٢١۔ كِتَابُ الْفَرَائِضِ ص ٦
[Machine] "Abu Bakr, Umar, and Uthman did not inherit the pregnant woman."
«لَمْ يَكُنْ أَبُو بَكْرٍ وَعُمَرُ وَعُثْمَانُ يُوَرِّثُونَ الْحَمِيلَ»
[Machine] "A woman from the Mujarib tribe wore a cloak that belonged to her brother from the Jaliib tribe. Abdullah bin Uthba inherited it from his sister."
«أَقَرَّتْ امْرَأَةٌ مِنْ مُحَارِبٍ جَلِيبَةٌ بِنَسَبٍ أَخٍ لَهَا جَلِيبٍ فَوَرَّثَهُ عَبْدُ اللَّهِ بْنُ عُتْبَةَ مِنْ أُخْتِهِ»
[Machine] "At the departure of this world, I am the guardian of so-and-so. He said, 'His inheritance shall be returned to the one who claims to be his guardian at the time of departure from this world, except if they present clear evidence. If not, then his statement shall be rejected, and his inheritance shall be returned to what the evidence supports.'"
عِنْدَ فِرَاقِ الدُّنْيَا أَنَا مَوْلَى فُلَانٍ قَالَ «يُرَدُّ مِيرَاثَهُ لِمَنْ سَمَّى أَنَّهُ مَوْلَاهُ عِنْدَ فِرَاقِ الدُّنْيَا إِلَّا أَنْ يَأْتُوا عَلَيْهِ بِبَيِّنَةٍ بِغَيْرِ ذَلِكَ يَرُدُّونَ بِهِ قَوْلَهُ فَيُرَدُّ مِيرَاثُهُ إِلَى مَا قَامَتْ بِهِ الْبَيِّنَةُ»
21.45 [Machine] Inheritance of Children Born out of Wedlock
٢١۔٤٥ بَابُ: فِي مِيرَاثِ وَلَدِ الزِّنَا
[Machine] Regarding Ali and Abdullah, they said, "The child of adultery is considered like the son of condemnation."
عَنْ عَلِيٍّ وَعَبْدِ اللَّهِ قَالَا «وَلَدُ الزِّنَا بِمَنْزِلَةِ ابْنِ الْمُلَاعَنَةِ»
[Machine] "A child of adultery is not inherited by the one who claims him, nor is he inherited by the biological offspring."
«أَنَّ وَلَدَ الزِّنَا لَا يَرِثُهُ الَّذِي يَدَّعِيهِ وَلَا يَرِثُهُ الْمَوْلُودُ»
[Machine] "It was considered that the child of adultery does not inherit, even if claimed by a man."
«أَنَّهُ كَانَ لَا يُوَرِّثُ وَلَدَ الزِّنَا وَإِنْ ادَّعَاهُ الرَّجُلُ»
[Machine] "Whichever man comes to a boy, claiming to be his son and that he had illicit relations with his mother, and no one else claims that boy, then he will inherit him."
Bukayr said, "I asked Urwah about this and he said it is like the saying of Sulayman ibn Yasar." Urwah also said, "We have received information that the Messenger of Allah ﷺ said, 'The child belongs to the one who slept on the bed, and the stoning is for the adulterer.'"
«أَيُّمَا رَجُلٍ أَتَى إِلَى غُلَامٍ يَزْعُمُ أَنَّهُ ابْنٌ لَهُ وَأَنَّهُ زَنَى بِأُمِّهِ وَلَمْ يَدَّعِ ذَلِكَ الْغُلَامَ أَحَدٌ فَهُوَ يَرِثُهُ» قَالَ بُكَيْرٌ وَسَأَلْتُ عُرْوَةَ عَنْ ذَلِكَ فَقَالَ مِثْلَ قَوْلِ سُلَيْمَانَ بْنِ يَسَارٍ وَقَالَ عُرْوَةُ بَلَغَنَا أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «الْوَلَدُ لِلْفِرَاشِ وَلِلْعَاهِرِ الْحَجَرُ»
[Machine] "The son of a cursed person is like the son of adultery, inheriting from his mother and his mother's inheritors inherit from him."
«ابْنُ الْمُلَاعَنَةِ مِثْلُ وَلَدِ الزِّنَا تَرِثُهُ أُمُّهُ وَوَرَثَتُهُ وَرَثَةُ أُمِّهِ»
«لَا يُوَرَّثُ وَلَدُ الزِّنَا»
[Machine] "They inherit from their mothers, and if she gives birth to twins and dies, the sixth inherits."
«يَتَوَارَثُونَ مِنْ قِبَلِ الْأُمَّهَاتِ وَإِنْ وَلَدَتْ تَوْأَمًا فَمَاتَ وَرِثَ السُّدُسَ»
[Machine] "The child of adultery does not inherit, only the one who has not established paternity or who is owned by his mother through marriage or purchase inherits."
«لَا يَرِثُ وَلَدُ الزِّنَا إِنَّمَا يَرِثُ مَنْ لَمْ يُقَمْ عَلَى أَبِيهِ الْحَدُّ أَوْ تُمْلَكُ أُمُّهُ بِنِكَاحٍ أَوْ شِرَاءٍ»
[Machine] About Al-Hasan in regard to a man who divorces a woman and then marries her, he said, "There is no harm except if she is pregnant, as the child will not follow him."
عَنْ الْحَسَنِ فِي الرَّجُلِ يَفْجُرُ بِالْمَرْأَةِ ثُمَّ يَتَزَوَّجُهَا قَالَ «لَا بَأْسَ إِلَّا أَنْ تَكُونَ حُبْلَى فَإِنَّ الْوَلَدَ لَا يَلْحَقُهُ»
The Prophet ﷺ decided regarding one who was treated as a member of a family after the death of his father, to whom he was attributed when the heirs said he was one of them, that if he was the child of a slave-woman whom the father owned when he had intercourse with her, he was included among those who sought his inclusion, but received none of the inheritance which was previously divided; he, however, received his portion of the inheritance which had not already been divided; but if the father to whom he was attributed had disowned him, he was not joined to the heirs. If he was a child of a slave-woman whom the father did not possess or of a free woman with whom he had illicit intercourse, he was not joined to the heirs and did not inherit even if the one to whom he was attributed is the one who claimed paternity, since he was a child of fornication whether his mother was free or a slave. أن رَسُولَ اللَّهِ ﷺ «قَضَى أَنَّ كُلِّ مُسْتَلْحَقٍ اسْتُلْحِقَ بَعْدَ أَبِيهِ الَّذِي يُدْعَى لَهُ ادَّعَاهُ وَرَثَتُهُ بَعْدَهُ فَقَضَى إِنْ كَانَ مِنْ أَمَةٍ يَمْلِكُهَا يَوْمَ يَطَؤُهَا فَقَدْ لَحِقَ بِمَنِ اسْتَلْحَقَهُ وَلَيْسَ لَهُ فيمَّا قُسِمَ قَبْلَهُ مِنَ الْمِيرَاثِ شَيْءٌ وَمَا أَدْرَكَ مِنْ مِيرَاثٍ لَمْ يُقْسَمْ فَلَهُ نَصِيبُهُ وَلَا يَلْحَقُ إِذَا كَانَ الَّذِي يُدْعَى لَهُ أَنْكَرَهُ وَإِنْ كَانَ مِنْ أَمَةٍ لَا يَمْلِكُهَا أَوْ حُرَّةٍ عَاهَرَهَا فَإِنَّهُ لَا يَلْحَقُ وَلَا يَرِثُ وَإِنْ كَانَ الَّذِي يُدْعَى لَهُ هُوَ ادَّعَاهُ فهُوَ وَلَدُ زِنَا لِأَهْلِ أُمِّهِ مَنْ كَانُوا حُرَّةً أَوْ أَمَةً»
[Machine] "Do not buy it, do not eat its price, and do not use it."
«لَا تَبِعْهُ وَلَا تَأْكُلْ ثَمَنَهُ وَاسْتَخْدِمْهُ»
وَسَمِعْتُ مَالِكًا «يَقُولُ ذَلِكَ»
[Machine] Indeed, the Prophet ﷺ decreed that the inheritance of the cursed individual's son should all go to his mother due to the hardships she endured.
أَنَّ النَّبِيَّ ﷺ «قَضَى بِمِيرَاثِ ابْنِ الْمُلَاعَنَةِ لِأُمِّهِ كُلِّهِ لِمَا لَقِيَتْ فِيهِ مِنَ الْعَنَاءِ»
[Machine] "He said concerning the child of adultery to his mother's guardians: 'Take him, as you inherit him and understand him, and he will not inherit you.'"
أَنَّهُ قَالَ فِي وَلَدِ الزِّنَا لِأَوْلِيَاءِ أُمِّهِ «خُذُوهُ إْنَكُمْ تَرِثُونَهُ وَتَعْقِلُونَهُ وَلَا يَرِثُكُمْ»
21.46 [Machine] The Inheritance of the Wanderer
٢١۔٤٦ بَابُ: مِيرَاثِ السَّائِبَةِ
[Machine] Abdullah said: "The generous person puts his money wherever he wants." Abdullah bin Yazid said: Shu'ba said: "I have not heard this from Salamah except from me."
عَبْدُ اللَّهِ «السَّائِبَةُ يَضَعُ مَالَهُ حَيْثُ شَاءَ» قَالَ عَبْدُ اللَّهِ بْنُ يَزِيدَ قَالَ شُعْبَةُ «لَمْ يَسْمَعْ هَذَا مِنْ سَلَمَةَ أَحَدٌ غَيْرِي»
«كُلُّ عَتِيقٍ سَائِبَةٌ»
[Machine] The translation of the phrase "عُمَرُ «الصَّدَقَةُ وَالسَّائِبَةُ لِيَوْمِهِمَا أَوْ لِوَقْتِهِمَا»" from Arabic to English is: "The age/an entire lifetime of 'sadaqah' (charity) and 'sā'ibah' (letting loose animals for grazing) is for their day or their time."
عُمَرُ «الصَّدَقَةُ وَالسَّائِبَةُ لِيَوْمِهِمَا أَوْ لِوَقْتِهِمَا»
«لِلَّذِي أَعْتَقَهُ»
[Machine] "Mawlā died during the time of Uthman without having a heir, so he commanded for his wealth to be entered into the treasury."
«مَاتَ مَوْلًى عَلَى عَهْدِ عُثْمَانَ َلَيْسَ لَهُ وَالٍ فَأَمَرَ بِمَالِهِ فَأُدْخِلَ بَيْتَ الْمَالِ»
[Machine] About stolen property in a man who died and had no inheritor, he said, "His wealth is where he directed it. If he did not direct it, then it is in the treasury."
عَنْ مَسْرُوقٍ فِي رَجُلٍ مَاتَ وَلَمْ يَكُنْ لَهُ مَوْلَى عَتَاقَةٍ قَالَ «مَالُهُ حَيْثُ أَوْصَى بِهِ فَإِنْ لَمْ يَكُنْ أَوْصَى فَهُوَ فِي بَيْتِ الْمَالِ»
[Machine] Regarding the statement of Damarah and Rashid ibn Saad and others about the freed slave, they said, "Certainly, his loyalty belongs to the one who freed him. His separation is only from slavery, not from loyalty."
عَنْ ضَمْرَةَ وَرَاشِدِ بْنِ سَعْدٍ وَغَيْرِهِمَا قَالُوا فِيمَنْ أُعْتِقَ سَائِبَةً «إِنَّ وَلَاءَهُ لِمَنْ أَعْتَقَهُ إِنَّمَا سَيَّبَهُ مِنَ الرِّقِّ وَلَمْ يُسَيِّبْهُ مِنَ الْوَلَاءِ»
[Machine] Ibrahim and al-Sha'bi said, "There is no harm in selling abandoned goods and gifts."
عَنْ إِبْرَاهِيمَ وَالشَّعْبِيِّ قَالَا «لَا بَأْسَ بِبَيْعِ وَلَاءِ السَّائِبَةِ وَهِبَتِهِ»
[Machine] "A man emancipated a runaway boy and then came to Abdullah and said, 'I have emancipated a runaway boy for myself, and this is his belonging.' He said, 'It is yours.' He said, 'I have no need for it.' He said, 'Put it, as there are many inheritors here.'"
أَعْتَقَ رَجُلٌ غُلَامًا سَائِبَةً فَأَتَى عَبْدَ اللَّهِ وَقَالَ إِنِّي أَعْتَقْتُ غُلَامًا لِي سَائِبَةً وَهَذِهِ تَرِكَتُهُ قَالَ «هِيَ لَكَ» قَالَ لَا حَاجَةَ لِي فِيهَا قَالَ «فَضَعْهَا فَإِنَّ هَاهُنَا وَارِثًا كَثِيرًا»
21.47 [Machine] The inheritance of the boy
٢١۔٤٧ بَابُ: مِيرَاثِ الصَّبِيِّ
[Machine] "When a boy begins to talk, he inherits and is prayed for."
«إِذَا اسْتَهَلَّ الصَّبِيُّ وُرِّثَ وَصُلِّيَ عَلَيْهِ»
[Machine] "If a boy receives an inheritance and is inherited and prayers are offered for him."
«إِذَا اسْتَهَلَّ الصَّبِيُّ وَرِثَ وَوُرِثَ وَصُلِّيَ عَلَيْهِ»
[Machine] "There is no newborn except that it is slapped and cries at the time of Satan's influence, except for Jesus son of Mary, peace be upon him."
«لَيْسَ مِنْ مَوْلُودٍ إِلَّا اسْتَهَلَّ وَاسْتِهْلَالُهُ بِعَصْرِ الشَّيْطَانِ بَطْنَهُ فَيَصِيحُ إِلَّا عِيسَى ابْنَ مَرْيَمَ عَلَيْهِ السَّلَامُ»
[Machine] The Messenger of Allah ﷺ said, "A newborn does not inherit until he or she cries out and even if born alive."
قَالَ رَسُولُ اللَّهِ ﷺ «لَا يَرِثُ الْمَوْلُودُ حَتَّى يَسْتَهِلَّ صَارِخًا وَإِنْ وَقَعَ حَيًّا»
[Machine] "When a newborn baby arrives, pray for them and inherit (the good qualities)."
«إِذَا اسْتَهَلَّ الْمَوْلُودُ صُلِّيَ عَلَيْهِ وَوُرِثَ»
«أَرَى الْعُطَاسَ اسْتِهْلَالًا»
[Machine] The newborn is not inherited until they become capable, and no funeral prayer is performed for them until they become capable. Once they become capable, the funeral prayer is performed for them, they are inherited, and the dowry is fulfilled.
«لَا يُوَرَّثُ الْمَوْلُودُ حَتَّى يَسْتَهِلَّ وَلَا يُصَلَّى عَلَيْهِ حَتَّى يَسْتَهِلَّ فَإِذَا اسْتَهَلَّ صُلِّيَ عَلَيْهِ وَوُرِّثَ وَكُمِّلَتِ الدِّيَةُ»
[Machine] "He is not offered prayers and a newborn is not offered prayers until he starts crying."
«لَا يُصَلَّى عَلَيْهِ وَلَا يُصَلَّى عَلَى مَوْلُودٍ حَتَّى يَسْتَهِلَّ صَارِخًا»
21.48 [Machine] In the loyalty of the offices
٢١۔٤٨ بَابُ: فِي وَلَاءِ الْمُكَاتَبِ
[Machine] If one of the two desks bought the other, this one is from its master, and this one is from its master, so the sale is for the first (desk). The people of the town say loyalty is to the seller's master, and they say this purchase is only for the desks, so loyalty is to their master.
إِذَا ابْتَاعَ الْمُكَاتَبَانِ أَحَدُهُمَا الْآخَرَ هَذَا هَذَا مِنْ سَيِّدِهِ وَهَذَا هَذَا مِنْ سَيِّدِهِ فَالْبَيْعُ لِلْأَوَّلِ وَيَقُولُ أَهْلُ الْمَدِينَةِ الْوَلَاءُ لِسَيِّدِ الْبَائِعِ وَيَقُولُونَ إِنَّمَا ابْتَاعَ هَذَا مَا عَلَى الْمُكَاتَبِ فَالْوَلَاءُ لِلسَّيِّدِ
21.49 [Machine] In the summer, the servant gets married.
٢١۔٤٩ بَابُ: فِي الْحُرِّ يَتَزَوَّجُ الْأَمَةَ
[Machine] "Whichever free man marries a slave woman, he has half-freed himself, and whichever slave marries a free woman, he has half-freed himself." Abu Muhammad said, meaning the offspring.
«أَيُّمَا حُرٍّ تَزَوَّجَ أَمَةً فَقَدْ أَرَقَّ نِصْفَهُ وَأَيُّمَا عَبْدٍ يَتَزَوَّجُ حُرَّةً فَقَدْ أَعْتَقَ نِصْفَهُ» قَالَ أَبُو مُحَمَّد يَعْنِي الْوَلَدَ
21.50 [Machine] Inheritance of Loyalty.
٢١۔٥٠ بَابُ: مِيرَاثِ الْوَلَاءِ
[Machine] Regarding the commoner's situation when a man marries a woman and then divorces her, and they have a child together? He said, "If she is a free woman, the financial responsibility is upon her mother. And if she is a slave, meaning a young child, then it is upon his guardians."
عَنْ الشَّعْبِيِّ فِي الْعَبْدِ يَتَزَوَّجُ الْمَرْأَةَ ثُمَّ يُطَلِّقُهَا وَلَهُ مِنْهَا وَلَدٌ؟ قَالَ إِنْ كَانَتْ حُرَّةً فَالنَّفَقَةُ عَلَى أُمِّهِ وَإِنْ كَانَ عَبْدًا يَعْنِي الصَّبِيَّ فَعَلَى مَوَالِيهِ
[Machine] From Ibrahim, they both said, "His loyalty is to whoever begins with freeing a slave for the first time."
عَنْ إِبْرَاهِيمَ أَنَّهُمَا قَالَا «وَلَاؤُهُ لِمَنْ بَدَأَ بِالْعِتْقِ أَوَّلَ مَرَّةٍ»
21.51 [Machine] In the servant, there is a division between two men, one of whom is set free according to his share.
٢١۔٥١ بَابُ: فِي الْعَبْدِ يَكُونُ بَيْنَ رَجُلَيْنِ فَيَعْتِقُ أَحَدُهُمَا نَصِيبَهُ
[Machine] Ibrahim said, "If there is an obligation, it belongs to him, and if the servant seeks help, the obligation is between them."
عَنْ إِبْرَاهِيمَ أَنَّهُمَا قَالَا «إِنْ ضَمِنَ كَانَ الْوَلَاءُ لَهُ وَإِنْ اسْتَسْعَى الْعَبْدُ كَانَ الْوَلَاءُ بَيْنَهُمْ»
[Machine] About 'Amir, there was a slave between two men. One of them emancipated his share, so he said, "Complete his emancipation. If he does not have property, the slave should be sold for half of a fair price, and the right to manumit is for the one who emancipated him."
عَنْ عَامِرٍ فِي عَبْدٍ بَيْنَ رَجُلَيْنِ أَعْتَقَ أَحَدُهُمَا نَصِيبَهُ فَقَالَ «يُتَمَّمُ عِتْقُهُ فَإِنْ لَمْ يَكُنْ لَهُ مَالٌ اسْتُسْعِيَ الْعَبْدُ فِي النِّصْفِ بِقِيمَةِ عَدْلٍ وَالْوَلَاءُ لِمَنْ أَعْتَقَ»
[Machine] About his father, in a dispute between two men, one of them set free his portion and the other held onto it. He said, "His inheritance is between them."
عَنْ أَبِيهِ فِي عَبْدٍ بَيْنَ رَجُلَيْنِ أَعْتَقَ أَحَدَهُمَا نَصِيبَهُ وَأَمْسَكَهُ الْآخَرُ قَالَ «مِيرَاثُهُ بَيْنَهُمَا»
[Machine] And Qatadah said, "It belongs to the one who sets free, and its price is on him, and the people of Kufa say it."
وَقَالَ قَتَادَةُ «هُوَ لِلْمُعْتِقِ كُلُّهُ وَثَمَنُهُ عَلَيْهِ وَيَقُولُهُ أَهْلُ الْكُوفَةِ»
21.52 [Machine] What is the entitlement of women?
٢١۔٥٢ بَابُ: مَا لِلنِّسَاءِ مِنَ الْوَلَاءِ
[Machine] About a man named Ata, he dies and leaves behind belongings and sons and daughters. Will there be any allegiance for women? He said, "Women inherit from what he had written and allegiance belongs to men, not women, except what they have written or freed."
عَنْ عَطَاءٍ فِي الرَّجُلِ يَمُوتُ وَيَتْرُكُ مُكَاتَبًا وَلَهُ بَنُونَ وَبَنَاتٌ أَيَكُونُ لِلنِّسَاءِ مِنَ الْوَلَاءِ شَيْءٌ؟ قَالَ «تَرِثُ النِّسَاءُ مِمَّا عَلَى ظَهْرِهِ مِنْ مُكَاتَبَتِهِ وَيَكُونُ الْوَلَاءُ لِلرِّجَالِ دُونَ النِّسَاءِ إِلَّا مَا كَاتَبْنَ أَوْ أَعْتَقْنَ»
[Machine] "Women do not inherit from loyalty except what they have been set free from or what has been set free for those they have set free."
«لَا تَرِثُ النِّسَاءُ مِنَ الْوَلَاءِ إِلَّا مَا أَعْتَقْنَ أَوْ أَعْتَقَ مَنْ أَعْتَقْنَ»
[Machine] "A man died and left behind some property. Then, the properties were sold and he left some money. Ibn Al-Musayyib and Abu Salamah Ibn Abdul Rahman distributed what remained from his properties among the men and women of his relatives as their inheritance. And whatever money was left after his will, it belonged to the men of his relatives from the men of his family, excluding the women."
«تُوُفِّيَ رَجُلٌ وَتَرَكَ مُكَاتَبًا ثُمَّ مَاتَ الْمُكَاتَبُ وَتَرَكَ مَالًا فَجَعَلَ ابْنُ الْمُسَيَّبِ وَأَبُو سَلَمَةَ بْنُ عَبْدِ الرَّحْمَنِ مَا بَقِيَ مِنْ مُكَاتَبَتِهِ بَيْنَ بَنِي مَوْلَاهُ الرِّجَالُ وَالنِّسَاءُ عَلَى مِيرَاثِهِمْ وَمَا فَضَلَ مِنَ الْمَالِ بَعْدَ كِتَابَتِهِ فَلِلرِّجَالِ مِنْهُمْ مِنْ بَنِي مَوْلَاهُ دُونَ النِّسَاءِ»
[Machine] About Umar, Ali, and Zaid, they said: "The allegiance belongs to the elders, and they do not inherit women's allegiance except what they have emancipated or written."
عَنْ عُمَرَ وَعَلِيٍّ وَزَيْدٍ أَنَّهُمْ قَالُوا «الْوَلَاءُ لِلْكُبْرِ وَلَا يُوَرِّثُونَ النِّسَاءَ مِنَ الْوَلَاءِ إِلَّا مَا أَعْتَقْنَ أَوْ كَاتَبْنَ»
عَنْ أَبِي قِلَابَةَ
عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ
[Machine] On the authority of Sulaiman bin Yassar, they said: "Women do not inherit from their husbands except what they have been freed or written for."
عَنْ سُلَيْمَانَ بْنِ يَسَارٍ أَنَّهُمْ قَالُوا «لَا تَرِثُ النِّسَاءُ مِنَ الْوَلَاءِ إِلَّا مَا أَعْتَقْنَ أَوْ كَاتَبْنَ»
[Machine] Women do not inherit from loyalty except what they have freed or what has been freed by the one they freed, except for the cursed ones. Indeed, she inherits from the one who freed her son, from whom the father has been excluded.
«لَا تَرِثُ النِّسَاءُ مِنَ الْوَلَاءِ إِلَّا مَا أَعْتَقْنَ أَوْ أَعْتَقَ مَنْ أَعْتَقْنَ إِلَّا الْمُلَاعَنَةُ فَإِنَّهَا تَرِثُ مَنْ أَعْتَقَ ابْنُهَا الَّذِي انْتَفَى مِنْهُ أَبُوهُ»
