺ «إِنْ قَتَلَهُ فَهُوَ مِثْلُهُ» فَأَتَاهُ آتٍ فَقَالَ وَيْلَكَ إِنَّ رَسُولَ اللهِ ﷺ يَقُولُ «إِنْ قَتَلَهُ فَهُوَ مِثْلَهُ» قَالَ يَا رَسُولَ اللهِ مَا أَخَذْتُهُ إِلَّا بِأَمْرِكَ فَقَالَ «أَمَا تُرِيدُ أَنْ يَبُوءَ بِإِثْمِهِ وَإِثْمَ صَاحِبِكَ» قَالَ بَلَى يَا رَسُولَ اللهِ قَالَ «فَإِنَّهُ كَذَلِكَ» فَرَمَى نِسْعَتَهُ وَقَالَ «اذْهَبْ حَيْثُ شِئْتَ»

[Machine] Al-Ash'ath bin Qais al-Kindi and a man from Hadramaut disputed in front of the Messenger of Allah ﷺ, in a piece of land that was in the possession of Al-Ash'ath bin Qais al-Kindi, which the man from Hadramaut claimed as his. The Messenger of Allah ﷺ said to the man from Hadramaut, "Present your evidence." He replied, "I have no evidence." The Messenger of Allah ﷺ then said, "If you have no evidence, then Al-Ash'ath may take an oath." The man from Hadramaut said, "My right has been lost, O Messenger of Allah, if you allow him to take the oath." The Messenger of Allah ﷺ said, "Whoever takes an oath while he is lying to usurp the wealth of a Muslim, he will meet Allah on the Day of Judgment while He is angry with him."  

الطبراني:١٨٣١٨حَدَّثَنَا أَحْمَدُ بْنُ دَاوُدَ الْمَكِّيُّ وَأَبُو خَلِيفَةَ قَالَا ثنا إِبْرَاهِيمُ بْنُ أَبِي سُوَيْدٍ ثنا إِبْرَاهِيمُ بْنُ عُثْمَانَ ثنا عَبْدُ الْمَلِكِ بْنُ عُمَيْرٍ عَنْ عَلْقَمَةَ بْنِ وَائِلٍ الْحَضْرَمِيِّ عَنْ أَبِيهِ قَالَ

اخْتَصَمَ الْأَشْعَثُ بْنُ قَيْسٍ الْكِنْدِيُّ وَرَجُلٌ مِنْ حَضْرَمَوْتَ إِلَى رَسُولِ اللهِ ﷺ فِي أَرْضٍ فِي يَدِ الْأَشْعَثِ بْنِ قَيْسِ الْكِنْدِيِّ ادَّعَاهَا الْحَضْرَمِيُّ فَقَالَ رَسُولُ اللهِ ﷺ لِلْحَضْرَمِيِّ «بَيِّنَتُكَ» قَالَ لَيْسَ لِي بَيِّنَةٌ قَالَ «فَإِنْ لَمْ يَكُنْ لَكَ بَيِّنَةٌ حَلَفَ الْأَشْعَثُ» قَالَ هَلَكَ حَقِّي يَا رَسُولَ اللهِ إِنْ جَعَلْتَهَا يَمِينَ الْأَشْعَثِ فَقَالَ رَسُولُ اللهِ ﷺ «مَنْ حَلَفَ عَلَى يَمِينٍ وَهُوَ فِيهَا كَاذِبٌ لِيَقْتَطِعَ بِهَا مَالَ امْرِئٍ مُسْلِمٍ لَقِيَ اللهَ يَوْمَ الْقِيَامَةِ وَهُوَ عَلَيْهِ غَضْبَانُ»
