tabarani:18318 – Aḥmad b. Dāwud al-Makkī And ʾAbū Khalīfah > Ibrāhīm b. Abū Sūwayd > Ibrāhīm b. ʿUthmān > ʿAbd al-Malik b. ʿUmayr > ʿAlqamah b. Wāʾil al-Ḥaḍramī from his father

[Machine] Al-Ash'ath bin Qais al-Kindi and a man from Hadramaut disputed in front of the Messenger of Allah ﷺ, in a piece of land that was in the possession of Al-Ash'ath bin Qais al-Kindi, which the man from Hadramaut claimed as his. The Messenger of Allah ﷺ said to the man from Hadramaut, "Present your evidence." He replied, "I have no evidence." The Messenger of Allah ﷺ then said, "If you have no evidence, then Al-Ash'ath may take an oath." The man from Hadramaut said, "My right has been lost, O Messenger of Allah, if you allow him to take the oath." The Messenger of Allah ﷺ said, "Whoever takes an oath while he is lying to usurp the wealth of a Muslim, he will meet Allah on the Day of Judgment while He is angry with him."

الطبراني:١٨٣١٨ – حَدَّثَنَا أَحْمَدُ بْنُ دَاوُدَ الْمَكِّيُّ وَأَبُو خَلِيفَةَ قَالَا ثنا إِبْرَاهِيمُ بْنُ أَبِي سُوَيْدٍ ثنا إِبْرَاهِيمُ بْنُ عُثْمَانَ ثنا عَبْدُ الْمَلِكِ بْنُ عُمَيْرٍ عَنْ عَلْقَمَةَ بْنِ وَائِلٍ الْحَضْرَمِيِّ عَنْ أَبِيهِ قَالَ

اخْتَصَمَ الْأَشْعَثُ بْنُ قَيْسٍ الْكِنْدِيُّ وَرَجُلٌ مِنْ حَضْرَمَوْتَ إِلَى رَسُولِ اللهِ ﷺ فِي أَرْضٍ فِي يَدِ الْأَشْعَثِ بْنِ قَيْسِ الْكِنْدِيِّ ادَّعَاهَا الْحَضْرَمِيُّ فَقَالَ رَسُولُ اللهِ ﷺ لِلْحَضْرَمِيِّ «بَيِّنَتُكَ» قَالَ لَيْسَ لِي بَيِّنَةٌ قَالَ «فَإِنْ لَمْ يَكُنْ لَكَ بَيِّنَةٌ حَلَفَ الْأَشْعَثُ» قَالَ هَلَكَ حَقِّي يَا رَسُولَ اللهِ إِنْ جَعَلْتَهَا يَمِينَ الْأَشْعَثِ فَقَالَ رَسُولُ اللهِ ﷺ «مَنْ حَلَفَ عَلَى يَمِينٍ وَهُوَ فِيهَا كَاذِبٌ لِيَقْتَطِعَ بِهَا مَالَ امْرِئٍ مُسْلِمٍ لَقِيَ اللهَ يَوْمَ الْقِيَامَةِ وَهُوَ عَلَيْهِ غَضْبَانُ»

ahmad:18863 – Hishām b. ʿAbd al-Malik > Abū ʿAwānah > ʿAbd al-Malik > ʿAlqamah b. Wāʾil > Wāʾil b. Ḥujr

[Machine] I was with the Messenger of Allah ﷺ when two men came to him, arguing about a land. One of them said, "This person wrongfully took my land, O Messenger of Allah, during the time of ignorance. He is Amr ibn Qais ibn Abis al-Kindi, and his opponent is Rabi'ah ibn Abdan." The Messenger of Allah asked him to present evidence, and he replied, "I have no evidence." The Messenger of Allah ﷺ said, "Then his oath would decide." The man said, "I have nothing except that." When he stood up to take an oath, the Messenger of Allah ﷺ said, "Whoever usurps someone's land unjustly will meet Allah on the Day of Resurrection while He is angry with him."

أحمد:١٨٨٦٣ – حَدَّثَنَا هِشَامُ بْنُ عَبْدِ الْمَلِكِ أَخْبَرَنَا أَبُو عَوَانَةَ عَنْ عَبْدِ الْمَلِكِ عَنْ عَلْقَمَةَ بْنِ وَائِلٍ عَنْ وَائِلِ بْنِ حُجْرٍ قَالَ

كُنْتُ عِنْدَ رَسُولِ اللهِ ﷺ فَأَتَاهُ رَجُلَانِ يَخْتَصِمَانِ فِي أَرْضٍ فَقَالَ أَحَدُهُمَا إِنَّ هَذَا انْتَزَى عَلَى أَرْضِي يَا رَسُولَ اللهِ فِي الْجَاهِلِيَّةِ وَهُوَ امْرُؤُ الْقَيْسِ بْنُ عَابِسٍ الْكِنْدِيُّ وَخَصْمُهُ رَبِيعَةُ بْنُ عَبْدَانَ فَقَالَ لَهُ بَيِّنَتُكَ قَالَ لَيْسَ لِي بَيِّنَةٌ قَالَ يَمِينُهُ قَالَ إِذًا يَذْهَبُ بِهَا قَالَ لَيْسَ لَكَ إِلَّا ذَلِكَ قَالَ فَلَمَّا قَامَ لِيَحْلِفَ قَالَ رَسُولُ اللهِ ﷺ مَنْ اقْتَطَعَ أَرْضًا ظَالِمًا لَقِيَ اللهَ ﷻ يَوْمَ الْقِيَامَةِ وَهُوَ عَلَيْهِغَضْبَانُ
