21. Book of Inheritance
٢١۔ كِتَابُ الْفَرَائِضِ
«إِنَّ أَوَّلَ جَدٍّ وَرِثَ فِي الْإِسْلَامِ عُمَرُ»
[Machine] The first instance of inheritance in Islam was when Umar inherited his wealth. Ali and Zaid came to him and said, "That is not for you. You are just like one of the two brothers."
إِنَّ أَوَّلَ جَدٍّ وَرِثَ فِي الْإِسْلَامِ عُمَرُ فَأَخَذَ مَالَهُ فَأَتَاهُ عَلِيٌّ وَزَيْدٌ فَقَالَا «لَيْسَ لَكَ ذَاكَ إِنَّمَا أَنْتَ كَأَحَدِ الْأَخَوَيْنِ»
[Machine] Umar used to share with his brother and two siblings, and when they increased, he gave him one-third, and he gave him one-sixth with the child.
«كَانَ عُمَرُ يُقَاسِمُ بِالْجَدِّ مَعَ الْأَخِ وَالْأَخَوَيْنِ فَإِذَا زَادُوا أَعْطَاهُ الثُّلُثَ وَكَانَ يُعْطِيهِ مَعَ الْوَلَدِ السُّدُسَ»
[Machine] "I had seen an opinion in my grandfather, so if you see that you should follow it, then follow it." Uthman said to him, "If we follow your opinion, it is indeed guidance, and if we follow the opinion of the sheikh, then he is truly knowledgeable."
«إِنِّي كُنْتُ رَأَيْتُ فِي الْجَدِّ رَأْيًا فَإِنْ رَأَيْتُمْ أَنْ تَتَّبِعُوهُ فَاتَّبِعُوهُ» فَقَالَ لَهُ عُثْمَانُ إِنْ نَتَّبِعْ رَأْيَكَ فَإِنَّهُ رَشَدٌ وَإِنْ نَتَّبِعْ رَأْيَ الشَّيْخِ فَلَنِعْمَ ذُو الرَّأْيِ كَانَ
