21. Book of Inheritance
٢١۔ كِتَابُ الْفَرَائِضِ
[Machine] About a man named Ata, he dies and leaves behind belongings and sons and daughters. Will there be any allegiance for women? He said, "Women inherit from what he had written and allegiance belongs to men, not women, except what they have written or freed."
عَنْ عَطَاءٍ فِي الرَّجُلِ يَمُوتُ وَيَتْرُكُ مُكَاتَبًا وَلَهُ بَنُونَ وَبَنَاتٌ أَيَكُونُ لِلنِّسَاءِ مِنَ الْوَلَاءِ شَيْءٌ؟ قَالَ «تَرِثُ النِّسَاءُ مِمَّا عَلَى ظَهْرِهِ مِنْ مُكَاتَبَتِهِ وَيَكُونُ الْوَلَاءُ لِلرِّجَالِ دُونَ النِّسَاءِ إِلَّا مَا كَاتَبْنَ أَوْ أَعْتَقْنَ»
[Machine] "Women do not inherit from loyalty except what they have been set free from or what has been set free for those they have set free."
«لَا تَرِثُ النِّسَاءُ مِنَ الْوَلَاءِ إِلَّا مَا أَعْتَقْنَ أَوْ أَعْتَقَ مَنْ أَعْتَقْنَ»
[Machine] "A man died and left behind some property. Then, the properties were sold and he left some money. Ibn Al-Musayyib and Abu Salamah Ibn Abdul Rahman distributed what remained from his properties among the men and women of his relatives as their inheritance. And whatever money was left after his will, it belonged to the men of his relatives from the men of his family, excluding the women."
«تُوُفِّيَ رَجُلٌ وَتَرَكَ مُكَاتَبًا ثُمَّ مَاتَ الْمُكَاتَبُ وَتَرَكَ مَالًا فَجَعَلَ ابْنُ الْمُسَيَّبِ وَأَبُو سَلَمَةَ بْنُ عَبْدِ الرَّحْمَنِ مَا بَقِيَ مِنْ مُكَاتَبَتِهِ بَيْنَ بَنِي مَوْلَاهُ الرِّجَالُ وَالنِّسَاءُ عَلَى مِيرَاثِهِمْ وَمَا فَضَلَ مِنَ الْمَالِ بَعْدَ كِتَابَتِهِ فَلِلرِّجَالِ مِنْهُمْ مِنْ بَنِي مَوْلَاهُ دُونَ النِّسَاءِ»
[Machine] About Umar, Ali, and Zaid, they said: "The allegiance belongs to the elders, and they do not inherit women's allegiance except what they have emancipated or written."
عَنْ عُمَرَ وَعَلِيٍّ وَزَيْدٍ أَنَّهُمْ قَالُوا «الْوَلَاءُ لِلْكُبْرِ وَلَا يُوَرِّثُونَ النِّسَاءَ مِنَ الْوَلَاءِ إِلَّا مَا أَعْتَقْنَ أَوْ كَاتَبْنَ»
عَنْ أَبِي قِلَابَةَ
عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ
[Machine] On the authority of Sulaiman bin Yassar, they said: "Women do not inherit from their husbands except what they have been freed or written for."
عَنْ سُلَيْمَانَ بْنِ يَسَارٍ أَنَّهُمْ قَالُوا «لَا تَرِثُ النِّسَاءُ مِنَ الْوَلَاءِ إِلَّا مَا أَعْتَقْنَ أَوْ كَاتَبْنَ»
[Machine] Women do not inherit from loyalty except what they have freed or what has been freed by the one they freed, except for the cursed ones. Indeed, she inherits from the one who freed her son, from whom the father has been excluded.
«لَا تَرِثُ النِّسَاءُ مِنَ الْوَلَاءِ إِلَّا مَا أَعْتَقْنَ أَوْ أَعْتَقَ مَنْ أَعْتَقْنَ إِلَّا الْمُلَاعَنَةُ فَإِنَّهَا تَرِثُ مَنْ أَعْتَقَ ابْنُهَا الَّذِي انْتَفَى مِنْهُ أَبُوهُ»
[Machine] "It was inherited by the followers of Umar rather than the daughters of Umar."
«أَنَّهُ كَانَ يَرِثُ مَوَالِيَ عُمَرَ دُونَ بَنَاتِ عُمَرَ»
[Machine] "From Abu Qilabah regarding a woman who died and left behind her children, so they inherited her wealth and belongings. Then her children died. He said, 'The rights return to the family of the woman.'"
عَنْ أَبِي قِلَابَةَ فِي امْرَأَةٍ مَاتَتْ وَتَرَكَتْ بَنِيهَا فَوَرِثُوهَا مَالًا وَمَوَالِيَ ثُمَّ مَاتَ بَنُوهَا قَالَ «يَرْجِعُ الْوَلَاءُ إِلَى عَصَبَةِ الْمَرْأَةِ»
[Machine] About a man who wrote a slave, then died and left behind male and female children. He said, "The males should have more (rights) than the females."
عَنْ رَجُلٍ كَاتَبَ عَبْدًا لَهُ ثُمَّ مَاتَ وَتَرَكَ وَلَدًا رِجَالًا وَنِسَاءً قَالَ «لِلذُّكُورِ دُونَ الْإِنَاثِ»
[Machine] He used to say about a woman who died and left a slave: "The loyalty belongs to her children, so when they die, it will return to her family."
أَنَّهُ كَانَ يَقُولُ فِي امْرَأَةٍ مَاتَتْ وَتَرَكَتْ مَوْلًى قَالَ «الْوَلَاءُ لِبَنِيهَا فَإِذَا مَاتُوا رَجَعَ إِلَى عَصَبَتِهَا»
[Machine] "Women have no authority except what they themselves have freed in their own individuality."
«لَيْسَ لِلنِّسَاءِ مِنَ الْوَلَاءِ شَيْءٌ إِلَّا مَا أَعْتَقَتْ هِيَ فِي نَفْسِهَا»
[Machine] "Do Omar's daughters have any share from his inheritance?" He said, "I don't see anything for them, and if you want to give them something, you can give it to them."
هَلْ لِبَنَاتِ عُمَرَ مِنْ مِيرَاثِهِ شَيْءٌ؟ قَالَ «مَا أَرَى لَهُنَّ شَيْئًا وَإِنْ شِئْتَ أَنْ تُعْطِيَهُنَّ أَعْطَيْتَهُنَّ»
«يُحْرِزُ الْوَلَاءَ مَنْ يُحْرِزُ الْمِيرَاثَ»
[Machine] Uthman said, "Go, by the One in whose hand is the soul of whomever you wish." Abu Bakr then entrusted Abdul Rahman ibn Amr ibn Hazm.
لَهُ عُثْمَانُ «اذْهَبْ فَوَالِ مَنْ شِئْتَ» قَالَ أَبُو بَكْرٍ فَوَالَى عَبْدَ الرَّحْمَنِ بْنَ عَمْرِو بْنِ حَزْمٍ
