21.50 [Machine] Inheritance of Loyalty.

٢١۔٥٠ بَابُ: مِيرَاثِ الْوَلَاءِ

[Machine] Regarding the commoner's situation when a man marries a woman and then divorces her, and they have a child together? He said, "If she is a free woman, the financial responsibility is upon her mother. And if she is a slave, meaning a young child, then it is upon his guardians."  

الدارمي:٣١٧٨أَخْبَرَنَا أَحْمَدُ بْنُ عَبْدِ اللَّهِ حَدَّثَنَا أَبُو شِهَابٍ عَنْ الشَّيْبَانِيِّ

عَنْ الشَّعْبِيِّ فِي الْعَبْدِ يَتَزَوَّجُ الْمَرْأَةَ ثُمَّ يُطَلِّقُهَا وَلَهُ مِنْهَا وَلَدٌ؟ قَالَ إِنْ كَانَتْ حُرَّةً فَالنَّفَقَةُ عَلَى أُمِّهِ وَإِنْ كَانَ عَبْدًا يَعْنِي الصَّبِيَّ فَعَلَى مَوَالِيهِ

[Machine] From Ibrahim, they both said, "His loyalty is to whoever begins with freeing a slave for the first time."

عَنْ إِبْرَاهِيمَ أَنَّهُمَا قَالَا «وَلَاؤُهُ لِمَنْ بَدَأَ بِالْعِتْقِ أَوَّلَ مَرَّةٍ»
